The Palm Beach Art Collection Features Open Impressionism

A blend of classical impressionism and modern expressionism, with a dash of plein air style, artist Erin Hanson uses the ‘alla prima’ technique, capturing the drama and movement of nature.

Hanging precariously and horizontally from red sandstone hundreds of feet above the ground may not seem like it would inspire the creation of beautiful oil paintings, but that is precisely what happened with Erin Hanson. The colorful cliffs of Red Rock Canyon, Nevada, inspired Erin to paint with thick, blocky strokes of paint, and she developed her own techniques of capturing the vibrant colors and bold lines of the desert, in a new style of painting that became known as Open Impressionism.

Open Impressionism uses color to create emotion, thick oil paint strokes to create movement, and separated brushwork to create a stained glass effect; a blend of classical impressionism and modern expressionism, with a dash of plein air style. Unlike traditional oil painters, Hanson does not build up the painting layer by layer; instead, she lays her paint strokes side by side without overlapping and works to get each stroke “right the first time.” These clean strokes give a mosaic effect to her paintings, while also conveying a sense of movement to her work. She uses a limited palette of only five pigments to create a vivid dance of un-muddied color upon the canvas, choosing colors that ignite the imagination and capture the emotional feeling of being out of doors.

prima. “Alla prima comes from Italian, literally meaning ‘at first attempt’ and is loosely applied to any painting that is done in a direct, expressive style.

“I extensively plan out my paintings before I start painting with a brush, working out compositions and color combinations that will most effectively capture the drama of the landscape. I work with a limited palette of 4-5 colors, which I mix into a wide variety of hues and values appropriate to the scene I am creating. When it comes time to paint, I try to get the painting ‘right the first time,’ using as few brush strokes as possible to capture the immediacy and emotional movement of a landscape. The French term for this application is “premier coup.” You can see the texture of every brush stroke in my paintings, since I do not layer or thin my paint with turpentine. The result is an impasto oil painting with additional depth and movement from the thick texture of the paint.”

How one woman’s passion for bee keeping has impacted local communities, providing sustenance and a positive environmental impact.

Sierra Malnove was given her first beehive in 2012 by a bee specialist and since then it’s been all about the bees (and honey). It was that same bee specialist that recommended Sierra after a talk he gave at Broken Sound Country Club led them to want to get into the bee business. They had bee needs and she wanted more bees, a perfect match.

Now nine years later Sierra tends to bees at 28 golf and country club communities throughout Southern Florida as well as numerous private clients. “Backyard beekeeping is becoming very trendy,” Sierra enthuses, “there’s over 5000 registered beekeepers in Florida and many “over winter” their bees in Florida.”

“There’s so much diversity [at the clubs], a real safe haven for the bees, a visual buffet for the eyes and an actual buffet for the bees. What attracts the members in the first place visually is coming full circle to something they can actually taste.”

“BallenIsles Country Club was going to get rid of a portion of saw palmetto during renovations,” Sierra explains, “I took them out there during bloom and they saw ten different species of pollinator and then they tasted the honey fresh out the box, it changed their mind and they kept the saw palmetto.”

The small batch honey that Sierra will extract and prepare at her Kosher Certified Palm Beach Creamed Honey facility are truly all unique. “Every location is totally different – native, tropical, maybe a majority palms, what kind of annuals and perennials do they use? And it will all produce different flavored honey.”

“I have three locations in Admirals Cove so close to the water the bees make mangrove honey, it’s a really special batch,” Sierra says. “I like to touch base with every department, golf maintenance, the general manager, chefs and bartenders to see how they all can utilize the honey. Utilizing honey as amenities or gifts, food and drinks, the spa; the programs also can help clubs get and maintain their Audubon Certification.”

“Admirals Cove is implementing the honey into facials,” She says, “infused with rose hips and 25 carat gold, it’s really renewed a sense of awe and interest in the program.”

“The club bees are really living their best lives, low stress levels, not being moved around to pollinate, year-round forage, no competition, and they don’t have to be artificially fed.”

And the last time she was stung?

“Yesterday, right on the nose!” Sierra pauses, “there’s no managing the bees, it grounded me, you can’t be mad at the bees. What you give off is what you get back. It’s the vibe in the air. I want to be the happy bee lady.”

Beginning with her eponymous interior design company, McCann Design Group, Sara McCann has grown her Hive brand into a multi-functioning collective that includes all aspects of design, furniture, clothing, floral, kids and even the occasional croissant. All filtered through one defining lens and disseminated to a team that shares a belief in that singular vision, working in harmony to create unique looks start to stop, bottom to top. Almost like a hive mind.

Opened in 2013, Hive Home, Gift, and Garden was born out of a designer’s needs. “With so many of our interior design jobs at that time there was no place to go to for that last ten percent of the project, the finishing details and accessories,” Sara explains, “The Hive home store was born of that necessity.”

It truly is an all-in-one design stop and shop, with the added feature that anything purchased in the store can be delivered to the buyer that same day. Furniture, lighting, and accessories are curated and arranged in vignettes so people can get a vision of what it would look like in their own space. The entire selection of products for sale are vetted by Sara. In fact, the motto of the enterprise is “Sara wouldn’t put anything in the home store that she wouldn’t put in her own home.”

Speaking of new and exciting, Sara has already decided on Hive’s next trajectory, a space further down Dixie Highway south of Southern to be called Pure by Hive. Opening late fall, Pure will offer a more contemporary aesthetic, not quite modern but with updated, clean lines and new vendors targeting a younger demographic. “We’re noticing clients want a cleaner aesthetic,” Sara says, “they’re choosing more contemporary or transitional furniture.” And her advice for those Florida newcomers? “Don’t be afraid to start fresh with furniture choices and color palette.”

“Although we work primarily in Palm Beach, we are fortunate to have projects in Kennebunkport, Southampton, Lake Geneva, and Birmingham,” Sara announces. The Hive mind is expanding.

Can These Walls Talk?

Do Americans have a First Amendment right to express themselves through the custom design of their home, thereby avoiding local regulations that seek to promote community aesthetics? That’s the question a divided panel of the Eleventh Circuit recently addressed—the first federal appellate court to do so—in Donald Burns v. Town of Palm Beach (2021).

Burns’s Custom Beachfront Mansion

Donald Burns, a resident of Palm Beach and former telecom executive, sought to demolish his 13,000-square-foot Bermuda-style mansion and replace it with a midcentury modern home nearly twice the size. His new two-story oceanfront mansion would have a basement garage, wine storage area and steam room, and would be screened from view by a limestone wall, louvered gate and heavy landscaping.

Palm Beach’s seven-member architectural review commission, experienced in art, architecture and real estate, denied Burns a permit, finding that the proposed residence did not satisfy the town’s “look-alike” ordinance because it was excessively dissimilar from other homes within 200 feet with respect to specified architectural and design criteria.

Burns Sues the Town of Palm Beach

For decades, courts have concluded that the First Amendment protects far more than just the spoken and written word. Based on this principle, Burns sued the Town of Palm Beach in federal court, claiming the town had denied his First Amendment rights to express himself through his residential aesthetic. He complained that the commission had rejected his proposed design based solely on that aesthetic—in other words, simply because they didn’t like midcentury modern-style homes.

During the litigation, Burns asserted that he sought through his design to communicate his “evolved philosophy of simplicity in lifestyle” and the message that he was “unique and different” from his neighbors. He wanted his new mansion “to be a means of communication and expression of the person inside: me.”

The trial court ruled for Palm Beach, albeit finding that the proposed residence did not fall neatly into existing First Amendment case law.

On Appeal, A Split Eleventh Circuit Rules

A sharply divided three-judge panel of the Eleventh Circuit ruled 2-1 against Burns in an opinion that ran more than 130 pages. Writing for the majority, Judge Robert Luck agreed that Burns’s proposed mansion was not expressive conduct but “just a really big beachfront house that can’t be seen, located on a quiet residential street in Palm Beach, Florida.”

The majority held that the plans called for “carefully shielding” most of the home from view— and even if the structure could be seen, there was no evidence a reasonable viewer would understand it to be anything other than “a really big house.”

The majority expressly declined to decide the admittedly “harder issue” of whether residential architecture can ever be expressive conduct protected by the First Amendment and, if so, what is the proper First Amendment test to apply.

In his dissent, Judge Stanley Marcus pointedly criticized his colleagues for curtailing the freedom of expression. Beginning with the premise that architecture is art, he found it difficult to square the majority opinion with well-settled law extending First Amendment protection to artistic expression in all its forms.

Residential architecture is inherently functional and semipermanent. It might be art, but it isn’t pure speech entitled to heightened protection, as even the dissent recognized. Ultimately, Burns’s proposed mansion—20,000-plus square feet shielded by privacy walls, landscaping and the ocean—was far from a perfect vehicle for deciding whether residential architecture can ever be expressive conduct protected by the First Amendment.

A team of women at Jones Foster defended the Town of Palm Beach in Donald Burns v. Town of Palm Beach, a landmark lawsuit brought under the First Amendment of the United States Constitution claiming the right to freedom of expression in residential architecture. That defense team included Litigation Shareholder Joanne M. O’Connor, Litigation Associate Hanna B. Rubin, Paralegal Karen Bould and Litigation Shareholder Margaret L. Cooper (in memoriam). Ms. Cooper argued dispositive motions before the District Court and Ms. O’Connor handled the oral argument before the Eleventh Circuit.

The luxury real estate market in Palm Beach County has and continues to experience strong demand, with many affluent buyers seeking upscale properties in the area. This demand has contributed to the appreciation of property values over time.

Palm Beach County’s luxury market has international appeal, attracting buyers from around the world. Its proximity to major cities like Miami and Fort Lauderdale, as well as its beautiful weather and highquality amenities, make it a sought-after destination for international luxury real estate investment.

The vast amount of people moving to Florida in recent years has caused housing prices to rise significantly in a relatively short period of time. This strong demand has also caused the amount of available inventory to remain relatively low at a 2.8 month’s supply (a six month’s supply is standard in a normal market). These and other factors form a perfect affordability crisis storm that continues to sideline many aspiring homeowners.

Florida’s new home construction market is also affected by the strong demand. While previous supply chain issues experienced during the pandemic have been resolved, current construction labor shortages are now causing delays for home builders in various metropolitan markets around the area.

In conclusion, Florida’s real estate market continues to thrive as a result of its enduring appeal as a soughtafter destination. The state’s natural beauty, vibrant culture, and favorable tax environment combine to create an irresistible draw for homebuyers. In comparing the real estate market between 2022 and 2023, the data reveals a remarkable 37.3% surge in condo sales, while single-family home sales have experienced a significant 14.9% rise. Additionally, it is worth noting that the market has witnessed a notable 7.2% decrease in the number of new listings, underscoring the current demand and potential implications for buyers and sellers alike.
