THE BIA IS BACK in Action! The world is starting to open back up and so are we here at the NCBIA! Last week at our first Member Mixer of 2021, our members turned out in droves! It was absolutely amazing to have so many new and veteran members together just laughing the night away! In my opinion these Member Mixer are exactly what being a member of the association is all about. It is a fantastic opportunity for us all to get together in a relaxed atmosphere and get to know each other. I truly feel that more business gets passed at an event like this than in any other forum. We not only had a lot of new members in attendance, but we had quite a few potential members there as well! We plan on having 2 to 3 more of the member mixers over the next few months so I highly encourage you to grab a friend that you think would be a great fit to the NCBIA and come on out!

I am sure that you have seen the numerous emails and flyers that have come out about it. This is going to be a night to remember that is for sure! If you have not turned in your registration, you need to do it TODAY!! Not only will we honor our outgoing president Jeremy Vorndran but we will install our 2021 Board Of Directors! We will induct Jeff Hensley and Jeremy Vorndran into our esteemed Hall of Fame and we will give away our Circle Of Excellence Awards to our much deserving members! I am very excited to see the turnout that we currently have signed up so you really do not want to miss this event! We have members coming from all over including our OHBA Executive Vice President Vince Squillace and some other special guests from OHBA! Words cannot even begin to express how excited I am to be able to celebrate with all of you. We are heading into month 5 of 2021 and we already have some big things that we are moving full speed ahead with! Our workforce development committee is getting ready to launch our Mentorship Program with the Lorain County JVS trade programs. Those programs include Carpentry, Masonry, Electrical & HVAC. It has been awe inspiring to watch this committee come up with these ideas and get this program off the ground! They are made up of some of the best and brightest individuals in the association and I know that they are going to kill it! Keep watching your eNews as well as the next edition of this Newsletter to see how you can get involved with this great initiative! I look forward to seeing what the rest of 2021 has in store for this great association

NAHB’s Economics Data Helps Members Succeed The NAHB/Wells Fargo Housing Market Index, a monthly survey of NAHB members that takes the pulse of the single-family housing market, is an industry benchmark. NAHB also provides forecasts analysis of housing starts and new home sales, and special studies on specific aspects of the housing market. Housing Economics, a paid subscription publication, provides even more in-depth information. Eye on Housing, the group’s blog, is a great way to stay on top of what’s happening in the housing market. Economic Impact Analysis of New Construction By the end of 2020, America’s home builders will need to construct 4 million new single-family homes and 1.5 million multifamily homes to meet demand due to population growth and to replace older homes removed from the inventory. To help members and associations make the case for this necessary growth and fight impact fees and other anti-growth measures, NAHB has developed proprietary models that estimate the costs and benefits of new home construction in a typical local area. The analysis is available in two free reports. One examines the Income, Jobs and Taxes Generated by new construction. The other compares costs to revenue for local governments. Together, the two reports show how quickly housing typically pays for itself. Customized Analysis for a Small Fee On a fee basis, NAHB can also provide customized reports on the local impact of home building related to specific projects or the impact of construction within a specific local area.

Legal Support • • • • • • •

NAHB provides numerous legal resources for members and for state and local association staff. While the NAHB staff counsel cannot replace your local attorney, we may be able to help with legal research, litigation funding, and/or litigation strategy, depending on the situation and the issues involved. The Office of Legal Affairs (OLA) manages and supervises all legal programs for NAHB and works on a diverse array of legal matters to advance NAHB’s overall mission including litigation, regulatory and advocacy matters. The OLA’s caseload includes cases in the U.S. Supreme Court, the U.S. Courts of Appeals, and state appellate courts. The OLA also administers the Legal Action Fund, a service designed to assist state and local associations and their members with ongoing cases, legal education seminars on building industry-related issues to all members and affiliated HBAs, and a host of other industry-related programs. The OLA works with NAHB committees to advance the industry’s interests relating to the risks associated with the construction of new homes and remodeling and to help the members identify, manage, and minimize such risk. Land Development and Growth To help facilitate new construction, NAHB provides numerous resources to help members and HBAs advocate for more practical growth and development, to find innovative solutions for funding essential infrastructure, and to demonstrate how home construction benefits the economy. • • •

Land Use 101 is a one-stop toolkit that assembles the best available resources from NAHB to address virtually every issue relating to growth, land use and development including impact fees and housing affordability. Among the resources it provides are NAHB briefing papers, presentations, talking points, and credentialed reports that members and staff can use to address issues in their markets. A similar resource, Housing for All, presents case studies of innovative solutions that communities nationwide have employed to help make homes more affordable and to enable more families to achieve homeownership or have access to suitable rental housing.

Ordinance Reviews • • •

As a free service, NAHB’s Legal and Land Use staff assist members and HBAs by reviewing state and local ordinances and regulations relating to development and construction, including local zoning ordinances, comprehensive plans, subdivision regulations, complete streets ordinances, impact fee ordinances and state legislation. The Legal staff examines and analyzes ordinances based on constitutional, statutory, and case law considerations. Generally, ordinances are reviewed for statutory compliance, procedural and substantive due process considerations, Fifth Amendment takings issues and other legal deficiencies. NAHB’s Land Use staff also provides rigorous critical review and comments on the land use policy and implementation aspects of proposed and revised ordinances. Staff members also provide onsite assistance and expert witness testimony as needed.

Building America’s Home Construction Work Force NAHB’s nonprofit partner, HBI is a national leader for career training in the building industry. It provides students the skills and experience they need for successful careers through pre-apprenticeship training, job placement services, mentoring, certification programs, textbooks,

and curricula. With an 80 percent job placement rate for graduates, HBI training programs are taught in local communities across the country to youth, veterans, displaced workers, and other underserved populations. AHB Chairman Chuck Fowke and First Vice Chairman Jerry Konter recently conducted virtual and in-person meetings with congressional leaders to urge them to keep housing in the forefront of the national agenda. The NAHB Senior Officers reiterated the importance of housing and homeownership to the economy and urged lawmakers to take steps to ensure an adequate supply of lumber and other building materials to help stem rising housing costs. HOUSING STARTS Spring Forward in March

H

ousing production rebounded in March as buyer demand remains solid due to low mortgage interest rates. Overall housing starts increased 19.4% to a seasonally adjusted annual rate of 1.74 million units, according to a report from the U.S. Department of Housing and Urban Development and the U.S. Census Bureau. This was the fastest pace for combined single-family and multifamily construction since June 2006. The March reading of 1.74 million starts is the number of housing units builders would begin if development kept this pace for the next 12 months. Within this overall number, single-family starts increased 15.3% to a 1.24 million seasonally adjusted annual rate. When comparing the first quarter of 2021 to the first quarter of 2020, single-family starts are up 19.6%. The multifamily sector, which includes apartment buildings and condos, increased 30.8% to a 501,000 pace. “Builder confidence remains strong, pointing to gains for single-family construction in 2021,” said NAHB Chairman Chuck Fowke. “However, rising costs for most kinds of building materials continue to impede positive additional momentum in the market.” “Demand remains solid due to low mortgage interest rates and a thin level of inventory in the resale market, which is spurring the need for additional supply,” said NAHB Chief Economist Robert Dietz. “The test for the industry this year will be balancing growth and higher construction costs, given ongoing housing affordability challenges.” On a regional basis compared to the previous month, combined singlefamily and multifamily starts are 64% higher in the Northeast, 122.8% higher in the Midwest, 13.5% higher in the South and 13.6% lower in the West. The gain in the Midwest is likely weather-related. Overall permits increased 2.7% to a 1.77-million-unit annualized rate in March. Single-family permits increased 4.6% to a 1.2-million-unit rate. Multifamily permits decreased 1.2% to a 567,000 pace. Looking at regional permit data compared to the previous month, permits are 8% lower in the Northeast, 2% higher in the Midwest and 6.4% in the South. Permits held steady in the West.

HOW BUILDERS TRY TO DEAL with Rising Lumber Prices

s most industry observers know, softwood lumber prices have been extremely high and volatile over the past year. During an unprecedented four-month surge in 2020 prices nearly doubled, reaching an all-time high in September. Since then prices have continued to fluctuate, increasing recently to the point that they are now considerably higher than they were even at last September’s historic peak. In this environment it is not surprising that builders identified prices and availability of building materials as the top challenge they expected to face in 2021. That raises the question of what, if anything, builders are doing to try to cope with the challenge. NAHB investigated this recently by including a question on reactions to the rising and volatile lumber prices in its April 2021 survey for the NAHB/Wells Fargo Housing Market Index (HMI). In response, 47 percent of single-family builders in the HMI panel indicated that they were including price escalation clauses in their sales contracts. Although price escalation clauses are by far the most common response to rising lumber prices, in addition at least 10 percent of the builders reported pre-ordering lumber, obtaining lumber price guarantees from suppliers, pausing before starting to frame the structure, otherwise delaying building or sales, and including shared price clauses in sales contracts. Shared price clauses resemble price escalation clauses that tie the final house price to the price of building materials. The difference is that, in the typical shared price clause, the home builder agrees to absorb part of the material price increase, with the home buyer covering the rest. Among builders who have been successful in locking in lumber prices by obtaining price guarantees from suppliers, 42 percent reported that the prices were typically guaranteed for 15 to 29 days. Also fairly common (reported by 33 percent) were lumber prices guaranteed for 30 to 59 days. The median length of the price guarantee was 28 days.

Housing starts have been relatively strong lately (although the rising number of unused permits is a sign of some stress in the market). However, as NAHB’s housing affordability pyramid shows, the strength is due largely to demand at the high end of the income distribution, and a large number of households with more modest incomes have been priced out of the market for new homes. A post published last week showed how higher prices create affordability challenges for minority households in particular.

Neither guaranteeing prices for a month nor any of the other practices cited above completely compensates for the historic surge and volatility in lumber prices the industry has experienced recently. Price escalation clauses seem to offer some protection for builders, but don’t prevent them from losing sales to customers unable to afford the escalated house prices.

Increases as Economy Picks Up Speed BY ROBERT DIETZ

T

he rising costs of building materials are top of mind for most builders and other stakeholders throughout the industry. Lumber prices are up approximately 200% from a year ago, adding about $24,000 to the price of a new single-family home and $9,000 to a new apartment. And as buyer traffic remains strong, additional costs and delays for other building materials are further challenging the sector, including appraisals. On an aggregate basis, residential construction costs are up almost 10% over the last year — rising five times faster than the recent measures of inflation. However, as these supply-chain issues affect other parts of the economy, which progressively continues to reopen, the pace of economic growth will increase inflationary pressure. The Consumer Price Index, a broad inflation proxy, increased at a 2.6% rate over the last year. And more is coming in 2021. The economic policy question is whether an uptick in inflationary costs will be temporary or permanent. The Federal Reserve believes these forces will be temporary, and that as supply-chains unwind, inflationary forces will be dampened. This would be the favorable outcome for the building industry because it would mean the Fed could continue its “lower for longer” policy of accommodative strategy for monetary policy and interest rates. Doing so would help further heal the labor market, and provide additional support for multifamily and single-family housing demand.

T

he 10-year Treasury rate temporarily increased above 1.75% this week — reaching a 14-month high. This is well ahead of forecast and will push interest rates above 3.3% for the average 30-year fixed rate mortgage. According to recent estimates published by NAHB, the rate increase over the last few weeks prices out approximately 1.3 million households from being able to purchase an average home. Combined with unsustainable growth in home prices (up an average of more than 11% over the last year) and rising construction costs, it is clear that housing affordability is trending lower. Fortunately, buyer traffic remains strong, consumer confidence is at a post-recession high and prospective buyers have increasingly accumulated additional savings during 2020 due to lack of service sector purchases. Nonetheless, as economic growth expectations increase for 2021, higher rates and higher input costs should be expected over at least the next 12 months. Additionally, a proposed large tax/spend infrastructure plan is a wild card in the outlook given possible impacts on the federal deficit. Nonetheless, home sales started the year weaker, largely because of affordability and weather-related factors. New home sales declined 17% on a monthly basis in February, but remained 8% higher than a year ago. However, pricing is headed higher — up 5% over the last 12 months — as input costs (most notably lumber) experienced gains. The February dip pushed sales down from the unsustainable surge of the second half of 2020 and back to a somewhat slower post-Great Recession growth trend. Existing home sales fell to a six-month low as incredibly tight inventory conditions frustrated buyers. Despite rising rates and historically low inventory, geographic and market trends suggest growth for home construction. For remodeling, the aging of the existing housing stock offers significant business opportunities. The typical home in the U.S. is 39 years old, with older stock in the Midwest and Northeast. The second-home housing market continues to be hot, with 15% of recent new home sales attributed to secondhome buyers, according to an NAHB survey. And the suburban shift in housing preferences, with gains for the share of home buyers looking for homes in the outer suburbs, will tend to favor new construction. This will allow reductions in land costs to offset some of the gains in material pricing in lower-density markets or those with significant numbers of telecommuters.

BUILDER CONFIDENCE Edges Up as Strong Demand Offsets Supply-Side Challenges

S

trong buyer demand pushed builder confidence up in April even as builders continued to grapple with rising lumber prices and supply chain issues and consumers faced higher home prices due to a lack inventory. The latest NAHB/Wells Fargo Housing Market Index (HMI) released today shows that builder confidence in the market for newly built single-family homes rose one point to 83 in April. “Despite strong buyer traffic, builders continue to face challenges to add much needed housing supply to the market,” said NAHB Chairman Chuck Fowke. “The supply chain for residential construction is tight, particularly regarding the cost and availability of lumber, appliances, and other building materials. Though builders are seeking to keep home prices affordable in a market in need of more inventory, policymakers must find ways to increase the supply of building materials as the economy runs hot in 2021.” “While mortgage interest rates have trended higher since February and home prices continue to outstrip inflation, housing demand appears to be unwavering for now as buyer traffic reached its highest level since November,” said NAHB Chief Economist Robert Dietz. “NAHB’s forecast is for ongoing growth in single-family construction in 2021, albeit at a lower growth rate than realized in 2020.” Derived from a monthly survey that NAHB has been conducting for 35 years, the NAHB/Wells Fargo HMI gauges builder perceptions of current single-family home sales and sales expectations for the next six months as “good,” “fair” or “poor.” The survey also asks builders to rate traffic of prospective buyers as “high to very high,” “average” or “low to very low.” Scores for each component are then used to calculate a seasonally adjusted index where any number over 50 indicates that more builders view conditions as good than poor. The HMI index gauging current sales conditions increased one point to 88 and the gauge charting traffic of prospective buyers posted a threepoint gain to 75. The component measuring sales expectations in the next six months fell two points to 81. Looking at the three-month moving averages for regional HMI scores, the Northeast rose six points 86 and the South moved up one point to 83. OHBA Update It is starting to look like covid interruptions are on the downside. That is good for all to hear. While many lives were interrupted and some were impacted to a sorrowful end, maybe we are now on the mend. In the political world, just about everything is in motion. The federal government has a new political party in charge with a new President and Senate. Lumber problems continue as well as worker shortages. On a bright note, business is brisk and demand at all-time highs. News stories of apparent housing shortages underline the fact that difficulties in meeting housing demand due to excessive regulation is becoming clearer each day. Now will policy makers adjust, we’ll just have to wait and see. Stateside, the state legislature will soon wrap its budget work for the next two years. No new taxes are expected. On the regulatory front, licensure of trades continues. Residential licensing for roofers, plumbers, electricians and mechanical contractors are being considered. Licensing of commercial roofers and elevator contractors are also being considered.

On a positive note, we are hearing from high government officials with their concern about housing prices and availability. Many of these officials were not helpful in the past with our efforts but seem more likely to be helpful now. We need to hear from you regarding the housing situation in your community. APRIL 22, 2021 REPORT #4 HB 126 PROPERTY VALUES RECEIVING ATTENTION HB 126 Property Values (Merrin, D.) To require local governments that contest property values to formally pass an authorizing resolution for each contest and to notify property owners. Text/Analysis Referred in Senate (4/21/2021; Local Government & Elections) HB 126 has already passed the House, and is now awaiting hearings in the Senate local Government Committee. During his House sponsor testimony, Chairman Merrin, returning for the third time with the legislation, explained that current law allows local governments to contest the value of properties through the Board of Revision process with a general goal of generating more property tax revenue based on higher property valuations. "Only twelve other states provide similar authority to local governments. However, the practice has become so abusive in Ohio, the Council of State Taxation representing over 500 national corporations has publicly downgraded Ohio business climate due to this specific issue," he said. "Local governments filing complaints hire private-sector attorneys with public funds. The complaints put significant pressure on affected property owners. Homeowners have to decide whether to hire legal counsel or represent themselves through the BOR process," the sponsor said. "Many complaints are frivolous and designed to encourage property owners to settle rather than incur legal costs. As you can imagine, law firms hired to target property owners intimidate many Ohioans and create unnecessary divisiveness. It is important to note the vast majority of local governments do not engage in the controversial practice of filing BOR complaints." Rep. Merrin said the bill "ensures elected officials authorize BOR complaints." "This is accomplished by requiring legislative authorities to approve a resolution authorizing their legal counsel to file each BOR complaint, but allows resolutions to be group together for a single vote," he said. "To be clear, this bill does not prohibit local governments filing BOR complaints. It only requires a resolution be approved confirming the legislative body's intent to challenge the property value of a parcel." He said the requirement would "enhance transparency and accountability" in the process. "Furthermore, House Bill 126 requires legislative authorities with a resolution on their agenda authorizing a BOR complaint to provide advanced, written notice to the property owner. Currently, property owners are notified by the BOR after their local government files a complaint," he said. LEGISLATIVE UPDATE HB 123 Community Reinvestment Areas (Fraizer, M., Cross, J.) To modify the law governing community reinvestment areas and the terms under which property may be exempted in such areas. Text/Analysis Committee Hearing in House Ways & Means (4/20/2021; REPORTED) The house ways & means committee voted HB 123 out of committee this week 10-6. The bill aims to update the Community Reinvestment Area law enacted in 1994. According to the sponsors, post-1994 CRA's place burdensome additional reporting requirements, limitations, and page 38

unnecessary fees that if removed may vastly improve the opportunities for Residential, Industrial, and Commercial Investment that reside in a CRA zone; with corresponding benefits to County and Municipal entities offering the incentive. Creating opportunities for business, industries, and everyday people to benefit from improving their community and find gainful employment. This proposed legislation will remove much of this red tape, and turn CRAs into what they were always intended to be: a permissive economic tool for communities to enter into, and benefit from. This legislation is simply improving their usability and applicability. Rep. Fraizer said the bill is largely focused on "building consistency with Economic Development tools, aligning TIFs and CRA default tax incentive percentages to range from 75% to 100% based on school board approval - 80% of CRAs tracked by DSA - reducing penalty years for relocating from 5 years to 2 years for relocating in the State, and cleaning up language and process. OHBA would appreciate insight on whether CRA’s can be a useful tool for residential development. HB 175 Water Pollution (Hillyer, B.) To deregulate certain ephemeral water features under various water pollution control laws. Text/Analysis Committee Hearing in House Agriculture & Conservation (3/23/2021; CONTINUED) OHBA will offer support of HB 175 during its proponent hearing in the House Agriculture Committee on the 27th. OHBA has been following this issue since the WOTUS definition was changed to exclude certain ephemeral and erosional features. Additionally, in July, OHBA filed an ERAC appeal challenging the OEPA General Permit to regulate ephemeral streams, and is continuing to navigate the negotiations through the formal ERAC process. Currently, the Ohio EPA regulates ephemeral streams that only flow in the event of rain or snowfall through its General Permit issued last spring. Please contact OHBA with any questions on HB 175 or the ERAC appeal. HB 201 Natural Gas (Stephens, J.) To prevent local governments from limiting use of natural gas. Text/Analysis Committee Hearing in House Energy & Natural Resources (4/21/2021; CONTINUED-AMENDED (See separate story)) After testifying in support of HB 201, OHBA signed on to a industry letter reiterating its support for HB 201 send to the House Energy Committee yesterday. HB 201 would prohibit local ordinances limiting natural gas use and has drawn support from some industry and business groups, while opponents continue to blast the measure as a Home Rule violation. OHBA will continue to be supportive as the bill gets out of the House and moves along in the Senate process. Please feel free to contact OHBA with any questions or concerns. SB 64 Roofing Contractors (Hottinger, J., Lang, G.) To regulate and require the registration of roofing contractors. Text/Analysis Committee Hearing in Senate Government Oversight & Reform (3/24/2021; CONTINUED) OHBA continues to work with proponents of SB 64 on changes to exempt whole home construction from the registration requirements. Further changes are also expected further simplifying the registration process in a sub bill currently being drafted for adoption in the coming weeks.

2-Hour Safety Training Requirement for 2020 Policy Year Deadline is 6/30/2021 2020 Rating Year—BWC Rule—ORC 4123-17-68

Group Rated and Group Retro Rated employers who have had a claim from July 1, 2018 through September 30, 2019, have to complete a required two hours of safety training by June 30, 2021. BWC’s requirement applies to any allowed claim an employer had from 7/1/20189/30/2019, regardless of size or severity. Two hours is the minimum amount of safety training mandated by the BWC. Only one person from the employer needs to take this safety training. If an employer experienced more than one claim within this period, they are still only obligated page 40

to attend two hours of safety training. If an employer has multiple policy numbers, they must attend two hours of safety training per policy. Deadline Extended Again for HVAC Assistance Program: June 30, 2021 The Ohio BWC has again extended their deadline to apply for reimbursement for eligible expenses under their COVID-19 Indoor Air Quality Assistance Program to June 30, 2021. This federally funded program provides reimbursement for nursing homes, assisted living centers, and adult day centers that invest in air quality improvements that reduce the spread of COVID-19. This may include the costs of inspections, assessments, maintenance, and improvements to indoor heating, ventilation, and air conditioning (HVAC) systems. It also provides reimbursement for secondary devices designed to destroy bacteria, mold, and viruses. Read more, including eligibility requirements, on the BWC’s website.

Sample Written Safety Program Templates BWC’s Division of Safety and Hygiene (DSH) has created sample written safety program templates for employers to download and to customize to their operations. DSH utilized our safety experts from Loss Prevention Field Operations, including specialized consultants from the OSHA On-Site Consultation Program, and the Public Employment Risk Reduction Program to create an assortment of branded sample written program templates to share with employers. Each template is laid out identically and has a welcome page with information on how to use the template. DSH Assistant comments provide added guidance, best practices, or links to resources or reference standards. Additionally, each sample written program template offers supporting documents for training, checklists, definitions, and more. OSHA Launches Program to Protect High-Risk Workers from Coronavirus In response to President Biden’s executive order on protecting worker health and safety, the U.S. Department of Labor’s Occupational Safety & Health Administration (OSHA) has launched a National Emphasis Program (NEP) focusing enforcement efforts on companies that put the largest numbers of employees at serious risk of contracting the coronavirus. The program also prioritizes employers that retaliate against workers for complaints about unsafe or unhealthy conditions, or for exercising other rights protected by federal law. NEP inspections will enhance the agency’s previous coronavirus enforcement efforts, and will include some follow-up inspections of worksites inspected in 2020. The program’s focused strategy ensures abatement and includes monitoring the effectiveness of OSHA’s enforcement and guidance efforts. The program will remain in effect for up to one year from its issuance date, though OSHA has the flexibility to amend or cancel the program as the pandemic subsides. For programmed inspections, the NEP will target high risk industries for COVID-19. The primary targets for COVID-19 inspections remain in the healthcare and personal care industries, including physicians’ and dental offices, home healthcare, ambulance services, hospitals, including psychiatric and substance abuse hospitals, nursing care facilities, residential intellectual and developmental disability facilities, and retirement and assisted living communities. For un-programmed inspections, which include inspections initiated based on complaints, referrals from media reports, reports from other April 2021

agencies like local health departments or the Centers for Medicare & Medicaid Services, and severe incident reports such as in-patient hospitalizations and fatalities, OSHA will be prioritizing these cases for on-site inspections, especially allegations of potential worker exposures to COVID-19. This is in stark contrast to how OSHA handled the thousands of complaints received in the last year, most of which it treated through an informal process of allowing employers to self-investigate allegations related to COVID-19 and report back to OSHA their findings and detail the measures they had in place to protect employees. Most inquiries of this nature resulted in closure of the cases without a formal inspection from OSHA. Fatalities cases also will be prioritized. New to OSHA’s target list for this NEP are certain non-healthcare industries such as meat processing, poultry processing, supermarkets and other grocery stores, discount department stores, general warehousing and storage, temporary agencies, restaurants, and prisons and correctional facilities. OSHA also has identified a secondary list of non-healthcare essential critical infrastructure industries such as food and agriculture and manufacturing of food, beverage, wood, paper products, chemicals, energy sector manufacturing, plastic and rubber, mineral products, and metal manufacturing. Email Notices to Injured Workers Come from New BWC Address April 8 The Ohio BWC is transitioning to a different email delivery system called GovDelivery. Beginning April 8, injured workers who receive eNotices from BWC about claim payments will receive the messages from a new email address: OhioBWC@public.govdelivery.com. This new system has a different look and feel than what injured workers are used to. If the injured worker doesn’t receive email notices when they normally would, ask the injured worker to please check their spam folder. If the injured worker sees the email there, have them mark it as “not spam” to receive future messages correctly. In the months to come, the BWC will continue to increase their use of electronic communications. If you or the injured worker has questions, call the Ohio BWC at 1-800-644-6292.

By Mid-April: Industrial Commission to Begin Video Hearings Since the beginning of the COVID-19 pandemic, the Ohio Industrial Commission (IC) has been conducting administrative Hearings telephonically. There have been a number of connection problems by using this format, including random “dead spots” during some of the Hearings. The IC has announced that by mid-April, it will transition to a “web conferencing solution” offered by Webex to conduct Hearings. This virtual format, which is similar to Zoom, will allow the parties to participate by video, which will be very helpful to employers and their representatives. Participants who do not have a computer or internet access can continue to participate by telephone. Additional information regarding this new format can be found at ic.ohio.gov/webex/.

Identity Theft and Fraudulent Unemployment Claims The most prevalent pain point for employers over the last 3 or 4 months has shifted from the high volume of unemployment claims to managing a rash of fraudulently filed imposter unemployment claims. These are instances in which a bad actor has stolen someone’s identity and filed a claim for unemployment benefits. The Federal Trade Commission has reported a near 18-fold increase in fraudulent government documents from 2019 to 2020. This issue is currently impacting employers and their employees nationwide with the US Department of Labor inspector general’s office estimating that more than $63 billion has been paid out improperly through fraud or errors — roughly 10% of the total amount paid under coronavirus pandemic-related unemployment programs since March 2020. What are some indicators of possible fraudulent unemployment activities? Insure your employees are mindful of any documents from their state’s unemployment agency, especially in the event they have not recently filed a claim. These communications could include a “notice of password reset”, notice of “PIN” reset, receipt of bankcard, confirmation of direct deposit, request for information, or any other form or document from the unemployment agency.
