mid the increase in COVID-19 hospitalizations in Puerto Rico, Gov. Pedro Pierluisi Urrutia announced Wednesday that he is monitoring the numbers in case he has to increase restrictions in the next executive order to stop the spread of the coronavirus. “I am monitoring from day to day. If there is reason to restrict it, I will do so, although right now there is not that justification,” Pierluisi said. “Infection levels have not reached the red level or even orange. We are at a level right now that, for the executive order we have, is reasonable. The important thing is that the order is being enforced.” “There is a clear time to intervene and restrict. But our hospitals have been able to face this pandemic, even at the height of it,” the governor added. Pierluisi added that Puerto Rico will be able to comply with the mandate of President Joe Biden to expand the vaccine campaign on or before May 1 for the entire adult population. “At the rate we are going, we are going to achieve that goal, possibly earlier,” he said. The governor’s remarks came at the end of a visual inspection he conducted of the island Health Department COVID-19VacuTour, in partnership with theVOCES Puerto Rico Vaccine Coalition, at Dr. Pedro Rosselló González Puerto Rico Convention Center in Miramar. Earlier in the day, Health Secretary-designate Carlos Mellado López urged citizens to take care of themselves with the confirmed presence of COVID-19 variants on the island.

While confirming that the island is currently facing a case spike, Mellado López told members of the press he cannot “categorize here and say that they are not variants.” “That is what is worrying,” he said. “That is why I strongly urge the public to take care of themselves, because the more we contain the virus and vaccinate more people, the more we will be able to get out of this situation.” “If these variants continue to spread, then we could have a problem,” he added. “We have already seen it in Chile. That is why it is important that we, and I repeat, it is the citizens who have to take control of this.” At press time, Mellado López said Puerto Rico continues to have 19 confirmed cases of coronavirus variants. Among those, 14 cases involve the UK variant (B 1.1.7), four the California variant (B.1.427 / B.1.429) and one involves the Brazil variant (P.1). The Puerto Rico Health Department expected to inoculate around 10,000 citizens with the Johnson & Johnson vaccine, which only requires one shot and 14 days to develop immunization in its recipient, to citizens who received an appointment for Wednesday’s mass vaccination event. At press time, Mellado López said more than 5,000 coronavirus vaccines had been administered at the convention center. When asked what will happen with islanders who attended the event without an appointment as it was reported that many were waiting in another line to get a shot, he said those citizens could wait until 10 p.m. to get a shot if there are leftover vaccines. If not, he said, they will receive an inoculation appointment for another day.

A

year after the SARS-CoV-2 pandemic began in Puerto Rico, citizens arrived on Wednesday at the Cataño Fishing Village to purchase wild caught fish and other fresh seafood products with which to safely prepare their Good Friday dinners. Around 10:15 a.m., Cataño residents and visitors from neighboring municipalities were lining up outside the kiosks, following safety measures to prevent the coronavirus from spreading while waiting for the fish sellers to put on display the local catch available for the day. Emily Hernández García, a San Juan resident, told the STAR that she was at the fishing village in order to purchase fresh fish and other delicacies to please her mother, who was right next to her in a wheelchair and wearing a blue surgical face mask. “We’re here looking up for those items that people seem to go for, like sawfish, red snapper and other treats for my old lady, in the tradition of Holy Week,” said Hernández García, who said she visits the fish markets every time the family gets a craving for fresh fish. “We bought three red snappers and a small sawfish so the family can have an amazing feast,” she added. When the STAR asked if she came to Villa Pesquera last year during the outset of the coronavirus pandemic, Hernández García said that it has actually been two years since she was there because both she and her mother were living in Pennsylvania. “It feels divine to come back here,” she said. “It’s not the same living here, in your homeland, where there’s so much warmth, there are beaches and I have everything, while living back there [in the northeastern United States] was cold and tough.” “We came back and we are staying here -- we’re not going anywhere else,” Hernández García added. “We finally understood we’re like the coquí; we’re from here, there’s no turning back.” Meanwhile, she said the service has been friendly and organized, and there was enough parking space. Bayamón resident Yolanda Cruz said she didn’t go to the Cataño Fishing VIllage as she sought to protect herself against the coronavirus by staying home. “My mom and my niece were the ones

who were eager to come here because they would always get their fish from here,” Cruz said. “I felt a bit unsure at first, but once I came here, it felt like doing something that seemed normal before.” When the STAR asked how she felt coming to Villa Pesquera a year after the COVID emergency began, she said she saw the place “very empty.” “I see fewer people and activities than before,” Cruz said. “It usually looked packed before the pandemic.” Nonetheless, she said, she felt safer as the establishment is enforcing safety measures, there was no crowding and citizens are getting vaccinated against COVID-19. “They took my temperature right before I entered, and you could see the administration is being careful here,” she said. Cruz said coming back to consume local and wild caught fish has been “the best thing.” “To see the fish right in front of your eyes, knowing that it’s fresh, it’s great,” she said. An elderly couple told the STAR meanwhile that they felt “very happy to be here getting fresh fish.” “It feels great to be able to celebrate something that we were unable to do last year,” said the man as he walked away holding hands with his wife. As some islanders were lining up to purchase fresh fish, others were lining up to get lunch and enjoy their surroundings. Resident Víctor Manuel de Jesús Reyes, who is 78 years old and had a face mask with the U.S. flag and a baseball cap that said “Jesus is my boss,” said he is a frequent customer at Villa Pesquera. Although he said the economic activity at the establishment has been slower, he was very pleased to be able to sit down and enjoy a meal outside.

“I have only seen … two food stations open since I came back,” de Jesús Reyes said as he pointed out that the other four stations have remained closed. However, de Jesús Reyes told the STAR that he felt happy to return to the place as he, like many others, was unable to go there earlier due to the coronavirus pandemic and the lockdown ordered to mitigate the COVID-19 outbreak. “The food they serve here is capable of filling both body and soul,” he said while he was enjoying a plate of red snapper medallions with rice and bacon, red kidney beans, and a diet soda. “You see what I’m eating here? It was just five dollars. You can’t get that elsewhere,” de Jesús Reyes told the newspaper. He added that being able to satisfy his appetite during the coronavirus pandemic “with affordable and delicious food” has been gratifying. Likewise, a group of elder acquain-

tances said they were there to “enjoy nice food with a few beers.” They pointed out that they have visited Villa Pesquera three times so far in 2021, and have also seen only two food stations open. “Someone told us that the six stations are supposed to be open, especially during the weekend, but I have only seen that two were open,” said a woman who later enjoyed a cup of fish broth, shrimp salad and a beer. “Do you see how fresh that looks? It is beautiful,” she said. Meanwhile,Villa Pesquera owner Fernando “Nando” Torres said that even though he has seen more demand from citizens compared to Holy Week last year, productivity has been lower as “fewer fishermen have been able to go out on the ocean and catch [fish] during the COVID pandemic.” “Last year we were able to remain open and fulfill our sales,” Torres said as he instructed customers where to get in line to purchase fish. “Our sales have not fulfilled our expectations, but at least we have had sales,” he added. When the STAR asked if he was hopeful of seeing improvements in the future, he said he was sure that “things will get better soon.” The STAR reported Tuesday that Agriculture Secretary-designate Ramón “Pirul” González Beiró urged citizens to visit the island’s fishing villages and consume fresh fish during the Easter weekend as supporting them helps guarantee the island’s food security. Municipalities with fishing villages currently open to the public are: Mayagüez, Cataño, Ponce, Guayama, Arroyo, Patillas, Maunabo, Naguabo, Fajardo, Arecibo, Isabela, Loíza, Aguadilla, Humacao, Yabucoa, Rincón, Vega Baja, Vieques, Culebra, Lajas, Guánica, Salinas, Añasco, Aguada and Cabo Rojo.

NMEAD commissioner: ‘People should not expose themselves to danger’ Urges islanders to remain cautious amid unstable maritime conditions on Easter Weekend By PEDRO CORREA HENRY Twitter: @pete_r_correa Special to The Star

A

s Holy Week winds down and citizens are expected to flock to the island’s bodies of water to enjoy some Easter weekend leisure, Emergency Management and Disaster Administration Bureau (NMEAD by its Spanish acronym) Commissioner Nino Correa Filomeno urged islanders on Thursday to stay safe during the weekend as maritime conditions will remain unstable. In an interview with the STAR, Correa Filomeno said NMEAD and its municipal branches, along with other bureaus from the Puerto Rico Public Safety Department, the U.S. Customs and Border Protection program, and around 118 Strike Team volunteers, have joined forces across the island to mitigate further issues during the weekend. “The appeal we are making, because we don’t want to go back to the fact that, as you know, it always happens to us, that just because there is a fatality, we should stress once again that people should not expose themselves to danger,” the NMEAD chief said. “Since it is Easter Week, the problem we have is that, apart from these [ocean] currents and the danger that there will be on the beaches, we want to take this appeal further because you know that people always plan to be in different areas such as rivers, lakes.”

Correa Filomeno warned that “there are strong ocean currents and strong undertows, especially in the northern area of the island, that will continue until Monday.” The official added that “there is a warning for small boats for all our coasts, that is from tomorrow, Thursday [today] until Friday.” “We would like to say next Monday that there were no fatalities on our beaches, in our rivers, in our lakes, in our pools, or anywhere else, and that people were able to spend time with their families and friends well,” Correa Filomeno said. “The holidays are the days that we work the hardest because we want to be alert to give them that security to the extent that we can, and so that we can be in any place where an emergency may arise, that we can be present and solve it without someone losing their life.” Aside from this, he said that “whether you are capable at

swimming or handling waves, staying away from the water is still the best option.” “We are aware that most citizens have stayed home for a year [due to the COVID-19 pandemic], and they will find a way to participate in a family activity, so we need that with the security we promise to provide, citizens also cooperate in doing so,” the NMEAD commissioner said. Meanwhile, National Weather Service-San Juan meteorologist Emanuel Rodríguez said “we are going to have dangerous sea conditions, mainly in the waters of the Atlantic [Ocean] and the Anegada Passage” today. “We will have from five- to seven-foot swells, which means this is a warning for small boat operators,” Rodríguez said. “For swimmers, we are going to have a high risk of sea currents, and this is for all the beaches of the north coast of Puerto Rico and the island of Culebra.” ‘These are conditions that are not safe for swimmers,” he added. “We had in earlier months incidents of drowning on the beaches despite the fact that we have these communications on the high risk of sea currents, so we are urging the public to try to avoid activities on the beaches of the north coast, but if they are going to go, [do so] with extreme caution to prevent future tragedies.” Although Rodríguez said surge levels will decrease from four to six feet during the coming weekend, he reiterated that both small boat operators and swimmers must stay safe as conditions remain unstable. As for rain, Rodríguez said the weekend will be mostly sunny, with passing showers in eastern central and western Puerto Rico.

uerto Rico Tourism Co. Executive Director Carlos Mercado Santiago and Natural and Environmental Resources (DNER), Secretary Rafael Machargo Maldonado announced on Wednesday a strategic alliance between the agencies for the launch of “Tumba la Tiraera,” an initiative that seeks to increase awareness of the management of solid waste to help protect the island’s natural resources and promote their enjoyment through tourism. Starting Tuesday and throughout April, the month dedicated to Planet Earth, the initiative will be active in mass media, such as billboards, publications and social media, and will have the support of renowned artistic personalities including singer Wiso G, author of the “Tumba la Tiraera” jingle. The first phase of the initiative will run from today to Sunday and includes the participation of Conwaste, the island company dedicated to the collection and recycling of waste. “The management and protection of all the resources that make Puerto Rico an attractive and diverse destination is vital to maintaining and improving the growth opportunities of our tourism industry, one of the most important engines of economic development on the island,” Mercado Santiago said. “We are very satisfied to join forces again with the DNER

and with the collaboration of Conwaste in this call to citizens, to join us and promote the conservation of our natural resources, not only for the enjoyment of future generations but also because of its importance in maintaining the island as a world-class destination,” he added. Machargo Maldonado stressed that the effort with public agencies and private companies “is an example of what we can do when we work together for a common good.” “In these days when thousands of people recreate on the beaches or in protected natural areas, we are going to be aware and, if the trash can is full, or there is no trash can, do not litter; ‘Tumba la Tiraera,’” the DNER chief said. “It is difficult to find better entertainment than enjoying the natural wonders of our island. However, we must be aware that, with each plastic or ‘foam’ cooler that we leave on the beaches, in the sea, or in the forests, we subtract life from our environment and render conservation efforts useless. Responding to the call for conservation is our duty as citizens.” During the Holy weekend seven of the most popular beaches on the island will be participating in the program: Crash Boat, in Aguadilla; Boquerón, in Cabo Rojo, at Porta del Sol; the Punta Guilarte Spa, in Arroyo, at Porta Caribe; Casa y Pesca, in Arecibo; Puerto Nuevo Spa, in Vega Baja, at Porta Atlántico; Luquillo Beach, in the northeast; and the Último Trolley, in Ocean Park in the San Juan metro area.

A total of 22,000 biodegradable garbage bags and T-shirts, hats and other promotional items will be handed out to all those who are enjoying the aforementioned beaches. In addition, golf cart-type vehicles equipped with mobile containers will be touring the beaches to assist in the collection of material for disposal and recycling. Parties ordered to submit statement on April 8 bankruptcy hearing By THE STAR STAFF

U

.S. District Court Judge Laura Taylor Swain ordered the island government and Employee Retirement System (ERS) bondholders to file a joint statement by noon Thursday on whether they want to proceed with a hearing on April 8 to present oral arguments related to the validity of pension bonds. Swain made her remarks in an order issued Tuesday. On March 10, the court entered an order postponing oral arguments to April 8 on whether summary judgment should be granted on the validity of the bonds, to allow the parties to negotiate a settlement. On March 8, the federal Financial Oversight and Management Board had submitted to the court a third debt adjustment plan and disclosure statement to restructure some $35 billion in commonwealth, ERS and

Public Buildings Authority debt. The oversight board at an omnibus hearing two days later said it may file a fourth amended plan of adjustment

and disclosure statement in April if it reaches a settlement with ERS bondholders on the validity of their bonds. The parties at the time sought a continuance of the hearing to allow negotiations toward a settlement to move forward. The dispute is whether the ERS, which filed for bankruptcy in 2017, was authorized under its charter law to issue $3 billion in bonds in 2008. The bondholders argued that they have legal opinions from prominent law firms confirming the validity of the debt. They argued that between 2004 and 2006, the commonwealth itself would have issued $2 billion in bonds payable from a general fund, and transferred the net proceeds to ERS but the island Legislature did not approve a bond issue. In 2006 and 2007, the government evaluated an alternative method by which ERS itself, rather than the commonwealth, would issue bonds.

ederal prosecutor W. Stephen Muldrow declined on Wednesday to comment on statements made by Mayagüez Mayor José Guillermo “Guillito” Rodríguez last week to the effect that the mayor was a victim in relation to the arrests made in the Mayagüez Economic Development Inc. (MEDI by its Spanish acronym) case. “I am not going to go into the case of the mayor of Mayagüez,” Muldrow said in response to questions from the press. Asked whether it was prudent to regard the mayor of the “Sultana del Oeste” as a victim, when the case has not yet ended, Muldrow again declined to comment. “I am not going to comment on the case,” he reiterated. formal indictment last week in which seven people were charged with 33 counts of wire fraud and money laundering. Muldrow, the U.S. attorney for the District of Puerto Rico, Tyler Hatcher, special agent in charge of the Internal Revenue Service, Criminal Investigation (IRS-CI) Miami Field Office, and Rafael Riviere Vázquez, special agent in charge of the FBI, made the announcement. “The defendants in this conspiracy were entrusted to invest public money for the benefit of the municipality of Mayagüez and the western zone, but instead they used part of it for personal gain and expenses, defrauding the government,” Muldrow said in a statement. “We will continue to target these types of fraud schemes and will work with our law enforcement partners to bring the accused to justice.” Hatcher said: “People in a position of trust who use public money to commit fraud for personal enrichment purposes betray the trust of citizens whom they are supposed to serve.” “These funds were destined to improve the quality of life of the citizens of a region of Puerto Rico and this fraud will not go unpunished,” he said. “We are all responsible for complying with the laws, regardless of position of influence. The IRS Criminal Investigation along with our law enforcement partners will continue our collective efforts to enforce the law and build public trust.” The indictment alleges that from March 2016 to June 2018, the defendants Eugenio García Jiménez, alias “Gino”; Stephen Kirkland, also known as “Steve”; Steve Minger; Alejandro Riera Fernández; Joseph Kirkland; Arnaldo Irizarry Irizarry; and Roberto Mejill Tellado orchestrated a scheme to defraud the municipality of Mayagüez and Mayagüez Economic Development Inc. of money belonging to Mayagüez by falsely representing that the total of $9 million in capital belonging to the Municipality of Mayagüez and entrusted to MEDI for investment in fact was invested and returned a significant rate of return. MEDI is a national public for-profit corporation created with the purpose of promoting the economic development of Mayagüez and the western region of Puerto Rico, generating jobs, supporting infra-

Puerto Rico’s Unsecured Creditors Committee (UCC) and the oversight board’s Special Claims Committee argued that while the ERS was allowed to seek a loan, it was not permitted under the language of its own charter law to issue bonds. The statute reads: “The (ERS) Board of Trustees may authorize the (ERS) administrator to seek a loan from any financial institution of the government of the commonwealth of Puerto Rico or the federal government of the United States of America or through the direct placement of debts, securing said debt with the assets of the system.” The bondholders argued that the English translation of the ERS charter law used by the oversight board and the UCC was wrong. The bondholders argued that instead of “to seek a loan” the statute should have read “to borrow,” which is the correct translation to English of the Spanish phrase “tomar prestado.”

The defendants transferred, distributed and spent the money in ways inconsistent with the statements made to the Municipality of Mayagüez and MEDI regarding the investment of the money, to include purchases of a marine vessel, jewelry, clothing, school fees, meals at restaurants, public services, credit card payments and home decoration, as well as real estate improvements (swimming pools, for example) and the payment of home mortgages. Using multiple phantom corporate entities and financial accounts, the defendants collectively received hundreds of thousands of dollars from the Municipality of Mayagüez, earmarked for investments, which the defendants then used for personal expenses and purchases of real and personal property. The use of phantom corporate entities further served to conceal the scheme to defraud Mayagüez and MEDI and allowed the defendants to lull Mayagüez and MEDI into believing that the $9 million was invested as falsely represented by the defendants. Of the $9 million obtained from the municipality through material misrepresentations, the defendants only returned $1.8 million to the Municipality of Mayagüez and in doing so, they falsely represented that the $1.8 million was a return on investment. If convicted, the defendants face a maximum statutory sentence of up to 20 years in prison and a fine of up to $250,000 on charges related to wire fraud, and up to 10 years in prison on the money laundering charges.

U.S. confidence in COVID-19 vaccines rising, but pockets of resistance remain, survey shows By JAN HOFFMAN

A

s eligibility for COVID-19 vaccination rapidly expands to all adults in many states over the next month, a new poll shows a continuing increase in the number of Americans, particularly Black adults, who want to get vaccinated. But it also found that vaccine skepticism remains stubbornly persistent, particularly among Republicans and white evangelical Christians, an issue that the Biden administration has flagged as an impediment to achieving herd immunity and a return to normal life. By now, roughly 61% of adults have either received their first dose or are eager for one, up from 47% in January, according to the latest monthly survey by the Kaiser Family Foundation. The shift was most striking among Black Americans, some of whom have previously expressed hesitancy but who have also had access issues. Since February, 14% more Black adults said they wanted or had already gotten the vaccine. Overall, Black adults, who have also been on the receiving end of vigorous promotional campaigns by celebrities, local Black physicians, clergy members and public health officials, now want the vaccine in numbers almost comparable to other leading demographic groups: 55%, compared with 61% for Latinos and 64% for white people. The Biden administration has made equity a focus of its pandemic response and has added mass vaccination sites in several underserved communities. In early March, a New York Times analysis of state-reported race and ethnicity information showed that the vaccination rate for Black people in the United States was half that of white people, and the gap for Hispanic people was even larger. Dr. Reed Tuckson, a founder of the Black Coalition Against COVID, hailed the increasing acceptance rates but noted that practical problems still get in the way of uptake. “The data, and our anecdotal feedback, are encouraging and further support the need for equitable distribution and easy-to-access vaccination sites that are led by trustworthy organizations,” he said. “The system needs to support those choices by making the right thing to do the easy thing to do.” Overall, the poll found that the so-called “wait-and-see” group — people who have yet to make up their mind — is shrinking commensurately, now at 17%, down from 31% in January. The seven-day average of vaccines administered hit 2.77 million on Tuesday, an increase over the pace the previous week, according to data reported by the Centers for Disease Control and Prevention. The survey was taken March 15-March 22, among a random sample of 1,862 adults. Despite the progress, 20% of adults say they would either definitely refuse the shot or only be vaccinated if required by their job or school. The people most likely to firmly oppose being vaccinated identify as Republicans (29%) or as white evangelical Christians (28%). In contrast, only 10% of Black adults said they would definitely not get it. According to the Kaiser survey as well as other polls, Republicans have budged little in their views on vaccine acceptance in recent months, although they were more open last fall, before the November presidential election. The partisan divide over the COVID shots is wide, with just 46% of Republicans saying they have received at least one shot or want to get it, compared with 79% of Democrats. No group is monolithic in its reasons to oppose or accept the vaccines. Those who are skeptical say they mistrust the government generally and are apprehensive about the speed of the vaccine’s development. Awash in online misinformation, many cling to a fast-spreading myth — that tracker microchips are embedded in the shots. For rural residents, access to the vaccine is so problematic that they see the logistics and travel time involved as simply not worth it. With so many reasons cited to avoid the vaccine, crafting messages to coax vaccine confidence can be difficult.

But the latest Kaiser report identified some approaches that seem to be successful in moving people to consider the shots. At least two-thirds of the so-called wait-and-see group said they would be persuaded by the message that the vaccines are “nearly 100% effective at preventing hospitalization and death from COVID-19.” Other strong messages included information that the new vaccines are based on 20-year-old technology, that the vaccine trials included a broad diversity of candidates, and that the vaccines are free. The survey also noted that many people who are hesitant would be amenable to certain incentives. As the country begins to open up and on-site work returns, the role of the employer in vaccination is becoming increasingly pertinent. A quarter of those who are hesitant and have a job said that they would get the shot if their employer arranged for workplace vaccination. Nearly as many would agree if their employers gave them financial incentives ranging from $50 to $200. But overall, the strong growth in adults who have either gotten one dose of the vaccine or are inclined to get it is most likely because of their increasing familiarity with the notion. Surveys show that as they begin to know more friends and relatives who have gotten the shot, they can more readily imagine getting it themselves.

‘It wasn’t right’: Young witnesses offer emotional testimony in Chauvin trial

S

he was the teenager whose video of George Floyd’s final moments rippled across the globe. And in a courtroom Tuesday, Darnella Frazier, now 18, shared her story publicly for the first time, testifying that she remained haunted by Floyd’s cries for help as she watched a police officer kneel on his neck. Frazier, 18, at times crying, spoke softly during emotional testimony on the second day of the trial of Derek Chauvin, the former officer facing murder charges. As her voice cracked, Frazier described how what she witnessed that day last May had changed her life. She sometimes lies awake at night, she said, “apologizing to George Floyd for not doing more and not physically interacting and not saving his life.” “When I look at George Floyd, I look at my dad,” she added. “I look at my brothers. I look at my cousins, my uncles because they are all Black. I have a Black father. I have a Black brother. I have Black friends. And I look at that, and I look at how that could have been one of them.” Frazier was among a diverse group of bystanders who by accident became eyewitnesses to one of the most high-profile police brutality cases of recent decades. They were Black and white. There was a firefighter, high school students and a mixed martial artist. Their stories were an expression of the trauma of a city that is still struggling to rebuild physically and emotionally from last summer’s unrest. Most of Tuesday’s witnesses were children and teenagers

at the time of the fatal arrest, and they painted a harrowing, consistent picture of what transpired at the intersection of 38th Street and Chicago Avenue in South Minneapolis. They all said they have struggled with what they saw. “It seemed like he knew it was over for him,” she added, referring to Floyd. “He was terrified. He was suffering. This was a cry for help, definitely.” The defense has said that the crowd influenced the way the police responded after arriving on the scene. It has become a crucial point of contention between the prosecution and the defense. Chauvin’s lawyer said that the officers felt threatened at what they saw as a growing and increasingly hostile crowd, which diverted their attention from caring for Floyd. The prosecution has attempted to portray the bystanders as ordinary people who were scared and presented no danger to the officers. Chauvin’s lawyer, Eric J. Nelson, did little to press most of the young witnesses or challenge their accounts. Frazier’s 9-year-old cousin, who was with her outside the convenience store, Cup Foods, testified to the trauma of seeing Floyd struggle as Chauvin knelt on his neck. “I was sad and kind of mad,” said the young girl, Judeah Reynolds, who, like the other minors who testified, was not shown on camera during her testimony. “It felt like he was stopping his breathing and it was kind of like hurting him.” Frazier, who was 17 at the time of Floyd’s death, testified that she and her cousin were going to a store she had been to many times before to buy snacks. Surveillance video showed what looked like a casual stroll, with the cousins smiling at each other as they approached the entrance to Cup Foods. Fra-

zier wore a hoodie over her head and comfortable blue pants, while her cousin, petite with a poof of hair, wore a teal T-shirt that said “Love.” When she saw officers pinning Floyd, Frazier said, she ushered her cousin into the store and then came back out. She pulled out her phone and tapped record, creating a roughly 10-minute clip that she would later post on Facebook. She recorded what was happening because “it wasn’t right,” said Frazier, who sat in the witness box wearing a blue pantsuit and allowed her tears to flow at times. Like her, most of the six eyewitnesses who testified Tuesday described feelings of helplessness and anger. If they felt like they were unable to do anything for Floyd as he was pinned to the street last year, several of the witnesses suggested that this was their chance to do something for him. “I just want the truth to come out,” said Kaylynn Ashley Gilbert, a 17-year-old high school senior, who had stopped by Cup Foods to buy snacks and a cellphone cord with a friend, and became distressed by what she saw happening to Floyd. Genevieve Hansen, 27, had visited a community garden on her day off and was walking home when she saw emergency lights down the block. A firefighter and emergency medical technician, she said she went to see if any of her colleagues were there. She came upon a scene that quickly worried her, with Floyd going limp on the pavement and a woman screaming that the officers were killing him. She told the officers that they needed to check his pulse but they shooed her away, she testified. “I was desperate to help,” she said, dabbing her eyes with a tissue at times during her testimony. “I would have been able to provide medical attention to the best of my abilities, and this human was denied that right.” Donald Williams, 33, a mixed martial arts fighter, went to Cup Foods that day to buy a drink and clear his head after going fishing with friends and his son. He remembered becoming a bit disturbed when he saw the life being sucked out of a fish they had caught and placed in a plastic bag, he said. He was drawn to the commotion by the police car, and quickly became upset when he saw Chauvin’s knee on Floyd’s neck. It appeared to be a blood choke, he testified, referring to having seen the hold render people unconscious as a fighter. He grew so frustrated at the officers that he began yelling obscenities at them. Williams then took a highly unusual step: He called the police on the police. “I believe I witnessed a murder,” he told a 911 operator, according to a recording of a call he placed that evening that was played in court. On the witness stand, Williams wiped his eyes as the recording played. The operator asked Williams if he wanted to speak with a sergeant. Yes, he told her. “That was bogus what they just did to this man,” he told her. “He was unresponsive. He wasn’t resisting arrest.” On the 911 recording, Williams could then be heard addressing the officers: “Y’all murderers, bro!” One of the prosecutors asked Williams why he called 911. “I just felt like that was the right thing to do,” he replied. “I didn’t know what else to do.”

Two ex-deputies face manslaughter Charges in Black man’s death in Texas By NEIL VIGDOR and JACEY FORTIN

T

wo ex-sheriff’s deputies in Texas have been indicted on second-degree manslaughter charges in the death of a Black driver whom they repeatedly shocked with a Taser during a 2019 traffic stop despite his pleas that he had heart disease and could not breathe, a prosecutor said Tuesday. The former Williamson County deputies, James Johnson and Zachary Camden, had been accompanied by a television crew from the reality television show “Live PD” at the time of their fatal encounter with Javier Ambler, 40, whom they were pursuing for failing to dim his lights to oncoming traffic. The charges against Johnson and Camden were announced by José Garza, the district attorney in neighboring Travis County, which includes Austin, Texas, where Ambler crashed his vehicle after the police pursued him over a traffic violation. “With these indictments, we have taken another critical step towards justice for the Ambler family and for our community,” Garza said in a statement. “While we can never take away the pain of the Ambler family, the grand jury has sent a clear message that no one is above the law.” Ken Ervin and Doug O’Connell, the lawyers for Johnson and Camden, said in a joint statement Tuesday that Ambler had led the former deputies on a chase for 22 minutes after a series of collisions and had resisted arrest. “Mr. Ambler’s physical exertion in resisting the three officers it took to get him into handcuffs no doubt contributed to his medical emergency, but Mr. Johnson and Mr. Camden are neither morally nor legally responsible for his death,” the statement said. The lawyers for the former deputies accused Garza of trying to score political points with the indictments, which came a few weeks after Garza announced that a grand jury had returned an indictment against an Austin police officer in the shooting death of a man last year that touched off protests against police violence in the state capital. The lawyers also represent the officer in that case. Bail was set at $150,000 for Johnson and Camden; both have been released. Their lawyers said the former deputies intended to plead not guilty and turned themselves in Tuesday after their in-

dictments were signed Monday. Ambler’s father, Javier Ambler Sr., thanked Garza in a statement for pursuing charges against the former deputies. “Our goal has always been to hold these officers accountable so that there are no more families who have to suffer like ours has,” the statement said. On March 28, 2019, Williamson County deputies tried to stop Javier Ambler because the vehicle he was driving did not dim its lights to traffic, officials said. After deputies tried to pull Ambler over, the authorities said, he kept driving for more than 20 minutes and crashed his vehicle in downtown Austin. There, deputies used a Taser on Ambler several times. “I have congestive heart failure,” Ambler could be heard saying on the body camera video. “I can’t breathe.” As he and the deputies struggled, Ambler said, “Save me.” One deputy yelled, “Do what we’re asking you to do.” Ambler was transported to Dell Seton Medical Center in Austin and pronounced dead just after 2:30 a.m. The indictments of the former deputies brought the number of people charged in connection with Ambler’s death to four. Last year, the county’s sheriff at the time of Ambler’s death, Robert Chody, was arrested on an evidence tampering charge related to destruction of recordings of the encounter. He has pleaded not guilty, along with Jason Nassour, a Williamson County assistant attorney, who was also charged with evidence tampering. “Live PD,” which premiered on A&E in 2016, previously broadcast police officers around the country as they made traffic stops, responded to calls and went on highspeed chases. The show was almost live; a delay helped avoid airing footage that was particularly disturbing. A disclaimer at the beginning of each broadcast told viewers that “all suspects are presumed innocent until proven guilty.” The show did not cover what happened to people who had been arrested. Sometimes, people being filmed shielded their faces or objected to the presence of cameras. Television shows about policing attracted scrutiny last summer amid nationwide protests following the death of George Floyd in May, and in June, A&E announced that it had ceased production of “Live PD.”

Representatives of A&E did not immediately respond to a request for comment Tuesday.

As mask mandates lift, retail workers again feel vulnerable By SAPNA MAHESHWARI

M

arilyn Reece, the lead bakery clerk at a Kroger in Batesville, Mississippi, started noticing more customers walking around the store without masks this month after the state mandate to wear face coverings was repealed. Kroger still requires them, but that doesn’t seem to matter. When Reece, a 56-year-old breastcancer survivor, sees those shoppers, she prays. “Please, please, don’t let me have to wait on them, because in my heart, I don’t want to ignore them, I don’t want to refuse them,” she said. “But then I’m thinking I don’t want to get sick and die, either. It’s not that people are bad, but you don’t know who they’ve come into contact with.” Reece’s heightened anxiety is shared by retail and fast-food workers in states like Mississippi and Texas, where governments have removed mask mandates before a majority of people have been vaccinated and while troubling new variants of the coronavirus are appearing. It feels like a return to the early days of the pandemic, when businesses said customers must wear masks but there was no legal requirement and numerous shoppers simply refused. Many workers say that their stores do not enforce the requirement, and that if they do approach customers, they risk verbal or physical altercations. “It’s given a great false sense of security, and it’s no different now than it was a year ago,” said Reece, who is not yet able to receive a vaccine because of allergies. “The only difference we have now is people are getting vaccinated but enough people haven’t gotten vaccinated that they should have lifted the mandate.” For many people who work in retail, especially grocery stores and big-box chains, the mask repeals are another example of how little protection and appreciation they have received during the pandemic. While they were praised as essential workers, that rarely translated into extra pay on top of their low wages. Grocery employees were not initially given priority for vaccinations in most states, even as health experts cautioned the public to limit time in

The issue has gained serious prominence: On Monday, President Joe Biden called on governors and mayors to maintain or reinstate orders to wear masks as the nation grapples with a potential rise in virus cases. The United Food and Commercial Workers union, which represents nearly 900,000 grocery workers, said this month that at least 34,700 grocery workers around the country had been infected with or exposed to COVID-19 and that at least 155 workers had died from the virus. The recent mass shooting at a grocery store in Boulder, Colorado, has only rattled workers further and added to concerns about their own safety. Diane Cambre, a 50-year-old floor supervisor at a Kroger in Midlothian, Texas, said she had spent much of the past year worrying about bringing the virus home to her 9-year-old son and dreading interactions with customers who were flippant

about the possibility of getting sick. She wears a double mask in the store even though it irritates her skin, already itchy from psoriasis, and changes her clothes as soon as she gets home. After Gov. Greg Abbott of Texas said on March 2 that he would end the statewide mask mandate the next week, Cambre said, customers immediately “started coming in not wearing a mask and stuff, and it’s been pretty hard getting anybody to wear one.” Management is supposed to offer masks to people who aren’t wearing them, but if they don’t put them on, nothing else is done, she said. Asking customers to wear masks can result in tense exchanges and even tantrums from cart-pushing adults. A Kroger representative said that the chain would “continue to require everyone in our stores across the country to wear masks until all our frontline grocery associates can receive the COVID-19 vaccine,” and that it was offering $100 one-time payments to workers who received the vaccine. The differing state and business man-

dates have some workers worried about more confrontations. The retail industry was already trying to address the issue last fall, when a major trade group helped put together training to help workers manage and de-escalate conflicts with customers who resisted masks, social distancing and store capacity limits. Refusing service to people without masks, or asking them to leave, has led to incidents in the past year like a cashier’s being punched in the face, a Target employee’s breaking his arm and the fatal shooting of a Family Dollar security guard. MaryAnn Kaylor, the owner of two antique stores in Dallas, including Lula B’s Design District, said the mask mandate repeal mattered a lot for stores and people’s behavior. “He should have focused more on getting people vaccinated instead of trying to open everything up,” she said of Abbott, noting that Texas has one of the country’s slowest vaccination rates. “You still have cases every day in Texas, and you have people dying still from COVID,” she said. “This complete lifting of mandates is stupid. It shouldn’t have been based on politics — it should have been based on science.” Some Texans have started to seek out mask-friendly establishments. Kaylor said that lists of Dallas businesses that require masks had been circulating on Facebook, and that people were consulting them to figure out where to buy groceries and do other shopping. Emily Francois, a sales associate at a Walmart in Port Arthur, Texas, said that customers had been ignoring signs to wear masks and that Walmart had not been enforcing the policy. So Francois stands 6 feet away from shoppers who don’t wear masks, even though that upsets some of them. “My life is more important,” she said. “I see customers coming in without a mask and they’re coughing, sneezing, they’re not covering their mouths,” said Francois, who has worked at Walmart for 14 years and is a member of United for Respect, an advocacy group. “Customers coming in the store without masks make us feel like we aren’t worthy, we aren’t safe.”

Despite Chile’s speedy COVID-19 vaccination drive, cases soar

aving negotiated early access to tens of millions of doses of COVID-19 vaccines, Chile has been inoculating its residents faster than any other country in the Americas and appears poised to be among the first in the world to reach herd immunity. But experts say the country’s speedy and efficient vaccination drive — only Israel, the United Arab Emirates and Seychelles have vaccinated a larger share of their populations — gave Chileans a false sense of security and contributed to a sharp spike in new infections and deaths that is overloading the health care system. The surge in cases, even as more than one third of Chile’s population has recei-

ved at least the first dose of a COVID-19 vaccine, serves as a cautionary tale for other nations looking to vaccination drives to quickly put an end to the era of beleaguered economies, closed borders, and social distancing. The rise in cases triggered a new set of strict lockdown measures that have restricted mobility for nearly 14 million people. “When transmission rates are high, the vaccine does not rein in new infections right away,” said Dr. Denise Garrett, an epidemiologist at the Sabin Vaccine Institute in Washington, D.C. “And with the new variants, which are more contagious, we’re not likely to see a big impact until the vast majority of the population is vaccinated.” The severity of the crisis in Chile became clear Sunday, as President Sebastián

Piñera asked Congress to delay by six weeks a vote scheduled for early April to elect the representatives who will draft a new Constitution and other officials. “Protecting the health of our compatriots has always been our first priority,” Piñera said in a statement Sunday, arguing that the current state of the pandemic was not conducive to holding a vote that was “democratic, inclusive and safe.” While more than 6 million of the country’s 18 million people have been vaccinated, a surge in infections has left intensive care units operating with few beds to spare and the system at a breaking point. Last week, Chile recorded 7,626 new COVID-19 cases in a single day, a record, and the pace of new infections has doubled in the past month. The main hospital in the coastal city of Valparaíso had to create an overflow morgue over the weekend. Health officials in Chile have identified cases of new variants that were first identified in the United Kingdom and Brazil. Dr. Francisca Crispi, a regional president of Chile’s medical association, said that 20% to 30% of medical professionals in the country have gone on leave because they are so exhausted. Many are experiencing mental health problems and suicidal ideation, she added. “No one questions that the vaccination campaign is a success story,” she said. “But it conveyed a false sense of security to people, who felt that since we’re all being vaccinated the pandemic is over.” The government moved too quickly as it reopened its borders in November and eased restrictions on businesses, said Crispi. In January, after tightly restricting the flow of people across provincial borders, the country created a permit system for Chileans to go on summer vacation. “There was no control or traceability of the people who arrived in the country and many people traveled abroad on vacation” said Crispi. She called the vacation permits a “seriously misguided measure.” Soon, Chile also allowed gyms, churches, malls, restaurants and even casinos to reopen. Even as experts urged caution, the government stuck to its plan to reopen schools March 1.

As people began moving and consuming with greater ease, doctors grew concerned, especially because the government did not have an effective contact tracing system in place. “The situation we’re in is one we saw coming,” said Dr. Claudia Cortés, an infectious disease specialist who teaches at the University of Chile and has been treating COVID-19 patients at a private clinic in Santiago. “More than 4 million people traveled around the country. That led the virus, which had been largely contained to some major areas, to spread across the country.” Health minister Enrique Paris has defended the vacation permits system but acknowledged that the government should have been more emphatic about conveying that the virus remained a big threat as Chileans became more lackadaisical about mask wearing and gatherings. “The mistake was perhaps to not have communicated the evident risk so the people who obtained those permits could have had the necessary instructions,” he said in early March. Several other countries in the region are struggling to rein in contagion. In Brazil, hospitals in several states have waiting lists of gravely ill patients. Doctors in Paraguay say they are facing shortages of basic drugs as the virus spreads briskly. Chile is better equipped than any of its neighbors to get the virus under control. Rodrigo Yáñez, a senior foreign ministry official who oversaw the vaccine procurement program, said Chile was successful in securing a large quantity of doses soon after manufacturing began by acting decisively and early. The government has relied mainly on the Chinese-made CoronaVac and on Pfizer’s shot, but it has also placed orders from other suppliers to ramp up the pace. Yáñez said the government’s campaign to encourage Chileans to get vaccinated has been effective at reducing the percentage of people who have expressed reservations about the vaccines in public opinion polls. “We expect that the effect of the vaccines will be felt by mid-April,” he said in an interview.

Entitled to vaccines, undocumented immigrants in U.K. struggle for access By ALLISON McCANN

I

n early February, the British government announced that every person living in the country would be eligible for a coronavirus vaccine, free of charge, regardless of their immigration status. Public health experts praised the decision, necessary to ensure the safety of everyone, while others raised alarms at the prospect of noncitizens jumping ahead of eligible Britons. As in much of the world, the virus has ravaged immigrant communities in Britain, many of which supply the bulk of front line workers in grocery stores and domestic care. Many immigrants also live in crowded, multigenerational housing that exposed older family members throughout the pandemic. The government’s so-called vaccine amnesty was designed to encourage even those without legal status to come forward and get vaccinated. But more than a month after the announcement, many undocumented immigrants said they remained fearful that asking for a vaccine would risk arrest or deportation. Others said they had been denied registration at local doctors’ offices, which often ask for identification or proof of address — although neither is required to access primary care. The most common response, however, was confusion or a lack of clarity about which services were available — the lasting effects of a yearslong “hostile environment” policy that aimed to force those without legal status to leave the country by blocking their access to jobs, bank accounts and free medical care. “It’s all very well to say, ‘Anyone can get a vaccine,’” said Phil Murwill, head of services at Doctors of the World U.K. “But for years there was a deliberate policy of creating a hostile environment for undocumented immigrants that has put people off from accessing any kind of care. And we’re seeing that play out now.” Outside estimates put the number of undocumented immigrants in Britain somewhere between 800,000 and 1.2 million, or just under 2% of the population. (The British government has not estimated the size of this population since 2005, when it was said to be 430,000.) It is a significant group that includes many at-risk workers, and one that epidemiologists say the vaccination campaign — which has so far given nearly half the population at least one dose — must reach if Britain hopes to safely exit the pandemic. This month, Ghie Ghie and Weng, two undocumented domestic workers from the Philippines, walked arm in arm to the Science Museum in London, one of more than the 1,500 vaccination sites across the country. (Like other undocumented people interviewed for this article, the women

asked to be identified only by their first names for fear of arrest.) Ghie Ghie had gotten her first shot of the vaccine the previous weekend and was hoping Weng could get hers. The women, aged 40 and 51, were younger than the eligible age groups but had booked an appointment online under the category of health- and social-care workers, which the government defined as “doctors, nurses, midwives, paramedics, social workers, care workers, and other front line health and social care staff.” (As of last week, those age 50 and older are now eligible in England.) There was no reference to domestic work, and they were hoping no one would ask. Other domestic workers they knew had been turned away at vaccine sites that required proof of employment. “My employer was worried; she kept asking me to go and get my vaccine,” said Ghie Ghie, who takes care of four children, three of whom are back in school. “But they wouldn’t write me a letter, they don’t want to get involved. They’re asking you to do it, but they’re not supporting you.” Weng works part time for two families, traveling between the households each week. “I want to get my vaccine in case the government asks, so that I can show I am not putting anyone at risk,” she said as she waited in line at the vaccine center. She reemerged about 30 minutes later, proudly clutching the card showing she had received the first dose of the AstraZeneca vaccine. In 2018, the Home Office, the government ministry in charge of immigration, officially withdrew a data-sharing agreement that used patient information from the National Health Service to track down people thought to be violating immigration rules. (Data sharing still exists for deportation cases involving serious crimes.) The Department of Health and Social Care has said that anyone undergoing vaccination, testing or treatment for the coronavirus would not be subject to immigrationstatus checks. But there are still instances in which the two agencies share patient information, most commonly in cases of undocumented immigrants with an unpaid medical debt of 500 pounds (around $690) for more than two months. Primary care, including treatment by a family doctor, is free, whereas secondary care — hospital visits, surgeries, maternal care — is not. Those working on behalf of undocumented immigrants say that this hybrid health care system only adds to the confusion about what benefits undocumented immigrants are entitled to. “The government needs to suspend all charging and data-sharing operations if they want to prioritize the widest possible access to public health,” said Zoe Gardner, a policy adviser for the Joint Council for the Welfare of Immigrants.

Three women working to vaccinate children shot dead in Afghanistan By ADAM NOSSITER

hree health workers, all women, working for the government’s polio vaccine campaign were shot dead in Jalalabad in eastern Afghanistan on Tuesday, local officials said, only weeks after three women working in television were killed in the same city. The women, all in their 20s, were going about their jobs in the bustling town near the border with Pakistan when they were gunned down in two separate attacks. Semin, 24, and Basira, 20, who like

many Afghans both went by only one name, were shot and killed by two gunmen as they entered a house in Jalalabad to vaccinate the children who lived there, the governor’s office said. The two were going door to door in the city, a practice the Taliban have banned in the past in areas under their control. It was Semin’s first vaccination campaign, said Ahmad Faisal Nizami, the victim’s cousin. She had recently been married and had graduated from a teacher training college. stan on Monday, was shot and killed about an hour later elsewhere in the city. No group immediately claimed responsibility for the killings. Taliban spokesman Zabihullah Mujahid rejected any involvement in the incident in a WhatsApp message. Afghanistan, which recorded 56 cases of polio in 2020, according to the Global Polio Eradication Initiative, is one of two countries where the disease has not been eradicated, trailing behind Pakistan. Around the same time as Tuesday’s shootings, there was an explosion at the city’s regional hospital, officials said, in front of the compound where the vaccines are stored. There were no casualties, but windows were shattered. The latest killings — part of a wave of targeted assassinations often singling out women, journalists, professionals, activists and doctors — happened at a fraught moment for Afghanistan as the Taliban have made steady military gains, and relentlessly attack those deemed as collaborating with the Afghan government. Additionally, remnants of the Islamic State group operating in the region have focused on carrying out fewer large-scale bombings and more smaller but targeted assaults. Meanwhile, the United States has yet to definitively say whether it will meet the May 1 deadline for withdrawing all U.S. forces, per an agreement the Trump administration signed with the Taliban in February 2020. “My niece Basira was a poor girl,” said Haji Moqbel Ahmad, a tribal elder in Jalalabad, who added that the woman had not been threatened before. “She was shot and killed while she was doing her job.”

Basira, a vaccine worker since her teens, had been enlisted for a five-day vaccine campaign for which she would be paid less than $30, officials said. The month began with the assassination of three women who worked for a television station in Jalalabad. A female television and radio presenter from the same station was gunned down in much the same way in December. The Islamic State claimed responsibility for both incidents. The New York Times documented the deaths of at least 136 civilians and 168 security force members in such targeted killings in 2020, more than nearly any other year of the war. So far, 2021 has not seen any reprieve from the same kind of violence. The Taliban are increasing pressure on government and society, asserting dominance as stuttering, intermittent negotiations take place to settle the Afghan conflict. Jalalabad has been among the hardesthit cities. A day after the television-worker killings, a female doctor there was killed by a roadside bomb. Ross Wilson, the U.S. chargé d’affaires in Kabul, denounced Tuesday’s killings. “Such attacks are a direct affront to Afghans’ dream of building a better life for their children,” Wilson wrote on Twitter. “My deepest condolences for the victims’ families as we call for justice. Attacking vaccinators is as heartless as it is inexplicable.” Humanitarian agencies also expressed outrage. Henrietta Fore, executive director of UNICEF, issued a statement calling the victims “courageous vaccinators who were at the forefront of efforts to combat the spread of polio and keep Afghanistan’s children safe from this disabling disease.”

fresh surge of new coronavirus cases is taking a heavy toll in Pakistan, with Prime Minister Imran Khan and President Arif Alvi among several senior officials to have contracted the virus recently, just as the nation struggles to stem the outbreak. As the number of cases soars, the federal government has imposed a ban on public gatherings, sports events and wedding ceremonies, starting in April. Emergency wards of hospitals in Lahore

and Islamabad have been filled to capacity with coronavirus patients, according to health workers. Several neighborhoods in both cities have been placed under strict lockdowns. Officials said Tuesday that at least 100 deaths had been reported in the past 24 hours. The country has recorded 14,356 deaths and 663,200 infections since the start of the pandemic. The virus is also taking a toll in the senior ranks of the government. Khan was reported March 20 to have become infected, while Alvi and the defense minister, Pervez Khattak, tested positive Monday.

The president’s wife, Samina Alvi, who said she had tested negative, noted that the couple had received a first vaccine dose in mid-March, although it was not clear which vaccine. “It takes time to develop immunity,” she wrote on Twitter. Officials said that Khan was making a steady recovery and had been allowed to resume work. On Tuesday, Abdul Hafeez Sheikh, the country’s former finance minister, also tested positive for the coronavirus. Khan removed him

from his position Monday because of Sheikh’s failure to stem an increasing inflation rate. Dr. Faisal Sultan, the acting health minister, said that the four provinces of Pakistan had been given permission to independently import vaccines. The federal government has said that it is in the process of procuring more vaccines from China, but critics have denounced the slow rollout. The vaccination drive was started this month, with people older than 60 and health workers eligible for doses developed by the Chinese company Sinopharm.

The GOP has some voters it likes and some it doesn’t By JAMELLE BOUIE

T

he most outrageous provision of the Election Integrity Act of 2021, the omnibus election bill signed by Gov. Brian Kemp of Georgia last week, is one that makes it illegal for anyone except poll workers to offer food or water directly to voters standing in line. Defenders of the law say that this is meant to stop electioneering at the polls; critics say it is a direct response to volunteers who assisted those Georgians, many of them Black, who waited for hours to cast their ballots in the 2020 presidential election. Less outrageous but more insidious is a provision that removes the secretary of state from his (or her) position as chairman of the State Election Board and replaces him with a new nonpartisan member selected by a majority of Georgia’s Republican-controlled Legislature. The law also gives the board, and by extension the Legislature, the power to suspend underperforming county election officials and replace them with a single individual. Looming in the background of this “reform” is Secretary of State Brad Raffensperger’s conflict with Donald Trump, who pressured him to subvert the election and deliver Trump a victory. What won Raffensperger praise and admiration from Democrats and mainstream observers has apparently doomed his prospects within the Republican Party, where “stop the steal” is dogma and Trump is still the rightful president to many. It is not even clear that Raffensperger will hold office after his term ends in 2023; he

Jody Hice of Georgia’s 10th Congressional District, an outspoken defender of Trump’s attempt to overturn the election. This is what it looks like when a political party turns against democracy. It doesn’t just try to restrict the vote; it creates mechanisms to subvert the vote and attempts to purge officials who might stand in the way. Georgia is in the spotlight, for reasons past and present, but it is happening across the country wherever Republicans are in control. On March 24, for example, Republicans in Michigan introduced bills to limit use of ballot drop boxes, require photo ID for absentee ballots, and allow partisan observers to monitor and record all precinct audits. “Senate Republicans are committed to making it easier to vote and harder to cheat,” the state Senate majority leader, Mike Shirkey, said in a statement. Shirkey, you may recall, was one of two Michigan Republican leaders who met with Trump at his behest after the election. He also described the attack on the Capitol on Jan. 6 as a “hoax.” Republican lawmakers in Arizona, another swing state, have also introduced bills to limit absentee voting in accordance with the former president’s belief that greater access harmed his campaign. One proposal would require ID for mail-in ballots, and shorten the window for mail-in voters to receive and return their ballots. Another bill would purge from the state’s list of those who are automatically sent a mail-in ballot any voter who failed to cast such a ballot in “both the primary election and the general elec-

tion for two consecutive primary and general elections.” One Arizona Republican, John Kavanagh, a state representative, gave a sense of the party’s intent when he told CNN, “Not everybody wants to vote, and if somebody is uninterested in voting, that probably means that they’re totally uninformed on the issues.” He continued: “Quantity is important, but we have to look at the quality of votes, as well.” In other words, Republicans are using the former president’s failed attempt to overturn the election as a guide to how you would change the system to make it possible. In Georgia, as we’ve seen, that means stripping power from an unreliable partisan and giving it, in effect, to the party itself. In Pennsylvania, where a state Supreme Court with a Democratic majority unanimously rejected a Republican lawsuit claiming that universal mail-in balloting was unconstitutional, it means working to end statewide election of justices, essentially gerrymandering the court. In Nebraska, which Republicans won, it means changing the way the state distributes its electoral votes, from a district-based system in which Democrats have a chance to win one potentially critical vote, as Joe Biden and Barack Obama did, to winner-take-all. This fact pattern underscores a larger truth: The Republican Party is driving the nation’s democratic decline. A recent paper by Jacob M. Grumbach, a political scientist at the University of Washington, makes this plain. Using a new measure of state-level democratic performance in the United States from 2000 to 2018, Grumbach finds that Republican control of state government “consistently and profoundly reduces state democratic performance during this time period.” The nationalization of American politics and the coordination of parties across states means that “state governments controlled by the same party behave similarly when they take power.” Republican-controlled governments in states as different as Alabama and Wisconsin have “taken similar actions with respect to democratic institutions.” The Republican Party’s turn against democratic participation and political equality is evident in more than just these bills and proposals. You can see it in how Florida Republicans promptly instituted difficult-to-pay fines and fees akin to a poll tax after a supermajority of the state’s voters approved a constitutional amendment to end the disenfranchisement of most ex-felons. You can see it in how Missouri Republicans simply ignored the results of a ballot initiative on Medicaid expansion. Where does this all lead? Perhaps it just ends with a few new restrictions and new limits, enough, in conjunction with redistricting, to tilt the field in favor of the Republican Party in the next election cycle but not enough to substantially undermine American democracy. Looking at the 2020 election, however — and in particular at the 147 congressional Republicans who voted not to certify the Electoral College vote — it’s not hard to imagine how this escalates, especially if Trump and his allies are still in control of the party. If Republicans are building the infrastructure to subvert an election — to make it possible to overturn results or keep Democrats from claiming electoral votes — then we have to expect that given a chance, they’ll use it.

l alcalde de Vieques, José ‘Junito’ Corcino Acevedo, informó el miércoles que hasta el próximo domingo, personal de la Guardia Nacional de Puerto Rico estará brindando servicios de cernimiento a toda persona que viaje hacia dicha isla municipio, como medida adicional de control del COVID-19. Personal de la Guardia Nacional estableció una serie de áreas de cernimiento que incluye la toma de temperatura corporal, así como un pequeño cuestionario relacionado al COVID-19, en el aeropuerto regional Antonio Rivera Rodríguez y el terminal de lanchas en el poblado de Isabel Segunda. “Nosotros queremos un Vieques vibrante y con actividad económica sostenible. Nuestros comerciantes están listos para recibir a los visitantes este fin de semana largo, han hecho todos los preparativos para crear ese ambiente seguro que se requiere por estos tiempos. Pero queremos que todo se realice enmarcado en los más estrictos controles de salud para garantizar la seguridad de nuestros residentes. Por eso, como medida adicional,

hemos coordinado con la Guardia Nacional para establecer puntos de cernimiento en los puertos de entrada a nuestra isla”, sostuvo el alcalde mediante un comunicado de prensa. Se espera que desde mañana, cientos de turistas visiten la llamada ‘Isla Nena’ como parte de las actividades relacionadas con la Semana Santa, que usualmente marca el inicio de la temporada turística de verano en Puerto Rico. n aras de preservar el orden y la sana convivencia durante la Semana Santa, la Policía Municipal de San Juan informó el miércoles que se implementará un plan de seguridad que incluirá la movilización de aproximadamente 290 empleados. Personal municipal de la Policía, Manejo de Emergencias y Obras Públicas estarán a cargo de que se cumplan con las leyes, ordenanzas vigentes y que se apliquen las disposiciones que establece la Orden Ejecutiva 2021-19. “En San Juan estamos preparados para recibir la visita de turistas y ciudadanos que durante los días festivos se dan cita en la Capital. Ya sea para participar de actividades religiosas o para vacacionar, San Juan es el epicentro y casa para muchos durante estos días. Por tal razón, hemos establecido un plan de seguridad que asistirá durante cualquier eventualidad mientras velamos por el cumplimiento de las leyes”, sostuvo el alcalde, Miguel Romero. Por su parte, José J. García, comisiona-

do de la Policía Municipal de San Juan, destacó que la zona del Condado es una costera y es tradición de muchos puertorriqueños visitar las playas en celebración de Semana Santa. “Teniendo esto en mente, este plan se confecciona para mantener un balance en la sociedad, que garantice el orden público y el disfrute de la vida cotidiana”. Según explicó el alcalde, durante los días del 1 al 4 de abril, la Policía Municipal prestará vigilancia tanto en las áreas terres-

tres como marítimas y para ello, se activarán varias de las unidades policíacas, específicamente, 199 agentes. La Unidad de Tránsito se concentrará en rondas preventivas por las avenidas principales, las zonas de Condado, calle Loíza, Último Trolley y El Escambrón. Además, estarán pendiente a la problemática de vehículos mal estacionados. La Unidad Marítima, que comprende los vehículos todoterreno, lanchas, jet ski y buzos, brindará vigilancia desde ambos

puntos para evitar que embarcaciones y/o bañistas actúen en contra de las disposiciones de la Orden Ejecutiva y demás normas. Por otro lado, la Unidad Canina proporcionará cooperación en el patrullaje, mientras que la Unidad de Impacto proveerá atención en las áreas circundantes, dando énfasis a la Plaza del Mercado de Santurce, calles cercanas y se extenderá hasta las áreas turísticas de Miramar y Viejo San Juan. Romero Lugo añadió que, unos 11 efectivos de la Oficina para el Manejo de Emergencias Municipal se mantendrán en el área para atender cualquier emergencia que pueda surgir en la zona. También, personal de Obras Públicas trabajará en la limpieza de las zonas turísticas, de manera que se puedan mantener las áreas libres de basura. ‘Diana’ musical sets Netflix run — and Broadway opening night By MICHAEL PAULSON

“D

iana,” a new musical about the idolized but illfated British princess, managed to get through nine preview performances before Broadway shut down last March. Now, one year, one pandemic, and one Oprah interview later, the show is ready to try again, with a new strategy and a new context. In a first for a Broadway show, a filmed version of the stage production will start streaming before the musical opens. “Diana,” which was shot over a week last September in an audience-less Longacre Theater, will begin streaming on Netflix on Oct. 1, and then two months later, on Dec. 1, will resume previews on Broadway. The musical’s producers announced Tuesday that they intend to open Dec. 16, which is 625 days after its originally scheduled, but pandemic-postponed, opening night. The producers are putting their Broadway tickets on sale now, and counting on the Netflix film, which will have an open-ended run, to boost interest in the stage production. “I think people will see the movie and will say, that’s a show I want to see in person,” said Frank Marshall, a prominent filmmaker who is one of the musical’s lead producers. Another lead producer, the Broadway veteran Beth Williams, acknowledged that the plan involves “a slightly more complicated rollout,” but added “we feel like it’s an incredible opportunity to put ‘Diana’ in front of the global Netflix audience, and then give them an opportunity to see it live.” Broadway, of course, remains closed in an effort to con-

tain the spread of the coronavirus, and producers expect that most full-scale plays and musicals won’t attempt to start performances until after Labor Day. “Diana,” which chronicles the life and death of the Princess of Wales, who was the first wife of Prince Charles, is among the first shows to put tickets on sale and to choose a specific date for a target opening. The scheduling, Marshall said, was a matter of trying to anticipate how the country’s post-pandemic reopening will unfold, and trying to coordinate the two projects to strengthen them both. “We wanted to make sure our marketing plans aligned,” he said. “I’m very optimistic about the fall, for both movies and for Broadway.” (A spokesman for the show declined to say how much Netflix paid for the streaming rights.) The musical, featuring Jeanna de Waal in the title role, is directed by Christopher Ashley and choreographed by Kelly Devine, who previously collaborated on “Come From Away”; it was written by Joe DiPietro and David Bryan (the Bon Jovi keyboardist), who created the Tony Award-winning “Memphis.” Through virtual and in-person work, the show, which had a pre-Broadway production at La Jolla Playhouse, was revised early in the pandemic. The producers said they do not expect further revisions, and expect their cast to remain intact. Diana has remained an object of public fascination in the years since her death in a 1997 car crash. But her story also has a contemporary sequel, as her younger son, Harry, and his wife, Meghan, stepped away from their royal duties, and, in an interview this month with Oprah Winfrey, he said that “my biggest concern was history repeating itself.”

ame of Thrones” ended in 2019 but George R.R. Martin still hasn’t finished the next novel in his Song of Ice and Fire series, the books that inspired the globally popular HBO drama. Alas, no word on when that might happen. But impatient fans may have something else to look forward to: The return of favorite characters like Ned Stark and Jaime Lannister in a stage adaptation of “Game of Thrones” that is being developed in the hope of productions on Broadway, in London’s West End and in Australia, with a target debut of 2023. “It ought to be spectacular,” Martin said in a statement announcing the play on Tuesday. The author will write the story alongside the playwright Duncan Macmillan, who also adapted George Orwell’s “1984” for the stage and recently wrote “Lungs,” a play that streamed live from London’s Old Vic Theater last summer. Dominic Cooke, a former artistic director of the Royal Court Theater, will direct. No specific characters have yet been confirmed to recur, but a few seem like safe bets — a young Ned Stark, his sister Lyanna, and a braggadocious teenage Jaime Lannister all attended the event in Martin’s books. Simon Painter, Tim Lawson and Jonathan Sanford will produce, in partnership with Kilburn Live. Painter is known for creating large-scale touring shows like “The Illusionist” franchise, which he launched with Lawson. Vince Gerardis will also serve as an executive producer. The play is the latest in a series of prequel projects that have been announced since the HBO fantasy epic concluded in 2019. Martin recently agreed to a five-year deal with HBO to create content for the network, and one “Game of Thrones” prequel, “House

Ramin Djawadi, the show’s composer, toured with musicians playing the score set to clips from the series in arenas all over the world from 2017 to 2019, complete with confetti snow, sparks, smoke and “dragon” fire. Other fantasy epics have attempted journeys to the stage after the conclusion of their literary sagas, among them J.K. Rowling’s “Harry Potter” series and J.R.R. Tolkien’s “Lord of the Rings” books. The two-part “Harry Potter and the Cursed Child,” which debuted in London in 2016, won six Tony Awards during its Broadway run, which began in 2018, and has been produced in Toronto and Melbourne, Australia. But the “Lord of the Rings” musical, which opened in Toronto in 2006 before transferring to the West End, was never a critical — or box office — success, and went on to become one of the biggest commercial flops in West End history. But, right now, for Westeros fans, excitement is running high. “The seeds of war are often planted in times of peace,” Martin said. “And now, at last, we can tell the whole story … on the stage.”

When a break from TV brings more TV

For its second season, “For Life,” starring Nicholas Pinnock, moved the story outside of prison. By MIKE HALE

W

hen I learned I would be sidelined by surgery for six weeks, I thought I would use the time to catch up on some of the things you miss when television is your occupation — movies, books, sunshine. But who was I kidding? It was the perfect excuse to watch even more TV. With additional time to binge (like a normal person), I had the pleasure of discovering or catching up on things that otherwise would have slipped past. Here are some highlights from my convalescent viewing: current or recent shows I would not have gotten around to writing about if I had been on my feet. ‘Call Me Kat’ (Fox) Mayim Bialik’s new sitcom, which recently finished its first season, is a remake of the British show “Miranda,” with Bialik playing a less acerbic and more grounded-in-reality version of the loopy shop owner played by Miranda Hart in the original. Some things have changed — the shop is now a cat cafe rather than a novelty gift store — and some, unfortunately, have stayed the same, like the icky gimmick whereby the cast breaks character to mug and wave to the camera during each episode’s closing credits.

That’s close to a deal-breaker, but I found myself coming back to “Call Me Kat,” a show that doesn’t break any ground but occasionally locates some wiggle room for genuine feeling amid the sitcom formulas. (It has that in common with Chuck Lorre’s “Bob Hearts Abishola” on CBS.) Bialik, better cast here than she was in “The Big Bang Theory,” is charming and funny as Kat, who’s an equal mix of effervescence and insecurity; she has a trouper’s facility with the punch lines and a smart habit of underplaying the zaniness. In the season finale, Bialik’s obvious, bashful delight in her show and her fellow cast members even redeemed the credits dance. ‘Delilah’ (OWN) This new drama about an independent and idealistic lawyer in Charlotte, North Carolina, fills the prime-time soap opera vacancy left when “Greenleaf” ended its five-season run on OWN last year. And it keeps everything in the family: Like “Greenleaf,” which traced the intrigues at an enormous Memphis church, “Delilah,” currently halfway through its first season, was created by writer and producer Craig Wright. The virtues of the series have to do with solid construction and credible plotting and characters, with satisfaction

rather than excitement — it gets the job done without insulting your intelligence. Maahra Hill, in her first shot as a series regular, let alone star, brings an appealing tartness and determination to the title character. She also works well with Jill Marie Jones, who plays a best friend and opposing lawyer reminiscent of Yvonne Orji’s Molly in “Insecure.” And despite what look like the constraints of budget and pandemic shooting, the first-season arc involving a cover-up of defective military equipment has been fairly tense. ‘For Life’ (ABC) The COVID-19 pandemic showed up as a plot point in a lot of shows this season, but most paid it lip service, having characters ostentatiously don masks on the way to procedural business as usual. “For Life,” on the other hand, took a thoughtful, tough-minded approach, sending its hero, the one-time jailhouse lawyer Aaron Wallace (Nicholas Pinnock), back into his former prison to investigate a coronavirus outbreak among the inmates. Titled “354,” it was the best pandemicthemed episode I saw. In its recently concluded second season, the moving and nuanced “For Life” was again among the handful of distinctive dramas on network TV, a group that includes CBS’ “Evil,” the CW’s “Black Lightning” and NBC’s Canadian import “Transplant.” An abbreviated 10-episode run was an advantage, but what really helped in Season 2 was Aaron Wallace’s release from prison, the life-changing victory toward which the first season had built. The show could have lost momentum; instead it opened up and gained depth, physically free of the claustrophobic jailhouse confines but still tightly linked to them in psychological and thematic terms. ‘Resident Alien’ (Syfy) In shows like “Con Man” and “Powerless,” versatile actor Alan Tudyk has made a particularly fine art out of frustration — specifically, the agony of the man who feels that the lesser beings around him are not paying him the proper respect. Tudyk is at it again, except that this time he’s playing a towering, pompous alien scornful of the humans he has been sent to exterminate.

The premise of “Resident Alien,” which was created by “Family Guy” writer and producer Chris Sheridan, is pretty irresistible. Tudyk’s space traveler crashes in the Colorado mountains, stranding himself on Earth and losing his humanitydestroying gizmo under the snowpack. To fit in while he searches for it, he kills and assumes the shape of the first human he finds; now named Harry, he learns human behavior and the English language from marathon viewings of “Law & Order” and takes his place as the town’s decidedly prickly new doctor. Tudyk deftly dispenses both deadpan stares and comic apoplexy, and through the first half of its initial season, the show was consistently clever and astringently funny. Some schmaltz started to creep in at midseason; there’s a lot riding on Wednesday night’s finale. ‘Snowfall’ (FX) Set in Los Angeles in the mid-1980s, “Snowfall” takes inspiration from stories of CIA involvement in the birth of the crack cocaine epidemic, but it isn’t interested in arguing about the historical record. Across its four seasons — the fourth has three episodes remaining — it has been a bleak and bracing morality tale, tracing the mutually beneficial but increasingly soul-destroying relationship between precocious drug dealer Franklin (Damson Idris) and sleepy-eyed CIA agent Teddy (Carter Hudson), who is idealistic one moment and toxically cynical the next. Counting John Singleton and “Justified” writer Dave Andron among its creators and producers (and the great crime novelist Walter Mosley among its writers), “Snowfall” is, when it’s on its game, one of the most engrossing shows on TV. It tends to seesaw, sometimes losing its grip on its intertwining story lines; watching sitcom veteran Suzy Nakamura get to stretch out this season as a hard-case investigative reporter has been fun, but the plot built around her doesn’t make a lot of sense. The show is on firm ground, though, when it focuses on Franklin and Teddy and on the small band of dreamers and bitter realists they trust, played by a stellar cast including Sergio Peris-Mencheta, Michael Hyatt, Amin Joseph and Isaiah John.

Virus variants can infect mice, scientists report By APOORVA MANDAVILLI

B

ats, humans, monkeys, minks, big cats and big apes — the coronavirus can make a home in many animals. But now the list of potential hosts has expanded to include mice, according to an unnerving new study. Infected rodents pose no immediate risk to people, even in cities like London and New York, where they are ubiquitous and unwelcome occupants of subway stations, basements and backyards. Still, the finding is worrying. Along with previous work, it suggests that new mutations are giving the virus the ability to replicate in a wider array of animal species, experts said. “The virus is changing, and unfortunately it’s changing pretty fast,” said Timothy Sheahan, a virus expert at the University of North Carolina at Chapel Hill, who was not involved in the new study. In the study, the researchers introduced the virus into the nasal passages of laboratory mice. The form of the virus first identified in Wuhan, China, cannot infect laboratory mice, nor can B.1.1.7, a variant that has been spreading across much of

Europe, the researchers found. But B.1.351 and P1, the variants discovered in South Africa and Brazil, can replicate in rodents, said Dr. Xavier Montagutelli, a veterinarian and mouse geneticist at the Pasteur Institute in Paris, who led the study. The research, posted online earlier in March, has not yet been reviewed for publication in a scientific journal. The results indicate only that infection in mice is possible, Montagutelli said. Mice caught in the wild have not been found to be infected with the coronavirus, and so far, the virus does not seem to be able to jump from humans to mice, from mice to humans, or from mice to mice. “What our results emphasize is that it is necessary to regularly assess the range of species that the virus can infect, especially with the emergence of new variants,” Montagutelli said. The coronavirus is thought to have emerged from bats, with perhaps another animal acting as an intermediate host, and scientists worry that the virus may return to what they describe as an animal “reservoir.” Apart from potentially devastating those animal populations, a coronavirus spreading in another species may then acquire dan-

gerous mutations, returning to humans in a form the current vaccines weren’t designed to fend off. Minks are the only animals known to be able to catch the coronavirus from humans and pass it back. In early November, Denmark culled 17 million farmed mink to prevent the virus from evolving into dangerous new variants in the animals. More recently, researchers found that B.1.1.7 infections in domesticated cats and dogs can cause the pets to develop heart problems similar to those seen in people with COVID-19. To establish a successful infection, the coronavirus must bind to a protein on the surface of animal cells, gain entry into the cells and exploit their machinery to make copies of itself. The virus must also evade the immune system’s early attempts at thwarting the infection. Given all those requirements, it is “quite extraordinary” that the coronavirus can infect so many species, said Vincent Munster, a virus expert at the National Institute of Allergy and Infectious Diseases. “Typically, viruses have a more curtailed host range.” Mice are a known reservoir for hantavirus, which causes a rare and deadly disease

in people. Even though the coronavirus variants don’t seem to be able to jump from mice to people, there is potential for them to spread among rodents, evolve into new variants and then infect people again, Munster said. The variants may also threaten endangered species like black-footed ferrets. “This virus seems to be able to surprise us more than anything else, or any other previous virus,” Munster said. “We have to err on the side of caution.” Sheahan said he was more concerned about transmission to people from farm animals and pets than from mice. “You’re not catching wild mice in your house and snuggling — getting all up in their face and sharing the same airspace, like maybe with your cat or your dog,” he said. “I’d be more worried about wild or domestic animals with which we have a more intimate relationship.” But he and other experts said the results emphasized the need to closely monitor the rapid changes in the virus. “It’s like a moving target — it’s crazy,” he added. “There’s nothing we can do about it, other than try and get people vaccinated really fast.”

OVID-19 was the third leading cause of death in the United States in 2020, displacing unintentional injuries and trailing only heart disease and cancer, federal health researchers reported Wednesday. The coronavirus was the cause of death for 345,323 Americans in a year that exacted a steep price in lives lost. In roughly 30,000 additional cases, death certificates cited COVID-19 but it was not deemed the cause of death, according to the National Center for Health Statistics. Some 3,358,814 Americans died of all causes in 2020, a 15% increase in the ageadjusted death rate over that in 2019, when 2,854,838 Americans died. In addition to COVID-19, heart disease claimed higher

numbers of lives than expected last year, as did Alzheimer’s and diabetes — a phenomenon statisticians refer to as excess deaths. “There’s a substantial number of excess deaths, beyond what we would have expected in a normal year,” said Robert Anderson, chief of the mortality statistics branch at the NCHS and a senior author of two reports published by the Centers for Disease Control and Prevention. While deaths from heart disease and other illnesses should have increased slightly because of the aging of the population, “this is way up and beyond what we would expect,” Anderson added. In a second report issued Wednesday, he and his colleagues scrutinized 378,000 death certificates in 2020 that listed COVID-19 as a factor to determine whether too many deaths

had been erroneously attributed to the coronavirus. In the early days of the pandemic, testing was sporadic and patients often died of what initially seemed unrelated causes, like heart attacks. But the researchers found that the virus was in fact the underlying cause of death in the vast majority of the cases. “Since the beginning of the pandemic, people were claiming deaths were simply being attributed to COVID when people were dying of other causes,” Anderson said. “We show that’s not the case.” The researchers’ examination of accompanying conditions on death certificates, like pneumonia or respiratory failure, and contributing conditions, like high blood pressure and diabetes, were consistent with what doctors see in patients who die of COVID-19.

COVID-19 death rates were highest among men; elderly people ages 85 and over; and Native American, Alaska Native and Hispanic individuals. Overall, the highest age-adjusted death rates for all causes were seen among the elderly; Black, Native American or Alaska Native individuals; and men.

How blowing up college sports became a rallying cry for some in Washington By ALAN BLINDER

R

amogi Huma, a former college football player, had been at a Justice Department lectern for eight seconds when he began an excoriation of the National Collegiate Athletic Association. The governing body of college sports was, he declared, “a predatory economic cartel that treats players like university property rather than people.” Huma had long used similar language as the leader of the National College Players Association, an advocacy group. But his 2019 speech to a roomful of antitrust experts at the Robert F. Kennedy Building signaled a shift in Washington. Less than a decade earlier, Huma recalled, federal law enforcement officials had told him that the capital’s political climate did not support action against the NCAA. Now he was being invited to speak on Pennsylvania Avenue. “More and more people find what the NCAA is doing is just patently unacceptable in terms of their treatment of athletes,” said Sen. Cory Booker, D-N.J., who played football at Stanford University and has championed a proposal that would compel colleges to share athletics profits with some players. The association, he added, was “not realizing the moral view of this has really grown or shifted.” The NCAA is embroiled in perhaps the most crucial stretch of its long relationship with Washington, where top government officials have increasingly voiced doubts about the management and restrictions of college sports. On Wednesday, the 115th anniversary of the NCAA’s founding under pressure from President Theodore Roosevelt, the Supreme Court was slated to hear the association’s appeal in a case about caps on certain benefits for student-athletes. This summer, around the time the justices could announce their ruling, a Florida law is scheduled to take effect and allow players to profit off their fame, disrupting the uniform rules that have regulated college athletics for generations. Those potentially seminal developments were brewing before this month’s NCAA basketball tournaments demonstrated unequal treatment between the men and women competing in them, prompting new outrage from members of Congress. And, encouraged by Huma, star athletes at both tournaments called attention to what they condemned as overly restrictive NCAA rules that have remained in place even as the industry’s financial might swelled. The confluence of events could ultimately push Washington toward a few outcomes, including national protections for student-athletes or sustained scrutiny on the NCAA from Capitol Hill and the Justice Department. What lawmakers say is already clear, though, is that the NCAA’s political standing has eroded in recent years, diminished by protracted internal debates and bipartisan, coast-to-coast pressure for

NCAA officials contend that they are still a force in Washington and that they are committed to new rules to allow players more financial opportunities, especially through social media platforms where many athletes command large followings. Change has been slow, however, because of the association’s byzantine design and because the Justice Department, in the waning days of the Trump administration, expressed misgivings about the NCAA’s plans. The association’s president, Mark Emmert, acknowledged in an interview this month that there were “significant concerns about some of the dynamics in college sports right now, and that’s neither inappropriate nor unfair.” But he bristled at more than a year’s worth of assessments by current and former lawmakers, regulators and college sports executives that the NCAA had become less formidable in the capital. “We’re talking about these issues, working them through, trying to make sure everybody understands the views of the universities that are the members of the association,” said Emmert, who noted that he had spoken with a senator perhaps an hour earlier. “Are there disagreements? Of course. Are we open to the input, thoughts and ideas of members of Congress? Of course.” The NCAA has long been a favored target for frustrated fans, incredulous boosters and, from time to time, senators. But only in the past few years has the association also become such a lasting political target, a status it has been especially unable to shake since 2019, when California passed a law to allow players to pursue endorsement deals and hire

agents. The measure, scheduled to take effect in 2023, passed unanimously and amounted to a direct challenge to the NCAA’s restrictions on players. After California’s move, elected officials elsewhere — some motivated by moral outrage, others perhaps by the prospect of losing a prized recruit to a California school, and just about all sensing an issue that defied traditional partisan lines — joined the chorus demanding new rules. Confronted with a sea of statehouse uprisings, the NCAA shifted its focus toward Washington and promised its own changes. There has been significant reason to seek federal intervention: Different rules from one state to another, NCAA officials warned, would allow some universities to dangle better benefits toward recruits and give certain schools unfair advantages. But some in college sports also believed that buttoned-up Washington could be something of a safe harbor, especially compared with restive state capitals where the NCAA’s concerns were being proudly defied. In Washington, though, some prominent lawmakers were wary after years of delays and mixed signals from college sports leaders. They were hardly ready to shut out the NCAA, many said, but the association would not go unquestioned. “There’s no question that the NCAA has a lot of power,” said Rep. Lori Trahan, D-Mass., who played volleyball at Georgetown University. “I know my office and I have had plenty of communication with them. But what you’re seeing right now is a bipartisan recognition that the current system is broken, it has been for a long time, and it needs to be fixed.” Lawmakers, she added, feel “like they’ve got a role to play in all of this. Would we have liked the NCAA to come up with a proposal that met the need and met the inequity? Of course.” Sen. Chris Murphy, D-Conn., noted that it was “kind of impossible for them to represent the interests of both Auburn and Amherst,” but suggested that the sprawl of the NCAA, which includes about 1,100 colleges and universities, left its message muddled and inconsistent. “The power of the status quo in this debate is going to flow directly through the schools and conferences, not the NCAA, and I think the NCAA has made it pretty clear that they are not able to articulate a consensus point of view but that they’re also not terribly interested in policing student safety and student economic rights,” he said. Although the NCAA has a lobbying presence in Washington, powerful leagues have increasingly stepped up their efforts to shape policy. Federal records show that the five most influential leagues in college sports — the Atlantic Coast, Big Ten, Big 12, Pac-12 and Southeastern conferences — combined to spend more than $1.7 million on lobbying in 2020, up from $300,000 in 2019.

From page 26 Emmert, a former professor of political science, suggested it was a savvy approach, not a measure of the NCAA’s clout, for leagues to try to lobby officials who might be particularly affectionate toward their brand-name schools. Others in college sports agreed that a conferencedriven lobbying strategy could certainly be good politics, but that it also reflected serious concerns about the NCAA’s influence. “The NCAA blue disc is toxic in some quarters in Washington, D.C., but I would suggest that not all of that is fair,” said Bob Bowlsby, the Big 12 commissioner, referring to the association’s logo. “The analogy with Congress is spot on: Everybody loves their congressman but hates Congress, and everybody loves their school, but they hate the NCAA.” With the NCAA sometimes proving “a problematic brand,” Bowlsby said, “we, obviously, want to have our own representation.” That notwithstanding, the NCAA still has powerful allies in Washington. Until recently, Veterans Affairs Secretary Denis McDonough and Vivek Murthy, the surgeon general, sat on the association’s board. When McDonough left the board last year, Robert Gates, who led the Pentagon for parts of the George W. Bush and Obama administrations, took his place. Legislators are careful not to question the personal integrity of NCAA leaders. But in a twist that many government and sports officials laughingly acknowledge, the U.S. Congress has wound up complaining about another organization’s sluggishness. Some lawmakers say that the NCAA’s current proposal, which would allow students a regulated opportunity to profit off their fame, falls far short of expectations. “There are a lot of people who were sort of stunned by how little they offered, or were appalled by how little they offered,” Booker said. “And it may have confirmed a lot of skepticism about the institution’s ability to govern itself, to reform itself.” Although Democratic proposals have drawn most of the attention, especially now that the party controls both chambers of Congress and the White House, Republicans have offered measures that would give student-athletes greater autonomy but impose more limited checks on the NCAA’s power. a hearing last year that drew Bowlsby, Emmert and Huma, did not respond to an interview request, nor did Rep. Anthony Gonzalez of Ohio, who introduced a bipartisan proposal during the last Congress and was the only Republican lawmaker to address the NCAA convention in January. “The thing that I’m always balancing in my head is, how do we extend student-athlete rights as far as we can without jeopardizing the system overall?” Gonzalez, who played football at Ohio State University, said in that appearance. A crucial question now is the timing of any federal action. Some legislators, like Booker and Trahan, believe that the emergence of new state laws will encourage Congress to act quickly, per-

haps as soon as this summer. But lawmakers said the White House had shown only limited interest so far, and Murphy predicted the matter would not go before the full Senate before the end of 2021. “Realistically, this is not on the top 10 list of the House or the Senate right now,” said Murphy, who said he was unbothered by the possibility of varied state laws coming online. And while the Justice Department sided with the former athletes whose case, NCAA v. Alston, No. 20-512, was to go before the Supreme Court on Wednesday, the department is widely seen as unlikely to take additional quick action on college sports in the opening months of a new

administration. Even before the transfer of power, the government was not close to bringing an antitrust case against the NCAA, according to two former law enforcement officials who spoke on the condition of anonymity to discuss confidential deliberations. The department declined to make Richard Powers, the acting assistant attorney general for its antitrust division, available for an interview. “We were created through a political process,” Donald M. Remy, the NCAA’s chief legal officer, said. “It has been the case since then that the public trust of college sports has drawn the interest of federal, regional, state and local policymakers.” On that much, at least, the NCAA and its critics and skeptics agree.

S

ixth-seeded Texas went cold at the worst possible moment, failing to muster a credible threat to South Carolina. Louisville had a clear shot at Stanford, but the top-seeded Cardinal came back — and then some — in the second half. Stanford claimed the last spot in the national semifinals with a 78-63 defeat of Louisville, after trailing by 12 points at halftime. South Carolina sailed in the round of 8 with a 62-34 win over Texas. In the ultimate sign of futility after a run that included upsets of UCLA and Maryland, Texas scored zero points in the fourth quarter — missing all 15 of its shots. The Longhorns shot 23% for the game. The Gamecocks dominated from the start to earn their third trip to the national semifinals and their first since winning a national title in 2017. “When we got knocked down four times this season, they got back up stronger,” South Carolina coach Dawn Staley said in a television interview after the game, referring to the Gamecocks’ four losses this year. “And that’s the mark of a true champion.” Louisville’s Dana Evans put up 10 of her 24 points in the first quarter while the Cardinals kept Stanford below 28% shooting in the first half. But a 13-0 run toward the end of the third quarter put the Cardinal ahead as they started containing Louisville’s top scorers. Then, Stanford ran away over the final 10 minutes. Lexie Hull had 21 points and nine rebounds, while Haley Jones had 10 points and 10 rebounds. Stanford’s Ashten Prechtel, who finished with 16 points and made all six of her shots, opened the fourth quarter with a 3-pointer that bolstered Stanford’s confidence and sparked a decisive run. “It was tough to not play in the first half — and I was nervous,” Prechtel said about Louisville’s lead. At halftime, Prechtel said Stanford coach Tara VanDerveer “ripped into us a little bit” and told them they had to “compete in the second half” if they wanted to stay in San Antonio. “Coming out of halftime, there was urgency to how we were going to play,” Prechtel said. Cooke led with 16 points, and added six rebounds and three assists. Henderson had 12 points and seven assists, while Saxton had 12 points and eight rebounds. The Longhorns got into gear briefly in the third quarter as more and more Texas fans trickled into the audience after work hours, bolstering the cheers and outcries that bounced around the cavernous stadium walls at the Alamodome. Looking exhausted and downtrodden after Warren scored their final points in the third quarter, the Longhorns let South Carolina celebrate early with a big run while they continued to watch their shots bounce off the rim, not adding a single point to their score in the final 10-minute period. “It was hard for me to not get too excited,” South Carolina’s Cooke said of the last quarter in a call with reporters after the game. It was the first scoreless period of the women’s tournament since the NCAA switched from halves to quarters in 2016, according to the organization’s records. The university, located in Austin, is about 80 miles from San Antonio, the hub for the tournament where most of its games have been staged. “I thought our fans provided a great environment for both teams,” Schaefer said Monday. South Carolina will play Stanford. On Monday night, UConn and Arizona squeezed past their opponents to set up the other semifinal. Both semifinals are scheduled for Friday night.
