Is a mediator the wizard in facilitating that elusive solution? What does it mean to say that mediators are neutral conflict resolvers? It appears to imply that mediators act as neutral and impartial brokers of settlement negotiations in a procedural sense. Mayer in his book Beyond Neutrality however suggest that most conflicts are actually resolved by the affording participants “third side” resources such as a provider, teacher, bridge builder, mediator, healer and peacekeeper. Without compromising impartiality some of these resources are often part of what a mediator provides. Mediators do not take sides with participants and do not decide who is “right' and who is “wrong”. Mediation is not able to change anyone's values. The process is not aimed to find fault, assign blame or punish anyone. Is competition always bad and cooperation always good in the mediation process? Not necessarily. Competition can be constructive provided that participants are ethical, wise, skillful and informed. As Mayer puts it “One of the greatest gifts conflict resolvers can give to people in conflict is to assist them in competing constructively when competition is appropriate.” Is it correct that the aim of Mediation is a win-win solution? Yes but as in most instances the mediation process commence at a stage when participants are overly conscious of only loss. The primary objective in mediation should thus be through the use of win- win language assist participants to generate options and solutions which would bring about a

resolution that is in the interest of everybody directly or indirectly involved. As the mediator can have access to more information than legal practitioners, it is possible to recognize the myriad of ways legal issues interacting with the participants lives can be resolved in a way best suited to everyone involved. Before agreement participants have a right to change their minds, to try out an option, or to make sure that the final result will be balanced and fair. Participants cannot loose anything because they control the process and as such they can both get the proverbial second bite at the cherry. The mediator is also in a position to explore the consequences and risks of a failure to settle, provide an unbiased review of the issues and can facilitate a more realistic approach to the likelihood of success. Mediation does not force a settlement but may open up choices which did not exist before. Mediation can thus, at the very least help participants to understand that the risk associated with litigation in the matter might outweigh the benefits of a mediated settlement. Is the principle “interests are in: positions are out always applied? No. It is often necessary for participants to create options by testing proposals even if these proposals are not necessarily made with underlying interests at heart but rather to test the water.

Is passionate advocacy denied because constructive communication is regarded to be of more importance? Mayer argues that effective negotiation may be undermined or prolon ged if the participants are denied the opportunity to strongly advocate things they feel strongly about. The task of the mediator will be to properly manage the reaction to the advocacy and it follows that this does not mean that this should not happen. Are adversaries a problem as good relationships are the goal? Mediators should know when to engage and when to avoid conflict- sometimes it is required to be adversarial to move the conflict. The goal to achieve is an effective resolution of the conflict, not necessarily the establishment of harmonious relationships. In mediation, at least initially, the conversation occurs between the mediator and one person at a time. While the mediator talks to one person, the other will be expected to listen. This may feel awkward at first as it is different to the normal communication pattern of people in conflict. This allows the mediator to ask questions that will assist the understanding of each participant's perspective. It also allows the participants to understand each other's perspective. In this way the real issues, as opposed to legal demands can be unearthed and explored. Different solutions often become apparent as by listening and gaining an understanding of the other participant's perception of the issue makes it possible to see the other side of the proverbial mountain which has two sides.

Tips & Tricks for a no-worry swimming pool After a good week of cold and rain we are now really heading for the hoter period again. Time to prepare your pool for summertime and turn it into a safe and easy maintenance pool. Many people bump into a dirty pool and water when they open the cover. On a daily basis LIC Pool is called out to pools with a problem, from dirty water, poorly working equipment to a leaking pool shell. It all starts with perfect balanced water. Not so easy as it seems but very important because it does not only look ugly when the water is dirty but even the equipment and pool surface may age faster and even cause premature breakage.

With the home water testing kits you can only test the level of acid and chlorine but there is a lot more that makes your water safe and properly balanced. Alkalinity: Total alkalinity is a measure of the 'buffering capacity' of the water, or its ability to resist a change in pH. Every pool needs to have a check up on the Total Alkalinity at least every 3 months. At the LIC Pool testing station in our shop we do this for clients at no charge. You will safe on chlorine and Acid once this total alkalinity is between 80-120 ppm. If it is out of this range the water has no buffer and can't be balanced and therefore you will use to much chemicals and waste money and your pool water is not safe to swim. Marshmallow bars This is a deliciously decadent recipe, but since its winter we can treat ourselves Ingredients: ¾ cup butter 1 ½ cups sugar 3 eggs 1 t vanilla 1 1/3 cups our ½ t baking powder ½ t salt 3 T cocoa ½ cups chopped pecan nuts 4 cups marshmallows

Topping: 1 cup of dark chocolate 3 T butter 1 cup peanut butter 2 cups rice crispy cereal

Method: Cream together the butter & sugar. Add eggs & vanilla, beat until light & fluffy. Combine flour, baking powder & salt and add to creamed mixture. Add pecan nuts and spread mixture into a roasting pan. Bake at 180˚C for15-18 minutes. Sprinkle with marshmallows and return to the oven for 2-3 minutes. Then spread melted marshmallows with a knife dipped in cold water. Topping: Combine dark chocolate, butter & peanut butter. Heat while stirring continuously until melted and well blended. Remove from heat and add rice crispy cereal. Stir the mixture and then spread over cooled base. Leave to set & then slice up and enjoy!

Take care, before there’s not a drop to spare Indoors

Use what you need to have more for your garden Ÿ Take shorter showers – close the tap while you're scrubbing or washing hair, rinse only when you're done. Ÿ Turn off the water while shaving or brushing teeth – you'll be amazed how much water is saved. Ÿ If you have a dishwasher, load it fully instead of hand washing a few items at a time, hand washing uses far more water than modern, efcient dish washers. If you have 2 sinks, ll one with rinse water, with one sink only, rst gather all our washed dishes in a dish rack, and then rinse them quickly. Ÿ Make sure toilets don't leak. Replace old fashioned large cisterns with smaller modern low ow models.

Adjust sprinklers on lawns so that only the desired area is watered and not the house, pavement or street. Water as early as possible to avoid unnecessary evaporation due to heat building up in the soil. This will ensure better saturation, also in other areas of the garden. Water deeper and infrequently – this promotes deep, strong, drought tolerant root systems. Don't over water! Excess moisture weakens the plant's root system by damaging the hair roots that are responsible to take water and nutrients through to the main arteries. The plant will be more susceptible to diseases and insect damage. Even drought resistant plants will make use of water if it is available and eventually evolve to become lazy, with shallow roots, making them dependent and much weaker. In-ground sprinkler systems irrigate quickly, applying no more water than the soil can absorb. Divide your water cycle into shorter periods which reduce runoff and allow for better absorption every time

you water. Watering cans help minimize water wastage (and prevent abby arms). Organic rich soil retains moisture far more efciently than clay or sand. Use enough compost, old cattle manure or coco peat when preparing for planting. Never consider using human waste, dog or cat litter – all of these contain bacteria, parasites, viruses and pathogens that can cause various unwanted conditions. Don't add it to your garden compost heap either, the heat generated is far too low to destroy any of these elements.

Mow lawns on a higher cutting, the slightly longer foliage minimizes evaporation and builds a healthier root system.

Moral of the story – it's a team effort, being “in charge” is not always the answer!

Trees are more visually appealing when their lower branches are trimmed to 'lift' the canopy and create better structure. Removing unnecessary foliage reduces water requirements too.

The roots of Marigold secrete a substance that destroys Nematode parasites in the soil. Nasturtium leaves are nature's best antibiotic, full of goodness, not just the owers look great in salad. Now is the time to plant these two insect repellent annuals.

Reduced leaf size and fewer leaves -Plants with reduced leaf size have less surface area from which water can be lost through evaporation, e.g. Lavender. Others again, shed their leaves during periods of drought to reduce moisture loss – Acacias. Grey or blue-green foliage – reect the rays of the sun, keeping the plant cool, reducing water loss: Helichrysums, Echeverias, Artemesia, Lavender. Plants such as Buddlejas, Olea Africana (Wild Olive) and Gazanias have the undersides of their leaves
