AREA HISTORY

Deschutes River Ranch is roughly two miles west of what is now the unincorporated town of Tumalo. Tumalo was originally called Laidlaw in its earliest days which date back to the 1880s. The town was platted in 1904, and Tumalo Irrigation District was formed that same year. The town was initially thought to be a future hub with a crossing of the Deschutes River and railroad junction of rail lines from the coast and Columbia River. Tumalo never incorporated and always stayed as a rural service area, which kept the community small with rural favor.

Deschutes River Ranch was originally a working “dude ranch”, from the 1970s and on, until it was established as a private planned community with adjacent natural areas and agricultural production. A portion of the Deschutes River Ranch resides on what was first settled by Marshall Clay Aubrey in 1891. Aubrey lived until 1921 and was considered one of the true pioneers and cowboys of the area. The HOA is a non-profit organization that fully enforces high standards for exceptional homes and properties.

WATER SOURCES | WATER RIGHTS

For domestic water, a purchaser will have to develop a private well to service a dwelling. Contacts of local well drillers are available through the listing broker. The 22.5± acres of water rights Wild Horse Trail Farm water rights serviced by TID (Tumalo Irrigation District, https://www.tumalo.org). (19.5 ± acres, total, of useable water rights with remainder 3.0± acres under long term lease with neighboring tax lot 2502, contact listing agent for more details.) Tumalo Irrigation District was formally created in 1922 and services 685 patrons for irrigation water used on hay, pasture, lavender, vegetables, and other crops. Buyers may contact TID at 541-382-3053 to inquire further about water rights that are appurtenant to the property.

Under Oregon law, all water is publicly owned. With some exceptions, cities, farmers, factory owners, and other users must obtain a permit or water right from the Water Resources Department to use water from any sources, whether it is underground, or from lakes and streams. Landowners with water flowing past, thru, or under their property do not automatically have the right to use that water without a permit from the Department. The waters of Oregon are administered by the State of Oregon, under a “priorappropriation” doctrine, “first in time, first in right.”
