The Branch has authorized two members to take part in a weeklong NALC Advance Formal A Training outside Washington DC. Those selected are Che’ Perez of Fairfield and Shana Lum of San Ramon. The program will start early in 2023.

Congratulations to Joseph Manio, son of Richmond Hilltop carrier Jerry Manio who’s one of six winners of the NALC’s prestigious Doherty Scholarships. The award is for $4,000 for 4 years. The young scholar also has won the Branch 1111 Katherine Ellis Scholarship. He is set to attend UCLA.

Here is a thought. Stop playing tiddlywinks with your management tools (which are not new standards) and get back to the bargaining table to increase the wages and benefits for new hires. The mindless wonders should strongly consider incentivized MOUs for areas with high attrition rates.

Our Outpost is Greater East Bay Branch 1111. And those individuals who fight to defend it and protect your rights as a letter carrier are your Shop Stewards, Chief Stewards and Full Time Officers. Yes, we are the union. However, it is not just the ones that have been deputized to protect and enforce our contract. It is all of us banding and working together. As the late great Congressman John Robert Lewis once said, “If you see something, say something.” In other words, if one of us is being mistreated or our rights are being violated, report it to your Shop Steward. Better yet and if you are tired of the wolves howling at the moon and want to affect change, become a Deputy Shop Steward. For all unions to stay strong well into the future, we need new Deputies. Think about it.

Mindless Madness

The USPS abandon this program because they feared they might lose their authoritarianism, and they cared more about making arbitrary numbers. Are all the leaders of the Postal Service just mindless zombies who march to the beat of a hollow drum? Or are they just self serving tyrants whose only goals are to pad their own pockets through “Hocus Pocus?” So, if we have the greatest delivery service in the world and we are essential workers, why hasn’t the Postal Service done more to protect its own business and improve the quality of life of its workers? It doesn’t make any sense. On one hand the Postal Service keeps pushing to hire new letter carriers but doesn’t offer any incentives or higher starting pay. On the other hand, they don’t know how to act or treat the few new employees who dare join our ranks. It is mindless madness.

What is the Deems Desirable List? Is it a list of what individuals want? No, it is not a wish. Is it in the Contract? No, it is not. It is a sneaky manager or supervisor who clicks a button on a computer so when you call in, it automatically requests you to bring in medical certification. In short, it is a violation and an improper way to place an employee on Restricted Sick leave (RSL). What does the Contract say about the this Deems Desirable List or any such computer program?

Step 4 Decision M 01468 states in relevant part, “The RMD/eRMS is a computer program. It does not constitute a new rule, regulation, or policy, nor does it change or modify existing leave and attendance rules and regulations. When requested in accordance with Articles 17.3 and 31.3, relevant RMD/eRMS records will be provided to local shop stewards.” Step 4 M 01597 states in relevant part, “This is in further reference to our conversation regarding your December 1 correspondence concerning supervisory activation of the "Deems Desirable" option in eRMS and the Restricted Sick Leave List (RSL List) provisions of ELM Section 513.39 As noted in our June 20 response to a previous NALC inquiry that included this issue, a supervisor's determination that medical documentation or other acceptable evidence of incapacitation is desirable for the protection of the interest of the Postal Service must be made on a case by case basis, must be consistent with the provisions of ELM 513.361 and may not be arbitrary, capricious, or unreasonable.

So, if you are snake bitten by your supervisor, the remedy is to report it to your local Deputy, who will saddle up and bring the smack down. You should also provide your steward with a statement of facts and receipts of all costs incurred as a result of this violation. Remember that knowing your rights is only half of the battle. The other half is enforcing your rights.

Many carriers feel like the Post Offices they work in are a far cry from reality, like an abandoned Outpost in the wilderness. What happened to the Post Office of old where employees mattered? Back then, the USPS even had a program called, “Employee Involvement Quality Work Life (EI).”

The Deems Desirable List

On the far western shores of the Pacific Ocean lies an Outpost in the midst of the wilderness. It is occupied by brave men and women who protect it and enforce the laws of the land. These courageous souls fight off hungry bears, mean badgers, sneaky foxes, hooting owls and howling wolves. They live in the Wild Wild West where words of wisdom and badges of honor are no longer found, and there is no relief. Who are these individuals? Why do they protect the Outposts?

When you first start out though, it can be very difficult to work for the U.S.P.S. By no means am I saying ANYTHING derogatory about this great company that has been able to help its Letter Carriers (Parents) send their kids to college and, they have been able to go on expensive trips regularly So again, not bad. But we are in a new generation and the Postal Service, along with the NALC, needs to start thinking outside the box.

Maybe the new carriers are saying that their behavior is and should be acceptable because the old way of behavior hasn’t fixed the same old problems and it’s time to try different tactics.

People would rather work for Chick fil A, or In N Out Burger whose starting pay is $21.00 per hour and work as much or as little as they want. Rather than work as a CCA ($18.92hr) or a PTF ($21.92hr) who must work 7 days a week, and over 12 hours a day. I’m sorry but this is borderline slavery! So, I guess the real question is, “What are the National Parties going to do about

believe that we can turn this around. The Postal Service can literally destroy this industry in a good way, because we hit every house in America! If we had the staffing, no other delivery service could touch us. Even Amazon would find it difficult to keep up. With FedEx and UPS already giving us some of their packages to deliver, that tells us that they wouldn’t be able to keep up with us either. There is so much potential for the U.S.P.S. but the people running it just don’t get it, which is absolutely mindboggling to me. So let’s stay strong and keep our hopes up for both parties because I truly believe that we can save this great company before it’s too late.

I grew up in the 50s and 60s, lately I have said I don’t understand new carriers because it seems they don’t want to really work and or don’t care about their job.

Former Judge Michael Luttig recently said “We Americans no longer agree in what’s right or wrong, what is to be valued and what is not, what is acceptable behavior and not, and what is and is not tolerable discourse in civilized society.

Maybe the new carriers are saying it’s not right to be ordered in on schedule days off. It’s not right to be mandated to work 1, 2, 3 or 4 hours of overtime, it’s not right to be mandated to work 12 hours days and 70 hours weeks. It’s not right to see some carriers getting preferential treatment. It’s not right to constantly fix management mistakes.

Contract Negotiations are Coming!

Well, here we go again. It’s about that time for the National parties to step up to the negotiating table again. As we all know our Collective Bargaining Agreement for the 2019 2023 contract years will be expiring around March of 2023, it’s nothing new but this next contract that is agreed upon will determine if the Postal Service can sustain the crazy Parcel/Package volume and the understaffing. We are running out of time!Many of our 30, 20, and even 15 year Letter Carriers are moving on or retiring because it’s just too much. The hours are like nothing we have seen before. The Postal Service can’t get people to work for its company because the starting wage for what the average Letter Carrier has to deal with is abysmal to say the least. Don’t get me wrong, the Postal Service isn’t the best company to work for but when you get to the max pay which is when you reach 12 ½ years, it’s actually not bad It could be up to $40 per hour by the end of January 2023.

After this charming prelude conversation, usually a just cause (just cuz) interview is scheduled. Are you afraid of just cause interviews? Hopefully the following example of questions and answers will help you answer without incriminating yourself which is usually the interrogators’ sole purpose.

• Do you have anything else to add that I may not be aware of?

• I don't know what regular in attendance means. I can't come to work if I am incapacitated due to illness or injury or need to care for my family member. (FYI Sick leave dependent care only covers spouse; parents; parents in law; children; brothers; sisters; grandparents, grandchildren; stepparents; stepchildren; foster parents; foster children; guardianship relationships; same sex and opposite sex domestic partners; and spouses or domestic partners of the aforementioned)

• Are you aware of (Postal Rule or regulation)?

On or around May 2022, the national parties agreed to a new Memorandum of Understanding (MOU), Re: Alternate Route Evaluation and Adjustment Process. This is a joint process between the NALC and the USPS. Here are some of the things you canTherexpect.ewill be no management official(s) in your station or office following you for the entire week telling you how not to and how to do you route. No more forms to complete, no more counting pieces of mail, parcels and sequenced mail every single morning. You will be evaluated based on what you normally do day in day out.

The process is more data driven. The team “will be responsible for data analysis, route evaluation and adjustment, jointly conducting carrier consultations and jointly ensuring that all resulting data and unit records are updated”.

The data analysis period consists of a Live Week of data collection which is jointly selected and seven additional weeks which are drawn randomly at the national level. No data will be used from the months of June, July, August and December. For future sites that will be evaluated and adjusted, data will be collected from September 1, 2022 until November 30, 2022.

The evaluation of office time is either the regular carrier’s actual average total office time during the analysis period or the estimated standard during the analysis period. Keep in mind that under the M 39 Handbook, the office time allowance shall be fixed at the lesser of the two. In other words, it will not benefit the carrier to work too fast in the office or if the carrier is taking longer in the office than the standard allowable time

Without getting into deeper details, just be aware that the DSR knows what you are doing at all times while you are on the street delivering mail.

According to the information I gathered from the Technology Integrated Alternate Route Evaluation and Adjustment Process (TIAREP) training at the 72nd Biennial National Convention in Chicago, the Digital Street Review (DSR) will show an automated playback that shows what the carrier did at a particular time or day, which includes Daily Summary or overview and Daily Details, two of most important reports.The Daily Summary Report shows total and net street time, allied times, customer contact, major street events and shows whether a carrier visited 80% or 90% of the route, etc. The Daily Details Report is similar to a 3999 that shows sector segments, what time the carrier entered and left each sector segment, how many scans a carrier did and identifies active deliveries, etc.

to complete your assignment at a pace that you can maintain all day, safely. Take your breaks and lunch. This is important for you to rest and refresh for your safety. Management may push you, faster go faster.

Is it a condition of employment to leap tall buildings in a single bound?

I was originally asked to write an article regarding a day in the life of a Shop Steward. I tried, multiple times. But for whatever reason the article seemed to turn into complete chaos towards the middle. Then it hit me, it’s not unusual for my day to turn into complete chaos by lunchtime! There’s nothing easy about being a steward. And while I realize that I chose to be a steward, the chaos that follows the title was something I could have never imagined! So instead of sharing my office chaos with you I have decided it would be more beneficial if I gave some advice to my brothers and sisters on things you can do to help us stewards out.

3. Follow your medical restrictions if you have them: I don’t understand why a carrier would go through the trouble of going to a doctor, be placed on medical restrictions, only to continue to do whatever it is they shouldn’t be doing. If your doctor feels its best that you do not work 12 hours a day, then my advice to you is to follow their advice.

Pursuant to Section 242.332 of the M 39, “No carrier shall be disciplined for failure to meet standards, except in cases of unsatisfactory effort which must be based on documented, unacceptable conduct that led to the carrier’s failure to meet office standards.” Furthermore, the pre arbitrations settlement H1N 1N D 31781, dated October 22, 1985, provides that “there is not set pace at which a carrier must walk and no street standard for walking.”

You are an essential worker, accurately and consistently, delivering the many important documents, medicine (including chemotherapy drugs and insulin) diplomas, gifts, and goodies, every day no matter what the conditions.

I could write all day about the things carriers can do to make my job easier. The list goes on and on. But in my opinion, this is a good start. Every office is different, and every steward is different. But one thing that we all share is a passion to ensure that our brothers and sisters can come to work, have access to the tools and equipment we need to work safely and to be treated with dignity and respect. And in the end that is what unites us all.

4. Have patience with us: if you bring something to my attention and I tell you that I will file a grievance, then I promise you I will file that grievance. But the grievance process does not get you instant results, far from it. Please be patient and have faith that I will do my job.

If you are unsure if you should sign something, first make sure you understand what the form says, ask questions, and get clarification if you’re confused. After signing it, ask for a copy.

1. Fill out a PS Form 3996: I understand the urge every morning to argue with management on whether your route is over or not. Just fill out the paper and hand it to your supervisor. There’s no need to argue. If they deny it, that’s ok! Ask what they would like you to do with the mail, wait for a response, then ask for a copy of the PS Form 3996 and walk away. It’s pretty simple.2.

5. If you are absent from work fill out PS Form 3971 yourself: Whether it was planned in advance or called out using the sick line, it doesn’t matter. When you come back to work after being out the first thing you should do is fill out a PS Form 3971. Why? Because if you fill it out then you get to decide what type of leave is being used whether you take annual leave, sick leave or even LWOP as reason why you were absent instead of management determining that for you.

If you have an issue please request to speak with your steward: Management is required to give you time to speak privately with your steward when you request it. It may not happen immediately, but it must be timely. Put in a request to speak to a steward.
