Ignite Nebraska BUILDING A HOLISTIC PIPELINE FOR IN-DEMAND JOBS

In the last 18 months, the nonprofit Ignite Nebraska has helped generate $800,000 in salaries for Douglas County. It’s on track to hit $3 million by the end of the year.

Participants of the flagship IT apprenticeship program are nearly doubling their incomes after finishing the program, putting them on the path to achieving economic and career stability.

While the numbers are impressive, the confidence and new opportunities gained by participants are paramount.

“One participant is so excited to enroll her kid in a summer program, which is something that she never thought she’d be able to do,” said Ignite Nebraska’s new Executive Director Kellee Mikuls.

All 14 graduates have continued employment at their respective partner organizations. Some are taking advantage of workplace tuition reimbursement programs to continue advancement at the company.

“That’s impact,” Mikuls said.

Hungry for change

Founded in 2022 by Joni Wheeler, Ignite Nebraska is a pipeline initiative aimed at solving what Mikuls calls a talent perspective issue, “not a talent shortage.”

“There are so many entry-level jobs open, and employers struggle with filling those price ranges,” she said. “We have individuals who are hungry to be a part of an organization and a culture, but they don’t know how to get there.”

For example, individuals may lack training in soft skills, such as interpersonal communication or time management.

There are also more complex issues affecting individuals that many may be aware of, such as the “benefits cliff.”

In a LinkedIn post, Mikuls, who has over 3,500 followers, spoke about how despite her own experience accessing public benefits, she was unaware of the problem until she began at Ignite.

benefit of $800 a month,” she wrote. “That $2 raise is not going to pay for child care, so you reject the raise to be able to have a means of making a living.

“Image if I didn’t get that period of time of benefits. I wouldn’t have been the youngest shareholder at CBRE, or the founder of Swishboom, or the now executive director of Ignite Nebraska.”

When asked about the decision to share her story, Mikuls said that being vulnerable allows others to do the same.

“I grew up privileged to have so many safety nets,” she said. “Not everyone had that. This program helps people make a safety net for themselves.”

Indeed, the benefits cliff was a problem that Wheeler recognized early on when considering the structure of the inaugural program. Ignite Tech (I.T.) was designed to help mitigate the problem by gradually working participants up to full-time hours at their paid apprenticeships.

Activating potential

While Mikuls admits that other programs in Omaha provide accelerated IT training, Ignite’s program is different because of the integration between education and on-the-job training.

“We know that having guaranteed jobs ahead of when we have participants is hard work,” Mikuls said. “That’s why many of our nonprofit counterparts aren’t doing it.”

Bellevue University is the academic partner for the program, providing instruction on data analysis and visualization basics, as well as modern workplace (help desk) skills.

Participants are assigned a paid apprenticeship with a corporate partner — Union Pacific, Blue Cross & Blue Shield of Nebraska, or Boys Town — where they apply the skills learned at Bellevue University.

Over the 24 weeks, Ignite also works with participants to increase their soft skills, such as handling workplace conflict resolution and managing deadlines.

Because participants are going through the program as a cohort they can build a support network.

“For a lot of our participants, this is the first time they have peers cheering them on,” Mikuls said.

By the end of the 24-week program, participants will have credits toward

a computer science degree and a guaranteed job at the corporate partner organization.

H3 jobs

Initially, Wheeler selected IT as the starting point for the organization because the field is in demand, therefore offering high-paying positions and career advancement opportunities.

The same tenants are applicable for the second program, launching this Summer. The 10x10 program is focused on entry level, office-jobs.

A basic search on Indeed for entry-level positions in Omaha at the time of this writing included over 5,000 open positions. These positions range from a surgery scheduler at Midwest Eye Care to a records management assistant at Kutak Rock to an underwriting specialist at the National Indemnity Company.

The 10-week program will teach a variety of in-demand, entry-level skills, such as Microsoft 365, basic accounting, CRM software, and more.

Participants will have access to soft skills training, benefit and resource counseling, and professional and personal support services through one-on-one and group group coaching.

“Our 10x10 Program is a great way for a wide variety of Nebraska employers to get to see the amazing talent we have in our community,” Mikuls said.

Chance for fulfilling work

While the I.T. and the 10x10 programs share many similarities, there is one major difference. Participants of the 10x10 program are guaranteed a job at completion but aren’t automatically matched with an employer.

Because the skills learned are universal, to an extent, participants and partner employers will be able to screen each other at a matching event.

During the event, which takes place in the fifth week, participants and potential employers meet and then rank each other.

“It’s more about a culture fit,” Mikuls said. “We’ll make sure they have the skills; we are the insurance policy.”

Ignite is looking for employment partners for both programs and said any company with an entry-level position could be a great candidate.

“We can also upskill someone who is entry-level if they are interested in going into IT,” Mikuls said.

If there were any lingering doubts as to the scope of intellectual property theft in the United States, 2023 served to extinguish them.

According to statistics gathered by the National Intellectual Property Rights Coordination Center, intellectual property theft in 2023

and the financial cost these crimes inflicted on American businesses increased substantially since the previous year.

The incidence of IP theft was up 21% year over year and indictments of perpetrators were up nearly 100%. The total estimated cost from intellectual property thefts increased 36% over that period,

from $822.3 million to $1.12 billion.

Two pieces of federal legislation appeared: the Protecting American Intellectual Property Act, signed into law in January 2023, and the American IP Defense and Enforcement Advancement Act, introduced last summer. Additionally, the Department of Justice formed a new unit, the Disruptive Technologies Strike Force, to address the illegal transfer of sensitive technology to foreign adversaries.

Learning curve

Despite the alarming prevalence of intellectual property crimes, many companies are still woefully unaware of how to protect themselves.

“A lot of beginning entrepreneurs do not realize that they even have intellectual property, do not understand the types of intellectual property they might have, or that different types are protected in different ways,” said William Hale, Sioux City managing partner with

“If they have an invention and that product goes to market or is sold or provided to others prior to submitting a patent application, it is likely too late to get a patent and protect the invention. Also, if they become aware that someone may be infringing on their IP and do not seek to protect it, it could be considered a ‘waiver,’ and they may lose some rights to the protection.”

Hale said even those companies with the acumen and foresight to protect their intellectual property initially may be unaware of the limitations of that protection, which can be critical as they grow.

“The core principles of intellectual property law have not changed much over time, however with the online world we have seen more of a likelihood for international IP theft than we would have seen before,” he said. “It is now easier for smaller companies to be known more globally, and so it increases the geographical distance of the threats that are faced.”

It is important for entrepreneurs to understand the various forms of IP and how best to protect them.

The issues surrounding the protection of intellectual property have only become more complicated with advancing technology such as artificial intelligence. With AI software that can imitate the art of working designers, for instance, ethical and legal issues arise when

“Advancements in artificial intelligence create opportunities and create complications,” said Chad Swantz, attorney and co-owner of Suiter Swantz IP. “Artificial intelligence is a tool to assist in the protection of intellectual property but may also serve to assist competitors to develop non-infringing products.”

Swantz said entrepreneurs need to take action and precautions to protect sales and prevent infringes as much as possible as digital piracy is on the rise.

With all of the pitfalls and vagaries that come with this area of the law, the advice of experienced counsel is becoming crucial.

“Intellectual property protection, including registering trademarks, can prevent competitors from unfairly selling off the goodwill of your registered trademarks,” Swantz said.

“In our firm, we specialize in working with entrepreneurs for the protection of their intellectual property, including trademarks, copyrights, patents, and trade secrets. We are typically involved with the client from the creation of the intellectual property, protection of the intellectual property, and enforcement of the intellectual property.”

Getting help

Tom Langan, an attorney with the Dvorak Law Group, said business owners should seek legal advice sooner rather than later to map out a strategy that protects intellectual property while not infringing on someone else.

“From a trademark perspective, we stress to clients that there is a difference between whether the entity name is available with the applicable Secretary of State’s office and whether it is available from a branding perspective,” he said.

“Even if the entity name itself is available, more analysis is necessary to determine whether it infringes on the intellectual property rights of any other business with a similar name in a similar industry.”

Langan recommends seeking counsel before investing in developing a brand.

“Some of the more difficult conversations we have are when business owners receive a cease-and-desist letter informing them that their name is infringing and needs to be changed,” he said.

concerning its intellectual property should be revisited regularly, Langan said.

“The legal relationship oftentimes depends on the entrepreneur’s risk tolerance,” he said. “At a minimum, though, we encourage seeking legal counsel prior to major events, including making a significant purchase, incurring debt, and selling the company to a third party.”

Protecting what’s yours

As for what to look for in a qualified legal team, Clint Cadwallader, chair of the Intellectual Property Practice Group at McGrath North, urged prospective clients to do their homework.

“There is often much more behind protecting intellectual property than just securing a registration,” he said. “A qualified intellectual property attorney can also assist with guiding entrepreneurs with the universe of other issues that IP touches.

“These may include employment and proprietary rights agreements, commercializing IP, license agreements, policies and procedures, the acquisition or sale of IP, non-disclosure agreements, and enforcement of intellectual property rights.”

As pressure to protect intellectual property is likely only to increase in the future, companies must get up to speed quickly to minimize their risk.

“For many companies, their most valuable asset is their intellectual

property. It is important for entrepreneurs to understand the various forms of IP and how best to protect them,” Cadwallader said.

“While this is an upfront investment, it is often more expensive to ‘clean-up’ legal issues that could have been prevented early on through appropriate intellectual property protection.”

Historically high demand for lawyers as well as legal support staff is driving new and expanded programs to attract and develop talent.

A confluence of factors has resulted in a job market that decidedly leans in favor of the legal professional, be it an entrylevel lawyer, a lateral mover, or a support professional such as a paralegal.

In fact, the market for attorneys with experience moving to another position in another firm or business – those lateral hires – is the hottest it’s been in the last 30 years, according to Dave Sommers, executive director of the Omaha Bar Association.

“Attorneys are in high demand across all areas of practice in the Omaha metro area, and this trend has accelerated significantly in the past two to three years,” Sommer stated. “New attorneys are finding many job postings that, five years ago, would have been only available for laterals with years of experience.”

Even more pronounced is the need locally for paralegals, assistants, secretaries and other legal support staff.

“One of the best decisions a high school senior could make right now is to go get a two-year associate’s degree in paralegal studies and/or a certificate in stenography,” he said. “The jobs for legal support staff are everywhere, not just in law firms, but also in courthouses and nonprofits.”

It could be argued, Sommers said, that the salaries and hourly rates for support staff don’t reflect the demand for their services.

“Someone applying should always consider countering the offer made by the employer,” he added.

Sommers isolated a trifecta of drivers, starting with the significant shoes left to be filled as baby boomers exit practices.

“One attorney with 40 years of experience or one senior paralegal might have the ability to do the work of two to three hires,” he said.

Costlier and longer cases represent a second factor, an issue Sommers said could be helped by leaning into mediation and arbitration as an alternative form of dispute resolution. Lastly, he spoke to a “sizeable rise” in smaller businesses hiring attorneys as

general counsel in the face of more and ever-changing regulations.

“These smaller businesses are finding that model of one attorney in-house to be much more cost-effective than having a private firm attorney on speed dial,” Sommers noted.

The OBA has responded by launching a job placement service for attorneys looking to move to town or to switch jobs in town.

“The market necessitates that we don’t have the luxury of letting people move out of the area or out of legal practice if we can help it,” he said. “So, the OBA is committed to finding better fits for attorneys in the area.”

He suggested avoiding the mindset of demanding attorneys be a “shark/bulldog” who inspires fear.

“There are attorneys who fit this description who will lead with disruption, drama and court filings that will cost you a lot of time, emotional bandwidth and money,” Sommers explained. “A great attorney will focus on what is most efficient and the best value for you and your business and may push back against your request to file a lawsuit as not worth it in the big picture.”

Firms take action

Ruth Horvatich, shareholder and recruiting committee chair at McGrath North, said the firm is always looking for attorneys skilled in specific niches or practice areas.

“But we also look for well-rounded attorneys who like practicing law,” Horvatich said.

She encouraged candidates to thoroughly research firms they are interested in and network with attorneys at those firms to learn about the organization’s culture. Overall, she characterized it as an exciting time, as the next generation of attorneys takes the reins.

“As more senior attorneys retire or adjust their practices, the opportunities for experienced attorneys are on the rise, which in turn offers opportunities for entry-level attorneys,” Horvatich said.

McGrath North has primarily grown from its summer associate/ law clerk program, which she said capitalizes on recruiting top candidates from law schools in the Midwest who consistently stay with the firm throughout their legal careers. There are considerable

implications of having a pipeline of talented legal professionals.

“Society benefits from a reliable system of justice, both in the criminal courts and the civil courts,” Horvatich said. “When the market for the attorneys is attractive — as it is now — the quality of lawyers increases, and society benefits through increased reliability in the justice system.”

David Goeschel, shareholder and recruiting committee chair at Koley Jessen, also spoke to the local and statewide implications of retaining talent in Nebraska and attracting new professionals from beyond our borders.

“We feel incredibly fortunate to have such strong relationships with two in-state law schools (University of Nebraska-Lincoln and Creighton University) that do an excellent job educating and preparing students for life after law school,” Goeschel said.

That said, the candidate pool naturally remains smaller than other markets.

“It will be an ongoing challenge for Omaha and broader Nebraska to continue to attract and retain enough talent to allow for growth in our legal market and the broader business market,” he said.

Overall, Goeschel said Koley Jessen characterizes the local legal market as strong, with diverse private practice, in-house and public sector opportunities across experience levels — be it firms hiring law school grads or companies seeking more experienced attorneys to fill specific needs.

Specific to their firm, he said all areas are growing.

“So, our focus isn’t just on their skill sets, but on ensuring candidates are the right fit for our culture,” he explained.

Be open to opportunities

The Omaha Jackson Lewis office is actively seeking lateral partners, according to Kenneth M. Wentz III, office managing principal and attorney at law.

“Ideally, with a transportable client base, and associates with three or more years of experience,” he added.

Wentz urged attorneys to gain as much courtroom, client-facing and writing experience as possible in their first through fifth years, and to seek feedback from peers and colleagues. Those with three-plus years’ experience, he said, will likely have their pick of positions. Anyone looking to make a change should embrace an informal meeting with someone at said firm or company.

“It is a great way to get to know the people and the culture,” he said.

Given the abundance of opportunities, Wentz was struck by Omaha’s low “attorney mobility.”

“Many attorneys clerk for a firm in law school, are hired by the firm and then stick with the firm for most of their legal career,” he said.

At pivotal years three to eight, Wentz indicated one should consider ways to enhance their ability to develop and cultivate business, grow as leaders, and participate in mentorship in the office and firm. For instance, Jackson Lewis mentees are paired with attorneys across the country in various practice areas. So, they gain well-rounded experience in employment law. For those with 12- to 15-years, Wentz said attorneys may have a book of business and specialized practice that, again, commands a premium when moving laterally.

“This is similarly true for attorneys who have spent time in judicial clerkships and government agency practices — you have extraordinary value, given your knowledge and expertise,” he added.

Stories at the Fencepost LONGTIME COMPANY QUALITY FENCE GETS NEW OWNERSHIP

BJ Ross recently traded in a job in corporate leadership to pursue a dream of being a small business owner. He purchased the 35-year-old Quality Fence Company, Inc., which was founded by Scott Harding with the help of his brother Jeff.

Ross, hailing from corporate America with 20 years of experience in logistics and distribution, searched for a company to purchase for a year. When he met the Hardings, he was attracted to their ownership style.

“I fell in love with Cathy and Scott and what they’ve built,” he said.

“I bought this company by their personality and culture.”

Ross counts his good fortune that Cathy, Scott’s wife, who joined the company around 10 years ago, remains working in the business in an administrative role. Scott Harding and his brother Jeff are active in commercial sales and the shop respectively.

Ross defined three key criteria as purchasing requirements for prospective ownership. The business’s financials, the existing team, and how the previous owners ran the company.

Part of the historical record built by the Hardings hangs on the walls of his office from framed Midlands Business Journal articles over the years. The average tenure of his 10 employees, running seven to 10 years, is a source of pride. The company partners with five subcontractors with over 15 years of experience.

“I think of myself as a process guy, focused on continuous improvement,” he said. “I was willing to bet on myself with this purchase.”

Ross felt that he would be able to learn the industry and take the company to the next level of leadership. His wife Kayla, a physical therapist by trade, now a small business owner, set up the company’s social media platforms. Ross looks forward to seeing his kids, now 9, 6 and nine-months-old grow up around his business.

New perspective

Ross sees his role as a game changer, skilled at asking questions and building action plans, but he also knows there are inherent challenges to be faced during his first year of ownership. Challenges include navigating the cost of materials and growing employees.

One of his biggest concerns is that the industry he now lives within is fragmented. Small companies of two employees can compete with larger operations for both commercial and residential projects. He said that residential work is running at a slower pace and commercial opportunities are saturated.

His experience includes serving six years on the board of directors for the Urban League of Nebraska, the last two as vice chair.

“It’s important to give back. There’s a lot of opportunity in education and the workplace,” he said.

He said his natural affinity for coaching and teaching transfers well. He likes to move quickly and understand the dynamics of a team.

“I lean on my faith and my family,” Ross said. “I want this business to be successful. I have invested a lot of money and have a family at home. Faith will continue to lead me.”

In the Business of Wine TOAST NEBRASKA WINE FESTIVAL GIVES

Many who visit Nebraska wineries come for a glass of cold Edelweiss in the summer months. The hearty grape varieties grown in our state attract tourism and consumer interest every year and the organization supportive of these homegrown businesses brings an opportunity for wine enthusiasts to sip on wines made by wineries throughout the state.

The Nebraska Winery and Grape Growers Association (NWGGA) will be hosting the TOAST Nebraska Wine Festival May 17-18 at Stinson Park in Aksarben Village.

The festival, which got its start in 2013, gives Nebraska wineries and grape growers an opportunity to share their wines with attendees. This year 17 wineries will be participating.

NWGGA serves as an organization to not only promote the local industry but to also provide quality assurance and education opportunities.

“We do this by hosting vineyard field days, training our viticulturists, conducting quality assessments, and providing education for our vintners,” said Alyssa Brodersen, executive director.

Brodersen noted that Nebraskans love their wine, and according to Wine America’s 2022 Economic Impact study, the industry generates close $1.28 billion in economic activity in Nebraska.

“Nebraska’s ‘wine country’ regions generate 14,000 tourist visits and $4.75 million in annual tourism expenditures, benefiting local economies and tax bases,” she said.

Most grape varieties grown in Nebraska are French-American hybrids, which are hearty enough to withstand the state’s weather.

Brodersen said varieties include whites such as Brianna, Edelweiss, Frontenac Gris, Itasca, La Crescent, La Crosse & Vignoles; and reds, including Frontenac, Chambourcin, DeChaunac, Marecha Foch, Marquette and Petite Pearl.

The festival will also include 47 vendors to compliment wines available during the event.

Blue Cross and Blue Shield of Nebraska (BCBSNE) recently partnered with Husker Athletics for Touchdown for Teachers (T4T), recognizing the educators who go above and beyond to support their students and improve their communities across Nebraska.

Through the T4T campaign, community members are asked to nominate an educator who has impacted their lives for the Outstanding Nebraska Teacher Award. In total, the campaign received 850 nominations from across the state.

Julie Eastridge – Kindergarten teacher at Black Elk Elementary School, Omaha

Eastridge has taught many students during her 35 years as an educator, making learning fun and engaging for each one.

“She has given so much of her time as an educator, but also wears many other hats throughout the day,” one nomination said. “She always has a positive attitude and makes everyone feel part of the family when you walk in the room.”

Becky Lindgren – Math teacher at Elgin High School

Lindgren has inspired students for 33 years, and this year, fought and won her battle with ovarian cancer. Despite chemo treatments, Lindgren continued to show up, putting her students at the top of her list.

“My son having the opportunity to watch her persevere through her treatments with a positive attitude and determination is something I’ll always be grateful for,” one nomination said.

Monica Maly – Special education teacher at Blair High School

A special education teacher for the last six years, Maly has thought creatively to offer spaces, opportunities and specialized plans for her students to feel like they belong somewhere and have a place to succeed.

“Monica goes above and beyond, nurturing minds and hearts alike,” one nomination said. “Her passion for education and community upliftment

serves as a beacon of inspiration.”

Tami Phillips –Sixth grade teacher at Sargent Public Schools

For the past three years, Phillipps has battled stage four colon cancer while continuing her role as a teacher and volleyball coach and impacting each student she teaches.

“Tami is the type of teacher every student wishes to have throughout their school years,” one nomination said. “Her room is always inviting, and often times, over her lunch hour, one will find students in her room simply catching up.”

Brianna Richards – Special education teacher at Fullerton Elementary School, Omaha

For 17 years, Richards has gone above and beyond, working countless hours teaching, creating support plans and modifying activities to help her special education students be independent and successful.

“She works countless hours teaching and helping children with special education needs,” one nomination said. “She spends extra hours creating individual education plans, putting support plans in place and modifying activities to help her students.”

In April, Herbie Husker, representatives from BCBSNE and Husker Athletics and the school’s administration surprised each teacher with a football signed by Matt Rhule, the Husker’s head football coach, a framed certificate and tickets to attend the Nebraska Football Red-White Spring Game.
