Sellers have a choice of two marketing options - “listed price” or “no price”! When the choice is “no price”, it is usually a sale by auction. An auction is not scary, it’s just a method of sale that allows the potential Buyer to access the property first, and establish the value second. This method of sale can benefit both Sellers and Buyers. An auction property can sell at any one of the three phases of an auction program:
1. PRE AUCTION - If the Seller receives an acceptable offer prior to auction they could accept the offer and cancel the auction. From a Buyer’s perspective, this cuts out the competition. However, the offer must be unconditional prior to auction day.
2. AUCTION DAY - If not sold prior, the property will be offered For Sale under the hammer. To participate in the auction you must be registered to bid and able to sign an unconditional contract. It cannot be subject to finance, building & pest or the sale of another property etc. As a Buyer, you can see your competition, if any.
3. POST AUCTION - If the property is passed in at auction, it can be sold with any set of conditions agreed between the parties. If you are unable to bid at auction it is wise to attend to auction and make your move post auction. After auction it’s back to private treaty - same as a “listed price”.
A significant number of Buyers are caught in the dilemma:
Do I sell first and then try to find a property to buy, or Do I find a property to buy and then have to sell.
If you have found yourself in the later position, make it a condition of your offer. If accepted, we prepare a contract subject to the sale of your existing property.

I’m ready to buy... what’s the process!
• It all starts with an offer from you, the Buyer.
The Seller responds to that offer by:
o Accepting your offer,
o Rejecting your offer, or
o Giving a counter offer.
Initial, negotiations are conducted verbally.
When agreement has been reached, a contract will be prepared to reflect the verbal agreement, ready for your signature.
The contract documents the sale, including the:
o Full name and contact details of the Buyer and Seller,
o Solicitor/Conveyancer details for the Buyer and Seller,
o Agent’s name and contact details,
o Agreed sales price and deposit,
o Settlement date (usually the number of days from the contract date), and
o Conditions, that may include -
* Finance approval (usually within 21 days from contract date)
* Building and Pest inspection (usually 7 days from contract date
* Other special condition (specific to your agreement, if required)
The Buyer signs the contract first, and when it has been signed by both parties the contract is dated - all timing starts from that date.
The signed contract is processed in our office and copies emailed to all parties:
o The Buyer’s Solicitor/Conveyancer,
o The Seller’s Solicitor/Conveyancer,
o The Buyer, and
o The Seller.
When you receive your copy of the contract as the Buyer, you will receive instructions on where to pay the deposit. The BSB and Account number will be supplied so you can do this by Internet Transfer.
The Solicitor/Conveyancer for the Buyer & Seller will complete the transaction.
As the agent, we will keep in contact with all parties to ensure a smooth transfer. The Buyer needs to arrange the following two things ASAP, if applicable:
o Building and Pest Inspection (see this book for a referral contractor) access can be arranged via RJR Property, the agent.
o Finance approval (see this book for a referral Mortgage Broker) the valuation inspection can be arrange via RJR Property, the agent.
Settlement - once we have been notified by both Solicitors/Conveyancers that settlement has been completed, we can release the property keys to you.

Following negotiations, where the Buyer and Seller verbally agree on the sale price and conditions, RJR Property prepare a sales contract to reflect that agreement. The contract, signed by both parties, is sent to the legal represtatives of the Buyer and Seller. They will complete the transaction of behalf of their clients.
As most Buyers don’t have regular contact with a Solicitor, they often need our assistance to find a suitable firm. Finding the right legal represtentative is not only about the price, it needs to ensure the smooth transfer of your most valuable asset. Your Solicitor/Conveyancer needs to be able to deal with Queensland property.

The sales contract usually allows 7 days for a building and pest inspection on behalf of the Buyer. The Buyer can choose any licenced firm to carry out that inspection. If you are able to personally attend the inspection, you can discuss any queries with the inspector on site. You will then receive the report as confrimation.
