On-Country evidence

by First Nations people has been heard in the Torres Strait and in Cairns in the landmark Warratah Coal vs Youth Verdict case.

It was the first time in history the Queensland Land Court heard First Nations evidence on-Country and in accordance with First Nations protocols.

The court heard cultural evidence on the islands of Erub and Poruma.

They began by hearing evidence at the site where witness Kapua Gutchen’s ancestor’s grave was being eroded by sea level rises.

The next day the parties went out on Sea Country and visited the nearby islands being eroded by rising seas, including Merad.

On Merad some of the parties joined Kapua planting seagrass.

On the way back, the court inspected corals that have bleached.

On day three, Thursday, the court went to where Christianity first came to Zenadth Kes in 1871, known as the Coming of the Light, and the monument to this event which is now under threat from sea level rise.

On the final day, the Court travelled to Poruma with Florence

and Lala Gutchen where the court heard evidence of loss of culture and attempts to protect the island through sea walls.

On Tuesday last week Yidinji Traditional Owner Jiritju Fourmile performed a welcome to Country and smoking ceremony near sacred sites at Isabella Falls before sharing cultural evidence at locations around Gimuy/Cairns.

Youth Verdict co-director and First Nations lead Murrawah Johnson said the onCountry hearings were hugely important.

“This case is the first time that First Nations cultural rights are being considered in the context of climate change and the impacts that climate has on the human rights of Aboriginal and Torres Strait Islander people in Queensland,” she said.

“If we’re successful in the court, we hope that this coal mine isn’t able to go ahead that’s proposed in central Queensland in the Galilee Basin, and also that First Nations rights are going to be more considered in the context of the approval of new coal mines.”

EDO Managing Lawyer Sean Ryan said evidence in the case was concluded, with closing arguments due to be heard in June and July.

COVID mortality numbers jump Last Friday there were 3790 new COVID-19 cases recorded in Queensland.

Of Friday’s new cases, 63 cases were Aboriginal and Torres Strait Islander people.

There were 1429 active COVID-19 cases in Aboriginal and Torres Strait Islander people in Queensland – three weeks ago, on 20 May,

that number was 5000+.

In Queensland during the pandemic, 42 Aboriginal and Torres Strait Islander people have died of COVID-19 – three weeks ago that number was 13.

Reporting systems for the numbers provided here have recently changed, which is why the numbers have significantly altered.

Day tours to Torres Strait from Cairns launched

Last weekend a new tour that packs six Torres Strait experiences into one big day out from Cairns was launched from Gab Titui Cultural Centre.

A Strait Day was jointly founded by non-Indigenous Waiben resident John Palmer with Masig Islander Fraser Nai, who said the tour would provide a powerful platform to tell the story of his culture to a new audience.

He said it also presented economic opportunities for his community.

“Until now most travellers to the Torres Strait have arrived by cruise ships, stayed in unbranded accommodation, or driven the long red track to the tip of Queensland to meet the ferry to Torres Strait,” he said.

“For travellers short on time and big on curiosity, our tour makes the Torres Strait doable in a day – all from the comfort of a hotel in Cairns.

“This is the last frontier for tourism in Australia.

“It is the only part of Australia where you will see two Indigenous Peoples living on their own country.

“It’s full of unrivalled cultural experiences put together by really friendly locals.”

Tourism Tropical North Queensland Chief Executive Officer Mark Olsen said Strait Experience was one of the growing number of Indigenousowned tour options in Tropical North Queensland.

“Indigenous culture has been a part of the Tropical North Queensland tourism experience for more than three decades but the way it is presented has changed radically as more First Nations people become involved,” he said.

The six attractions and experiences include a scenic flight over the Torres Strait, a tour of Ngurapai (Horn Island) stopping at Horn Island Heritage Museum, a tour of Waiben (Thursday Island) with time to explore the Green Hill Fort, an Islander style banquet lunch and a stirring song and dance performance by notable artists.

Fraser said over the day local guides would share their stories and coordinate ground and ferry transfers to optimise time in region.

“We want to create a platform to lift people up ... and tell the Torres Strait story,” he said.

They said they were passionate about platforming small Torres Strait Island businesses in order to empower their community, stimulate economic growth, and create pathways.

A Strait Day will run on the first Saturday of every month with website bookings opening from July.

New Mayor sworn in Torres Shire Council’s newly elected Mayor Cr Yen Loban was officially sworn into office last week.

Cr Loban said it was a proud day.

“It has been such an emotional and proud day signing in as Mayor of Torres Shire Council,” he said.

“Thank you all my family and friends for your encouragement, confidence and support.

“Thank you to every single voter who participated in casting your vote for Mayor of the bi-election, whether voting for me or my peers, you all took your time and effort to show your concern and interest in local council, and I will dutifully respect and serve you all to the best of my abilities.”

The Declaration of Office Ceremony was held in the Torres Shire Council Chambers where family members and close friends were able to witness the proceedings.

As prescribed under Section 169 of the Local Government Act 2009, the Declaration of Office was conducted by virtue of the authority vested in the Council’s Chief Executive Officer Dalassa Yorkston. Father Tom Stephen officially blessed the newly elected Mayor.

Mayor Yen Loban said he looked forward to working with Council and serving our community.

Break and entry to school building Police are investigating a break and enter to an Aplin Road school between Friday, 3 June and Monday morning, 6 June.

Louvres outside one of the classrooms were damaged and a window was broken, and entry was gained to the room.

A number of food items, a speaker and a calculator were stolen.

On Friday, 27 May, Badhu Community welcomed Commissioner C’Zarke Maza of Meriba Omasker Kaziw Kazipa and his Cultural Support Officer Elsie Seriat.

It was the last session of their trip around Zenadth Kes, presenting community information sessions about the Meriba Omasker Kaziw Kazipa (Torres Strait Islander Traditional Child Rearing Practice) Act 2020.

Commissioner Maza and Elsie explained the application process for the legal recognition of Torres Strait Islander child rearing practice and answered questions in a group discussion.

They were also available for one-on-one conversations for those wanting privacy.

Community members raised a lot of questions about various scenarios that involved traditional child rearing practices, a sensitive Ailan customary practice throughout families of Zenadth Kes. “The application process is new and applications have been able to be made from

September, 2021,” Commissioner Maza said.

He said the granting of a Cultural Recognition Order enabled a new birth certificate to be issued and permanently transfered parentage of the child (or adult) to their cultural parents.

The legislation helped Torres Strait Islander families to remove any legal barriers and allowed the child’s cultural identity to reflect that of their legal identity and lived experience.

Commissioner Maza said he was aware the legislation was still very new and was happy to take on board any feedback that the community had about the current application process.

“The ideal start

to life for any child is to be nurtured in a loving family, and for generations, Torres Strait Islander children have been cared for in strong, loving families under traditional child-raising practice,” Mr Maza said.

Member for Cook Cynthia Lui said legal recognition of customary practices in the present enabled a new future where Aboriginal, Torres Strait Islander and non-Indigenous peoples walked together as equals.

“Milestones like Meriba Omasker Kaziw Kazipa and the Mabo decision are important markers of our progress as a nation,” Ms Lui said.

“I am so proud to have introduced the Meriba Omasker Kaziw

Kazipa legislation to Parliament, to bring together traditional lore and Queensland law.”

Court to hear case for early pensions The Federal Court will consider whether First Nations people in Australia are denied equal access to the age pension due to lower average life expectancy, and whether the pension age for Aboriginal & Torres Strait Islander people should be lowered later this year.

It will be the first time any Federal Government has faced court for their failure to close the gap in life expectancy between First Nations people and non-Indigenous people in Australia.

Wakka Wakka man, Dennis (who has chosen not to publish his surname) has brought the case with the Victorian Aboriginal Legal Service and the Human Rights Law Centre, with support from DLA Piper.

“As an Aboriginal man, I’ve seen too many of my people dying at a very early age,” Dennis said.

“White people are living longer because they haven’t lost what we have lost.

“So many things that Aboriginal people are suffering from today, are because of how we have been treated since colonisation.

“It’s only fair for the pension age to be lowered.

“The pension is an important part of caring for and looking after our people when they can’t

work anymore.

“But this isn’t just about money.

“Things will never get better unless we acknowledge something is wrong.

“Truth and accountability are important.

“This case is about telling the truth, and asking the government to work together with us, to give our people the same chance in life as everyone else.”

The Full Court will consider facts agreed between the parties, including that social, economic and health inequalities experienced

by Aboriginal & Torres Strait Islander people as a result of the ongoing impacts of colonisation directly contribute to the gap in life expectancy today.

The new Albanese government may take the initiative to address age pension inequality out of court by simple changes to the eligibility age for Aboriginal & Torres Strait Islander people.

Busy week for making brave Reconciliation Week changes

WORKSHOPPING: lots of activities on offer.

The Be Brave, Make Change theme to last week’s National Reconciliation Week rang true across the Torres Strait last week.

Most of our communities marked Referendum Day to Flag Day and through to Mabo Day with many holding activities in between – and Waiben was no exception.

On Tuesday last week Community hosted youth arts creative workshops in lino block printing with Joey Laifoo, t-shirt design with Sally Sloss and coconut leaves weaving with Nancy Nona in Anzac Park.

More than 70 young people were there to participate.

The day was supported by Torres Health who provided information workshop materials and refreshments.

Radio 4MW held two outside broadcasts over the week, both in front of the TSIMA building.

Guest Presenter Frank (Bungi) Cook and our TSIMA crew Sylvia Tabua and Jen Enosa with technical production and support from Luke Mosby and Anthony Geagea.

Their guests included John Abendego, author Wasie Tardent, several Queensland Police Service officers, Mabo Day Committee and event organiser Ella Kris, and performers Jack Bani and father Gabriel Bani.

Chelsea Watego’s ground-breaking book Another Day in the Colony was launched on Mabo Day on Waiben, just before the evening’s festivities.

A collection of deeply insightful and powerful essays, the book is a forensic examination of the racism faced by First Nations peoples in Australia on a daily basis.

Chelsea is a Munanjahli and South Sea Islander woman born and raised on Yuggera country.

She thanked editor Louise Moylan, Diat Alferink, Carol Thompson, Lisa Hayes and Pedro Stephen for their help and support.

“In my book there’s some ideas for young people to help them in their future life,” she said.

MP’s calendar pic search on again for 2023 Federal Leichhardt MP Warren Entsch is calling for photographs that capture our iconic places, people, events, flora and fauna for his twelfth annual Leichhardt Community Calendar Competition.

He said he regularly gets positive feedback about the calendar and always endeavours to include a wide range of places and subjects in its pages.

“This calendar is one of my favourite projects during the year,” Mr Entsch said.

“This is a fantastic opportunity for people to showcase their

photography skills to thousands of businesses in the Far North.

“The top 14 shots – one for each month plus a front and back cover – will feature in this year’s calendar along with the name of each photographer, as well as details of where each photo was taken.”

Respect and Eso to unsung Mabo hero Our new columnist Ella Kris will give voice to unsung women heroes, young and old, near and far. This week starts with the recognition of one of our Mabo day heroes.

This year we celebrated 30 years of the Mabo High Court decision. We acknowledged the five plaintiffs, and the many Meriam witnesses in the case and their families.

I want to offer a very special acknowledgement to a very special lady, not often spoken about.

This year she was remembered at major Mabo day events around the country. It was her mother’s cry for justice and healing that saw the case come to fruition.

On the 14th of August 1981, at a public meeting

at Tamwoy Town, Aunty Flo Kennedy called for this action.

On the 29 August 1981 Aunty Flo Kennedy, Reverend Dave Passi and Uncle Koiki Mabo met with Nonie Sharp, Professor Garth Nettheim, Dr Herbert (Nugget) Coombs, barrister Barbara Hocking, solicitor Greg McIntyre and Philip Mills at a land rights conference at James Cook University.

They discussed a legal case. At that meeting and during September 1981, Counsel – Ron Castan QC, Bryan Keon-Cohen, and Barbara Hocking (all

from Melbourne) were retained for the intending Meriam plaintiffs.

From there we saw Uncle Koiki Mabo and his co-plaintiffs put the concept into action.

Leitha Assan said, “I just returned home from an AIATSIS Summit and during a session where G re g M c I n t y re w a s sharing the journey, a PowerPoint slide came up with a beautiful photo of Flo Kennedy and Barbara Hocking. My heart felt a sudden burst of overwhelming admiration and love for Aunty Flo as I fondly remembered her

strength, humbleness and enormous integrity.”

To all the women behind the scenes who made this year’s Mabo Day celebrations and commemorations a success – here’s to you and your beautiful hearts with their burning design to be brave and make a change.

Remember - the conception of this movement came from a woman.

The High Court decision on 3 June 1992 forever changed the legal face of traditional land ownership for First Nations peoples, Australia’s new Indigenous Federal Minister for Indigenous Australians Linda Burney says.

“We have come a long way, as a nation, since Mabo, but we are painfully aware of how much further we still need to travel before we have true reconciliation,” she said.

“The hopes and dreams that Eddie Koiki Mabo’s victory unleashed will not be fulfilled until we have completely closed the gap between Aboriginal &

Torres Strait Islander peoples and the rest of our nation on health, education, opportunity, standard of living and life expectancy.”

Local MP Warren Entsch said there was no doubt Eddie Koiki Mabo was one of the most influential people in our nation’s history.

“It’s been 30 years since Eddie’s decade long fight led to the monumental decision in the High Court that overturned the legal concept of ‘terra nullius’ or land ‘belonging to no one’,” he said.

“Today, on Mabo Day, we celebrate his life and honour his legacy in securing land rights for all Aboriginal & Torres Strait Islanders.”

for Native Title said the Mabo legacy continued to inspire recognition of the rights, cultures and customs.

“Since Mabo, Torres Strait Islanders & Aboriginal peoples across Australia have made hundreds of successful Native Title claims to the land and sea our ancestors have long been custodians of,” he said.

“Native Title allows us – as Traditional Owners – to protect our culture and heritage.

“We have the power to make decisions about land and sea use.

“Soon, in the spirit of reconciliation and selfdetermination, the region’s Native Title responsibilities will transfer from government to Gur A Baradharaw Kod Torres Strait Sea and Land Council (GBK) on 1 July, 2022.

“Native Title also provides an economic base for our people and Native Title groups.

“On my community at Badu, we have established thriving businesses that generate wealth and jobs for the Badulgal people.”

Celebrations across the Torres Strait were mirrored across the nation, starting with Mer - pictured below and facing – who began with a community breakfast and the paying of respects at the gravesites of each of the five plaintiffs, and witness Henry Kabere, in the 1992 High Court challenge.

A procession of tribal groups followed, before a flag-raising ceremony, speeches and a presentation by the Women of Mabo before the feasting and dancing began.

Working in collaboration with Tagai Badu Campus, it was all about the children, the passing on

of cultural knowledge and educating the significance of our celebrations.

An amazing job by the Badhu Events Committee who wanted to extend a warm thank you to TSRA, TSIRC, Mura Badulgal (TSI) Corporation RNTBC, Meriba Ged Ngalpun Mab, GBK, and the many other sponsors and volunteers who made the day possible.

The day was enjoyed by all with positive feedback all round.

From 1 July 2022, Gur A Baradharaw Kod Torres Strait Sea and Land Council (GBK) will deliver Native Title services in the Torres Strait region.

The TSRA will cease its Native Title services on 30 June 2022.

The TSRA, GBK, and National Indigenous Australians Agency (NIAA) are working closely together to ensure a smooth transition.

BY ALF WILSON About 500 people marched through the Townsville CBD last Friday, just one part of five days of celebrations in Townsville from 1 to 5 June.

The men, women and some children gathered at Perfume Gardens in the city before they walked 200m across Victoria Bridge to Central Park where the Eddie Koiki Mabo monument was located.

Torres Strait Islander & Aboriginal Community Elders of Townsville had agreed local celebrations were to particularly include youth, to help encourage them to take on and continue the challenge of tackling the unfinished business of reconciliation.

The elders wanted to give them a voice as the future custodians of their traditional country, to maintain their heritage, story lines, rights and practices.

especially First Nations Peoples, across Brisbane and Ipswich.

At the church there was a Welcome to Country and a service of commemoration, followed by refreshments and Torres Strait Islander singing and dancing.

Words & Pics by Bel Lui Everything turned out well at the 30th anniversary celebrations hosted by a special committee made up from the local Torres Strait Islander cultural organisations in Cairns.

Committee member Patricia Ansey/Passi said she was very happy.

The day began with a march from the Scott Street entrance of the Cairns showground to the Fred Moule Pavilion for flag raising ceremony and celebration.

Special shirts were designed to represent each of the eight tribes of Murray Island, colourfully depicting their totems. Meriam Cultural flags were raised to half-mast in respect to the Torres Strait Islander families in mourning.

Guests included Gail Mabo, MPs Warren Entsch and Michael Healy, and a representative from MP Bob Katter’s office.

Many thanks were offered to local Indigenous elders who contributed to the day, which ended with a great night of feast and entertainments.

Tagai State College students, with Our Lady of Sacred Heart, lead their own celebrations and entertainment on Mabo Day after a successful march on Waiben last Friday.

TI Primary’s language and culture teacher Richard Matthew said the students made their school, community and families very proud.

MEANWHILE Kadhego Ngurpay Lag community and students on Saibai Island enjoyed a community event organised by volunteers, Elders, PBC, TSRA Rangers, TSIRC and Tagai State College – Saibai Island.

Students and the school community joined together in a march from the School down to the water front, singing and cheering as they made their way through the town.

They finished at Bloomfield, where everyone came together for an official ceremony and entertainment by the children.

Speakers included a welcome Prayer by Pastor Rodney Menegi, a welcome to country

by Councillor Conwell Tabuai, some sharing of some important words on the significance of Mabo Day by Mr. Kaltie Tabuai while MC was Marcus Warusam.

During Term 2 students have learned significant dances as part of the Tagai State College Language Unit.

Four boys from Thursday Island were selected to participate in 2022 IMF National Deadly Fun Run Championship in Mackay last weekend.

The program started on Saturday with a community relay.

On Sunday they each did five kilometres each in the Mackay Marina Run. “Their selection was purely based on, consistency, commitment, passion and

dedication,” volunteer coach and former-IMF graduate Harold Matthew said.

“This was shown by all four well-deserved participants, who were Harold Matthew, Kiwat Abednego, Michael Zitha and Ngukis Mosby.

Cowboys hold their line before Origin

BY ALF WILSON The Hammer nailed two tries when the Cowboys scored a 32-6 win over the Gold Coast Titans in the NRL split round 13 at Cbus Stadium last Thursday.

Hamiso Tabuai-Fidow, aka The Hammer, was picked to be 21st man and reserve for the Queensland State of Origin side but was allowed

by Queensland authorities to take his place in the Cowboys team.

The Cowboys were missing four stars on Origin duty including Reuben Cotter.

That didn’t stop them from winning their ninth game of the season, to end up sitting third on the 16-club table.

The Queensland players were at the grounds watching the Cowboys thrash the Titans in a Queensland Derby.

Each time the Hammer scored he was cheered for by Cotter, which was shown on live television.

Just before halftime in the 35th minute Tabuai-Fidow pounced on a ball to score the

Last year’s runners up Mulga scored seven tries to five in an entertaining match.

Gold Stars win cliffhanger final

In the Gold Stars line up was fullback Jasmine Peters, centre Hagiga Mosby,

halfback Tahlulah Tillett, second row forward Sareka Mooka and interchange players Theophelia Mosby-Nona and Samara Luta.

Waiben-born Hagiga and Theophelia, Brisbane-born Jasmine, Cairns-born Tahlulah and Sareka, and Townsville-born Samara all contributed to the win.

Gold Stars scored three tries to two and

led 10-6 at half time against minor premiers the Capras in the big dance.

It wasn’t until 69 minutes and 40 seconds for the Gold Stars to seal the victory at Moreton Daily Stadium, Redcliffe.

Gold Stars try scorers were Alicia Martin (4th minute), Jasmine Peters (10th) and Shaniah Power (69th). Romy Teitzel kicked the goal.

At the end of the qualifying fixture rounds in the competition, the Gold Stars finished third and defeated Wynnum Manly 32-14 in their semi final.

The premiership will go a long way towards the Gold Stars gaining entry into the NRL women’s competition with a decision due soon.
