DEAR FRIENDS, Thank you for your continued partnership, support, and encouragement. As we reflect on our work this past year, we are reminded that none of what we accomplished would have been possible without you.

Although it’s been said before, it could not be truer today: we live in uncertain times. The deep divides in Washington D.C., and proposed cuts to health care, social services, and legal aid, impact the communities we serve. This means that families in our community facing seemingly insurmountable obstacles — from threats of eviction, lack of access to educational services, or chronic health care needs — are now dealing with even more uncertainty.

You, our partners, helped us address this uncertainty with an increase in your steadfast support of the Law Foundation over the past year. You helped ensure protections against unjust evictions, you joined in our advocacy to prevent the displacement of 400 residents of Buena Vista Mobile Home Park in Palo Alto, and you gave generously to provide emergency support for families that lost everything when parts of San Jose flooded last February.

As we look to a new year, our attorneys, social workers, and advocates will continue to find innovative ways to increase our impact. With a combination of legal and social services, strategic public policy advocacy, and educational outreach, we will use the law to advance the rights of underrepresented individuals and families in our diverse community to achieve social justice in Silicon Valley. THE CHALLENGE For many, a legal crisis is a life-changing event. The legal system can be difficult to navigate. Often, only a lawyer can make the difference with an issue involving housing, education, or health. The Law Foundation of Silicon Valley directly serves our community every day: Families struggling to hold on to a stable home, while rents increase and affordable housing options are limited.

Parents attempting to navigate the education system to ensure that their special needs child receives the education she deserves.

A father living with a mental health disability that needs help navigating health care benefits and employment-related issues.

An elderly woman living alone on a limited income, who can no longer afford her home due to a mortgage lending scheme.

A child in the foster care system who would like to live with a relative and needs a legal advocate to help navigate guardianship.

Promoting & Preserving Affordable Housing Where you live matters. A safe and stable home impacts health and opportunities, including where children go to school. The Law Foundation’s housing team is committed to promoting affordable housing opportunities in Silicon Valley, for our elderly, our families, and our children. This year alone, we have been intensively involved in significant advances in tenant protections and affordable housing preservation. We will continue our tireless fight for affordable housing in Silicon Valley. We are proud to report that what we are doing is working.

Standing Up to Discrimination Against Families When you think of your home, you think of more than the walls that make your house. You think of the community and the opportunities available around you. For families in Fremont, home meant not having a place where children were welcome. At the Silvertree Mohave Complex, the children weren’t allowed to play outside of their own homes. Neighbors from the Homeowners' Association often yelled at the children and confiscated their toys, leaving parents feeling intimidated and unsure about whether or not they would lose their housing altogether.

After growing frustrated, residents from the complex began working with our attorneys. The tenants described the policies that targeted families in the complex; including not allowing children the use of the complex grounds, a violation of state and federal fair housing laws. Law Foundation attorneys, along with pro bono co-counsel Winston & Strawn, recognized these rights and the importance of outdoor play for children and filed a class action lawsuit on behalf of homeowners and tenants. Through our legal advocacy, the Homeowners Association agreed to pay damages and began allowing the children in the complex to freely play outside without targeted rules that hindered their rights. Families in the complex can now breathe easier knowing that their children feel safe and secure in the community that is their home.

Fair Housing Law Project

OUR HOUSING IMPACT Just Cause Eviction - Enacted Years of hard work by tenants and nonprofit groups, like the Law Foundation, led to increased protections for renters in San Jose. Until April of 2017, San Jose was the only major Bay Area city where landlords could evict tenants for any reason, including raising the rent.

Following a much anticipated vote by the San Jose City Council, landlords must now provide a “just cause” for evicting tenants, such as failure to pay rent, illegal activity, or disturbing neighbors.

Legal Housing Discrimination - Enforced Until recently, landlords in Santa Clara County could refuse to rent apartments or homes to people receiving government assistance to help cover their rent payments. This legal form of discrimination kept thousands of people in our community from finding safe and stable housing. After the Law Foundation’s housing team and other local advocates called on elected officials to take action, a countywide ordinance passed to ensure that, in our already limited housing market, there is not discrimination against tenants receiving rental assistance.

Affordable Housing - Protected Last November, voters in Mountain View passed Measure V, aimed at stabilizing rents and providing protection from no-cause evictions for certain rental units. When the California Apartment Association (CAA) moved to sue the City to block the law from going into effect, the Law Foundation, along with pro bono co-counsel Fenwick & West, the Stanford Community Law Clinic, and the Public Interest Law Project, stepped in to represent a group of Mountain View voters, tenants, and organizations. In a major win for Mountain View tenants, the CAA dropped its lawsuit earlier this summer. This means that more housing in Mountain View has protections that benefit the entire community.

Buena Vista Update - Saved For five years, more than 400 residents of Buena Vista Mobile Home Park, Palo Alto’s last mobile home park, fought to preserve their homes after the park owners announced their intention to sell the property to a developer. This summer, a deal was reached that will preserve the park as affordable housing in perpetuity. That means that over a hundred lowerincome families will continue to enjoy Buena Vista’s diverse and tight-knit community and benefit from living in a high opportunity area of Silicon Valley, one that has high-quality Palo Alto schools, safe neighborhoods, and proximity to good jobs.

Social Workers & Legal Services There are many emotional, familial, environmental, and social issues that complicate the legal barriers our clients face. The Law Foundation’s unique approach of pairing professional social workers with lawyers in our Legal Advocates for Children & Youth program plays an important role in our ability to help families and children overcome serious legal problems and lead healthy, stable, and more productive lives. Through comprehensive assessments, expertise, and advocacy, our social workers assist attorneys with interviewing our youngest clients and enable our legal teams to consider the developmentally appropriate needs of children during a stressful time.

This social work-legal partnership is just one of the many creative ways in which we take a holistic approach in our work to provide the best solutions for our community members facing lifechanging legal issues.

National Award

Law Foundation’s Silicon Valley Medical-Legal Partnership The National Center for Medical-Legal Partnership honored the Law Foundation’s Silicon Valley Medical Legal Partnership as a 2017 Outstanding Medical Legal Partnership (MLP) Award recipient.

Our medical-legal partnership with Santa Clara Valley Medical Center (VMC) connects patients in VMC’s Pediatrics Department and Homeless Healthcare Program with Law Foundation attorneys.

Legal Advocates for Children & Youth

This award highlighted the Law Foundation as a national leader in establishing innovative ways to include legal screening and interventions into hospital practice.

The Law Foundation’s MLP team is onsite at multiple clinics each week to use the law as a tool to help solve persistent medical problems for children and families. Just as a doctor would refer someone with a specific medical need to a specialist, the VMC MLP allows doctors to refer a patient to a lawyer. The Law Foundation’s Pediatric MLP has handled a record number of 545 referrals this past fiscal year.

When Children Need Lawyers at School The Individuals with Disabilities Education Act (IDEA) requires public schools to provide education that supports each student’s needs, including children with disabilities. Under federal law, schools have the responsibility to assess students with disabilities and then develop individualized education plans (IEPs) for them. Unfortunately, schools are often resistant to providing special education students with individualized services because it can be costly.

The Law Foundation is the primary organization in Santa Clara County that provides free legal representation to families of children who are not receiving adequate education services. We teach families about their children’s education-related rights and provide legal representation when a child’s needs are not being met. Often, this means accompanying families to school meetings to ensure that the district is providing timely services. By representing individual clients, we help school districts better understand their responsibility to appropriately educate all children.

Stability for Unaccompanied Minors Daniel was only a child when he arrived in the United States from his home country. When his father abandoned him at a young age and his mother’s disability left her unable to care for him, his only hope was to live with a relative who could provide for his daily needs. However, Daniel’s only uncle was in the United States. When Daniel arrived, undocumented and seeking refuge, his uncle found the Law Foundation and began working with us to gain full guardianship.

With the expertise of the Law Foundation, Daniel obtained Special Immigrant Juvenile Status, or SIJS. The purpose of the SIJS program, a federal U.S. immigration initiative, is to help provide sanctuary for foreign children who arrive undocumented and have been abused, abandoned, or neglected. Unlike criminal cases, where a lawyer is appointed regardless of ability to pay, the children facing possible deportation have no guaranteed legal help and face a greater chance of being deported to their home countries where their lives were previously threatened.

With our multi-disciplinary team, comprised of an attorney and a social worker, Daniel had a stronger voice. With his green card and permanent residency status, Daniel’s life became more stable. Today, he’s a college student who now has the promise of Silicon Valley within his reach.

Watchdog for Patients’ Rights As a reputable leader in disability law, our attorneys and advocates play a critical role ensuring that regional partners in behavioral health understand the law and implement policies that protect the rights of people in their care. Our community relies on the Law Foundation’s expertise to serve as a watchdog for the Santa Clara County Behavioral Health Department.

This year, when a new, private for-profit psychiatric facility was making plans to open in south San Jose, our team was there to extensively monitor the process and advocate with the facility to safeguard protections for patients under California’s civil commitment and patients’ rights laws. We worked closely with the facility’s leadership to implement due process hearings, meaning adults and youth that are involuntary held are guaranteed the opportunity to review their case and have a voice in their care.

Moreover, our attorneys worked to make certain that medication restrictions and regulations for youth and foster youth placed in the hospital were properly followed, giving the hospital’s youngest patients the quality of care they deserve under the law. Today, the Law Foundation continues to leverage our legal expertise to ensure the success of the hospital in caring for patients experiencing serious mental health issues by overseeing hearings at the facility and providing on-going training with the staff.

When everyone is able to receive proper care in accordance with the law, the result is a stronger, more inclusive future for the entire community.

Health Legal Services & Mental Health Advocacy Project

Navigating Public Benefits When David was released from prison after 28 years, he knew it was his chance to start over and build a better life for himself. However, with more than half of all inmates in California returning to prison within three years, David knew the odds were stacked against him. Even worse, the long-term experience of prison conditions left him with severe posttraumatic stress disorder that negatively affected his ability to establish a daily routine—he knew he needed help.

David started receiving treatment for his disability at Santa Clara County Valley Medical Center and soon began the often confusing and difficult process of applying for public disability benefits. After growing increasingly discouraged from multiple application denials, our medical-legal partnership team began working with David and his treatment group to create a strong appeal case for his right to disability benefits. Through our collaborative effort, David received the financial assistance he qualified for all along.

Today, David is stably housed, receives ongoing medical care, and has a better chance for success in his new life outside of prison.

SYSTEMS CHANGE The Law Foundation’s direct work with clients gives us a unique perspective into the systems that cause hardships and challenges. Often, we see many similar cases that are a result of an overall systems issue that unfairly impacts our low-income and underrepresented clients.

The Law Foundation was part of a legal team that obtained a positive federal appeals court ruling determining that undocumented immigrant children detained by federal authorities must be given adequate living conditions, including access to clean water, proper heating and cooling, and appropriate sleeping conditions. Co-counsel on the case included Orrick, Herrington & Sutcliffe, the Center for Human Rights and Constitutional Law, and La Raza Centro Legal.

In January, the Trump administration attempted to withhold funding from sanctuary cities. The Law Foundation, along with pro bono co-counsel at Cooley LLP, filed two amici curiae briefs in the matter on behalf of dozens of nonprofit organizations and associations throughout California. This effort helped support a preliminary injunction that protects crucial safety net services, allows local governments to keep local police from acting as immigration enforcement, and helps keep immigrant community members from being too fearful to access services critical to public health and safety.

RACE EQUITY & INCLUSION Our best work as social justice lawyers and advocates takes place when we understand the challenges that our clients face every day. To have longterm impacts on our client’s lives and our community, we need to address systemic inequalities in a strategic way. The Law Foundation’s Race Equity and Inclusion Initiative began as an internal effort to tackle the need for our organization’s services to be more community based and race conscious, taking into account the biases and inequities that affect individuals, families, and children in Silicon Valley.

This year, a team from the Law Foundation was chosen to be part of the Sargent Shriver National Center on Poverty Law’s Racial JusticeTraining Institute (RJTI) cohort, a groundbreaking national leadership program rooted in a commitment to race equity as an integral and essential part of anti-poverty advocacy. Earlier this year, we joined with 18 other equity teams from legal services organizations around the country in Chicago to learn more about essential concepts such as implicit bias, structural racialization, systems thinking, and community lawyering.

This important experience is enabling us to make deliberate and positive changes in the way we serve our clients, from our recruitment and hiring process to trainings on how our external communication does not perpetuate negative stereotypes of our client community.

This important work continues and your on-going support of the Law Foundation makes it possible to advance our progress on these crucial issues affecting our clients and the systems we live in.
