When Modiin Was a Yishuv By: Car yn Meltz

I have had the privilege of living in Modiin since practically the beginning of the city’s existence which at the time was Moatza Mekomit Modiin, and not as we know it today, Iriyat ModiinMaccabim-Reut. How we came to live in Modiin was a very similar story to many others who moved in the early years of the city. We were a young family with one baby and were looking for affordable housing (which is quite ironic these days because Modiin is not known for its cheaper prices anymore). We had been living in Petach Tikva, and had almost signed on a rental in Beit Shemesh when my aunt who was visiting from America said that we should check out this new place called Modiin. We came, looked at a few projects and bought our first apartment. As we were trying to navigate our way around the neighborhood, we tried driving down a dirt road (90% of

the roads were dirt roads), but it was too steep so we turned back. We discovered later that it was never meant to be a road and was built as a walkway up the mountain.

During the early years of the city, families who had already made aliyah moved to Modiin from other cities within Israel. living here yet. The Pesach before we moved in, a group of English speakers met up at a park in Maccabim – because there weren’t any parks in Modiin – to meet one another. The group was put together through friends of friends who knew of someone moving to Modiin.

We moved into our new home in Givat C on November 1, 1997 (did you know Givat C was named that because the streets are built in a C shape?). We had a great view of the city center which was just a traffic circle (the mall would be built years later, and we witnessed the endless amounts of times the traffic circle was dug up and reconstructed). We moved to Modiin with no phone line, and worse yet, no cable! We didn’t know anyone when we bought, but thanks to the meet and greet over Pesach we were invited out for Friday night dinner (the family was using a generator because they didn’t have proper electricity yet), kiddush and Shabbat lunch.

We would get knocks on our door almost daily from the workers on the projects around us asking for water, a cup of coffee or even the use of our outlets. The Pizza Shul (named after its triangular shape at the time) was operational, but only with the aid of the very long extension cord to the neighboring apartment to get light.

We were very excited when Modiin Center opened and Modiin had its first proper supermarket, its first coffee shop (remember Cousins?), and its first photo store (Orient Tzilum). Yitzchak Rabin only existed on the Givat C side because there was no Buchman. There was also no Kaiser, no Tzippor, no Shimshoni, and certainly no Tzipporim.

Modiin felt like a yishuv, we all knew each other. We all had the same first three digits to our phone numbers – 972 – when someone would ask, “what’s your phone number”, the person would respond

with only the last four digits which gave a collegiate feel. Since most of us came as young families, we have the zechut to watch the families expand and to share in all the smachot.

It was just a matter of time until an English magazine was started in Modiin, as most other cities with a high percentage of Anglos already had one. Daniella Hellerstein had recently moved to my block – she lived at 43 Nahal Sorek and I lived at 34 Nahal Sorek (the mailman would give us each other’s packages if one of us weren’t home so that we wouldn’t have to go to the post office to collect) – and was one of the first olim to come to Modiin fresh off the boat. We were pre-Nefesh B’Nefesh.

Bibas: From Resident to Mayor By: Rachel Kops and Car yn Meltz

Mayor Haim Bibas has been serving as our mayor for over seven years, but has been living in Modiin for almost 20. ModiInfo sat down with our mayor to discuss how “The City of the Future” has taken form over the past 20 years and the direction that it will continue to grow.

Former Prime Minister Yitzchak Rabin z”l came to the hills of Modiin in 1993 for the cornerstone ceremony. A few years later, Haim Bibas and his family were amongst the first families to move to the

new town of Modiin.

Bibas, originally from Beit She’an, was living with his family in Tel Aviv when his wife, Yafit, decided that the family was relocating to Modiin. Not only were they pioneers in moving to a building site in 1997, but they were pioneers in building a new city from a speck of dust.

A bit of history about our third mayor of ModiinMaccabim-Reut. Bibas finished his keva army service in 1992. He served as Lieutenant Colonel (Ret.) and as Battalion Commander training officers and squad leaders, as well as training military police reservists. He then continued on to study political science at the University of Haifa. He then received a master’s in Public Administration and Local Government from Bar Ilan University.

Local issues were important to Bibas, and in 2000, he helped form the first vaad ganim in the city. This was the Continued on page 8

first opportunity to start implementing policy in a growing city that needed guidance. Politics was in his nature and he decided to join the Likud party. In 2002, Modiin resident and current MK, Yariv Levin, established a Likud branch in Modiin in which Bibas was a part of. The two focused on issues, such as education, that needed to be brought to the forefront in Modiin.

In 2003, under Moshe S p e c t o r ’s mayorship, Bibas won a seat on city council and was the volunteer o n - c a l l acting mayor for the second part of the term. In the 2008 and 2013 elections, Bibas ran for mayor and won. He entered his position wanting t o i m p r o v e education, culture and transportation in the city. In 2014, in addition to serving as mayor, Bibas assumed the position as Chairman of the Federation of Local Authorities in Israel. The main role of the Federation of Local Authorities is to represent the local authorities and to promote their interests with the Knesset and various government authorities, as well as official and national institutions and organizations.

Education continues to be a key component to Bibas’s administration, “We have to listen to our youth, hear what they want and fulfill their needs. The children of today are our leaders of tomorrow.” When he became mayor, 72% of students graduated with a matriculation certificate (bagrut) and today the number has increased to 85%. Modiin has award winning schools, for example, this year the Maccabim-Reut High School (MOR) won the prestigious National Education Award. The city has also encouraged the growth of youth movements and has provided permanent structures for the youth movements to meet.

Cultural life in the city has grown over the past 10 years. The city boasts a thriving Heichal Hatarbut, Sportek, soccer field, municipal pool and more. The seaside park is in the beginning stages of planning – residents will be able to feel the beach close to home.

Currently, the major project underway is the City Center complex which is slated to be completed in the middle of 2018.

The complex will include a commercial center in the center of the city, which according to the plans will include a new main avenue of the city that will be a continuation of Rechov Dam HaMaccabim, from the roundabout by City Hall until Rechov Ficus. The ground floors of the buildings will be for stores and will face the new main avenue which will have wide sidewalks, parking along the street, paths, landscaping, benches, fountains, play structures, kiosks and a bike lane.

The city is also in the beginning stages of building an academic institution for higher education in an effort to enable young adults to study for their degrees in their hometown.

The structure will be built near the city pool.

Of the 90,000 residents in the city, 20% are olim. “The city has been successful in absorbing olim from all over the world. It is of great importance to us that our olim receive the support that they need,” said Bibas. The olim center that is currently housed in Maccabim will be moving to its new location to a renovated building in Reut.

The city is doing everything possible to fill in the gaps as the city grows. One of the missing elements is a hospital facility, however, by law a presence of 250,000 residents is necessary prior to its establishment. In turn, Bibas has initiated talks with private medical centers, such as Assuta, in an effort to bring a larger medical complex to the city. Nonetheless, a project of this stature will take time to be realized.

What will M o d i i n MaccabimReut look like in another 20 years? The city will be fully formed – from the City Center all the way to the Technology Park and Einav Center. It will be a thriving city in the center of the country.

“Modiin is a model for many cities around the country and around the world. People come to see how Modiin, the first planned city in Israel, has been built from ground zero. Modiin is an example of the Zionist dream coming true,” said Bibas.

Modiin Real Estate over the Years By: Ze’ev Shumac her

Ze’ev Shumacher, CEO of Shumacher Realty, has been in the business of real estate since the beginning of the millennium. Through the years, he has been dealing with first- and second-hand real estate, as well as forming buyers’ groups, purchasing groups and amutot (not for profit organizations).

Shumacher Realty was established in 2006, but his experience in the Modiin real estate market goes back 16 years, giving him a unique outlook on real estate in the city.

His vast experience has enabled him to compare prices in Modiin and the changes they have undergone through the years – prices listed in NIS:

While first-hand apartments refer to those being sold by contractors, second-hand apartments are apartments that have already been lived in,

and are for sale by their owners or by real estate agents.

Modiin’s Most Wanted Shumacher reveals that throughout the years, four-room apartments have always been the most wanted size, both first- and second-hand.

However, he states that if 16 years ago the Pan-Israeli dream was a fourroom garden apartment or a cottage, nowadays in Modiin the preferred size is five rooms first-hand.

“In the past decade, the real estate market in Modiin has doubled its size. The market is growing and there are many apartments in the market – first and second-hand. In the first years, there was much supply, and prices almost did not go up. In the year 2006 there was an increase in prices and then prices went slightly down.

“In 2007, a process of growth began in real estate prices, which has been going on to this day, with a small pause in 2012 .The prices have gone up in Modiin similar to other parts of Continued on page 12

the country. I believe this is due to the laws regarding wages for foreign construction workers. Once their wages grew, prices of homes have grown accordingly.

“While the trend of the graphs for housing prices in Modiin is relatively similar to that in other cities, the average prices here are slightly higher than the national average price.”

What are the reasons for the upsurge in housing prices?

Shumacher says that there are several: 1. The real estate market, like any other market, is affected by supply and demand. Ever since its establishment in 1997, Modiin has had a supply smaller than the demand, and as a result, real estate prices are constantly increasing.

2. Land is limited in Modiin, and the prices the Government of Israel requires for land is very high.

3. The State requires contractors to invest in development of areas around their projects. This is very costly, and contractors naturally raise the price of the apartments as a result.

4. Second- and first-hand apartments never meet the demand, and firsthand apartments now under construction will only be supplied in a few years and do not answer the current demand for new homes.

Modiin has always been attractive for buyers from all areas of the country and from all walks of life. Shumacher says that the reason is its geographic location, in the middle of the country, halfway between Jerusalem and Tel Aviv, and close to major routes such as Route 1, 443, 431 and Route 6.

The city itself is attractive due to the good educational system, attracting young educated families. The fact that the city was preplanned, unlike any other city before it, ensures that it is a pleasant, green and attractive city. One must not forget the socio-economic level of Modiin. Its population is educated and with an above average income.

The result is a good mix of young and old, religious and secular, sabra and olim and they all live quite peacefully with one another. The people of Modiin also have a great sense of loyalty and belonging to the city, so that there is minimal negative immigration from Modiin outwards.

But Shumacher says that while social, economic, geographic and educational reasons are important, the major reason is the real-estate aspect. “All neighborhoods in Modiin are considered good neighborhoods. There may be areas which are more expensive than others, but there are no ‘bad’ neighborhoods, and accordingly, there are no cheap neighborhoods.”

Modiin is an excellent city, with excellent people, but was considered ‘periphery’ until recently. However, in the past few years, this has changed and Modiin is now considered to be right in the center of the country. Accordingly, prices have gone up. “In the past, buyers sought apartments for 1.1 to 1.2 million NIS, nowadays they know that Modiin prices are very much like those in Ra’anana, Kfar Saba and Hod HaSharon. Today, they cannot find a four-room apartment in Avnei Chen for less than 1.7 million NIS,” says Shumacher.

Shumacher says that this is also true for businesses, “If in the past people would jokingly say that in order to get to Modiin one needs a visa, nowadays Modiin is perceived as closer to the center, and many businesses are considering moving into Modiin, due to its prime location.”

Who buys a house in Modiin?

While in most of the latest transactions buyers were local Modiin residents wishing to upgrade their homes, there is a slight increase in Jerusalemites looking into moving to Modiin. When Modiin was first inhabited in 1997, many new residents came from Jerusalem, as well as from Ramla and Lod, but Shumacher says that in the last few years, most of the newcomers were from the greater Tel-Aviv area, including Rishon LeZion and Holon.

The most expensive realty in Modiin (excluding Maccabim and Reut) is in the Shvatim (North Buchman) neighborhood. A 6.5room cottage on Dan Street, built in 2002 was sold at the end of 2013 for 4.35 million NIS, and today it is estimated at 4.8 million NIS. Another six-room cottage with a basement on Yosef Street was sold in 2010 for four million NIS. In the past five years there were about 20 transactions of 3.5 to 4

million NIS. Shumacher points out, that most cottages in this neighborhood were bought for $300350,000, which were then about 1.2 to 1.4 million NIS. In the 13 years since it was erected, the prices in HaShvatim tripled, some even are 3.5 times the original

price. This is not the case in other neighborhoods in Modiin, nor in other parts of Buchman, but only true for some of the cottages and streets in this neighborhood.

Reflecting Back...

R u t h & A n t h o ny R o s e By: Car yn Meltz Ruth and Anthony Rose were one of the first residents to move to Modiin in 1996. When they first came to see Modiin, the only indication of the city was a fallen sign that said in Hebrew, “Here will be built Modiin – The City of the Future”.

The Roses were living in Jerusalem at the time, and Modiin gave them the opportunity to buy a house with a garden.

They were looking for an environmentally friendly city and Modiin had shown potential. They looked at the plans for many homes and decided to buy on Tiltan, across from what would years later be the Maccabi building. In December of 1996, they moved in with a toddler and a newborn and as Ruth said, “It was a leap of faith.” A neighbor who they had known from their Jerusalem days, had moved in shortly before the Roses and brought over schnitzel, peas and rice on their first night in Modiin. She voiced to

her new friend, “What if Modiin doesn’t take off?” But within the first year they knew that Modiin was the right choice. Soon after, Anthony’s parents moved into the building and Anthony’s sister and family moved into the building next door. Their gardens faced each other and they thought they could “send” an onion over with a little toss. The aim was a bit off, it hit a pole and splattered everywhere.

There was no eruv, no shops, just housing and lots of construction.

The first year was a lot of dirt and a lot of flat tires (and many visits to Dror’s Tires).

Since Maccabim and Reut had been around since the mid-80s they could do their supermarket shopping there, however many residents opted to return to their former cities for all their other shopping needs. Country Center, the first center in Modiin, opened in January 1997.

The post office was in a red caravan and there was mail dispersed everywhere – some things haven’t changed much in 20 years!

The Anglo community started to trickle in from the very beginning and all the English speakers knew one another. Social groups slowly began to form and Modiin was turning into a community that others wanted to move to.

The city, however, had not anticipated the amount of religious people that would move here. There was hardly any religious life at the beginning. The Iriyah built the Kipodan shul where the Ashkenazim and Sepharadim davened together. As time progressed and the number of religious people that moved in increased, the services increased too.

Those who have been here since the beginning remember Ir Chofshit which is an anti-religious party, however, the residents of the city didn’t feel the tension and the secular and religious got along well in the city.

Ruth said that in their apartment complex, three of the eight apartments were religious and all the kids in the complex played together. It was never a religious issue, quite the opposite, it was proof of how they could live together.

Anthony was the only plumber in Modiin for about a year which enabled him to build up his clientele. It took just that long for him to be able to leave his Jerusalem clients behind and work exclusively in Modiin and the surrounding yishuvim where he works to this day as Modiin Plumbing/Instalazia Modiin.

Modiin is not as intimate as it was all those years ago, but that comes with the growth of the city. “It was nice to be part of something new, to get in on the ground and build up the city. In choosing a city, Modiin was a great choice. We would choose it all over again.”

Polly & Marc Sherman By: Car yn Meltz Polly and Marc Sherman moved to Modiin in October, 1997 from Petach Tikva. They were looking for a larger apartment and wanted to stay in the center of the country. They went to a housing fair at Ganei HaTarucha where they were swept away by the affordable housing plans that they saw. Even though Modiin was always projected to be a big city it was hard to imagine that from the start.

The construction of the apartment followed the development of their infant son Arieh. By the time they moved in, Arieh was a year old. It didn’t bother them that they didn’t know anyone when they first moved to Modiin because they knew that in time they would make their circle of friends.

Marc’s first friends were his bus buddies that he rode with every morning on his way to work in Tel Aviv, they called themselves the Modiin Mob. Another group of friends that formed was through the children. Many of the families that moved to Modiin had a baby around the same age as Arieh and were also looking to create a community life. It was like living on a yishuv

where everyone came to know one another.

The Shermans joined Yozma, the reform movement in Modiin.

Polly became part of the steering committee and was involved in setting policy. Arieh went to the Yozma gan for two years and then continued on in Yachad.

Yachad answered a desperate need for the new concept of “mixed marriages” – secular and religious families.

“Yachad was proof how tolerance can exist in the peaceful city of Modiin,” said Marc.

The differences between Modiin of today and yesteryear are very striking – today you can go to a social event and not know a soul. On Yom Haatzmaut there were plastic chairs set up in the amphi and could fit everyone who came. The main meeting point was the park – there was no mall, no going out for coffee. On Shabbat, everyone from all the different neighborhoods used to convene at the Country Center park.

A few years later, Polly and Marc adopted a baby boy, Lior. There was an enormous amount of food and help that poured in from all the friendships they had forged over the years. What was once a heap of mud in their backyard became a beautiful garden setting for their new son’s welcome home party packed with friends.

Polly is a household name in Modiin as she has delivered many of the babies (see article on right) from Modiin. She saw herself as the shtetl midwife and felt privileged that many of her friends wanted her there for their babies’ births. It gave Marc a sense of pride, too, and something to talk about on his bus rides. He even had to run a Tupperware party when Polly had to leave in the middle to deliver a baby. Polly said, “There is an enormous sense of pride to watch the babies that I delivered grow up and now go off and serve in the army.

Midwifery wasn’t the reason we moved here, but it became an added bonus.”

Modiin may be a bedroom community, but after a busy day of work in Tel Aviv or Jerusalem, it’s like a sigh of relief coming home to where they established their roots. “The best thing we ever did was to move to Modiin. We had an untold pride of being part of the initial making of the city. Our children grew up together and they will be able to tell their children how they met through the toddler group. We started in a city with nothing and built it into something. That’s making history,” Polly said.

Modiin’s First Birth

THE KEY MAN

I never had any intention of having a home birth. I was hoping for an easier labor and delivery than my first child, but I never anticipated what happened that day!

My husband, Avi, called a friend in a panic and asked her to pick up our son and take him to gan (he was in gan with her daughter).

Before I knew it, my water broke (luckily in the bathroom). Avi called Polly, the midwife, who had just gotten to her “day-job” in Jerusalem. She said to call MADA, get me on the bed, and to deliver the baby. I felt like I needed to push while my son was standing next to me and asking what was wrong. Avi called our friend again and bellowed (in a nice way), “Get here, NOW!” She was nine months pregnant herself, trekked up the stairs of our three-floor walkup, whereupon Avi basically threw Naftali at her to get him out of the house. At that point Avi told me to start puffing so I wouldn’t push.

He unlocked the door so MADA could come in, got me on the bed, and basically started to deliver the baby. I guess it was a good thing it was baby number two and not number one!

When the baby was at least halfway out, MADA came (and the guy thought he was being funny by saying it was a good thing I didn’t want an epidural!). They helped clean up the baby, cut the cord, etc. I wasn’t really able to move until the midwife came and she managed to get me a little calmer, delivered the afterbirth, etc.

After a little while, they took me and the baby, along with the midwife to the hospital, where we received whatever care was needed. Avi then had a chance to calm down and our friend saved the day by coming to clean up and save the mattresses.

Our Ezra was the first baby born in the city of Modiin!

I woke up quite early the morning of March 4, 2001 with contractions. Although occurring regularly, they weren’t so bad and they were still about 12 minutes apart. We figured we had loads of time, even when they moved to about 10 minutes apart. Only one problem – I had basically no “transition”. From 10 minutes apart they jumped to two minutes apart. It was about 7 am on a Sunday morning. We were 45 minutes from a hospital in either direction. My one-and-a-half-year-old son was still home. Everyone was basically on their way to work, taking their kids to gan, etc.

Rivka Klein-de Graaf & Steve Klein By: Car yn Meltz Rivka Klein-de Graaf and Steve Klein moved from Pisgat Zeev to Modiin on May 28, 1997 with their baby daughter, Gefen. Broken by the Jerusalem market and with the housing market soaring in Pisgat Zeev, Rivka and Steve, who made aliya from Holland and America respectively, were looking to buy an affordable home. They went to a housing fair in Binyanei HaUma and started to look at plans for Modiin.

Rewind to 1994 – Steve had taken classes in urban studies at Hebrew University and attended a seminar on Modiin in comparison to a city in both Holland and England. The conclusion was that the cities in Holland and England were better planned than Modiin and as a result the couple had resisted buying in Modiin. But with the Jerusalem market out of reach, Rivka and Steve decided to take the plunge and aren’t sorry that they did.

Although Gefen was only a baby at the time when they were looking to buy a home, they needed to think about education as well as their careers. There was already talk about bringing the Tali school system to Modiin and that was of high interest to the couple. (A few years later, Tali was turned into the Yachad school system.) Rivka, who practices homeopathy, was looking for a home with space for her practice and Modiin housing provided that solution as well. They found a five-room apartment with a garden in the Prachim area.

Rivka remembers that the sound of birds chirping was initially lacking because there weren’t any trees or greenery. There also weren’t any sidewalks – only dirt roads. A friend assured her, “One day this will all be green.” And in time, the sounds of nature were replaced by the familiar sounds of tractors plowing new homes.

At the beginning there was a feeling of loneliness especially since they only had one car which Steve took to work so Rivka was limited in where she could go with Gefen. A mommy and me group in English formed and once a week there were meetings with others from all over the city. Friends started to become family within the olim network.

Everyone knew each other. There were no street signs at the beginning (and barely any cellphones either), so that when their guests would visit Modiin for the first time they were able to ask on the street, “Do you know Dutch Rivka and American Steve?” and the answer was usually, “yes”.

Modiin became even more like home when Rivka’s parents made aliya from Holland and moved to the city in 2011. “Modiin was wonderful before but became amazing when my parents moved here,” Rivka said. Modiin spans the generations and it’s becoming more common for parents to follow their children to Modiin.

Although Modiin doesn’t have a high percentage of Dutch olim, Rivka was able to bring a piece of her culture to the city. She started, along with seven other families, a Dutch school in 2002 and the school received subsidies from the Dutch government. Thirty Dutch families from all over the country participated and they met once a week. The Dutch prime minister came for a visit during his stay in Israel.

Rivka’s practice from their home enabled her to be a stay-at-home mom to their two children. The practice had an organic growth that grew by word of mouth. Rivka said, “I have been practicing for 19 years, am still busy and love working with people in Modi’in!”

Twenty years later, they are living in the same home, driving the same green Mazda (and now Gefen drives that same car when she comes home from the army), but living with sidewalks, people and green everywhere.

Wedding Number One in Modiin By: Car yn Meltz Baruch and Shari Pilo were one of the first residents to move to Modiin. Baruch was working for a security company and was relocated to the Modiin area due to the new demand for alarm systems in the homes that were being built here.

They had both been living in big cities and Shari couldn’t believe that she was leaving a bustling city for a place without any amenities. On the first day in their new rental, Shari became distraught to the point where she started to repack. However, later that day, Baruch proposed, “Shari, we’re going to get married and bring up a family here.” Once he voiced those words, Shari was hooked.

The next step after becoming engaged was getting a marriage license. Although there was yet to be a physical Rabbanut office in Modiin, Rav David Lau had already assumed the position as Chief Ashkenaz Rabbi of Modiin. Baruch called Rav Lau to discuss the process – being an olah from Canada, Shari needed to provide the proper documentation to get married in Israel. Rav Lau drove around to other cities in order to meet their witnesses for the wedding and helped Shari’s oleh rabbinical

cousin obtain permission to officiate their wedding.

Shari and Baruch needed to pay the marriage license fee, but their upcoming marriage was the first one in Modiin and there was no official Rabbanut to pay. Rav Lau went to the neighboring cities to pay their fee but, alas, no one was willing to accept the payment. He told the couple that no one wanted their money and he stamped their license with the number “001” on it.

We lived in the Prachim neighborhood for five years and then in Buchman Tzafon for two.

Why did you choose to live in Modiin?

Jodi: It was a great location, the rent was very reasonable and we did not want an all Anglo community – funny how that turned out!

Josh: We had a few friends who lived here and were very happy and we liked the idea of moving to and contributing to a young and developing city.

How did you build up your business in a growing city?

Josh: I started by renting space in a small dental practice in the Prachim neighborhood until I was able to open my own place. I worked in other cities which enabled me to allow my practice to grow with Modiin and B”H it has.

Jodi: Like Josh, I rented studio space in another artist’s studio once a week. I figured I would have a place to do my own art work and start putting the word out there that there was a new therapist in town. Word of mouth brought in my first clients, who I will never forget. It is in their merit and in the merit of those they recommended that my practice has grown to be what it is today.

We now have the privilege to be working side by side in adjoining offices, which works great for both of us.

Is it harder today to run a business because there’s more competition?

Josh: I don’t think it is harder, I think that as the city grows, so do its needs.

Jodi: As a therapist, I find myself surrounded by talented colleagues.

Each of us working together to offer the residents of Modiin and its surrounding cities the best services possible.

What keeps you in Modiin?

Jodi: Our kids, our friends and our kids’ friends. Of course the fact that we both work so close to home is a big plus!

I grew up in Long Branch, N.J., and made aliyah to Modiin in the summer of 2005. After making aliyah in the seventh grade, I was a counselor in Tzofim Datiyim (the religious scouts) for numerous years and, while in high school, co-founded a youth group for English speaking olim, Aliyah Anonymous, in Modiin. During high school, I also ran Samantha’s, a small dessert catering business, where I catered a number of local simchas and sold desserts around the city for each chag. I have been contributing recipes and articles to Jewcy, Joy of Kosher, Aish Hatorah and My Jewish Journal, in addition to my website, avivharkov.com since high school. After graduating from the Orot Modiin Ulpana, I enlisted in the Israeli Navy, where I served as a Naval officer in the international relations department. I was then an emissary for World Bnei Akiva in Hong Kong, where I led the activities for the Jewish community’s children.

Modiin’s First Anglo Resident Reminisces on Modiin’s 20th Birthday By: Lisa Katz Shimoni We spent the first part of 1996 renting in Reut, from where we could watch both our newly purchased home and the newborn city of Modiin slowly rise up from the dust. It seemed like every time we drove down the dirt roads and newly paved streets of the construction site that people were calling Modiin, we got a flat tire. But those punctures did not deflate our excitement at watching our home and the city around it take shape.

At the time our home was being built, relations with the Palestinian builders were good. On our visits, we would discuss life and even politics with Ahmed from Hebron. Locals would even go to Beit Sira to buy plants and building materials.

I wonder today if our pleasant exchanges with the workers is the reason our home did not have the mysterious water problems experienced by many of the surrounding homes.

In August 1996, my husband Giora, six-year-old daughter Maytal, three-year-old son Noam and I (three months pregnant) broke into our Modiin home. Our rental agreement had expired in Reut.

Although our Modiin house was ready and waiting, the official “getting the keys” had been delayed by bureaucracy. The four-plus of us needed a place to sleep, and Giora and I needed an office. My boss at Microsoft in Seattle and Giora’s boss at CompuServe in Columbus, OH, USA were not going to accept missed deadlines due to Israeli bureaucracy. So, we felt we had no choice but to sneak into the house, where we spent the first few nights in Modiin in sleeping bags on the hard basement floor. When the local manager of our building company threatened to report us to the police, I took one of those steps toward “becoming Israeli” that all of us olim take over time. I looked him in the eyes, said, “We’ve paid for the house,” and walked away.

Being in the house was a relief, but the challenges of being in a new city still awaited us. To get the internet connection we desperately needed for work, Giora headed out

Modiin Celebrating into the nail-laden streets. He roamed until he found and befriended a Bezeq worker. Then he roamed some more until he found and befriended an Electric Company worker. He physically brought both workers together to our street’s electrical box where they connected those wonderful wires, so we could get on the grid, go back to work, and meet the mortgage payments on our new home. As a bonus, Giora’s new Bezeq friend let him pick one of the first phone numbers in the city.

September and the Jewish holidays arrived. On Rosh Hashana, we and the city’s few other residents received an encouraging and touching welcome plant from the Iriya. Then Modiin’s first minyan – a total of 10 men of both Ashkenazi and Sephardic roots from all over the city – gathered in the Dorot school for holiday prayer services.

Unfortunately, during the services, one of the 10 men decided he did not like the prayer nusach and left. And then there were nine. Some challenges bring out the best in us, and I believe that Modiin’s early minyan participants were challenged, more than in established places, to be welcoming and inclusive. Likewise, the challenge of the new city’s early lack of infrastructure meant that we and other families would host Friday Continued on page 34

night services in our yards and living rooms. Even the Iriya got into the hosting spirit – the head of the city’s religious department would deliver Kiddush refreshments to the minyan on Shabbat mornings, albeit by car.

Maytal went to first grade at Netiv Zvulun, which was housed in Dorot. This initial mixing of religious and secular in one school building was a preview of the “culture of tolerance” that would become a part of the city’s unique character in Israel. Noam went to a chaotic gan with an extremely unqualified ganenet. This experience taught me that I was going to have to speak up and even work myself to ensure quality education for my children in this young city. These early experiences with Modiin’s system of education, and others that followed, contributed to my participation in the founding of Yachad Modiin. I believe it was the brilliance and dedication of other Modiin residents, combined with the municipality’s openness to and even support of grassroots movements, that has enabled the creation and success of Yachad and other innovative, inclusive and quality organizations and programs in this city.

During our first year in Modiin, our most heartwarming “new city” event took place on March 7-8, 1997. Gilad’s birth on the prior Friday night meant a Shabbat brit in the new city. This would be the first brit to take place in Modiin, where no mohel yet lived. The only mohel we could find on short notice who was willing to spend Shabbat in the then dull and dusty city came with a wife and five children under eight years old. Thanks to the generous spirit of the city’s residents, places to sleep were found for the mohel’s family of seven as well as Giora’s

large family. And despite the unseasonably cold temperatures and even snow flurries, people walked to the brit in our home from all over the city and even Reut. And the house was magically filled with enough hot cholent and sweet kugel to feed everyone, including the shivering soldiers at the nearby checkpoint. Just six months into our first year here, Modiin had become more than a city. Modiin had become a community.

I have always associated the support and goodwill felt at Gilad’s brit with the city of Modiin. My theory is that if you have a place in which everyone at some point is “new”, then a friendly and welcoming culture is likely to develop. My great hope for this quickly growing city is that Modiin residents, who were once new but are now becoming veterans of this 20-year-old city, can maintain and nurture the city’s innate culture of kindness.

Defective Construction in Apartments Bought from Contractors By: Sigalit Handsher Farkash, Adv. & Notary How many times have you heard complaints about a contractor who built an apartment that turned out to have defects, which the contractor does not come to fix? How many times does the contractor ignore the repeated calls of the exasperated resident?

It is important to know that buying an apartment from a contractor means buying “on paper”. The home is still unbuilt or partially built, so the contractual documents include the apartment’s technical specifications (“mifrat tekhni”) and floor plans, which define how the residence will be constructed, the number of rooms in it, its location within the building, exposures to open air, and the like.

Before the apartment is delivered, there is a meeting between the contactor’s representative and the buyer, in which they tour the apartment and compare its actual condition with that stated in the technical specifications and floor plans. During

this tour, a protocol is recorded, in which the buyer notes everything that seems flawed under examination of a reasonable buyer. It must be noted that the presence of construction defects is not cause for refusal to accept possession of the apartment, unless the apartment is unlivable according to the determination of an engineer. During the course of one year, the contractor is obligated to repair the defects discovered during the tour. In the event that the defects under discussion are in need of urgent repair, the contractor must make the repairs immediately.

The first year in the lifecycle of the apartment is very important, since it is at this time that the contractor is obligated to repair any discrepancy discovered in the apartment, even a cosmetic defect such as paint or plaster. It is thus very important to inform the contractor, preferably in writing, of any defect discovered during the first year of the apartment’s

Modiin Celebrating life cycle. It is significant because even if the contractor repaired the defect, and the defect returned later, the contractor cannot dismiss it with the claim that the first year has already past. After the first year, the “maintenance period” (“tekufat bedek”) begins.

The duration of this period varies depending on issue, based on the Addendum to the Sales Law – Residential. For example, the maintenance period for defective pipes and plumbing is three years. For defects in the frame of the building, the maintenance period is seven years. The implication is that the contractor has an obligation to repair every defect discovered in the apartment during the maintenance period and which is addressed in the addendum to the law. If he refuses, he must prove that the defect does not stem from inferior workmanship or material, but is the fault of the buyer. At the end of the maintenance period, a warranty period of three years began, during which the buyer bears the burden of proving that the source of the defect is in the contractor’s inferior workmanship or materials, not any fault of the buyer’s.

Note that the buyer must contact the contractor within a reasonable amount of time from the discovery of the defect, and must notify him of the defect, giving the contractor a reasonable amount of time to repair the defect. I have encountered cases in which the resident notified the contractor of the defect by telephone and later had difficulty proving this notification. It is therefore important that the notification of the defects be in writing. It is recommended that one obtain an engineer’s opinion on the construction defect and the costs of repairing the defects before seeking monetary remuneration from the contractor.

The engineer’s opinion should be mailed to the contractor, preferably by registered mail, and accompanied by letter demanding either repairs or remuneration, depending on the case. If the contractor did not reply; or if he made the repairs but they were not adequate, and he then did not respond to further communications; or even if he made the repairs several times but the defect returned, he will have to relinquish the right to repair and instead indemnify the buyer monetarily.

Yes, that should be pretty much everyone. Now raise your hand again if that goal fell by the wayside.

Let me set the scene for you: We all have days when we don’t

There was a lack of information for newcomers, so with her perspective of being a new olah and with mine of someone who had already been living in Modiin, ModiInfo was born. We went around to stores selling ads with no product to show, but with the help of our two assistants – Sammy and Noa (our two babies at the time) – we were able to do it.

We still can’t believe how we were able to get that first 12-page one-color issue off the ground!

“A Taste of Torah” gives children of all ages fun access to the parasha.

Almond-Crusted Salmon with Lemon, White Wine and Scallion Sauce By: Aviv Harkov Excerpt from “A Taste of Torah”

On the next day, Moses came to the Tent of the Testimony and behold! the staff of Aaron of the house of Levi had blossomed; it brought forth a blossom, sprouted a bud and almonds ripened.

(Parashat Korach, Bamidbar 17:23) In this dairy dish you can really taste the beauty of the almonds.

It’s almost as if you can feel the sprouts featured in this week’s parashah blossoming on the tip of your tongue. Serves 6-8.

Ingredients Sauce 1 Tbsp. butter ½ cup scallions, thinly sliced ½ Tbsp. lemon juice 1½ Tbsp. white wine ¾ cup heavy cream Salt and pepper

Crust 2 lbs. salmon fillets Salt and pepper 1½ cups almonds (sugar and salt free) 3 Tbsp. breadcrumbs 3 garlic cloves, crushed 1 tsp. ground ginger ½ tsp. ground black pepper 1 Tbsp. butter 2 Tbsp. white wine 1. Start the sauce by melting the butter in a pan over a medium-low heat. When the butter has melted, add the scallions, sautéing them gently for 5–10 minutes, or until they begin to brown. Remove the pan from the heat.

Modiin Celebrating 2. Preheat your oven to 350°F. Place the salmon fillets in a large baking dish, skin side down, and sprinkle them with salt and pepper.

3. Begin to prepare the crust by crushing the almonds in a food processor for about a minute. Then add the breadcrumbs, garlic, ginger and black pepper to your food processor and combine well.

You can stop crushing them when the nuts are slightly larger than the breadcrumbs. Remove into a medium-sized bowl.

4. Melt the butter and combine it with the wine before adding the liquid into the bowl with the almond and breadcrumb mixture to create a paste. Spread it evenly on top of your salmon, pressing firmly to ensure it sticks, creating your crust.

5. Place the salmon on the top rack of your oven and bake for about 10–15 minutes or until it turns a paler shade of orange. The thicker your salmon fillets, the longer this will take.

6. Return the pan of browned scallions to a medium heat to finish up your sauce while the salmon is cooking. Add the lemon juice, white wine and cream to the pan. Stir and lower the heat until the sauce thickens slightly, 5–10 minutes.

7. Serve the hot salmon with the sauce, at room temperature, on the side.

Sous chefs can be in charge of making the crust. Let them place the ingredients in the food processor, whir it up, and then enjoy getting their hands dirty while they press it onto the salmon.

A Dvar Torah for Parashat Korach

They fell on their faces and said, “O God, God of the spirits of all flesh, shall one man sin, and You be angry with the entire assembly?”(Bamidbar 16:22) The Rambam asks why God threatened to punish the entire Jewish nation when only Korach and his group of followers had sinned. The Rambam answers that despite the fact that only Korach and his assembly rebelled, no one in the Jewish nation fought against his uprising. They allowed him to plant a seed of doubt in their minds.

Moses understood why God was angry at the entire nation and immediately defended Bnei Yisrael before Him. He also warned the Jews that they must separate themselves from Korach or face the same punishment. Ultimately the majority of the Jewish nation put their faith into Moses and God. Because of this, they were spared God’s wrath.

A Story about Having Faith in God When King David was just a boy, many years before he was anointed king of Israel, his father sent him to take food to his brothers, who were at war. When he came near to the battlefield, David found that there was a brief ceasefire in which one enemy soldier, a giant, dared anyone to face him in single combat, and so end the war. King Saul did not know what to do; no one wanted to fight the fearsome giant, Goliath. Young David stepped up and said that he was willing to fight Goliath. Everyone laughed at this – a child fighting the mighty giant? But David did not care. He told King Saul that he was a shepherd, and that he protected his father’s sheep from dangerous predators, such as lions or bears, all the time. He had complete faith that God would help him defeat the giant, just as He protected David from the wild animals.

King Saul decided to give the brave boy a chance. He gave David his own armor and a sword, but they were too big for him, so David faced the giant without armor. As he walked toward Goliath, David started to collect rocks for his slingshot. When Goliath saw who his opponent was, he laughed. This young boy?

He stood ready. The young David had faith in God; he loaded his slingshot and aimed carefully, at Goliath’s head. David hit Goliath smack in the middle of his forehead – and with God’s help, defeated the evil giant.
