T Editorial; Will “endo” ever end?

I

t was quite timely that on Labor Day this year, that our policy makers signified their seriousness in making a second look, or a review of the Labor Code not only to update its provisions but also towards the realization of stopping the endo or the contractualization of labor. .As early as last year, the President has already certified as urgent a proposed law against contractualization or “endo” (end of contract) arrangements. This is so “in order to strengthen workers’ security of tenure by prohibiting the prevalent p ractices of contractualization and labor-only contracting which continue to immerse our workers in endless poverty and underemployment.” You can see this mal practice done almost anywhere. This process of circumventing security of tenure of labor wherein after the fifth month instead of regularizing the employee after the sixth month, the contract with many workers end on the 5th month and all kinds of excuses are made by management including those of a slow economy, labor retrenching, losing business, you name it they have all the excuses. It is about time endo must end and with finality hopefully this year. But In addition, there had also been many pro-labor laws that have been en-

acted during the term of the present administration of PPRD/ Among others, are Republic Act 11165 also known as the Telecommuting Act, a bill that allows private sector employees to work from home, which has been signed into law by President Rodrigo Duterte on January 10, 2019. The new law seeks to uphold work-life balance among Filipino employees and to address the traffic congestion especially in Metro Manila, so that workers can legitimately work at home to save time and money. Also, last February 20, 2019, President Duterte signed into law an act that grants 105 days of paid maternity leave to all working mothers with an option to extend their leaves for another 30 days without pay. In addition, the law allows a total of 7 out of the 105 days of maternity leave to be transferred to the father, further extending a fathers’ paid paternity leave to 14 days. It is our hope that the labor sector starting this year will find the brighter light of day after the enactment of these three major labor laws, plus hopefully this year the end of contractualization or the controversial end of contract arrangements or “endo.”

Likewise, getting drunk during fiestas is allowed even by the most conservative of Bohalana missus, by Bingo Fiesta celebration (Bohol style) perP. day celebration.. For those well- to- do hosts, a new crispy lechon is served in every lunch and dinner for three consecutive days or a total of 6 lechons per house. Unbeatable! Two- it is only in Bohol that EVERDAY in May there is a fiesta celebration, be it a town or barrio fiesta. Aside from the city, during the month the towns of Alburquerque, Maribojoc, Sagbayan, San Isidro, San Miguel, Calape , Bilar, Tubigon, San Isidro, Candijay and Talibon celebrate theirs. Uniquely Bohol – fiestas here mean every home becomes an “open house” for everyone. No need for an invitation nor for a guest to to know the names of the owners of the house. One can just grab his plate and join the guests- no impoliteness is construed. What is also patented in a way for Boholanos is that 95% of the Boholanos who

At least new curtains, salas repainted and new ornamental plants abound. And it is perhaps only in Bohol where you see the “masters bedroom” vacated for guests to stay.. The host family wont mind staying in one room and have the other rooms occupied by visitors. And food, ah the food. In Bohol fiestas – it is normal for the hosts to pack food for the visitors to bring home (“bring house”) after partaking of a hearty meal. And, of course, every minute shared at the table becomes a memorable bonding time among family members and new- found friends, Bohol’s surname is Hospitality with a capital H. History shows that it was here that the stranger- Spaniard Admiral Legaspi was welcomed by Datu Sikatuna with a warm embrace and a blood compact as treaty of friendship and what is now called as “Sandugo.” This warm,welcoming attitude remains in the heart of every Boholano. A kind of hospitality that perhaps no other culture can beat. But ,too, there is the deep religiosity of the Boholanos reflected in every fiesta celebration as it is done to honor their patron saint. It is normal seeing all guests and hosts attend the Pontifical Mass on the feast daya way of thanking their patron saint for the blessings and the protection they bring for the whole year. So ingrained is the fiesta psyche in the minds of the Boholano folks. For instance, even in ordinary nipa houses in the middle of the rice field- a host family will buy a piglet a week after their fiesta for them to raise and get ready for next year’s fiesta celebration. or tropical climate countries like the Philippines, summers are both loved and dreaded at the same time. People love to go to the beautiful beaches to swim, snorkel or go diving with family and friends. But others dread the summer months because of the intense humidity they bring. Depending on where we are in the country, temperatures could soar to as high as 42 deg Celsius, which could be intensely uncomfortable. Sometimes, the scorching noon day sun and the humidity combine to give us headaches or make us dizzy. While the rainy season is still a couple of months away, we must find ways and means of keeping our cool during the hot, summer months. The following is a practical how-to piece on surviving summer in the Philippines: first, choose summer clothing well. Wear Cotton fabrics – tee shirts, shorts, pants and even Cotton sheets/linens for sleeping. Now’s the time to ditch the Satin or Polyester Chiffon fabrics in favour of Cotton. veryone knows it is a mortal sin to commit suicide. Suicide is destroying God’s gift of life not to mention the ultimate selfish act and hurts others more than it hurts you. If shooting yourself in the head and you die immediately is called suicide, what is shooting yourself in the head everyday for ten years and then you die called? Is that not also suicide? The only difference seems to be the time it takes to die. If you accept that in both cases it is wrong; why is doing something over and over you know will eventually kill you, not also slow suicide and a mortal sin? Three of the top four causes of death in the Philippines, (hypertension, stroke, heart disease) could be stopped with a simple diet change. A major contributing factor to hypertension, stroke and heart disease is SALT. Everyday many Filipinos are committing the mortal sin of “slow” suicide by ingesting far more salt than is healthy.. Take a walk in your local supermarket. There is row after row of processed foods high in salt. The Harvard School of Health and Baylor University conducted a study of “precooked dried noodles”(

Otherwise, our passions would be akin to the passions of any animal that is by nature irrational, following a logic that is completely shaped by instincts alone and nothing beyond. Like anything else in human life, our passions also need to be educated, grounded and oriented to what is truly proper to us. They should not just be a product of our genes and hormones and the other chemicals and elements that

Jesus breathed on His disciples after the resurrection and they received the Holy Spirit. Every breath that you and I take is a gift that comes from the Father of Lights. He has made us and He has promised to sustain us. Every good and perfect gift that we have comes from our Heavenly Dad. The One who created us is the One who will continue to provide all that we need, both physically and spiritually. recite prayers, read, or repeat memorized words without thinking what we are doing? How often is our mind somewhere else than with Him to whom we address these words? How often do we think that the more words we use, the more the Lord must hear and answer us? How often has prayer become a routine — the killer of an intimate relationship with our loving God? Prayer is supposed to be a conversation, a dialogue with God. In a dialogue, we must give the partner time and room to respond. For food choices, we might load up on vegetable salads, water-based fruits like Pears, Watermelons, Wat er Chesnut (Singkamas). Much as we’re tempted to indulge in our favourite summer treat, Halo-Halo or Sago and Gulaman, Mais con Yelo, we might want to minimize this to reduce our sugar intake. Iced Lemon Water or Pineapple Cucumber Shake/Smoothies might be the better option. We might want to bathe at least twice a day to cool down. A cold or warm shower at bedtime, a sprinkling of baby powder on our necks and back and relaxing music would make for a restful slumber during hot, summer nights. Before bedtime, ensure that we unplug all gadgets such as cellphones, computers, laptops and all switches as these emit heat that we don’t want. These are just a few tips to survive the summer . Plaintiff during his marriage with his wife Dulcesima Ramirez acquired and took possession of a parcel of land covered by and an embraced in Transfer Certificate of Title No. FT-5497, containing an area of two hundred ninety four (294) square meters, more or less, situated at Poblacion, Guihulngan, Negros Oriental, copy of certificate of title is hereto marked as Annex “A”; 6. For about 18 years now; plaintiff is separated-in-fact with his wife who has been living in Japan; 7. Plaintiff has been in actual, continuous possession of the said parcel of land; 8. On February 5, 2018, plaintiff filed before this Honorable Court a petition for Judicial Authority to sell one-half portion of the aforesaid property representing his conjugal share, pursuant to Section 239 and applicable provisions of Title XI of the Family Code, docketed as FCSpec. Martinez with full knowledge of plaintiff’s action in seeking judicial authority to sell, surreptitiously employed fraud and malicious machinations and obtained a Bogus deed of sale in their favor and within an extraordinary short time they were able to swiftly secure a certificate of title into their name, copy of Bogus deed of sale and allegedly obtained TCT No. 103-2018000525 are hereto marked as Annex C and; 10.Plaintiff noticed that TCT 103-2018000525 is unsigned by the concerned Acting Registry of Deeds for the Province of Negros Oriental; 11.Verification with the Bureau of Internal Revenue and the Registry of Deeds for the Province of Negros Oriental showed that there was no copy of the “acknowledgement receipt” for the consideration of the land which is a requirement in obtaining a Certificate Authorizing Registration (CAR) with the Bureau of Internal Revenue (BIR) to insure that the consideration of the land is paid and to assess the proper tax; 12.After they illegally obtained Transfer Certificate of Title, they sold the said land to defendant JGM Corporation whose agent has full knowledge that it was plaintiff who has been the actual possessor. The price of the sale is P300,000.00 which is unconscionably low, as the market value of the property is at P15,000.00 per square meter the land is worth or more than FOUR MILLION, a copy of deed of absolute sale is hereto marked as Annex “E”; 13.The deed of sale allegedly executed by Bernardo S. Martinez in favour of defendants Bernardo Martinez, Jr. and Toniko Martinez involving the subject conjugal land is illegal and void ab initio because it is a falsity. He did not sell it; 14.In fine, the Transfer Certificate of Title No. 103-2018000525 in the name of defendant Bernardo Martinez, Jr. and Toniko Martinez covering the subject land must perforce illegal and spurious. A certificate of title does not create or vest title neither a means of acquiring titles to lands but only confirms and record title already existing and vested; 15.Consequently, defendant Bernardo Martinez, Jr. and Toniko Martinez transmitted and conveyed NO rights whatsoever to defendant JGM Finance Corporation the alleged vendee of the sale involving the questioned property; WHEREFORE, it is respectfully prayed of this Honorable Court that judgment be rendered in favor of the plaintiff and order that: 1. The deed of absolute sale in favour of defendants Bernardo Martinez, Jr. and Toniko Martinez be declared null and void; 2. hundred parishioners from five parishes un der the Diocese of Dumaguete in the

northern part of Negros Oriental participated in a disaster preparedness training of Smart Communications. Public Affairs Junior Manager NN Navarro of SMART Communications, Inc. said this is the third training for the clergy and different parishes to capacitate and equip them with knowledge response during calamities or natural disasters. “This time, it is focused in the northern part of the province because the area is deemed to be prone to earthquake as it experienced the 6.9 magnitude in 2012, and this training is requested by Bishop Julito Cortes,” said Navarro.

oth the Philippine Army (PA) and Philippine National Police (PNP) urged local officials and even political candidates to reject and report extortion attempts by New People’s Army (NPA) rebels and against supporting the communist movement. The presence of NPA terrorist groups threatens the security in the province which the soldiers and the police are now preparing for possible violence by communist rebels as elections near. With this, the Communist Party of the Philippines – New People’s Army (CPP-NPA) was declared “persona non grata” by Negros Oriental officials.

The Department of Trade and Industry (DTI)Negros Oriental recognized some local business establishments for upholding consumer rights while practicing responsible business by awarding them the DTI Bagwis Awards. The DTI Bagwis Awards has three levels namely Bronze Seal, Silver Seal, and Gold Seal. The business establishments that received the Bronze Seal Award are Du Ek Sam - Brown Lines and Du Ek Sam White Lines. DTI awarded the Silver Seal Award to VCY Sales Corporation (Triumph Home Depot) and G and S Solid Corporation (Sentro Auto Parts and Services). In Dumaguete, texting the CHRONICLE desk, the Dept of Labor DOLE provincial head Maritess Mercado said, the amazing and shocking surprise of it all is that out of the 4,362 jobs offered, only ten (10) “as in pulo ra,” were hired and only 798 were qualified for the job and the rest simply had to return to their homes jobless as usual.. This is not fair both to the job fair organizers, the l, 424 unqualified applicants who desperately were seeking any job but could not be taken. Yet congratulations to the ten applicants who were hired on the spot. Can you spot if there is anything wrong here? Of course it is the monumental mismatch: thousands of jobs available, and yet only a handful will qualified, much more hired.

Yet many howl in complaint when foreign workers like Chinese nationals are imported for hiring. It is so ironical: hundreds and thousands of applicants Filipinos on Labor Day nationwide, ended up as not qualified for the job openings. Imagine, of the 200,000 jobs available and only few hundreds maybe will qualify? In Negros Oriental only ten were hired on the spot and 198 qualified. This indicates an unmistakable mis-match between jobs available and the courses offered in schools. Many people believe that most of our colleges and universities both public and private are not offering the proper courses which are commensurate to the future jobs available. A constant synchronization process between DOLE AND DepEd must be made in order to make available jobs commensurate to the applicants. In Singapore, we had

It is only then that they decide what course to take because by then, they are already almost sure of employment when they graduate. This is how labor and education should work together in the Philippines. . Education, should offer the right courses and trainings, so that labor will be able to hire t he graduates...Upon the future. What we have now is an oversupply of teachers, maybe nurses, management, liberal arts, English majors, math majors, and others which have no job openings in the near future. That is why job fairs which were offering 200,000 jobs to jobless Filipinos last Labor day May 1 were not mostly hired. Thousands of jobs will remain open, and thousands of applicants

will remain jobless. Labor and Education departments are seemingly not doing anything effective about the proper matching of courses offered and jobs available. When we talk about matching, job openings and their statistics must be provided to the public and the applicants so that only those qualified may apply for the jobs. Trouble is only a small ratio usually qualify for the job openings offered Why? Because there is no effective synchronization between the Dept of Labor and Dept of Education, and even Public Employment Offices (PESO) in informing the public in general , what are the kind of jobs available. Then Government should make a list of all jobs available, disseminate it to all possible outlets.
