A good education equips our youngest New Zealanders with the skills they need to succeed well into the future.

Management has always required people with high levels of competence and performance to carry out the duties and responsibilities of the role, and secondly, to lead others.

Okay so let’s really talk about the elephant in the room. Running a business and keeping your mental health stable.

Education remains a key priority for the Government, and it’s vital we future-proof education for our rapidly changing world. In Auckland, one way we’re planning for the future is by investing heavily in modern school facilities. Earlier this year we announced 41 new classrooms will be built at eight schools across Auckland under Budget 2017, as part of our commitment to creating extra capacity for students in our fastest-growing city. And we announced another 30 new classrooms this month. To ensure our education system keeps pace with technology advances, we’re investing $40 million to help young people fully participate in their digital studies. The investment includes funding for the professional development of teachers, more resources to support digital learning, and funding for external providers offering digital learning programmes. Our investment in digital learning builds on the $700 million we have invested in digital education infrastructure, and ensuring all schools are able to connect to uncapped, fast broadband. We want all our young New Zealanders to be digitally fluent so they can achieve a lifetime of success. This is why we’re making the most significant changes to our education curriculum in a decade, helping prepare New Zealanders for the 2020s and beyond. To help achieve this, we will replace the decile system with a targeted funding system to better support students who are at greatest risk of not achieving. The new Risk Index will allocate resources to schools based not on the characteristics of the neighbourhood, but on the circumstances of the students. This means we can better direct extra resources to where they are most needed, and help more students achieve. It’s worth noting that no school or early learning centre will have its funding reduced as a direct result of the change. In some cases, we expect to see some schools gain considerably more funding. The Risk Index has been designed to ensure young people’s privacy is protected at all times, and it won’t be possible to identify which children generate the additional funding.

At the end of the day the senior management leadership challenge is to add value and this can be achieved by building the confidence of those we lead. It is critically important that we direct, lead and inspire the next generation of managers, so as to ensure they have the skills to carry the flag in the future. The best new managers are continually being trained by their senior managers and peers, and are teaching themselves to become better at their roles through learning and growth. Many young managers today will readily understand and comprehend the 'what' and 'why' of management however, may struggle with having the confidence to put this knowledge in to practice.

Is an accountant really qualified to help keep your mental state appropriate? Hmmm… maybe not. But… typically your advisor is aware of the business factors. By nature there comes an awareness of the mental issues that might come with dealing with IRD (especially if in arrears etc.). Business is not always plain sailing, we entail unexpected head winds, cut-offs and accidents. It’s about being aware of the environment and responding appropriately to it. The secret is being aware that things won’t (always) go to plan, and then having a course of action when this happens. Maintaining one’s mental health and stability falls somewhat outside of what we are taught as we come through university and qualify as accountants and advisors.

This is a dilemma that many companies' senior management teams face and the following suggestions may assist. It is only experience that can bring these new manager's skills to life and be meaningful.

But it is a very real aspect to life in the business world.

Here are some tips to assist you with your next managers.

That is how to get more clients of the type you want, how to get them back more often, how to increase prices or margins and how to be more effective in business processes.

Firsly, set meaningful objectives and goals. Goals should be S.M.A.R.T, (specific, measurable, achievable, relevant and timely). Goals will clarify the direction and what is expected to be accomplished. Goals should be linked to your strategic plan. Practice modelling. Model the behaviours required by setting an example with your own behaviours. There is a theory called operant conditioning and this relates to a concept of consequence. The probability that a person performs in a certain way is a function of previous consequences.

That said, an awareness and open line of communication is essential. Your advisors are there to keep you on the straight and narrow in respect of business.

That is (relatively speaking) the easy part. The more difficult part is how to achieve that whilst keeping and maintaining a significant other relationship, raising children, and staying involved in your spiritual or social events. Make sure your advisor has a holistic bent. They won’t necessarily have all the answers, but they need an awareness.

From this we can see that responses following desired behaviours will occur more and responses followed by undesirable consequence will be less.

Through this awareness they should have contacts to help you and to work with you to achieve ultimate work/life balance.

Be an encourager and motivator. Positively reinforce good behaviours. Examples of positive reinforcement are praise and recognition. By contrast, negative reinforcement is often seen as punishment.

There is no point having the best and most beautiful business if your personal life is in tatters (yes a personal opinion).

To me, the most important part is that the Risk Index will end the unfair stigmatisation of lower decile schools, as well as the students attending those schools. No child should be hindered by the stigma of where they go to school.

Management is not an easy task and it is expected that those in management positions can deliver on a number of skills or competencies. These include; organising, time management, problem solving, decision making, mentoring and motivation, goal setting, effective listening, conflict management, self-control and communication.

A good education is the path to a better future – and the national-led Government is committed to delivering an education for young New Zealanders that will set them on the right path for success.

Companies that invest in their management training will undoubtedly reap the rewards in improved productivity, profitability, efficiency and overall satisfaction (customer, company and individual) levels.

The most important thing is to have someone to share your thoughts with. Maybe that’s a significant other, a colleague, a coach, an advisor. Just make sure you are heard and listened to. It is important. For you, for your family, for your business.

Training to retain - is it worth it?

There is a little-known section of the Health and Safety at Work Act 2015 (HSAWA) which places a specific health and safety obligation upon landlords, in addition to the primary obligation of all PCBUs.

Difficult to get right, expensive to get wrong – that’s how many business owners describe paying provisional tax.

One of the hot topics amongst employers today is employee retention: the dual challenges of finding good employees – and keeping them.

What has surprised me is how many leases do not specifically address this potentially significant liability. Briefly, within the wording of s42 of the HSAWA is an obligation on landlords to ensure, so far as is reasonably practicable, that the premises, any fixtures, fittings or plant supplied under lease that are used as or for a workplace or any of these that are being commissioned, installed or constructed and intended as or for a workplace, must all be without risk to the health and safety of any person. What this means in layman’s terms is, as a landlord, you are potentially liable for hefty fines if anybody gets hurt while in the premises and it is proven you had not taken reasonable steps to prevent the harm occurring. The HSAWA does not allow you to shift your obligation onto the tenant. This means, apart from making sure the premises, any fixtures, fittings or plant are checked so they comply with current standards of health and safety, you can only rely on a generic clause of the lease which obliges a tenant to comply with statutes and regulations. The question that arises here is whether, in all circumstances, simply relying on the generic clause of the lease satisfies your health and safety obligations. My view is that this does not necessarily satisfy the underlying s42 obligation, as there may be specifically hazardous or risky characteristics of a premises or fittings, fixtures or plant which would require a landlord to have in place some defined rules as to safe use. But, because the standard lease does not expressly bind a tenant to complying with a landlord’s rules of safe use, if you require the tenant, its workers and visitors to the premises to comply with these rules, you will need to include an additional provision in the lease document. Recently, I was advising the landlord of a building used as a factory. There were several features which were hazardous and created identifiable risks. My client wanted to make sure the tenant had appropriate health and safety policies that addressed the particular hazards of the building. We achieved this through changing the wording of the lease. There are other aspects of current health and safety legislation that you may not be aware of. It pays to obtain good advice, as ignorance of the law is no good excuse.

However, that statement no longer rings true.

I agree it is a challenge for some sectors and yet, more money and more training isn’t the ‘white-knight’ answer for every situation.

New rules mean you don’t have to constantly estimate your liability throughout the year anymore. Inland Revenue (IRD) will no longer hit you with interest if you pay your provisional tax based on a five percent uplift of last year’s liability (this is known as the standard method).

Ongoing training is a brilliant solution when retention matters most. Here are three really good reasons to invest in a development or training programme. Ask yourself:

• Can we increase productivity through training? • Can we increase performance in our leaders by developing their capability?

Now before you get your celebratory dance on, this is tax. The devil is always in the detail. So here’s an easy-to-digest summary of how provisional tax now works.

• Have our peoples’ technical functions moved on and do we need to up-skill them?

The biggest change applies to smaller taxpayers using what IRD calls the ‘safe harbour’. • If you paid the amounts of tax required as per the standard method at your three provisional tax dates for that year

Conversely, when training is simply perceived as a reward (and therefore a seemingly nice thing to offer someone who has threatened to leave or might be considering it), it rarely ‘hits the mark’ as a retention measure and can even have undesired consequences.

• Then you will not be charged IRD interest if you did not pay enough provisional tax, provided any final balance is paid by your terminal tax date

Whenever I am asked to support an organisation with a retention programme, I recommend training as part of a development plan for an individual, not as a reward or an inducement to remain.

• Then this is a significant win for small businesses (and trusts). Previously, the safe harbour threshold was $50,000 and applied to individuals only.

In these situations, I have noticed that for every leader who sees training as ‘time and money spent’, there is another who sees training as investing in their future.

The second change affects medium and larger businesses.

Well-planned training is priceless to an organisation and individual. Providing professional development is most impactful when it goes hand-in-hand with a purpose.

• If your actual income tax liability is less than $60,000; and

• If your actual income tax liability is $60,000 or more; and • If you paid provisional tax for that year based on the standard method

If the purpose is to bribe an employee to stay with the organisation, then the rewards will be short lived. Resources can also be wasted through over training individuals, as you often need to spend money, invest time, and employees may lose interest in the education opportunity.

• Then you will not be charged IRD interest if you paid the amounts of tax due as per the standard method at your first and second provisional tax dates for that year, even if your actual liability is higher

As someone who sees the benefit of targeted capability building, I am 100 percent behind the value of training, capability development and education. I am not however a fan of it being used as a retention tool, as it just won’t work without a purpose.

• Then the final balance will be due at your third provisional tax date. IRD interest applies on any underpayment of tax from this date.

Developing a member of your team as part of a succession plan works - if you are looking for ways to keep your key people, challenge them. Develop their capability so they can lead a team or a project, can step into a leadership role or increase their responsibility. In my experience, most organisations want to look after their staff well but, given the seemingly intangible nature of wellness, are unsure of the best way to spend their dollars.

You might want to stop and think for a moment about how people would find your company if they couldn’t Google your website. Yes, they might see you on Facebook or hear about you on the radio, but your information is likely to be quite superficial and where do you send them for more detail… your website. Yes, we’re back to that again. Whether you’re big or small, new or old, or selling a product or service – your website will be a critical investment. To help you take your website from average to awesome, the team at Priority Communications have put together the following tips. Make it easy to find Having the right keywords in your web content will help you rank higher in search results. A simple but unique URL will help too – no one wants to spend five minutes typing in a web address, and they also won’t spend five minutes trawling through search results looking for you. Google AdWords is another way of boosting your site – just make sure you’re sending people to good content. Make it easy to use You only have to stroll down the street or through a mall to see that people are using their phones all the time. All the time! Not only does your website need to be intuitive, but it also needs to be mobile friendly. If it doesn’t work just as well on a little screen, people will quickly swipe left. Great content should be your top priority The reason people visit websites is for information – whether that’s written content, video or images. Put yourself in your customers’ shoes and think about what they want from your website. Short and sweet is key. Use high quality images If you have the budget to hire a photographer, do it. Stock images have their purpose, but there’s nothing like unique, local photos. If your website includes profile photos, make sure they’re professional, consistent and represent your brand. Ask for help There’s more to websites than just pasting in some text and photos. If it isn’t your thing, call in an expert. My advice is to start with the basics. A challenge every workplace has, regardless of the business type, is that people come in all shapes and sizes. One size desks or chairs do not suit all, and so the starting point of any programme within an office setting is the furniture selection. When buying a desk, it pays to buy those that are easily height adjustable so that individuals can set them at the right height for themselves, by themselves. And remember that just because a desk or chair is adjustable, not everyone will know how to adjust it. This is also true if you’re investing in sit-stand desks; make sure people know how to adjust them up and down during the day. Adjustable desks may cost more at the outset but will benefit with less lost time off work and increased productivity, particularly for those people who have to sit for long periods of the day. Get advice on the right kind of desk for your people and the tasks they are doing before you buy. It can save money long term and ensure optimal use of this furniture. Set workstations up correctly Screen height and position is another crucial area which, if not addressed correctly at the time of set-up, can lead to eye and neck strain – two of the most common complaints from high computer users, but there are others.

tips to improve your memory

How often have you found yourself in this situation: you’ve needed to remember something really important, so important that you are certain you will remember it and don’t need to write it down, only to later realise that you can’t for the life of you remember what it was... According to popular source of health advice, Mercola, you could have less of that, with more of this:

1. Eat right

The foods you eat (and don’t eat) have a crucial effect on your memory. Of the foods believed to provide the best brain power, popular favourites include: turmeric-based curries, celery, broccoli and cauliflower, walnuts, crab, garbanzo beans/ chickpeas, red meat, blueberries, and healthy fats including organic butter, olives, salmon, avocado and nuts.

2. Exercise

Exercise stimulates the brain’s nerve cells to multiply, strengthening their interconnections and protecting them from damage. The recommended exercise for improved memory is high-intensity interval exercise, strength training, stretching and core work alongside intermittent movement.

Six tips for longevity in business In 2015 when Crown Worldwide Group, who enjoys a turnover of more than $800 million, reached its 50th anniversary, founder Jim Thompson shared with Entrepreneur magazine six tips to building a business that will last decades:

1. Be in for a bumpy ride “It is rarely ever a smooth ride. You have to be the type of person that will persevere and push through all of those challenges.”

2. Have a plan and know how much it will cost “Having a plan and knowing where you are going is key for any new business, and part of that is having adequate funding. “Just how much you need is difficult to define because it depends on what type of business you are running. In our case we started out with very little capital but in the modern era, I wouldn’t recommend that.”

3. Learn to delegate and choose good people “It is not possible to do everything yourself in a successful business - you need to delegate.

But in fact the reverse is true: Core values are what make you successful in the first place. “Having respect for the people who work for you, believing in doing a good job in the right way, giving the customer a good experience, communicating with people, giving something back to society - all these things are critical. “Do things the right way and you’ll have a better chance of success.”

6. Don’t sell too quickly “Retain ownership of your business if you can. Don’t give it away or sell too early. “So many entrepreneurs today say, ‘I’m going to run it for five years then sell it.’ But I don’t think that’s what true entrepreneurs do. Instead, that’s being a speculator.”

Seven simple rules for finding success in Australia What do you get when you blend the insights of a digital entrepreneur with the discipline of traditional marketing? You get a company called Aamplify, a darling of marketing across Australasia. By any measure, the meteoric rise of Aamplify over four years in New Zealand and Australian markets has been a success. Now employing 25 people in Auckland, Sydney and Melbourne, Aamplify could be truly said to understand the psyche of the new economy more than most marketing companies. So how did Aamplify manage to capture the Australian market by storm? One reason is the digital entrepreneurship credentials of the managing partner of Aamplify – Sam Williams. Sam earned his stripes in major international markets. In 1994, he began working in Australia for a company involved in the (then) sharp end of telephone messaging systems. His job was developing new markets. When the opportunity came up for him to work in Silicon Valley during the dot-com boom of the late 1990s, he leapt at it. As chief strategy officer of a well-funded Silicon Valley phone messaging start-up (Blue Silicon), he began thinking about how to inject brand experience into every aspect of its audio product. “It took me to the UK, where I recorded the late Roger Moore to be our voice on the Blue Silicon system,” he says.

“I experienced career and life lessons that I knew could be applied to help a Kiwi business punch above its weight on the world market,” he says. “I understood the start-up mentality. I developed and deployed market and business strategies and was also tactical. “All of these things you’re forced to do as a start-up in a new country, when you simply have to make things happen.”

Aamplify begins Aamplify started out boldly in 2012. Sam cherry-picked his work fellows, with the idea that Aamplify would re-define marketing “from the client side”. “Aamplify didn’t just employ people with an agency background,” he says. “It came from people who our clients know have actually deployed and applied the things we’re advising them to do. Because of our experience, we can react and think far more pragmatically than most agencies. Our clients relate to that more readily.” Moving into Australia, Sam’s global experience kicked in. He found that what was lacking in agencies in New Zealand, was also lacking in Australia. Consequently, the business grew.

“It was a major step in understanding marketing. Roger gave us a point of distinction and differentiation. While Blue Silicon didn’t reach the velocity and scale required, it consolidated my thinking about how to get traction in a new market with different cultural values from your home.”

“We have been redefining marketing because we’ve previously been marketers inside major organisations,” he says. “Aamplify is a mixture of right-brain creatives with left-brain logical and practical people. We’re also a mixture of ages – mature and millennials together. Consequently, we connect with the new economy and understand digital and traditional marketing.”

Sam later came back to Southern California as the vice president of a New Zealand organisation there.

Some people believe you can manifest your destiny. What does the science say? We are taught manifestation from an early age through the power of positive thinking and goal setting. Tangible or quantifiable and in incremental steps, this is what form we are told our goals should take to be achievable. As we age these goals take the form of intentional behaviours that forge our path to personal and career success. Some people are able to set and achieve their goals on their own with ease, and others require, or prefer, outside assistance, support or motivation. Either is fine.

The believers The Secret is a popular documentary directed by Drew Heriot. Through interviews with scientists, authors and philosophers, The Secret investigates the principles of the metaphysical school of New Thought and the ‘secret’ to leading a happy and successful life. The film essentially concludes that what you desire you attract and you become, and you can therefore manifest your desired destiny if you want enough for it to happen – consciously or otherwise. Oprah Winfrey and Will Smith are famously outspoken about their belief in manifestation and how they use it to shape their life. But it’s not just for notable celebrities; many individuals have used some form of manifestation that they say has transformed their life. Ella Drew, health and lifestyle coach and founder of True North Lifestyle Design, was introduced to manifestation through her own quest for perfection. Battling depression and an eating disorder, she happened upon a mentor who coached her through her “blocks and beliefs” to complete mental, physical and to a lesser extent, financial freedom. It changed her life. Ella is now a health and lifestyle coach and manifestation is a crucial step on her clients “guaranteed journey to freedom”. Recently Ella ran into car problems; shortly afterwards she won a brand new Mini Cooper. She believes she manifested it.

Mentors in business Mentors, coaches, advisors; call them what you will but they are becoming increasingly commonplace in business. Today many of the most notable businessmen and billionaires are outspoken about the impact mentorship had on their success - behind many notable businessmen and billionaires has been a mentor.

In British newspaper The Sun, Richard Branson wrote: “It’s always good to have a helping hand at the start. I wouldn’t have got anywhere in the airline industry without the mentorship of Sir Freddie Laker. “Understandably there’s a lot of ego, nervous energy and parental pride involved, especially with one- or two-person start-ups…Going it alone is an admirable, but foolhardy and highly flawed approach to taking on the world.” Bill Gates is another who credits part of his success to his mentor, in this case Warren Buffet. During a 2009 interview with CBC, Gates credited Buffet for teaching him how to deal with tough situations and how to think long-term. Gates famously believes that “as we look ahead into the next century, leaders will be those who empower others.” Mentorship can also happen informally, in almost any situation, and an increasing number of people are recognising and seizing the opportunity to absorb as much information and perspective from these experiences, situations or scenarios, whether serendipitous and free or intended and paid for.

Mentorship and manifestation Part of what mentors do is instil, or at the very least encourage, some form of manifestation or goal setting. Meditation is a popular style of manifestation, as it allows one the time to focus, or mentally and physically recharge and keep on track to achieving their goals.

Jerry Seinfeld is an advocate of meditation, saying, “To me it’s a work thing - if you meditate, you can get so much work done. I always say to people you know how about three nights a year you get a good night's sleep? You can have it every day with meditation.” Oprah has also spoken publically on the subject on manifestation, saying: “Knowing that stillness is the space where all creative expression, peace, light, and love come to be is a powerfully energizing, yet calming experience. “Only from that space can you create your best work and your best life.”

To do so, we accept that we’re masters of our own experience and step into the present moment where we can effect change. But the most common argument supporting manifestation as a scientific principle is the Law of Attraction. It first appeared in print in 1877 and by the end of the century it was a solidified concept of New Thought philosophy. It is based on the idea that everything, including people and their thoughts, is pure energy and that ‘through the process of like energy attracting like energy’ – in this case focusing on positive thoughts brings positive experiences into a person’s life – a person can improve their health, wealth and relationships. The naysayers, on the other hand, note that the law of attraction is considered pseudoscience, with experts split on the subject. They say the claim by some that the law of attraction is bound by quantum physics is false; that the law of attraction is not at all based on quantum physics because ‘thought energy’ is within the realm of metaphysics, not real science. Whether or not what you truly think is what you truly become, is there any harm in taking measures that are suitable to you personally that keep you on target to achieving your goals; personal, career or otherwise?

The “Apple tax” in New Zealand Tax politics and tax policy Apple, along with other companies with global name recognition like Amazon, Gap, Google, Ikea, McDonalds, Microsoft and Starbucks, have had a lot of media coverage of late expressing concern that they pay little or no tax in the countries where they make sales around the world. Most of the global brands are selling to New Zealanders, leading many commentators to observe that these entities seem to be paying little or no tax here. This article considers why that may be so under our current laws, and how changes to international tax policy settings could affect multinationals doing business here. While politicians and tax policy-makers have been upset about such tax strategies as Google’s “double Irish, Dutch sandwich” and have called for substantial reform of international tax settings and a new “fair share” approach amongst the various countries in which multinationals are doing business, it is important to understand that a century of international tax policy settings have left us with tax laws and state self-interest which facilitates, rather than discourages, tax minimisation behaviour. Those policy settings, established in the predigital, pre-globalisation era, are now very much in the spotlight. Corporate taxpayers that take advantage of differences in tax regimes around the world are operating legally and not contravening New Zealand or other country’s tax laws. Often, they are legitimately utilising the benefits currently offered by double tax agreements between New Zealand and other jurisdictions, and the tax differences under the laws of different countries, to minimise their New Zealand tax costs. How does a double tax agreement work? In summary, double tax agreements are agreements between two countries designed to (amongst other things) facilitate investment and trade by preventing double taxation of taxpayers involved in cross-border transactions. Double tax agreements are part of our law. They are treaties which override our domestic tax legislation. These treaties determine which country or territory has the right to tax specific types of income, or limit the level of tax payable. The “deal” under these agreements is generally that a country “trades away” its right to tax income with a source in that country, taxing instead on the basis of the residence of the taxpayer.

New Zealand governments have long understood the benefits of these treaties, and currently has 39 double tax agreements in place. How might this affect multinational corporates such as Apple? Under New Zealand’s double tax agreements, New Zealand agrees not to tax a non-resident entity’s business income unless the non-resident has a “permanent establishment” in New Zealand. Even if a permanent establishment exists, not all of the non-resident’s sales income may be taxable in New Zealand. Sales income may need to be apportioned between the permanent establishment and the non-resident’s home jurisdiction, and costs incurred in relation to those sales may be deductible. Under long-established double tax agreements, multinational corporates such as Apple, Facebook and Google have quite legitimately minimised their New Zealand tax bill by not having a permanent establishment in New Zealand, despite having significant economic activity carried on in New Zealand. How will the rules change? The Organisation for Economic Co-operation and Development (OECD), has responded to this issue by proposing to amend the definition of ‘permanent establishment’ in international double tax agreements, and most OECD member countries (including New Zealand) have agreed with that approach. The proposed amendment will deem a nonresident entity (with a consolidated global turnover in excess of EUR €750m) to have a permanent establishment in New Zealand if a related entity carries out sales-related activities for it here. As a result, tax policymakers anticipate that Apple and similar companies will pay tax on New Zealand sales. Time will tell whether these changes will be effective in combating a multinational’s avoidance of a permanent establishment, as many non-resident multinationals may seek to restructure their New Zealand operations (or to

cease to sell in New Zealand entirely) in light of these impending changes. In addition to the changes in relation to the definition of a permanent establishment, there are related changes in New Zealand’s transfer pricing rules (including new rules promoting tax transparency by requiring reporting of sales activity), as well as certain aspects of our GST regime and thin capitalisation rules to strengthen New Zealand’s tax base. New Zealand’s transfer pricing rules are being amended to align with the OECD’s guidelines as well as Australia’s transfer pricing rules. A transaction will be able to be disregarded if the legal form does not match its economic substance. If independent entities would not have entered into the contracted conditions, proposed new rules would allow for those conditions to be replaced by arm’s length conditions (or allow the entire arrangement to be disregarded). The burden of proof for demonstrating that the actual conditions align with arm’s length conditions will shift from the commissioner of Inland Revenue to the taxpayer. The “time bar” (i.e. the period of time within which Inland Revenue can amend taxpayer assessments of tax) for transfer pricing issues will also be increased from four to seven years. The Government is also proposing to strengthen New Zealand’s thin capitalisation rules. It is proposed that the interest rate on related party debt will be based on the parent’s credit rating for senior unsecured debt, plus an appropriate margin. Inland Revenue considers this broadly approximates the multinational’s cost of debt. It is also proposed that the calculation of ‘assets’ is changed in the thin capitalisation rules, whereby assets are netted off against ‘non-debt liabilities’ (such as provisions and trade creditors) in

the balance sheet (but excluding loans that are equivalent to equity, such as interest-free shareholder loans). Assets will also have to be valued (for thin capitalisation purposes) using values reported in financial statements, and assets and debts will have to be measured using average values during the year. New Zealand’s GST rules were recently amended late last year through what has been coined the ‘Netflix Tax’. This has seen the imposition of GST on digital products and remote services (such as e-books, videos, music, and software downloads) supplied by offshore sellers to New Zealand private consumers. When certain conditions are satisfied, an operator of an electronic marketplace (such as an app store) may also be required to register and return GST on supplies made through the marketplace, instead of the underlying supplier. GST registration under these rules generally operates as a ‘pay only’ system involving an obligation for offshore sellers to pay GST with no ability to claim GST on costs incurred. New Zealand proposes to implement the permanent establishment, transfer pricing and interest deductibility limitation amendments, and has sought feedback from the wider public. Submissions for these proposed amendments closed on April 18, 2017. The proposed amendments to the concept of a permanent establishment under New Zealand’s double tax agreements, our transfer pricing and thin capitalisation rules as discussed in this article may therefore not yet be in their final form, so watch this space. Breaking down barriers By Natalia Rietveld

Adversity can be hard to overcome, sometimes it feels as though the world is against you and the easiest thing to do is give up. But any hardship thrown your way can be used to your advantage if you use it as the driving force behind achieving your goals; Rez Gardi’s story is one of doing just that. Imagine being dragged across the classroom by your hair because you couldn’t pronounce a word correctly. Imagine watching people die from disease and hunger strikes, and seeing your own father imprisoned for fighting to get basic human rights. Imagine not having a country to call your own, being forced from camp to camp and not knowing whether you’d have food, education or shelter at your new destination. Would you surrender, or would you fight? The things we struggle to imagine were an everyday reality for Rez. She didn’t know how bad things had been for her family until she saw how people in New Zealand lived. Rez is Kurdish. She is one of around 40 million Kurdish people worldwide who are oppressed and don’t have a country to call their own – and she claims to be one of the lucky ones. “The only difference between me and millions of other refugees worldwide, is that I was fortunate enough to be resettled in a beautiful, safe place like New Zealand, and to get an education.” Sadly, New Zealand hasn’t been always been “a safe place” for Rez, particularly after the 9/11 attacks. “On many occasions I was cornered by a whole group of kids who would push me around until I fell on the floor and then they’d kick me endlessly,” Rez says. They made her feel so worthless that she tried to erase her identity and become “as Kiwi as possible”. This changed after visiting Kurdistan in 2005 and meeting some of her family for the first time.

“I couldn’t necessarily be a freedom fighter in the sense that my parents and family are, but I realised I was quite good at writing, reading and public speaking, so I thought maybe a career in law could be my way of making a difference.”

Rez didn’t choose to be a refugee; “I was born as a refugee in a refugee camp in Pakistan”. She didn’t choose to be relocated to New Zealand and she certainly didn’t choose to be tormented by her classmates.

She hopes that having won 2017 Young New Zealander of the Year, awareness will be raised about the adversity and challenges that many people face in New Zealand and she hopes it promotes acceptance for diversity.

“I saw how beautiful the Kurdish culture and history was. I was fascinated about how everyone was speaking my language.” The trip was eye-opening in more ways than one. Rez saw firsthand the injustice the Kurds were still facing under Saddam Hussein’s regime. “I had to cross three different borders to visit everyone. When I was entering Turkey, they confiscated all the Kurdish clothes, CDs, posters and flags I had bought as souvenirs.”

Seeing that made Rez feel powerless, but she knew with an education under her belt she had the means to fight. “I couldn’t necessarily be a freedom fighter in the sense that my parents and family are, but I realised I was quite good at writing, reading and public speaking, so I thought maybe a career in law could be my way of making a difference.”

What she did choose, was to fight for all those who are not given a choice at all. Ecoware In 2011, New Zealanders sent more than two million tonnes of waste to landfill as stated on the Ministry for the Environment’s website. And that number is increasing. By Natalia Rietveld

James and Alex know this because they are involved every step of the way with their products – from sourcing materials, to manufacture, right through to composting. Every step their business takes is a giant leap towards a true, clean and green New Zealand. Their recent partnership with the Christchurch City Council is exactly the sort of thing they have been striving for since day one.

Breaking ground Starting Ecoware as a couple of guys in their mid-20s trying to convince all the top dogs that there is a waste problem in New Zealand and that they have the solution was no easy task. “You’ve got these two young guys coming in trying to change the world - we spent the first few years just educating people,” James explains. “Persistence beats resistance. We were up against multinationals and we were this foreign object that people didn’t take seriously.”

It says “The amount of packaging consumed by each New Zealander is growing. Reasons for this include design and marketing, safety/ food standards, demographics and lifestyle.” An island of plastic waste, expanding 2.5 million sqkm, has been discovered in the South Pacific, much of that waste is believed to have come from New Zealand. Ecoware co-founders James Calver and Alex Magaraggia realised a long time ago the extent of New Zealand’s waste problem. But unlike most who would just sit back and wait for something to change the two friends decided to act upon it.

Ecoware came to life six years ago. It is a brand of food and beverage packaging created without the use of fossil fuels and is New Zealand’s first carboNZero packaging company. While studying a marketing and management degree at Auckland University, James got a job placement doing event management; one of the events he undertook was the Weet-Bix Kids TRYathlon. Included in the job description was organising the waste disposal. Earlier this year nearly 29,000 children took part in the TRYathlon; with every child comes supporters and a lot of people create a lot of waste.

Now people are beginning to realise the issues surrounding waste, with the all the talk about climate change, but James believes New Zealanders still have a lot to learn. “People are aware of the problem, but I don’t think they are fully aware of the magnitude. “Pretty much every piece of plastic created still exists. The word ‘recycling’ sounds nice, but you’re ultimately just reusing fossil fuel plastic.” James questions how it will ever disappear.

After getting a couple of people on board they were able to prove to others that they weren’t ‘all talk’. And now they are proud to have the backing of a major city council – and rightly so. “Councils need to lead by example and Christchurch is doing that, because if they’re not doing it, then why should all the little food vendors and cafés do it?” The Christchurch City Council has made a bold decision and James says hopefully after seeing the positive results, other councils will follow suit. The trial took place earlier this year and has proven to be hugely successful. With the use of Ecoware products across three of Christchurch’s major events they have managed to divert 12 tonnes of waste from landfill. The council is now looking into phase two of the trial which will see them using compostable packaging at 30 events over the next 18 months. James says it’s more than just diverting waste from landfill - when people see their local council taking on this sort of initiative it’s only a matter of time before the community starts to get on board and change within individual households is encouraged. Survey results taken at the events have shown the flow-on effect is already taking shape.

Walking the talk France has declared it will ban all single-use plastics by 2020. Australia has increased their landfill levy rates significantly in an attempt to deter people from mindless dumping. New Zealand needs to step up if it

is to remain the ‘clean green’ nation it claims to be. The Ministry for the Environment’s 2008 survey showed that around three quarters of the waste disposed of in landfills could have been diverted. “New Zealand as a country is so far behind the majority of the rest of the world,” James says. “We are only clean green New Zealand because we are too small to make a mess.” The problem is, it is far too easy and far too cheap to just dump everything all together. Before the trial with the Christchurch City Council, commercial composting facilities couldn’t accept food packaging waste due to the risk of contaminating their high-grade organic certified compost. James and Alex, alongside the council, worked tirelessly to create a product that could not only be composted at these facilities, but could withstand the different foods these events had to offer. Their Kraft tableware range was the product for the job and lived up to their expectations. Already on the right path, the duo refuses to stop here. While creating products from plant materials is far more superior to using fossil fuels, Alex and James still want to do one better. “At the moment we are turning plants to plastics, but in about three or four years’ time, we are hoping to catch methane or greenhouse gas emissions from the atmosphere and turn that into polymers, so we are creating a carbon positive product.” They have a pilot factory already on the task. “It was one thing for us to produce and sell environmentally-friendly products, but we wanted to take that one step further and actually prove that we do care.” They have even decided to invest some of their proceeds towards different environmental causes. “About 10 percent of our profits last FY went into forest restoration programs and end of life education; we want to be more than just a packaging company.” In six years this dynamic duo has made themselves known in more ways than one. Having only just reached their 30s they’ve still got plenty of time on their hands and plenty of tricks up their sleeves to shape New Zealand’s clean green image. The lesser evil Marijuana, society and the impact of heavy consumption By Natalia Rietveld

And so, the debate continues; as stated in our previous articles, an overwhelming number of New Zealanders are in favour of law reform when it comes to the Class C drug marijuana. It appears marijuana can do no wrong and everything is pointing in its favour – even Sir Richard Branson is suggesting we use marijuana to our advantage. Economically speaking it seems to stack up. But socially – that’s another story. The age-old argument is that marijuana is the lesser of two evils when compared to alcohol, unfortunately that is a hard one to prove, as alcohol is far more prevalent in our society. In a survey conducted by the Ministry of Health, it stated that the proportion of New Zealanders aged 15 years or more who drank alcohol in the past year, was 80 percent (in 2011/12). Of that 80 percent “one in eight past-year drinkers consumed a large amount of alcohol (more than six standard drinks for males or four for females on a drinking occasion) at least once a week”. Compare that directly to marijuana use; in a 2007/8 New Zealand Drug Use and Alcohol Survey (NZADUS) it states that 46.4 percent of the New Zealand population had tried marijuana in their lifetime and one in seven of those aged 16-64 years had used it in the past 12 months. University of California’s Magdelena Cerdá led a study team who conducted a thorough investigation based on participants from the Dunedin Multidisciplinary Health and Development study, often referred to as the Dunedin Longitudiual Study. It states that when comparing alcohol and marijuana, in terms of the severity of social effects associated with heavy use, alcohol use had a bigger part to play in traffic offences and violent crime than marijuana. The New Zealand Police (New Zealand Police 2010) estimate that “approximately one-third of all police apprehensions involve 18 | September/October 2017    www.aucklandtoday.net.nz

alcohol”. They go on to say that “half of serious violent crimes are related to alcohol”. Odyssey House Community Services team leader, Kereama Carmody, has been with Odyssey House for seven years. He says around 90 percent of what he deals with is alcohol related and he hasn’t seen a lot of violence associated with heavy marijuana users. Of the six people currently in the youth residential addiction unit, there is one person in there solely for cannabis addiction. “You don’t see them get aggressive when they are having cannabis withdrawls. It takes away the motivation, so you end up having those issues around schooling and attendance.” And that relates directly to what Magdelana and her team noted in their study. Magdelena told UC Davis Health Newsroom that their research wasn’t intended to support legalisation of marijuana nor was it against it. “But it does show that cannabis was not safe for the longterm users tracked in our study.” When looking at only the economic and social consequences of frequent marijuana use, they found that it was just as detrimental as heavy alcohol consumption. It states, “the more years of cannabis dependence, the worse the economic and social problems”. Dunedin study members who were dependent on cannabis were also more likely, during the course of their lives, to be dependent on alcohol than were study members who were not dependent on cannabis. The social issues noted by heavy cannabis users remained consistent though when factors including abuse of alcohol were removed.

Workplace The study linked persistent cannabis dependence (and regular cannabis use) with antisocial behaviour in the workplace. Study members reported behaviours such as lying to get a job, quitting without notice, being purposely counterproductive, stealing money and falsifying hours.

Financial In the study it states that “Cannabis dependence was more strongly linked to financial difficulties than was alcohol dependence”. Study participants were measured in net worth, troubles with debt and cash flow, difficulty to pay basic expenses, food insecurity, welfare benefit receipt, and credit ratings. They admit in the study that the burden placed on society due to alcohol consumption is greater than that of marijuana use, given that alcohol is legal and readily available, “the burden posed by cannabis use may increase, however, if cannabis use increases after legalisation of cannabis use”. “Our data indicate that persistent cannabis users constitute a burden on families, communities, and national social-welfare systems. Moreover, heavy cannabis use and dependence was not associated with fewer harmful economic and social problems than was alcohol dependence. Our study underscores the need for prevention and early treatment of individuals dependent on cannabis,” the team stated at the time. So what is the lesser of two evils? It’s safe to assume that time will tell, but if the Government is in favour of marijuana law reform, we may just have to up our services to assist those who find themselves struggling with dependency.

“We are building a new team at present and are taking baby steps, but we may add to the staff in future,” says Blair. Blair has lodged an application to be a licensed building practitioner with the Building Practitioners board.

With 35 years’ experience as a builder, boat builder and marine engineer, Blair Cole takes a lot of pride in his background, having always worked in the three trades. “I’ve built waterproof boats, and I build waterproof homes too!” Over the years he has built up many contacts in the three industries throughout Albany and Auckland. Project development could run in the blood as other members of Blair’s family are also involved in project development in Tauranga and the Coromandel, while his 19-year-old son is currently in his first year of a building apprenticeship, and is held in high regard by his employer. Coffee with conscience IncaFé was founded to promote organic coffee on the beliefs that all organic produce tastes better, is much better for the consumer, grower and environment, and that small community farmers are the ones that usually look after the land the best and should receive at least a living wage for their efforts. Hence, IncaFé has been organic and Fairtrade certified from the start. IncaFé Organic Coffee celebrated 10 years last April and was the first roastery to be carboNZero certified in 2008. The idea of IncaFé was born in 1998 when founders Carmen Castro and Joop Verbeek met in Peru whilst he was working there. They moved to New Zealand in 2000 and opened a small cafe in Queenstown in 2003. The roastery was set up in New Plymouth in 2007. Although a relative newcomer to the Auckland market, its coffee has also been available through iCoco Coffee, an Auckland roastery founded in 1998 that became part of IncaFé in 2008. Since 2015 IncaFé has been operating a café and barista training centre at 31 Sale Street in Auckland’s CBD. The company gives various training courses there including the internationally recognised City & Guilds qualification.

The business has grown substantially through its brands, exports and private label products. Carmen says their unwavering focus on quality means they provide superior beans, which have won numerous awards since 2012 at the New Zealand Coffee Awards, including the Supreme Award in 2013-14. She says much of the coffee flavour is determined by the quality of the raw beans. A big part of the company’s success is selecting the right growers and working very closely with them. “Our coffee is hand-picked and mostly shade grown at high altitudes in some of the world’s best coffee growing areas. We buy almost all our beans directly from our growers to ensure maximum quality.” IncaFé works closely with the coffee growers in Peru. “Since 2006 we have worked with Felix Marin, who founded Coopchebi originally with his five brothers and are the most awarded coffee growers in Peru.

Argenta is leading the world in animal health innovation.

Argenta might just be the one of the most successful New Zealand businesses you’ve never heard of. Started in 2006, it has grown from a South Auckland startup to a global pharmaceutical business employing almost 500 people around the world. We asked Doug Cleverly, Argenta’s co-founder and CEO, about the trajectory of the business over the past 11 years and its path to global expansion and success.

We worked in close collaboration with the client from the very early stages of research, right through to manufacturing scale-up, registration and commercial supply. We invented, developed and tested the product until it was ready to be put out into the market.

You have sites in the US and the UK now. What has that meant for your capacity?

I started my career in the early 1990s, working as a forensic scientist and a toxicologist, but I switched to a job in formulations chemistry in a lab. After years working for pharmaceutical companies and research labs in New Zealand and in the USA, I came home, started a contract research business, then co-founded Argenta and bought the South Auckland site that is Argenta’s global headquarters and New Zealand manufacturing plant.

Today, the company exports products and services to more than 40 countries. We have the capacity and agility to service a broad range of clients, from large animal health multinationals through to emerging biotech and life sciences companies. And we have the capacity to work from, as we call it, Molecule to Market.

The product invention work and chemical R&D was carried out by our R&D teams in New Zealand and Kansas. We conducted the clinical R&D in the US via our network of veterinarians. We assisted the client with FDA registration for retail in the US and Europe, achieving a single pass approval through FDA. The product is manufactured at Argenta’s facility in Auckland and bottled in Iowa, before successfully launching in the US market in February 2017.

What does that mean, exactly?

What’s the future for Argenta?

It sounds like the growth was rapid. How quickly did you become a global business?

I’ll give you an example. Aratana Therapeutics is a USbased company that develops therapies to treat medical conditions in cats and dogs. Aratana’s founder approached us at an industry conference in 2009 with an idea to translate a range of chemistries, created for human health, into products that would aid the health of animals.

In the short term, we are evaluating setting up a new R&D capability in our Dundee facility, expanding headcount and facilities in Kansas, and building additional capabilities at our R&D headquarters in New Zealand.

How did Argenta come to be?

Even in those early days, I knew that here in New Zealand, if we had a business that worked with the rest of the world, we could do well. By our second year, Argenta had won a major R&D contract with what was then called Pfizer Animal Health, and the team began to grow. Two years later, we acquired New Jersey-based clinical research provider, AlcheraBio. We experienced some tough times during the Global Financial Crisis, like everybody else, but we survived and in 2012 we opened a research laboratory in Lawrence, Kansas City. In January 2016, operations began at AML Riverside in Fort Dodge, Iowa. And in April 2017, we acquired our first European site in Dundee, Scotland.

What exactly does Argenta do? We’re specialists in the world of animal-health pharmaceuticals and have significant IP in this space. We’re a provider of research and development (R&D)

This was a novel concept and Argenta was excited by the challenge of how to progress the concept into a range of viable products. We provided regulatory consultation via one of our US sites and that assisted with raising capital to fund the initial stages of their business. This later expanded into the provision of a regulatory strategy that in turn lead to a business plan that the client used as a basis to seek further specific advice and funding relating to the various activities outlined in the plan. In late 2010, our R&D team was engaged by Aratana to research and develop a specific product for the management and control of pain in dogs. Over the next seven years, we became the research engine for this product. All divisions of Argenta were engaged in

The company plans to become a company with manufacturing revenues in excess of US$500M per annum in the next decade; such growth will be driven by tripling R&D output and stepping up the company’s innovation effort. The world is truly our oyster, but as the saying tries to convey, it is hard to pry open and not every oyster has the pearl. Whilst it’s wonderful, albeit challenging, to be in the current cycle of rapid growth, there is the ever-present need to manage risk. Our management, our board and our shareholding represent the perfect balance.

Looking out for the elderly As children we are taught to respect our elders, with years of experience under their belt they bring a wealth knowledge and wisdom, they’ve worked hard their entire life to earn that respect and to live out their retirement comfortably. Our own lives are spent working hard so when it comes time for us to retire we too can wear that badge of respect and enjoy the fruits of our labour. Unfortunately for many older people in New Zealand that rite of passage is ripped away from them and too often it’s ripped away by those who they love and trust the mosttheir family. Age Concern statistics show more than three quarters of alleged abusers are family members and more than half of the alleged abusers are adult children or grandchildren. Somewhere along the line the respect and admiration we are meant to hold and should hold for our older family members has been lost. Being lied to, neglected, manipulated, stolen from, disrespected and sometimes physically and sexually abused is a reality many of our older New Zealanders face and with the rising aging population so too are the cases of neglect rising alongside it.

The following MAY indicate an older person is being abused: • Unexplained behaviour, sleeping or eating habits • Withdrawal and/or edginess • Fear of a particular person • Confusion • Unexplained injuries • Drowsiness (due to over-medication) • Recoiling from touch • Unusual withdrawals from bank accounts • Unpaid bills, lack of money for necessities.

in your neighbourhood or even a loved one. “A call, as simple as someone saying ‘there’s something going on here or ‘it doesn’t look right’ and we will follow up with the older person and work through it with them.” Although Age Concern receives more than 2,000 referrals each year, it is estimated that only one in 14 cases get reported. That is due to a number of factors and it can get very complicated when family members are involved Stephanie says. “It’s something we can’t change overnight sometimes. We have to form a relationship by listening and gaining trust and that can take a while. “We have to respect the older person’s needs and desires. Through just listening and gaining trust we can help them understand that this (the abuse) is not what they should stand for.” Age Concern works alongside many other agencies such as health services, needs assessment services, the police, and banks to ensure the best possible outcome for the older person.

Since then, finishing technology has provided a steady stream of protection and colouring improvements. The first and most important of these was the development of the anodising process, which converts the aluminium surface into an extremely hard, durable, corrosion resistant, long-lasting oxide finish.

The Tanners are enthusiastic proponents of the benefits of anodising aluminium. “It won’t flake, peel or blister; it has superior corrosion resistance to other coatings; it is resistant to solvents and thinner products, as well as to graffiti and scratching; it is colourfast and because the oxide becomes integral to the aluminium itself, the metal has greatly extended longevity.”

The process was first used on an industrial scale in the United States in 1923 to protect Duralumin seaplane parts from corrosion. Here in New Zealand the property development company Chase Corporation established the original anodising plant in Auckland in the 1970s to anodise aluminium for windows in commercial properties it was building. Today Alert Anodising is privately-owned and operated by the Tanner family and takes great pride in its knowledge of the anodising process, and its years of experience in applying it to a wide range of aluminium products.

“The plant came into our family some 30 years ago when my father-in-law bought it,” says Karen Tanner, the current co-owner of Alert Anodising. “Then he sold it on to my husband and me just over 18 years ago. We were in our 30s then and looking for an opportunity to be in control of our own destiny. Now our son is also involved and is an anodiser and supervisor on one of our anodising lines. That’s three generations in the family.” When Don and Karen Tanner took over the business, the anodising tanks they used could handle lengths of aluminium of no more than three metres. “We needed to grow and handle greater bulk. Servicing virtually anything with wheels It’s the beginning of a new era. What was originally the Franklin Electric Power Board workshop, and then the Counties Power workshop, is now a privately-owned company still with the same old-school work ethic, but looking to the future for opportunities to grow and innovate in the fields of engineering and heavy automotive servicing. The Franklin Electric Power Board came into existence in 1924. That fact has contributed to the newly formed company’s name – The Workshop Est 1924 Limited. Back in the 1920s Franklin EPB was just a small power company, but it had its own mechanical department to maintain its trucks and other vehicles. Then Franklin set up an engineering workshop as well, to make the various hardware components associated with power generation – things that couldn’t be purchased easily from overseas. These two departments were still in existence when in 1993 Franklin became Counties Power, and now engineering and heavy vehicle servicing is the core business of The Workshop Est 1924 Limited. “Counties Power wanted to concentrate on its core business within the energy distribution business,” says The Workshop’s new owner Chris Cranshaw. “I’ve always liked workshops and building things, so the chance to buy the engineering and mechanical units of Counties Power was very serendipitous.” Chris gained not only a workshop with a long tradition, but also a number of longserving staff with a huge range of skill sets and expertise.

Both Chris and John have a vision for the future of The Workshop 1924 now that they can determine their own direction. They want to broaden the range of products they make and the range of vehicles serviced. “With so much publicity lately about electric vehicles, putting in place the skills and equipment to convert big diesel trucks to electricity is definitely something we will be considering. “But whatever we do, the future looks exciting for our new company with its solid foundation in the past”. Nothing is ever quite the same. “We’ve designed and made some pretty strange pieces of equipment over the years in the engineering workshop, and mechanically, we service virtually anything that moves with wheels on. “That includes all types of large heavy trucks. There are not many places that can lift these and have them in the air all day while mechanics work underneath! “One of our latest projects has been a fit-out and refurbishment of the Microsoft offices in the Auckland Viaduct. This was a very large area – some 1,800 square metres on one floor of the building. “Everything was stripped out and completely remodelled with meeting rooms, breakout rooms, a cafe and work spaces to accommodate 150 staff. The design is striking, contemporary and light-filled and a very pleasant place to work.” Geoff says that another very satisfying recent project was the fit-out and refurbishment of Level 8 of the AA Centre where once again everything was stripped out, right back to just the concrete walls and the windows. The space was then remodelled into what Geoff refers to as a “very cool office”. Designed by Athfield Architects the space has a modern industrial feel with polished concrete floors and black veneer and steel features. Social responsibility FRAMECAD is moving strongly towards increasing its humanitarian work. The company recently completed a project with the New Zealand Red Cross in Fiji, building schools as part of the clean up following last year’s cyclone Winston, and has built schools in Haiti following the devastating earthquake. The company has also developed technology to speed up the construction of social projects, such as schools, community centres, housing in any environment.

The company then takes the output of that 3D model and sends it to their manufacturing process, which they also developed. There it effectively prints the parts for high precision steel structural components, to make everything from a house to an eight level hotel.

Drain clearing experts The Tamaki College sports ground is an example of the larger jobs recently undertaken by FreeFlow Drain Specialists. To prevent flooding on the field, which is used regularly in winter by rugby players, the team improved the sub soil drainage. This involved surface relocation, excavation, installing a sub soil drainage system, back filling with scoria, replacing the top soil then laying grass. “This was one of our bigger jobs,” says director Kumi Rao. “But we also do a lot of smaller jobs throughout Auckland, particularly drain unblocking, cess pit and sceptic tank cleaning.” FreeFlow Drain Specialists has also completed contracts with the Waitemata District Health Board and Counties Manukau District Health Board, along with large companies such as cleaning and maintaining the cess pits and sceptic tanks for Auckland Meat Processors Ltd. Kumi and his fellow director Suds Iyer say while these bigger jobs are interesting and varied, much of the company’s work involves drain unblocking and cleaning, sceptic tank and pit cleaning for smaller companies and individuals. The efficient alternative to standard pile foundations With a proven track record of more than forty years in Australia, Rob Voigt thought it was time to bring it to New Zealand. Screw piles can be used in conjunction with timber, steel subfloor systems or integrated into a concrete slab. Screw piles have the distinct advantage over conventional piling systems as they can be easily removed with minimal disturbance to the area they were installed, making them the perfect option for any temporary structures, accommodation or site offices etc. “We’ve tested piles in a paddock and in a gravel driveway, the next day we barely noticed that they had been there,” Rob says. His team work closely with the engineers, to provide a fast, accurate and cost-effective system that meets or exceeds the NZ Building Code and standards. Screw piles are even an option for installation of road signage, light poles and footings for sculptures. They again have the advantage over conventional systems as there is no need for excavation, concrete, or large amounts of labour. Conventional systems can be hazardous operations in public areas. As the loading of the pile is measured as it is installed, extensions are added on until the required loading, stated by the engineer, is achieved. This depth may vary from pile to pile, but this method ensures they do not go any deeper than required. No over engineering Each individual pile is drilled down to a specific KN which is calculated from the engineers required loading. As each piles KN is known at all stages of drilling, we drill to a depth which is determined by the loading requirements. These depths are all dependent on the ground condition in that precise location. Minimal concrete If concrete is to be used at all, it is only used to stabilise the top section of the pile - whether it be in a shallow strip footing or an individual pile cap. This saves time as there is minimal excavation and waiting time for concrete to set. Minimal excavation Piles can be installed in the existing ground contour or a pre-excavated platform. When the piles are installed, there will not be any spoil removal required from the

pile locations. Work can be carried out in any conditions and do not require slurry clean out, submersible pumps, or extra disposal costs due to weather conditions. The stunning University of Waikato design The University of Waikato engaged Opus Architecture to design the new “Te Piringa – Faculty of Law”, an iconic landmark building for Waikato University.

Opus has gained invaluable experience in this field when it was the first to introduce these systems in New Zealand for the Ministry of Justice.

The new building provides high quality teaching spaces and faculty accommodation with cutting-edge technology, optimum connectivity and adaptability.

Through the design, Opus has used architecture as an expression of the way we learn and the way we relate to our environment - creating areas that facilitate the educational process.

Conceived as a new gateway into the existing campus, the design utilises a challenging sloping site to create dynamic circulation patterns and spaces where users can socialise and relax. The journey through the building offers a discovery of space, light and connection. The law is an important cornerstone of civilised society and this philosophy was a strong driver influencing the choice of materials. The predominant monolithic concrete palette expresses solidarity and provides longevity and low maintenance, steel represents strength, glass achieves a high degree of transparency and wood was incorporated for its organic relationship. The office tower is naturally ventilated and has an external structure allowing each floor to be subdivided in various ways without restriction. Flexibility is the key which allows shared teaching spaces to be used for more than one purpose. The design also references the rectilinear nature of both the Student Centre and the Performing Arts Centre, thereby helping to create a timeless vernacular across the campus. An outstanding architectural feature is the ceremonial staircase, which creates a journey for the visitor to enjoy the illustrated 50-year history of the University of Waikato. Another feature, the Moot Court, is a fully functional courtroom, with demountable fittings, enabling the majority of space to be used for other purposes when not set up as a courtroom. The Moot Court is a classic example of innovation using the latest AVL technology that allows linkage anywhere in the world – this has amazing potential for distance learning and for international connections, lectures, case discussions and research meetings.

A green roof links the three buildings together, creating an outside space where the students can circulate and relax. A central sunken courtyard gives users of the lower levels a connection with the external world.

The end result is a modern tertiary education facility which integrates cultural aspects and acknowledges the contribution of Maori Pedagogy (Akonga Maori), and also the contribution of the University of Waikato in areas of Maori law and business. “A daring move by an architect on his own home,” is how the jury of the 2017 Auckland Architecture Awards described the alterations made by architect Jonathan Smith on his family’s villa in Ponsonby. That “daring” move won Jonathan and his team at Matter the NZIA Housing Alterations and Additions Award. It’s by no means the first award this architectural practice has earned. “Being recognised by our peers for our work and for all the skin we put into the game is fantastic,” Jonathan says. “Our projects are a collaborative journey that we take with our clients, contractors and consultants. We really invest in the projects and seeing our hard work fulfilled in a tangible way with an award shows that we have been effective and achieved a superior outcome.” Matter was formed in 2012. Its name reflects that the core of architecture is matter and the team of five involved have applied their collective expertise to a wide spectrum of design work and solutions throughout New Zealand and Australia. “We began with new builds and renovations and that is still our core passion, but we are now also known for urban planning, design and strategic thinking, as well as work on apartments and commercial buildings. No

matter what we do however, we have a profound commitment to our clients and to their requirements.” Jonathan explains that Matter does not have a recognisable style. For them every job is new and it is the context of both client and site that drives the approach and the design. “The many awards we have won are testament to the variety of work we have undertaken. When it came to the alterations to Tree Villa, his 1890s heritage-protected villa, Jonathan saw the opportunity to really push the boundaries as an architect and to experiment. “We had owned the property for eight years. It was in very bad condition and eventually we determined it had to be brought up to 21st century standard for healthy family living. I knew it would be a complex process though.” The complexities lay with the historic overlays and character of the villa, with the narrowness of the site and with the need to take close neighbours and the fabric of the local community into consideration. Tackling the big projects with ease Replacing bridge joints on Auckland’s Grafton Bridge and conducting concrete repairs and concrete protection to the Tuakau Bridge in South Auckland are among the recent projects undertaken by specialist construction firm MaxBuild. Constructed in 1910, the iconic Grafton Bridge is listed by Heritage New Zealand. Maxbuild replaced the eight bridge joints with a Wabo joint system supplied by BAS. MaxBuild business development manager, Paul Tanner, says this system met the requirements for movement accommodation and traffic exposure. “As Grafton Bridge is a core component of Auckland’s public transport network and is located in an urban area, the bridge joint replacement needed to be undertaken efficiently during night time working hours and within strict noise limits.” Constructed in 1933, the Tuakau Bridge is an important crossing of the Waikato River. MaxBuild is a trained specialist installer of bridge joints. PRO-FLOORS MARKS ITS SECOND DECADE OF SUCCESS Pro-Floors rung in 20 years of successful business on the 4th of July this year. For director Wayne Valder, it has been 20 years of grass roots and sticking to the knitting. Back in 1997 Wayne had been steadily swinging a hammer for 16 years, subcontracting to market leaders G J Gardner Homes and Golden Homes, when they approached him with the idea of extending his work onsite to the rib raft concrete floors. Hence the creation of the Pro-Floors brand. A builder with a belt became a sub-traded contractor with a 10 tonne digger, an Isuzu four wheeler, a Mitsubishi six wheeler and five full time staff.

The Auckland construction industry was in a boom and Pro-Floors soon branched into excavation.

The scope and versatility has developed into hotmixng, drainage, concreting and kerbing over the 20 years.

With rapid growth in the new sector, commercial excavation became Wayne’s main focus and in 2000 he bought his brother, Grant Valder, in to manage and eventually the sale (in 2007) of the concreting side of business.

The fleet has also grown and is currently running at 17 Mitsubishis, 18 excavators, four bobcats, a hotmix machine, six rollers, two graders, two crusher units, two loaders and 18 Hilux utes.

Today Grant operates Pro-Floors Concrete Ltd in a yard right around the corner, specialising in foundations, floor slabs, readymix and paving products. Despite keeping the Pro-Floors name, the company specialises in commercial earthworks.

Pro-Floors 20th birthday was marked by the opening of Wayne’s newest venture, a Cleanfill tip located at Brookby Road. “The tip gives us a significant difference in the civil industry. We are able to dispose of offsite spoil in our own tipsite, which reflects directly in the competitive costs we offer and are able to pass onto the client in cartage and tipping,” Wayne says. “What do you mean $400K…?!” she said with a sound of disdain. There was a long silence. “But… our architect said it would be less than $200K. “That is all we have in the budget and we have already spent over $20,000 getting it through council,” said the quivering voice on the other end of the phone. I tried to reassure her. “What I suggest is that I put together a detailed quote with all the quantities and the costs.” She cut me off sharply. “Look! Don’t worry, I will call around.” And just like that she was gone. Two weeks later I get another call. “Hi, it’s Erika. We spoke recently about our renovation and you offered to do a detailed quote? I have been requesting prices from several builders and those that have bothered to respond have not included many details. It feels like these guys are just pulling prices out of the air because they are busy and can charge what they want.”

I get calls from people like Erika all the time. The truth is that 95 percent of builders are honest and in reality, putting together even a basic quote takes them a lot of time, usually after-hours time… that was previously reserved for family. In Erika’s case, she was looking to add 100 square metres to her house. Her architect had estimated $2,000 per square metre, but that is very conservative; $2,500 is more realistic for quality workmanship and $3,200 on the high end. Then there was everything the architect had forgotten to mention in his estimation like: New roof, new kitchen, new bathroom, new floor linings, all existing walls insulated and re-gibbed, whole house painted, all new joinery, and removing load bearing walls and putting in beams. Now Erika was faced with the bills for plans and a building consent on a project she couldn’t afford to complete. This situation could have been easily avoided. Here are the five mandatory steps that anyone considering a renovation or extension must do before starting. 1. Find a builder 2. Get a concept design 3. Get it costed 4. Make compromises
