LETTER FROM THE PRESIDENT

HALFWAY THROUGH 2021! We have officially reached the halfway point of 2021! And the possibilities that are coming up are endless! Our membership numbers are rising, our participation at events is up and many of our members are building stronger relationships than ever as we all bond over the last year we have had. When I sit down to write these articles I try to reflect on how the last month has shaped our organization. Currently I am completely overjoyed with the direction we are heading. We have had 2 members mixers so far and both of them have been very well attended! At the last one at the Rush Inn, we had over 10 potential new members and we gave out so many potential member packets. Our membership chairs Matt Herb and Jon Sherer have made it a point to talk to all of these potential members and we should see another uptick in new members here within the next month! I could not be more proud of the work that these two are putting in! From coming up with a unique and amazing theme, to making sure they attend all of the events, to greeting the new and potential members, it just makes my heart so happy! Attending the OHBA state board meeting solidified that feeling as well. Where many other associations across the state are struggling, we are among the top in recruiting and retaining our members! I’d like to think it is because we are constantly trying to come up with new and exciting ways to support you within the NCBIA.

On Saturday, May 29, 2021, Joe, 74, was surrounded by his family as he gave up his position as 'King of the Mat' to his 12 year battle with kidney cancer. Joe was born in Cleveland on September 8, 1946 to John and Edith (Ethel) Scaletta (nee Curphey). He grew up in Cleveland and graduated from John Adams High School in 1965. In 1973, he met the love of his life, Leslie (nee Saladonis) Scaletta at a wrestling tournament. He knew immediately he 'got himself a good one' and nine months later they were married. They have celebrated 47 years of marriage. Together they had four amazing children, Jonelle (Tom) Sear of Avon, Amanda (Matt) Barnes of Galena, Ohio, Michael (Melissa) Scaletta of Avon and Giovanna (Myles) Bremke of Henrietta Township; he is also survived by his sister, Gayle Spadaro of Avon. Joe is survived by 10 grandsons and one granddaughter, Tommy, Ethan and Elliott Sear, Nathan, Charlie, Frankie and Matthew Barnes, Joey and Luciana Scaletta, John and Daniel Bremke; his grandchildren called him 'Pa' and loved spending time with him and learned their love of fishing and wrestling from him.

Throughout his life, Joe had many hobbies including fishing, water fowl hunting, traveling and gardening. He passed many of these passions to his children and grandchildren. Joe and Leslie spent much of their married life in Avon. The last 10 years they resided six months a year on Kelleys Island and six months of year on Don Pedro Island, Florida.

One of his proudest achievements was graduating from Ohio University with a Bachelors and Masters in Education. While a member of the Ohio University wrestling team, he became a student of the sport and developed lifelong friends. Joe's passion for wrestling continued after college as he began teaching and coaching. He coached at Columbia High School and Bay Village High School. His Bay Village Team won a state title in 1972 and state runner up in 1976. In 2010, Joe was inducted into the Bay Village High School Athletic Hall of Fame and in 2019 was inducted in the National Wrestling Hall of Fame as an Outstanding Citizen. In 1979, Joe decided to leave coaching and teaching to join his friend and mentor, Howard Ferguson, in real estate. In 1991, Joe formed his own company, Scaletta Development Corporation (SDC). His developments and home building were awarded over 150 awards from various associations. Joe served on many boards including the Avon Board of Education, Leadership of Lorain County, North Coast Building Industry Association and Ohio Home Builders Association. Joe was a long-time member of the North Coast BIA and was inducted into their hall of fame in 2010. In 2015, Joe and Leslie founded the Ohio Chapter of Reel Recovery and have since raised $100,000 for the organization. Reel Recovery is a national nonprofit that conducts 3-day fishing retreats for men who have cancer at no cost to the participants. Joe and his family would like to thank Dr. Brian Rini, former Cleveland Clinic Oncologist and 'Dr.' Laura Wood RN, MSN, OCN of the Cleveland Clinic for their outstanding care which extended his life beyond expectations. If you are invited, you will be provided with an agenda and details for your initial 20 Club meeting. In addition, you will gain access to the Invited Member Section on the website where you can see FAQs about the 20 Club program, Introduction to Financials (one of the biggest member benefits) and other materials to help you prepare for your first meeting. HOW TO HELP PROSPECTIVE Buyers Visualize Energy Cost Savings

P

roviding prospective buyers with tangible information on anticipated utility cost savings can be a differentiator for your business and create a lasting impression as they look at other potential homes to purchase. Saving money on utility bills is a driver for many prospective home buyers. According to NAHB’s What Home Buyers Really Want, 2021 Edition, home buyers are willing to pay an average of $9,292 up front to save $1,000 a year in utility cost (which is equivalent to a 9.29-year simple payback), up from $8,728 (8.73-year simple payback) in 2019. The median amount is $5,000 (five-year payback), which has remained stable since 2003. During the May Home Performance Counts: Virtual Green Home Tour, Paul Parkinson, director of sales at Lennar, explained: “People don’t know what they don’t know. Having a visual for someone to stop at, whether it’s a virtual tour or live tour starts the conversation: ‘What is this, and what does it mean?’ Then we can talk about HERS scores and the products we use in order to make the homes more energy efficient. We go, ‘Do you like to save $2,500?’ And people generally nod their heads, yes. Then we can say ‘That’s what you are going to save if you buy this home.'” “That’s enough of the conversation,” he noted. “You don’t want to get too deep into the details because not everyone is going to understand what you are saying, but keeping it simple is effective.” “The HERS index is a great visual because it shows customers that there really is a way to measure the performance of a home, as energy costs are one of the most expensive costs to operate a home,” added Annette Bubak, REALTOR® GREEN of Sunnova Energy. “The visual is also great because it makes us stop and think. It’s a memory point. The home buyer goes to another community — maybe they don’t have these types of visuals there, but now they start asking questions. It can be a differentiating point between builders in a community.”

POST-WINTER STORM UPTICK for Sawmill Output in March

T

he historic climb for lumber prices, combined with delays and higher costs for other building materials, is a significant limiting factor for home building in 2021. Despite a historically diminished level of overall housing inventory and solid demand due to low mortgage interest rates and demographics, new construction has been limited in its ability to add needed supply to the market, resulting in unsustainable gains for home prices. Fortunately, real-time data indicate that lumber prices are now falling with an expectation that prices will decline below $1000 per thousand board feet in the coming weeks. The following data track estimates concerning the sawmill industry (NAICS 3211). The data indicate that domestic production did not kept pace with the gains for home construction during an extraordinary 2020. A cited reason for the lack of lumber production in the U.S. has been challenges with labor, a limiting factor for the overall economy in both the manufacturing and construction sectors. Bureau of Labor Statistics data indicate that, indeed, sawmill industry employment is lower than a year ago. As of March 2021, the most recent data available, sawmill employment was 88,900. This is an 0.8% decline from March 2020, or a net loss of 700 jobs. In contrast, residential construction employment was up 2.8% or 82,000 net jobs over the same period. Despite the decline in workers, sawmill output was flat over the course of 2020, albeit along a choppy trend. Revised data from the Federal Reserve demonstrate that the seasonally adjusted rate of sawmill output in March 2021 (the most recent available) was 4% higher than that recorded in March 2020, when the spring decline for production began last year. March 2021 saw a 4.4% gain over February 2021, due in part to a post-Winter Storm Uri rebound. Looking back, total 2020 sawmill output was up just 0.1% higher compared to 2019. This was due to an upswing in production in November and December, which followed a decline in the third quarter. It worth noting that on a seasonally adjusted basis, the high point for U.S. sawmill output was May 2018. Output is down 8% since that time despite substantial price gains. The 2020 output levels were insufficient to keep up with the demand from residential construction. The preceding graph presents singlefamily starts and sawmill output indexed so that 2012 housing starts / 2017 sawmill output levels equal 100. The growing gap between the two measures, particularly in 2020 when single-family starts expanded by 12%, is a reason for the dramatic increase in lumber prices. This impact on price can be seen above by adding an indexed measure of the BLS Producer Price Index for softwood lumber. These data indicate that the rise in price was due, in part, to the inability of lumber production to keep pace with residential construction expansion. This gap, and the material cost impact, can only be closed via a significant increase in domestic production, more U.S. imports of lumber, or a significant substitution to other building materials. Fortunately, lumber prices are now expected to decline in the weeks ahead, as indicated by recent activity in future markets.

Construction Loan Volume Moves Higher BY: ROBERT DIETZ

E

nding a period of volume decline that began at the end of 2019, the volume of residential construction lending posted an increase during the first quarter of 2021. Nonetheless, overall residential construction loan volume ended the year lower due to accelerated sales growth, which reduced outstand loans at a faster rate. The volume of 1-4 unit residential construction loans made by FDICinsured institutions increased by 1.1% during the first quarter, as new homes sales accelerated. The volume of loans increased by $0.8 billion at the start of the year. This loan volume expansion placed the total stock of home building construction loans at $78.2 billion. On a year-over-year basis, the stock of residential construction loans is down 4%, with quarterly loan declines in two of the last three quarters. Since the first quarter of 2013, the stock of outstanding home building construction loans has grown by 92%, an increase of almost $37.5 billion. It is worth noting the FDIC data represent only the stock of loans, not changes in the underlying flows, so it is an imperfect data source. Lending remains much reduced from years past. The current amount of existing residential AD&C loans now stands 62% lower than the peak level of residential construction lending of $204 billion reached during the first quarter of 2008. Alternative sources of financing, including equity partners, have supplemented this capital market in recent years. The FDIC data reveal that the total decline from peak lending for home building construction loans continues to exceed that of other AD&C loans (nonresidential, land development, and multifamily). Such forms of AD&C lending are off a smaller 29% from peak lending. For the first quarter, these loans posted a 0.5% increase, a possible indication of increased land development activity.

SUPPLY-SIDE CHALLENGES in Focus BY ROBERT DIETZ

T

he economy, aided by a historic amount of deficit-financed stimulus, is booming. While GDP growth is expected to post the best year since at least 1984, the commonly cited challenges to maintaining momentum — and warding off persistent inflation — are coming into focus. Builders have faced these supply-side challenges for years, and that experience indicates relief will be partial and slow. For home builders and remodelers, the top industry challenge is attaining affordable and reliable sources of building materials. In fact, a recent NAHB survey revealed a record number of builders are reporting material shortages: 94% citing a scarcity of lumber and 95% reporting delays for appliances. These numbers are unprecedented over the last two decades. The economic factors behind the lumber shortage are clear: while U.S. sawmill output posted a small 3% gain in 2020, single-family construction increased 12%. Moreover, imports of Canadian lumber were lower in 2020 than they were in 2016 (at the onset of the current lumber dispute), despite a large gain in construction volume. Regulatory burdens remain an important cost factor as well. NAHB updated the regulatory analysis from 2016 and found in the 2021 survey that for the average new single-family home, there were almost $94,000 in various regulatory costs. This marked an 11% gain from 2016 and a 44% increase from a decade ago. And in just the past year, new-home prices have risen 20%. While housing demand remains strong, these higher costs will eventually cause the market to cool. The labor market offers both good and bad news for the residential construction industry. Overall employment continues to improve, helping housing demand. Although smaller than forecast (likely due to expanded unemployment insurance benefits), the economy created 559,000 jobs in May on a net basis and the unemployment rate fell to 5.8%. However, hiring in the construction sector is becoming more challenging. The number of open jobs in construction (357,000 in April) increased to an almost two-year high.

HOW A BILL Becomes a Law Not to give you the high school civics lesson, nor recite the famous cartoon rendition, “I’m just a bill on capitol hill”, but a view from beneath the surface. As having plied my trade in this profession for close to five decades, I see a lot below the surface, which often rises to the actual policy ruling the good citizens of Ohio. At the outset, I will declare many, many good and well-meaning officeholders have been true to their duty and tried their best to serve admirably. Not a news source in Ohio failed to headline the expulsion of former speaker, Rep Larry Householder: the first since before the Civil War, a most rare occurrence. Just about all the other 98 House members found this to be a troubling and emotional ordeal. However, the facts which led to the dismissal are most rare, as well. The stage was set with an 80 plus page indictment from the federal government and sworn statements by FBI agents. The charges were principally RICO conspiracy allegations surrounding a 60-million-dollar bribery scheme to pass a bill. According to the FBI, this is the largest of its kind in Ohio history. While the trial is not expected for some time yet, (the indictment was issued a year ago) the House had removed the Speaker from his leadership post, though he remained a member after being reelected last November. Despite his reelection, Householder was urged to resign, but refused to do so. Upon a petition to expel him, the House voted him out. Here, where it gets interesting. The Ohio Constitution provides for expulsion of a member for certain conduct somewhat defined in the Ohio Revised Code, as using physical force against another member. While a felony conviction is, being charged with a crime is not so listed. Nonetheless, members from both parties made pleas for expulsion despite no clear violation, as described in the constitution, occurred. This led to a spirited debate around if the members could stretch the definition of disorderly conduct in the Constitution to include the alleged “conduct” of Rep Householder: overseeing the conspiracy as described in the indictment. As we all know, the majority prevailed and Rep Householder was expelled by the House of Representatives. The lesson here is how and when can a term be used to fit a particular set of allegations? The answer simply being, when a majority thinks so. While this is an extreme set of circumstances, it pretty much frames what you need to support a particular issue or grievance. We take no side in this debate, nor criticize how legislators voted on the issue. However, this adequately describes how powerful the legislature can be as it exercises its authority. Premium installment & true-up reporting for private employers Employers must pay premiums timely to the Ohio Bureau of Workers’ Compensation (BWC) to receive and maintain workers' compensation coverage. Through the year, employers have been making premium installment payments based on estimated payroll. As we near the conclusion of the 2020 policy year (July 1, 2020 through June 30, 2021), BWC will be requiring all employers to reconcile (“true-up”) the payroll that was used to estimate their premium with their actual payroll for the policy year. BWC will also be sending information regarding premium installments for the upcoming 2021 policy year (July 1, 2021 through June 30, 2022).

If you expect your payroll to change during the 2021 rating year from the estimate provided, you can call BWC at 800-644-6292 and request a change to your payroll and installment schedule.

Failure to make installment payments based on the installment schedule can result in lapses in coverage, therefore make sure installment payments are paid by the due dates as noted on the installment schedule. The first installment payment will be due by mid/late June 2021.

If you pay your full 2021 premium by the June installment due date, you can earn a 2% Early Payment Discount. There is no need to switch to an annual installment, but the premium must be paid in full by the due date. BWC will issue the 2% refund the following month.

OSHA launches program to protect high-risk workers from coronavirus In response to President Biden’s executive order on protecting worker health and safety, the U.S. Department of Labor’s Occupational Safety & Health Administration (OSHA) has launched a National Emphasis Program (NEP) focusing enforcement efforts on companies that put the largest numbers of employees at serious risk of contracting the coronavirus. The program also prioritizes employers that retaliate against workers for complaints about unsafe or unhealthy conditions, or for exercising other rights protected by federal law. NEP inspections will enhance the agency’s previous coronavirus enforcement efforts, and will include some followup inspections of worksites inspected in 2020. The program’s focused strategy ensures abatement and includes monitoring the effectiveness of OSHA’s enforcement and guidance efforts. The program will remain in effect for up to one year from its issuance date, though OSHA has the flexibility to amend or cancel the program as the pandemic subsides. For programmed inspections, the NEP will target high risk industries for COVID-19. The primary targets for COVID19 inspections remain in the healthcare and personal care industries, including physicians’ and dental offices, home healthcare, ambulance services, hospitals, including psychiatric and substance abuse hospitals, nursing care facilities, residential intellectual and developmental disability facilities, and retirement and assisted living communities. For un-programmed inspections, which include inspections initiated based on complaints, referrals from media reports, reports from other agencies like local health departments or the Centers for Medicare & Medicaid Services, and severe incident reports such as in-patient hospitalizations and fatalities, OSHA will be prioritizing these cases for on-site inspections, especially allegations of potential worker exposures to COVID-19. This is in stark contrast to how OSHA handled the thousands of complaints received in the last year, most of which it treated through an informal process of allowing employers to self-investigate allegations related to COVID-19 and report back to OSHA their findings and detail the measures they had in place to protect employees. Most inquiries of this nature resulted in closure of the cases without a formal inspection from OSHA. Fatalities cases also will be prioritized. New to OSHA’s target list for this NEP are certain non-healthcare industries such as meat processing, poultry processing, supermarkets and other grocery stores, discount department stores, general warehousing and storage, temporary agencies, restaurants, and prisons and correctional facilities. OSHA also has identified a secondary list of non-healthcare essential critical infrastructure industries such as food and agriculture and manufacturing of food, beverage, wood, paper products, chemicals, energy sector manufacturing, plastic and rubber, mineral products, and metal manufacturing. JUNE 14, 2021 REPORT #7 BUDGET DISCUSSIONS CONTINUE OVER THE WEEKEND; AFFORDABLE HOUSING AMENDMENT ONE OF MANY ITEMS As HB 110, the Biennial Budget heads to conference committee, there are numerous items to be reconciled between the House and Senate versions. Discussions were ongoing over the weekend to try to work through some of these differences. The conference committee is scheduled to meet this week. One amendment added by the Senate, at the request of the current Senate President, proposes changes to O.R.C. 5715.01 and 5713.03 dealing with the valuation of subsidized residential rental property. The amendment would require county auditors to value Low Income Housing Tax Credit (LIHTC) properties and other properties receiving federal subsidies to be valued as market rate properties without regard to governmental use restrictions. OHBA has been closely following the issue, and has conversations with all the parties involved, including President Huffman. Feel free to contact OHBA with any questions.

LICENSING AND CERTIFICATION BILLS ON THE MOVE HB 107 Elevator Law (Baldridge, B.) To revise the Elevator Law. The House Commerce and Labor committee heard concerns from elevator contractors from around the state who OHBA has been working with on HB 107. While the proponents are using public safety to justify a one size fits all licensing bill, both Mike Simko, Access Solutions, Inc., and David Fesman, Med Mart, testified sharing concerns about the overreach and scope of HB 107. While residential elevators have been exempted already from the contractor licensing, OHBA has suggested changes to address the accessibility equipment also making up the business of the contractors who do the residential work. While the bill is not scheduled for another hearing this week, OHBA is scheduled to meet with the sponsor to reiterate concerns heard from those in the residential elevator industry. OHBA continues to watch HB 107 and work on language to further clarify the scope of the licensing legislation.

EXPANSION OF LICENSING TO RESIDENTIAL PLUMBING, HVAC, ELECTRICAL CONTRACTORS SB 142 Occupational Regulation (Schaffer. T.) To license residential only construction contractors and to make changes to the law regulating specialty construction contractors. OHBA continues to have discussions with the bill’s sponsor, and has submitted proposed changes to SB 142 to further clarify the ability to use subcontractors, and maintain the scope of the bill as it applies to specialty contractors.

RESIDENTIAL ROOFING REGISTRATION LEGISLATION SB 64 Roofing Contractors (Hottinger, J., Lang, G.) To regulate and require the registration of roofing contractors. The Senate Government Oversight & Reform Committee accepted a substitute version last week before hearing testimony from the insurance industry. Among the changes is language to clarify that new home construction is not covered. OHBA has been working closely with the sponsors and proponents, the insurance industry, on a bill that makes the most sense in that it is primarily tied to regulating roofing contractors as their work is tied to insurance payments. SB 64 includes various provisions already in the Consumer Sales Practices Act (CSPA), as well as page 38

protections such as, provisions that allow consumers to cancel the contract three days after finding out that their insurer has denied their claim, in whole or in part. SB 64 clearly allows for subcontracting, and would not apply to new home construction.
