• All affidavits of publication will be provided as digitally signed PDFs delivered via email.
• This is in full compliance with longstanding New York State law, which recognizes electronic affidavits statewide.
• Higher rates apply for wet-signed, postal-mailed affidavits due to printing, manual signing, and certified mailing costs.
• Customers must request a wet-signed, postal-mailed affidavit at the time they submit their legal notice for publication. Otherwise, an electronic affidavit will be prepared and delivered by default.

Local Emergency Order:
Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, May 2, 2025, May 30, 2025, June 27, 2025, July 25, 2025, August 22, 2025, and September 19, 2025 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.
And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

PUBLIC NOTICE
NOTICE IS HEREBY GIVEN that the Suffolk County Water Authority (“SCWA”), with an address at 4060 Sunrise Highway, Oakdale, New York 11769, held a public hearing on April 22, 2025 at 6:30P.M. with respect to real property, namely 164 Fifth Avenue, Bay Shore, New York 11706, (the “Premises”). The public hearing was held open until May 2, 2025 to allow for the submission of written material for SCWA to consider. Thereafter, SCWA issued Determination and Findings. The following is a brief synopsis of said Determination and Findings:
1. The purpose of SCWA’s acquisition of the Premises is to further develop and maintain the public water supply and distribution system that provides safe and fresh drinking water for the residents of Suffolk County. As part of the evolving efforts to protect and update the systems that treat emerging contaminants, SCWA has employed the use of Advanced Oxidation Process systems, of which Hydrogen Peroxide is a necessary component. Hydrogen Peroxide is required at every site where an AOP system is in use. At the time of the hearing, SCWA had 17 locations with additional systems planned. Consistent delivery of Hydrogen Peroxide to all locations has been problematic and in order to avoid any supply shortage, SCWA plans to centralize the storage of Hydrogen Peroxide at its Production Control facility in Bay Shore and then distribute to the individual sites through an internal delivery methodology. The site to be acquired is adjacent to the Production Control facility and will allow for expansion of the SCWA site to allow for the Hydrogen Peroxide storage.
2. The Premises are located at 164 Fifth Avenue, Bay Shore, New York 11706 (SCTM Dist: 0500 Section 366.00 Block: 02.00 Lot: 044.000).
3.The reasons that SCWA selected this location for acquisition is that the Premises are contiguous with the Production Control Facility, which is located at 180 Fifth Avenue, Bay Shore, New York 11706. The Premises are immediately adjacent to the facility’s current public parking lot, on the southerly border, and will easily allow for expansion of parking. This expansion then allows for space on the Northern side of the building to be converted from employee parking to storage for the Hydrogen Peroxide.
Further, the Premises is vacant and boarded single family building that has not had documented water usage since 2009.
4.The Premises will be redeveloped in a manner that is consistent with local zoning and other uses in the area, including an adjacent plot of land. SCWA finds that this lot is sufficient, appropriate and adequate for the proposed use and that redevelopment of this lot will remove blight and will be compatible with the surrounding character of the neighborhood and community.
5.The local community will benefit from the use of eminent domain to acquire the Premises because it will decrease blight and allow the SCWA to improve its ability to deliver safe, fresh drinking water to the residents.
6.The condemnation of the Premises will not result in adverse impacts on the environment.
7.SCWA finds that proceeding with the acquisition of title to 164 Fifth Avenue, Bay Shore, New York 11706 through eminent domain will provide for increased efficiency of SCWA procedures and help to protect the infrastructure of Suffolk County’s water system. As such, SCWA will proceed with the eminent domain of real property located at 164 Fifth Avenue, Bay Shore, New York 11706.
Copies of the Determination and Findings will be forwarded upon a written request without cost. There are 30 days from the completion of the publication requirement to seek judicial review of the condemnor’s determination and findings.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/Owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this g rant. No permits or approvals shall be granted prior to
the effective date of this change of zone.
10. Parking:
A parking relaxation is granted as part of this application. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems.
