ome 12,000 athletes, coaches and officiating officials of this year’s Palarong Pambansa from the 17 regions throughout the country are now arriving here in Dumaguete City.

he Commission on Elections Tuesday announced its imposition on the strict provisions on media election exposures under Rep. Act 9006 otherwise known as the Fair Elections Act. Provincial Comelec Officer Atty. Juvenal Tuale met with station managers and political block timers in his Comelec office and gave them copies of his order implementing the media rules on elections.

He said that radio block times now fall under the prohibited election propaganda under Sec 7 (e) of the Fair Elections Act. He added that all candidates or parties are given only an aggre-

Dear Radio Station Managers: With start of the Campaign Period for the local candidates which officially took off on 29 March 2013, complaints against radio block timers are now considered bona fide. May we therefore remind you of the pertinent provisions of COMELEC RESOLUTION NO. 9615 promulgated on 15 January 2013 and implementing R.A. No. 9006 otherwise known as Fair Elections Act. The pertinent provisions of the said COMELEC resolution are as follows: • “The term “political advertisement” or “election propaganda” refers to any matter broadcasted, published, printed, displayed or exhibited, in any medium, which contain the name, image, logo, brand, insignia, color motif, initials, and other symbol or graphic representation that is capable of being associated with a candidate or party, and is intended to draw the attention of the public or a segment thereof to promote or oppose, directly or indirectly, the election of the said candidate or candidates to a public office. In broadcast media, political advertisements may take the form of spots, appearances on TV shows and radio programs, live or taped announcements, teasers, and other forms of advertising messages or announcements used by commercial advertisers.” (Section 1, Paragraph 4) • “SECTION 7. Prohibited Forms of Election Propaganda. – During the campaign period, it is unlawful: XXX d. For any newspaper or publication, radio, television or cable television station, or other mass media, or any person making use of the mass media to sell or to give free of charge print space or air time for campaign or election propaganda purposes to any candidate or party in excess of the size, duration or frequency authorized by law or these rules; e. For any radio, television, cable television station, announcer or broadcaster to allow the scheduling of any program, or permit any sponsor to manifestly favor or oppose any candidate or party by unduly or repeatedly referring to, or unnecessarily mentioning his name, or including therein said candidate or party; • The duration of air time that a candidate, or party may use for their broadcast advertisements or election propaganda shall be, as follows: o For Candidates /Registered Political parties for a National Election Position: Not more than an aggregate total of one hundred (120) minutes of television advertising, whether appearing on national, regional, or local, free or cable television, and one hundred eighty (180) minutes of radio advertising, whether airing on national, regional, or local radio, whether by purchase or donation. o For Candidates Registered Political parties for a Local Elective Position: Not more than an aggregate total of sixty (60) minutes of television advertising,

(Section 7[g]) Thus, from the foregoing, it is clear that the use of Radio Block timers, who are obviously paid for by candidates or supporters of certain candidates, who utilize their air time to promote a person’s candidacy or bombast or put down other candidates would fall under the term, “Prohibited Election Propaganda” under Section 7[e] mentioned above. Furthermore, such Radio Block Times, just like Political Jingles, likewise fall within the definition of “Political Advertising” and should count towards the 90-minute total time limit for Local Candidates. It is therefore not enough for the radio station concerned to air a “disclaimer” prior to the radio block time because such will not relieve the station manager, the operator and the owner of the radio station from criminal and administrative liability for violation RA 9006 as implemented by COMELEC Resolution No. 9615. It is therefore expected that the airing of Radio Blocktimers who either promote the election of a candidate or who bombast other candidates to thwart their election will cease to continue immediately upon receipt of this memorandum. Otherwise, this Office will be constrained to file the appropriate criminal charges and administrative cases for suspension of franchise in order to enforce the provisions of the Fair Elections Act. Electoral fraud hat the people and the electorate should watch out for in this election is the commission of electoral fraud. Acts of electoral fraud are unlawful schemes that thwart the will of the people. Electoral fraud is not limited to those, and similar incidents that happened in Maguindanao. Right here in Negros Oriental, electoral fraud is being committed, all because of the desperate desires of politicians to win elections by hook or by crook. One form of electoral fraud that we have seen is the broadcasting of a new radio during the election period under the wings of the Liberal Party. The radio station controlled by a company of the Sy family, operates in a property identified with the family of Liberal Party gubernatorial candidate Josy Sy-Limkaichong. The Fair Elections Law prohibits issuance of permits during the election period The Liberal Party in the province, must have sensed probable defeat that they need to employ foul and unfair means against their political opponents. It doesn’t take a rocket scientist to know that the broadcasting of a radio station during the election period without the requisite permit, and the procurement of a permit through illegal means, is designed to gain an unfair advantage against its political opponents. This goes against both the letter and spirit of the Fair Elections Act and the Election Code. This radio station opened without the required mayor’s, business and other permits, according to the helpless mayor himself. This is very basic for any law abiding citizen and business entity. It procured midnight permits from the NTC, which are illegal because it did not comply with the specific terms and conditions laid down by the NTC itself. To my mind, the problem is, this is a form of corruption. Why is corruption such a bad thing? Corruption is bad because while it may benefit one or a few, the vast majority of the people suffer. How will the people eventually suffer if one does not follow basic laws, like the procurement of the lawful permits? It results in the breakdown of law and order. People will no longer follow the law, also. Who will want to procure city permits, if others can

“Unfair” Elections Act hile it is true that the spirit of the Fair Elections Act or Republic Act 9006 is to level the playing field for all candidates, what has resulted is the unfair competition and the law has become “unfair” to those who have less in gold.

One specific aspect, is the conflict of interpretations in the media exposure for the candidates and political parties especially in the areas of section 6. With the filing of certificates of candidacies as early as October the campaign spree blasted almost immediately with having no prohibition in the law. What resulted was chaos in the media and the mad rush to purchase radio and TV block times by the rich candidates to the detriment of the poorer ones who could not afford even a regular radio spot to sustain them

up to May 11. The irony is that it was anythinggoes on media since October last year. But come April, entered the very strict media limitations: from the hours-long political block times, to an aggregate of only 2-minutes per candidate of airtime in 45 days! We agree it was an impossible order. But the law is the law. The abrupt stoppage of political block times became chaotic among rich political circles. The poorer ones were smiling. Suggestion: the law should be amended such that after filing of their certificates of candidacies in October, campaigning in any form should be prohibited until the campaign period starts 45 days before elections. Plus the revival of the mandatory Comelec time on radio which is free to all candidates. In this manner the playing field becomes level, and the poorer candidates can now have equal media time like everybody else.

Unless the Comelec reverses its order, we uphold the law e had no choice but to abide by the order of the Commission on Elections (Comelec) to halt all political block times and implement the 2-minute political radio ad rule of the Comelec. You can read the Comelec Order in Full on page 2. It is not our own doing to halt the block times of politicians, it is the Comelec’s order. Everybody in that foto appearing on page 2 got a signed copy from Comelec. If others do not follow the rule of law, then we beg to disagree because we will abide by the rule of the Comelec. That is the right thing to do. The detractors of the Comelec order were there personally when the Comelec ordered the 2-minute rule to be imposed. We are just following the Comelec which is the regulatory agency of this elections. If others do not follow, that’s the call of the Comelec whom we believe will have to impose its own order. Otherwise nobody will believe the Comelec anymore. There are requests from politicians to continue the block times. Our stand is that if the Comelec reconsiders its order we will also comply. It is not correct to say that we self made such order. No. It was the Comelec as you have heard in our replays for days over DYEM-FM BAI Radio and we have continued to replay the Comelec order until such time when the commission will take back its own words. Until the Comelec reverses its order, we will abide by the order and stand our ground because that is the right thing to do. -o0oSuddenly it was the new comers in local broadcasting who were the ones making potshots at us to malign us. The poorest sector suffer—those dependent on government and other social services. Yet it is a good thing nonetheless that even before the elections, politicians have shown their real character. It gives the people a chance to make a genuine assessment. You cannot assess a politician by the way he or she sings or dances. You evaluate a politician by his or her deeds. If a politican corrupts while not yet elected, how much more if the politican is wrongly elected? A politician who is corrupt before elections will certainly be a corrupt leader after elections. So beware. Be warned. That is why it is important to look for honorable men and women in government service— those who do not yield, or refuse to compromise values, at the altar of political expedience. I hope you cannot be fooled by catchy slogans like ‘Daang Matuwid.’ For many, they see it as ‘Daang MoTuwad’.

When things are going well, we feel elated. When hardships come, we sink into depression. But true joy transcends the rolling waves of circumtances. Joy comes from a consistent relationship with Jesus Christ. When our life is intertwined with his, he will

help us walk through adversity without sinking into debilitating lows and manage prosperity without moving into deceptive highs. The joy of living with Jesus Christ daily will keep us levelheaded, no matter how high or low our circumtances.

And he began by saying them. “Today this scripture is fulfilled in your hearing.” All spoke well of him and were amazed at the gracious words that came from his lips. “Isn’t this Joseph’s son?” they asked. Tell them my name is I am that I am.” – Exodus 3 Having been a teacher of preaching, I know some students who feared going to the pastorate for not having done well in homiletics. Like Moses, and Jeremiah, DR. PROCESO UDARBE we sometimes give this excuse. We may say we have never spoken in public. The excuse of Moses is understandable. But what does God say to Moses? “Moses, show me what is in your hand.” And Moses says, “It is a rod, Lord.” However, in Moses’ thoughts, we can imagine, what use would it have for the formidable task ahead? Actually, the rod symbolized the totality of Moses’ experience. With the rod he protected himself in the desert and forests against the beasts of prey and the marauders. In his shepherding, he used the rod to put the sheep back in line. The point is God had prepared Moses to deal with a disobedient people, stubborn, unbelieving and fearful. Added to all this, Moses had lived in the palace, and his knowledge of it would be helpful. But what God meant to convey to Moses was that the equipment we need is right under our nose or right at the end of our arm—at our fingertips. The pen in the hand of Rizal caused a revolution. hand of Martin Luther changed the face of the world. The ballot in our hand can effect a change for good in our society. The eraser and chalk in the hand of teachers of the public schools have made Filipinos lawabiding citizens. So the question to Moses as well as to each of us is: What is in your hand?” And by the way, the rod in Moses’ hand did cause a liberation of God’s people. But, finally Moses, not quite satisfied so far, asked God one more question: “When I go to Egypt and meet your people, what shall I say if they ask me as to who has authorized me to go and liberate them? Suppose they ask for your name?” God said: “Tell my people I am that I am sent you.” This clinches the whole matter for Moses for as he understood it, God was promising him this: “ I will be what I will be in any situation you will find yourself in.” In other words, God would be there in their struggle with the Pharaoh, with them in their escape, with them in their sojourn in the wilderness on their way to the Land of Promise. “I am that I am” was a divine assurance. seem that any appeal to God in working out our politics and all other temporal affairs like our business, culture, education, etc., is taboo, is a no-no, is a contradiction to our very humanity, our rights and freedom, etc. And so, from this weak conception of democracy, graver errors start getting committed not only individually but also collectively. Now RH is ok with its open approval of contraception. Divorce is being mulled. In other countries, abortion is already legal, euthanasia is approved, and same-sex unions are promoted. All these coming as a result of a so-called democratic mentality where if there is a majority or a significant number of the people asking for anything regardless of its morality, then it should be given. In the States today, the push to legalize same-sex marriages by presenting it as a way to have a kind of marriage equality is a clear example of how democracy is defaced and has gone amok. It is not anymore inspired by God’s law, but rather by human preferences. We need to overcome this prejudice that, I imagine, comes from a certain mentality that at least sidelines God if not deny his existence and his providence altogether. We need to realize that especially in this crucial aspect of our life—our politics that affects all of us—a clear and strong reference to God is made as one of democracy’s fundamental principles.

s April 15 approaches, it is time to finalize your U.S. income tax return. The two steps, to do so, are to determine if you have accounted for all your taxable income and if you have claimed all of your allowable tax deductions, assuming you are not claiming the BY ROBERT L. WOLFF standard deduction. If you miss declaring all your taxable income, most likely, the IRS will notify you of the missing income and impose additional income taxes and penalties. Most likely, if you miss a deductible expense on your tax return, the IRS will not send you a notice that you missed a deductible item. If you earned income from working in the Philippines or from a business in the Philippines that is subject to U.S. income taxes, there is an income exclusion of $95,100 in 2012, plus other deductions that you most likely qualify for. Plus, you may qualify for a credit for income taxes paid in the Philippines that can be applied against your U.S. income tax liability. To claim the $95,100 income tax exclusion, you must file for it before being contacted by the IRS with regard to your income tax return. Once contacted by the IRS, you are out of luck for claiming the $95,100 exclusion. Most taxpayers take the standard deduction, unless they have itemized deductions that exceed the standard deduction. Common itemized deductions that can be claimed are medical expenses, state and local income taxes, real property taxes and certain interest payments. There are other non-itemized payments that may be available to reduce your tax bill, such as an IRA contribution. Your IRA contribution for 2012 is due April 15, even if a filing extension has been

requested. Making the IRA contribution by mail is OK if the letter is postmarked before April 16. Your IRA is a dollar for dollar deduction from your taxable income. A $2,000 contribution will reduce your taxable income by $2,000. If your marginal income tax rate is 30%, that is a $600 tax savings that stays in your pocket. If you can’t file your tax return by April 15, there are two ways to get a sixmonth extension to file your return. You can file Form 4868 with the IRS by the due date of your tax return, adding a check for any additional tax you expect to owe. But be careful not to lowball your estimate: if it is unreasonably low, the IRS can void the extension. You can also e-file the 4868. Or, for a fee, charge an extensionrelated tax payment on your credit card through an IRSapproved processor. In both cases, the new due date for your tax return is Oct. 15. If you can’t pay the tax due with your extension or when filing your return, file anyway to beat the 5%-amonth late filing levy. You can also use Form 9465 to set up an installment plan.

The IRS will waive the failure-to-pay penalty for some taxpayers this year. Because Congress waited until January to finalize the 2012 tax rules, the filing season started late for filers of many common forms. If these filers make a good faith effort to figure their tax bills with their extension requests but end up owing more taxes when they file, the Service will abate their late-payment penalties if they pay up in full by Oct. 15. Finally, be sure to finetune your estimated tax payments and withholding for 2013 if you owe taxes for 2012 or you expect your income to increase in 2013. You’ll need to determine and pay your 2013 estimated tax payments to avoid any under payment penalties. You needn’t prepay all the estimated tax you might owe for 2013, just an amount equal to 90% of it, or 100% of your 2012 tax bill (110% if your AGI exceeded $150,000 in 2012). Doing so avoids the underpayment penalty, even if you end up owing the IRS more in taxes in 2013 than you expected. If you pay too much, then you will get a refund.

Others remember their loved ones who never made it home, the ones who bear the marks of the war. Our own war veterans here have their own stories of valor of the men who fought in that war. That time in history may seem so far away now, but all Filipinos must not forget the sacrifice of those who fought to give all Filipinos the freedom they now enjoy. Through the years Men and Women in uniform have served our country well – from the soldiers who fought the Japanese during World War II, the soldiers sent during the Korean War, soldiers sent to the UN Peacekeeping Mission and the soldiers serving our country now to preserve our peace and order. They have put their lives on the line during war and in peace time. Hopefully, every year when the country celebrates Araw ng Kagitingan, the people remember and appreciate all those in the past and in our present who, in war and peace, serve and protect our country.

Parenthetically, the much ballyhooed Reproductive Health Law as a poverty eradication measure will soon be discredited and found to cause further impoverishment once fully implemented because it will transfer billions away from the poor to pharmaceutical companies abroad, assuming that it will be sustained by the Supreme Court. In this country the poverty issue should not be a very weighty problem. Blessed with rich natural resources, an educated labor force, an aggressive entrepreneurial class and a banking system awash with liquidity, all it needs is a clear vision/mission handed down by the powers that be that as of this time of writing seem to have adopted a timorous, laid-back approach to development which has made this economy one that sits on a one-legged tripod mostly dependent on the blood, sweat and tears of overseas workers. A more robust development of agriculture, manufacturing, potential tourist destination supported by adequate infrastructure and social overhead projects could easily eradicate the concentration of poverty in urban ghettos and sacadas and their kind in rural areas. In recent times churchmen have gone overboard in their concern for the poor as evidenced by the popularity of the Theology of Liberation which combined the tenets of Marxist analysis with the social doctrines of the church which goes back to Rerum Novarum in the nineteenth century. In this country some of the leaders of agrar-

ian militancy were former parish priests who have championed the cause of the sacadas, marginalized and alienated in rural areas by embracing the doctrine of despair promoted by the hard left. Pope Francis may have to confront adherents of liberation theology – a political movement inside the Catholic Church, prevalent in his own turf in Latin America which interprets the teachings of Jesus Christ relative to perceived unjust socio-political and economic

structures of sin. Fortunately for the pope the Latin American Episcopal Conference (CELAM) has done much to disengage liberation theology from its Marxist moorings. In recent years, specifically in Medellin, Colombia and Puebla in Mexico, the church has redefined liberation theology bringing it back to its Christian social doctrine with emphasis on the church preferential option for the poor now clearly emphasized by Pope Francis.

They will all be in danger even if NK only uses conventional weapons in attacking SK. The educated guess for dates for any military attack from NK, if any, are: April 10 (days NK asked the embassies in Pyongyang to leave, April 15 ( death anniversary of Kim Un’s father) and April 30 (end of SK-USA military exercises.) Would NK have the nerves to fire the first shot in any of those dates? What could be the possibly motivation why an impoverished police state would be so audacious as to threaten its sibling SK and a powerhouse like America. There is this thing about short, flabby guys who want to cover their physical inadequacy by appearing tough and militaristic. Maybe Kim Un wants to also show his countrymen that young as he may be- he can be aggressive and warlike in the global stage. It could also be to agitate a feeling of” being in a state of war”, so that the North Koreans would rally behind him and forget that many of them have no food to eat and are sad victims of human rights violation. Maybe Kim Un wants to show the new lady leader of SK , likewise , who said she will be “tough with NK” that he ain’t no sissy and yields to no woman. He also wants to show the world bravado -so they can leave him alone and in becoming a nuclear power -and, thus, enable him to hostage the world even more-in the future. The whole world will not humor him by agreeing with his blackmail. In fact, none of the foreign embassies in Pyongyang followed his advice to leave the country- for following him would enhance the scenario of a “world crisis” and make a lion out of a mouse that Kin Jong Un really is. But there is also a more subtle way. CNN reported of a NK dissident who -with little money- was able to cross to China via a long route and who then sought asylum in SK as a political opposition. Now, he is happily employed, married and owns a home and car in Seoul. He was ecstatic to be in the free world- to express his thoughts,sing and dance, do the arts, wear clothes he wants, talk freely and earn a decent living. This is also the dream of millions of oppressed North Koreans who yearn for freedom and democracy as they struggle with famine, state violence and a dull life under a military dictatorship. The Free World might like to consider infiltrating the ranks of the disgruntled North Koreans and then agitate them to rebel against the brutish Kim Jong Un. Overthrowing this infantile leader in crew cut and Maoist jacket would be like spanking a pesky punk. Of disciplining a conceited braggart with inclinations towards mass murder by using nuclear weapons against the enemy. That would be good for the Philippines which will always be threatened by the bellicose attitude of Kim Jong Un. Farmer Murdered by NPAs. Brgy Siapo, San Jose, NOR a certain Cirilo Sienes, 40 years old, a farmer from Sitio Guinlungsuran of Brgy. Siapo was shot to death by NPAs around 4 o’clock in the afternoon last April 06, 2013 while the victim was tilling farm. The victim suffered a gunshot wound in his forehead causing his instantaneous death. Two (2) empty shells of caliber .45 and a computerized letter from NPA’s “Rachelle Mae Palang Command South East Negros” were found in the crime scene. The NPA’s “Kangaroo Court” decided to execute Sienes for not supporting the NPA’s ideology and struggle as stated in the propaganda letter left by the perpetrator at the scene. LTC MARION R SISON, Commanding Officer of 79th Infantry (Masaligan) Battalion called the NPA’s heinous crime an act of cowardice, targeting defenseless, peace-loving civilians who are deliberately shunning away from armed struggle. Since January this year, two (2) blatant killings were already perpetrated by members of the NPA under the South Eastern Front Komiteng Rehiyon Sentral Bisayas (SEFKRSB) operating in Southern Negros Oriental. Parco said BSP and AMLA Council (AMLAC) aim to reach out to all the pawnshops and money-changing businesses in Dumaguete and the province to apprise them of their duties and responsibilities as soon as they encounter large sums of money in the course of their daily activities. Parco admits they were not able to extensively reach out to the pawnshops and money-changing businesses as potential targets of money launderers, while banking institutions are closely being monitored for transactions involving huge accounts. In discouraging money laundering acts, Parco enjoins pawnshop owners and money changers in the province and the city to immediately report transactions amounting to more than P500,000 so that they can be monitored by the AMLAC. The monitoring is conducted to determine if such amounts didn’t come from illegal sources. A lot of transactions had been noted in the pawnshops and money-changing businesses in Dumaguete, prompting the BSP and AMLAC to initiate a seminar and briefing to discuss the duties and responsibilities of both the pawner and the pawnee.
