Wow. What an amazing response from our first newsletter. I have been wanting to do this project for a while, and am so happy that we did and for all the positive feedback.
Also I want to thank Preston for doing the Lyon’s* share of the work to put this newsletter together.
Wow 2022 has been a crazy year for real estate agents. Just when we mastered how to sell a house in a day, and how to get our Buyer’s offers accepted in bidding wars, along came summer and everyone went on vacation. The “out of office” replies from my email campaigns have tripled. And I think everyone is feeling the JOY of summer travel, after 2 summers of being “safe” at home.

Dear Real Estate Broker,
My Buyer and I are reviewing the closing statement and I see that although the seller is paying a 6% commission, The listing agent is getting 3 1/2% and I as the selling agent am only getting 2 1/2%.
So what now for real estate? School started and the cycle will continue. As people come to Florida on vacations, layovers or a night before a cruise they will once again start asking: How come we don’t live here? I mean that is what I did during a layover to Jamaica in 2005. Florida is open for business and the bidding wars that frustrated so many buyers has ended. That does not mean prices have dropped or will, we are in a new normal due to many factors (many of which i discuss in the Real Estate Finder Podcast with Staci), but it does mean that Buyers will once again make deliberate decisions (I choose real estate over Wall St as a career BECAUSE of the slow deliberative decision making process involved).

*Sometimes I think that I spend so much time on Lyons Road that I have come to believe the proper spelling is with a Y.
Dear Selling Agent,
The offer of compensation in the MLS is decided between the listing agent and the Seller. It does not matter what the listing agent is charging. Totally irrelevant. They can be selling their mom's house and charge little to nothing.
This is a business of cooperation. We want all agents and brokers to cooperate with us to sell the house so we offer them a portion of the commission. Back in the day of the listing was 6% and the offer of compensation was 3% it was simple. But that was not set in stone or by rule.
In the passed few years I noticed especially expensive houses to offer a little bit less. I
Isn’t the listing agent obligated to split the commission evenly between both agents?
I checked the MLS and the line that states variable/ dual rate commission Y/N says No.

personally in my business always offered 3%. Especially when I was flipping houses and selling my own inventory. However in the Crazy Seller’s Market of 2021, when simply listing a house resulted in multiple offers within hours, we had to ask ourselves, why would we spend thousands of dollars to attract an agent to bring us a buyer?
As we enter the new normal I believe the offer of compensation will stabilize.
You also asked about variable/ dual rate commission. That has nothing to do with the Buyer’s cooperation. This means that the amount the listing agent receives will be different if the listing agent brings the buyer Vs. If another agent brings the Buyer.
Imagine being so good at your job and finding a buyer for your listing, that your boss wants to pay you less for being awesome. But sometimes agents agree to this just to make the Seller happy. To me it’s ridiculous. I mean why be penalized for doing a good job. And why encourage me to bring a customer to a DIFFERENT house. But I digress.
If the listing agent takes a variable commission depending on who brings the buyer it needs to be disclosed in the MLS. Make that line yes. And if asked what the variable rate is, the listing agent must answer. This matters because 2 Identical offers can “vary” the net to the Seller.

I was recently commissioned by the one and only Frank McKinney to compose a piece of music for his July 7th Red Carpet Premiere of Real Estate Breakout! So on that Thursday, I suited up in my Maestro Tux, danced my way to the IPIC in Delray, and let my fingers ride the ivory ocean at the 6pm, 8pm, and 10pm showings. I must say… WOW did I have a blast!!
I’ve been to countless Frank events over the years and I always have the pleasure of meeting fantastic people and building wonderful new relationships so if you have never been to a Frank event, I highly encourage you to check one out!
If you don’t know this about me, one of my dreams (and I’m getting there) is to compose music for film scores and musicals (or really for any occasion.) So that evening of July 7th, was just the beginning of the wonderful things to come!! Real Estate has been a wild journey so far, and while my detour into Real Estate was very unexpected and felt incredibly far away from anything music related… Music has opened the doors for my opportunities in Real Estate!! Arriving to certain destinations in life isn’t always what we picture, nor is it fun at some moments, but I have to say… this journey in life has kept my WONDER ALIVE!!!!
The theme of the night was breaking out from the fears in our life that often imprison us and prevent us from sharing with the world our gifts, talents, dreams, and visions. I know that in my own life fear has held me back in countless moments. In this piece, you get to see some of the inspiration from those fears, and the journey to face them.
