The Not-For-Profit recipient was United Cerebral Palsy of Long Island, a Hauppauge-based organization that advances the independence, productivity, and full citizenship of people with a wide range of disabilities. Other not-for-profit nominees were Family Service League, Gurwin Healthcare System, Michael Magro Foundation, The Corporate Source, and the Winters Center for Autism. Kilfinane Energy Consultants of Northport, which uses patented technologies to disinfect indoor air, received Rookie of the Year honors. The only other finalist in that category was HireBlue.

Two degrees, to be exact. Robert Kufner, the company’s President and CEO said the building’s HVAC systems regularly fight the heat-emitting machines to keep the air within a small temperature range of 74 degrees. It is readily apparent energy spending is one of their biggest expenses. As labor and raw material costs continue to rise upwards of 5 percent each year, Kufner said the company looked for ways to control whatever costs it could. For 71 years, Designatronics has called Long Island home, starting in New Hyde Park before recently building their state-of-the-art facility near Hicksville’s Long Island Rail Road station. However, staying on Long Island was not guaranteed, despite the company’s preference to avoid a move to New Jersey or Pennsylvania. Enter the New York Power Authority (NYPA)’s ReCharge NY program last year. In about four
months from application to award, NYPA was able to offer this HIA-LI member the energy price stability needed to plan for the long-term. Even during the pandemic’s rise in 2020, Designatronics saw pent-up demand on the horizon. They used savings found in ReCharge NY and other economic development programs to buy new machinery and create more high-paying jobs. In December 2020, 158 employees worked at Designatronics. Now, at 172—and this ReCharge NY customer is hiring for at least 10 more positions. Designatronics is just one of over 200 customers on Long Island that have received a ReCharge NY allocation since the program’s inception in 2012. TALK OF THE TOWN It’s Not Brain Surgery (Actually, It Is – And It’s Amazing) By Gregory Zeller A Bohemia-based med-tech with an eye for optics has introduced a breakthrough wearable technology for brain surgeons. Designs for Vision, a circa-1961 manufacturer riding the cutting edge of specialized optical products, has raised the curtain on the Reveal FGS System, an innovative tool for tumor surgeons – particularly brain-tumor surgeons – performing fluorescenceguided surgeries. Reveal FGS combines specialty illumination and unique optical filters to give tumor surgeons optimal lighting conditions, allowing them to operate more quickly and with “added emphasis on efficient fluorescence-guided procedures in brain tumor surgery,” according to a company statement. Among the next-generation system’s specific targets: glioma, a nefarious tumor known to develop in the brain and spinal cord. Glioma – which affects about 12,000 U.S. patients annually, representing about one-third of all brain tumors – spreads fingerlike projections through otherwise healthy brain tissue, making it extremely difficult to remove. Enter the Reveal FGS System, which targets the “rare orphan disease” – essentially, diseases that don’t affect enough patients to attract the attention of major pharmaceutical companies – and does so at a fraction of the cost of comparable technologies, according to Ken Bragança, Designs for Vision’s vice president of operations. “Reveal FGS System … makes fluorescence-guided surgery more accessible by lowering the entry cost to a fraction of the previous technology,” Bragança said. “Rather than just the largest, best-funded hospitals being able to provide this technology, the Reveal FGS System brings the miracle of fluorescence-guided surgery to all hospitals.” Fluorescence-guided surgeries, in which patients are administered an “optical imaging agent” that’s absorbed by a tumor and imaged using specific light wavelengths, were first used in the United States in the middle of the 20th Century. In Europe, surgeons have been using the technology to target brain tumors for decades. But the use of FGS for brain surgeries was only approved in the United States a few years ago, placing the Reveal FGS System ahead of the domestic curve. “Reveal FGS … is a refinement of fluorescence-guided surgery equipment,” Bragança noted. “Many doctors who’ve tested the system say that it significantly reduces the time of surgery
by minimizing the set-up and relocation of the microscopes, and offers a more complete visual field of the operation area.” The refinements are all hallmarks of Design for Vision’s expertise. Founded in 1961 in Buffalo by pioneering optometrist William Feinbloom – inventor of the modern contact lens, among other optical advances – the Bohemia-based company spent decades focused on the visual acuity of patients; today, including research and manufacturing partnerships with major corporations like Japanese multinational Hitachi, the manufacturer specializes in technologies for healthcare providers, with more than 100,000 specialized optical products in use by surgeons and dentists. The Reveal FGS System combines a blue light emitter with wearable lenses incorporating innovative “high-band pass filters,” electronic filters that attenuate signals at specific frequencies. Combined, the technologies allow neurosurgeons to see a tumor’s exact pattern and differentiate it from healthy tissue, while facilitating “greater flexibility of movement” for the surgeons, who can view tumors “from greater ranges of angles and positions than they would via a fixed microscope,” according to Designs for Vision. Walter Stummer, the president of the German Society for Neurosurgery and chairman of neurosurgery at Munster University Hospital in Germany, worked closely with the Designs for Vision team on the technical specifications. “We have a certain part of blue excitation light that is strong enough to give you good background information, but not too
strong to cloak the red fluorescence,” noted Stummer, who’s credited with developing modern-day fluorescence-guided brain surgery and the lighting and filter standards used to microscopically monitor such procedures. “The microscope has these very specific characteristics … so we know what we’re seeing as red fluorescence is tumor and what we’re seeing as blue is not tumor,” the scientist added. “That’s why it’s so important that when you construct a new hardware for visualizing, that you maintain these exact characteristics.” Theodore Schwartz, a neurosurgery professor at New YorkPresbyterian Hospital/Weill Cornell Medical Center in New York City, was among the surgeons who tested the Reveal FGS System, which “could have the potential to work for other surgical procedures,” according to Designs for Vision. As far as its primary application is concerned, Schwartz applauded the device for “increase[ing] the sensitivity and specificity” of fluorescence-guided tumor surgeries. “With this new Reveal FGS System, [fluorescence-guided surgery] has become even more effective,” Schwartz said in a statement. “[It] allows you to get a greater percentage of the fluorescent light to be visualized. “I now use the Reveal FGS System as another tool in my approach to remove suspected high-grade gliomas, because (of) ease-of-use and a better overview of the entire operative field,” the neurosurgeon added.

Designs for Vision recently introduced its Real FGS System, a tool for a procedure known as fluorescence guided surgery, which enables surgeons to more quickly spot and remove tumors. The technology comprises “advance wearable specialty lighting and appropriate optical filters” that provide optimized lighting conditions during brain tumor surgery, according to the company. This system, the company claims, would make surgery to specifically remove giloma, a rare tumor that develops in the brain and spinal cord, more accessible. The tool improves the ability to see the tumor tissue, aiding in the removal of the material. The wearable technology “makes fluorescence guided surgery more accessible by lowering the entry cost to a fraction of the previous technology,” Ken Bragança, vice president of operations at Designs for Vision, said in a statement. “Rather than just the largest, best-funded hospitals being able to provide this technology, the Reveal FGS System brings the miracle of fluorescence guided surgery to all hospitals. According to the company, most surgeons operating on gilomas use high-cost lighting microscopes, and in part because of those high costs, there are fewer surgeries performed. The company claims that its $8,000 system, more medical centers would have access to the tool, making the complex surgery possible. The wearable Reveal System provides easy to use blue light in the 405 nm wavelength combined with wearable lenses with unique
high band pass filters allowing the user to see the pattern of tumor presence that differentiate from not malignant tissue. This technology allows improved visualization of tumors previously not visible under standard lighting conditions. Additionally, neurosurgeons who have tested it report greater flexibility of movement, as they can view tumor tissue from greater ranges of angles and positions than they would via a fixed microscope. The company began working on the FGS System back in December 2019, after some of its representatives attended a symposium whose keynote was delivered by Dr. Walter Stummer, now director of the Department of Neurosurgery of the University Hospital Münster and Past President of the German Society for Neurosurgery. Stummer, along with Dr. Herbert Stepp from the University of Munich, worked with the Designs for Vision team in developing the system.
A three-month testing phase of the Reveal FGS System ran from March through May of 2021. Designs for Vision approached several leading oncologic specialists within neurological surgery in the United States who agreed to participate in the beta testing phase. Long Island is currently in the midst of an acute affordable housing crisis that threatens its future. According to the Regional Plan Association, 300,000 Long Islanders are housing cost-burdened, which means they spend more than 30 percent of their income on housing. About 20 percent of families pay more than 50 percent of income on housing, an extreme burden that means they literally cannot put food on the table. The RPA further notes that while housing costs on Long Island have increased 24 percent since 2000, median income has actually dropped during that same period, making housing even less affordable. At the same time, Long Island has failed to expand its housing stock. According to a recent report from the Furman Center for Real Estate and Urban Policy, Long Island has granted only 56,000 housing permits between 2001 and 2018, fewer even than the number of jobs added during this period. The negative economic impacts of COVID-19 – including massive job losses in the services sector disproportionally affecting communities of color and skyrocketing real estate prices – increases the risk that already cost-burdened Long Islanders will fail to keep up with their rent, mortgage, insurance, and tax payments, losing their homes forever, and eliminates any hope for first-time home buyers.
Why it Matters The fact that housing, which I’d argue is a basic human right, is becoming so unaffordable for so many on Long Island – especially for families with lower and moderate incomes – reinforces and perpetuates social and racial inequities that we’ve been living with for many years. The housing crisis also directly threatens Long Island’s economic future. As noted in a 2018 Rauch Foundation report, “59% of Long Islanders – an all-time high – say they are somewhat or very likely to leave in the next five years for a more affordable area – an increase of 10% in the last five years.” In addition, a home is usually the largest source of a family’s net worth. Barriers to affordable home ownership is the single biggest reason for the net worth disparity between white families and families of color. What Can Be Done? The roots of Long Island’s housing crisis are complex and retracing them all lies beyond the scope of a single article. Suffice it to say that decades of federal, state, local, and private policies have conspired to create the current situation, and it appears that no single solution can effectively address it. At the same time, however, there are particular aspects of the current crisis that can be – and to some extents are being – addressed in a way that makes me hopeful. Reforming Restrictive Zoning A huge obstacle to increasing the affordable housing stock on Long Island lies in restrictive local zoning regulations. New York State is unique among its neighbor states in terms of completely ceding control of housing to local entities which typically bow to local opposition to any new housing (such opposition is often led by the local school board). Among other things, restrictive zoning leads to higher land costs which is the main reason why housing is so expensive
on Long Island compared to other regions of the country. A new law incorporated within New York State’s recently passed Fiscal 2022 Budget, the Rail Advantaged Housing Act, offers some hope. While the Act does not forbid local entities from rejecting new housing proposals, it expedites appeals for proposals falling within a half-mile of MTA train stations and sets up a system by which developers can pay into a “local agency zoning mitigation account” to offset any future locally borne costs. Locally, the Suffolk County Legislature needs to reinvigorate the 72-h program, which transfers County-owned land to the Towns with the express purpose of developing affordable housing. Without a vigorous 72-h program, it is economically impossible for agencies such as Habitat for Humanity of Suffolk to develop affordable housing in Suffolk County. Encouraging ADUs (Accessory Dwelling Units) Another state-level measure, New York Assembly Bill A4854, currently in committee, proposes to make Accessory Dwelling Units (second dwelling units on a single lot) more prevalent by making them more difficult to reject by local entities. This measure has the potential to expand Long Island’s affordable housing stock. Finally, provisions within the recently-passed American Rescue Plan Act, particularly with respect to its provision of $47.5 billion in relief for housing, offers some cause for optimism. Solving the affordable housing crisis on Long Island – and elsewhere in the U.S. – will require many different programs working in tandem. My hope is that corporate leaders will support all measures – private and public – with potential to ease the crisis. While there is much to be done – and much to be overcome – it is my belief that a way forward can and must be found.

Increases In SNAP Funding Could Reduce Food Insecurity For More Than 140,000 Long Islanders

It seems that every year for at least the past five years, Long Island Cares and the other 199 food banks across the United States that are members of Feeding America have been advocating for an increase in funding from Congress for the Supplemental Nutrition Assistance Program (SNAP). Increasing SNAP funding would result in low-income families having more access to healthy food choices and could also reduce the number of individuals and families struggling with food insecurity. Recently, the U.S. Department of Agriculture (USDA) released a re-evaluation of the Thrifty Food Plan, used to calculate Supplemental Nutrition Assistance Program (SNAP) benefits. As a result, the average SNAP benefit – excluding additional funds provided as part of COVID-19 relief efforts will increase for Fiscal Year 2022 beginning on October 1, 2021. The re-evaluation concluded that the cost of a nutritious, practical, cost-effective diet is 21% higher than the current Thrifty Food Plan. As a result, the average SNAP benefit will increase by $36.24 per person, per month, or $1.19 per day, for Fiscal Year 2022. The timing for this long-awaited increase in SNAP benefits could not have come at a more appropriate time. The cost of the average market basket has increased by
double-digits. The average cost of a gallon of gasoline for your car has jumped to $3.09 per gallon, and the cost of rent or purchasing a single-family home continues to increase as a result of the Coronavirus global pandemic leaving nearly 290,000 Long Islanders wondering how to put healthy meals on their tables. One of the immediate benefits of the increase in SNAP purchase power is that it’s a real and measurable “investment in our nation’s health, economy, and security,” according to Agriculture Secretary Tom Vilsack. “Ensuring low-income families have access to a healthy diet helps prevent disease, supports children in the classroom, reduces health care costs, and more. And the additional money families will spend on groceries helps grow the food economy, creating thousands of new jobs along the way.” In addition to increasing the amount of SNAP benefits the revised plan adds more fish and red and orange vegetables to align with recommendations in the Dietary Guidelines for Americans, 2020-2025, which has the potential of benefitting farmers and fisherman across the

SNAP is one of the most far-reaching, powerful tools available to ensure that all Americans, regardless of background, can afford healthy food. More than 42 million Americans rely upon SNAP to feed their families supplemented by visits to a local community food pantry or any one of Long Island Cares six satellite centers in Freeport, Lindenhurst, Huntington Station, Hampton Bays and our newest in Bethpage opening soon. As of June 1, 2021, 140,400 Long Islanders receive SNAP benefits – 99,345 residents of Suffolk County, and 41,055 in Nassau County. The evidence is clear that SNAP increases food security, including among households with children who have been disproportionately impacted by hunger during COVID. With so much continued uncertainty regarding COVID-19, rebuilding our infrastructure, and the need to control inflation, it’s comforting to know that at least in relation to food insecurity we are making progress even if it took five-years to achieve it.

Indeed, as soon various COVID-related restrictions that forced credit card companies to delay collection efforts were lifted, the credit card companies sought to collect millions of dollars owed to them. I understood their motive, and I had my leverage. This was not the time to work out a payment plan; this was the time to cut a deal.

If COVID-19 has reinforced anything for lawyers and negotiators, it is that cash is still king! In a world where paying bills has been put on hold without consequence, the bill collectors, who are used to a steady stream of cash, are finding themselves sunbathing in a dry riverbed. I lived this in a recent negotiation for a client, and we at CMM foresee it coming to a head with respect to residential and commercial mortgages. Debtors with cash may be able to cut a deal with creditors who have been legally unable to collect, potentially forgiving a significant amount of debt. Money now is better than a payment plan. My recent story: our client was hit with a lawsuit from its credit card company seeking payment of over $200,000 in accrued debt. The client initially hoped that we could work out a payment plan to buy some time to repay the owed money. I dug in. I quickly learned that not only was our client sued for this debt, but hundreds if not thousands of people were sued for the same debt types in and around
Armed with this information, and after strategizing with our client, I was able to negotiate a lumpsum deal, settling for a mere 25% of the amount claimed. The credit card company indeed preferred to accept our client’s payment now – of a vastly smaller sum – than receive the full payment over the course of years. I was able to successfully negotiate a huge win for our client. This is just one example of the importance of understanding the context and underlying motives of a negotiation. Similar to how credit card companies are filing lawsuits against their cardholders, banks and lenders will soon go after property owners in default, and when facing a prepared negotiator on the other side, may agree to various creative solutions to protect their investment. Approaching these matters in the same way we would have in February 2020 will simply not work. Negotiations often go awry when one party assumes the motives and intentions of the other party. Whether you’re suspicious that the opposing party gives in too easily or you’re fooled that someone has
good intentions when they really don’t, negotiations can sometimes turn into a guessing game. Everyone’s first instinct is to assume they know what the other party wants – but it’s important to truly understand what’s really motivating them. Is someone trying to sell you their business because they are ready to retire and it’s time to move on? Or are things tough in their industry and they’re trying to ditch the company before it’s too late? Doing your research and digging into the past and present situation of the opposing party is an important step you shouldn’t enter a negotiation without having done first. This process helps you put things in context – and you can’t negotiate effectively without doing that. If you were negotiating a real estate deal during a recession, would you use the same approach as if you were negotiating when the market is booming? It’s no different coming out of a pandemic. Strategies that worked in 2019 must be tweaked now in 2021. And likewise looking toward the future, what makes one negotiation strategy effective today may make it ineffective in the future. Today’s post-pandemic game plan will most definitely need to be modified when in a similar situation as my client in 2023 and beyond. Every negotiation is unique in terms of facts and timing. A skilled negotiator must take time to do their research and enter that negotiation equipped with all the background information that they can possibly find. This way, you’re fully prepared to tackle the issues at stake in the negotiation.

Jefferson’s Ferry’s Strong Financials Affirmed with a Stable Outlook, BBB rating from Fitch Ratings. Jefferson’s Ferry, a not-for-profit Life Plan Community, recently received a solid BBB rating with a stable outlook by FitchRatings. The ‘BBB’ rating primarily reflects the expected resilience of Jefferson’s Ferry’s financial profile throughout Fitch’s forward-looking analysis of the expansion and renovation of the community during its ambitious Journey to Renewal project. When completed, Journey to Renewal will add 60 one- and two-bedroom independent living apartments to the Jefferson’s Ferry campus, as well as expand and upgrade its Healthy Living Center, Rehabilitation Therapy Center, Fitness Center, and dining venues. HRDA is a community based 501c3 non-forprofit. HRDA is focused on outdoor park space and community-oriented services. HRDA coordinates with HIA, political leadership and
businesses to increase accessible open space for members to enjoy for sports, outdoor activities, gatherings, and other community functions. HRDA sponsors and organizes public and private local organizational events that support the well-being of the HIA and residential community. This past week, the Hauppauge Recreation Development Association (HRDA) hosted its first ever “PARTY FOR THE PARK” event. Along with HIA, Smithtown, Islip, County and State leadership, HRDA unveiled the commitment to develop new park areas and rejuvenate existing parks for Hauppauge inclusive of HIA member employees that join HRDA. “This event was tremendously successful in showcasing our communities desire to gather and celebrate HRDA initiatives for a park & community center. Together, we will solve the lack of accessibility to open space gathering spaces, especially sports fields for Hauppauge community.’ said Dave Wolmetz, HRDA Board Member.
On September 10, the Village of Islandia held a special ceremony at the First Responders Memorial in honor of the memory of five local first responders who were killed during the September 11, 2001 attacks: Raymond M. Meisenheimer, Peter Brennan, John P. Napolitano. Glen K. Pettit and William J. Mahoney, Jr. This event commemorated the 20th anniversary of the terrorist attacks on U.S. soil. Mayor Allan M. Dorman was joined by village elected officials, employees and residents and members of the Col Francis S. Midura Veterans of Foreign Wars Post #12144 in remembering those who lost their lives during the 9/11 attacks. The mayor scheduled the ceremony for the 10th to give the residents the opportunity to attend other September 11th memorial ceremonies throughout Long Island the following day. The First Responders Memorial was unveiled on June 2, 2018. It features five plaques, one for each of the five local residents who lost their lives that day.
