"It would not be reasonable and effective for affected ratepayers to bring the challenge on their own The City has vast resources to defend the three items of their budget, something that is far beyond the financial capabilities of the thousands of ratepayers who objected to the budget to bring multiple legal challenges," states Nilesh Ambaram Gopal of Sapoa
The first draft budget was published for comment on 27 March, introducing the three fixed charges, which caused a public outcry Sapoa objected on several grounds, along with a protesting petition of more than 10 000 signatures that was submitted to the City No fewer than 14 000 comments were made during the public participation period Virtually all commentators strongly objected to the first draft budget, mostly against the fixed charges
Changes were made to the first draft budget in May by the City, resulting in the publication for comment on the revised draft budget
In the revised draft budget that was passed on 26 June, the City stated that it sought to alleviate the impact on lower and middle-income households by the introduction of rebates
However, Sapoa holds that these reductions and rebates do not detract from the fact that the fixed charges are unlawful and should not have been introduced in the first place
According to Sapoa, the tariffs linked to property values do not comply with the Property Rates Act
It points out that the three tariffs are not based on consumption It is not a surcharge based on a basic charge nor a municipal tax Sapoa considers the tariffs a form of property rates as they are linked to property value, but points out that they do not comply with the Property Rates Act

The Mayor said that if Sapoa were to succeed in their argument, the effect would be "to have ordinary families effectively subsidising the wealthiest property owners"
The City scrapped the old "pipe levy" charge because it was unsustainable for R50 million and R500 000 homes to make equal contributions to Cape Town's infrastructure and fixed service costs
"Fixed charges linked to property value is a lawful, more fair, and equitable way for Capetonians to contribute within their means to our city's infrastructure programme and fixed service costs Cross-subsidising – where the better off among us help to fund services for the less fortunate – is the only sustainable way to ensure a working city of hope for all," he said
The Mayor added that the City had engaged extensively with Sapoa, who had accepted the necessity of Cape Town's R40 billion infrastructure budget over three years, a South African record, but that Sapoa had offered no workable alternative means of distributing fixed infrastructure and service costs among ratepayers
"The only alternative to fixed charges linked to property value, is for everyone to pay a flat charge regardless of whether you are low-income or affluent," said HillLewis
The Mayor further said that fixed charges are necessary because all ratepayers need to make a contribution to municipal infrastructure and not only those who can't afford to invest in alternative water and electricity sources

The installation of fence around the Plattekloof Natural Heritage Site which borders Welgelegen, Edgemead, Bothasig, Kleinbosch and Monte Vista, has been completed.
The natural heritage site is located on Eskom property and the fence project was done in partnership with the electricity supplier and local community organisations
In November last year
TygerBurger reported on the project which was started in 2023 Back then Steve Maritz, chair of the Edgemead Neighbourhood Watch (ENW), said that since the start of the installation of the fence, there had been a definite reduction in crime He said the fence project had been a gamechanger and that it had played a significant role in reducing crime
The natural heritage site has been used as a hideout by some vagrants and
criminals who targeted houses located next to the reserve
Since the project has been underway several clean-ups had been conducted as well as a fire break installed The local neighbourhood watch organisations have also discovered several fauna and flora species, unique to the area
The fence project was done over five phases and last week Maritz confirmed that the last section of the project along Plattekloof Road and between Plattekloof Road and Giel Basson Drive have been completed
"The section of the fencing project between Kleinbosch and Welgelegen between Giel Basson Drive and Plattekloof Road commenced on 24 March and good progress has been made with only the bottom kerbing and anti-climb razor wire top to be installed," says Maritz

The National Sea Rescue Institute (NSRI) has unveiled a major expansion of its Emergency Operations Centre (EOC) at the Volunteer Support Centre in Cape Town nearly doubling the facility’s size and significantly enhancing its realtime response capabilities This critical upgrade boosts the NSRI’s capacity to coordinate rescue operations, monitor coastal activity, and respond rapidly to emergencies across the country

Eskom has confirmed that Unit 1 of the Koeberg Nuclear Power Station, currently offline for long-term maintenance, will return to service later than expected
Originally scheduled to be back online this month (July), the unit is now set to return by the end of August
According to Eskom, the delay is due to additional maintenance needed on the new steam generators During routine inspections specifically a method called eddy current testing defects were found in four tubes out of thousands These defects were addressed immediately through an advanced automated repair process, carried out by international specialists and local teams
“Our top priority is always the safety of our employees, the public and the environment,” said Bheki Nxumalo, Eskom’s Group Executive for Generation

Eskom also announced that all critical safety tests have been passed, including the legally required 10-year Integrated Leak Rate Test This test involved pressurising the reactor building over 72 hours to ensure it remains structurally sound and airtight a key safety
requirement Despite the extended timeline, Eskom says this will not increase the risk of loadshedding The national electricity grid is currently stable, and Koeberg Unit 2 remains fully operational, delivering close to 950MW with an Energy Availability Factor (EAF) of over 99%
“The planned return of 2 500MW this winter is not dependent on Unit 1,” Eskom said “Our latest Winter Outlook remains valid, and loadshedding will not be necessary if unplanned outages stay below 13 000MW ” Once maintenance is completed, Unit 1 will be refuelled, tested, and reconnected to the grid Eskom stressed that Koeberg’s two units are never taken offline at the same time, ensuring that the power station continues to contribute significantly to the country’s electricity needs

After undertaking a pilgrimage covering a distance of over 270km the chief executive of the Tygerberg Hospital Children's Trust is back home
This week she shared some of her experience of the walk across Portugal and Spain with TygerBurger
Louise Theron, chief executive, said the walk was done to raise funds for the hospital and the children that the facility cares for Theron was accompanied by Leone Malan, a lifelong friend The duo walked from Porto in Portugal to Santiago de Compostela in Spain over 14 days Their mission - to raise critical funds for life-saving paediatric equipment for the children of Tygerberg Hospital, one of South Africa’s busiest public hospitals, she said
In May this year the newspaper also reported on the two before they embarked on their journey Theron and Malan left South Africa for Europe on 19 May They started the Camino on 22 May and arrived in Santiago de Compostela on 5 June The two friends arrived back in South Africa on 12 June

With each step, they carried not only their backpacks but also the hopes of countless children and families who rely on Tygerberg Hospital for care and healing
The pilgrimage, historically walked for spiritual reflection, became a symbol of a very real and urgent modern-day causesupporting the lives of vulnerable children in need of specialised medical care, said Theron

Road markings raise safety concerns
In the article “Road markings missing” of 16 July, one is not sure what the City means by “capacity constraints”, but whatever it means, it reflects on service delivery As missing road markings creates a safety risk, it can be seen as an essential service which the City must deliver and of course, also maintain We are however of the opinion that there is also a problem with the service providers who delivers an inferior service If they add too much water with the paint it does not last long enough and there are no consequences and responsibility, they are paid as if it was a job well done
In the article “Safety audit suggested on dangerous road” also of 16 July we totally agree with Cllr Bresler “due to a shortage of manpower there is a general lack of visible traffic police on neighbourhood roads” However we are of the opinion it is more a lack of effective policing!
Maybe it is time for a Local Dialogue on these issues as well as others, and it does not have to cost R700 million NORTHERN DISTRICT COMMUNITY FORUM
Potholes a growing risk

Since the upgrade work on Jake's Gerwel Drive, which has stalled, these two roads are taking a beating
Concentrate on monitoring the state of the wear and tear on the roads, before the now visible potholes cause unnecessary incidents
