UNDERSTANDING THE FORECLOSURE PROCESS We all regularly hear about the “foreclosure crisis” going on in our country but what you may not know is that the situation in Florida is far worse than in any other state. According to the latest statistics released by the Mortgage Banker’s Association, Florida accounts for 23.7% of all foreclosures nationwide; which correlates to Evan M. Rosen 466,454 homes. Not only is this the largest number of any other state, it is larger than the total number of loans in 22 other states combined. The result is our courts are backed up with a caseload of 310,770 cases. Couple that with the termination of special court funding for foreclosure cases which took effect on July 1st and it appears the crisis in Florida is only getting worse. So how did this backlog swell to such an enormous figure? Why does it take so long for a bank to foreclose? This was not always the case, right? Well, we know that before Wall Street started selling shares of stocks in pools of mortgages through a process known as securitization, foreclosures could be handled within a few months. Now, in great part due to the banks’ rush to profit and lack of proper simple documentation required in any real estate or mortgage transfer, as well as the lack of complicated documentation required as a result of the securitization process, no one knows how long some cases will take because in many instances no one can properly prove who is entitled to foreclose.
Like every other plaintiff in any civil lawsuit, the plaintiff has the burden to prove all elements of their case by a “preponderance” or greater weight of the evidence. In a foreclosure action, the entity entitled to foreclose must successfully prove by this standard, among other things, that they are the proper party; the entity or person actually entitled to receive payments due under the terms of the note; and/or the party entitled to foreclose. This is generally referred to as “legal standing” and often, the banks cannot prove they have it. What follows is a chart illustrating the time periods in the pre-foreclosure and foreclosure process in Florida.

Well it’s summertime blues and now I know why we feel this why. Just listen to a politician or media commentator and one of those recognizable idioms becomes part of the dialogue. Take for example a fairly new one, “AT THE END OF THE DAY.” What is the individual talking about? Do they mean at 5:00 PM when the whistle blows at the factory or the time Latin families sit down for dinner or the time Entertainment Tonight begins. I imagine using that aphorism is less threatening than if a doomsayer who resembled Nostradamus said, “AT THE END OF THE WORLD.” With that dictum, I would get more concerned and stock pile on supplies: Water, flashlight, galoshes, Campbell Soups, plastic sheets and duct tape. Another saying that is starting to get my gourd is, “FROM THE GET GO.” What get go? Is the person talking about when they were in diapers or when they rented their very first apartment with a futon bed, pine bookcase and beer in the refrigerator? It is very ambiguous when they say that but, I imagine it fits perfectly in with their career or business plan - - - kind of preppy if you ask me like tossing caps in the air on graduation day and looking forward to that great big beautiful tomorrow. Another pretentious one that does not need repeating is, “HAVING SAID THAT.” Who really cares if they just said that? Does the proverbial speaker honestly think there is some grammarian from Toastmasters International keeping track of the way he or she speaks? I never hear President Obama say that. Perhaps he should try “SAY WHAT,” especially when it comes to dealing with the Republicans. The lingo conjures up a sense of security and a starting point for more rhetoric. Philanthropy is a big part of the community and apparently there are only a few aphorisms that can describe what an individual or organization is genuinely doing; for example, the frequent, “MAKING A DIFFERENCE.” Are they talking about changing their Xerox paper to color or their wardrobe to plaid? Another one is “DO THE RIGHT THING.” This one is popular among police benevolent groups and sports figures. I believe this phrase sounds better than, DO THE LEFT THING, which sounds too dyslexic and the right wing would have a field day thinking it is
too liberal. Another charity case is, “GIVING BACK.” What have they taken they feel they need to give back; their video collection of Nancy Graves or the Glenn Beck television shows? One euphemism that has red, white, and blue written all over it is, “IN HARM’S WAY.” My feeling is this maxim brings together both sides of the political spectrum and it is making the greatest sacrifice. For those who believe the Lord created the world in six days, the ocean and mountains look fine. If the Supreme Being worked on the seventh day well then maybe it would have been a better place. But that would be overtime and corporations are cutting back on the forty hour week and we’re back to “AT THE END OF THE DAY.” Well it’s time to “STEP UP TO THE PLATE” for colloquialism even if you’re not playing baseball. Hearing this one signifies a base hit and that’s one for the team! One that a banker thought up and in all probability caused the recession is, “LET’S GIVE CREDIT WHERE CREDIT IS DUE.” I understand that it has this positive pat-on-the-back feeling. When Congress says it, do they mean to raise the debt ceiling? When European Nations use it, consider it a way of dealing with the Greek debt crisis and “GIVING BACK” to Greece for all their contributions to western civilization. Another saying that sounds as if it came from a pawn shop is, “GIVE IT UP.” I believe this started in elementary school when a classmate was hogging the rubber ball and the other students wanted to play. I also hear this at music concerts when introducing the entertainers. I sure would not want our government to say “GIVE IT UP” especially when it comes to raising taxes on working class Americans. However, Congress can raise taxes on the two percent of the wealthy Americans and that I would not mind so much. Duplicating the success of the Johnson and Wales University mobile cookery, a caravan of gourmet food trucks recently converged at the Intracoastal Mall parking lot. This is the first time at the North Miami Beach location where twenty vendors participated in the Gourmet Truck Expo with most of the food items starting at $3.00 to $10.00. The sponsor, with the same name as the event, specializes in organizing and promoting food truck events in South Florida. Mobile kitchen culture has evolved from the humble taco stand to the stainless steel vending truck that blows its horn at places of employment during morning breaks and at lunchtime. Now there is a surge of mobilized trained chefs cooking up dishes with appetizing menus in customized vehicles. From concession trailer to catering trucks, dependable generators keep the vehicles up and running with electricity and once inside, kitchens are installed with propane stoves, steamers, refrigerators, freezer, stainless steel table, cabinets and sinks.
At the expo, diners waited in line to order various dishes. At night, the atmosphere changed as guests flocked to lighted marquee signs or followed their nose to ambrosia. A couple of mobile kitchens set up table and chairs; some families brought their own adding to the asphalt ambience. Edward Garazi and his wife Carrie were sampling items from Motys Grill. “It’s a social thing and this event brings more attention to the outdoor mall. The food is very good and I recognize several of the vendors from the university.” At Mr. Good Stuff, the specialty is Carolina BBQ with cheddar cheese and coleslaw served on a cornmeal Luna. Creative dishes as, Son of Brisket was flavorful served with red pickled onions. At the Mexican Gourmet, fish and shrimp tacos at $3.50 each was a bargain. Aaron Merullo pulled his 12 foot yellow and red food trailer called PS561all the way from Lake Worth. “I serve 100% all beef hot dogs and avocado veggie dogs with all the toppings. I usually bring my trailer to birthdays, graduations and Super Bowl parties.” A traditional South American dish was
served at the Che Grill. Flavorful empanadas, stuffed pastries made with beef, chicken, ham & cheese or spinach and select seasonings and herbs. Another dish that looked appetizing but would raise a cholesterol red flag was the house specialty Lomito Sandwich. This is a thinly sliced churrasco steak grilled topped with mozzarella cheese, ham, fried egg, bacon, lettuce and tomato. Hold the mayo please! Many of the food dishes served obviously catered to a Latin palette; however, flavors distinctly from American, Japanese, Greek, Italian and Caribbean were available. Families shared items and were able to travel the culinary world. “I am trying the grilled goat cheese & prosciutto sandwich from Ms. Cheezious and it is quite tasty. Ordering a meal from a food truck is less expensive than ordering it from a full-service restaurant,” said Anie Lauredo from North Miami. Racks Italian Restaurant, a tenant of the shopping center, parked their truck and quickly became a popular meeting place since the eatery set out tables and chairs.

Those who attended the Gourmet Truck Expo saw the attractively landscaped Intracoastal Mall anchored by TJ Maxx, Old Navy, Sunrise Intracoastal Cinemas, Dollar Tree and Winn Dixie. An extensive renovation was completed in 2008 with many new retailers and restaurants now open.

- It’s no secret that guys love their cars, but are they more likely to always change the oil on time than to visit the doctor for their annual checkup? Almost 70 percent of men find it easier to care for their cars than for their personal health, according to findings from a new survey of 501 men ages 45 to 65 commissioned by Men’s Health Network and Abbott. In addition, more than 40 percent reported they would be more likely to address issues with their car than their health. Men may bring their cars in for service when an issue arises, and schedule regular tune ups to ensure that things are running smoothly, but they might not address their health in the same way. As a result, some men may be ignoring the symptoms of certain health conditions because they are reluctant to visit the doctor, the survey found. If men treated their bodies the way they treat their cars, they would schedule regular doctor’s appointments in the same way that they schedule regular tune ups. The survey is part of “T-Talk Tune-Up,” a new national campaign to raise awareness of men’s health issues. Racing champion Terry Labonte and national men’s health expert Dr. Harry Fisch have teamed up to lead the campaign and encourage men to schedule annual checkups with their doctors. “For many men, tuning up our cars is easier than getting checkups for our health,” says Labonte. “With the help of my wife, Kim, I (ARA)

New medicine approved by FDA to treat type 2 diabetes (ARA) - Diabetes (both type 1 and type 2) affects approximately 25.8 million Americans and an estimated 220 million people worldwide. Type 2 diabetes is the most common type, accounting for an estimated 90 to 95 percent of diabetes cases. Diabetes is a chronic disease that occurs when the body either does not properly produce, or use, the hormone insulin. Now there is good news for people with type 2 diabetes. Boehringer Ingelheim Pharmaceuticals, Inc. and Eli Lilly and Company announced the U.S. Food and Drug Administration (FDA) recently approved TRADJENTA(TM) (linagliptin) tablets, a new prescription medication used along with diet and exercise, to lower blood sugar in adults with type 2 diabetes. TRADJENTA (pronounced TRAD gen ta) can be used alone or with other commonly used medications for type 2 diabetes - metformin, sulfonylurea or pioglitazone. TRADJENTA lowered hemoglobin A1C (HbA1C or A1C) levels up to 0.7 percent (compared to placebo) in clinical trials. A1C is measured in people with
diabetes to provide an index of blood sugar control for the previous two to three months. TRADJENTA should not be used in patients with type 1 diabetes or for the treatment of diabetic ketoacidosis (increased ketones in the blood or urine). It has not been studied in combination with insulin. “Many people with type 2 diabetes are not able to control their blood sugar with diet and exercise alone and may also require one or more medications,” says Dr. John Gerich, professor of medicine, at the University of Rochester School of Medicine. “The FDA approval of TRADJENTA is exciting because there is only one dose to remember for patients, regardless of kidney or liver impairment. With TRADJENTA, physicians will have another option for managing type 2 diabetes, a potentially devastating condition.” TRADJENTA is a tablet that can be taken once a day, with or without food. It lowers blood sugar by increasing incretin levels, which increase insulin levels after meals and throughout the day. It was approved based on a clinical
trial program which included approximately 4,000 adults with type 2 diabetes. Included in the program were placebo-controlled studies evaluating TRADJENTA alone and with other commonly-used medications for type 2 diabetes. TRADJENTA lowered fasting plasma glucose (FPG) compared to placebo, when used as monotherapy and in combination with metformin, sulfonylurea or pioglitazone. FPG is used to determine glucose levels in a fasting state, usually upon waking up in the morning. It also lowered two-hour post-prandial glucose (PPG) levels compared with placebo as monotherapy and when used in combination with metformin. PPG is used to determine glucose levels after meals, usually two hours after eating. Effective ways to manage stress in the workplace (ARA) - From paltry paychecks to annoying coworkers, more than three quarters of Americans are stressing out about something related to their job, according to a new study. The vast majority of Americans (77 percent) are stressed by at least one thing at work, finds the Harris Interactive-Everest College Work Stress Survey. The most common issues are: low pay, commuting, unreasonable workload and concern over being fired or laid off. But these are not the only issues American workers are facing - annoying coworkers also made the list, followed by difficulty with a boss, poor worklife balance and lack of opportunity for advancement. “We’ve seen numerous surveys that confirm workplace stress has increased during the last several years,” says Wendy Cullen, vice president of employer development for Everest College.
Concerns over low pay and job security are consistently one of the top stressors for Americans. In most regions of the U.S., 16 percent of Americans listed low pay as their top stressor, and concerns over job security were a close second. For example, 13 percent of college graduates ranked losing their job as the biggest stressor, which is in line with Americans without college degrees. “One change we are seeing is that more and more Americans are pursuing careers in industries like health care, which offers more long-term stability.” Switching careers or going back to school to gain access to a more secure or better paying career is one technique that many individuals use to deal with insecurity in the workplace. How to deal with stress “The impact of stress cannot be overstated,” says Davis Brimberg, a Los Angeles-based psychologist who focuses on
workplace issues. “Almost all psychological problems are worsened by stress. People of all occupations and income levels are greatly affected,” he says. Workplace stress can have negative consequences on your performance at work, and your life. There are a number of techniques for dealing with workplace stress. First, learn to recognize the symptoms - you may feel a constant sense of nervousness, which can often lead to feeling withdrawn, irritable or apathetic. Stress is also associated with physical problems, such as fatigue and muscle tension. Physical exercise is also shown to help with stress management. Aerobic exercises have been shown to release mood-raising endorphins, so
getting 30 minutes of exercise a day can actually help decrease your stress levels. It is also important to get enough sleep, which can help your body deal with the effects of stress throughout the day, and makes you better able to manage emotional swings. There are also important strategies in your workplace that can help you deal with stress. Do not over-commit to non-
essential tasks. Prioritize important tasks, and learn to delegate non-essential ones. Also, you can schedule regular breaks into your daily routine to allow yourself to get away from your workstation or office. Additionally, Brimsburg suggests that getting help can be effective. “Counseling can be very helpful in relieving signs and symptoms of stress-related issues.”
