ome 50 representatives from a cross section of the private sector reacted with a collaborative stand to the latest study of the Asian Institute of Management (AIM) which was summarized, saying that “Dumaguete City, as a capital city, needs to unite the people and government towards a definite direction if this city has to keep pace with present progressive trends.

The study which covered seven areas noted strong and weak points of Dumaguete hoping that the findings will be used as a tool for investors, in the areas of : real estate, call centers, franchising, banking and even for religious leaders in identifying where to estsablish themselves. Scrap, retake nurses board T

he bad news is, —that the entire results of the June 2006 nurses board examination will likely be scrapped and a re-take without additional fees is imminent among the 24,000 examinees of whom only 17,000 passed.

The good news is,— for Dumaguete, only 12 examinees took that exam. It would have been disastrous if over 500 or more from Dumaguete local nursing schools will have to re-take that board exam which was marred with cheating in subjects 3 and 5, that’s medicalsurgical nursing and psychiatric nursing subjects.

Among the Dumagueteños who took the board exam, one failed out of the three examinees from the prestigious Silliman school of nursing; while two failed out of the nine who took the same exam from St. Paul University Dumaguete. City’s peak headcount could hit 400,000 – JD

he city’s daytime peak population head count could easily hit 400,000 out of its over 100,000 actual residents.

This was revealed by City Administrator Junny Dumalag who represented the City Mayor on Wednesday’s edition of “Dumaguete Tonight” public affairs program over DYEM ENERGY FM. Without the knowledge of many, the influx of people to Dumaguete City has been noted even by future and present investors who have counted those who take lunch on a busy day. That is

why there is an influx of fastfood from Manila which have restaurants opened briskly in Dumaguete City, he said. People come to Dumaguete from all sides of Siquijor, Dipolog and the rest of Mindanao, southern Cebu from as far as Argao and Badian, plus those from the north, south, and interior towns of Negros island. here is an urgent need for Congress to pass legislation that would deter the filing of baseless and frivolous law suits against journalists. s one of the country’s leading higher education institutions turns 105 years old on August 28, Silliman University renews its commitment to build a university on competence, character and faith. This year’s Founders Day theme, “Sustaining our Christian Life and Mission”, gives emphasis on the University’s goal of achieving a unity of faith and purpose in the training and preparation of its students. Silliman President Ben S. Malayang III said the University’s 105th Founders Day celebration means that Silliman has not lost its “momentum”. “It is a continuing energy to push the university forward. This shows in many ways that Silliman is not resting on its past glories and laurels. How Silliman is valued by alumni and friends can be seen in the fact that every August is a cause for joy for many Sillimanians,” he said. The highlights of the Founders Day Celebration in-

clude the investiture of Malayang as the 12th Silliman President in the afternoon of August 28. This event will be attended by members of the Silliman community, and representatives from government, educational institutions from the country and abroad, United Board for Christian Higher Education in Asia and other national and international organizations that Silliman and the President have formal ties with. Native trees fit for Nautical Highway

ive years from now, expect layers of indigenous or native trees to line our national highways and other major thoroughfares in the country The Department of Environment and Natural Resources (DENR) will lead a simultaneous massive nationwide tree planting on August 25 which will take place along the country’s three major highways from Laoag City to Zamboanga City, covering a total length of 3,439 kilometers. Environment and Natural Resources Secretary Angelo T. Reyes during his visit to Dumaguete City on August 15 said the “Green

Philippines Highways” projects aim to promote the image of every Filipino as a planter of trees. “We badly need trees to pull down the pollution and to beautify our thoroughfares. Lately, on the national scene, editors and high ranking executives of national dailies have been charged with violating the laws against inciting to sedition. At the homefront, the Negros Chronicle has not been spared from harassments by high ranking local government officials who do not like what we publish. A series of libel suits have been slapped against the Negros Chronicle. Fortunately, all these harassment suits never saw the light of day and have been dismissed at the city prosecutors’ level and the Department of Justice. The unabated slapping of harassment suits, with the in tention of pressuring newsmen, or even to silence them should be stopped. This continued harassment sends a dangerous signal against press freedom in the country, and sends a chilling effect upon every journalist. A journalist is hampered professionally and economically in the performance of his duties as the purveyor of truth if he has to face frivolous lawsuits. In the United States, there are state laws that protect journalists against the filing of baseless civil or criminal charges hurled at them. Such baseless charges have been commonly labeled as Strategic Lawsuits Against Public Participation (SLAPP). In California for instance, the legislature has passed a statute against SLAPP where a newsman, or an individual engaged in the exercise of free speech who is sued, can seek a preliminary court determination whether the suit is meant only to harass him.

Dumaguete City’s Competitiveness The community, especially City Hall, is appreciative of the efforts of two major private institutions, namely, Silliman University and the Asian Institute of Management (AIM) in presenting updated results of an intensive study on how Dumaguete City has fared among 65 other cities in the country in terms of its competitiveness in providing an environment that nurtures dynamism of its local enterprises and at the same time giving prosperity to its residents.

The results were both shocking and encouraging. We say all sectors, both private and public, should look at the results of the study in a positive light and make it a vehicle for self improvement. In that study, Dumaguete was pitted against nine other similarly small cities and it was found out that the cost of doing business in Dumaguete is quite expensive as most businessmen rent a space for their enterprises. The biggest setback is the high cost of power in running a business. As to the dynamism in the local economy, it was noted that Dumaguete has a vibrant and promising tourism industry; people have easy access to various financing, the average household income is manageable and the growth of registered business has gone up especially the advent of so many fastfood centers. The City Administrator said that by night, Dumaguete has a population of 100,000 or more but during day time, especially at lunch time, the population of a growing city like Dumaguete could easily soar to as high as 400,000 which means that two big malls can viably open and operate in the city within next year. Reason is that many people from neighboring towns, north and south, including Cebu’s hourly ferry and that of Siquijor’s almost hourly trips do business, buy goods here and most of all the thousands of students who come for high school and college in Dumaguete. Our greatest asset, the study showed is human resources. Dumaguete City could yet be the small city which has big quality educational centers making it a haven of IT centers. The curricula is relatively relevant thus we have a good number of people who are eager to learn more skills through trainings. Yet we need more vocational institutions.

MAYOR PERDICES EXPLAINS Dumaguete’s direction before the academe and businessmen.

But apparently, politics, which is dominated by clan-elected public officials, lack enough collaboration between the public and private sectors in terms of harnessing the products of our educational institutions. Most government-hires are politically linked with government officials. That is why many of our talented people get out of Dumaguete to seek greener pastures. We are top netsavers, the study said, making Dumaguete a haven of no less than 30 commercial banks. That bank branches open only if they can generate P90-M in deposits is proof enough that people here are netsavers and other provinces and cities borrow and use our money, the AIM study said. AIM people said our traffic management is a mess, we rank 26th, and our narrow downtown roads are congested, we need to open new commercial centers. We have enough Internet service providers but our phone line connections to ISP need a lot of improvement. Our abundant electric supply is not reliable because power distributors blame each other for frequent brownouts which have been attributed to falling leaves of trees since time immemorial.

Who is Ninoy Aquino? resident Gloria M. Arroyo has declared tomorrow Monday, August 21 as a national public holiday and for a good reason.

The day marks the 23 death anniversary of Senator Benigno Aquino – a contemporary national hero who paid the supreme sacrifice of his life in order to bring freedom to a land devastated by 20 years of tyranny and oppression of Ferdinand Marcos. There are heroes and there are heroes. One can trivialize heroism and say hero is James Yap who scores the winning basket in a PBA championship; Popeye for rescuing Olive from brutish Brutus and Dustin Hoffman for saving VIPs in a flaming airplane in “The Accidental Hero.” There is, however, a kind of heroism that dwells beyond self, family, friends and vested interests. It is the kind that makes one give up one’s life for strangers or the nation at large.

We have enough policemen compared to other cities, but our police needs better equipment and more training. Our boulevard is very polluted and we rank 17th in the incidence of murder per 100,000 population. This figure does not include the unsolved and unreported murders. His wife Imelda and a set of salivating throne pretenders were lurking at the shadows – ready to grab the throne by hook or by crook - by crook in all likelihood. Ninoy had foretold his own death when he said in that fateful plane to Manila “I have a bulletproof vest here but if they hit me on the head, I’m a goner. You all have to be very watchful because

this could be over in a few seconds.” The rest as you know is history but without its final chapters since to this day the brains who ordered the cowardly soldiers to shoot Ninoy in the tarmac (who everyone knows) have not been convicted. Ken Kashiwahara, Ninoy’s brother-in-law had earlier offered the “Chain Solution” while aboard the plane where he and Ninoy were to be handcuffed together in order to avoid foul play. Somehow the Plan never got implemented.

hat happened to the second attempt to impeach President Arroyo is proof that impeachment in the Philippines is a legal process decided in political terms. The Committee on Justice in the House of Representatives, controlled by President’s majority party, dismissed the impeachment complaint outright for being supposedly insufficient in substance. In due course, the complaint will be submitted to the House in “plenary”, but likewise the voting will be along party lines, and we can expect that the same will die an instantaneous death. The impeachment provisions of the Constitution under the article on “accountability” are only good on paper. Ideally, the grounds for impeachment constitute criminal acts ie. bribery, treason, graft and corruption, etc. But instead of subjecting a sitting President to criminal prosecution, which cannot be done, the Constitution indicates impeachment as a remedy to remove him or her from office. Criminal prosecution against the President may be instituted only after his or her removal by impeachment.

It is clear then, as clear as the limpid waters of Boracay (before the oil spill), that impeachment is in the nature of a criminal proceeding whose sole purpose is to remove the President from office, not to inflict the penalties for criminal violations, like bribery, treason, and graft and corruption, which, as said, can be dealt with only after his or her removal from office by the impeachment process. I have been talking “legal”, not “reality”. The “reality” is that, as we said, impeachment is a political exercise of something which should be a legal process. When the House Committee on Justice dealt a death blow to the impeachment complaint, it was not thinking “legal”. When it said that the complaint was not sufficient in substance, it was motivated by political, not legal, considerations. It is axiomatic that a complaint or petition is an “initiatory pleading” setting

forth allegations supportive of the causes of action, which, in this case, are the constitutional grounds for impeachment. Presentation of evidence will be done at the Senate which is the constitutionality designated “trier” of fact and law. Both majority and opposition, to my mind, committed incipient errors. The error of the majority is in ruling that the “impeach complaint” was insufficient in substance on the basis of considerations outside the purview of the complaint. Contemporary events in the global arena and in our nation today will seemingly point out a pattern of violence, It appears that there is a blueprint of the obliteration and annihilation of the human race. There is every reason for us to pour out our hearts and be saddened by the incidence of deceptions, lies, corruption and violence that continue to permeate the modern society. However, we still have a glimmer of hope that there are a number of us who, like Habakkuk in the Bible account, feels yelling to

God in desperation because of the unbearable burden that circumstances had brought upon us. God is making himself known and He is demonstrating many important and lifechanging things, if we only listen. God said He will do amazing things. The contemporary events that are presently happening around us preface the “amazing things”. When things around us become almost unbearable, we wonder if God has abandoned us. But remember, listen and believe on this my brethren, God is certainly in control, He has a plan and he will judge the evildoers in his time. If we are truly humble, we will be willing to accept God’s answer and await His timing. We should not despair that God is seemingly not doing anything about the wickedness in our society. These are times when TRUE FAITH in God or what I may call PASSIONATE FAITH in God is tested. Shall we, the believers and the faithful, succumb to the pleasures and comforts of this perverted world and forfeit the restful and fulfilling blessings of our faith? Hang-on brethren and remain

In the lowest ebb of his despair, Aquino reportedly sought God in the Bible and found his peace As a government official, Aquino was a passionate scholar whose well-researched exposes and eloquent speeches moved his enemies to pee in their pants and for his fans to look for his autograph. Ninoy Aquino could have walked tall among fellow politicians of today’s breed. He could be remembered for what politicians today are not. For look around us the present-day politicians openly or silently partake of pay-offs, balatos and kick-backs, do shabby legislative work if they are not indulging in silent meditation inside session halls or murdering the English language, or worse working for personal and collegial interests rather than the national good. That’s when we really miss the man, Ninoy. That is the reason why business in Binondo stopped on the day of his burial in 1993 – the longest funeral march ever in Philippine history. Imelda Marcos immediately branded the funeral as a “big fart” while the Manila daily called Daily Express (daily suppress, it was) published two paragraphs on the event while its headline screamed: “Man Electrocuted while Watching Aquino Funeral.” These clearly showed you the state of Imelda’s olfactory nerves (and other nerves, besides) and the depths Martial Law journalism had fallen into. Meantime Ninoy’s death had galvanized support for the reluctant widow Cory Aquino as the moral choice to battle Marcos in the polls of 1986. All through the earthshaking events of the election down to EDSA people power, the long shadow of Ninoy cast its image on the nation. And to the spiritual-oriented march from Ninoy’s death to our freedom at EDSA was a script written from the Above much like the deliverance of the Isaraelites from their oppressors. That the democratic governments after Marcos are all hard-put in putting the Philippines house in order only serves to tell us how the physical and financial resources of the nation had been ransacked by the Marcos ghouls and how much the culture of corruption and greed has seeped into our bureaucratic consciousness. That the struggle for complete emancipation continues today does not, all however, debase the glory of our liberation in 1986. Let us remember the man Ninoy who helped us savor democracy once again – and let him remain in our hearts, the place he truly belongs.

Sitting there on his hospital bed, I overheard his friends talk about colon cancer. The sadness in my heart might have been mirrored in my face because as some visitors left, Old Peter told me “I have colon cancer, and it won’t be long before I will die. But I don’t want you all to cry; I have lived a good life. It is enough”. That very same day when he learned that he had terminal cancer, he insisted on going home saying that the hospital won’t make him better and planned to have a party on next Wednesday. He explicitly expressed his desire not to be placed inside a casket with no wake and was to be buried as soon as possible. In the Philippines where tradition plays a significant role in the lives of Filipinos, what Old Peter wanted was somewhat weird – extraordinary. But time constraints made that impossible and he was buried the day after. Old Peter got his wish. He was inside a very simple box with no paint and no glass. His picture on top of the box was to be the only thing to be seen of what was Old Peter. It was a pleasant sight knowing that his wishes were granted. For in his lifetime he asked for a little but had given so much. Even in death, Old Peter was teaching me lessons in life and leaving behind a legacy. A legacy that defies the odds and breaks down walls – a legacy of love and simplicity.

Even if I’m old, the sound of my mother’s voice is as soothing as when I was a child. She used to send me off to bed with kisses and wake me up with them. Those were the times when I thought the world was perfect, and nothing can take me away from her, even death. She knew I am a night person. Before I was diagnosed with cancer, I used to paint after dinner until my vision turned blurry with sleep. But as I counted the stars, I was amazed by how many they are. There are 500 million galaxies in our universe alone, according to the astronomers. But as science continues to probe infinity, they found out that there are about ten billion to fifty billion galaxies in those vast expanse of space. We see just a tiny fraction of those billions of stars in our galaxy. God created this huge, seemingly boundless space, in the heavens. He is bigger and more powerful than all of these. So big, that he could take all our troubles in the palm of his hands, that He can erase all the pains of humanity combined. We are bound to doubt as we are enveloped with fear, by seemingly endless trials and problems that we experience and read everyday. Sometimes we ask, where is God in all these? Does God see this small helpless child who needs help? Does He see this young

woman who wants cure for her breast cancer? Is He present inside the dialysis room, where I found my friend, begging for cure? But He reminds us that “When you pass through the deep waters, I will be with you; and through the rivers, they will not overflow you. When you walk through the fire, you will not be scorched, nor will the flame burn you.” Isaiah 43:2. Take courage, my friend, for like you, I bear the same fear everyday. But through an email, a visit, a card sent through a snail mail, or a precious book called the Bible, He is always there, assuring us that He loves us, and we are more valuable than those beautiful stars in heaven.

The Publisher’s Association of the Philippines, of which the Negros Chronicle is an active member, will take the initiative of drafting a similar bill and propose it to Congress. The state should officially declare it to be in the public interest to encourage continued participation in matters of public significance, and that this participation should not be chilled through abuse of the judicial process. It is our obligation as journalists to band together and curb this disturbing increase in strategic lawsuits brought primarily to chill the valid exercise of the constitutional rights of freedom of speech and petition for the redress of grievances. journalism seminar on ethics, libel, and responsible reporting is open not only to practicing journalists but also to young writers including students, organizers said yesterday. The seminar – part of the three-day North Cotabato Media Summit scheduled in Kidapawan City, August 26 – is designed to equip practicing journalists and school campus writers skills and full understanding of ethical and responsible reporting in the wake of the unmitigated killings of journalists, particularly those in the countryside. Juan P. Dayang, president of the Publishers Association of the Philippines, Inc., (8929278) said the idea of designing a seminar on ethical and distinctive journalism came from Cotabato Gov. Manny Piñol, himself a former journalist. ecilio “Tete” Espina Flores was born on December 16, 1917, to Regino and Felicitas Flores of San Juan Street. He was the 6th of seven children. He died peacefully on August 12, 2006, of natural causes. Cecilio is survived by his wife of nearly 65 years (Rosario Legaspi Flores), seven children (Davey, Jesce, Don, Giles, Connie, Lilibeth, and Cecile), 16 grandchildren, and 3 step-grandchildren. Among his proudest accomplishments, Cecilio was a commanding officer in the United States Armed Forces in the Far East (USAFFE). He began his military career as a Second Lieutenant, rising through the ranks of First Lieutenant and Captain, ending World War II as a Major. Even after the war, his home remained open to other veterans seeking his advice and assistance with veterans’ affairs. he year is 1901, and Silliman Institute opened its gates to the community to fulfill a vision and mission of compassion and service through learning and social in volvement. In so doing, it addressed the needs of the individual for growth and opportunity and that of the society for progress and peace. A hundred and five years later, to this date, Silliman which is now a University still professes and performs that purpose with even a greater commitment and firmer resolve. While nurturing academic excellence in various fields of endeavor is still its priority, it has not lost sight of its vision and mission of learning and serving. In fact, its focus has become even clearer. The University’s outreach and extension programs have served wonderfully as a laboratory for the students and teachers. They have humanized the rather staid and vicarious learning atmosphere in the classroom. In the College of Law, the faculty, students and the administration have been tapped to conduct lectures and seminars on the latest development of law and jurisprudence. The College has a Legal Counseling Office that offers free legal services. Its Legal Environmental Advocacy Program (LEAP) has assisted local government units and even the national government in the enactment of ordinances and the formulation of policies and programs concerning the environment, particularly on coastal resources. The College plans to revive the Silliman Law Journal to serve as a forum for discussion and dissemination of contemporary legal problems and topics of public interest. The College of Law proposes to strengthen and

expand its existing programs to comprise three (3) core components, namely: (1) Legal Education, ServiceLearning and Training; (2) Advocacy; and (3) Research and Publication. These programs shall be unified and coordinated under an interdisciplinary center to be called the Senator Jovito R. Salonga Center for Law and Development. This will be a Center that would honor a man who is known for his compassion for the downtrodden and for his exceptional intellectual ability — A man who is his brother’s keeper. The Senator Jovito R. Salonga Center will engage in the study and application of law and jurisprudence from an interdisciplinary perspective towards policy development and transforming society to better the lives of our people. It is goal-driven instead of being confined by themes. Thus, the Center will deal with laws on the environment, human rights, public governance, women, children, juveniles, and other areas that will promote political, economic, and social development. The Senator Jovito R. Salonga Center will seek to help design and channel societal demands. It will both articulate diverse societal preferences and serve as an independent shaper of the policies that emerge. It will pioneer in what the Center calls Transformative Law – the study and application of law to transform society, forge policies through advocacy, legal education, research, training, and service-learning.

ll members and alumni of the Silliman University Law Alumni Association of the College of Law, Silliman Uni versity, will convene for the 18th SULAW General Assembly which will be held on Saturday, August 26, 2006 starting at 11:30 o’clock in the morning. The venue of the assembly is the Moot Court, Villareal Hall, College of Law, Silliman University, Dumaguete City. The Guest of Honor and Speaker is former Senator and former member of the Board of Trustees of Silliman University, the Honorable Jovito Salonga who will also launch the opening of the Salonga Center for Law and Development at the College of Law. Chief Justice Antonio Panganiban has also been invited to grace the occasion. A highlight of the assembly is the awarding of the 2006 Outstanding SULAW awards to two (2) distinguished alumni who

have made the College of Law proud. They are Honorable Alvin G. Dans, in the field of Public Service and Atty. Emilio C. Capulong, Jr., in the field of Human Rights Advocacy. All members and alumni are strongly urged to attend this annual gathering held in connection with the 105th Founders Day celebration of our beloved alma mater Silliman University.
