Legal advice: How to protect your property from fraud.

Fraud in the property sector is a larger problem than many people realise. Fraudsters generally aim to steal property by transferring its legal ownership. Alternatively they might take out a fraudulent mortgage on a property and then leave the owner saddled with the debt.
Who is most at risk?
Your property is potentially most at risk if you have no mortgage on it, if it is vacant or rented out, if you are not resident in the UK, or if your ID has been stolen. Properties without recent land registry activity are also targeted because fraudsters believe that you are less likely to notice what is happening.
How is property fraud carried out?
The fraud generally starts with identity theft. Stolen documents or personal information are then used to pose as the owner of a property. Fraudsters then change existing documents or create new fake ones, perhaps pretending to remortgage or sell a property. These are then submitted to HM Land Registry to change the ownership of the property for the fraudster’s benefit. This is often followed by a quick sale before anyone notices.
How can you protect yourself?
Between 2009 and 2023 HM Land Registry prevented more than £340 million of property fraud but there are various steps that property owners can take to reduce their individual risk of being the subject of fraud. Is your property registered?
The starting point is to be sure that your property is registered with HM Land Registry. Property that has been bought or sold since 1990 will be registered, but property that has been owned by the same person for several decades may still not be registered. Unregistered property is at greater risk from fraudsters. A property that is unregistered relies on hard copy deeds to prove ownership which can also cause problems if the deeds are lost or damaged. You can check whether your property is registered at www.gov.uk/search-property-information-land-registry
Sign up to the Property Alert service
HM Land Registry encourages property owners to sign up to their free Property Alert service. If certain types of activity are spotted in relation to the property you are monitoring, you will receive a message alert. Most of the messages will be about a genuine change that you have made, such as new mortgage details, but if you are alerted to a change you do not recognise then you will be able to investigate quickly. You can sign up at www.gov.uk/property-alert and then make sure that you keep your details up to date so that you can be contacted quickly and easily.
Getting a restriction to stop activity on your property
It is possible to put an anti-fraud restriction on the title register. This would block any transfer or mortgage on your property unless a solicitor or conveyancer certifies that the application was made by you.
Check your credit report
Checking your credit report regularly to ensure that there hasn't been an unexpected financial activity is a useful additional precaution.

Two recent events have reminded me about one of the now hidden recent histories of this area. The first was the death in March of the last surviving pilot from the Battle of Britain, Group Captain John ‘Paddy’ Hemingway. The second, was watching the excellent Channel 4 TV series ‘Top Guns, Inside the RAF’.
Both events link to our former air station, RAF Sutton Bridge. Although not serving locally, Group Capt. Hemingway piloted Hurricane aircraft during the war which, along with the better known Spitfire, were the mainstay of the air force. RAF Sutton Bridge played a pivotal role in thwarting the Luftwaffe in its 1940 air campaign as it was one of the key training grounds for allied pilot’s fighting skills. The station housed a compliment of nearly 70 Hurricanes at the height of the war, plus other types, some involved in target towing over RAF Holbeach, the Air Weapons Range at Gedney Drove End. Britains ‘Top Gun’, the Central Gunnery School, the first of its kind in the world was established at RAF Sutton Bridge in 1942.
Secondly, the last programme in the Channel 4 TV series followed the success of an RAF Typhoon pilot, earning his own Top Gun credentials, in part following live firing runs over the targets at Gedney Marsh.
We should be proud of our aviation heritage. We live with the background noise of military aircraft and have done so throughout living memory. As far back as 1917, fighter aircraft from a temporary wartime base at Tydd St Mary intercepted German Zeppelins gathering over the Wash before flying inland, using the River Nene as a navigation aid.
RAF Sutton Bridge and its satellite air gunnery range at RAF Holbeach was established nearly a century ago in 1927. Sutton Bridge based aircraft towed canvas drogues that fighter pilots could target. The reason it is here is the unique suitability of the Wash marshes for gunnery practice and the need for a nearby airfield to support the aircraft and crews. As an aside, a fairly interest fact is that RAF Holbeach is both the largest and smallest establishment in the UK by site area, depending on the state of the tide!
The skies over our area would have been filled with training sorties in the wartime years. Apart from the dozens of airmen at the airfield, the River Nene was used by the Dambuster squadron for practice runs, targeting the swing bridge as a pretend dam. Sutton Bridge was responsible for training over 400 pilots involved in the Battle of Britain.
Prior to the war, RAF Sutton Bridge was an air gunnery training base, with aircraft towing targets out over the Wash for aircraft gunners to take aim at. In 1942 the fighter crew training function at Sutton Bridge was relocated and the Central Gunnery School, the first of its kind in the world, established at the airfield. The role of this new venture was to teach already experienced fighter pilots and bomber rear gunners how to perfect their shooting skills. Once graduated from the school they were posted as gunnery instructors to fighter and bomber squadrons. During this time the airfield was operating Spitfires and Wellington bombers. This ‘Top Gun’ school predated the US equivalent, made famous by the eponymous Tom Cruise movie by some 26 years, and is a role also now undertaken at RAF Coningsby with its Typhoons.
The airfield, which had only a grass runway closed to flying operations in 1958. Little can now be seen on the ground but is commemorated by a memorial near the swing bridge, surmounted by a twisted propeller blade from a crashed hurricane of the Sutton Bridge training squadron. Fortunately, the pilot was able to bale out, was helped by locals and returned to the base safely by horse and cart!

Spring has arrived with the countryside starting to burst back into life , from roadside verges and fields full of daffodils to the new life with the lambs bouncing around enjoying themselves. Easter is just a few weeks away.
At our meeting on the 9th April we welcome Steve Dixey from North Lincolnshire who will be giving us a presentation on the North Lincolnshire Marshes. Everyone is welcome, non members £3.
We are busy working towards our first Lincolnshire Through the Lens Photography Exhibition which takes place from Friday 18th to Monday 21st April at the North Sea Observatory, Chapel St Leonards, Skegness from 10am to 4pm each day.
