Bill: What to Expect.

Legal changes governing the relationship between landlords and tenants are imminent, mainly aimed at protecting tenants. Some are expected to be in force before or by the summer. David Moulton, who specialises on property litigation at Fraser Dawbarns, outlines key points for landlords to consider.

The starting point is that fixed term tenancies are ending. All tenants will be on periodic tenancies and need to give two months’ notice if they plan to move.

Getting a tenant to vacate

It will become harder for a landlord to get a tenant to leave as the “no fault” Section 21 notice option will disappear. Depending on the circumstances, the landlord may be able to serve a Section 8 Notice indicating a need or good reason for a possession order to be granted.

If a landlord wishes to sell, this will be a justifiable reason but the notice period will be four months.

If a tenant fails to pay the rent, is exhibiting antisocial behaviour or is in breach of the tenancy terms in some other way, eviction will still be possible. This is likely to be a more drawn-out process than proceedings based upon a Section 21 Notice and gives the tenant the opportunity to raise complaints about the state of the property and use this as a defence to a claim for non-payment of rent.

Rent increases

Two months, rather than one, will become the compulsory notice period for increasing a tenant’s rent.

Letting to new tenants

The process of attracting new tenants is changing to discourage discrimination and there may be fines for non-compliance.

• Stricter action against stipulations such as no pets or children is expected. It will remain possible to reject applicants if a property is genuinely unsuitable, such as a two bedroom property for a large family, provided it represents a proportionate means of achieving a legitimate aim.

• The rent at which a property is advertised will have to be the amount that it is let for to stop anyone paying above market rate to secure a property.

• The option of paying several months’ rent in advance will also no longer be available.

Decent Homes Standard

The private rental sector will have to comply with similar standards of repair as currently apply to social housing. The introduction of ‘Awaab’s Law’ will also create clear timeframes for landlords to deal with serious health-concerning hazards. Local Councils will have greater powers than ever before to force landlords to carry out repairs to ensure that the standards are met.

Other Proposed

Changes

Landlords will at some stage need to be registered on a new private rented sector database and will also need to sign up with the private rented-sector Ombudsman.

There is further detail which will interest some landlords but be of little significance to others. Landlords should consider reviewing their tenancy arrangements now and discussing their future plans with their property agents.

February is upon us which means we a step closer to Spring. February is always a strange month weather wise but can throw up all sorts of opportunities for photographers. As I write this article I am in the midst of arranging a photography group visit to the Kings Lynn Mart with a professional photographer, this is always great fun. There are also lots of light shows taking place across Lincolnshire at Spilsby, Boston and Lincoln all free. There is also the Luxmuralis Projection in Lincoln Cathedral, which is well worth visiting but you do need to book tickets in advance.

Our next group meeting takes place on Wednesday 12th February at 7.30pm at the Church Hall, Long Sutton whereby we welcome Neal Smith a wildlife photographer from Boston and is well known to us. We are opening this meeting up to the general public. Tickets on the door. £3 per person.

Hare coursing has been in the press again recently with police receiving more than 40 complaints one Sunday in January. Dozens of coursers were involved, driving dangerously round country lanes and across fields. Three people were arrested and charged with criminal damage.

Lincolnshire Police have been cracking down on the illegal ‘sport’ for over five years, to deter hare coursers, charging about the countryside in 4-wheel drive vehicles, chasing down hares with their dogs, causing a danger to the public and damaging fields, crops and boundaries.

According to press statements the 2023/24 coursing season saw 256 incidents across Lincolnshire, 13 arrests, 14 dogs and eight vehicles seized.

The sport of hare coursing has, since the Hunting Act 2004 been illegal, and socially unacceptable for a while longer than that, but, like fox hunting was a popular local rural pastime in times gone by, with riders on horseback following their dog packs.

The Long Sutton and District Civic Society has in its collection the George Thomas Peele horn, used by The Harriers, the local hunt, the usual quarry for which was hares. Interestingly the South Lincolnshire hunting grounds were all part of the famous Belvoir Hunt, whose territory extended from the borders of Leicestershire to the Wash. Before social attitudes changed local newspapers carried regular reports of local hunts. One such from The Wisbech Telegraph of Saturday February 10th 1872 read:

'The South Lincolnshire pack has lately had excellent sport...Mr Peele met at the Hall Marsh. Found at once, and after a pretty ring of two miles, changed at Lutton Leam for a straight-necked one that led at a spanking pace over the Hall Farm, crossing Wood Lane, Sutton Bridge Road, Mr. Atkinsons Farm and the railway (the pack just missing a train), through the common up to Mr. Peele's farm, where the hare crossed the Wisbech Rd, and, taking a bend to the right, over the old Roman Bank, she set her head straight for the Fens, on up to Forman's Bridge, where they had a short check in a field of turnips. The distance to this point was five miles and a half, straight line. Here two hares had been seen, and it is possible a change occurred: however, they raced back a little to the right of the former line, crossing the Fen and Roman Bank on to the common, and up to Mr. Derry's. Doubling, leaving Sutton Crosses to the right, puss went fast to Mr. Moore's wood, near where she laid up, and the hounds got their first view. Racing her back to Forman's Bridge, up to the Roman Bank, making for home, she was compelled to lay up once more. Again sighting her, the pack rattled her to Mr. Perkins stack-yard, where they killed: time 2 hours and forty minutes'.

The horn is contemporary to this account bearing the date 1871. It is believed that George Thomas Peel is the same as Mr. Peele in the extract who led the Hunt. The former Peele Community College (now University Academy Long Sutton) also bears his name as it was built on his land (Hall Farm).
