In approaching the court, the organisation is encouraging other concerned parties to join the case as friends of the court

Sapoa has requested an early court date to ensure clarity before the City begins preparing its 2026-’27 budget on 1 September The case is backed by some of its most influential members that own various properties within Cape Town that include, among others, Tyger Valley, CapeGate and Canal Walk shopping centres, as well as Table Bay Mall and V&A Waterfront In its supporting affidavit, the non-profit contends its members’ property rights are being infringed upon under Section 25 of the Constitution The organisation is bringing the challenge on behalf of its members, as well as in the public interest

The first draft budget was published for comment on 27 March, introducing the three fixed charges, which caused a public outcry Sapoa objected on several grounds, along with a protesting petition of more than 10 000 signatures that was submitted to the City No fewer than 14 000 comments were made during the public participation period Virtually all commentators strongly objected to the first draft budget, mostly against the fixed charges

Changes were made to the first draft budget in May by the City, resulting in the publication for comment on the revised draft budget In the revised draft budget that was passed on 26 June, the City stated that it sought to alleviate the impact on lower and middle-income households by the introduction of rebates

However, Sapoa holds that these reductions and rebates do not detract from the fact that the fixed charges are unlawful and should not have been introduced in the first place

Sapoa says a continued rise in municipal costs has a significant detrimental effect on the costs of occupancy faced by tenants in commercial retail properties

If municipal costs push charges past a certain limit, tenants struggle and landlords must help, but their options are limited Leases can become unaffordable, leading tenants not to renew According to its Operating Costs Report, by June last year, electricity made up 29% of total operating costs, while municipal charges accounted for a staggering 60%

According to Sapoa, the tariffs linked to property values do not comply with the Property Rates Act

It points out that the three tariffs are not based on consumption It is not a surcharge based on a basic charge nor a municipal tax Sapoa considers the tariffs a form of property rates as they are linked to property value, but points out that they do not comply with the Property Rates Act

The cleaning levy will be funding general cleaning on council property, litter picking and providing other services like illegal dumping removal and informal settlements

“The question to be answered is whether it is legally permissible to levy tariffs against property owners for cleaning services based on the value of their properties, regardless of whether the property owner actually receives such services at the property or in the area of his property,” states Gopal

He points out that section 229(1) of the Constitution states that a municipality may impose rates on property and surcharges on fees for services provided by the municipality, and submits that the cleaning tariff has not been adopted as a property rate in terms of applicable rates legislation

Furthermore, Sapoa states it cannot be a surcharge on fees charged for services because a surcharge is an additional percentage “profit” on the consumption tariff and not a tariff linked to property value

WATERANDSANITATION

The organisation further holds that fixed water charges are also irrational, arbitrary and contrary to the rule of law as entrenched in the Constitution

The organisation also notes that, until now, the fixed water charge was based on the pipe-connection diameter, and the fixed sanitation charge was tied to water usage The new system breaks this link to actual consumption

Thus, they argue that property owners who invested in alternative water systems to reduce consumption after the Day Zero crisis are now being penalised These improvements raise property values, which under the new tariff system, results in higher water charges, a move Sapoa calls irrational

Whilst Sapoa regularly engages on property issues and seeks cooperation with municipalities, it says repeated attempts to address members’ concerns with the City of Cape Town were unsuccessful As a last resort before litigation, Sapoa requested a legal opinion justifying the link between tariffs and property value, but the City declined

‘SAPOAPROTECTSPROFITSOVERPEOPLE’ In response to Sapoa’s High Court Application, Cape Town Mayor Geordin Hill-Lewis says Sapoa’s attempt to stop Cape Town’s pro-poor budget is to protect their own vested interests, and puts their profits ahead of the people of Cape Town

“Sapoa represents the country’s wealthiest and largest property ownersmainly shopping mall owners - who have benefited significantly over the years from Cape Town’s functionality and success However, they now argue that the City should charge the biggest property owners the same as individual low-income families,” he stated

“The City simply cannot agree that wealthy property owners should be charged the same as lower-income or middle-class households This would be regressive, would place ”

He holds that the City’s budget protects homes under R2,5 million and extends rates relief to many more middle-class homes, all whilst preserving the City’s critical infrastructure and service investments

“In contrast, this court application by the richest of the rich property portfolio holders seeks to go back to a system of regressive taxation which hits ordinary families, and the poor, the hardest,” said Hill-Lewis

The Mayor said that if Sapoa were to succeed in their argument, the effect would be “to have ordinary families effectively subsidising the wealthiest property owners”

The City scrapped the old “pipe levy” charge because it was unsustainable for R50 million and R500 000 homes to make equal contributions to Cape Town’s infrastructure and fixed service costs

“Fixed charges linked to property value is a lawful, more fair, and equitable way for Capetonians to contribute within their means to our city’s infrastructure programme and fixed service costs Cross-subsidising – where the better off among us help to fund services for the less fortunate – is the only sustainable way to ensure a working city of hope for all,” he said

The Mayor added that the City had engaged extensively with Sapoa, who had accepted the necessity of Cape Town’s R40 billion infrastructure budget over three years, a South African record, but that Sapoa had offered no workable alternative means of distributing fixed infrastructure and service costs among ratepayers

“The only alternative to fixed charges linked to property value, is for everyone to pay a flat charge regardless of whether you are low-income or affluent This is not a sustainable nor fair way to fund infrastructure investment and the fixed costs of service delivery If a flat charge of say R500 is billed, and one household earns R20 000 whilst the other earns R100 000 a month, this charge represents 2,5% and 0,5% of their monthly income respectively,” said Hill-Lewis

The Mayor further said that fixed charges are necessary because all ratepayers need to make a contribution to municipal infrastructure and not only those who can’t afford to invest in alternative water and electricity sources

“Cape Town would not have a working electricity or water service to speak of if the City only charged people for consumption Many costs are fixed in nature – pipelines, trucks, cables, staff to service it all These costs remain no matter how much people consume, and so fixed costs must be met with a portion of fixed revenue Infrastructure must be available for all and must always work To achieve this, costs must be borne by all ratepayers,” said Hill-Lewis

Gunmen open fire in B’fell

Police have launched an investigation into a case of attempted murder following a shooting incident in Old Paarl Road on Tuesday afternoon, which left a man wounded

The incident took place shortly before 13:30 near the intersection of William Dabs Road, police confirmed

According to Col Johannes Marthinus, station commander at Brackenfell Police Station, the victim was travelling with his wife in a blue Audi in the direction of Brackenfell when a white vehicle that had exited from the R300 highway stopped behind them

The gunmen got out of their vehicle and opened fire on the victim's car from behind Several shots were discharged before the gunmen fled the scene, heading back towards the R300

Despite being struck by at least one bullet in the back the driver managed to continue to a safer location down the road, where he called for assistance

Kobus Kotze of Titanium Securitas confirmed the victim sustained a gunshot wound to the back He was treated at the scene and transported to hospital in a stable condition

The final Environmental Impact Assessment (EIA) report and supporting documentation was submitted to the department of environmental affairs and development planning (DEA and DP) on 11 July, concluding the public participation period.

This came after the fourth and intended final round of public consultation regarding the proposed expansion of the Cape Winelands Airport was held in May Cape Winelands Airport, formerly known as Fisantekraal Airfield, was acquired in November 2020 by the applicant, who since established Cape Winelands Airport

The site is located approximately 10,5km northeast of Durbanville on the R312 and approximately 6km north of Joostenberg Vlakte on the R304

The current airport site is 155ha in size

The proposed project entails the expansion of the existing Cape Winelands Airport in a phased development approach, which will include the realignment of a primary runway with a length of 3,5km, according to an executive summary for the final EIA report

In celebration of Mandela Day 2025, 1 080 adults and children gathered at the Market Hall in GrandWest to give 67 minutes of their time toward a worthy cause packing meals for children in need

The event, organised by Rise Against Hunger (RAH) in partnership with GrandWest, brought together volunteers from corporate businesses including Nedbank, Standard Bank and Good Hope FM, as well as 42 learners and three educators from Elswood-, Bellville Southand Rocklands High Schools

From 09:00 to 13:00, the Market Hall buzzed with energy as 24 teams, each with 432 volunteers per session, worked in synchronised production lines, packing a staggering 240 624 meals

This food-packing drive is part of RAH’s national Mandela Month campaign, which aims to pack 2,5 million meals in July to support 225 Early Childhood Development

(ECD) centres across South Africa for a full year The meal packs contain rice, soya, soup mix and a sachet with 23 essential vitamins and minerals, designed to meet children’s daily nutritional needs

Volunteers were treated to creative dishes made by GrandWest Executive Chef Keshan Rambarun using these very ingredients

GrandWest General Manager Mervyn Naidoo expressed his gratitude to all who participated: “Every person who volunteers their two hands for just 67 minutes, once a year, helps us pack well over a quarter of a million meals ” Naidoo explained that GrandWest has hosted this initiative annually with RAH since its inception even attended by Graça Machel at the inaugural event “Volunteers not only help feed children in

UWC Prof warns measles is a preventable threat

A public health expert from the University of the Western Cape (UWC) has urged a scale-up of measles vaccinations following an outbreak in Gauteng

Prof Talitha Crowley, Academic Division Head at UWC's School of Nursing, said that vaccination coverage in Gauteng, reportedly under 75%, is well below the threshold to prevent outbreaks "To prevent any measles outbreak, we need less than 5% who are not vaccinated in a community, or effectively 95% vaccination coverage "

The National Sea Rescue Institute (NSRI) has unveiled a major expansion of its Emergency Operations Centre (EOC) at the Volunteer Support Centre in Cape Town nearly doubling the facility’s size and significantly enhancing its realtime response capabilities This critical upgrade boosts the NSRI’s capacity to coordinate rescue operations, monitor coastal activity, and respond rapidly to emergencies across the country

A key driver of the expansion is the rapid rollout of the NSRI’s Beach Safety Camera system, which includes a flagship site in Bloubergstrand Bloubergstrand was one of the original four camera locations along with Strand, Kleinmond, and Herold’s Bay that helped launch the initiative Since then, thanks to generous donor support, the network has grown to include Victoria Bay, Nature’s Valley, and three additional systems in Plettenberg Bay

Koeberg Unit 1 return delayed

Eskom has confirmed that Unit 1 of the Koeberg Nuclear Power Station, currently offline for long-term maintenance, will return to service later than expected

Originally scheduled to be back online this month (July), the unit is now set to return by the end of August

According to Eskom, the delay is due to additional maintenance needed on the new steam generators During routine inspections specifically a method called eddy current testing defects were found in four tubes out of thousands These defects were addressed immediately through an advanced automated repair process, carried out by international specialists and local teams

“Our top priority is always the safety of our employees, the public and the environment,” said Bheki Nxumalo, Eskom’s Group Executive for Generation

Eskom also announced that all critical safety tests have been passed, including the legally required 10-year Integrated Leak Rate Test This test involved pressurising the reactor building over 72 hours to ensure it remains structurally sound and airtight a key safety

requirement Despite the extended timeline, Eskom says this will not increase the risk of loadshedding The national electricity grid is currently stable, and Koeberg Unit 2 remains fully operational, delivering close to 950MW with an Energy Availability Factor (EAF) of over 99%

“The planned return of 2 500MW this winter is not dependent on Unit 1,” Eskom said “Our latest Winter Outlook remains valid, and loadshedding will not be necessary if unplanned outages stay below 13 000MW ” Once maintenance is completed, Unit 1 will be refuelled, tested, and reconnected to the grid Eskom stressed that Koeberg’s two units are never taken offline at the same time, ensuring that the power station continues to contribute significantly to the country’s electricity needs

Road markings raise safety concerns

In the article “Road markings missing” of 16 July, one is not sure what the City means by “capacity constraints”, but whatever it means, it reflects on service delivery As missing road markings creates a safety risk, it can be seen as an essential service which the City must deliver and of course, also maintain We are however of the opinion that there is also a problem with the service providers who delivers an inferior service If they add too much water with the paint it does not last long enough and there are no consequences and responsibility, they are paid as if it was a job well done

In the article “Safety audit suggested on dangerous road” also of 16 July we totally agree with Cllr Bresler “due to a shortage of manpower there is a general lack of visible traffic police on neighbourhood roads” However we are of the opinion it is more a lack of effective policing!

Potholes a growing risk

In response to "Calls grow to fix crumbling Goodwood roads" (TygerBurger 16 July) and "Goodwood roads crumble in rain" (2 July)

Since the upgrade work on Jake's Gerwel Drive, which has stalled, these two roads are taking a beating

Concentrate on monitoring the state of the wear and tear on the roads, before the now visible potholes cause unnecessary incidents

After undertaking a pilgrimage covering a distance of over 270km the chief executive of the Tygerberg Hospital Children's Trust is back home

This week she shared some of her experience of the walk across Portugal and Spain with TygerBurger

Louise Theron, chief executive, said the walk was done to raise funds for the hospital and the children that the facility cares for Theron was accompanied by Leone Malan, a lifelong friend The duo walked from Porto in Portugal to Santiago de Compostela in Spain over 14 days Their mission - to raise critical funds for life-saving paediatric equipment for the children of Tygerberg Hospital, one of South Africa’s busiest public hospitals, she said

In May this year the newspaper also reported on the two before they embarked on their journey Theron and Malan left South Africa for Europe on 19 May They started the Camino on 22 May and arrived in Santiago de Compostela on 5 June The two friends arrived back in South Africa on 12 June

HIGHLIGHTS

Among the highlights is Journey Through Song (25–26 July), a powerful musical theatre piece inspired by Ernestine Nur Stuurman Audiences can also engage with This Bra is a Psycho (28 July–2 August), a provocative play delving into trauma love and queer identity Marcé Underwood’s one-woman performance, I Want to Call You Daddy (6–9 August), explores single motherhood in post-apartheid South Africa, fusing poetry, storytelling, song, and movement A compelling discussion on 8 August with Marlow Valentine from Inclusive and Affirming Ministries (IAM) reflects on 30

years of queer faith activism.

The festival also includes a short film screening and panel discussion featuring Sister Dinges and Mr Isaacs, both addressing the intersections of identity, grief, and resilience Also on 8 August, the Woman Zone Women’s Day radio programme airs on Fine Music Radio (FMR 101.3FM), spotlighting women’s stories and achievements

On 9 August Women’s Day—the festival culminates in a full day of activity The programme includes keynote addresses by Le Roux and Justice Albie Sachs, interfaith blessings, a vibrant “Women Walking Artscape procession, health screenings, craft stalls, and a jazz concert honouring Bush Radio’s 30th anniversary

Other key events include Please Don’t Call Me Moffie (8–9 August), a powerful exploration of toxic masculinity and mental health; Voices in Unison choral performance (10 August); and Pass the Flame (15–16 August), a cross-generational music collaboration featuring legends like Thembi Mtshali-Jones and emerging talents such as KUJENGA. Later in the month, the Woman Zone Book Launch (16 August) celebrates 10 years of The Women’s Library, with the launch of Together Apart: The Story of Life in Apartheid and a panel discussion with literary activist Xolisa Guzula and artist Sue Williamson. The month closes with a poignant Story Café on 23 August, focused on Sara Baartman and cultural body image
