THE PRESIDENT’S MESSAGE BY

W

elcome to the spring issue of Soundings. It was great seeing everyone at the ASA Annual Meeting in New Orleans, especially after missing last year due to the pandemic. I would like to especially thank the South American participants who traveled a great distance to be there. We all look forward to our continued expansion into the South American market.

Congratulations to our marketing committee on their diligent work in continuing to provide informative content for this Soundings publication. Due to their efforts, readership has more than doubled. Congratulations are also in order for Stephen Dann and Alejandro Pena Zepeda on their newly elected positions as Associate Member Representatives to the Executive Committee. I look forward to working with them over the next two years.

I would like to thank all the Associate member nominees who participated in the election process. Additionally, I appreciate those members who worked hard to complete and approve the budget for the fiscal year 2022. Our membership committee continues to build the membership and reach out to members, checking company contact information and email addresses. To that end, I ask that you take a few moments to complete the questionnaire that was sent in early February. This was designed to enhance corporate associate member benefits and this information will be collected to create an interactive map listing equipment and capabilities of their companies.

The new member equipment web page is currently active, and I encourage our members to visit the site.

During my tenure as president, I will work with our members to bring attention to the influence on China’s expansion into the worldwide wreck removal market and how it directly affects the U.S. response posture.

I would also like to focus and collaborate with authorities to improve the gaps that were identified in the GAO (Government Accountability Office) report published in 2021. As an organization, we can have a positive impact on identifying and suggesting solutions to the findings of 4

the report. I recently re-read the 1982 National Research Council (NRC) report entitled “Marine Salvage in the United States” (NRC, 1982) and “The Assessment of the Marine Salvage Posture of the United States” (1994). I realized that we started talking about the gaps in 1982, reassessed in 1994, and today we have many of the same challenges and gaps that we did 40 years ago. It is my goal to bring these issues to the forefront of the collective intellect of the ASA in the hopes of closing as many of these gaps as possible.

As I write this, we’re coming out of a difficult two years where business was far from normal. Now that COVID appears to be waning, the events unfolding in the Ukraine present new challenges. Although it is unknown what effects the turmoil in Europe will have on the salvage community, we are an industry built on uncertainty and adaptability. I will continue to build upon our strengths while using our unity to fortify our organization as a whole.

I look forward to these tasks and as always, welcome the information and input from our ASA members around the country as we navigate these ever-changing waters.

Felicitaciones a nuestro comité de marketing por su diligente trabajo para continuar brindando contenido informativo para esta publicación de Soundings. Gracias a sus esfuerzos, el número de lectores se ha más que duplicado. Me di cuenta de que empezamos a hablar de las brechas en 1982, las reevaluamos en 1994, y hoy tenemos muchos de los mismos desafíos y brechas que teníamos hace 40 años. Mi objetivo es llevar estos temas al frente del intelecto colectivo de la ASA con la esperanza de cerrar la mayor cantidad posible de estas brechas.

Re: H. R. 6865, Coast Guard Authorization Act of 2022, Sec. 401. Restriction on changing salvors Dear Chairman DeFazio and Ranking Member Graves: The American Salvage Association requests your assistance on a matter of great concern to us that is currently before your committee.

The referenced amendment to restrict changing salvors, if enacted, has the potential to be detrimental to the environment, to marine safety, and to prevent the use of the best qualified and efficient resources in emergency salvage, marine firefighting, and wreck removal operations. We respectfully request you remove §401 from the referenced bill. §401 needlessly complicates the decision-making authority of the Federal On-Scene Coordinator during what is often a time critical and dynamic situation involving vessel salvage operations when responding to major marine casualties. As you know, vessels regulated under OPA 90 are required to submit Vessel Response Plans that include identification of resource providers, including salvors. Importantly, to maximize the probability of success of an operation, OPA 90 allows critical flexibility by authorizing the Coast Guard to accept the use of resource providers not listed in the Vessel Response Plan “…if the President or the Federal On-Scene Coordinator determines that deviation would provide for a more expeditious or effective response…”

The role of the Vessel Response Plan is important in that it requires a vessel operator to “pre-plan” how it will respond to a marine casualty. However, since one can never predict the unique circumstances typically involved in salvage operations, current law already authorizes the Coast Guard to allow changing of response providers to address the unique demands of each specific incident. This provision is vital in salvage operations as it allows for the replacement of resource providers that are not performing, underperforming, not fully qualified or equipped, or for the use of resources that would provide for a more rapid and effective response.

022, SECTION 401: RESTRICTION ON CHANGING SALVORS We are concerned that §401, if adopted, will undermine the incident evaluation and decision-making process of the vessel operator and Federal On-Scene Coordinator by imposing post-decision scrutiny on the Coast Guard for difficult decisions made during the unpredictable events of a salvage operation. This extra burden on decision makers involved in complex salvage operations undermines their ability to act with confidence as they work to protect the people, property and environment impacted by a major marine casualty.

The national response system implemented after the passage of OPA 90 has been a success due to the hard work of federal and state response agencies as well as industry and their resource providers, including the salvage industry. No two salvage operations are alike and ensuring decision makers involved in leading a response have clear authority to act on behalf of the nation is critical.

We believe that before a change as significant as §401 is implemented, Congress should have the benefit of learning from the experience of the salvage industry to avoid adopting policies with significant unintended consequences. We represent a wide spectrum of the U.S. marine industry including vessel owners, salvage and marine firefighting resource providers, oil spill removal organizations, and diving contractors. We are available and committed to assisting you, your staff and the committee in understanding the challenges of delivering salvage services when requested.

In summary, we are concerned that §401 was included without notification to or consultation with those marine companies affected by the change and should be removed from the bill.

Safer Shipping for Container Vessels

he fortunes of the container shipping sector can best be described as mixed. From an earnings perspective, the market is riding high, and carriers are experiencing profit margins they could only have dreamt about a few years ago. However, the effects of COVID have conspired to cause unprecedented delays in the container supply chain resulting in port congestion in many parts of the world. Terminal operations have been impacted by the pandemic as well as the availability of the “last mile” truck and train operators, resulting in ships and containers suffering disruption and delays. A further consequence is the long 8

turnaround times for loaded containers meaning lengthy delays in getting empty containers back into circulation.

Despite this, a more systemic issue lies in the industry’s appetite to build ever larger vessels.

Whilst this brings the advantages of economies of scale, it has also laid bare the increasing and everpresent likelihood of catastrophe in the form of risk accumulation, onboard fires, and large container spills.

Big ships can equate to big risks. Aside from the ever-present and tragic potential for injury and loss of life, these ultralarge container vessels are extremely valuable. A 24,000 TEU vessel is likely to be insured on an H&M basis for around $150 million, but the cargo will be valued at eight or nine times that amount giving a total value of approaching

$1 billion. This is a problem as these large vessels are more prone than others when it comes to fire risk.

Latest figures from CEFOR (the Nordic Association of Marine Insurers) show that the overall claims frequency for marine incidents of all types has fallen continually since 2005, but that the incidence of onboard fires and explosions is increasing. More granular analysis from CEFOR shows that the frequency of fires on large containerships is following an upward trend (since 2005) with vessels over 50,000 GT leading the way. This is, perhaps, unsurprising as the more boxes carried on board, the greater the probability that at least some of these containers will contain cargo which may self-ignite.

Between 2000 and 2015 there were 56 reported containership fires resulting in around US$ 1 trillion worth of damage, but in 2019 alone more than 40 onboard fires broke out on this vessel type – including YANTIAN EXPRESS, APL VANCOUVER and GRANDE AMERICA. Tragically, many resulted in danger for the crew, causing injuries or even loss of life. In many cases it was not easy to identify the cause of these fires, but most experts believe they were due to undeclared, mis-declared, or poorly stowed dangerous cargoes.

WHAT CAN BE DONE? From our perspective, the answer seems to be twofold. First, is to crack down on the increasing number of dangerous cargoes that are wrongly declared – deliberately or by honest mistake. Mis-declaring a cargo can lead to its incorrect storage which, in turn, can encourage it to combust.

Sitting a box that has the potential to combust adjacent to boxes carrying flammable materials is a recipe for disaster.

Second is to address the onboard firefighting capabilities.

Current SOLAS regulations do not appear to have maintained pace with the increasing size and complexity of these large vessels and have become inadequate.

Onboard fixed firefighting systems might comply with the regulations, but that is scant comfort if the regulations themselves are outdated. Seafarers should not be relied upon to fight the fire themselves. Although they will have received some rudimentary training, they are – first and foremost – mariners, and not firefighters.

container spills. There is a heightened issue with the integrity and stability of onboard container stacks, particularly in heavy weather. The very fact that these vessels are growing larger in size and therefore able to carry more boxes, exacerbates the risk in terms of sheer numbers of boxes lost overboard.

Between 2008 and 2019, the World Shipping Council reports that an average of 1,382 containers were lost overboard each year. But recently there has been a massive increase. In mid-February of last year, 260 containers were lost from the 13,092 TEU MAERSK EINDOVEN off northern Japan. Two weeks earlier the MSC ARIES (14,952 TEU) lost 41 containers in the Pacific.

In the same month a further 750 containers were lost by the 13,092 TEU MAERSK ESSEN, also in the Pacific; and in November last year a huge loss from ONE APUS (14,026 TEU), also in the Pacific, amounted to around 1,800 boxes.

The root causes for these continued losses are complex, but the fact that our weather patterns are becoming more severe is most likely a significant factor. Other contributors are:

• Wrong declaration of container weights (VGM) • Poor packaging of containers not complying with the CTU Code requirements • The insufficient stowing of containers on-board not complying with the CSS Code • Non-compliance with ISO standards for container lashing equipment and corner castings • Design issues of the container vessel Lashings are a particular issue. Containers are stacked and secured to each other with twist locks at their four corners.

Lashing rods and turnbuckles are then used to secure the containers to the deck of the vessel. Physical forces endured by the ship going through rough weather (such as rolling) are passed through the container stacks creating enormous momentum and often resulting in collapse or loss.

Created in the late 1950s, containerization has changed the way that global supply chains operate and today underpins the movement of most finished goods. But the ever-increasing size of these vessels are creating unintended consequences that must be dealt with to ensure safer and more environmentally friendly shipping.

hen disasters occur in the U.S., the Public Information Officer (PIO) role within the Incident Command System (ICS) is vitally important and sits directly below the Incident Commander within the organizational chart. At a time when news coverage is 24/7 and accuracy in reporting can be hit or miss, no incident response can be fully successful without a strong and competent PIO. It is important to note that the PIO role focuses solely on ensuring an accurate flow of information to the public about the response through a variety of methods including media relations, press conferences (when needed) social media, website postings, and the proactive issuance of news content.

The PIO role is not focused on the business or reputation of the Responsible Party(ies) involved in the incident.

Today, PIO activities alone are not enough to protect the involved company’s reputation or to deliver a truly comprehensive communications response. A PIO can never replace the need for a strategic corporate communications effort to protect and manage a Responsible Party’s long- term reputation and support its ability to return to business as usual following a crisis. These activities are fundamentally different from the incident communications delivered by the PIO. Unfortunately, even some communications firms that are focused solely on incident communications do not understand this need for a dual approach to communicating during a crisis.

A recent example of the need for a combined PIO/Corporate Communications response in today’s media environment was a pipeline-related crude oil spill on the West Coast. The incident represented the potential for significant damage to world famous beaches and important 14

fisheries and generated extensive global media coverage.

From the very beginning, the oil spill merited a strong proactive voice from the Unified Command tasked with the response and clean-up. And, as investigations into the incident gradually uncovered the cause of the spill to be third-party damage to the pipeline, the need for a parallel corporate communications effort became critical to ensuring that the Responsible Party’s story was broadly communicated and understood, and that its reputation remained solid.

As the cause of the crisis became apparent, the Unified Command worked cooperatively with the Responsible Party to ensure that the story did not become over sensationalized and remained continuously based on fact, not conjecture. While no company can escape some temporary negative impact to its reputation when a crisis like this occurs, long-term reputational damage was avoided because of the Responsible Party telling its story while keeping the Unified Command constantly updated on its messaging and parallel communications efforts.

Another recent example of the successful use of a combined PIO/Corporate Comms approach to a crisis occurred recently in the Gulf of Mexico where an equipment failure on a drill rig resulted in a very loud and very visible water and natural gas plume that could be heard and seen from a protected National Seashore. What could have become a highly sensationalized story was well managed by the Incident Command with the engagement of key regulatory agencies, government response organizations, the local municipality, and the Responsible Party. Through a carefully coordinated communications effort including PIOs from several of the involved groups, including the Responsible Party, information was compiled, vetted and released daily to the general public to ensure them that there was no danger to public safety, despite the visible effects of the plume, no endangerment to wildlife or the environment, and a reassurance that the Responsible Party was cooperating completely to achieve the quickest possible end to the incident – all in the midst of a series of severe summer weather events. At the same time, the Responsible Party’s corporate communications counsel worked closely with the PIOs to negotiate messaging, media strategy and approaches that would fulfill the objectives of the PIOs while ensuring the Responsible Party’s story was told fully and accurately.

Because of the immediacy and continuous updating of the incident status to the local community, panic was avoided as was any long-term damage to the Responsible Party’s corporate reputation and its ability to continue operations.

This was an equipment failure that immediately received a temporary fix and was then completely repaired with new, more durable replacement parts as quickly as possible under very challenging meteorological conditions. End of story.

On the surface, a PIO and a corporate communications counselor will likely perform many of the same tasks, including writing news releases, conducting media relations, and organizing news events. However, despite these similarities, there are four differences that make their roles distinct.

1. Who they report to: The PIO reports to the Incident Commander for the incident – it is almost always a shortterm relationship. A PIO may be from the Responsible Party, the Coast Guard or other organization involved in

In the instance of an oil spill, this information would include reports on beach closures, amount of oil spilled, the response objectives, resources involved in clean up activities, clean-up progress and details about public safety. During the same event, a crisis communications counselor will communicate information from the Responsible Party. This may include information intended to set the incident in context, such as details of the company’s safety track record, corporate resources being dedicated to the clean-up effort, commitment to environmental integrity and the affected communities. Importantly, the corporate response will also include communications which extend beyond just the facts such as expressions of regret (possibly apologies), statements of sympathy or commitments to conduct investigations. Both roles are essential.

4. Training and experience: PIOs will have completed ISC training including PIO-specific courses. PIOs may come from other communications or journalism backgrounds, but most come to the position from other non-communications focused backgrounds having been chosen for their communications abilities. Crisis communications managers generally have less structured course-based training and are instead more likely to have worked as journalists or have degrees in public relations and/or communications. While the PIO works according to a formalized step-by-step process, corporate comms is much less process driven and can use more diverse tools and strategies to convey a company’s position during an incident.

This has proven time and again to be a costly misunderstanding of today’s media and communications environment.

n Friday, February 11th, Rebecca Garcia-Malone, Chairwoman of the ASA’s Education Committee (EC), served as a guest lecturer for Cal Maritime’s Marine Transportation: People, Planet and the Profession course headed by Associate Professor and Faculty Senate Vice Chair, Dr. Elizabeth McNie. Garcia-Malone offered students a high-level overview of the marine salvage industry by providing insight on its history and evolution, relevant laws and regulations, commercial contracting matters, and the various roles and career opportunities that exist within this exciting field. Several case studies were also discussed allowing students to gain a better understanding of the complexities of marine salvage and emergency response operations. This spring, the EC will turn its focus to relaunching the program’s Annual Marine Sciences Scholarship Competition held jointly with the North American Marine Environment Protection Association (NAMEPA). After several years of COVID related impacts to the program, the committee is aiming for a successful revitalization with a high volume of student submissions. Stay tuned for more information!

he Regulatory Affairs Committee continues to monitor the Merchant Mariner Credential (MMC) issue. As reported in the winter edition of Soundings, last November the committee and the ASA Legal Counsel participated in the National Merchant Marine Advisory Committee meeting which, among other assignments, was tasked with making recommendations to the Coast Guard on a report the agency is required to make to Congress on the issue.

It is still unclear at this point if the National Offshore Safety Advisory Committee (NOSAC) will also be tasked

by Coast Guard with making recommendations. If NOSAC is tasked, ASA will be represented. We continue to collaborate with SCAA, ADCI and OMSA on the issue.

Please note that the statutory moratorium on MMC enforcement ends December 31, 2022. ASA Legal Counsel, with support from the Regulatory Affairs Committee, continues efforts on an extensive analysis proposing a different interpretation than that of Coast Guard of the MMC requirement 46 USC § 8701.

Stevens Towing and the Charleston Heavy Lift team utilized the 500-ton floating derrick, Ocean Ranger, to handle a rotor scheduled for export through the Port of Charleston in December 2021. The 105 metric ton rotor was lifted from a Superior Cranes trailer at Columbus Street Terminal. The rotor was transported from Columbus Street Terminal over to Wando Welch Terminal via the Ocean Ranger where upon arrival, it was set on the CMA/CGM vessel MV OOCL Atlanta for export. PACIFIC MARITIME GROUP SUPPORTS PACIFIC MARITIME GROUP APOYA LAS OPERACIONES DE LIMPIEZA CLEANUP OPERATIONS ON LAGUNA EN LAGUNA BEACH BEACH In December 2021, Pacific Maritime Group helped clean up a diesel fuel spill on Laguna Beach in Orange County, California. Unfortunately, an accidental spill of diesel fuel threatened to spoil a part of the popular 1000 Steps Beach area. Ancon Services of Carson, California was hired as the prime response contractor bringing over 40 years of experience to the site with crews trained in responding to environmental disasters.

The impacted portion of the beach was small and inaccessible from the street. All equipment and materials had to be delivered by sea. Luckily, Pacific Marine Group’s landing craft, SEA SCOUT, was made for such operations. Once the SEA SCOUT delivered an excavator, skid steers, all-terrain vehicles, containment boom, bags, and absorbents, the Ancon crews went to work capturing and bagging the contaminated beach sand. Shortly after that, the SEA SCOUT returned to deliver approximately 900 tons of clean replacement sand for Ancon crews to replace and grade flat on the impacted areas. Upon completion of remediation operations, all waste, tools, and equipment were loaded onto the SEA SCOUT for transit back to Pacific Tugboats yard in Long Beach, CA. In December 2021, Resolve Marine announced that Phase 3 exploration and site evaluation of the Clotilda had commenced. Working jointly with Southeastern Archaeological Research, Inc. (SEARCH), Resolve is the lead contractor for the Alabama Historical Commission, bringing decades of experience working along the Gulf Coast of Alabama to survey, locate, and archaeologically document and assess historic shipwrecks. Working on different aspects of the project since 2018, the assembled team brings extensive knowledge of Clotilda, as a vessel, a shipwreck and archaeological site with powerful, emotional connections to the community of descendants and others who care about its story.

Over the course of several months, Resolve and partners will conduct a structural and engineering assessment; a maritime archaeological and environmental investigation; and prepare an in-situ conservation and preservation plan. The RMG-60, a 100 x 40 FT crane barge locally based in Theodore, AL has been moored at the site with topside support equipment for dive operations, artifact stabilization and storage, equipment use and staging, analyses, and archeological documentation.

MAJOR STRUCTURAL REPAIRS AT CRISTOBAL INNER ANCHORAGE Last October, while at the Pacific entrance of the Panama Canal, a Panamax oil tanker suffered major damage to her port side shell plate and internal structure.

Talleres Industriales was contacted immediately by agents and the ship manager to inspect the damage along with a class surveyor and develop a repair plan to be executed once the vessel completed its transit and arrived safely at Cristobal’s inner anchorage.

Talleres’ naval architects and steel foremen were mobilized to conduct the inspection and take all appropriate measurements of the damaged area. Shortly thereafter, Talleres’ repair plan was developed and forwarded to the vessel manager and class surveyor, where it was approved the same day. All repair specifications and drawings were then sent to Talleres’ welding workshop in Colon for procurement and prefabrication.

Upon the vessel’s arrival in Cristobal, generators, ventilation, lighting, scaffolding, cutting and heavy welding equipment were mobilized to the site. Crews were challenged with installing 5.5 tons of steel during the regions rainy season while also managing the complexities of a new COVID variant outbreak and social strikes in the area.

Once on site, scaffolding was built around the damaged section to serve as a suspended workstation. Once the shell plating was prepped and cut, all new marine plates were fitted and welded into place by class approved personnel. All welds were ultrasonically tested to the satisfaction of the class surveyor and the attending superintendent upon which final touch-ups were completed to the vessel’s original specifications.

AFRAS President, Captain Joseph Re, USCG (retired), presented the award to Captain Greg Giggi, Allwater Marine Services/TowBoatU.S. Charleston.

Mr. deGroot holds a degree in Material Science & Engineering from the University of Washington and holds several other certifications.

Mr. deGroot has been in the maritime industry since 2002 where he began as a Deckhand before going to school and returning as a field engineer and estimator.

Mr. deGroot made his way to Global in 2013 where he worked under Mike Langen as a project engineer on ROV and marine construction projects. deGroot later rejoined Global in July of 2021 in his current role.

Mike Langen, VP of Marine Construction & Technology, retired from Global Diving & Salvage, Inc. at the end of 2021 after 25 years of dedicated service. First joining in 1983, Mr. Langen started at Global as a diver, working on many oil spill jobs. He later rejoined Global in 1998 with an engineering degree as a construction manager where he worked his way to his present role. During Mr. Langen’s time at Global, he was crucial in the execution of some of the largest, daunting, and most complex projects.

Dan Pierson, Senior Vice President said, “Mike has served this company exceptionally these 25 long years. His expertise and commitment has been a driving force for getting Global where it is today. While it is sad to see him go, we are glad he will be able to get some well-deserved rest. His hard work is leaving Global in a great position for its future.”
