Examining ACT Government Procurement Values and Industry Feedback

Welcome to the June edition of Canberra Builder: an edition focused on demonstrating the roles of the ACT Government’s Procurement Values in the building and construction industry. The Procurement Values are:

> Aboriginal and Torres Strait Islander economic participation

> Business development and innovation

> Diversity, equality and inclusion

> Environmental responsibility

> Fair and safe conditions for workers

> Transparent and ethical engagement

This edition highlights how these issues are at the heart of many of our local companies and how the values often overlap. Many local companies began addressing diversity and inclusion when the founders immigrated to Australia. These companies are now at the leading edge of recruiting more women into our industry, as well as supporting the training of apprentices and new entrants to the industry. Local companies are now also emerging as leaders in employing Indigenous workers and apprentices as we lead a more diverse and inclusive industry. The broad perspectives these workers bring onboard allow their companies to develop more innovative practices and encourage fair and ethical operations.

After speaking with many of our members over the past few months, it is obvious that the headwinds facing our industry are continuing and in some cases are getting stronger. Some recent ABS data provided by MBA Australia illustrates the challenges, including:

> ACT new home building approvals declined 57.7% in March 2023 compared with March 2022.

> While feedback from subcontractors indicates a strong demand for additional workers, official data is mixed –demand for concreters and construction managers has increased in the 3 months to April 2023, while demand for another 12 occupations has declined.

> Insolvency data shows that, Australia-wide, construction insolvencies were on par with the 10-year average until March 2023, but are starting to spike upwards.

> Cost increases for building materials have slowed in the March quarter, but still increased by 1.6% overall, and are 11.4% up on a year ago.

A lot of what we are seeing here is the hangover effect from COVID-19, which saw supply chains disrupted and a massive spike in demand for renovations and building followed by a rapid rise in inflation and interest rates.

These challenging and uncertain economic times mean that now is an important time for the MBA to be closely engaged with all of our members. To do this we encourage all members to attend our sector meetings and contact us when you need help. As we navigate through these interesting times, talking, listening and supporting each other is another strength of our industry and our MBA.

Our ACT based team of more than 40 specialists in safety, construction law, training, carpentry and insurance are here to help all of our members.

Finally, I would like to welcome Mark Bauer, CEO of Manteena, who has filled the role on the Executive Committee as Commercial Sector Representative until the next election for Commercial Sector Chair later this year. I would like to thank Matthew Rayment for his service to the MBA ACT Executive Committee.

Responding to Industry Reforms and Member Survey Results

As Frank has explained in his introduction, there are a multitude of factors currently challenging our local building and construction industry. In some cases, reforms being progressed by the ACT Government are complicating and compounding these challenges.

One of the most important reforms currently underway is the reform to the ACT’s planning system. This reform has been ongoing for a number of years and is now nearing completion.

The MBA has supported the reform project from the beginning. We all know about the approval delays, problems and uncertainty contained in the current system, and the risks of third-party appeals. While we support improvements to the planning system, it is important Government moves forward in a way that addresses the various issues raised in the submissions to the draft Territory Plan, allows adequate transition time, and supports industry with education and training in the new system.

At the same time, we have called on the ACT Government to take the opportunity presented by the planning reform project to address our chronic housing supply shortage and make changes to the RZ1 zone housing rules.

Other ACT Government reforms we are currently managing include:

> Codes of practice for silica dust, formwork and psychosocial risks and hazards

> Developer regulation

> Implementation of the National Construction Code 2022

We will keep all members informed on the progress of these reforms through our member updates and sector meetings.

I would also like to thank all members who participated in our bi-annual member survey. The results of this survey demonstrated the following:

> Our member profile is showing that, on average, members are becoming younger and more digitally savvy and participation from female members has increased.

> Overall, member satisfaction is very high.

> There is demand for more short course training, especially in the area of business management skills.

> Consumers who have recently engaged an MBA member have a high opinion of MBA members, with the majority believing that MBA membership is a sign of quality.

Thank you to everyone who contributed to the survey results. We will be using this information and feedback to better tailor our processes and services to the needs of our members.

ACT GOVERNMENT PROCUREMENT VALUES with Major Projects Canberra

The ACT Government undertakes procurement with a focus on ensuring the government’s decision-making is aligned with community values while supporting the Canberra economy and local jobs growth. There are many considerations that inform these procurement values, as outlined in the Charter of Procurement Values

At Major Projects Canberra (MPC) we are committed to delivering a range of ethical, environmental, economic and social benefits through our purchasing practices and processes in the construction and construction related services space.   MPC strives towards our social objectives to encourage and enable women to reach their potential in construction. The ACT Government’s Women in Construction Procurement Policy puts gender on the tender for construction contracts, supporting the commitments made through the ACT Women’s Plan 2016-26 to establish procurement that prioritises contractors who set targets for the number of women employed, improve working conditions for women in construction and/or have plans in place to achieve gender equity in the workplace.

To ensure government procurement has a positive impact on our physical environment and ecosystems, the ACT Government has committed to a target of net zero emissions in the ACT by 2045. The ACT Climate Change Strategy 2019-2025 set a target to reduce emissions from ACT Government operations by 2040 through environmental responsibility and sustainability practices.

The ACT Government is committed to increasing local capability and economic benefits for the Canberra Region when determining the best available procurement outcome as well as supporting economic participation of Aboriginal and Torres Strait Islander Enterprises with procurement supporting training, skills development, and self-determination.

Inclusive practices and transparent and ethical engagement, with fair and safe workplace conditions and environments for workers, are well embedded values in procurement processes, often represented through the use of standard evaluation criteria and contractual obligations.

MPC looks to work in partnership with industry in achieving the range of procurement values, and encourages industry to bring forward innovative ideas and solutions to deliver the intended benefits the procurement values provide for our community.

In responding to approaches to the market, industry may consider what they can offer to support the achievement of one or more of the Territory’s values. The Value for Money commitment (as outlined in the Government Procurement Act) requires the consideration of both financial and non-financial factors that contribute to the achievement of the optimal procurement outcome.

There is remarkable progress being made on infrastructure projects for the growth and renewal of Canberra and the community. MPC looks forward to continuing to work with our construction partners, recognising and supporting innovation and encouraging aspirational targets in the construction space to achieve ethical, environmental, economic and social benefits.

There is remarkable progress being made on infrastructure projects for the growth and renewal of Canberra and the community.

SHIELDS TO SUCCESS: Rork Projects’ Indigenous Engagement Strategy

Brian O’Rourke and John Paul Janke have been friends since first meeting in Grade Four. At that time, they founded their childhood friendship on mutual support and learning. Throughout the years it has grown to an empowering dynamic that has carried over into their business relationship as Co-Owners of Rork Projects.

Together, Brian and John firmly believe that, as an Indigenous business in a privileged position, they want to – and need to – make a tangible difference to employment and business opportunities for Aboriginal and Torres Strait Islander people. Brian and John believe that this support not only enhances and enriches Rork Project’s company culture, but also that of their clients, networks and the wider community.

To that end, Rork Projects’ Indigenous Engagement Strategy was developed and an internal Indigenous Engagement Committee was formed to support the execution of the strategy. Brian and John worked to define the goals, ideas and outcomes they want to pursue in consultation with their employees, who work with them to drive the implementation of the strategy. From an internal perspective, the strategy helps to maintain the team’s focus and keep them accountable to themselves, clients, contractors and communities. Having clear guidelines, standards and goals enables every staff member to understand the importance of their role in encouraging stronger social understanding and participation in Indigenous issues, as well as how they can influence and encourage positive change. John stated that, ‘I’m extremely proud of the fact that our employees are pushing us and challenging us. They are asking questions, asking what we can do better and how we can be better.’

Together, five key areas of focus were developed:

1. Driving change through awareness

2. Supporting Indigenous business and employment opportunities

3. Creating opportunities for clients by raising cultural awareness and increasing Indigenous engagement

4. Influencing a nation to understand Indigenous issues and participate in creating positive change

5. Supporting indigenous excellence through the education and empowerment of Aboriginal and Torres Strait Islander students

Ultimately, Rork Projects’ Indigenous Engagement Strategy aims to ensure continuous improvement, help influence the commercial sector on Indigenous issues and support opportunities to drive change together. Some of the goals are more challenging than others so the rate of progress does vary between each of the projects, but, importantly, there is always progress.

The initiatives brought about by the Indigenous Engagement Strategy have opened Rork Projects to many new networks and partnerships. The team proudly joins and supports many corporate clients and business partners to celebrate

JobTrainer Women in Civil Construction Program

Master Builders ACT & SPARK have partnered for a 3rd time to deliver the JobTrainer Women in Civil Construction Program.

Industry data collected by Master Builders Australia in April 2023 states that 10.9% of all construction workers in the ACT are women. This innovative program aims to encourage the participation of women in the civil construction industry by setting them up with fundamental skills and knowledge to begin their career. The training and employment pathways gained from the program can be used to access roles across the sector, including those in the planning, design or creation of major infrastructure projects.

The nine-week program commenced on Monday 1 May 2023 with 14 eager participants aged between 17 and 59, many of the participants being single mothers, and all interested in entering the civil sector.

By the time each participant graduates on Wednesday 28 June 2023, they will have completed 7 core units of competency from the Certificate III in Civil Construction Plant Operations, as well as the following training:

> Crystalline Silica Exposure Prevention

> Manual Handling

> Bullying and Harassment

The program also includes a range of workshops such as resilience, mental health and wellbeing, time management and yoga.

To ensure participants learn each skill in the most supportive environment, all training takes place in the Master Builders ACT training rooms and workshop. To support the participants learning, they also undertake a total of four weeks of onsite work experience with one of our civil contractor partners. Further, SPARK provides wrap around support to participants throughout the program.

This program was made possible through JobTrainer and is a jointly funded initiative of the ACT and Australian Governments.

Increasing Female Participation in Construction Industry STARTS AT SCHOOL

The proposed policy will require suppliers who are tendering for ACT Government construction contracts estimated at $5 million or more to:

> meet set targets for the number of women employed in different job categories (e.g., tradesperson, apprentice and leadership roles)

> improve working conditions for women in construction

> have internal plans in place to achieve gender equity in the workplace.

CEO Michael Hopkins said, ‘For there to be a material increase in female participation in the building and construction industry we need to engage with females, their parents and career counsellors at school and present the wide range of career opportunities available in the building and construction industry.

Existing industry-led programs that provide entry-level training and paid work experience have been successful in securing sustainable employment opportunities for women in the building and construction industry. This includes the Women in Civil program run by Spark Ginninderry in collaboration with MBA ACT, which you can read more about on Page 16, and the Women Building Australia program, featured on Page 49.

The ACT Government could build on the success of existing programs by providing an increased sustainable funding stream for industry associations to continue and building upon the existing success of these programs.

Without increasing the pipeline of young women entering the industry, and providing a wholistic workforce development strategy, any attempt to mandate targets won’t provide a sustainable increase in female participation in the building and construction industry.

The MBA’s blueprint for future-proofing the building and construction industry’s workforce identifies that 6,982 building and construction workers will be needed in the ACT by November 2026 to meet demand. This is a fantastic opportunity to attract more women to the building and construction industry to meet industries need.

At a time when the building and construction industry is experiencing long-term workforce shortages employers are already focused on sourcing more women into construction roles.

With a collaborative effort between employers, educators, parents and industry, the ACT could be a leading jurisdiction for increasing female participation in the building and construction industry.’

SEXUAL HARASSMENT SOUNDS LIKE:

Why won’t anyone call it out?

Sexual harassment is never acceptable.

Sexual harassment isn’t always what you might expect. It might be unwelcome touching, suggestive comments or jokes, sexualised nicknames, intruding into personal space or unwelcome personal questions and comments - in person or online. It doesn’t matter who the person is or how small, hidden or innocent the behaviour may appear, sexual harassment should be reported every time it occurs.

You should report all sexual harassment to your manager, human resources team or WHS representative. If these internal processes fail, you can report your concerns to WorkSafe ACT and our psychosocial team will look into it. You can even report it anonymously. If someone sexually assaults you at work, you should call the Police immediately on 000.

Sex Discrimination – POSITIVE DUTY

On 28 November 2022, the Anti-Discrimination and Human Rights Legislation (Respect at Work) Bill was passed by parliament and introduced a positive duty on employers and persons conducting a business or undertaking (PCBU) to eliminate:

> workplace sexual harassment, sex discrimination and sex-based harassment;

> conduct that amounts to subjecting a person to a hostile workplace environment on the ground of sex;

> and, certain acts of victimisation.

This places a legal duty on the employer and PCBU to shift their focus from dealing with workplace sexual harassment, discrimination and victimisation from a reactive perspective, to taking proactive measures that are reasonable and proportionate to prevent this from occurring. What is considered ‘reasonable and proportionate’ will be different for each company and depend on factors such as the size, nature and resources available to the company.

In the event that an employer or PCBU fails to take all reasonable steps to prevent workplace sexual harassment and discrimination from occurring, the employer and PCBU may be held vicariously liable for the misconduct of its employees.

WHAT DOES THIS LOOK LIKE IN PRACTICE (A FEW EXAMPLES):

> Gender mainstreaming: this implies casting a gender neutral lens over all workplace policies and processes to determine if they treat women equally.

> Assessing workplace culture: an assessment of the workplace and its activities should be done to identify if there are any barriers preventing women from participating, and removing those barriers.

ENFORCEMENT:

From December 2023, the Australian Human Rights Commission (AHRC) will be able to monitor and enforce compliance with this positive duty through a range of regulatory tools such as conducting inquiries and issuing compliance notices.

In the current transition period all employers and PCBU’s are encouraged to implement reasonable and proportionate measures to prevent workplace sexual harassment, bullying and victimisation before the AHRC comes knocking.

Parkes Way/Coranderrk St Roundabout Signalisation

This project involved signalising the Parkes Way/Coranderrk Street roundabout to accommodate the high flow of surrounding traffic. The project works included: turn lane widening, kerb and stormwater adjustments, installation of new services conduits and traffic signals, pavement works, line marking and signage and new tree installation.

An example of innovative practices during this project was seen in the under-boring and installation of underground services without cross trenching.

To limit disruption to traffic flow and maintain safety around live traffic, the team developed Traffic Management Plans at seven different stages of the project.

Bridge Maintenance Program Construction 2021–2022

Sponsored by Civil Construction Hire

Complex Co successfully repaired 14 bridges across the ACT for the Bridge Maintenance Program Construction 2021–2022 project. This project included a diverse range of work, from the replacement of failing bridge joints to the repair of bridge bearing pads, waterproofing, and a bridge-deck extension.

There were a number of complex elements to the project including working in high traffic areas and the identification of a bridge with lead paint. The Complex Co team implemented strict contamination protocols and removal practices including a worker monitoring program and air monitoring at all crucial stages of the project.

The excellent planning by Complex Co resulted in improved longevity of ACT bridges.

Cord Civil delivered the Raising London Circuit Enabling Utility Works project which involved the relocation of a 300mm trunk water main and a bank of nine telecommunications conduits around busy Canberra City streets. The project consisted of major underground service augmentation, developing 15 individual traffic management plans, flexible pavement reconstruction, concrete works, segmental paving, reinstatement of traffic control devices, and soft landscaping.

When the team discovered issues with existing conduits that were intended to link new infrastructure, they decided to identify and replace unfit components rather than the significant cost of replacing the entire run.

Cord Civil’s effective management and excellent planning allowed the safe delivery of a high-quality project in a high traffic environment.

This project involved developing 172 lots of land, and installing essential infrastructure including a high-level reservoir, a booster pump station, a rising main, a gravity main and two pressure zones controlled by a pressure reduction valve installation.

During this project an existing gully filled with 1280m3 of mixed waste was discovered. The teams went above and beyond to maximise the recycling potential of the onsite waste which showed an admirable commitment to sustainable practices. The essential work carried out by the three teams resulted in a development that will ultimately be home to 4,000 residents across 1,500 homes, with 23 hectares of amenities.

This project involved extending the boardwalk adjacent to Henry Rolland Park around the West Basin of Lake Burley Griffin. This work required detailed designs, extensive environmental controls, traffic management, importing and placing over 150,000 tonnes of fill material, installation of 104 concrete-filled circular hollow section piles, and manufacturing and installing 104 (10m long) precast concrete submerged beams and 258 precast concrete

boardwalk deck slabs. Through this work, the teams were also able to reclaim 2.8 hectares of new land behind the boardwalk.

The organisation, planning and forethought on this project has created a space that will be enjoyed by the Canberra community for many years to come.

This project involved vital repairs and upgrades to 14 bridges across the ACT around high traffic areas.

To allow minimal traffic disruption, an extensive amount of work had to be performed at night. To ensure the safety of their workers, Complex Co performed an options analysis on safety equipment that identified illuminated hard hats as an important addition to the uniform. These clear orange hard hats have several modes of illumination, which proved to be highly valuable in conjunction with night-time high-visibility clothing in allowing workers to be more visible to motorists.

PAVING A SUSTAINABLE WAY FORWARD WITH Capital Asphalt

Capital Asphalt is a locally owned ACT company that specialises in asphalt production and services. In 2021, they procured their state-of-the-art production facility in Hume and have since become leaders in environmentally responsible practices in the ACT building and construction industry.

The capabilities of the plant peaked Capital Asphalt’s interest as a unique opportunity to contribute to the company’s overarching sustainability strategy. At that time, environmentally responsible options were also a growing priority for clients and the ACT Government and the plant held fantastic potential for reducing waste and energy consumption.

The German manufactured Benninghoven ECO2000 asphalt production facility is the only one of its kind in the ACT. The plant utilises 30% less electricity than is standard and houses the technology required to produce high performance asphalt with a mix of recycled materials. To make the best use of the technology available to them, Capital Asphalt engaged in extensive product research onsite at their National Association of Testing Authorities accredited laboratory. After a substantial amount of trial and development, the expert team produced CAPECO (Capital Asphalt ECO).

CAPECO is a high-performance, sustainable range of asphalt that consists of up to 41.5% recycled materials, including:

> reclaimed asphalt pavement from old roads

> recycled, crushed glass

> old tyre rubber

> reclaimed baghouse filler.

Much like the Capital Asphalt team and facilities, the recycled materials are locally sourced wherever possible. The range includes varying products that are designed to perform well for each road layer. To put this achievement into perspective: if workers were to use CAPECO for a 285mm layer at the Northbourne and Barry Drive intersection, the project would prevent 3,315 old passenger vehicle tyres and 115,000 empty wine bottles from going to landfill.

In addition to the recycled materials, abundant consideration was given to the role temperature plays in the production and haulage processes. CAPECO utilises a warm mix additive that enables the asphalt to be produced at a lower temperature. This can reduce sulphur oxide emissions by 75%, nitrogen oxide emissions by 74% and volatile organic compound emissions by 90%. Energy consumption was also greatly reduced by eliminating reheating processes. Live bottom asphalt haulage trailers ensure the asphalt arrives onsite hot and state of the art bitumen storage tanks retain the temperature of the hot bitumen. As of now, these bitumen storage tanks are used exclusively by Capital Asphalt in the ACT.

It is no surprise that clients and industry stakeholders have been excited and impressed by CAPECO and the opportunities it presents. A Capital Asphalt client recently won the Climate Choice Business Award for Waste Minimisation for a project that utilised CAPECO. Capital Asphalt’s commitment to researching, developing and investing in innovative strategies to achieve environmental responsibility is paving the way forward for civil construction in the ACT.

EVENT WRAP-UP: The OzHelp Foundation’s 2023 Suicide Awareness Ball

On 3 June 2023, 330 attendees gathered at the Great Hall in Parliament House for the OzHelp Foundation’s (OzHelp’s) 2023 Suicide Awareness Ball, proudly brought to you by Master Builders ACT. The event was an incredible success, raising over $100,000. The funds will support the delivery of evidence-based suicide prevention programs and the provision of support to apprentices and workers across bluecollar industries with high rates of suicide.

At least two in five Australians aged between 16 and 85 experience a mental health disorder in their lifetime. In 2021, 3,144 Australians died by suicide, 75% of whom were men. During the same period, over 240,000 people from across Australia connected with OzHelp’s services, information, tools and awareness. In 2023, OzHelp wants to extend their reach even further.

To that end, the 2023 theme for the Suicide Awareness Ball was Hope. The theme was chosen to highlight the importance of compassion, understanding and collective efforts needed for suicide prevention. Further, it reflects OzHelp’s commitment to providing on-the-ground support and resources to those who are struggling. OzHelp CEO Hamish Thomson stated that he firmly believes that working together as a community will enable us to make a difference in the lives of those who are affected by suicide and mental health challenges.

Between courses, Johnathon Davis from Helping Hands amused and encouraged guests as the energetic auctioneer for the event. The live auction included four nights on the Sunshine Coast, a week in Phuket, a custom-made sapphire ring and more, as well as an additional 24 raffle items, all donated by the compassionate and generous businesses in the Canberra region. Existing Structure INSURANCE

One of the most overlooked risks when builders are engaged to perform renovations/ additions, or on takeover projects is just who is responsible for insuring the existing buildings?

It is essential that insurance for the existing buildings/completed works is discussed and agreed with the property owner prior to any works commencing. Failing to do so may lead to disputes, poor public relations or significant uninsured losses.

So who is responsible for insuring the pre-existing property during construction?

CHECK THE CONTRACT

The first place both parties should check is the construction contract. In most cases the contract will clearly set out the obligations of each party to arrange the various insurance policies required for the project.

The most common contractual position in standard domestic building contracts is for:

The builder to arrange:

> Construction Insurance to cover damage to the actual works in progress under contract.

> Public Liability Insurance to cover property loss or personal injury suffered by a third party.

The owner to arrange:

> Insurance for the existing property and contents.

If the contract is silent on which party is responsible for insuring the existing property, then it will continue to be the property owner’s responsibility as it was prior to the contract being entered into.

It seems relatively simple however there are critical issues that need to be addressed to avoid confusion, disputes and uninsured losses.

IT’S DANGEROUS TO ASSUME

It’s common for both builders and owners to assume that the builders Public Liability policy will cover the owners existing property if it is damaged during the project. But the builders Public Liability policy responds to injury or damage to third party property (including owners’ property) when the builder is legally liable for the damage. Simply because the builder is performing works on the site does not automatically mean that the builder is responsible for all occurrences of damage that may occur to the existing property.

Think of the situation where storm water enters a property during an extension to the existing building causing damage to the existing property and contents. The builder’s Public Liability policy responds when the builder is liable, meaning there has been a degree of negligence. What if the water entered through a different part of the building which is not under construction? What if the builder has taken all reasonable care to protect the property ensuring generous roof coverage by tarpaulins, correct ties, adequate overlapping, tarpaulins in excellent condition, ample weights used and appropriate consideration given to the foreseeable weather? What if the

builder is not legally liable for the damage? How would a court of law view this? The answers to these questions are uncertain and rely on an interpretation of law. You can be sure that if the builder’s Public Liability insurer believes their client (the builder) is not liable they will seek to decline the claim and defend any claim the owner brings against the builder – which is not a situation any builder or owner wants to find themselves in.

OWNER’S INSURANCE

After the contract has been checked and it has been established that the owner must maintain or obtain insurance for the existing buildings, another check needs to be performed.

Most home and contents policies now contain a clause that excludes storm or water damage when water enters the home as a result of building works. Many of the same home and contents policies also contain clauses requiring the homeowner to notify the insurer when building works occur. When notified, the insurer will often cease cover if the alterations or additions are performed on the home over a certain value. To avoid an uninsured loss, it is critical that the owner checks their policy wording or contacts their insurer to ensure that the cover they have in place will respond if alterations or additions are being undertaken. If the owner is unable to secure insurance for the existing buildings, Master Builders Insurance Brokers (MBIB) may be able to assist.

Another consideration that may affect the insurances is whether the property is to remain occupied or if the owner is moving out for the duration of the works. Again, MBIB can provide advice for each specific situation and arrange insurance as required.

WHY DOES THE CONTRACT WORKS INSURER NEED TO KNOW IF EXISTING STRUCTURE COVERAGE IS REQUIRED?

A contract works policy when extended to include cover for an existing structure will cover damage to the existing structure that occurs and is outside of the builder’s control, i.e. malicious damage, storm etc. The policy doesn’t automatically cover the existing structure for those events, as the policy is based on the contract works being completed by the builder, which is disclosed as annual turnover or the value of the contract. Each existing structure will have different sums insured and construction types, which are considered by the Contract Works insurer when adding the existing structure to cover. The contract value plus the insured value of the existing structure then becomes the total value which the policy will respond to cover once the existing structure is added to the policy.

In summary - check the contract, communicate with the owner to have them check the policy wordings and discuss with their insurer, and seek advice from your broker. That is the best way to avoid disputes, poor public relations, or worst of all, large uninsured losses.

The Master Builders Fidelity Fund was established in 2002 to protect the interests of builders and home owners in the ACT.

Income received by the Master Builders Fidelity Fund remains in the ACT, and is securely invested, and used for the betterment of the ACT building and construction industry.

The Fund issues Fidelity Certificates which provide protection for new homes or those making substantial changes, if the builder dies, disappears or becomes insolvent. The Certificates protect the owner during construction and for up to five years from the date a Certificate of Occupancy is issued.

Women Building Australia’s Business Resilience Mentoring On Demand

Women Building Australia’s Business Resilience initiative provides Business Operator Training and has just launched Mentoring On Demand. These programs are crucial to develop successful female-led businesses in the building and construction industry.

The Women Building Australia Mentoring On Demand program provides a self-matching, on-demand mentoring experience allowing mentees to seek assistance for a specific acute business issue they are facing. The mentee can search out a suitable mentor and receive practical advice and guidance from experienced industry practitioners.

Program Benefits:

For mentees, the program provides a safe and confidential space to explore issues and concerns in a supportive relationship, receive experienced guidance and support, learn from the real-life experience of other construction business owners, explore business options and tactics to solve their acute business issue, receive feedback and developmental guidance, and network and connect with other experienced industry practitioners. For mentors, the program provides an opportunity to contribute back to the industry and help to build robust building businesses, enrich their mentoring and leadership skillset, gain intellectual challenge and new perspectives, exercise emotional intelligence, network and connect with other industry practitioners, and help shape the women in the construction business community.

To be eligible to join as a mentee, individuals must be female, leading and/or running a small to medium building and construction business, an owner/operator or in a senior/management role and running the business side of the operation, either on or off the tools.

To join as a mentor, individuals must have at least 10 years of industry experience, be female or male, an owner/ operator or in a senior/management role in the industry and have experience running a building business or currently employed in a management or supervisory role in the building and construction industry.

Each mentoring relationship lasts a maximum of three months, during which the mentee outlines the specific acute business issue they are facing, and the mentor provides advice and guidance based on their own experience to help the mentee solve the issue.

EVENT WRAP-UP: ACT Chiefs Industry Luncheon

Over one hundred professionals from across the industry gathered at the National Press Club of Australia for the ACT Chiefs Industry Luncheon. The event was MC’d by the renowned Group Editor of Region Media, Genevieve Jacobs, who guided and supported the discussion of upcoming priorities, projects and opportunities in the building and construction industry.

Michael Hopkins, CEO of MBA ACT, opened the discussion with an overview of industry news, including the implementation of the housing accord and industry reforms. He also highlighted some recent developments at MBA ACT: member survey results were positive and revealed areas for growth, and a range of partnerships were being used to deliver advocacy programs that engage women, migrants, refugees, and others in entry-level training as a starting point for a fulfilling career in our industry.

ACT Chief Planner and Director-General of EPSDD, Ben Ponton provided an update on ACT planning strategies. He advised that there will be a movement into more metricsfocused outcomes, allowing for more flexibility in planning. He explained that processes will become less bureaucratic and more people-based with more opportunities for individuals and businesses to advocate to the government.

Ben stated that he was pleased with MBA ACT’s ‘ongoing and constructive engagement in local planning matters’ and wants to encourage similar involvement from all stakeholders. The increased input will lead to better outcomes and improve the overall wellbeing of the community and the environment.

Ben stated that there will be a focus on encouraging an inclusive and climate-change-resistant city. He emphasised that changes to the planning system would require a group effort from the industry because the planning system involves and benefits everyone. Formal and on-the-job training will be needed to ensure everyone takes the time to understand how to use the new system to benefit their work.

Similar sentiments were echoed by the ACT Government Architect and Director of Townsend + Associates Architects, Catherine Townsend. Catherine updated attendees on the future-responsive, change-resilient and flexible direction of design in the ACT. The upcoming design guide for ACT building and construction will provide qualitative guidance on the critical features that affect liveability. She surmised that using qualitative guidance rather than prescriptive measures will improve flexibility and elevate good design outcomes. Catherine also advised that a key goal is to ‘promote design understanding and literacy’. The design guide will be wellillustrated, include examples and be written for the general public as well as those in the industry. She stated that the goal is to limit prescriptive measures to allow for more flexibility, but the industry will need to increase their level of awareness and acceptance of the guide.

The ACT Chief Engineer, Adrian Piani, rounded out the panel with an update on the role of engineers in the coming months, advising that half of the approximately 5,000 engineers in Canberra work in a civil role. He stated that

there will be a heavy focus on sustainability moving forward, with a pull to reduce carbon infrastructure, phase out gas and mandate airtight buildings to reduce heating and cooling costs. Moreover, he emphasised the importance of getting more out of existing infrastructure.

Adrian also advised that the use of digital tools will increase, which will enable better tracking of data and trends. Already, an ACT Government Engineering Workforce Plan is available online and provides a guide on boosting the productivity of the ACT Engineering Workforce.

Overall, the panel was unified in their desire to create places people want to be by considering the ACT as a complex

ecosystem that will last many years. The discussion certainly created intrigue for the ACT Government’s new Territory Plan, which we understand will be released in July 2023 and come into effect in September 2023. Master Builders ACT will continue to call on the ACT Government to ensure there is sufficient consultation and transition on the implementation of the new Territory Plan.

On a similar vein, the new Small Business Energy Incentive will support investment by small and medium businesses in rolling out electrification and greater energy efficiency across their operations. Other goodies for small businesses in the budget include the $20,000 instant asset write off allowed during 2023-24.

With housing having such a major impact on households’ cost of living, some of the budget’s highlights related to measures aimed at improving outcomes here. NHFIC’s financial war chest has been increased by another $2 billion and now has up to $7.5 billion to support lower cost loans for the delivery of additional community housing stock. The federal budget has also attempted to encourage wider Build-to-Rent provisions through improved tax incentives. For those reliant on Commonwealth Rent Assistance (CRA), the maximum rates have been increased by 15 per cent which is equivalent to up to $31 extra per fortnight.

For the ACT building and construction industry, the biggest single component of the federal budget was the $535.3 million set aside for upgrades to cultural institutions including the National Gallery of Australia. The local building industry is also likely to see some benefit from the budget’s overarching initiatives related to affordable housing, support for home upgrades and measures to help small businesses. All of this assistance will be needed because Canberra’s building industry faces a few unique challenges. We are more dependent on higher density home building than any other jurisdiction, and prospects for this part of the market are difficult in current economic circumstances. Another problem is that the ACT’s cost base is higher than nearly every other jurisdiction: during March 2023, the average loan size for residential land purchase by owner occupiers was $420,000, higher than in every other state and territory apart from New South Wales. High land costs are a major obstacle to activity at this time.

ACT Migrant and Refugee Settlement Services KICKSTART TO CONSTRUCTION PROGRAM

In March this year, MBA ACT and ACT Migrant and Refugee Settlement Services (MARSS) partnered to deliver the first Kickstart to Construction program. The program was a jointly funded initiative of the ACT and Australian governments, with funding from Skills Canberra under the Adult Community Education JobTrainer grants program.

Over three weeks, seven dedicated participants worked to prepare for roles in the Australian construction industry by completing compulsory training and building their foundational skills. This included basic languageskills support to ensure lessons were equally engaging for varying levels of English fluency, as well as safety, white card, asbestos awareness and silica training.

Participants brought with them a range of international experience, including marketing, logistics, engineering, bricklaying and painting. The group quickly formed a tight bond with their fellow learners and their passionate teachers, creating a network of industry professionals and new entrants that will support them in their career journey.

Each participant was provided support to update their resume and get in touch with employers who were interested in new entrants to the industry. By the end of the program, more than half of the participants had already found employment in the construction industry and those remaining were set to attend interviews.

The Kickstart to Construction program illustrates MBA ACT’s dedication to encouraging new entrants to join the industry and our commitment to advocating for the benefits of a diverse workforce, such as the ability to utilise unique skills and experiences to develop and innovate.

Plans for the second run of the program are underway, with dates likely to be announced later this year. MBA ACT members will be contacted when opportunities to interview participants for employment arise.
