H

ouse Speaker and former President Gloria Macapagal Arroyo said that because of the fiscal stability during her term as president, infrastructure and other economic policies helped bring down the poverty rate during those years, from 39 percent when she started the presidency to 26 percent when she ended the term. This translates to seven million Filipinos graduating from poverty. Seven million poverty-stricken Filipinos graduated from the poverty line during Arroyo’s watch. This is no small measure leaving the poverty index at 26percent out of 39% when Arroyo started holding the office of President. Now, outgoing Speaker Gloria Macapagal Arroyo is spending her last two weeks in Congress visiting projects that she established during her incumbency as president of the Philippines.

I

t was such a bad timing. Just when classes reopened a few days ago, no less than 14 of 17 high school classrooms burned down completely last Thursday dawn, the study room for over 500 senior students at the City High School in Calindagan. The City High School is the home of 2500 students from Dumaguete. What was completely leveled by fire which was initially traced as having been caused by faulty electrical wirings” (as usual?) were 17 Marcos-type 1960s ventage onestorey classrooms which was also due for demolition due to old age. The site will be used as part of the athletic sports oval in the sprawling city high school campus in Calindagan. Although arson is a far-fetched possibility, we ask the question: why did a “spark” precisely start at dawn when it was cool devoid of the summer heat, except the fact that there was a sudden downpour at that time on that dawn . It is possible that very old loose and open electrical wirings sparked a short circuit that might have started the blaze in a totally empty building. Timely too or not, the building was already due for demolition because the site will be part of the athletic sports oval which will be expanded shortly. On its opposite side will be the proposed three-storey affair for a new senior high

classrooms to replace the very old structures. But hey, only now did we know from City High authorities headed by Principal Aldin Rabina and Dr Jude Mapui, curriculum division coordinator, that a few weeks ago, all the automatic votecounting machines for Dumaguete cluster of precincts were housed there inside that building! What a disaster could it have been if the fire occurred when the vote counting machines were stocked inside? What is also fact is there was no recent inspection by fire authorities on the safety status of the building when the machines were inside. So can we say that it was a blessing that the fire occurred a few weeks after elections when nobody was inside? What if all the vote counting machines were inside! Lesson learned: all dilapidated structures must be thoroughly inspected regularly by the fire department be it public or private. The fire at the City High School where vote counting machines for Dumaguete were stored was already a high risk, and a fire hazard at that time. The blessing is, that the blaze erupted 36 days after the midterm elections sparing all those vote counting machines which were stocked inside!

It can mesmerize us and can bring us to places, moments and conditions that are way beyond what our imagination can provide. It can take us into flights to fantasy land or to heaven itself. And to think that it is at bottom composed only of a few basic musical notes! It’s truly amazing that with just a few notes, we can create a practically infinite number of beautiful songs and music, bringing us to a borderless range of feelings and all kinds of considerations! Since I live in the west, I wouldn't even try to dare to compare the suffering in my country to the persecution that is happening in many other places around the world. Needless to say, God's grace will be sufficient in whatever level we need it to be for our circumstances. F

or some years now, the new me dia has taken center stage as the source of news among busy people who have little time to read the papers or watch the news on TV. New media or online media, as the new player on the block, has outpaced and upstaged traditional media as we know it. People who are mostly online rely on news feeds that come to them via their social media apps. Technology has come to influence not just our reading habits and preferences but our way of life. It is not uncommon for example, for two people sitting in a room to text or email each other rather than talk to each other. In another scene, it is common to see family members in a room lost in their own world. Rather than communicate with each other, they would rather chat with friends on their favourite gadgets. Face to face communication has given way to social media communication. In classroom settings, students usually use their cell phones to take pictures of the slide presentations or ask to copy the notes from a teacher’s presentation through a USB or request to have it sent to them through email. Of course, we know that due to the fact that we are not by nature simply material and biological but also and more importantly, spiritual, we have the power to transcend the limitations of the material things we use. We have the capacity for creativity, productivity and fruitfulness. We can bring these material things to another dimension. It’s good that we give due attention to this fact of life and be left deeply grateful for this reality. Let us be thankful to God, since it is actually he who shares his creativity with us, since we are his image and likeness. Let us be aware of the many possibilities that it provides and that we can take advantage of. In fact, we are supposed to be responsible of taking advantage of these

possibilities. And let’s be reminded also that given the way we are, or given the way God has made us, we are empowered to actually make use of small things to accomplish great things, even things that are actually beyond our human capacity to attain. Together with God’s grace, even the small things we do, give or contribute in any endeavor can acquire an eternal and supernatural value. Remember those gospel episodes of the miraculous catch of fish (cfr. Lk 5,1-11) and the multiplication of the loaves. (cfr. Jn 6,1-14) The common lesson that we can learn from there is that as long as we do or give the little that we can at the instance of God’s will, great things can happen and what we gain is a lot more than what we give and what we can imagine. Our creativity, productivity and fruitfulness are truly a participation in the creative power of God. This is a truth of faith that we should not for-

God desires and has the power to bring life even out of death, to make us rise from our tombs, and make us settle in our land. But God’s vision and promise ought to be our desire, too. He needs a little help from us, and it starts with our own desire for life, not death. It starts with our own efforts at doing what St. Paul counsels us — to leave behind life “in the flesh” and pursue one “in the Spirit.” We need to look closely at what life is all about. And Martha, for all her busybody attitude, might have understood it a little better than we do. She knew, that, first, “had He been there, her brother would not have died.” Second, she knew that “whatever He would ask of God, He would grant it.” She knew, too, that her brother “would rise, in the resurrection on the last day.” But what she did not know was the big surprise that God was, and is, a God of life, there and then — and even here and now. since during the Lenten Season this year, the Lord has kept urging me through my meditations, my readings, my thoughts, that it is now time for me to step out and write about my faith journey. Not in the “abstract” of around-me-happenings, but more on a personal basis. Thus, the change in title to “Footsteps in Faith”. I pray that you will continue to enjoy this journey along with me. My faith began to develop early in life. I grew up on a small dairy farm in the mountains of Vermont, USA. As the eldest child of three, I worked on the farm whenever I had time after school. My Dad taught me the value of hard, honest work, of doing the best one can do, and to seek out creative ways to make one’s best even better. Most of all he taught me to love God in nature. I can remember seeking out the first flowers of spring for a fresh bouquet after a long, cold winter.

Of walking through the nearby woodlands to look for berries, blossoms and blessings. Dad taught me through his example to look for God’s blessings in everything, especially in nature because he believed with all his heart and soul that everything in nature was a gift from God. Mom instilled in me not only homemaking and familynourishing skills, but also the virtues of thoughtfulness for others, of nourishing a spirit of joyfulness, patience, optimism, caring, trust and respect for one’s spouse. She inculcated in us children to always have faith in God to supply what we needed. Every Sunday she would ready us for church. After the Sunday service and children’s sermon, we kids would go downstairs for the children’s activities. I can remember having to memorize Bible passages; we could put a star on our chart if we could recite the verses assigned to us. When I began

We have needs and as we pray, then we can claim Philippian 4:19 “But my God shall supply all your need according to his riches in glory by Christ Jesus” We as Born Again believers, are conscious of doing things in the Spirit. KEVIN GOODWIN and ROLEN DELOSO, Defendants. X----------------—--- -—/ COM PLAINT Plaintiff, by counsel unto this Honorable Court most respectfully avers that: I. THE PARTIES 1. Plaintiff PHILSOUTH BUILDERS [“PHILSOUTH,” for purposes of brevity] is a sole proprietorship engaged in the construction and real estate development holding PCAB License No. 21962, with principal office at 2428 South National Road, Calindagan, Dumaguete City, Negros Oriental. For purposes of this case, PHILSOUTH is duly represented by its proprietor/general manager, LUISITO M. TIJING, and may be served with writs, notices and processes of this Honorable Court at the address of its counsel indicated below. 2. Defendant KEVIN GOODWIN is an American Citizen, of legal age, whose last known address is Lot 81, Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental, where he may be served with summons, writs and notices of this Honorable Court. 3. Defendant ROLEN DELOSO is a Filipino citizen, of legal age, whose last known address is Lot 81, Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental. II. JURISDICTION OF THE REGIONAL TRIAL COURT 4. Section 18 (8) of B.P. Blg. 129 as amended by R.A. No. 7691 provides that Regional Trial Courts shall exercise exclusive original jurisdiction: “(8) In all other cases in which the demand, exclusive of interest, damages of whatever kind, attorney’s fees, litigation expenses, and costs or the value of the property in controversy exceeds three hundred thousand pesos (P300,000.00) outside Metro Manila…” 5. Plaintiff contends that this instant case is under the jurisdiction of the Regional Trial Court, considering the fact that the same is for collection of a sum of money wherein the value of the demand is in the amount of Two Million Seven Hundred Ninety Six Thousand and Four Hundred Eighty Three (Php 2,796,483.00) Pesos. The aforementioned amount will be quantified hereinafter. 6. Section 408 (e) of the Local Government Code further strengthened by Administrative Circular No. 14-932 [2] mandates that all disputes are subject to Barangay conciliation pursuant to the Revised Katarungang Pambarangay Law before filing a complaint except for: “(e) disputes involving parties who actually reside in barangays of different cities or municipalities, except where such barangay units adjoin each other and the parties thereto agree to submit their differences to amicable settlement by an appropriate Lupon…” 7. Considering the fact that the plaintiff is a sole proprietorship and its place of businesses is in the City of Dumaguete and that Mr. Goldwin is a resident of Palinpinon, Valencia, Negros Oriental, it is concluded that the barangays where both parties are situated are of different geographical location and are likewise not adjoining each other. Hence, barangay conciliation proceedings are not required as a condition precedent for the filing of this instant case. III. ALLEGATIONS COMMON TO ALL CAUSES OF ACTION 8. Defendants Kevin Goodwin and Rolen Deloso are of public knowledge common-law husband and wife; 9. Defendant Deloso owns a parcel of land known as Lot 81 situated in Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental; 10. On December 5, 2014, THE PARTIES (Plaintiff and Defendant Kevin Goodwin) entered into a contract whereby the plaintiff was engaged by the defendant Goodwin to design and construct a one (1) unit two (2) storey residential building located at Lot 81, for the sum of Nine Million Three Hundred Twenty One Thousand Six Hundred Ten (Php 9,321,610.00). This fact is evidenced by the aforementioned contract, a copy of which is hereto attached as ANNEX “A” TO “A-4”, 11. Article IV of the same contract provides for the terms of payment which the defendant Goodwin is obliged to comply with, to wit: ARTICLE IV TERMS OF PAYMENT 4.1 Down payment: The FIRST PARTY shall pay to the SECOND PARTY the advance payment of 50% equivalent to FOUR MILLION SIX HUNDRED SIXTY THOUSAND EIGHT HUNDRED FIVE & 00/100 PESOS (Php 4,660,805.00) upon signing of this contract; 4.2 Progress payment: Payment for progress billings shall be done in the following manner: 2nd Payment – pay 20% of the contract amount upon reaching 50% of the physical work accomplishment 3rd Payment – pay 20% of the contract amount upon reaching 70% of the physical work accomplishment Final Payment- pay 10% of the contract amount upon completion, turn-over and acceptance of the project. 12. Additionally, Article V of the same contract provides for the terms as to the Commencement and Completion of the construction works, to wit: ARTICLE V COMMENCEMENT AND COMPLETION OF WORK 5.1 It is agreed that the construction of the PROJECT shall commenced within ten days from the date of the release of the Downpayment covered under Article 4.1 and should be completed within a period of THREE HUNDRED THIRTY (330) calendar days; 13. To add, paragraph 6.2 Article VI3 of the contract states that the management of the project in total shall be the responsibility of the plaintiff; 14. Worthy of note is paragraph 7.1 Article VII of the contract which defines the contractor’s obligations and liabilities, as follows: ARTICLE VII OWNER’S OBLIGATION & LIABILITIES 7.1 The SECOND PARTY works on the property, without interference from any party except authorized government agencies; 15. Prior to the execution of the contract, 4 on September 22, 2014, plaintiff provided the defendant Goodwin a detailed document which laid out proposed material specifications and schedule of finishes for the construction works which was thereafter accepted by the defendant. Among other matters, paragraph F in item number 17.0 of the same document contains a proviso which states: F. Major work revision and items not stipulated in this proposal entails additional cost and time, depending on the complexity of the detail. As proof thereof, the document is hereto attached as ANNEX “B” TO “B-5.” 16. After the perfection of the contract and defendant Goodwin’s downpayment of the amount provided by paragraph 4.1 of Article IV under the contract and the acquisition of the necessary permits from the proper government authorities, the construction works began on Lot 81. As proof that the permits were accordingly acquired, attached hereto as ANNEX “C” to “C-3” are copies of several permits issued by the government such as: Building Permit, Certificate of Zoning Clearance, Plumbing Permit, and Electrical Permit; 17. Correspondingly, a Certificate of Occupancy was issued by the Office of the Building Official after the completion of the construction, submission of an application for certificate of occupancy, and the issuance of a certification of final electrical inspection. As proof thereof, copies of the aforementioned documents are hereto attached as ANNEX “D” to “D-3”, 18. To the plaintiff’s surprise on September 9, 2016, defendant Goodwin sent a letter to the plaintiff through Mr. Luisito Tijing, falsely alleging that there were irregularities in the construction of the residential building. In addition, he stated that there were several violations of applicable Philippine statutes and that there was an agreement to use Class “A” materials in accordance with western standards. A copy of the letter is hereto attached as ANNEX “E”; 19. In response, the plaintiff sent a reply on September 12, 2016 and rebutted the allegations made by defendant Goodwin, stating that the methods applied to the project is based on generally accepted Philippine engineering standards in contrary to western standards. The letter added that the delay was attributable to the defendant himself, since he applied changes in the interiors and architectural finishes which in effect deviated from the original plan. As proof thereof, a copy of the aforementioned letter is hereto attached as ANNE “F” to “F-1”; 20. Despite the fact of delay from the defendant Goodwin’s interference with the construction works, the construction was already 70% completed as of January 2017. Pursuant to the contract, the plaintiff send defendant Goodwin a letter on January 9, 2017, requesting for the release of 90% partial billing as initially agreed upon. However, to no avail. A copy of the same letter dated January 9, 2017 is hereto attached as ANNEX “G”; 21. As of July 26, 2017, the full payment for the construction works had already become long overdue. This fact constrained the plaintiff to send another letter requesting for full payment, a copy of which is hereto attached as ANNEX “H”; 22. On August 10, 2017, defendant Goodwin sent plaintiff a letter asking what amount the plaintiff is claiming as per contract and the breakdown of the accounts payable. A copy of the letter is hereto attached as ANNEX “I”; 23. Plaintiff PHILSOUTH thereafter replied to defendant Goodwin’s letter on August 16, 2017 and laid out a breakdown of the long overdue account he has with the plaintiff through a Statement of Account. As proof thereof, attached hereto as ANNEX “J” to “J-1” copies of the letter dated August 16, 2017 and the Statement of Account; 24. The Statement of Account5 shows that as of August 15, 2017, the defendant Goodwin had an outstanding balance of PHP 2,796,483.00 payable to the plaintiff; 25. In a letter dated August 24, 2017, defendant Goodwin once again alleged that the plaintiff breached Article V, Section 5.1 of the contract by not completing the construction within the stipulated 330 days. Plaintiff replied in a letter through counsel on October 11, 2017 and once again clarified to the former that the delay was due to his interferences in revising the original plan of the construction. The aforementioned letters are hereto attached as ANNEX “K” to “K-1” and ANNEX “L” to “L-2” respectively; 26. Defendant Goodwin sent another series of letters hereto attached as ANNEX “M” to “M-1” and ANNEX “N” to “N-2” pushing forward his erroneous contention that the contract was breached with proposal for settlement in exaggerated figures; 27. To finally set things straight, the plaintiff sent a letter on January 27, 2018 to the defendant Goodwin laying out the terms pursuant to the contract dated December 5, 2014 and stood firm on the stand that on its part there were no breaches committed in constructing the residential building. It was he who cause maneuvers and scheming which resulted to the deviation from the contact. A copy of the letter is hereto attached as ANNEX “O”; 28. It has only been recently discovered by that the defendants moved out from the residential building situated in the Lot 81 premises, leaving no personal belongings behind. They never returned since then, Plaintiff exerted efforts in locating the defendants. However, to no avail. This fact leads to the conclusion that both defendants intent to leave the Philippines in fraud of the plaintiff; IV. CAUSES OF ACTION 29. The foregoing statements are hereby repleaded by reference: 30. Article 1159 of the New Civil Code finds significant application over this case. It states: “Obligations arising from contracts have the force of law between the parties and should be complied with in good faith…” 31. Paragraph 4.2 of Article IV6 as stipulated in the contract clearly and unequivocally states the mandatory nature by which the defendant is obligated to pay the plaintiff in given periods of development [of construction] certain percentages of the contract amount until such time full payment is made; 32. The exchange of letters essentially show that the defendant Goodwin refused to pay the amount he was obliged to pay, for the reason that there was an alleged breach of a condition stated in Article 5.1 of the Contract in that the construction should be completed within a period of 330 calendar days. As consistently stated in the replies made by the plaintiff, the delay was attributable to defendant Goodwin’s interference with the construction works. The act of defendant in interfering with the construction is a breach of paragraph 7.1 Article VII of the

same contract; 33. In lieu of the foregoing, it is contented that the plaintiff has a legal and valid right to the payment by the defendant Goodwin of the amount of PHP 2,796,483.00, said amount being an obligation voluntarily entered by Defendant in the aforementioned contract; 34. Defendant Deloso is impleaded as a party defendant in this case because of her capacity as the landowner and the common law wife of defendant Goodwin. She has also been a signatory to the permits issued in favor of defendant Goodwin; 35. Therefore, it is important to state that the defendant Goodwin has no valid and justifiable reason not to pay the foregoing amount, which refusal constitutes a violation of the terms and covenants of the subject contract marked and attached as ANNEX “A” to “A-4”, V. SECOND CAUSE OF ACTION 36. The foregoing allegations are hereby repleaded by reference. 37. Paragraph 9.2 Article IX of the contract has provided for terms pertaining to liquidated damages which the defendant may be held liable to pay should he fail to fulfill any condition of the contract. It states: “ARTICLE IX. LIQUIDATED DAMAGES 9.2 In the same manner, should the FIRST PARTY fail to fulfill any condition of the contract which is incumbent upon him, he shall be liable to pay 1/10 of 1% of total amount due for each day of delay as liquidated damages…” 38. Applying the foregoing provision to the fact that the defendant Goodwin failed to comply with Article 5.1 of the contract, plaintiff contends that he should be liable for liquidated damages; VI THIRD CAUSE OF ACTION 39. The foregoing allegations are hereby repleaded by reference. 40. To protect Plaintiff’s interest, the latter was constrained to engage the services of counsel and paid attorney’s fees in the amount of Fifty Thousand Pesos [Php 50,000.00,] including expenses of litigation and other costs of suit. As proof hereof, a copy of the acknowledgement receipt relating to attorney’s fees is hereto attached as Annex “P”. The Defendants, therefore, must be made to reimburse said expense and costs. VII FOURTH CAUSE OF ACTION 41. The foregoing allegations are hereby repleaded by reference. 42. They lived in respondent’s place after marriage but later they moved to petitioner’s place in Guihulngan City; 9. Respondent had sworn signs of immaturity and self-centeredness. They would always fight due to financial reasons. She is materialistic and rebellious. She would also argue with petitioner’s mother and she would not care for the child; 10. Unknown to the petitioner, she engaged in illicit affair with her former boyfriend; 11. In August 2006, respondent went to Manila for an alleged worked arranged by her sister. In reality, she cohabited with her former boyfriend who was working in Manila. She did not return home; 12. In 2008, petitioner’s parent’s in-law requested the presence of the child in Toboso. It appeared that respondent returned home in Toboso and wanted custody of the child. However, after one week, petitioner’s parent’s inlaw called the petitioner for him to get the child because respondent went back to her paramour in Manila; 13. It is clear that, at the time and prior to the celebration of their marriage, respondent was psychologically incapacitated to enter into and comply with the essential obligations of marriage although it is manifested after the solemnization of the marriage; 14.
