The organisation is bringing the challenge on behalf of its members, as well as in the public interest
"It would not be reasonable and effective for affected ratepayers to bring the challenge on their own The City has vast resources to defend the three items of their budget, something that is far beyond the financial capabilities of the thousands of ratepayers who objected to the budget to bring multiple legal challenges," states Nilesh Ambaram Gopal of Sapoa
The first draft budget was published for comment on 27 March, introducing the three fixed charges, which caused a public outcry Sapoa objected on several grounds, along with a protesting petition of more than 10 000 signatures that was submitted to the City No fewer than 14 000 comments were made during the public participation period Virtually all commentators strongly objected to the first draft budget, mostly against the fixed charges
Changes were made to the first draft budget in May by the City, resulting in the publication for comment on the revised draft budget
In the revised draft budget that was passed on 26 June, the City stated that it sought to alleviate the impact on lower and middle-income households by the introduction of rebates
However, Sapoa holds that these reductions and rebates do not detract from the fact that the fixed charges are unlawful and should not have been introduced in the first place
Sapoa says a continued rise in municipal costs has a significant detrimental effect on the costs of occupancy faced by tenants in commercial retail properties
If municipal costs push charges past a certain limit, tenants struggle and landlords must help, but their options are limited Leases can become unaffordable, leading tenants not to renew According to its Operating Costs Report, by June last year, electricity made up 29% of total operating costs, while municipal charges accounted for a staggering 60% According to Sapoa, the tariffs linked to property values do not comply with the Property Rates Act
It points out that the three tariffs are not based on consumption It is not a surcharge based on a basic charge nor a municipal tax Sapoa considers the tariffs a form of property rates as they are linked to property value, but points out that they do not comply with the Property Rates Act
LEGALITYOFVALUE-BASEDCLEANINGLEVY
The cleaning levy will be funding general cleaning on council property, litter picking and providing other services like illegal dumping removal and informal settlements
"The question to be answered is whether it is legally permissible to levy tariffs against property owners for cleaning services based on the value of their properties, regardless of whether the property owner actually receives such services at the property or in the area of his property," states Gopal
He points out that section 229(1) of the Constitution states that a municipality may impose rates on property and surcharges on fees for services provided by the municipality, and submits that the cleaning tariff has not been adopted as a property rate in terms of applicable rates legislation
Furthermore, Sapoa states it cannot be a surcharge on fees charged for services because a surcharge is an additional percentage "profit" on the consumption tariff and not a tariff linked to property value It also cannot be another permissible tax because such tax must be approved in terms of national legislation, which has not happened
WATERANDSANITATION
The organisation further holds that fixed water charges are also irrational, arbitrary and contrary to the rule of law as entrenched in the Constitution
The organisation also notes that, until now, the fixed water charge was based on the pipe-connection diameter, and the fixed sanitation charge was tied to water usage Thus, they argue that property owners who invested in alternative water systems to reduce consumption after the
Day Zero crisis are now being penalised
These improvements raise property values, which under the new tariff system, results in higher water charges, a move Sapoa calls irrational
Whilst Sapoa regularly engages on property issues and seeks cooperation with municipalities, it says repeated attempts to address members' concerns with the City of Cape Town were unsuccessful As a last resort before litigation, Sapoa requested a legal opinion justifying the link between tariffs and property value, but the City declined
SAPOAPROTECTSPROFITSOVERPEOPLE'
In response to Sapoa's High Court Application, Cape Town Mayor Geordin Hill-Lewis says Sapoa's attempt to stop Cape Town's pro-poor budget is to protect their own vested interests, and puts their profits ahead of the people of Cape Town
"Sapoa represents the country s wealthiest and largest property owners - mainly shopping mall owners - who have benefited significantly over the years from Cape Town's functionality and success However, they now argue that the City should charge the biggest property owners the same as individual low-income families," he stated
"The City simply cannot agree that wealthy property owners should be charged the same as lower-income or middle-class households This would be regressive, would place a disproportionate burden on ordinary families, and would be patently unfair "
He holds that the City's budget protects homes under R2,5 million and extends rates relief to many more middle-class homes, all whilst preserving the City's critical infrastructure and service investments
"In contrast, this court application by the richest of the rich property portfolio holders seeks to go back to a system of regressive taxation which hits ordinary families, and the poor, the hardest," said Hill-Lewis
The Mayor said that if Sapoa were to succeed in their argument, the effect would be "to have ordinary families effectively subsidising the wealthiest property owners"
The City scrapped the old "pipe levy" charge because it was unsustainable for R50 million and R500 000 homes to make equal contributions to Cape Town's infrastructure and fixed service costs
"Fixed charges linked to property value is a lawful, more fair, and equitable way for Capetonians to contribute within their means to our city's infrastructure programme and fixed service costs," he said
The Mayor added that the City had engaged extensively with Sapoa, who had accepted the necessity of Cape Town's R40 billion infrastructure budget over three years, a South African record, but that Sapoa had offered no workable alternative means of distributing fixed infrastructure and service costs among ratepayers
"The only alternative to fixed charges linked to property value, is for everyone to pay a flat charge regardless of whether you are low-income or affluent This is not a sustainable nor fair way to fund infrastructure investment and the fixed costs of service delivery If a flat charge of say R500 is billed, and one household earns R20 000 whilst the other earns R100 000 a month, this charge represents 2,5% and 0,5% of their monthly income respectively This means the impact on the lower-income household is actually five times more than on the higher-income household, which is regressive and inequitable," said Hill-Lewis
The Mayor further said that fixed charges are necessary because all ratepayers need to make a contribution to municipal infrastructure and not only those who can't afford to invest in alternative water and electricity sources
"Cape Town would not have a working electricity or water service to speak of if the City only charged people for consumption Many costs are fixed in nature – pipelines, trucks, cables, staff to service it all These costs remain no matter how much people consume, and so fixed costs must be met with a portion of fixed revenue Infrastructure must be available for all and must always work To achieve this, costs must be borne by all ratepayers," said Hill-Lewis

The installation of fence around the Plattekloof Natural Heritage Site which borders Welgelegen, Edgemead, Bothasig, Kleinbosch and Monte Vista, has been completed.
The natural heritage site is located on Eskom property and the fence project was done in partnership with the electricity supplier and local community organisations
In November last year
TygerBurger reported on the project which was started in 2023 Back then Steve Maritz, chair of the Edgemead Neighbourhood Watch (ENW), said that since the start of the installation of the fence, there had been a definite reduction in crime He said the fence project had been a gamechanger and that it had played a significant role in reducing crime
The natural heritage site has been used as a hideout by some vagrants and
criminals who targeted houses located next to the reserve
Since the project has been underway several clean-ups had been conducted as well as a fire break installed The local neighbourhood watch organisations have also discovered several fauna and flora species, unique to the area
The fence project was done over five phases and last week Maritz confirmed that the last section of the project along Plattekloof Road and between Plattekloof Road and Giel Basson Drive have been completed
"The section of the fencing project between Kleinbosch and Welgelegen between Giel Basson Drive and Plattekloof Road commenced on 24 March and good progress has been made with only the bottom kerbing and anti-climb razor wire top to be installed," says Maritz
This project was driven by ENW on behalf of the Plattekloof Welgelegen Panorama Neighbourhood Watch based on

the success of the initial section between the Eskom Acacia Substation and Giel Basson Drive, which has seen a definite reduction in crime in the area, as well as an increase in fauna and flora in the natural heritage, Maritz explains Martiz says ENW was approached to assist with getting the latest fencing project off the ground, based on the success of the initial project, and the good working relationship which had been developed between ENW and Eskom
"We would like to extend our sincere thanks to Eskom management for their co-operation to ensure the safety and security of their property Residents and neighbourhood watches are grateful as this massive security and safety risk is finally being addressed," says Maritz

Warm meals provided to needy
JOFOURIE JO FOURIE@NOVUSMEDIA CO ZA
In celebration of Mandela Day, 1 080 adults and children gathered at the Market Hall in GrandWest to give 67 minutes of their time toward a worthy cause packing meals for children in need
The event, organised by Rise Against Hunger (RAH) in partnership with GrandWest, brought together volunteers from corporate businesses including Nedbank, Standard Bank and Good Hope FM, as well as 42 learners and three educators from Elswood-, Bellville Southand Rocklands High Schools From 09:00 to 13:00, the Market Hall buzzed with energy as 24 teams, each with 432 volunteers per session, worked in synchronised production lines, packing a staggering 240 624 meals These meals will feed over 1 046 children for a full year through various school feeding schemes
GrandWest covered the R64 750 cost to allow learners and educators to participate and waived venue hire fees Corporate team entry fees helped fund the dry ingredients and basic packaging
2,5MILLIONMEALS
This food-packing drive is part of RAH’s national Mandela Month campaign, which aims to pack 2,5 million meals in July to support 225 Early Childhood Development (ECD) centres across South Africa for a full year The meal packs contain rice, soya, soup mix and a sachet with 23 essential vitamins and minerals, designed to meet children’s daily nutritional needs Volunteers were treated to creative dishes made by GrandWest Executive
Chef Keshan Rambarun using these very ingredients
GrandWest General Manager Mervyn Naidoo expressed his gratitude to all who participated:
“Every person who volunteers their two hands for just 67 minutes, once a year, helps us pack well over a quarter of a million meals Thank you to all the schools, small businesses, big corporates and staff for making a difference every year ”
Naidoo explained that GrandWest has hosted this initiative annually with RAH since its inception even attended by Graça Machel at the inaugural event
RISEAGAINSTHUNGER
According to RAH Regional Manager Dayne Myles, Mandela Month alone accounts for 40% of the meals they pack annually, with 2,7 million meals packed in July 2024, feeding over 11 000 children for a year Their ECD Connect programme channels savings on food into upgrades like first aid kits, sanitation facilities, and roof repairs particularly benefitting female-led micro-enterprises running creches
RAH identifies high-need areas, such as Stellenbosch, and partners with teachertraining organisations to ensure long-term development “The meals provide more than nutrition,” says Myles

Hopeforchildrenbornwithclefts
The month of July marks National Cleft and Craniofacial Awareness and Prevention Month, a time to shed light on conditions that not only affect a child’s physical development but also their confidence, well-being and future
In partnership with the Smile Foundation, Tygerberg Hospital in Parow and Red Cross War Memorial Children’s Hospital in Rondebosch, both leading tertiary centres, are working to raise awareness about cleft lip, cleft palate and other craniofacial conditions, while providing
reconstructive surgeries that transform young lives, the provincial health department said in a statement issued last week
“These are not just cosmetic procedures, they are life-saving and life-changing,” says Prof Nick Kairinos, head of plastic and reconstructive surgery at Tygerberg Hospital
Kairinos added: “The tertiary hospitals currently perform more operations for congenital anomalies than any other hospital in the country, thanks to the great plastic surgeons who work there and also those who work in private practice who give up their time, free of charge, to operate on children during the Smile Weeks, supported by the Smile Foundation These surgeries are for conditions such as craniofacial, cleft lip and palate, congenital hand and congenital ear anomalies Many of these children would otherwise not be operated on or have experienced long delays before they receive their life-changing surgery ”
EARLYDIAGNOSIS, TIMELYTREATMENT
Cleft and craniofacial conditions are often identified prenatally or shortly after birth
Early diagnosis allows doctors to start planning interventions immediately, setting newborns on a path toward improved longterm health
Without treatment, children face serious complications such
KIDS
as difficulty feeding, frequent ear infections, hearing loss, delayed speech, dental problems, developmental delays and even social isolation
Cleft lip and cleft palate, where parts of the upper lip or roof of the mouth do not form properly, affect around 1 in every 2 000 African children
One-year-old Anzelle van der Merwe from Bellville is one such child
Her cleft palate was only discovered at birth Her mom, Nicole, reflected on their journey “When I first saw her, I did not care about the cleft, I was just so happy to meet my baby I knew God would make a way I have been with her through every operation and recovery, and today we share an amazing bond I would not change a thing,” she said
These surgeries do not just repair a condition, they restore dignity, confidence, and the ability to speak, eat and smile without pain or shame
CRANIOSYNOSTOSIS:COMPLEX SURGERIESTHATSAVELIVES
Craniosynostosis, when the bones in a baby’s skull fuse too early, affects about 1 in every 2 500 children If left untreated, it can lead to abnormal skull
growth, increased pressure on the brain, and even brain damage, the department said
Three-year-old Caleb Magede from Blue Downs underwent a highly complex skull surgery at Tygerberg Hospital last year
His mother, Rufaro, shared their story “I was scared and confused when I first heard the diagnosis But the care and expertise we received gave me strength and hope,” she said Kairinos explained the depth of these procedures
“Craniosynostosis surgeries involve removing parts of the skull, reshaping them, and placing them back to protect the brain and allow normal growth It requires a multidisciplinary team of neurosurgeons and plastic surgeons working together ”
AMESSAGETOPARENTS ANDCOMMUNITIES
Both families expressed deep gratitude to the medical teams who supported their children through the surgical journey Rufaro encouraged parents to trust their instincts “If you notice anything unusual in your baby’s face or head shape, speak to your healthcare provider Early help can make all the difference ”
The department said it applauds the efforts of their dedicated public health professionals and partners who give children a second chance at a full, healthy life

After undertaking a pilgrimage covering a distance of over 270km the chief executive of the Tygerberg Hospital Children's Trust is back home
This week she shared some of her experience of the walk across Portugal and Spain with TygerBurger
Louise Theron, chief executive, said the walk was done to raise funds for the hospital and the children that the facility cares for Theron was accompanied by Leone Malan, a lifelong friend The duo walked from Porto in Portugal to Santiago de Compostela in Spain over 14 days Their mission - to raise critical funds for life-saving paediatric equipment for the children of Tygerberg Hospital, one of South Africa’s busiest public hospitals, she said
In May this year the newspaper also reported on the two before they embarked on their journey Theron and Malan left South Africa for Europe on 19 May They started the Camino on 22 May and arrived in Santiago de Compostela on 5 June The two friends arrived back in South Africa on 12 June
PILGRIMAGE
With each step, they carried not only their backpacks but also the hopes of countless children and families who rely on Tygerberg Hospital for care and healing
The pilgrimage, historically walked for spiritual reflection, became a symbol of a very real and urgent modern-day causesupporting the lives of vulnerable children in need of specialised medical care, said Theron
emotionally, but every kilometre was driven by the knowledge that our efforts could help save a child’s life
"We walked for the babies and children, for the parents waiting by ICU bedsides, and for the doctors and nurses who perform miracles every day at Tygerberg Hospital,” she said
SUPPORTCAMINO
The trust is now calling on the public, corporates, and friends of Tygerberg Hospital to support this Camino for Kids campaign by donating towards the purchase of critical paediatric medical equipment that are urgently needed in neonatal and paediatric wards

Decades later, still no action
Thanks for highlighting problems brought up by residents at a public meeting ( "Residents call for Action", Tygerburger 15 July)
I intentionally did not attend the meeting as I knew it would be yet another talkshop - as usual! What was new? 20 year-old issues! Since 2016 the existing problems simply escalated
After years of criticism I endeared because of my stance against ward 26/27 it was with gratitude that Vasco topped the onslaught of irate residents
We even had Dan Plato then mayor with a busload of councillors tour the area decades ago Result? Zilch!
When Clive Justus was councillor, I raised the issue of the squatters who initially erected shacks at Wingfield
Subsequently the present regime housed illegal
Ek wil graag iets van my hart af kry
immigrants there I dare any reader to go near the sight due to the indescribable filth and inhumane conditions
Voortrekker Road is a disgrace - prostitution flourishes; how certain "businesses" are allowed fails logic; squatters, homeless; illegal construction; overpopulated properties etc proliferate
House sales have reached record heights as law-abiding owners flee
And then, when a resident loses his cool, the councillor orders him "to leave my meeting" In November both ward 26/27 councillors simply did not turn up for a meeting which they called
There are some devoted councillors but regretfully others They are however safe as a bug in a rug

help
moeilike situasie is?
Ons het almal al gehoor: “Moet nie laat jou regterhand weet wat jou linkerhand doen nie
En dan is daar ook die Popi-wet wat blykbaar heeltemal geïgnoreer word
As jy sop wil uitdeel of skenkings wil maak – fantasties!

Road markings raise safety concerns
In the article “Road markings missing” of 16 July, one is not sure what the City means by “capacity constraints”, but whatever it means, it reflects on service delivery As missing road markings creates a safety risk, it can be seen as an essential service which the City must deliver and of course, also maintain We are however of the opinion that there is also a problem with the service providers who delivers an inferior service If they add too much water with the paint it does not last long enough and there are no consequences and responsibility, they are paid as if it was a job well done
In the article “Safety audit suggested on dangerous road” also of 16 July we totally agree with Cllr Bresler “due to a shortage of manpower there is a general lack of visible traffic police on neighbourhood roads”
However we are of the opinion it is more a lack of effective policing!
Maybe it is time for a Local Dialogue on these issues as well as others, and it does not have to cost R700 million

Potholes a growing risk
In response to "Calls grow to fix crumbling Goodwood roads" (TygerBurger 16 July) and "Goodwood roads crumble in rain" (2 July)
Since the upgrade work on Jake's Gerwel Drive, which has stalled, these two roads are taking a beating
Concentrate on monitoring the state of the wear and tear on the roads, before the now visible potholes cause unnecessary incidents
As it's known now to the authorities these two roads are being used as a leeway, to try and avoid bumper to bumper traffic on Jake's Gerwel Drive TESSA LUCK, Goodwood
