THE Department of Foreign Affairs (DFA) summoned Beijing’s envoy Monday to protest the use of water cannons and dangerous maneuvers against Philippine vessels in the West Philippine Sea, President Ferdinand Marcos Jr. said.

‘Reclamation to cause 8-meter floods’

SENATOR Cynthia Villar yesterday warned that a six- to eight-meter flood in Las Piñas City and other nearby areas could likely happen if the ongoing reclamation in Manila Bay reaches her hometown.

Villar, the chairperson of the Senate Committee on the Environment and natural resources, has been strongly objecting to any reclamation project at Manila Bay.

“I’m taking them [to the Supreme Court]. If they don’t revise [their plan], we have no choice. Will I allow my hometown to be submerged in a six-foot flood?” she said.

“If they continue with the reclamation in our part of Manila Bay, there will be no outlet for our four rivers. It was predicted there will be six to eight meters of flooding. Six meters is [equivalent to a] three-story building,” Villar added.

She said she already raised her concern with President Ferdinand Marcos Jr. and Environment Secretary Maria Antonia Yulo-Loyzaga.

“I told them we are a legislated protected area. We are entitled to a buffer

zone of three kilometers provided for by the DENR,” she said. The Las Pinas-Parañaque Wetland Park is a protected area recognized as a Wetland of International Importance during the Unesco Ramsar Convention.

According to the senator, her committee will conduct a public hearing on the ongoing reclamation project. She said she agrees with the observation of Justice Secretary Crispin Remulla that the awarding of the contracts for the reclamation project was rushed.

LOW-INCOME customers of the Manila Electric Co. (Meralco) have begun getting lower electricity rates with the implementation of Meralco’s new lifeline rate program.

Meralco vice president and head of utility economics Lawrence Fernandez said that under the program, discounts to lifeline rates or marginalized customers are subsidized by regular customers.

Similarly, the export ban imposed last July 20 by India--the world’s largest rice exporter---is expected to cause ripples in global rice prices that would affect millions of consumers, particularly in Africa and Asia.

Shipping group lauds move to resolve container issues

THE Association of International Shipping Lines (AISL) lauded the Department of Transportation’s (DOTr) approach to resolving the industry’s container deposit concerns.

“We can only commend the creativity of the Transportation Secretary for a coming up with a set of viable options which shipping lines can choose from in order to solve the container deposit problem which, for years, has been a source of irritants between the importing community and international shipping lines,” the AISL, in a statement said.

The group further said the solution being proposed by the DOTr Secretary “is consistent with the provisions of

House Bill No. 04933 which is under deliberation by the House Committee on Transportation.”

“DOTr’s pragmatic approach to the container deposit problem is a welcome departure from the solution offered by the PPA’s TOP-CRMS,” the group said.

In a letter dated July 12, DOTr Secretary Jaime Bautista presented three alternative options for shipping lines to consider, providing them with the freedom to choose the most suitable solution:

(a) Discontinue the container deposit practice; (b) Continue to collect container deposits contingent upon the availability to refund within 14 days, or

(c) Subscribe to container deposit

from Container Ledger Account (CLA) or other providers that offer equivalent services.

Shipping lines have the option to voluntarily cease the practice of requiring container deposits, continue collecting container deposit with prompt refunds, or avail of Container Ledger Account (CLA) services or explore other providers offering equivalent services, according to Ronas.

“Unlike TOP-CRMS, the DOTr’s democratic solutions provide shipping lines a latitude in determining, and choosing, the most appropriate resolution to the container deposit issue, ensuring a fair and competitive environment within the shipping industry,” Ronas said.

BARMM governors meet in Davao with Ibrahim in 1st Leaders Council

THE BARMM Governors’ Caucus (BGC) on Monday welcomed the convening for the first time of the autonomous region’s Council of Leaders by Interim Chief Minister Ahod Balawag Ibrahim.

Members of the Council of Leaders will meet on Wednesday, August 9, in Davao City.

Since the establishment of the BARMM in March 2019, the provincial governors have called for the activation of the Council of Leaders, so that the voice of Local Government Units (LGUs) can be heard and considered in the governance of the autonomous region.

During the launch of the BARMM Governors Caucus (BGC) on June 6, 2023, the five elected governors of BARMM called for the meeting of the Regional Peace and Order Council (RPOC), as well as the convening of the Council of Leaders, among others.

The RPOC met in Sulu last 10 June where the governors submitted their manifesto and an open letter to President Marcos. In a Joint Position Paper, the governors called for the regular meeting of the Council of Leaders, at least quarterly, to fulfill its mandate under RA 11054 or the Bangsamoro Organic Law.

The governors also called for the inclusion of the following critical and urgent issues in the agenda for the Council’s meeting: peace and order issues leading to the October 2023 barangay and SK elections; rationalizing and armonizing BARMM and local government planning; greater coordination between regional ministries and localities in the implementation of regional projects in local areass; transparent, accountable, and efficient implementation of regional projects and Issues on Rule of Law and Justice in the region. Amenah said Monday that higher provisions for subsidies, facilities, learning materials, and skills training programs comprise the bulk of the 3.3-percent increase in the budget allocation for the education sector in the fiscal year 2024 National Expenditure Program (NEP).

The DBM recently transmitted the proposed budget to the House of Representatives for deliberations following its approval by President Ferdinand Marcos Jr.

“As mandated by the Constitution, education will remain our top priority with a total budget of P924.7 billion, equivalent to 16.0 percent of the FY 2024 NEP,” Pangandaman said.

Pangandaman said that of the total amount, P758.6 billion was allotted for the DepEd, while P31 billion is for the Commission on Higher Education (CHED).

She said P15.2 billion had been provided for the Technical Education and Skills Development Authority

and P105.6 billion for the 116 state universities and colleges, among others.

The subsidies for students consist of P51.1 billion for the UAQTE Program and an additional P41.0 billion for Education Assistance — of which P39.3 billion goes to DepEd’s Education Service Contracting, Junior High School and Senior High School Voucher Program, and Joint Delivery Voucher Program for SHS Technical Vocational Livelihood Specialization.

Various infrastructure projects of state universities and colleges will receive P3.4 billion.

Sandigan acquits 2 TRC execs of malversation

THE Sandiganbayan has acquitted two former Technology Resource Center (TRC) officials of graft and malversation in connection with another Priority Development Assistant Fund scam.

Former TRC director general Dennis Cunanan and corporate support services manager Francisco Figura were acquitted by the Sandiganbayan’s second division due to the failure of the Ombudsman to prove their guilt.

In the decision promulgated on August 4, the antigraft court noted the “unequivocal misgivings” of the two former officials in entering into a P10 million project with the nongovernment organization Philippine Environmental and Ecological Development Association from 2007 to 2013.

“With respect to accused Figura and Cunanan, however, they are properly entitled to exculpation taking into consideration the misgiving and protestation they timely raised with regards to the PDAF transactions,” the anti-graft court said in the decision written by the division chairmann Justice Oscar Herrera Jr., that was concurred in by Associate Justices Edgardo Caldona and Arthur Malabaguio. As of June 2023, the Bank has already onboarded 8.35 million unbanked Filipinos to the formal banking system, allowing for convenient fund management and access to financial transactions such as cash withdrawals, fund transfers, and online bills payments.

LANDBANK has likewise taken significant steps to make digital banking more affordable, which includes recently reducing the transaction fees for online fund transfers to other banks through InstaPay, from P25 to P15.

The Bank has also doubled the total daily amount limit of fund transfers via InstaPay from P50,000.00 to P100,000.00, subject to a maximum amount of P50,000.00 per transaction.

Need for strong, credible opposition

A democracy like the Philippines, there is a need for assent and dissent.

Otherwise, we can only have tyranny.

The country has gone through upheavals, Santa Banana, when Martial Law was declared and freedom of the press was curtailed!

What I am concerned about is the lack of a strong and credible opposition, and a seemingly timid press.

Yes, we have an opposition voice in the House of Representatives, a minority of senators, but they seem always outvoted by what is called the “super-majority” in Congress, especially with the creation of a “Uniteam” in the House.

What I am concerned about is the lack of a vociferous press which we used to have, my gulay, in past administrations.

President Marcos Jr. is now in his second year of his six-year term.

I would like to say, so far, so good, especially as secretary of agriculture, also in his second year.

And poll surveys from the two most prestigious surveyors, Pulse Asia and the Social Weather Stations, tell us insofar as satisfaction and acceptance ratings are concerned, both President BBM and Vice President Sara Duterte are doing very well at 85 and 86 ratings.

But, just the same,even if BBM and Sara seem to be getting good acceptance and trust by the people, what I as a journalist for over seven decades miss are the strong and credible voices from the opposition.

While there are some criticisms from columnists on the policies of BBM, they appear inconsistent and vacuous.

Personally, as a journalist, I am satisfied with what Marcos Jr. is doing, especially as acting secretary of agriculture, having laid the groundwork for food security at affordable prices.

I also commend BBM for his many trips abroad in making foreign investors aware the Philippines has become an investment destination, and more especially that the economy is sound and improving.

But, honestly, I still would like to have a strong and credible opposition since I believe assent and dissent are integral in a living democracy.

WPS at UNGA

There are reports the Senate may finally agree among themselves to elevate the issue of the Philippines with China, continuously bullying the Philippines in disputed waters, especially at the Exclusive Economic Zone, in line with China’s aggressive claim on the whole China Sea, also depriving Filipino fisher folk of their livelihood.

All things considered, elevating the WPS issue to the United Nations General Assembly would make the issue with China an international concern.

At the moment, all we can do is to file hundreds of protests against China, with China continuously ignoring us.

We may shout ourselves hoarse, but if China will do what it wants to do, all we can do is nothing.

Thus, with the WPS issue becoming an international issue with UNGA, there is the possibility that the community of nations at the UN can exert enough pressure on China to stop bullying the Philippines to the detriment of fisherfolk who simply want to pursue their livelihood at the WPS.

That’s not much to ask for, is that?

Yes, there are some Asean nations that sympathize with us since some of them, like Vietnam, also have territorial claims against China at the WPS.

But, I believe there is no substitute in making UNGA aware of our problem with China at the WPS.

Special envoy to China

CHIBAYISH, Iraq – Mohammed Hamid Nour is only 23, but he is already nostalgic for how Iraq’s Mesopotamian marshes once were before drought dried them up, decimating his herd of water buffaloes.

Even at their center in Chibayish, only a few expanses of the ancient waterways—home to a Marsh Arab culture that goes back millennia— survive, linked by channels that snake through the reeds.

Pull back farther and the water gives way to a parched landscape of bald and cracked earth.

Mohammed has lost three-quarters of his herd to the drought that is now ravaging the marshes for a fourth-consecutive year. It is the worst in 40 years, the United Nations said this week, describing the situation as “alarming”, with “70 percent of the marshes devoid of water”.

“I beg you Allah, have mercy!” Mohammed implored, keffiyah on his head as he contemplated the disaster under the unforgiving blue of a cloudless sky.

The buffaloes of the marshes produce the milk for the thick clotted “geymar” cream Iraqis love to have with honey for breakfast.

As the marshes dry out, the water gets salty until it starts killing the buffaloes. Many of Mohammed’s herd died like this, others he was forced to sell before they too perished.

“If the drought continues and the government doesn’t help us, the others will also die,” said the

access to Beijing – and named with the rank of a special envoy to China. He could also be the personal envoy of BBM to Xi.

Thus, when I read plans to make Duterte a special envoy to China, my reaction, why not, my gulay!

This way, whenever Xi talks with Duterte it will be his duty and obligation to make what they talked about official and made public.

As for Duterte’s personal visit to Beijing, I still believe the former President is duty bound and has the obligation to make public what he and Xi talked about, especially so in connection with China’s incessant bullying of the country at the WPS.

Duterte may now be just a private citizen, but I believe, as a Filipino, he has the duty and obligation to make public what he and Xi talked about.

Last week President Marcos and former President Duterte met in Malacanang which fuelled speculation that BBM wanted to know what Chinese President Xi Jinping and Duterte talked about.

It was a personal visit of Duterte upon the invitation of the Chinese leader.

Surely, while Duterte’s visit was personal, I am sure they did not talk about the weather with so many issues between China and the Philippines.

And certainly, Santa Banana, we cannot expect BBM to make public what he and Duterte talked about!

Blacklisted

The US Embassy in Manila has called attention to a blacklisted government-owned construction company—the China Communications Construction Co. (CCCC) involved in a Manila Bay reclamation project and in fact ready to participate in the construction of a long bridge that would connect Cavite and Bataan provinces along Manila Bay.

The same CCCC met with BBM recently to inform him they were interested in investing in the Philippines.

The CCCC is in fact a state-owned construction firm that constructed those artificial islands in the contested waters which have been made into Chinese outposts by China.

According to the US Embassy, the World Bank and the Asian Development Bank have also blacklisted the CCCC for fraudulent business practices.

It must be noted China’s expansionist claims in the strategic waterways had been rising tensions between China and the Philippines.

The US Embassy is in regular discussions with the government regarding reclamation projects in Manila Bay, citing concerns about the potential long-term and irreversible impacts on the environment and the threats of natural hazards to Manila Bay and nearby areas.

In line with this information by the US Embassy, it would do well for Malacanang to look deeper into the involvement of the blacklisted CCCC in the Manila Bay reclamation projects. And it would do well for BBM to look into other projects of the government, like the National Grid where the Chinese are also involved.

Note that the National Grid is a very vital project insofar as national security is concerned.

Use of Anti-Terrorism Law

The opposition Makabayan bloc in the House of Representative has raised a very important issue in the government’s use, Santa Banana, of the Anti-Terrorism Law against suspended and fugitive Negros Rep. Arnulfo Teves, wanted together with others in the assassination of rival Governor of Negros Oriental Roel Degano by weaponizing the Anti-Terrorisim Law.

With the use of the Anti-Terrorsim Law against Teves, the Anti-Money Laundering Council has also frozen all the assets of all the accused.

The House opposition bloc raised the issue that with the Anti-Terrorsim Law against Teves and the others seemed not only to justify its existence but raising concerns about the ability of the Department of Justice in prosecuting the accused underlying issues on the effective investigation of the case and apprehension of the suspects.

Personally, I am disturbed the DOJ appears to be using the Anti-terrorsim Law against Teves and associates because of the failure of the government to make Teves and associates face the music.

THIS week the world marks the 78th anniversary of the atomic bombings of the cities of Hiroshima and Nagasaki, where at least 214,000 people were killed, when the United States dropped atomic bombs before the end of World War II.

The commemoration coincided with a censure from Japan’s prime minister at Russian threats to use nuclear weapons asJapan marked the anniversary of the atomic bombing on Sunday.

Around 140,000 people died in Hiroshima on August 6, 1945 and 74,000 in Nagasaki three days later – which preceded the surrender of Japan to the Allied troops led by General of the Army Douglas MacArthur.

At a ceremony in Hiroshima, which has since been reconstructed, Prime Minister Fumio Kishida, whose family comes from that city, said “Japan, as the only nation to have suffered atomic bombings in war, will continue efforts towards a nuclear-free world.

“The path towards it is becoming increasingly difficult because of deepening divisions in the international community over nuclear disarmament and Russia’s nuclear threat.

“Given this situation, it is all the more important to bring back international momentum towards realization of a nuclearfree world,” he said.

Kishida is correct and on the right track

Providing effective medical assistance following a single detonation of this size in Hiroshima in 1945 was almost impossible; today it would be even worse

when he said devastation brought to Hiroshima and Nagasaki by nuclear weapons “can never be repeated.” Kishida’s comments echoed those of UN chief Antonio Guterres, who issued a statement on the Hiroshima anniversary, saying “some countries are recklessly rattling the nuclear saber once again, threatening to use these tools of annihilation.”

Refusing to cooperate with ICC

IN 2019, during the tenure of then President Rodrigo Duterte, the Philippines decided to pull out from the Rome Statute, which established the International Criminal Court (ICC).

Earlier, i.e. on March 13, 2018, President Duterte released a statement announcing the withdrawal of the Philippines as a State-Party from the Rome Statute of the ICC.

He claimed that “the very considerations upon which the Philippines agreed to be a signatory to the Rome Statute have not been observed nor complied with.”

Duterte cited the following reasons for withdrawal: violation of his right to due process of law, lack of jurisdiction over his person, the supremacy of domestic laws, presidential immunity from suit, and lack of the requisite publication in the Philippines’ Official Gazette.

A written notification of withdrawal was deposited with the United Nations on March 17, 2018.

This decision came about after the ICC initiated a preliminary investigation into the Duterte administration’s drug war, and, later that year, a formal inquiry was launched.

Following this withdrawal, there were no plans under the administration of Marcos to consider rejoining the ICC.

On the pretext of protecting the country’s sovereignty, Marcos restated the Philippines, having severed its ties with the international tribunal, is not under the jurisdiction of the ICC.

The President stressed the investigation should be conducted by Filipinos.

At first glance, the President’s decision not to cooperate with the ICC may appear to be justified as it is prompted by a sincere desire to defend the country’s sovereignty from outside interference. Reasoning that the ICC prosecutors are discussing Filipinos, and the purported crimes took place within the Philippines, with Filipino victims. So, he questioned why the case would be taken to The Hague, suggesting it should be handled here instead.

The argumentation appeared reasonable and logical on the surface, yet on closer examination, it is specious, to say the least.

What Marcos has conveniently overlooked by his decision not to cooperate with the ICC probe is the undeniable fact that prior to Duterte’s unilateral withdrawal from the Rome Statute, a complaint had been filed while the country was still a party to a treaty.

As such the ICC was not ousted of its jurisdiction by such notice of withdrawal.

The fact that retired prosecutor Fatou Bensouda initiated the preliminary examination in February 2018 prior to Duterte’s withdrawal, the Rome Statute permitted the continuation of that process.

Even the Supreme Court acknowledged in its subsequent ruling that, despite the withdrawal, the Philippines is still bound to fulfill its obligations to cooperate.

This was the SC explicit pronouncement in the case questioning Duterte’s withdrawal from the ICC.

The issue of noncooperation with the ICC is more than a question of sovereignty than the quest for justice for the thousands of victims in the murderous drug war prosecuted by the Duterte government

While the Supreme Court unanimously rejected the legal challenge to President Rodrigo Duterte’s withdrawal from the International Criminal Court, which was investigating killings and alleged human rights violations in the nation, it cited the petition as “moot and academic.”

The court also stated the country’s withdrawal from the ICC’s jurisdiction, governed by the Rome Statute, had been in effect since March 2019, i.e. prior to Duterte’s notice of withdrawal.

As such, the case against Duterte and his cohorts continues despite the withdrawal.

The Supreme Court even said that the Philippines remains obligated to cooperate despite the withdrawal.

And since retired prosecutor Fatou Bensouda initiated the preliminary examination in February 2018 before Duterte’s withdrawal, the Rome Statute permitted the continuation of that proceeding.

In the same decision, the Court made it unmistakably clear that then President Rodrigo

Iraq’s marshes dying, civilization too

young herder, who has no other income. Both the Mesopotamian marshes, and the culture of the Marsh Arabs—or Ma’adan—like Mohammed who live in them, have UNESCO world heritage status. The Ma’adan have hunted and fished there for 5,000 years, building houses from woven reeds on floating reed islands where the Tigris and Euphrates rivers come together before pouring into the Gulf.

Even their beautifully intricate mosques were made of reeds.

But the marshlands have shrunk from 20,000 square kilometres (7,700 square miles) in the early 1990s to 4,000 (1,500 square miles) by latest estimates -- choked by dams on the great rivers upstream in Turkey and Syria and the soaring temperatures of climate change. Only a few thousand of the quarter million Ma’adan who lived in the marshes in the early 1990s remain.

Experts say that Iraq’s management of the waters has not helped.

Water levels in the central marshlands and the Euphrates which feeds it are “dropping by half a centimeter a day”, said engineer Jassim al-Assadi, of Nature Iraq, the country’s leading conservation group. That will get worse “over the next two months as the temperatures rise and more and more water evaporates,” he added.

To draw water for his remaining buffaloes, Mohammed Hamid Nour takes his canoe out into deeper water, where salt levels are lower. He rolled up his sleeves to fill a water tank on the canoe revealing a tattoo of the Zulfikar, the sword of Imam Ali, one of the founding figures of Shi’ite Islam. He got it for “baraka” or blessing, he smiled. He needs all the help he can get.

Saddam’s bid to kill them

The marshes already almost died once when former dictator Saddam Hussein dried them out so he could hunt down the Shi’ite rebels who had taken refuge there after the failed uprising in the wake of the First Gulf War in 1991.

In a few months, Saddam turned 90 percent of the marshes into a “desert”, Assadi recalled. Most of the Ma’adan fled or “moved elsewhere in Iraq or emigrated to Sweden or the United States”.

But when Saddam was toppled by the American-led invasion in 2003 the ditches he dug to drain the marshes were destroyed, and both the marshes and the Ma’adan returned.

Two decades later, the water level is plummeting again.

“The level of the Euphrates in Iraq is around half of what it was in the 1970s,” said Ali alQuraishi, of Baghdad’s University of Technology.

“In the face of these threats, the global community must speak as one. Any use of nuclear weapons is unacceptable,” Guterres said.

Earlier in May the President of the International Committee of the Red Cross, Mirjana Spoljaric, and the President of the Japanese Red Cross Society, Atsushi Seike, issued a statement ahead of the three-day G7 summit in Hiroshima.

In their statement, which we endorse as well, they said the world must remember the horror wrought by the two atomic bombings of 1945.

For the sake of the survival of humanity, we must indeed free the world of weapons that threaten catastrophic humanitarian consequences and irreversible harm. This requires immediate and decisive action by the entire international community. The risk of use of nuclear weapons is highest since the worst moments of the Cold War, amid heightened political tensions and new steps to expand arsenals. With almost 13,000 nuclear weapons in the arsenals of the nuclear-armed states, many with much more destructive power than the Hiroshima bomb and ready to be launched within minutes, “that dark path would have catastrophic effects on human health, the environment, the climate, food production, and socio-economic development around the globe.” As Mirjana Spoljaric and Atsushi Seike correctly pointed out: “No government or international organization is prepared to deal with such a situation.”

Duterte could not use the Philippines’ withdrawal from the Rome Statute as a means to avoid the investigation by the International Criminal Court prosecutor regarding charges of committing crimes against humanity in relation to the killings during his harsh war on drugs.

This much should have made President Marcos mindful of when he chose not to cooperate with the ICC probe.

“Withdrawing from the Rome Statute does not discharge a state party from the obligations it has incurred as a member,” the court said in a 101-page decision authored by Associate Justice Marvic Leonen.

It is not a matter of sovereignty but more so a matter of honoring its treaty obligations as party to the Rome Statute.

A treaty is binding on the parties and must be executed in good faith.

In fact, the high court ruled in the same decision that as a state party the Philippines was bound to recognize the jurisdiction of the ICC and cooperate with its processes even after its withdrawal from the treaty that created the international court.

Marcos, as president, is now duty bound to respect the court’s decision after it issues a final judgment.

He is obliged to adhere to it, regardless of any strong disagreements.

While Presidents have historically criticized the Supreme Court, they do not possess the power to invalidate or ignore these judgments.

The issue of non-cooperation with the ICC is more than a question of sovereignty than the quest for justice for the thousands of victims in the murderous drug war prosecuted by the Duterte government.

Government data indicates that slightly over 6,000 individuals lost their lives in over 200,000 anti-drug operations.

This is however being disputed by the ICC prosecutors who say the death toll is significantly higher, with estimates ranging from 12,000 to 30,000.

The UN Report on the Human Rights Situation in the Philippines says about 8,663 of the deaths are a result of the conduct of antiillegal drug operations, with estimates triple that amount.

It is a fight against impunity and to ensure that the victims and their families obtain their well-deserved justice.

Dams upstream in Turkey, where the Tigris and the Euphrates have their sources, and others on their tributaries in Syria and Iran, are the “principle” cause, he said.

“The Turks have built more dams to meet the needs of agriculture there. As the population rises, more water is needed for irrigation and domestic use,” the expert added.

Water has always sparked tensions between Iraq and Turkey. With Iraq asking Ankara to release more, the Turkish ambassador to Baghdad, Ali Riza Guney, sparked outrage last July by accusing the Iraqis of “wasting water”.

There is a grain of truth in the Turkish claim, scientists say. Iraq’s water management is far from ideal.

Since the time of the ancient Sumerians, Iraqi farmers have flooded their land to irrigate it, which is considered hugely wasteful.

But now water for agriculture is short, with the authorities drastically reducing arable farming to make sure there is enough drinking water for the country’s 42 million people.

Iraq’s President Abdul Latif Rashid told the BBC last month that the government “has taken significant steps to improve the water management system in talks with neighboring countries”, without going into detail.

Belmonte raises alarm on rise of leptospirosis

QUEZON City Mayor Joy Belmonte on Monday raised the alarm over rise of leptospirosis incidence in the city, saying at l0 cases are record daily.

She said the city government is doing its best to address the increase in the leptospirosis cases over the past two weeks, and directed the Quezon City Epidemiology and Disease Surveillance Unit (QCESU) to take appropriate actions.

Data from QCESU showed an increasing number of leptospirosis cases in the past two weeks with 26 cases reported from July 22 to Aug. 4. Notably, 10 were recorded on Aug. 1, the highest number of cases in a single day.

To curb the spread of the disease and protect individuals at risk, the use of Doxycycline or antibiotics to treat infections has been distributed in barangay health centers, QCESU chief Dr. Rolando Cruz said.

Early diagnosis is critical to preventing severe complications that could lead to hospitalization, Belmonte said. Rio N.

SPD chief urges public: Be vigilant vs. crimes

THE Southern Police District has called on the public to remain vigilant and report any information that may help the police in going after the criminals.

SPD director Brig. Gen. Roderick Mariano made the call following the successful rescue of a 10-year old kidnap victim in Las Pinas City.

The operation conducted by the Parañaque City Police on Aug. 5 also resulted in the arrest of the suspect along Tramo Street, Evergreen in Barangay Pulang Lupa Uno. The rescue operation was made only three hours after the incident was reported to the police by a concerned resident.

Prior to this, another 10-year-old victim had been reported missing and was last seen on July 27, 2023. The victim’s mother has sought assistance from the Investigation and Detective Management Section of Paranaque City Police.

The authorities advised the mother to share the suspect’s photograph and the victim’s details on social media platforms.

Win flags low enrolment in early child education

SENATOR Sherwin Gatchalian on Monday flagged the low enrolment in early childhood education, noting that only 9 percent of children aged two to four are enrolled in the country’s national and local child development centers (CDCs) for school year 2022-2023.

This means only 608,614 of the estimated 6,835,586 children aged two to four are enrolled in the CDCs. Gatchalian, chairman of the Senate Committee on Basic Education, noted that this falls far short of the goal of achieving universal ECCD coverage.

BI eyes amnesty for overstaying, illegal foreigners

THE Bureau of Immigration (BI) said it will propose the grant of amnesty to thousands of illegal and overstaying foreigners in the country, including POGO workers, and collect more than P2 billion from penalties and fines from these people.

Immigration deputy commissioner Daniel Laogan said under the planned amnesty program, an illegal alien would have to pay at least P25, 000 for each year he or she overstayed in the country.

In an interview, Laogan said the amnesty program for illegal aliens would encourage foreigners who have been illegally staying in the country for several years to come out, register, regularize their stay and avoid arrest and deportation.

The BI estimated that there are more than 500,000 foreigners illegally living in the country, adding that legalizing these immigrants will benefit the country’s economy in terms of extra revenues.

Speaker vows to raise OFW issues before ASEAN solons

SPEAKER Martin Romualdez has emphasized his commitment to raise critical issues concerning Overseas Filipino Workers (OFWs) in the ASEAN Inter-Parliamentary Assembly (AIPA) scheduled Monday.

“Among the key issues we want to address here include the protection and welfare of our OFWs” Romualdez said in a speech at a Filipino community event in Jakarta, Indonesia late Sunday.

Romualdez stressed that the administration of President Ferdinand Marcos, Jr. was steadfast in ensuring the safety, wellbeing, and protection of OFWs, acknowledging their sacrifices and contributions to the Philippine economy.

Two BuCor officials sacked pending investigation

TWO officials of the Bureau of Corrections (BuCor) have been relieved from their posts pending completion of investigations into alleged anomalies and controversies hounding the country’s penitentiary facilities.

Meanwhile, legislators were of the consensus that the problems besetting the BuCor needed systemic solutions, saying “band aid” remedies done in the past failed to ad -

dress the issues.

In a statement, BuCor chief Gregorio Catapang Jr. said he has relieved Deputy Director General for Administration Gerald Aro and Deputy Director for Operations and head executive assistant Angelina Bautista.

Guard in hit-and-run case accepts settlement

The security guard who was a victim of a hit-and-run incident involving a sports utility vehicle (SUV) near a mall in Mandaluyong City last year has agreed to an amicable settlement of the case.

“Nag-settle…And tinanggap naman dahil sabi nga e, kahit dalawang taon siyang hindi magtrabaho bilang security guard, mas malaki pa yung naibigay yata sa kanya na financial assistance,” said lawyer Federico Biolena, counsel of security guard Christian Floralde.

Biolena refused to disclose the settlement amount.

A video that later went viral captured the incident when the SUV, driven by Jose Antonio Sanvicente, ran over Floralde.

Based on the video, prosecutors found probable cause to charge Sanvicente in

court with frustrated homicide, saying there was intent to kill Floralde.

They noted that Sanvicente did not even slow down, stop the care, or change direction after Floralde was pinned by the suspect’s vehicle. Sanvicente eventually pleaded not guilty to the charge. According to Biolena, the settlement led to the dismissal of the frustrated homicide charge against Sanvicente by a Mandaluyong court because his client accepted the defense of the accused.

“It was a necessary consequence… if there is no complainant, how can the case progress? And then yun na nga, tinatanggap naman ni Floralde yung depensa na talagang purely accidental, hindi sinasadya yung pagkasagasa sa kanya kung kaya’t pumayag na siya i-settle,” the lawyer explained.

Order and Safety. Bautista asserted that she is open to an investigation.

“I ask that I be relieved of my position so as not to taint the good name of our Director General,” she said.

Laogan said giving them amnesty would also protect them, not just from corrupt immigration personnel, but from abusive law enforcers engaged in protection rackets victimizing illegal aliens.

The BI official said a significant number of foreigners – mostly Chinese, Indians and a few South Koreans – have been illegally staying and working in the country over the years.

“Some of them became undocumented because their passports were cancelled,” he said.

Most of the illegal Indians are engaged in business, while the Chinese seek employment in stores, mining companies and restaurants, he added.

House set to pass New Philippine Building Act

THE House of Representatives is set to pass on third and final reading this week the proposed New Philippine Building Act, replacing the 46-yearold Building Code.

Bulacan Rep. Salvador Pleyto Sr., a former Public Works and Highways undersecretary, said the measure contained in House Bill 8500 is proposed to help the public prepare for a possible catastrophic earthquake, or “The Big One.”

“The enactment of a New Philippine Building Act to replace the antiquated 46-year-old Presidential Decree 1096 is long overdue and will ensure that more precious lives and properties are saved and protected,” said Pleyto, principal author of the measure.

“We have to make our buildings withstand a magnitude 8 earthquake,” Pleyto said, noting that buildings should be “resilient against earthquakes, fire, flood, landslide, storm, volcano and multiple hazards.”

PD 1096 was issued by the late President Ferdinand Marcos Sr. in 1977.

“This law (PD 1096) has to be repealed. We have been using this obsolete law,” Pleyto stressed.

HB 8500 or the proposed “New Philippine Building Act,” promotes building resilience against earthquake, fire, flood, landslide, storm, volcanic eruption, and multiple hazards, as well as regulate the planning, design, construction, occupancy, maintenance, and demolition of buildings in the country. It was passed on second reading last week.

5. NGCP and UPSI may be served with orders, notices, pleadings and other legal processes through their respective counsels at the addresses indicated below. ANTECEDENT FACTS

Republic Act No. 9136, also known as the Electric Power Industry Reform Act (“EPIRA”), provides that it is the responsibility of NGCP to ensure and maintain the reliability, adequacy, security, stability and integrity of the nationwide electrical grid in accordance with the performance standards for its operations and maintenance, as set forth in the Philippine Grid Code (“PGC”),3 adopted and promulgated by the Honorable Commission, and to adequately serve generation companies, distribution utilities and suppliers requiring transmission service and/or ancillary services (“AS” or “Ancillary Services”)4 through the transmission system.5

7. Similarly, the PGC provides that NGCP is responsible for determining, acquiring, and dispatching the capacity needed to supply the required Grid AS and for developing and proposing Wheeling Charges and AS tariffs of the ERC.6

8. Ancillary Services is defined in Section 4 (b) ofthe EPIRA as referring “to those services that are necessary to support the transmission of capacity and energy from resources to loads while maintaining reliable operation of the transmission system in accordance with good utility practice and the Grid Code to be adopted in accordance with this Act.” These services are essential in ensuring reliability in the operation of the transmission system and consequently, in the reliability of the electricity supply in the Luzon, Visayas and Mindanao grids.

9. In order to implement and regulate the procurement of AS, the Honorable Commission approved the Ancillary Services Procurement Plan (“ASPP”)

Commission must first approve the ASPA before the same can be implemented.

33. As the demand for power in Luzon increases, the requirements of the system likewise increases. Ensuring the integrity of the system is essential to protect the interests of the public. The absence of system reliability and stability will certainly discourage investments and growth.

34. Applicants respectfully submit that the immediate approval of the ASPA by this Honorable Commission is a necessity to maintain the present reliability and security of the Grid. SEOUL—Organizers of the World Scout Jamboree asked host South Korea Monday to “urgently” evacuate tens of thousands of children from their campsite ahead of a typhoon, just days after a heatwave caused mass scout illnesses.

Typhoon Khanun, which killed at least two people in Japan, is due to make landfall in South Korea on Thursday, near where some 43,000 scouts have been camping in North Joella province for their problem-plagued jamboree.

Korean media have called the jamboree “a national disgrace” after an extreme heatwave caused hundreds of scouts to fall ill, and prompted American and British scout groups to withdraw as criticism grew over conditions at the campsite.

Organizers had insisted the event would continue but on Monday the World Organization of the Scout Movement said Seoul had told them that “due to the expected impact of Typhoon Khanun, an early departure will be planned for all participants.”

“We urgently call on the Government to expedite the plan for departure and provide all neces-

sary resources and support for participants during their stay and until they return to their home countries,” it said in a statement.

Some 36,000 participants from 156 countries will begin evacuating from the campsite at 10 am (9 am in Manila) Tuesday, Vice Minister for Disaster and Safety Management Kim Sungho said on Monday.

South Korea’s weather agency said Typhoon Khanun is forecast to bring heavy rain and strong winds across the Korean peninsula, including winds with a maximum speed of up to 44 meters per second—powerful enough to derail a moving train.

The jamboree was scheduled to run until August 12. South Korea’s presidential office has suggested that its contingency plan is for the tens of thousands of young people to be relocated to Seoul for the rest of their stay. AFP

Typhoon forces Japan atomic bomb commemorations inside

TOKYO—Typhoon Khanun was on course Monday to dump prolonged, heavy rain on one of Japan’s main islands this week, forecasters said, forcing commemorations of the Nagasaki atomic bombing to be held inside.

The typhoon last week reportedly killed at least two people, injured more than 100 and cut off power for several hundred thousand people in the southern Okinawa region before barreling towards Taiwan.

The weather system has since swung back to the Okinawa area and was expected to rumble northwards to the west of Kyushu on Tuesday and Wednesday before veering towards South

Korea, the Japan Meteorological Agency said in a televised press briefing.

The typhoon “could bring significant rainfall in wide regions,” an agency official told the briefing, adding that “heavy rainfall will increase the risk of disasters.”

The storm forced Nagasaki, one of the main cities on Kyushu, to scale down its annual commemoration ceremony of the 1945 bombing scheduled for Wednesday.

The ceremony is traditionally held outdoors at the city’s Peace Park and is attended by government ministers, officials and thousands of guests including survivors of the bombing. AFP

Cambodian king appoints Hun Sen’s son new PM, ending nearly 4 decades rule

PHNOM Penh, Cambodia—Cambodia’s king appointed Hun Sen’s son the country’s new leader Monday, beginning a handover of power that ends nearly four decades of rule, but the outgoing premier promised this was “not the end” of his political career.

King Norodom Sihamoni issued a royal decree appointing Hun Manet as prime minister, after Hun Sen had announced last month that he was stepping down and handing power to his eldest son.

Hun Sen—one of the world’s longest-serving leaders—made the announcement days after a landslide victory in July polls that were widely decried as a sham, after main challenger the Candlelight Party was barred from participating.

To officially assume the post, 45-year-old Hun Manet and his cabinet must win an August 22 vote in parliament, where his father’s Cambodian People’s Party has all but five of 125 seats in the lower house.

Hun Sen has for years pursued a ruthless campaign against any opposition, banning parties and forcing adversaries to flee abroad.

While insisting he would not interfere with his son’s rule, Hun Sen promised on Monday he would continue to play a prominent political role.

“It is not the end yet,” he said, adding he would continue serving in other positions until at least 2033.

After stepping down, Hun Sen has said he will become president of the Senate early next year, making him acting head of state when the king is overseas. AFP

through its Order dated 9 March 2006 in ERC Case No. 2002-253 and the Ancillary Services-Cost Recovery Mechanism (“AS-CRM”) through its Decision dated 3 October 2007 in ERC Case No. 2006-049RC. 10. The NGCP certified that the units of the Generation Facility have met and complied with the Standard Ancillary Services Technical Requirements of the ASPP as capable of providing Regulating Reserve. A copy of NGCP Accreditation Certificate No. 2022L020 in favor of UPS I, and valid from 22 September 2022 to 21 September 2024 is attached to this Application.7 Competitive Selection Process 11. On 04 October 2021, the DOE issued the AS-CSP Circular providing the policy for the conduct of the Competitive Selection Process (CSP) for the procurement of Ancillary Services by the System Operator (NGCP). Among the policies set by the AS-CSP Circular was the creation of an independent Third-Party Bids and Awards Committee (TPBAC) to spearhead and manage the CSP. 12. In its Letter dated 22 November 2022, the DOE approved the Terms of Reference (TOR) and Instruction to Bidders , and instructed NGCP to proceed with the publication and posting of the same pursuant to Sec. 7.4 and 7.5 of the AS-CSP Circular. 13. On 26 January 2023, the TPBAC approved its Notice of Invitation to Bid informing the public of the pending AS-CSP for Regulating Reserve (RR), Contingency Reserve (CR), Dispatchable Reserve (DR), Reactive Power Support (RPS), and Black Start Service (BSS); and inviting all interested grid-connected merchant plants and Independent Power Producers to apply for eligibility and participate in the competitive bidding for the procurement of AS. The Notice of Invitation to Bid likewise provided any interested grid-connected merchant plants a copy of the DOE approved TOR and Instruction to Bidders. 14. Subsequently, the Notice of Invitation to Bid was published on 31 January 2023 with the Malaya Business Insight and the Philippine Star The same Notice was also published on 07 February 2023 with the Business Mirror and the Manila Bulletin 15. UPSI was declared by the TPBAC as eligible to participate in the AS-CSP and submit its bid for the provision of Regulating Reserve. 16. Under Bid Bulletin 2023-02 issued by the TPBAC, eligible bidders may submit their bids on or before 13 March 2023. 17. Thereafter, pursuant to Bid Bulletin 2023-02, the TPBAC conducted the opening of bids timely submitted by all the eligible bidders whereby UPSI’s bid/offer16 for the provision of RR by its Generation Facility was considered for award after sufficiently complying with the post -qualification requirements. 18. On 12 April 2023, the TPBAC issued and submitted to the NGCP’s Board of Directors its Resolution and Evaluation Report on the conduct of the CSP17 indicating UPSI as one of the winning bidders. The TPBAC’s Evaluation Report was thereafter confirmed by the NGCP’s Board of Directors through a resolution dated 18 April 2023.18 19. On 18 April 2023, the TPBAC issued a Notice of Award in favor of UPSI19 informing the latter that it is to be awarded with a contract for the Provision of Ancillary Services in the Luzon Grid. The details of the award are as follows: 20. On 02 May 2023, NGCP and UPSI executed an ASPA pursuant to the AS-CSP Circular. CONTRACTED CAPACITY RATES AND IMPACT SIMULATION 21. Section 3 of the ASPA states that UPS I shall provide the AS in accordance with Schedule 1 of the ASPA, as follows: Contracted Capacities: Regulating Reserve (“RR”): BATAAN BESS: ± 40 MW (80 MW) 22. Schedule 3 of the ASPA provides for the formula for the computation of the Ancillary Service Payment, and the applicable rates for Capacity Payment: A. Ancillary Service Payment 1. UPSI submits that the rates represent a reasonable recovery of its opportunity cost in making available generation capacity to provide the procured AS. Stocks rise, peso tumbles on oil price surge

LOCAL stocks rebounded Monday, but the Philippine peso tumbled to a two-month low as global crude prices continued to rise.

The Philippine Stock Exchange index, the 30-company benchmark, rose 56.94 points, or 0.88 percent, to close at 6,507.78, while the broader allshares index rose 26.31 points to settle at 3,473.92.

Philstocks Financial Inc. research analyst Claire Alviar said despite the market’s advance, value turnover remained thin as investors remained cautious over upward risks to inflation rate.

The peso shed P0.28 to close at 56.02 against the greenback Monday from 55.74 on Friday. It was the local currency’s lowest level since it finished at 56.05 on June 9, 2023. Total volume turnover reached $973.75 million, down from $1.138 billion previously.

Michael Ricafort, chief economist of Rizal Commercial Banking Corp., said in an emailed response to Manila Standard the local currency’s weakness could be attributed to the surging global crude oil prices that posted new 3.5-month highs, thereby leading to some pickup in local fuel pump prices and overall inflation. Ricafort said this led to “higher import bill and wider trade deficit for the country.”

“The peso also weakened after recent signals on being careful of not hiking local policy rates too much to avoid slowing economic/GDP growth, as well as some net foreign selling in the local stock market recently,” Ricafort said.

He said the markets were still anticipating the seasonal increase in importation activities in the third quarter after the tail-end of the seasonal increase in OFW remittances and conversion to pesos for tuition payments and other related expenses in preparation for the start of the new school year.

Siemens Energy logs record loss on wind turbine tech trouble

Energy reported a record third-quarter net loss Monday after taking a 1.6-billion euro ($1.7 billion) hit to fix technical problems with its onshore wind turbines.

The group had warned in June that quality issues at its troubled Siemens Gamesa wind unit were worse than previously thought, sending its share plunging more than 30 percent.

After initially estimating the repair cost at more than a billion euros, Siemens Energy announced a 1.6-billion-euro charge to resolve the issues affecting “certain rotor blades and main bearings in the 4.X and 5.X platforms”. The charge weighed heavily on the company’s overall performance in its fiscal third quarter, which slumped to a net loss of 2.9 billion euros compared with a loss of 564 million euros over the same period a year earlier.

The result was also dragged lower by extra charges of 600 million euros in its offshore wind business, which has been hit by “higher product costs” and difficulties ramping up capacity.

Siemens Energy said it was “additionally burdened” by a 700-millioneuro write-down of deferred tax assets during the quarter.

Indonesia economy grows faster than expected in Q2

JAKARTA, Indonesia—Indonesia’s economic growth accelerated faster than expected in the second quarter of the year, official data showed Monday, the strongest rate in three quarters despite lagging exports.

Southeast Asia’s largest economy grew 5.17 percent on-year between April and June, according to Statistics Indonesia, beating analysts’ expectations.

The continued growth was driven by household spending, foreign and domestic investment and increased government spending, Statistics Indonesia official Edy Mahmud told reporters.

“During the second quarter of 2023, Indonesia’s economic performance was supported by the increase of peo-

ple’s mobility and religious holidays that drive up people’s consumption and production activities,” Mahmud said.

He emphasized the resilience of Indonesia’s economy emerging from the Covid-19 pandemic despite exports contracting for the first time since the last quarter of 2020, owing in part to declining palm oil prices. Exports fell 2.75 percent compared to the same quarter last year, figures showed.

Indonesia posted growth last year of 5.3 percent—the highest for nine years—on the back of soaring export prices and the lifting travel restrictions.

Musk, Zuckerberg ‘caged fight’ to be streamed live on X

WASHINGTON, United States— Elon Musk said Sunday that a “cage match” he and Meta CEO Mark Zuckerberg have seemingly agreed to as a fund-raiser will be carried live on X, formerly known as Twitter, which he owns.

“Zuck v Musk fight will be livestreamed on X,” Musk posted. “All proceeds will go to charity for veterans.”

Zuckerberg soon hit back on Threads, the new app he launched last month in a direct challenge to what was then still called Twitter, saying he was ready.

R&I revises PH credit outlook to ‘positive’

Japan-based debt watcher Rating and Investment Information Inc. affirmed the Philippines’ investorgrade credit rating at “BBB+” but revised its outlook to positive from stable, citing the country’s robust macroeconomic fundamentals, improving fiscal position, sound banking system, comfortable external payments position and stable political environment.

INVESTMENTS pledges received by the Philippine Economic Zone Authority soared 332 percent in the first seven month of 2023 to P97.16 billion from P22.48 billion in the same period in 2022.

PEZA director-general Tereso Panga said the new investments were projected to yield $747 million in exports and generate 18,407 new jobs.

“Among the bright prospects for the Philippines and the ecozones include our 6 to 7 percent GDP growth target, our ascension to RCEP [Regional Comprehensive Economic Partnereship] and other FTAs [free trade agreements], the 5 to 15 percent annual growth target by the industries, the Marcos administration’s efforts to increase our credit rating and our aggressive investment promotions,” he said.

Data showed that in July, investments from 15 new and expansion projects amounted to P16.57 billion with projected export values of $419.5 million and employment opportunities of 2,983 jobs.

Panga said PEZA was counting on the Office of the President to approve new and expanding economic zones. The OP approved on July 25 three new economic zone projects with combined investments of P750.38 million.

SM PRIME Holdings Inc., one of the leading integrated property developers in Southeast Asia, said Monday net income grew 49 percent in the second quarter to P10 billon from P6.7 billion in the same period last year on the back of strong mall and residential revenues.

SMPH said in a disclosure to the stock exchange second-quarter consolidated revenues jumped 39 percent to P31.2 billion from P22.5 billion a year earlier.

Domestic mall revenues surged 30 percent in the second quarter to P16.1 billion from P12.4 billion, while residential sales, led by SM Development Corp., also grew 82 percent year-onyear to P9.9 billion.

The positive second-quarter results led first-half net income to increase 38 percent to P19.4 billion from P14.1 billion.

First-half consolidated revenues were up 29 percent to P59.9 billion.

Consolidated operating income climbed 36 percent to P29 billion in the first six months from a year ago.

MORE Electric and Power Corp. opened onsite registration in barangays to process applications of customers qualified for lifeline rate subsidy under the Electric Power Industry Reform Act to reach more Pantawid Pamilyang Pilipino Program members and marginalized sectors.

MORE Power president and chief executive Roel Castro said they would get in touch directly with the groups concerned so more qualified customers could avail of the program.

“In addition to accepting applications in our office, we also deploy personnel to barangays for on-site registration,” Castro said.

MORE Power said it received 1,519 applications from 42 barangays as of Aug. 2.

The power retailer in Iloilo advised its customers to visit their official Facebook page for the exact date and venue of barangay onsite registration. The Department of Energy extended the full rollout of the subsidy application until September due to low application turnout.

Moody’s Analytics predicts slower PH economic growth in Q2

MOODY’S Analytics, a research agency which operates independently of Moody’s Investors Service, said Monday the Philippine economy likely slowed in the second quarter from the previous period.

“We expect Philippine GDP to grow 6 percent year-on-year, slowing from the 6.4 percent pace in the first quarter,” it said in its Asia-Pacific Economic Preview for the week.

“Easing inflation and a tight labor market will power household consumption,” it said.

Data from the Philippine Statistics Authority showed the GDP grew by 6.4 percent in the first quarter, one of the

fastest in the Asian region, despite the elevated inflation that impacted consumer spending.

The PSA will release the secondquarter GDP report Thursday.

Inflation peaked at 8.7 percent in January 2023 but eased in the succeeding months. Latest data showed it softened to a 16-month low of 4.7 percent in July.

The International Monetary Fund earlier raised its 2023 growth forecast for the Philippines to 6.2 from 6 percent in April 2023. The projection falls within the 6 percent to 7 percent growth forecast announced by the interagency Development Budget Coordinating Com-

mittee. The IMF revised downward its 2024 growth forecast to 5.5 percent from 5.8 percent because of global headwinds and lagged effects of policy tightening.

Data showed the economy grew by a 46-year high of 7.6 percent in 2022 on the back of reinvigorated economic activity due to the reopening of the economy to greater normalcy.

Preparations for the toll collection system are also underway, it said. Once completed, CALAX will connect to the busiest highway in Cavite― the Aguinaldo Highway―and help decongest major thoroughfares in the province and Laguna. The interchange will serve more motorists, including the 298,000 Silang residents, given the reduced congestion.

CALAX will expand to 45 kilometers and connect to Manila-Cavite Expressway in Kawit. Its operational segments stretch from Mamplasan in Binan, with interchanges at Laguna Technopark, Laguna Boulevard, Santa Rosa-Tagaytay Road up to Silang East Interchange.

Semirara Mining posted 26% decline in six-month net earnings to P19.2b

SEMIRARA Mining and Power Corp. said Monday earnings dropped 26 percent in the first six months to P19.2 billion from P25.8 billion in the same period last year on high base effect and normalizing coal indices. SMPC said in a disclosure to the Philippine Stock Exchange net income reached P10.2 billion in the second quarter, down 5 percent from a record high of P10.8 billion in the same period last year.

“Even with lower coal prices, we delivered our second-best first-half results because of China demand recovery and the improved performance of Sem-Calaca Power Corporation [SCPC] Unit 2,” said SMPC president and chief operating officer Maria Cristina Gotianun.

SMPC said it delivered robust financial results because of higher coal shipments, improved plant availability and increased electricity sales at elevated prices despite significant corrections in global coal index prices and the impact of high base effect.

Higher outlay for sports in ‘24 PH budget pushed

THE Philippine Sports Commission stands to receive a higher allocation in 2024 as several lawmakers were apalled by the drastic cuts made on its proposed budget that left it with a mere P210.44 million in the National Expenditure Program that was submitted to the House of Representatives.

From a budget of P2.31 billion in 2023, the PSC was given P210.44 million in the proposed 2024 national government budget, almost one-tenth of this year’s allocation.

The PSC funds sports programs and trainings for

national athletes.

“We found out that the budget for the PSC was slashed so we’ll try to push it to get more,” said Leyte Rep. Richard Gomez, a former fencer who represented the Philippines in several international games.

“The government is trying its best to give the support that it can, considering the limited budget that we have, we’re trying to support all our athletes,” Gomez added.

Gomez, however, did not reveal the amount that he wants to add to the proposed PSC budget but said it will be substantial.

Japan assumes role as World Cup favorite

SYDNEY—Japan has flown in under the radar to become the team to beat, along with England, at the Women’s World Cup and boasting the tournament’s leading scorer in Hinata Miyazawa.

The United States, the holders, and a European contingent led by continental champions England were touted as title contenders going into the World Cup.

Nobody was talking about Futoshi Ikeda’s Japan, who are ranked 11th in the world by FIFA.

Even back home, expectations that they could pull off a repeat of their 2011 World Cup triumph were low.

“I think we were left behind by the sudden strides that the rest of the world were making,” former Japan coach Asako Takakura, who led the team at the 2019 World Cup, told AFP ahead of the 2023 edition.

Japan went out in the last 16 in 2019 but are already into the quarter-finals four years later. They won all three of their group games—a record matched only by Sweden and England—scoring 11 times and not conceding.

The pertinent allegations of the Application are hereunder quoted as follows: NATURE OF THE CASE

1. This Application is for the approval of the Ancillary Services Procurement Agreement (“ASPA” or “Agreement”) dated 02 May 2023,1 entered into by the NGCP and UPSI, pursuant to Department of Energy (DOE) Department Circular No. DC 2021-10-0031 (the “AS-CSP Circular”) prescribing the conduct of Ancillary Services Competitive Selection Process (AS-CSP); in relation to the Ancillary Services - Cost Recovery Mechanism (AS-CRM) promulgated by the Energy Regulatory Commission in its Decision dated 3 October 2007 in ERC Case No. 2006-049RC. THE PARTIES

2. Applicant NGCP is a corporation created and existing under the laws of the Philippines, with office address at NGCP Building, Quezon Avenue corner BIR Road, Diliman, Quezon City. It holds a congressional franchise granted under Republic Act No. 9511,2 and is authorized to engage in the business of conveying or transmitting electricity through high-voltage back-bone systems of interconnected transmission lines, substations and related facilities, and for other purposes. The NGCP is authorized to conduct activities necessary to support the safe and reliable operation of the transmission system.

3. Applicant UPSI is a corporation duly organized and existing under and by virtue of the laws of the Republic of the Philippines, with principal place of business at 5th Floor, #100 Eulogio Rodriguez Jr. Avenue, C5 Road Bo. Ugong, Pasig City, 1604 Metro Manila, Philippines.

4. UPSI is the owner and operator of a power plant composed of a Battery Energy Storage System (BESS), with a rated capacity of 50 MW continuous output at 60Hz, including required ancillaries and spare parts, located in Concepcion, Tarlac (the “Generation Facility”), which was certified and accredited by the NGCP as capable of providing Contingency Reserve (CR).

5. NGCP and UPSI may be served with orders, notices, pleadings and other legal processes through their respective counsels at the addresses indicated below.

ANTECEDENT FACTS

6. Republic Act No. 9136, also known as the Electric Power Industry Reform Act (“EPIRA”), provides that it is the responsibility of NGCP to ensure and maintain the reliability, adequacy, security, stability and integrity of the nationwide electrical grid in accordance with the performance standards for its operations and maintenance, as set forth in the Philippine Grid Code (“PGC”),3 adopted and promulgated by the Honorable Commission, and to adequately serve generation companies, distribution utilities and suppliers requiring transmission service and/or ancillary services (“AS” or “Ancillary Services”)4 through the transmission system.5

7. Similarly, the PGC provides that NGCP is responsible for determining, acquiring, and dispatching the capacity needed to supply the required Grid AS and for developing and proposing Wheeling Charges and AS tariffs of the ERC.6

8. Ancillary Services is defined in Section 4 (b) of the EPIRA as referring “to those services that are necessary to support the transmission of capacity and energy from resources to loads while maintaining reliable operation of the transmission system in accordance with good utility practice and the Grid Code to be adopted in accordance with this Act.” These services are essential in ensuring reliability in the operation of the transmission system and consequently, in the reliability of the electricity supply in the Luzon, Visayas and Mindanao grids.

9. In order to implement and regulate the procurement of AS, the Honorable Commission approved the Ancillary Services Procurement Plan (“ASPP”) through its Order dated 9 March 2006 in ERC Case No. 2002-253 and the Ancillary Services-Cost Recovery Mechanism (“AS-CRM”) through its Decision dated 3 October 2007 in ERC Case No. 2006-049RC.

10. The NGCP certified that the units of the Generation Facility have met and complied with the Standard Ancillary Services Technical Requirements of the ASPP as capable of providing Contingency Reserve. A copy of NGCP Accreditation Certificate No. 2023-L011 in favor of UPSI, and valid from 20 March 2023 to 19 March 2025 is attached to this Application.7 Competitive Selection Process

On 04 October 2021, the DOE issued the AS-CSP Circular providing the policy for the conduct of the Competitive Selection Process (CSP) for the procurement of Ancillary Services by the System Operator (NGCP). Among the policies set by the AS-CSP Circular was the creation of an independent Third-Party Bids and Awards Committee (TPBAC) to spearhead and manage the CSP.

12. In its Letter dated 22 November 2022,8 the DOE approved the Terms of Reference (TOR)9 and Instruction to Bidders10, and instructed NGCP to proceed with the publication and posting of the same pursuant to Sec. 7.4 and 7.5 of the AS-CSP Circular.

13. On 26 January 2023, the TPBAC approved its Notice of Invitation to Bid11 informing the public of the pending AS-CSP for Regulating Reserve (RR), Contingency Reserve (CR), Dispatchable Reserve (DR), Reactive Power Support (RPS), and Black Start Service (BSS); and inviting all interested grid-connected merchant plants and Independent Power Producers to apply for eligibility and participate in the competitive bidding for the procurement of AS. The Notice of Invitation to Bid likewise provided any interested grid-connected merchant plants a copy of the DOE approved TOR and Instruction to Bidders.

14. Subsequently, the Notice of Invitation to Bid was published on 31 January 2023 with the Malaya Business Insight12 and the Philippine

16. Under Bid Bulletin 2023-02 issued by the TPBAC, eligible bidders may submit their bids on or before 13 March 2023.

Thereafter, pursuant to Bid Bulletin 2023-02, the TPBAC conducted the opening of bids timely submitted by all the eligible bidders whereby UPSI’s bid/offer16 for the provision of CR by its Generation Facility was considered for award after sufficiently complying with the post-qualification requirements.

18. On 12 April 2023, the TPBAC issued and submitted to the NGCP’s Board of Directors its Resolution and Evaluation Report on the conduct of the CSP17 indicating UPSI as one of the winning bidders. The TPBAC’s Evaluation Report was thereafter confirmed by the NGCP’s Board of Directors through a resolution dated 18 April 2023.18

19. On 18 April 2023, the TPBAC issued a Notice of Award in favor of UPSI19 informing the latter that it is to be awarded with a contract for the Provision of Ancillary Services in the Luzon Grid. The details of the award are as

30. The Computation of True Cost of Generation and the Summary of computed Consumer Price Index for Variable Operation and Maintenance (VOM) Cost, attached to this Application as Annex “X” and Annex “Y”, contain commercially valuable and sensitive information and data that reflect UPSI’s investments, business operations, calculations, and other trade secrets.

31. UPSI thus respectfully moves that these documents are not disclosed and treated as confidential documents in accordance with Section 1, Rule 4 of the Honorable Commission’s Rules of Practice and Procedure. Accordingly, UPSI submits one (1) copy of said documents in a sealed envelope, with the envelope and each page of the document stamped with the word “Confidential”.

ALLEGATIONS IN SUPPORT OF THE PRAYER FOR PROVISIONAL AUTHORITY

32. It is a declared policy of the State to ensure the quality, reliability, security and affordability of the supply of electric power.21 To this end, there is a need to comply with the system requirements for AS to ensure grid system security and reliability. As mentioned above, NGCP has the mandate to procure the required AS. However, the Honorable Commission must first approve the ASPA before the same can be implemented.

33. As the demand for power in Luzon increases, the requirements of the system likewise increases. Ensuring the integrity of the system is essential to protect the interests of the public. The absence of system reliability and stability will certainly discourage investments and growth.

34. Applicants respectfully submit that the immediate approval of the ASPA by this Honorable Commission is a necessity to maintain the present reliability and security of the Grid. In support of these allegations. NGCP submits a copy of the Judicial Affidavit of Ms. Lisaflor B. Kater,22 which is attached to this Application. PRAYER

WHEREFORE, premises considered, Applicants respectfully pray that the Honorable Commission:

1. Immediately ISSUE a provisional authority to implement the subject ASPA executed on 02 May 2023; and

2. APPROVE, after notice and hearing, the subject ASPA.
