I, Edward P. Local Emergency Order:

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, May 2, 2025, May 30, 2025, June 27, 2025, July 25, 2025, August 22, 2025, and September 19, 2025 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. PLEASE TAKE NOTICE that the County Legislature of the County of Suffolk, New York, will meet at the Evans K. Griffing Building, 300 Center Drive, Riverhead, New York 11901 in the Maxine S. Postal Auditorium, in said County, on the 15th day of October, 2025 at 2:00 p.m., Prevailing Time, for the purpose of conducting a public hearing upon a proposal for the extension of a Suffolk County Sewer District No. 2 – Tallmadge Woods (the “District”) to include part of the Port Jefferson Station area in and for said County, substantially in accordance with a certain report, map, plan and recommendations (the “Report”) transmitted to said County Legislature by the Suffolk County Sewer Agency, with the assistance of the Department of Public Works, at which time and place the Suffolk County Legislature will consider such proposal and hear all parties interested therein concerning the same.

Project Description

The proposed project is to extend the boundaries of Suffolk County Sewer District No. 2 – Tallmadge Woods (the “District”), to include a defined area within Port Jefferson Station, as an extension area to be known as Suffolk County Sewer District No. 2 – Tallmadge Woods, Zone A – Port Jefferson Station. With the extension of the District, it is the intention of the proposed project (the “Project”) to protect and improve the environment in the community, which has been limited in part by restrictions regarding wastewater disposal and minimize possible impacts to the environment. The connection of properties to sewer and the Project will reduce the environmental impact caused by underperforming cesspools and sanitary systems, by replacing such on-site systems with more reliable and efficient sewage treatment for the proposed Project area. The Project is being coordinated with the Town of Brookhaven. The proposed extension area to the District is approximately 31 acres and the Project will include the construction of sewer collection facilities within the proposed extension area that will enable connection to the existing facilities of the District for sewage treatment and disposal. The Project more specifically includes the construction of a gravity sewer system consisting of a network of pipes and manholes which ultimately discharge to a pumping station for conveyance to the District via a force main.

Notice of Cost

The proposed extension is proposed to be a separate zone of assessment of the District, to be known as Suffolk County Sewer District No. 2 – Tallmadge Woods, Zone A – Port Jefferson Station. Consistent with the law governing the District that is currently in effect, once the extension of the District is approved, capital improvement costs associated with being a part of the District will be charged to all rate payers within the proposed extension area on a benefit or Single-Family Equivalent (SFE) basis. Once the extension Project is complete and properties are connected to the District’s facilities, a user charge (for operation and maintenance costs) will also be charged, consistent with the manner by which current rate payers of the District are charged user charges.

The total maximum cost of the proposed extension project is estimated to be $29,514,100, with $28,864,100 estimated to be funded with federal grant funds. The remaining total cost of the Project not funded by the grants, which is approximately $650,000 of County serial bonds, will be paid for solely by the rate payers within the proposed extension on a benefit basis and the obligation will commence upon the establishment of the extension to the District.

As described in more detail in the Map, Plan and Report, the cost for the typical one-or- two-family home within the extension area the first year after the extension of the District is approved, under the current method for the collection of costs for the District (calculated by using the number of Single-Family Equivalents (SFE) within the extension) is $86.94 per SFE per year. Once the properties are connected to the District and the project is completed, which is expected to be in 2028, under the current method of collection, the property owners within the extension area that connect to the District’s facilities will also be billed a user charge (for operation and maintenance, consistent with the manner that other residential rate payers in the District are charged. The 2028 user charge for the District is projected to be $886 per SFE resulting in the total cost per typical one- or two-family home being approximately $973 and $1,946, respectively, which is to be paid by the property owners.

As described in more detail in the Map, Plan and Report, under the current method of collection of costs, the charges for a commercial property within the extension area will have the debt service charges, and the user charges once connected, determined based on a single-family equivalent of 225 gallons per day for the wastewater discharged in a manner similar to other commercial rate payers within the District, which will be prorated based on actual water use.

Each individual property owner within the extension area will be responsible for the costs to connect their property to the constructed facilities and the abandonment of existing onsite systems, with an average cost that is estimated to be up to $25,000.

It is anticipated that the current method of collection of the costs for the District, and in turn the Port Jefferson Station extension, will be replaced by the method of the collection of costs for the Suffolk County Wastewater Management District (“CWMD”) approved by the Suffolk County Legislature pursuant to Resolution No. 636-2024, as amended by Resolution No. 408-2025, that is to become effective January 1, 2026, and as set forth in the Map, Plan and Report upon which Resolution 636-2024, as amended, was adopted. Under the approved Map, Plan and Report for the CWMD, the cost to the typical property, which is a one- or two-family home that is connected to sewers is $702 for 2029.

As stated above, the proposed Project will be largely funded with grant funding, and the remaining cost of the Project will be funded by County serial bonds, repaid by the property owners within the extension area.

Copies of the report, map and plan for the proposed district extension are available in the Office of the Clerk of the County Legislature, where they can be reviewed during normal business hours Monday through Friday.
