Government repeals 251 obsolete regulations

Governor Jenniffer Aidyn González Colón announced Thursday that 12 government agencies in Puerto Rico have repealed 251 obsolete regulations as part of the first phase of the Initiative for Deregulation and Administrative Efficiency (IDEA in Spanish).

“With IDEA, Puerto Rico eliminates what does not work, adopts responsible technologies, and sets a clear agenda for economic development,” the governor stated at a press conference.

Efficiency Coordinator, attorney Verónica Ferraiuoli Hornedo, explained that over 300 public servants were trained and that each agency created its own committee to evaluate regulations, ensuring decisions were justified and aimed at improving public management.

“With the elimination of obsolete regulations, we are clearing out decades of bureaucratic accumulation. The next step is to ensure that every new regulation comes with a regulatory efficiency certification, which will require justifying the need to regulate, considering lighter alternatives, and evaluating costs and benefits,” Ferraiuoli Hornedo noted.

It was detailed that out of 4,160 registered regulations, 90 percent had not been reviewed in more than five years. To date, 2,918 regulations have been classified: 807 will be repealed, 1,245 revised or consolidated, and 866 will remain in effect. The remaining 1,242 are still under evaluation, including 92 belonging to agencies that no longer exist.

The Housing Finance Authority eliminated a 546-page regulation that was replaced with clear rules. At the Department of Health, outdated regulations related to leprosy and auxiliary midwives were repealed, leading to updated rules aligned with modern science.

“The Department of Health took part in a historic process of reviewing and eliminating obsolete regulations that, while relevant in their time, no longer served any function in today’s reality. This regulatory cleanup never compromised patient safety or public health,” said Health Secretary Dr. Víctor Ramos Otero.

The Department of Economic Development and Commerce (DDEC) repealed 87 regulations, including 58 from the DDEC itself and 29 from the Industrial Development Company. The agency stated the measure represents a 67 percent reduction in its regulatory burden.

develop a new banking regulation that represents significant progress in clarity, consistency, and regulatory relevance,” explained Commissioner Mónica Rodríguez Valle.

The IDEA initiative is part of a broader government strategy to modernize processes. The agencies that have formally begun repealing regulations include: the Fiscal Agency and Financial Advisory Authority, Convention District Authority, Housing Finance Authority, Industrial Development Company, the departments of Economic Development and Commerce, Education, Recreation and Sports, Health, the Office of the Commissioner of Financial Institutions, the Office of the Commissioner of Insurance, the Panel on the Special Independent Prosecutor, and the Office of Management and Budget.

As a result, the average age of regulations dropped from 22 to 16 years, and the proportion of regulations not reviewed in over five years was reduced from 90 to 54 percent.

It was also reported that the Government of Puerto Rico is preparing its first official artificial intelligence policy, which will include governance structures in each agency, data protection measures, transparency requirements for citizens, and mandatory human oversight in critical decisions.

“With the implementation of Puerto Rico’s Artificial Intelligence Policy, we are establishing a solid framework that promotes the responsible use of AI. This policy, supported by standard operating procedures, not only facilitates the adoption of advanced technologies but also ensures that every AI system is properly evaluated and supervised,” said PRITS Executive Director Martín Jiménez.

“We are sending a clear message: Puerto Rico is transforming to become the preferred destination for investment, where establishing and expanding operations is not only possible but efficient and attractive,” said DDEC Secretary Manuel Cidre Miranda, through Deputy Secretary Negrón-Reichard.

The Office of the Commissioner of Financial Institutions (OCIF) consolidated eight previous rules into a single updated regulation addressing important regulatory gaps.

“At OCIF, we consolidated six regulations and two circular letters that were already obsolete. This allowed us to

The IDEA initiative was established through Executive Orders OE-2025-009 and OE-2025-023 and is supported by three administrative orders that set guiding principles, mandate a mass review of regulations, and promote the digitalization of government operations.

Each agency has a specialized committee tasked with analyzing regulations and proposing actions to simplify citizens’ lives and improve public service productivity.

For the first time, the Government of Puerto Rico is establishing a uniform regulatory review process, accompanied by clear metrics and measurable results, to prevent a future accumulation of obsolete rules.

Groups representing long-term care homes welcome inspections

Jonathan Morales Adorno, president of the Federation of Long-Term Care Institutions (FICPRO), and Minerva Gómez, president of the Association of Owners of Long-Term Care Centers (ADCCLD), welcome random inspections of the 1,100 homes affiliated with both organizations.

They also strongly condemned the illegal and unethical practice of improperly sedating residents.

In response to public statements regarding allegations of improper sedation in long-term care homes and the recent closures of facilities by regulatory authorities, both Morales and Gómez said eight homes shuttered by the Department of Family Affairs between January and May were “clandestine and unlicensed” and did not belong to legitimate organizations that comply with state and federal laws.

“We are part of a highly regulated industry. The vast majority of licensed homes in Puerto Rico operate under strict regulations from the Department of Family and Health and Addiction Services Administration (ASSMCA). Our institutions comply with inspection, audit, and surprise visit protocols that ensure the quality of services. Generalizing the entire industry based on isolated cases creates a misperception and undermines the trust of families and the dedication of hundreds of caregivers who work with love and commitment,” Morales Adorno said.

Gómez added, “We support fair and rigorous oversight in long-term care homes, but we reject general statements without evidence that cast suspicion on an entire industry committed

to our seniors.” She has already sent a letter on the matter to Representative Wilson Román López and Secretary of the Department of Family, Suzanne Roig Fuertes.

Gómez emphasized that “oversight must be objective, proportional, and within the framework of the law, avoiding practices comparable to ‘fishing expeditions,’ which only generate mistrust. We ask: Were these remote complaints referred to the Department of Family Affairs’ Institutional Abuse Unit? Were they investigated? Were reports submitted? Was due process observed? Any facility that fails to guarantee protective and responsible care must face the consequences, but it is essential to ensure a

lawful process. Generalizing affects our entire service industry.” Morales Adorno not only condemned inappropriate practices but also emphasized that all medications, especially controlled substances, are stored similarly to those in hospitals. He stated, “Nursing homes have a medication registry that records the dosage given to each senior citizen, along with the time and the initials of the caregiver administering the medication. Once a senior citizen leaves the facility, these medications must be disposed of properly. The correct procedure is to contact the pharmacy with which the nursing home has a contract to collect the medications and manage their waste.”

“All duly licensed long-term care facilities in Puerto Rico have general practitioners, internists, and psychiatrists who visit our facilities and prescribe medications for senior citizens based on their condition. The nursing home only dispenses medication according to the doctor’s orders. We cannot administer medications without a doctor’s authorization. This task is performed by a nurse, who ensures that medication control is carried out properly,” summarized Morales Adorno.

As an organization committed to the well-being of older adults, FICPRO categorically rejects any practice that violates the health, dignity, and human rights of residents. Morales Adorno stated, “The improper use of medications as a form of control is not only unethical, but also illegal, and must be investigated and punished with the utmost rigor.”

Both FICPRO and ADCCLD agree that laws need to be improved and greater resources should be provided to both the Department of Family Affairs and ASSMCA.

PPD flags conflict of interest with nominee for disability advocate

The Popular Democratic Party (PDP) delegation in the Senate denounced on Thursday that the newly appointed Disability Advocate (DPI in Spanish), David Figueroa Betancourt, faces apparent conflicts of interest tied to his history of litigation under the federal Americans with Disabilities Act (ADA).

PDP Senate spokesperson Luis Javier Hernández Ortiz, together with Ponce district senator Marially González Huertas, questioned Governor Jenniffer González Colón administration for once again failing to properly vet its nominees.

“Today we raise the alarm about yet another nominee with a questionable background. The new Disability Advocate, David Figueroa Betancourt, appears to have clear conflicts of interest due to his past actions. Figueroa has or had professional ties with attorneys who dedicate themselves to suing businesses, medical offices, and even government entities of the Commonwealth of Puerto Rico,” Hernández Ortiz stated in written remarks.

According to the lawmakers, Figueroa Betancourt has acted as a plaintiff in multiple ADA-related cases, including suits against small businesses, restaurants, private companies, as well as public agencies and municipalities. Entities sued include the Municipality of Santa Isabel, the Public Buildings Authority, the Planning Board, and even the Disability Advocate’s own office.

“The person now heading the DPI has consistently filed lawsuits against small business owners, restaurants, and even government institutions, alleging ADA violations,” González Huertas added.

The legislators also cited reports by journalist Sandra Rodríguez Cotto linking Figueroa Betancourt to attorney José Carlos Vélez Colón, based in North Carolina, who has represented plaintiffs in dozens of similar cases.

The PDP delegation called for Figueroa Betancourt’s appointment to be withdrawn, reminding that, as a recess appointment, he has already been exercising the role for over a month.

“Let us recall that Governor Jenniffer

González Colón announced Figueroa Betancourt’s nomination on July 11, 2025. Since the Senate is in recess, this means the appointee has already been fully performing the duties of the

position for more than a month. This is a highly irregular situation, and the people of Puerto Rico deserve to know about it,” Hernández Ortiz concluded.

On July 11, Governor Jenniffer González appointed David Figueroa Betancourt as the new Advocate for Persons with Disabilities, the same day she also signed several bills expanding the “Bill of Rights” for this population.

Government activates emergency protocol as weather system nears Puerto Rico

The STAR STAFF

The government is closely monitoring a tropical system that could bring heavy rainfall to the island. On Thursday, Public Affairs Secretary Hiram Torres Montalvo, Public Safety Secretary Arthur Garffer, Puerto Rico Aqueduct and Sewer Authority (PRASA) executive president Luis González, Emergency Management and Disaster Administration Bureau (NMEAD) commissioner Ángel Jiménez Colón, National Weather Service (NWS) warning coordinator Ernesto Morales, Energy Czar Josué Colón, and Natural and Environmental Resources Secretary Waldemar Quiles provided an update on preparedness efforts.

A tropical wave located in the central

Atlantic shows potential for cyclonic development and could become a tropical depression by late this week or over the weekend. The system is expected to move near or north of Puerto Rico, bringing increased showers, thunderstorms, isolated wind gusts, elevated seas, and hazardous marine conditions.

In addition, swells from Hurricane Erin are forecast to reach Puerto Rico’s Atlantic waters starting Friday afternoon and persist throughout the weekend. The NWS may issue advisories for dangerous rip currents and strong surf.

“We are at the peak of hurricane season, making it essential to stay prepared and pay close attention to official bulletins for any system that could impact our region,” said Ernesto Morales, NWS warning coordinator.

In response, DSP Secretary Arthur Garffer and NMEAD Commissioner Jiménez Colón confirmed continued coordination with Governor Jenniffer González Colón and other government agencies to ensure municipalities—Puerto Rico’s first line of response—receive the necessary support.

“Today we completed pre-checks across all systems and equipment, and I can state with certainty that the Department of Public Safety is ready to respond quickly and effectively if needed. While the systems currently under watch do not pose an immediate threat to Puerto Rico, we remain in active preparedness and constant coordination with state and federal agencies. Our commitment is clear: to protect the lives and safety of all island residents,” Garffer emphasized.

AMPR meets with governor to demand action on teachers’ claims

Governor Jenniffer Aidyn González Colón met with the Puerto Rico Teachers Association (AMPR) and its Union Local to discuss pressing demands from the teaching profession, including overdue payments under the Teachers’ Career Program, the pension situation of active educators, the deterioration of schools in the southern region, and support for legislative initiatives aimed at restoring rights previously eliminated for teachers.

AMPR president, Professor Víctor Manuel Bonilla Sánchez, stressed that teachers cannot continue facing delays in the fulfillment of their rights. “We know the teaching profession has endured years of unkept promises and lack of action. Our demand has been clear: urgent justice for those who have dedicated their lives to educating generations. It is time to move forward with clarity and commitment; we need concrete and measurable results. Teachers cannot keep waiting—there

is no room for further delays,” he said in a written statement.

The governor acknowledged the backlog in Teachers Career payments and confirmed that the matter is one of her immediate priorities. She noted that she will meet with Education Secretary Eliezer Ramos Parés to outline a disbursement plan, which could be executed in phases.

Union leaders also called for immediate action in the reconstruction of southern schools damaged by the 2020 earthquakes. González Colón affirmed that the issue is among her top priorities and requested that AMPR submit specific recommendations regarding the most affected school communities.

Another issue discussed was the retirement system for active teachers. AMPR presented a proposal that revisits ideas put forward during a 2022 dialogue table. The governor committed to resuming talks on the matter.

Professor Ángel Javier Pérez Hernández, secretary general of the Union Local, emphasized the importance of addressing

the living conditions of retired teachers. “One of our priorities is ensuring that once teachers retire, they can live with dignity. We reminded the governor that we cannot accept educators receiving pensions below one thousand dollars. We have presented concrete proposals and data. We trust that the Executive will demonstrate a clear will to advance real solutions. Teachers value dialogue deeply, but they expect it to translate into concrete results, with clear timelines for compliance,” he stated.

During the meeting, concerns were also raised about the renewal of teachers’ health insurance plans, amid the risk that many could lose coverage in September. González Colón instructed her team to establish direct communication with the Health Insurance Administration (ASES) to evaluate alternatives.

The governor underscored the role of AMPR and expressed openness to future meetings, while the union reiterated its commitment to maintaining active oversight and pressing for immediate action on teachers’ demands.

Dignity Project senator denies filing complaint against Mercarder

Former Puerto Rico Federal Affairs Administrator and political analyst Carlos Mercader has temporarily stepped down from his role on the talk show “Pelota Dura” on NotiUno amid allegations of domestic violence involving his partner, Senator Joanne Rodríguez Veve. This information was confirmed by the show’s host, Ferdinand Pérez, on Thursday.

Rodríguez Veve’s ex-husband, Jaime Sanabria Montañez, issued a statement asserting that the senator neither authorized nor participated in the drafting of a document detailing the alleged incidents of domestic violence, which had been leaked to several media outlets and shared on social media.

“Upon learning of this situation, we reached out to Mercader, and he agreed to voluntarily step back from the program until everything is clarified,” Pérez stated. “There has been a lot of

speculation in recent days, but nothing has occurred beyond the letter that was recently published,” he added, referencing Sanabria Montañez’s statement that Rodríguez Veve had no involvement in filing an anonymous complaint regarding the alleged abuse involving Mercader.

The senator’s press contact, Ricardo Reyes Caparrós, shared these statements with the media. Sanabria Montañez clarified, “Regarding the document circulating on social media and in the press, I want to emphasize that Senator Joanne Rodríguez Veve did not authorize it, nor did she participate in its presentation. The official statement from the Women’s Advocate has already confirmed that the circulated document was altered, did not originate from her office, and was received anonymously.”

Women’s Advocate Astrid Piñeiro Vázquez reported the receipt of a letter containing these allegations. According to the details in the document, Mercader and Rodríguez Veve have

been in a romantic relationship since March 2023, and the alleged incidents of gender-based violence occurred between January 2024 and August 2025. The document also outlines some of the alleged assaults that reportedly took place in front of the minors born to Rodríguez Veve and Sanabria Montañez. However, Sanabria Montañez categorically dismissed these claims as “false.”

“It is untrue that the children have witnessed incidents of violence as insinuated. We strongly reject this falsehood due to the harm it causes to their well-being,” he added.

Neither Mercader nor Senator Rodríguez Veve have made any public comments on the matter.Former Puerto Rico Federal Affairs Administrator and political analyst Carlos Mercader has temporarily departed from Pelota Dura in NotiUno amid allegations of domestic violence involving his partner, Senator Joanne Rodríguez Veve.

Texas House approves redistricting maps, just as Trump wanted

The Texas House passed an aggressively partisan congressional map on Wednesday after weeks of legislative combat, giving President Donald Trump the gerrymander he requested — and possibly five new Republican seats in the U.S. House next year.

After more than eight hours of at-times tense and emotional debate, the final vote, 88-52, fell along party lines. It capped bitterly partisan political wrangling, with a Democratic walkout and Republican retaliation, and set off a redistricting fever that has spread from Austin to Sacramento, California, to Albany, New York.

The state Senate is expected to vote on the map as soon as Thursday evening, then send it by the end of the week to Gov. Greg Abbott for his promised signature.

The redrawing of Texas’ map was only the first battle in what is likely to be a bruising and protracted coast-to-coast clash over redistricting between states led by Republicans and those led by Democrats over the coming months. The California Legislature is expected to vote Thursday on a newly drawn congressional map designed to flip as many as five Republican-held seats to the Democrats, a counterweight to Wednesday’s vote in Texas. California’s changes would then have to be approved by voters in a referendum in November.

If the fight broadens significantly, the outcome of the redistricting war could help determine control in the U.S. House of Representatives, where Republicans hold a slim majority, even before a single vote is cast in what were expected to be very close midterms elections in 2026.

Already, Trump and his allies have been looking past Texas to other Republican states, including Indiana, Missouri and Florida. Be-

Texas!”

With passage in the state House, the map goes to the state Senate, where Republican leaders have an even stronger hand. Once Abbott signs it, Democrats have said they will challenge its legality.

“Texas will have to go to the courts,” said state Rep. Gene Wu, D-Houston, who led the walkout. He implored Democrat-led states to now take action. “California, New York, Illinois, Michigan and many other states — look at what’s happening here,” he said.

The actions by Texas and California this week will likely narrow the battlefield for control of the U.S. House next year, a critical fight that will shape the remainder of Trump’s term. Even so, with the House so narrowly divided, the expanding fight over redistricting alone is not likely to determine control of the chamber.

yond California, Democratic state leaders are looking at Illinois and Maryland ahead of the 2026 midterms, and New York ahead of the 2028 presidential election, vowing to embark on their own mid-decade redistricting efforts.

For Democrats, however, the fight is proving harder. The California effort will require working around the state rules that give an independent commission responsibility for redistricting. That is why the map that is up for passage in the state Legislature there Thursday would also have to be approved by voters.

Republicans have vowed to fight California Democrats’ plan at the ballot and in court. They lost a round on Wednesday when the state Supreme Court rejected a request from Republican state lawmakers to block the Legislature from moving ahead with Thursday’s votes.

The path to passage in Texas has been far simpler, despite sustained Democratic opposition.

Wednesday’s vote on the map had been delayed by more than two weeks by dozens of Democratic state representatives, who left the state to halt its passage by denying the House enough members to meet.

But as soon as they returned Monday, Republicans lawmakers moved swiftly to ensure its passage, rapidly approving an updated version out of two committees and assigning each Democrat a state police chaperone to ensure that representative could not leave again.

“The underlying goal of this plan is straightforward: improve Republican political performance,” state Rep. Todd Hunter, R-Corpus Christi, said Wednesday in a speech introducing the map legislation, known as House Bill 4.

“According to the U.S. Supreme Court, we can use political performance” in drawing congressional districts, he said. “And that is what we’ve done.”

One Republican member from the Fort Worth area, David Lowe, wore an oversized round pin reading “Big Beautiful Map” — a reference to Trump’s description of the Texas redistricting.

As debate began, chants and cheers could be heard through the closed doors from dozens protesting in the Capitol rotunda against the redistricting.

“House Bill 4 is an illegal and racially discriminatory congressional map that this body has no business passing,” said state Rep. Chris Turner, a Dallas-area Democrat. “This illegal and rigged mid-decade redistricting scheme is dividing our state and our country.”

Republicans have revised the map that has been under consideration since it was introduced last month. It would still aim to flip the five seats that Trump has publicly called for, but it was reworked slightly to place additional Republican voters in the districts where Republicans already hold House seats.

“Please pass this map ASAP,” Trump urged on social media Monday. “Thank you,

Some of the districts being redrawn in the two states could remain competitive in a nonpresidential election.

Even without the states most likely to redistrict — Texas, California and Ohio — 27 House seats that were decided in 2024 by fewer than 5 percentage points will remain in states unlikely to redraw their maps. Of those, 14 are held by Republicans, 13 by Democrats.

Still, Texas is the biggest prize available for Republicans, Trump has said.

And tensions have been rising in the state Capitol this week.

The day’s most heated moments came over the question of race and how the new map impacts districts currently occupied by Black members of Congress in the Houston and Dallas areas. In Houston, the map moves the 9th Congressional district, held by U.S. Rep. Al Green, an outspoken Trump critic, to an area where Republican voters predominate.

Hunter and Barbara Gervin-Hawkins, a Democratic state representative from San Antonio, argued over whether the Black members of the House were consulted over the map. “We weren’t asked any questions,” said Gervin-Hawkins, who is Black.

Hunter, who is white, disagreed. The two members interrupted each other several times. “Members, please try not to talk over one another,” Burrows interjected at one point.

“You own the walkout,” Hunter said to Gervin-Hawkins, talking loudly across a chamber that had grown otherwise quiet. “Don’t come into this body and say we didn’t include you. You left us for 18 days.”

Federal agents detain dozens of workers in raid at New Jersey warehouse

Federal officers detained dozens of immigrant workers at a warehouse in Edison, New Jersey, on midweek in what appeared to be among the largest federal raids in the state since President Donald Trump took office.

The hourslong operation was conducted by U.S. Customs and Border Protection, whose officers arrived at the warehouse along a busy stretch of shipping facilities west of New York City about 9 a.m.

The federal officers arrested 29 people, according to the Edison mayor’s office, which said that the township’s Police Department had been notified that the Department of Homeland Security, which runs the customs agency, would be in the area Wednesday.

The purpose of the operation remained unclear Wednesday night, and it was unclear if other federal agencies had been involved. The Department of Homeland Security and Customs and Border Protection did not reply to requests for comment.

A Customs and Border Protection spokesperson told Univision that the agency had carried out “a surprise inspection” of the warehouse. The agency also told Univision that the operation was part of routine customs enforcement efforts, not specifically immigration-related, but that officers had checked the immigration status of workers.

The warehouse — where packages were stacked high in a space about the size of a professional football field — handles shipping for major online retailers, distributing packages across the Northeast, three workers told The New York Times.

The facility is a bonded warehouse, a facility where importers can store foreign goods still in transit without immediately paying import duties and that is under the supervision of Customs and Border Protection, one worker said. The agency has said that it is authorized to conduct unannounced inspections at bonded warehouses to ensure that facilities are adhering to “protocols for the importation of cargo entering the United States.”

Workplace immigration raids have been uncommon in the New York City area, where most arrests have unfolded inside immigration offices and courthouses. Wednesday’s warehouse raid appeared to be at least the second this summer in Edison, a township and commercial hub of about 100,000 people that is about a one-hour drive from New York City.

On July 8, the immigration authorities raided a wine and liquor warehouse in Edison during a “worksite compliance inspection,” arresting 20 workers, mostly from South and Central America, who officials said were in the country illegally.

Many of the workers detained Wednesday hailed from Ecuador, Guatemala, Mexico, Peru and elsewhere, workers and activists said.

Workers who were interviewed Wednesday night described a chaotic scene of fear and confusion that began when about 20 federal agents stormed through the front door, while another group emerged from vehicles outside, blocking potential points of escape.

Inside, workers ran, yelling, “La migra,” which is Spanish shorthand for the federal immigration authorities, according to the workers, who spoke on the condition of anonymity, and activists who were outside and spoke with some employees as they were released. Some workers were injured during the scramble, workers and activists said, and a video showed at least one ambulance arriving on the scene.

Some workers hid from the officers in the warehouse’s towering rafters, remaining there for hours even after officers flew a drone inside the warehouse to try to find them, the people said in interviews. Some texted relatives from their hiding spots.

The agents did not state the purpose of their visit, according to some workers, and told those present to gather in a corner where workers were taken into a meeting room to be interrogated one by one.

Officers spent hours checking the workers’ immigration status, placing yellow wristbands on those whom they

determined to have legal status and leading others away in zip ties, employees said. Agents searched the warehouse and trucks to make sure no workers were hiding.

Amanda Dominguez, a community organizer at New Labor, an advocacy group that represents low-wage immigrant workers, said that the warehouse workers had been hired by a staffing agency, calling the raid an “an attack on working-class people.”

Outside, activists and relatives of the workers gathered throughout the day, searching for answers and waiting anxiously to see if their relatives had been detained or let go.

“People were very upset and crying and angry, completely understandably,” said Ellen Whit, who works at DIRE, a New Jersey hotline that responds to calls about raids and from relatives of immigrants who have been detained. “One girl’s father was taken. She was very, very upset.”

The facility was largely desolate Wednesday evening, its forklifts mainly quiet as supervisors called temporary employment agencies to help replace the detained workers.

Trump’s attempt to make museums submit feels familiar

Before Poland’s illiberal Law and Justice party came to power in 2015, the country had been deep in a reckoning over its role in the Holocaust. In 2000, historian Jan Gross published an explosive book, “Neighbors,” about a 1941 massacre in the Nazi-occupied Polish town of Jedwabne, where Poles enthusiastically tortured and murdered up to 1,600 Jews. The book punctured a national myth in which Poles were only either heroes or victims in World War II.

After “Neighbors” came out, Poland’s president, Aleksander Kwasniewski, went to Jedwabne for a ceremony broadcast on Polish television. “For this crime, we should beg the souls of the dead and their families for forgiveness,” he said.

The notion of Polish historical guilt made many conservative Poles furious. Law and Justice capitalized on their anger, running against what its leader called the “pedagogy of shame.” After the party’s 2015 victory, one of its first targets was the Museum of the Second World War, then being built in Gdansk.

The museum was supposed to explore the war’s global context and to emphasize the toll it took on civilians. Among its collection were keys to the homes of Jews murdered in Jedwabne. Before it ever opened, Law and Justice wanted to shut it down for being insufficiently patriotic.

Today in America, this history has an eerie familiarity. Five years ago, many institutions in the United States tried, with varying degrees of seriousness and skill, to come to terms with our country’s legacy of racism. A backlash to this reckoning helped propel Donald Trump back into the White House, where he has taken a whole-of-government approach to wiping out the idea that America has anything to apologize for. As part of this campaign, the administration seeks to force our national museums to conform to its triumphalist version of history.

In March, Trump signed an executive order, “Restoring Truth and Sanity to American History,” criticizing versions of history that foster “a sense of national shame.” Museums

and monuments, it said, should celebrate America’s “extraordinary heritage” and inculcate national pride. This week, the administration announced that it was reviewing displays at eight national museums — including the Museum of American History, the National Museum of African American History and Culture and the Smithsonian American Art Museum — and giving them 120 days to bring their content in line with Trump’s vision.

We’re already seeing glimpses of what that looks like. Last month, the National Museum of American History removed references to Trump’s impeachments from an exhibit on the American presidency. Those references were restored last week, but with changes: The exhibit no longer says that Trump made “false statements” about the 2020 election or that he encouraged the mob on Jan. 6.

Amy Sherald, the artist who painted Michelle Obama’s official portrait, canceled an upcoming solo show at the National Portrait Gallery after being told the museum was considering removing her painting of a transgender Statue of Liberty to avoid angering Trump.

The National Portrait Gallery denied this, but the Trump administration declared victory. “The Statue of Liberty is not an abstract canvas for political expression — it is a revered and solemn symbol of freedom, inspiration and national unity that defines the American spirit,” said Lindsey Halligan, a Trump lawyer who is now in charge of getting museums to reflect the administration’s ideology. What Trump and his allies seem to want from our museums is self-glorifying kitsch, the aesthetic lingua franca of all authoritarians.

For Pawel Machcewicz, founding director of the Museum of the Second World War, it’s been unsettling to see American museums subject to the sort of political intimidation he experienced in Poland. “I believed that American democracy had somehow stronger rules,” he told me by phone this week. “It’s older than Polish democracy. I thought the autonomy of research, the autonomy of museums, would be something sacred in the U.S. It turns out that it can also be subverted. So this is a very pessimistic lesson for us.”

But Machcewicz’s story has a lesson for Americans that’s at least cautiously optimistic. Rather than submit to Law and Justice’s attempt to destroy his museum, he battled the administration in court and was able to hang on long enough to open it in 2017. After only two weeks, the government succeeded in ousting him, but the fight over the museum’s fate garnered major national and international attention, dramatizing the autocratic nature of the new Polish regime.

Standing up to his government was costly. Machcewicz said he was subject to two separate criminal investigations, and for a time he left the country. “There is a high, high price to pay for such a resistance, and I am not going to condemn anyone who is not willing to pay such a price,” he said. But for him, it was worth it. After Law and Justice lost the 2023

election, Machcewicz became chair of the board of the museum, and it has been restored to its original design. That doesn’t mean the contest is over; Law and Justice may well retake power in 2027. But for now, Machcewicz has the peace that comes from doing the right thing. “If I had capitulated, I would have been a completely frustrated man, because I would feel like someone who has betrayed himself,” he said. It’s a message that those who are tempted to try to appease this administration, at our museums or anywhere else, might remember.

¿Es normal este dolor?

Cómo saber si tu rodilla o cadera necesitan evaluación médica

Hospital

Five international movies to stream now

Intriguing dramas in rural settings dominate this month’s picks.

‘Sweet Dreams’

I’ve been eagerly awaiting a new film from Ena Sendijarevic ever since her debut feature, “Take Me Somewhere Nice,” blew me away in 2019 with its mordant, sharply observed tale of a Dutch teenager reconnecting with her estranged Bosnian father and his homeland. Her follow-up, “Sweet Dreams,” which premiered at festivals in 2023, is finally available to stream in the United States — and it confirms Sendijarevic as one of the directors to watch in world cinema today.

Set in Dutch-ruled Indonesia in the early 20th century, the film is an exquisitely staged historical drama about a colonial family’s downward spiral after the death of their patriarch. Jan (Hans Dagelet), the owner of a sugar plantation, dies suddenly one day. No one’s all that upset about it: His neglected, corseted wife (Renée Soutendijk) seems relieved, and Jan’s son Cornelius travels in an almost gleeful haste from the Netherlands in the hopes of selling the estate and making some money. The only problem is that Jan has left all his wealth and property to the young son he has sired with Siti (Hayati Azis), the family maid.

The air is thick with humidity, mosquitoes and the rebellious grumblings of the Indonesian workers. The Dutch characters, sweating profusely in their aristocratic attire, are both sinister and clownish as they desperately try to maintain control. With a keen eye for both atmosphere and the violent absurdities of colonial domination, Sendijarevic shows us how brittle the veneer of so-called Western civilization really is

when power and profit are at play. (Stream it on Tubi.)

‘Asog’

Sean Devlin’s Philippines-set film is a queer drama in the truest sense of the term — it defies all labels, irreverently mixing genres and tones to create something proudly original. “Asog” follows Rey Aclao, aka Jaya, a trans TV anchor and performer, on a road trip to Sicogon Island, where she’s hoping to compete in a drag pageant. Jaya’s life and career were destroyed by Typhoon Haiyan, which swept across the Philippines in 2013, taking thousands of lives and destroying homes and infrastructure. Jaya is joined on her journey by Arnel Pablo, a high school student who lost his mother to the typhoon, and is visiting his father to collect money for her death commemoration ceremony.

for much of the movie’s first half, we’re enveloped in the same fog of confusion as her, quietly watching and listening as her mother carts her dad off every month to a secret location, animals disappear from their farm, and her parents whisper and argue behind closed doors.

We soon learn that Noah is the bearer of a hereditary curse, and that loving him comes at a price. But mysteries remain: Is the horror he emanates only the supernatural kind, or is there something more banal — and thus scarier — in the pull he exerts over the family? “The Beast Within” is a creature feature that operates like a chamber drama; there are no innocent villagers who are terrorized, or fields that are rampaged. Instead, the danger lies within the home, in the everyday monstrosities of toxic men. (Stream it on Hulu.)

‘Moon’

Mixed martial arts fighter Sarah (Florentina Holzinger) has reached the end of her competitive career, and in her small Austrian hometown, future prospects look bleak. When we meet her, she’s coaching two half-hearted young girls who accuse her of intruding on their personal space; later, she’s arguing with her sister, whose house she is crashing in. So when a job offer arrives from abroad — the scion of an ultrarich family in Jordan wants her to train his sisters for a month — it seems like a no-brainer. She is flown out and put up in a fancy hotel. Then she’s made to sign a nondisclosure agreement — which is the first clue that something’s amiss.

Along the way, the two meet several other people whose lives were drastically affected by Haiyan — including the residents of Sicogon Island, who for years have been fighting a real estate company that swept in after the storm in an attempt to drive them out and build a luxury resort on their ancestral land. All the characters in “Asog” are real people who play themselves, but Devlin (who wrote the film with Jaya and Pablo) crafts a fable-like film, with animated interludes, slapstick comedy, flamboyant agitprop and many other flourishes that allow the subjects to tell their stories on their own terms — with humor, rage and imagination. The film ends on a bittersweet note of solidarity and resistance, but its real victory came after it premiered at festivals: The acclaim that it garnered led to the real estate company compensating 784 displaced families on Sicogon Island with $5.1 million in reparations. (Stream it on Film Movement Plus. Rent it on Amazon Prime Video.)

‘The Beast Within’ Kit Harington stars in this gothic English spin on the werewolf myth. The action unfolds in rural West Yorkshire, where a family of four — 10-year-old Willow (Caoilinn Springall), her mother, Imogen (Ashleigh Cummings), her father, Noah (Harington), and her grandfather, Waylon (James Cosmo) — all live in what seems like enforced isolation and constant menace. Willow is our entryway into the film’s world, and

Directed by Iraqi-born Austrian filmmaker Kurdwin Ayub, “Moon” is a taut thriller of few words and mounting tension. The palatial mansion in which Sarah’s clients live feels like a mausoleum: quiet and ghostly. The girls she is tasked with training are shifty and nervous. There’s no internet in the house, and strange whispers and cries can be heard. Ayub is skillfully coy with exposition — details emerge in bits and pieces — and puts us squarely in the shoes of her befuddled heroine, an outsider who can tell that something is wrong but knows too little, and has too little power, to do anything about it. Driven by Holzinger’s raw, restrained performance, “Moon” upturns white-savior tropes, instead painting a gutting portrait of futility in the face of injustice. (Stream it on Mubi.)

‘Suro’

When Helena (Vicky Luengo) and Ivan (Pol López) leave the city to move to the Spanish countryside, they dream of an idyll. Helena has inherited a house surrounded by a cork estate from her aunt, and the couple plans to raise their sooncoming baby in this sun swept rural village, with fresh air and golden fields. But when they hire a local foreman to harvest the cork, their bubble begins to burst. Ivan, who prides himself on being equitable, tries to insinuate himself among the workers, but they only view him with wariness; in their eyes, he is the “landowner’s husband,” a term loaded with unspoken judgment. Then there are the Moroccan immigrant laborers employed by the foreman, whom Ivan and Helena try to help, only to worsen problems and deepen parochial rifts. Meanwhile, forest fires lurk on the horizon, threatening to burn it all down. Shot and performed with a gorgeous naturalism, “Suro” subtly, intelligently, exposes the naiveté of its protagonists, city-bred do-gooders whose idealism conceals an oblivious narcissism. Fed’s expansive experiment in strategy to get a reboot at Jackson Hole

MOST ASSERTIVE STOCKS

The U.S. Federal Reserve’s pivot toward the labor market in 2020 will get a reboot on Friday when Fed Chair Jerome Powell is expected to release a new framework for the central bank that accounts for a half-decade in which inflation surged, jobs were plentiful, and uncertainty became the watchword.

The new document may not completely discard the language rolled out when the Fed, in the midst of the pandemic and a burgeoning social justice movement, pledged not to short-circuit labor market gains on the mere threat of inflation in hopes of achieving “broad-based and inclusive” levels of

who helped organize the 2020 framework review as a top Fed adviser. “The world looks very different today.”

Powell has already acknowledged that the language adopted in 2020 had been overtaken by the surge of inflation during the COVID-19 pandemic and was likely on its way out. He is expected to detail the new strategy document when he addresses an annual Fed research conference on Friday.

Minutes of the Fed’s July 29-30 meeting released on Wednesday said the committee was close to finalizing changes to its statement of principles and reiterated that it “would be designed to be robust across a wide range of economic conditions.”

The current approach has been criticized for introducing complexities that may have slowed the Fed’s response to emerging inflation in 2021 and proved irrelevant to how the economy evolved during the pandemic.

Much of what was introduced in 2020, especially a controversial promise to allow periods of high inflation to offset low ones so it averages 2% over time, grew out of the Fed’s experience trying to lift interest rates from near-zero where they had been mired after the 2007-to-2009 recession.

employment.

But Powell has flagged that a recalibration is coming, potentially emphasizing stable inflation as a foundation for the best labor market results, and relegating some ideas to times when the economy is abnormally weak or inflation is abnormally low, as occurred in the decade before the pandemic.

In those years, as the Fed organized a nationwide series of community listening tours, staffers would ask about inflation and “people would look at us like we had two heads. It was not the topic” when employment and growth concerns were more paramount, said Duke University professor Ellen Meade,

That approach may remain appropriate during prolonged economic weakness, said former Fed Vice Chair Richard Clarida, who helped oversee the last framework revisions. But the approach for normal times may revert to the more straightforward inflation-targeting the Fed previously used.

“A verbatim reading of the 2020 statement holds up pretty well operating in the environment the Fed had been operating in for a dozen years. Inflation below target. Secular stagnation,” said Clarida, now global economic adviser for Pimco. But “2025 is not 2020. We have policy space.”

A rail platform becomes a lab to identify 6,000 bodies sent from Russia

The bodies arrive by the hundreds on a dusty railroad platform, nameless, mutilated, unearthed from mud, sand or collapsed trenches. In quick procession, they are unloaded in their white bags from a refrigerated car and wheeled to a trackside field lab, where they are examined and documented with quiet efficiency.

This vast shipment of the dead, returned by Russia in a swap with Ukraine, is one of the few results of three rounds of U.S.-orchestrated ceasefire talks. Those negotiations and a summit Friday between President Donald Trump and Russian President Vladimir Putin have done little to slow the fighting on the battlefield.

Ukraine hopes to identify each of the 6,000 bodies it has received from Russia under a deal reached in Istanbul — which also included a prisoner exchange — and return the soldiers’ remains to loved ones.

The bodies are just a fraction of the more than 70,000 people in Ukraine, both military personnel and civilians, who have been listed as “missing under special circumstances,” the legal designation for those who have disappeared during more than three years of war.

The first remains arrived in Ukraine in June. A conveyorbelt-like process at a railway station in the Odesa region in southern Ukraine is intended to speed up identification, bypassing traditional autopsies in morgues, which are already overloaded.

Six teams in total carry out forensic work under a section of the platform shaded by camouflage netting stretched to block the searing summer sun. Each team includes a police

investigator, a forensic technician, a pathologist, an intelligence officer and a sanitation worker.

“We are the first in Ukraine to organize this kind of work,” said Tetyana Papizh, the head of the regional forensic bureau.

The bodies are moved from station to station in a process that takes about 20 to 30 minutes for each. Workers check for explosive materials, document any personal items found with

the remains and take samples for DNA testing.

When possible, the teams perform fingerprinting using a technique in which fingers are soaked in water heated close to boiling, then injected with cold water to restore fingerprints.

The bodies receive 17-digit identification numbers, encoding the date of arrival, the institution that received the body and an individual sequence number.

Documents, tags, jewelry or scraps of clothing retrieved from the bodies can help in identification. If any are found, a technician photographs them, bags them separately and places them back with the remains in a new body bag.

“Personal items are extremely important,” said Andriy Shelep, a senior police investigator working on crimes committed during the war. “Some families don’t trust DNA results. They won’t accept death. They believe their loved one is still in captivity. But when they see the recovered items, the doubt is gone.”

Tension from working with the dead is unspoken but present in every movement on the railway platform, where the air was thick with the smell of decay.

Ruslana Klymenko, 27, a pathologist, leaned over a halfdecomposed body. Stains from body fluids had penetrated multiple layers of her protective suit. On her head, she had tied two pink ribbons, the only bright element in a dim scene under the camouflage nets.

“Lower jaw is missing,” she said to an investigator, who documented the finding.

Every few minutes, another white bag was laid out on the table and opened. What looked like rags and dirt inside may be putrefied tissue.

is arrested in sabotage of pipelines between Russia and Germany

Italian police have arrested a Ukrainian national who German investigators believe coordinated the undersea bombing in 2022 of two gas pipelines that directly linked Russia to Germany, the German authorities said Thursday.

It was the first arrest in the act of sabotage that occurred as the war in Ukraine raged, a technically sophisticated attack that had initially stumped investigators and led to much speculation about who had carried it out. Western investigators and intelligence officials later concluded that the attack was carried

out by a pro-Ukrainian group.

“The federal prosecutor’s office has achieved a very impressive investigative success: It has identified and arrested a suspected mastermind behind the bombing of the Nord Stream pipelines,” Stefanie Hubig, Germany’s justice minister, said in a statement.

The man, whom German prosecutors only identified as Serhii K. in accordance with strict privacy rules, was arrested early Thursday by Italian officers in Misano Adriatico, a small seaside resort on Italy’s east coast. The prosecutors said the suspect was a Ukrainian national.

It’s likely to take some time before the suspect is extradited to Germany, where he would face a German judge, an indictment and ultimately a trial, according to Ines Peterson, the spokesperson for Germany’s federal prosecutor’s office.

Prosecutors said they believed that the arrested man coordinated the bombing, which was carried out by a crew of divers who planted explosives on two sets of undersea pipelines, known as Nord Stream 1 and Nord Stream 2. The crew chartered a sailboat in Rostock, a German port city on the Baltic Sea, by using a shell company and fake identity papers and boating licenses, prosecutors said.

On Sept. 26, 2022, a patrol noticed a concentration of bubbles that turned out to have resulted from the massive underground explosions that damaged three of the four pipes.

The pipelines were not operational at the time of the explosion.

Germany had refused to use the recently completed Nord Stream 2 in the lead-up to the Russian invasion of Ukraine in early 2022, fearing that Moscow would use it to exert its influence over Western Europe. Russia had cut off gas flowing through Nord Stream 1, a move European officials believed was made to punish Europe for its opposition to the war in Ukraine.

The explosions promoted widespread speculation about who was behind the attack, with many blaming Russia, Poland or even the United States. It took investigators months to conclude that the crew behind the attack was working for Ukraine, which had the most to gain by ensuring that Russia could not easily export gas to Europe.

The Ukrainian government has denied that it ordered or coordinated the attack.

The arrest Wednesday came more than a year after German prosecutors issued an arrest warrant for another Ukrainian man in the case. That suspect left Poland before the police could arrest him.

Brazil wanted America’s help mining rare earths. Then came tariffs.

Tucked under layers of clay and rock, Brazil has a bounty that much of the world covets: millions of tons of rare earth minerals needed to build drones and robots, electric cars and guided missiles.

For years Brazil and the United States have quietly discussed how American investment and assistance could help the South American country unlock these vast reserves of rare earths, the world’s second largest.

But now, the diplomatic crisis between the Western Hemisphere’s two largest nations risks derailing years of U.S. efforts to secure access to Brazilian rare earths.

By loosening China’s grip on strategic minerals crucial to the economies and battlefields of the future, both nations stood to gain from such an alliance, according to current Brazilian and former U.S. officials.

American support could help Brazil become a global powerhouse in the extraction and processing of rare earths. And Brazilian rare earths could reduce American dependence on China, which controls about 90% of world supplies — and has shown itself willing to withhold them.

The talks about this alliance, which have not been previously reported, were at an early stage. Then, Brazil’s rare earths were suddenly thrust into the bitter trade dispute between the two countries that erupted last month.

Ties between the Brazil and the United States frayed when President Donald Trump targeted the country with 50% tariffs to help his political ally, Jair Bolsonaro, the former Brazilian president, who is facing criminal charges for plotting a coup.

Just before tariffs were imposed on Brazil, the United States signaled that access to Brazil’s strategic minerals should be part of trade talks. President Luiz Inácio Lula da Silva snapped back, accusing the United States of threatening his nation’s sovereignty.

“No one lays a hand,” Lula said last month, referring to Brazil’s critical minerals. “This country belongs to the Brazilian people.” Brazilian officials also made clear that they will now seek to explore tapping its rare earth deposits with other allies, like India.

“With Brazil, we were pushing an open door,” said José Fernandez, a former top official at the State Department. “I don’t

A mine in Minaçu, Goias state, Brazil, that produces rare earth elements, including neodymium, praseodymium, terbium and dysprosium.

know if this will backfire, but it certainly will not help.”

Brazil is believed to hold between 19% and 23% of global reserves of rare earths, a group of 17 elements needed to make powerful magnets used in a range of products, from electric cars and wind turbines to missiles and fighter jets.

For decades, China, home to 40% of rare earth deposits, has dominated global supply chains of the minerals, which are plentiful in the earth’s crust but difficult to extract and separate. The West has mostly left to China the hard work of mining, processing and refining rare earths into magnets imported by the United States and other countries. For some rare earths, China is virtually the only country able to separate and process them.

But other countries have grown wary of China’s chokehold. Beijing cut off supplies to Japan in 2010 and is now withholding some critical minerals and magnets from the United States in response to tariffs. To reduce its reliance on China, the Pentagon has poured millions into a Las Vegas-based mining company, MP Materials, becoming its largest shareholder.

Brazil has emerged as perhaps the most promising challenger to China’s monopoly. It has reserves of about 21 million tons, though it may be years away from producing significant amounts of the minerals.

“There is still a lot to be explored, to be studied,” said Inácio Melo, director-president of the Brazilian Geological Survey. “Brazil has enormous potential.”

For now, just one Brazilian mine, partially backed by American investors, is

churning out small quantities of minerals, which still have to be shipped to China for processing. But Brazil has ambitious plans to build a domestic supply chain spanning mines, processing plants and magnet factories.

Until recently, the United States had been helping Brazil inch closer to its goals. Biden administration officials made at least five visits to the country from 2022 to 2024, according to Fernandez, who participated in some of the meetings.

Brazil’s main focus in these discussions was securing technical assistance and American investment, Fernandez said. “Brazil was a very willing partner,” he added.

In the months after Trump took office, the top U.S. diplomat in Brazil, chargé d’affaires Gabriel Escobar, met with Brazil’s mining association to discuss a possible partnership on rare earth minerals, according to Raul Jungmann, the group’s president.

Then, in July, two weeks after Trump threatening Brazil with high tariffs, Escobar requested another meeting, according to Jungmann.

“The first time, he was more concerned with partnerships,” Jungmann said. The second time, the tone was more insistent, he added. “He made the United States’ interest in strategic critical minerals very clear, very explicit.”

In Brazil, a country sensitive to foreign involvement in its resources, after decades of booms and busts in commodities like rubber and sugar, U.S. interest in rare earths made headlines and triggered anger and suspicion.

Then, after the tariffs took effect and negotiations over a trade deal hit a stalemate, some Brazilian officials struck a more conciliatory tone, signaling they were open to putting rare earths on the negotiating table.

Trade talks between Brazil and the United States have since stalled, with Brazil accusing Trump of ignoring its attempts to negotiate and Trump insisting the country drop its case against Bolsonaro, which many in Brazil see as central to safeguarding the nation’s democracy.

Last week, tensions escalated when Trump accused Brazil of being a “horrible trading partner.” Lula shot back, pointing out that his nation runs a trade deficit with the United States. “We’re still willing to negotiate, but Brazil won’t kneel before the United States.”

Brazil now appears to be forging ahead largely without the United States. It is studying its deposits with the help of a Spanish mapping firm and working toward improving its processing abilities through a publicprivate partnership backed by more than two dozen companies and research groups from around the world.

The tariffs on Brazil were softened by hundreds of exceptions, but rare earths were notably absent from the list. That would make American firms reluctant to invest in the country’s rare earths, according to Sergio Fontanez, a former government adviser and chair of the U.S. Export-Import Bank, a government export credit agency.

“There’s an opportunity there for us,” Fontanez said. “But what you’re essentially creating now,” he added, “is an embargo for U.S. companies.”

Big tech’s AI data centers are driving up electricity bills for everyone

Just a few years ago, tech companies were minor players in energy, making investments in solar and wind farms to rein in their growing carbon footprints and placate customers concerned about climate change. But now they are changing the face of the U.S. power industry and blurring the line between energy consumer and energy producer. They have morphed into some of energy’s most dominant players.

They have set up subsidiaries that invest in power generation and sell electricity. Much of the energy they produce is bought by utilities and then delivered to homes and businesses, including the tech companies themselves. Their operations and investments dwarf those of many traditional utilities.

But the tech industry’s all-out artificial intelligence push is fueling soaring demand for electricity to run data centers that dot the landscape in Virginia, Ohio and other states. Large, rectangular buildings packed with servers consumed more than 4% of the nation’s electricity in 2023, and government analysts estimate that will increase to as much as 12% in just three years.

The AI boom threatens to drive up power bills for residents and small businesses. Nationally, the average electricity rate for residents has risen more than 30% since 2020. Much of that increase has been driven by utilities catching up on deferred maintenance and hardening grids for extreme weather. But in the coming years, AI could turbocharge those increases.

It is difficult to predict what that will mean for consumers’ power bills. But recent reports expect data centers will require expensive upgrades to the electric grid, a cost that will be shared with residents and smaller businesses through higher rates unless state regulators and lawmakers force tech companies to cover those expenses.

A June analysis, from Carnegie Mellon University and North Carolina State University, found that electricity bills are on track to rise an average of 8% nationwide by 2030 and as much as 25% in places like Virginia because of data centers.

In some places, it is happening already. Starting in June, the electricity bill for a typical household in Ohio increased at least $15 a month because of data centers, according to data from a major local utility and an independent monitor.

Data centers owned and operated by Amazon Web Services in Ashburn, Va., March 10, 2024. Electricity rates for individuals and small businesses could rise sharply as Amazon, Google, Microsoft and other technology companies build data centers and expand into the energy business. (Nathan Howard/The New York Times)

Tech companies insist they are not trying to fob energy costs onto residents and small businesses, saying they are willing to pay for the power they use and for much of the equipment needed to make it available. But getting the companies to make consumers whole will not be easy because determining how much large users like data centers should pay is not straightforward.

The business of keeping America’s lights on is mostly about two things: supplying reliable electricity and figuring out what to charge to deliver it. In recent years, big tech companies have inserted themselves into debates over both. They lobby lawmakers and regulators, and they are pitching their own pricing schemes to challenge those of utilities.

The utilities pay for grid projects over decades, typically by raising prices for everyone connected to the grid. But suddenly, technology companies want to build so many data centers that utilities are being asked to spend a lot more money a lot faster. Lawmakers, regulators and consumer groups fear that households and smaller companies could be stuck footing these mounting bills.

“Unless people lean on the public utilities commissions, the ratepayers will take it on the chin,” said Mark Cooper, an economic analyst at the Institute for Energy and the Environment at the Vermont Law and Graduate School.

In the debate over who will foot the bill, the industry’s eyes have been fixed on Ohio.

On a snowy day in December, a firstof-its-kind showdown played out in a small hearing room in Columbus. Lawyers for Ama-

zon, Google, Microsoft and other technology companies faced off against representatives of an electric utility.

The tech companies had plans for dozens of new data centers — so much that the local utility, American Electric Power, projected it would need six times the electricity central Ohio produced.

The utility had spent months meeting with the state’s consumer representative, tech companies, related industries and the staff of the regulator, the Public Utilities Commission of Ohio, to hammer out a deal.

But in October, before the negotiations were done, the tech companies gave the utility a few days’ notice that they were submitting their own proposal. Industry experts said they had never seen that kind of front-running before. Under the companies’ plan, they would pay less upfront than the utility had wanted.

Days later, the Ohio utility, the consumer representative and the regulator’s staff countered with a plan that would create a class of customer for data centers and would require them to pay more. This category would be in addition to the four main types of electricity customers — homes, businesses, factories and public rail systems — that pay different rates in Ohio and other states.

American Electric Power, which has 5.6 million customers in 11 states, warned the judge that if the state did not adopt its proposal, residents and smaller businesses would bear much of the costs for tech companies’ power demands.

Despite tech companies’ professed desire not to burden others, they often push regulators to impose some of the upgrade costs on everybody. They contend that data centers bring jobs to the area and that grid upgrades will ultimately help local businesses and residents.

The utility in Ohio has already committed to supplying electricity for 30 data centers in the region by 2030. But the tech industry is making additional requests to power 90 more data centers.

“We’re used to a couple megawatts added to our system,” Marc Reitter, the chief operating officer at the utility, said. “Massive amounts of power is extremely new territory.”

The utility’s proposal for a new category of customer will require data centers to make years of payments for the energy they need — something other customers are not required to do. It wanted data centers and cryptocurrency miners to pay at least 85% of the electricity

they request, even if they did not use it.

But Amazon, Google, Meta, Microsoft and other tech companies said they should pay less than what the utility wanted. The settlement the companies filed had committed to 75% of the electricity they requested, depending on the length of the contract. That would leave other utility customers to shoulder more of the cost of new grid equipment.

In addition, the tech industry wanted all large customers, including factories, to be treated the same. And it proposed a higher threshold for determining if data centers should be considered large users than in the utility-led proposal.

Kevin Miller, who was until recently a vice president at Amazon, said the Ohio utility’s plan could result in tech companies overpaying because data centers ramp up operations in phases. And data centers could be required to pay for power even if the utility failed to deliver all the energy it had committed to supplying, he said.

Last month, after spending months weighing the proposals, the commission ruled 5-0 against the tech companies. Last Friday, the tech companies asked the commission to reconsider the case, calling the ruling “unlawful and unreasonable.”

The Ohio ruling hinged on a big concern for utilities and lawmakers: that the tech companies may be asking for a lot more power than they will ultimately use. The worry is that executives could overestimate demand for AI or underestimate the energy efficiency of future computer chips. Residents and smaller businesses would then be stuck covering much of the cost because utilities largely recoup the cost of improvements over time as customers use power rather than through upfront payments.

These are not idle fears. Tech companies have announced plans for data centers that are never built or delayed for years.

The utility’s executives said their proposal sought to protect all customers if tech companies abandoned or delayed projects. They pointed to a case in Virginia where regular customers had to cover initial costs of grid upgrades for a data center that started operating years later than planned.

In that case, a developer of data centers, Unicorn Interests, told Dominion Energy, a large utility, in 2010 that it would build a data center next to the regional airport in Manassas, near Washington, that would need electricity by July 2013.
