Evidence in the groundbreaking case of Traditional Owners versus a central Queensland mining proposal has been heard on Erub and Poruma this week.

It was the fourth week of the Waratah Coal Pty Ltd v Youth Verdict Ltd & Ors trial, heard by the Queensland Land Court.

In a legal first, the Court has travelled to the Torres Straits to hear cultural evidence about climate change impacts with site visits.

Represented by the Environmental Defenders Office (EDO), Youth Verdict and The Bimblebox Alliance are arguing coal from Waratah’s proposed Galilee Coal Project will impact the human rights of First Nations Peoples by contributing to dangerous climate change.

They are also arguing the mine would destroy the Bimblebox Nature Refuge which sits on top of the proposed mine site.

It is the first time a coal mine has been challenged on First Nations’ cultural and human rights grounds in Australia.

Witnesses Kapua and Florence Gutchen have been supported this week by Youth Verdict member Aminata Morseu-Diop.

Environmental Defenders Office Senior Solicitor Alison Rose said it was her third visit to Erub and Poruma, this time with the Queensland Land Court itself.

“This is the first time the Land Court has ever been on country and heard evidence about climate impacts, which is really interesting and exciting,” she said.

“We had a really significant decision about that about a month ago where the Land Court decided that it was really important to go.

“And this evidence is being heard under the Human Rights Act as well, in particular, under Section 28, which is the right to culture.

“So, a lot of firsts in this case.”

She said Erub was prepared.

“The community has spent a lot of time preparing for the Court’s arrival, and making sure that everything’s in order so that the evidence can be heard,” she said.

STORY AND PIC BY CHRISTINE HOWES “The court will be going out on boats to hear seawater evidence as well from some sea country evidence, and that’s a very novel thing in itself.

“There’s a lot of impacts that are happening on sea country around Erub to fish traps, also to Mer, which is an island where turtles go to nest and baby turtles hatch.

“And they’re seeing some fairly significant impacts on turtle populations, so good for the Land Court to see that, and see the climate change impacts where they’re actually happening from First Nations people.”

Speaking in Cairns on Monday, Mamu Waribarra Youth Verdict member Serena Thompson said there were several historical precedents set by the case.

“The biggest historical event in this case thus far is the on-country evidence,” she said.

“But also that our argument is that the introduction of a new mine would essentially contribute explicitly to climate change and the effect of climate change on First Nations country, communities and people, and inherently our right to access culture, to practise, access country, practise culture, and be sovereign beings.

“So that’s also a very significant point to be made and definitely something that’s worth fighting for and something I think is well overdue in terms of climate justice and justice for First Nations communities.

“It is all about giving back the power where it’s supposed to sit, which is with us as sovereign people.”

She said climate change was an immediate issue for First Nations people.

“I feel like the further we get along in life, I think the more immediate climate change is becoming an issue for us as First Nations people,” she said.

“And I just really want to be able to do something, I want to do something for me, for my family, for my community and for other First Nations people.”

Late May Day celebration a great feast

The evening featured the Island Stars dance team and an awards ceremony.

Awarded for their work during the COVID pandemic were members of the Nurses Union, represented

by Cairns-based organiser David Beckham.

Also recognised was our Blue Care Aged Care workers, fresh from their

five-hour walk-off earlier that week, for their commitment and dedication.

Speakers included Together Union delegate Maria Passi, United Workers Union Cairns Regional Organiser Heath Mitchell, United Workers Union Aged Care Delegate Conwell Kris and others.

“This is about our tenth year of organising Labour Day celebrations here on Thursday Island,” Heath said.

“It was a great night, and the traditional island feast was fantastic.”

Coral bleaching worst ever

A summer of above average temperatures triggering a ‘marine heatwave’ has caused mass coral bleaching on the Great Barrier Reef, an annual ‘Reef Snapshot’ report has revealed.

The report was a joint initiative of the Australian government’s lead management and science agencies for the Great Barrier Reef - the Great Barrier Reef

Marine Park Authority, the Australian Institute of Marine Science and CSIRO. The Reef Snapshot includes extensive aerial observations, showing widespread bleaching that has affected the northern, central and southern regions of the Reef.

Climate Council Director of Research Dr Simon Bradshaw said the report confirmed the reef was in serious trouble.

“The Reef’s very survival, and all the jobs and industries that depend on it, requires a major step up on climate action now and during this next term of Government, starting with a credible plan to rapidly reduce Australia’s greenhouse gas emissions,” he said.

“Not 30 years from now, this decade.”

He said leadership was needed.

At least one billion dollars is needed over the next ten years to address housing shortages across the Torres Strait, Cape

York and Gulf of Carpentaria, the Torres Cape Indigenous Council Alliance (TCICA) says.

The group called on

both sides of politics, state and federal, to be honest about their commitment to fixing the dire state of housing in remote Indigenous

communities under the National Agreement on Closing the Gap. They said a new long-term agreement to support the delivery of

Big thanks to local animal support group volunteers This week was national volunteer week and the Thursday Island Animal Support Group (TIASG), which runs entirely on volunteers, said they wouldn’t exist without them.

President Sonia Einersen said people were surprised to hear there were no paid staff.

All our hard work is undertaken by our wonderful volunteers giving up their own time,” she said.

“TIASG wouldn’t exist without these wonderful humans and we are always looking for new volunteers.

“We have a variety of opportunities available.

“For animal lovers we always need foster carers, dog walkers and cage cleaners, but we also need volunteers that can write grant applications, assess adoption enquires, create social media content, fundraise, bake and much more.

“There is something for everyone.

“We have volunteers as young as seven who teach children about the importance of giving back to the community.”

Sam McCarry and her family has been volunteering with the group since its inception in March last year.

“It is great to know we are helping give animals a second chance” Sam said.

“Watching the animals change and know they are safe and loved is so fulfilling.

“My kids also learn about the responsibility that comes with owning a pet.”

The theme for National Volunteer Week 2022 was Better Together.

“Both major parties have been silent on new Indigenous housing in remote communities, ignoring the fact that our people are facing entirely preventable diseases like rheumatic heart disease because of severe overcrowding.”

Lockhart River Mayor Wayne Butcher said they had seen “zero long-term commitment”.

“No new housing,” he said.

“There are complex issues involved, but all we are asking for is a matter

of basic human rights.

“To all those rural communities and regional cities now experiencing severe housing shortages and overcrowding – this is what we have been facing for decades.

“But we have no choice about needing government investment in housing because we rarely even have the power or means to own land in our own communities; nearly all housing is social housing.”

Laptops ready to be put to good use

Computers are often in short supply and are critical to high schools these days, so a donation of 60 repurposed laptops to support senior students at Waybeni Koey Ngurapay Mudh was received with enthusiasm last week.

The donation was the result of a joint initiative between Origin Energy, the Origin Energy Foundation and DXC Technology.

Waybeni Koey Ngurapay Mudh Student Services Head of Department Matilda Loban said access to technology was a challenge.

“We would love to accept repurposed laptops, as technology is a big issue in our school, and it would be such a blessing to be able to provide our senior students with access to these devices,” Mrs Loban said.

The Origin Energy Foundation is a

philanthropic foundation established by Origin in 2010 focused on education, in particular STEM education, as a pathway to a brighter future.

As Origin’s major IT service provider, DXC is aligned with Origin’s commitment to support First Nations peoples and businesses.

As part of its First Nations Program, DXC has coordinated the refurbishment and repurposing of these laptops, no longer in use at Origin.

Each organisation has donated 30 laptops.

Origin Energy Foundation’s Ruth Lee said there were many benefits.

“Together with DXC, we are so pleased to provide these students with laptops – to support their educational journey, increase their access to technology and help improve their computer literacy,” she said.

Motorists caught speeding Call for better telecommunication On Tuesday 17 May officers caught several drivers speeding in the Douglas Street school zone.

Police would like to remind Thursday Island motorists to slow down and pay attention to the speed limits around schools after multiple motorists

were detected speeding.

Around 8.30am officers stopped a 26-year-old man when he was allegedly detected travelling at 48km/h in a 40km/h zone.

A 43-year-old man was intercepted at 8.32am as he was

allegedly travelling at 49km in a 40km/h zone.

A 23-year-old woman was intercepted at 8.18am allegedly travelling at 47km/h in a 40km/h zone.

Each of the three motorists was issued with a $183 traffic infringement notice.

Economic developments opportunities for Torres Strait and NPA residents would be greatly enhanced by better digital communication infrastructure, Katter’s Australian Party (KAP) candidate for Leichhardt Rod Jensen says.

He echoed calls from leaders and residents for “digital bridges” between the islands.

“Everything is online nowadays and we have the technology to connect even the most remote parts of the country but lack the urgency from government to prioritise high speed access in the far north,” he said.

“This is something I’ve been hearing about across the Cape region as well.

“There’s no reason people in the Torres Strait should be cut off from the benefits of fast internet and mobile services, as more and more services such as health and education are being delivered online, but need latest

generation tech to be effective.

“The poor state of the digital infrastructure, which in some cases is many generations old, reinforces the social exclusion that many people in remote places already feel, and I am on a mission to see that this message is carried forward.”

Mr Jensen arrived on Thursday Island on Tuesday evening to spend the week hearing about local issues.

“I am loving the opportunity the get to know a part of the world very few people visit let alone work for, and meeting with the residents and feeling their love of their home is a strong reminder of why I am running for this job in the first place,” he said.

He said he was also hearing a need for upgraded marine and housing infrastructure and more opportunities for economic development.

“The Torres Strait Regional Council’s call for marine upgrades chimes really well with

the KAP’s miniports policy proposal,” he said.

“A core priority for communities in the nation’s north is reliable transport infrastructure, and for the residents of the 15 divisions that make up the regional council, not having the ability to travel between the islands comprises the health, safety and standard of living of many residents, who rely on marine access to for health care, education, and just to do a basic grocery run.”

Mr Jensen said he supported the communities’ call for equitable access and would work hard on behalf of the leaders to see their calls were heard.

He said alternative methods of travel between communities and the mainland, such as by air, were largely unaffordable.

“Some of the access points are badly deteriorated, as you would expect given the conditions and the pounding the infrastructure receives

from the elements,” he said.

Mr Jensen said advocating for better housing options in Torres Strait was also a priority.

“A new establishment is upwards of $800,000 I am hearing, and an almost impossible ask for a local government to come up with that kind of money,” he said.

“More variety in the types of housing available to suit the different needs of tenants is an absolute must, as are different types of shelter to cater to residents who are couch surfing or in need or more permanent accommodation.”

Mr Jensen said he would support a renovation program aimed at upgrading existing accommodation as well removing asbestos, which made some housing unliveable and reduced the overall stock of housing in the communities.

“The challenges in the Torres Strait are very real, but together we can all make a difference,” he said.

Vaccination still best to protect from COVID-19 On Friday 6 May, there were 6,555 new COVID-19 cases recorded in Queensland.

Of Friday’s new cases, 111 cases were Aboriginal & Torres Strait Islander people and there were 5,761 active COVID-19 cases in Aboriginal & Torres Strait Islander people in Queensland.

Telstra art comp finalists announced Three out of six Queenslanders, out of 65 national finalists for the 2022 Telstra National Aboriginal & Torres Strait Islander Art Awards (Telstra NATSIAA) are Torres Strait Islanders.

Telstra NATSIAA is Australia’s longest running and most prestigious Aboriginal & Torres Strait Islander art award and has the country’s richest art prize pool and growing significantly since its genesis in 1984.

Each year, the Awards Ceremony and Exhibition celebrates emerging and distinguished artistic talent from around Australia.

Award partner, the Museum and Art Gallery of the Northern Territory (MAGNT) Director Marcus Schutenko congratulated the finalists.

“Such strength was

found in this year’s artworks despite the multifaceted impact of COVID on artists and their communities,” he said.

“We are stirred by such ambitious and deeply moving works from Aboriginal and Torres Strait Islander artists from across Australia.”

Telstra CEO Andy Penn said an increase in prize money this year made it the richest art prize pool in Australia.

“I hope this will encourage more emerging and established artists to share their stories,” he said.

“Each year the quality and scope of the work is exceptional, and I expect 2022 to be no different.

“I congratulate the finalists and again look forward to seeing the exhibition in August.”

The Our Islands, Our Home climate action campaign featured at the closing showcase of Afterpay Australian Fashion Week last Friday, as part of a collaboration with Grace Lillian Lee’s First Nations Fashion and Design.

The historic finale presented seven collaborations

between emerging First Nations designers and established Australian designers.

Each design duo’s couture garment was created in response to the Our Islands Our Home campaign.

This collection included yarns about sovereignty, respecting Country, meaningfully acknowledging Traditional Custodians

and the diversity of communities.

Impactful statements such as ‘Tread Lightly’, ‘Honouring Country’ and ‘Sovereign Land’ feature alongside a map outlining the language groups and other symbols.

travelled from Masig to Gadigal Land to perform in the show.

“We’re here to tell this story and we want our story to be heard and to be echoed throughout this country and through the waters, to the end of the earth, they’re our ancient race of people,” Yessie said.

“The salt water people of the Torres Strait need your help

to fight against climate change.”

The show included a historical performance of ‘My Island Home’ from Christine Anu with her daughter Zipporah.

The collaboration put a national and international spotlight on the campaign led by Torres Strait Islanders to protect their island homes from the climate crisis.

Weres – Meta – Zenadth Kes art work inspired by Reconciliation Week theme Weres - Meta - Zenadth Kes is a community art project based at the Gab Titui Cultural Centre that will bring unprecedented numbers of community members and visitors together on a regular basis to share a profound experience.

The installation, which will premiere on Friday 27 May, is part of the public program for the landmark 30th anniversary of the Mabo High Court Decision and Torres Strait Islander Flag Day. It aligns with this year’s National Reconciliation Week theme: Be Brave. Make Change.

Dare to Dream confirmed for week leading into Festival JUTE Theatre Company’s ‘Dare to Dream’ program will be in Bamaga in the week leading up to this year’s NPA Cultural Festival in June.

Dare to Dream is a creative touring program with an all-Indigenous cast and crew working with school students

over an intensive four days, culminating in a showcase performance on the Thursday and a public performance on the Friday of the festival.

Festival Coordinator Dev Lengiel said their timing couldn’t be better.

“Their current Dare to Dream program “Back on Track” is all about

road safety,” he said.

Taipans keep Pinder / Kuol

Lee signs to Dolphins

The CQUniversity Cairns Taipans have announced the club has retained league award winners – NBL’s Most Improved Player Keanu Pinder and Rookie of the Year Bul Kuol – will take their options for a second season in orange.

Head Coach Adam Forde recruited both talents for his first year at the helm of the Taipans, recognising their untapped potential – and that foresight has paid off for both players and the club.

Pinder was named Most Improved Player thanks to a breakout campaign under Forde – his former WA U20 Nationals, State Basketball League and juniors coach.

Their reunion in Cairns saw Pinder improve from 4.8 points and 4.3 rebounds per game to 10.8 points and 7.5 rebounds and take out the highly coveted award.

Kuol became the first rookie in NBL history to ever finish inside the Top 5 for three-point makes in a year, earning the Rookie of the Year accolade with a landslide 72 votes – the biggest winning margin of any other NBL award this season.

Last weekend he scored a try for the Newcastle Knights in their 16-6 win over the Sydney Bulldogs.

Lee has scored 60 tries in 121 first grade games for the Canberra Raiders, Cronulla and Newcastle, as well as making one appearance for the Queensland Maroons.

He was coached by Bennett in the successful 2020 State of Origin series and is a very popular member of the Knights’ playing group.

THE Remote Area Rugby League carnival, contested between teams picked from the Torres Strait, Cape York and the Gulf of Carpentaria, won’t be held this season.

The games are usually held in Cairns during June, after which a Northern United representative side is picked to meet Queensland Outback.

The United versus Outback match will go ahead under a different selection process.

The new game will also feature a women’s game between United and Outback, and is due to be held in Roma on 24 July during the QRL Queensland Country Week.

The main game will be the Hostplus Queensland Cup game between Burleigh Bears and Norths Devils on the outback town’s Arthur Beetson Oval.

“The RARL Challenge won’t be on this year, players will be selected from local competitions and Selection ID/Clinics around the Cape,

Gulf and Torres,” a spokesperson for the competition said.

“Officials have sent our NQ United Registration forms to local competitions asking for any

interested men and women in their club or community who wish to nominate for selection.”

Participants will need to be away from home from July 21 to July 26.

Blackhawks miss out on home ground advantage

BY ALF WILSON Townsville Blackhawks did not take advantage of their home ground advantage in Saturday’s round eight of the Hostplus Queensland Cup going down 42-20 to the PNG Hunters.

PNG launches new NRL bid

BY ALF WILSON The Papua New Guinea (PNG) government, along with local governing body PNG Rugby Football League (PNGRFL) and the country’s Sports Foundation, officially launched a campaign to enter an NRL team in 2030 at an event in Port Moresby earlier this month.

They said they were working towards being able to “demonstrate strong credentials as a prospective participant by 2025”.

The bid will “celebrate and showcase PNG’s passion for the game, sporting talent and events hosting capability”.

The bid has been backed by PNG’s Prime Minister and its cabinet.

“Sport is part of the fabric of Papua New Guinea,” PNG Minister assisting the Prime Minister on Sports and National Gaming Wesley Raminai said.

“Our PNG NRL bid team is ready.

“The time to start the journey is now.

“We can’t wait any longer.”

PNG is the only country in the world where rugby league is the national sport.

Cairns-based, respected rugby league identity David Westley said Torres Strait Islander players would be on the radar for a PNG side.

Now aged 47, Westley was a key member of the Torres/ Cape side, which in 2009 reached the grand final of the prestigious Foley Shield in Townsville (they lost 32-22 to Innisfail Eacham).

He was also the QRL Cape York and Torres Strait Development Officer in 2009 and 2010, based in Weipa.

Born in Rabaul, on the far northern eastern tip of New Britain, Papua New Guinea, Westley moved to Cairns as a nine-year-old boy.

He represented PNG four times, including at the 1995 World Cup, and played 143 matches in the ARL before it was the NRL. He was a member of the Canberra Raiders 1994 premiership team.

Westley lives in Cairns and is a coach of the Northern Pride under 21 team.

“I think that PNG would want some players from the Torres Strait, NPA and Cape York as the regions are close to their country,” he said.

“A lot of Papua New Guinea, Torres Strait and Aboriginal people are connected through marriage.”

Westley said PNG would have to also recruit players from other NRL clubs to complement their footballers who compete for the PNG Hunters in the Statewide comp.
