Jonathan and Kaye Steinsapir have filed a personal injury lawsuit against Rad Power Bikes
The Palisades-Malibu YMCA is located at 821 Vía De La Paz in Pacific Palisades but has land at Temescala Canyon Park. Nearly all of the land north of the Malibu city strip–in the Santa Monica Mountains Coastal Zone–is considered Environmentally Sensitive Habitat Area (EHSA) by the California Coastal Commission and this includes the YMCA land that abuts the Santa Monica Mountains Conservancy’s Temescal Canyon Park. The area is also at high-risk for fires. “It’s a fire hazard to all those homes above that area,” Kirtley said in a phone interview. “So now, whatever, person or company did this, [has] now put the disposal responsibilities onto the YMCA. Now we’re gonna have to use dollars that we could potentially have used in the community to clean up somebody’s mess. Those dollars are now going for that versus helping out a family that is in need,”
The parents of a 12-year-old girl who died riding an e-bike in Pacific Palisades last year have filed a lawsuit against the company that made the e-bike.
According to Kirtley, when he went to check how the unknown parties gained access to the land, he found that they had cut the pole that the chain was normally attached to that blocked off the area, rather than just cutting the chain itself.
Jonathan and Kaye Steinsapir have filed a personal injury lawsuit against Rad Power Bikes, Giro Sport Design, Inc., Bell Sports, Inc. and Vista Outdoor, Inc. in the Los Angeles Superior Court in the Stanley Mosk Courthouse in Santa Monica. The lawsuit alleges that their daughter Molly Steinsapir’s death was caused by the Rad Power bike she was riding with a friend and the Giro helmet she was wearing on January 21 of 2021 on a large hill on the street Enchanted Way in the Pacific Palisades.

Illegal Dumping at Palisades-Malibu YMCA Will Cost Organization $1,500
Not only did the parties responsible for the dumping leave their mulch on YMCA land, they also dumped more of the mulch on land that belongs to the Santa Monica Mountains Conservancy, in Temescal Canyon Park, as well.According to Kirtley, it will cost around $1,500 to remove the mulch from the land. “It’s about $500 for load, I believe, to dispose of, so with three loads it is potentially $1,500, that they got away with not having to pay for themselves. I’m going to have to have a crew come in and do that. We’ll see if we can work together [with the Santa Monica Conservancy] to maybe do it on a cheaper bid because they had a load or two dumped on their property as well,” Kirtley said. In addition to the money that the YMCA will have to spend on cleanup, it’s possible that they may have to spend more to install security cameras as well. “We may have to install an expensive camera system because of this which would be additional dollars that the YMCA is going to have to spend that normally would be giving to families or going towards programs to get things to families in need. I think it’s important that people know that there’s a ripple effect and how it affects the community, along with the fire hazard issue,” Kirtley said. If anyone has any information about the illegal dumping or who may be responsible, you can email YMCA Executive Director Jim Kirtley at jimkirtley@ymcala.org.
The lawsuit includes five claims for relief alleging product negligence, wrongful death, strict product liability, and breach of express and implied warranty and asks for damages and court costs.
B y D olores Q uintana
The lawsuit further alleges that the “other Defendants, in this case, manufactured, marketed and sold a bicycle helmet that was also defective. The purpose of a bicycle helmet is to absorb the impact of a crash, and the Giro brand helmet Molly was wearing cracked but did not protect her from the brain injury that ultimately killed her. These Defendants’ actions were also a substantial factor in causing Molly Steinsapir’s death.”
Parents File Lawsuit in Death of Daughter Riding a Power Bike in Pacific Palisades
Rad Power Bikes issued a statement via email when queried about the lawsuit, “The entire Rad Power Bikes team extends its deepest condolences to the Steinsapir family on the tragic loss of Molly Steinsapir. We are aware of the lawsuit that the family has filed. Rad Power Bikes does not comment on pending litigation, including this case, and therefore has no comment on the allegations in their complaint or the underlying accident.”
Three bags of mulch dumped sensitiveenvironmentallyonland
On Wednesday, August 10, PalisadesMalibu YMCA Executive Director Jim Kirtley was notified by a volunteer that an unknown party had dumped three piles of mulch on YMCA land that is classified as environmentally sensitive.
The lawsuit states “Rad Power Bikes bears responsibility for the death of Molly Steinsapir due to their intentional and knowingly inappropriate marketing of e-bikes to children, failing to adequately warn about the dangers of children operating e-bikes, and due to the design defects in the RadRunner power bike, each of which was a substantial factor in causing the accident and Molly Steinsapir’s death. Further, Rad Bikes’ conduct was malicious, fraudulent, and oppressive.”

Dog Goes Blind After Suspected Oxycodone Overdose in Santa Monica’s Palisades Park August 14 incident leaves dog “Chance the Rapper” blind B y D olores Q uintana
• Behavioral changes (lethargy or unsteady when standing or walking; hyperactivity)
Lori Burns, a resident of Calabasas, California, took her dogs, one of them named after the musician Chance the Rapper, for a walk along Palisades Park in Santa Monica on August 14. While watching her two dogs and the scene around her, little did she know that soon she would have to rush her dog Chance to the vet on that 78-degree day. In a Facebook post about the incident, Burns noted that the smaller of the two dogs, Chance the Rapper, “started to breathe heavily and then he just collapsed. He couldn’t stand, was panting, and staring…and not focusing.” After noticing her dog’s distress, Burns immediately rushed him to VCA Animal Hospital in West LosTheAngeles.vetat the hospital informed Burns that Chance had a temperature of 106, which is a temperature that is dangerous and can be fatal for dogs, and, according to Burns, “iced his body to try to reduce his temperature, gave him oxygen, started him on IV fluids and performed tests.” Most alarmingly, the veterinarian said, “they were not sure he was going to make it – the high fever could result in organ failure.” After an hour, the veterinarian called Burns and informed her that the tests revealed a suspected oxycodone overdose. Oxycodone is a potent opioid medication that is usually used for acute to severe pain management and can be highly addictive. Burns stated in the Facebook post that she then contacted the ASPCA’s Poison Control Line to get a case number and give the number to “the vet so they could start on a protocol.”
LAPD says no evidence of criminal or gross negligence in July 22 incident
Chance was held in observation by VCA Animal Hospital overnight and made a rapid recovery while in care. Unfortunately, the experience has left the 15-pound dog blind but, as quoted by KTLA 5 News, Burns said, “I was thankful that I could pick him up the next day, bring him home and have him at least start this new chapter of his life, dark and blind. At least he’s got my family and me to love on him.” It was Burns’ quick action that saved her pet’sAccordinglife. to KTLA 5 News, “Burns is unsure when or where Chance came in contact with the controlled substance, but she hopes her story helps other dog owners know what the risks and signs of a doggy overdose and brings attention to the condition of some local parks.”Petowners would do well to be aware of and stay conscious of their pet’s behavior, which can give clues to accidental pet poisonings or other issues. According to the Web MD Pet Center, an estimated 232,000 cases of pet poisoning in the U.S. each year. In this case, oxycodone, the strong prescription medication, is suspected as the cause, but even regular household substances and medications, like Acetaminophen, Chocolate and Xylitol, can be dangerous to pets. Symptoms of poisoning in pets can include:
• Seizures or tremors.
Paramedics transported the victim in critical condition to Ronald Reagan UCLA Medical Center in Westwood where she was placed on life support. She passed away on August 2. According to the LAPD, the driver of the vehicle is a woman in her 50s. She remained on the scene and cooperated with officials in the investigation. The LAPD says there was no evidence of criminal or gross negligence.
• Diarrhea or blood in the stool (either bright red blood or dark black tarry stools)

Zebra Construction Takes on Balcony Laws
• Property owner or manager will be given a few different options on the inspection process. The first being to inspect only what is required, and the second to inspect all exterior elevated elements to further reduce owner’s liability.•Once hired, Zebra can install inspection
By susan Payne Every building with 3 or more units in the state of California with an exterior elevated element above six feet, requires an inspection per the new “Balcony Law”. The first inspection of these elements must be completed by a licensed architect, engineer or contractor by January 1, 2025. Passed in 2020, bills SB-721 and SB-326 commonly known as the “Balcony Laws” state that 15% of each type of elevated woodconstructed element must be inspected every six years to promote safety and prevent loss of Zebralife. Construction is equipped and ready to help property owners and managers with inspections. General contractor Michelle Durey and Kevin Fanta cofounded Zebra in 2019 on the foundation of trust and old school values. These structural experts have already started the inspection process with a few of their“Sixclients.young people died and seven others were injured after a balcony collapsed in 2015. Evidence from the CSLB report pointed to dry rot, leading the balcony to become structurally compromised and collapse,” Durey said. Balcony Laws require wood constructed elements that extend beyond exterior walls of the building to be inspected. This can include balconies, decks, stairways, walkways and entry structures. After the initial inspection, subsequent inspections must be completed every six years. The building owner must keep record of inspection for two inspection cycles, equal to 12 years. If any exterior elevated elements pose an immediate threat to the occupant(s) the owner must receive the report within 15 days of the inspection and the local enforcement authority will be notified by the inspector. Zebra Construction will return a plan for repairs and cost to repair the elements at this time. Work can begin without a permit if it is an immediate threat, but a permit will still be needed by the end of the project. If there is no immediate threat, the report must be returned to the property owner within 45 days of the inspection. From inspection to repair, Zebra Construction has created an easy step-by-step process, so property owners are abiding by the law:•Free consultation is completed by Zebra Construction to review how many exterior elevated elements need inspection.
