Our community faces many challenges. Our country is divided and disinvesting, which means the resources our neighbors need, such as housing subsidies, basic needs, and health care, are unstable. Santa Clara County’s homeless population has increased. Immigrant children are facing inhumane treatment in federal facilities. Many people are experiencing fear and uncertainty in their daily lives because of poverty, discrimination, and inequity.

The Law Foundation’s work in housing, health, and children’s rights is crucial to addressing these issues in Silicon Valley and throughout California. We’ve had some significant victories this year.

Our attorneys, social workers, community workers, and advocates are fighting for families, children, seniors, and people living with mental health disabilities every day—in our office, in court, in hospitals, in shelters, and in the community. We couldn’t do this work without you.

Because of you, the Law Foundation’s worked on more than 11,000 legal matters in 2018-19.

Providing direct services to thousands of people also informs our systems change work, which impacted over 800,000 people last year. This approach creates long-term change on a communitywide level and addresses the root causes of the injustices our community members face.

These beliefs are the bedrock of the Law Foundation’s work and the pillars needed for a healthy and thriving community. When children, seniors, and families face stressful and destabilizing legal issues, a legal expert can make all the difference in advancing justice and achieving positive outcomes within our complex courts and legal systems.

When a civil legal need arises, it’s often community members who can’t afford a lawyer who are impacted most. Legal aid can keep a family in their home, improve health outcomes, and stabilize the lives of children facing abuse or neglect. In short, the Law Foundation’s services are life-changing. Our vision is that every person who calls Silicon Valley home can thrive and achieve stability through access to justice.

HOUSING Many families who have called Santa Clara County home for generations are facing increased obstacles, such as eviction, unhabitable conditions, homelessness, and discrimination. In the last three years, the housing crisis displaced 62,000 residents from our area, and homelessness rates have increased. Stability and quality of life for lowincome people and our entire community depends on strong renter protections and access to legal services that enforce these rights.

Precedent-Setting Agreement Prevents Homelessness for Seniors After six years of negotiations, the Law Foundation, Winchester Park residents, and Pulte Homes reached a landmark agreement regarding the closure of the Winchester Ranch Mobile Home Park in San Jose. For 40 years, Winchester Ranch has been an important source of affordable homeownership for seniors. Rather than face homelessness or displacement, over 100 seniors are able to stay at the same location in on-site replacement housing at the same rental rate and protections, including rent increase limits. This precedent-setting agreement sets a high bar for any future development of mobile home parks and protects naturally-occurring affordable housing.

Juvenal’s Story After living in his home for more than 20 years, Juvenal was evicted when his building was red-tagged for unpermitted repairs. The City gave him and all his neighbors 72 hours to clean out their apartments. Suddenly homeless, Juvenal threw away years’ worth of memories and belongings. He left his home without knowing where he would go or if he would ever return to the place he called home for so many years.

The Law Foundation believes stable housing is a human right. But every year, thousands of people like Juvenal are facing gentrification, displacement, and homelessness. The Law Foundation secured relocation assistance and other compensation for Juvenal and his neighbors after filing a lawsuit against their former building owners, which helped create stability for them.

Our team worked toward a broader goal of protecting all tenants in San Jose from unlawful eviction. Our advocacy empowered Juvenal and his neighbors to share their experiences with city leaders and the media, which led to increased tenant protections. The new laws help us represent and protect thousands of renters.

Community Workers Strengthen Access to Justice Our innovative community worker model amplifies our impact and grounds our work directly in the community.

As legal experts, our community workers provide various types of shorter-term assistance that give our neighbors the best chance at keeping or finding housing, including requests for additional time to move out or relocation assistance. They also advocate on behalf of clients at administrative hearings that don’t require a lawyer, communicate with landlords, and answer questions that preserve tenants’ rights in court.

The community workers are a key connection to the community. For example, they conduct “know your rights” presentations, partner with our client communities on critical issues like tenant protections, help with investigations for potential litigation, and translate and interpret in Spanish and Vietnamese at community events and meetings.

Elias’ Story At 14 years old, Elias struggled with his homework because he was reading at a second-grade level. He lives with attention-deficit/hyperactivity disorder and a behavior disorder, which makes it difficult to focus. Due to being in foster care, he moved schools several times. Instead of receiving the tutoring and support he needed, Elias was passed from one grade to the next. When Elias faced expulsion from his school, the Law Foundation stepped in with a legal strategy to obtain increased support for Elias, an approach that could also benefit other students in the future. The school district relented, and Elias was provided private one-on-one tutoring tailored to his needs. By representing Elias, the Law Foundation prevented his expulsion and set the precedent for other students with similar obstacles to ensure they are provided with an appropriate and adequate education.

Protecting Foster Youth & Their Futures Children in the child welfare system exhibit lower academic, social, and economic outcomes that affect their overall well-being and we work to be part of the change to improve these outcomes. For example, children are 35 times more likely to be victims of identity theft than adults. We focus on providing critical legal assistance to ensure that our foster youth’s credit is monitored, and any instances of theft are corrected, which can be a complicated process. The Law Foundation is also an appointed member of the Joint Foster Youth Task Force, and many of its recommendations to the Board of Supervisors are being implemented to improve outcomes for foster youth.

Recommendations include coordinating improved preventative services within the County, providing mentor parents and peer youth advocates, improving how placements are assessed, and supporting youth through services such as housing, transportation, medical and dental care, behavioral health services, and CalFresh benefits.

Backbone of Support All children should feel safe. When children and youth are in difficult situations, our attorneys and social workers are there to empower them and help them navigate the legal system. Last year, Eden* was missing for six months.

When she returned, she reported being emotionally, physically, and sexually abused by an adult. She was scared that he would find her and hurt her. While our attorney informed Eden of her legal options, including a restraining order, our social worker provided trauma-informed emotional support, validating Eden’s concerns. Once she felt safe enough to move forward, the Law Foundation successfully filed for a five-year restraining order against Eden’s abuser. When working with our children and youth who have experienced violence, abuse, and trauma, our social workers are the backbone of support for our clients. While the attorneys advocate on the legal side with filings, hearings, and orders, the social workers are sitting next to the client, checking in with them emotionally, and helping with critical services like finding housing if they flee from domestic violence, connecting them to a shelter, or helping them apply for benefits. With this innovative model, we are applying best practices to help families lead healthy, stable, and more productive lives. *Name has been changed

HEALTH People living with mental and physical health disabilities face a unique set of challenges, particularly when they are impacted by poverty. Every day we see clients who have been discriminated against or denied access to the income benefits, health insurance, or other assistance they rely on for basic necessities such as food, medicine, and housing.

Our Health program also plays a critical role in ensuring access to justice for those in mental health facilities.

Lorraine’s Story The housing crisis has exacerbated the limited living options for people living with a mental health disability.

Because of the low supply of housing, unlicensed care facilities are often the only option left. However, these facilities have little to no regulation, and conditions can be borderline inhumane — overcrowding, low quality and quantity of food, unfair evictions, lack of sanitation, and abuse or neglect. Years ago, Lorraine experienced these living conditions herself. As a Mental Health Peer Support Worker with Santa Clara County, she received ongoing reports about the inhumane conditions people faced in these facilities.

With Lorraine’s lived experience, support from community partners, and the Law Foundation’s legal expertise, the Community Living Coalition was created to improve the rights of people living in these group homes. This coalition, which is consumer-driven, means those who have been impacted by poor housing conditions and restrictive care are at the heart of this work. As the legal backbone of this initiative, the Law Foundation has trained facility operators about their responsibilities and educated residents about their rights. This proactive approach creates high-quality housing options for people living with mental health disabilities.

Medical-Legal Partnership Celebrates 10 Years Visiting a doctor is an essential part of staying healthy. But we know that there are many other factors — where you live, access to healthy food, a great education — and access to justice may be the only way to improve quality of life. Since 2009, we have served thousands of clients through our nationally-recognized medical-legal partnership with Valley Medical Center (VMC), where our attorneys team with doctors and nurses to address patients’ needs both inside and outside of the hospital. Just as a doctor would make a referral to a specialist, the partnership allows doctors to refer a patient to a lawyer. This year, we served more than 600 people through our collaboration, and 77% of those served were children. For adult services, 60% of cases addressed housing and public benefits. We are also on-site multiple times each week at VMC clinics located throughout the community to ensure easier access to our services. This upcoming year, we are expanding existing clinics to include three more additional legal practice areas to better meet community need and have launched a new Name and Gender Marker Change clinic.

Social Security Income Creates Stability Donna* lived by a creek in San Jose for more than five years. She had applied for Supplemental Security Income (SSI) for a disability and Widows Benefits but hadn’t received an update on her application status. Our attorney advocated on behalf of Donna to the Social Security Administration and assisted her with gathering necessary documents like marriage and death certificates. After working with our attorney, Donna was awarded retroactive benefits and now receives $1,300 per month. With this stable income, she can focus on finding stable and safe housing. *Name has been changed

SYSTEMS CHANGE Whether it’s empowering people to make a historic change or to be leaders in the change they want to see, the Law Foundation will continue to push until justice is achieved not just for one person, but for everyone.

At the Law Foundation, our comprehensive approach includes individual legal representation, social work support, community education, and an impactful pro bono program. But it’s not possible to serve all the people, families, seniors, and children that need access to justice one at a time.

Because of this, we work within our focus areas of housing, health, and children’s rights to have a systems-level impact, including policy advocacy, participation in system reform efforts, and lawsuits that challenge policies and practices. Focusing on systems change helps us develop lasting solutions to recurring problems that we know impact large numbers of the clients we serve. This proactive focus on systems change allows us to address the root causes of complex issues and ultimately improve systems so that thousands of potential clients no longer need our services.

The Law Foundation fights for Silicon Valley renters by advocating for the protection, preservation, and production of affordable housing.

By standing alongside the community in the fight for stronger tenant protections and representing clients against unjust evictions, the Law Foundation is on the front lines of anti-displacement and homelessness prevention.

As part of the Silicon Valley Renter’s Rights Coalition, the Law Foundation continues to protect and expand tenant protections. We engage in community lawyering practices, provide direct advocacy to decision makers, and educate tenant activists and community organizers on legal issues. In San Jose, we’ve advocated to prohibit source of income discrimination against renters with housing vouchers, ensuring rights for domestic violence survivors, and supporting a study about a commercial linkage fee for affordable housing. We’re building on the success in San Jose to strengthen tenant protections in other areas that are impacted by the loss of long-time residents and communities of color, including Milpitas, Gilroy, and unincorporated Santa Clara County.

Dignity and Respect for Minor Patients

The dignity of patients must be respected. This is why our Health program represented a 15-year-old girl who contested her hospitalization at San Jose Behavioral Health (SJBH). The youth was in distress, and while she acknowledged her mental health disability, she declined to take the prescribed anti-psychotic medication due to their severe side effects. As a result, the psychiatrist at SJBH filed a capacity petition to request that the court grant the authority to administer medication involuntarily—the first-known petition of its kind to be filed for a minor in Santa Clara County. There were no county policies and procedures addressing minors’ rights in medication capacity proceedings. An attorney from our Health program took on this

challenge as the main author of the policy and procedures to be proposed. Together with a dependency court judge, representatives from the Public Defenders Office, and other stakeholders (including our Children & Youth program), our attorney wrote a new policy based on established best practices. The policy included advance notice for the minor and their advocate before a hearing, requiring doctors to follow specific protocol, and ensuring parental consent when needed. Our Health program continues to do outreach and advise minors and families about their rights at San Jose Behavioral Health.

Improving Conditions and Policies for Immigrant Children in Federal Detention For the last four years, the Law Foundation has served as co-counsel on the Flores Settlement Agreement. Our involvement with this case embodies our mission and beliefs that every child deserves a champion. Every child needs stable and safe care to thrive—no matter their country of origin. Law Foundation representatives traveled to Customs and Border Patrol (CBP) facilities in July 2018 to interview detained children and assess their living conditions. What they saw was shameful. One five-year-old girl who was covered in dirt and dust following a long walk through the desert wasn’t allowed to shower for six days. At a facility in Tucson, each person was allotted one aluminum blanket. Children and their parents reported that they were often too cold to sleep at night.

This year, the Law Foundation has continued to advocate for improved conditions in federal facilities. Most recently, the U.S. Court of Appeals for the Ninth Circuit dismissed the government’s appeal of the decision that CBP violated the Flores Settlement Agreement by holding children in border patrol stations that are unsafe and unsanitary. Poor conditions include failing to provide children with basic hygiene provisions such as toothbrushes, clean clothes, and showers. Legal intervention continues through the independent monitor, and a medical expert will be conducting a comprehensive assessment and providing recommendations to the facilities.

The David Shannon Memorial Leadership Fund honors the memory of David Shannon, longtime champion of justice, extraordinary leader at NVIDIA, and previous Law Foundation Board Member and Board President. The fund supports and serves to honor David’s legacy of exceptional leadership by increasing the organization’s ability to serve its clients and impact the greater community. This mirrors David’s commitment to justice, especially for those without legal access. The fund will support a focus on impact litigation, including class action matters, policy advocacy, and systems change work such as drafting proposed legislative solutions.

Emma’s Story When Emma moved in with her aunts, Sonia and Susan, she was leaving behind an unstable home, including an abusive stepfather and being left at home alone for weeks at a time.

While trying to get Emma access to treatment after she sprained her ankle one day, her aunts realized they didn’t have the legal authority to manage her health care. They didn’t have her birth certificate or social security card. That was when they knew they needed to do something.

Emma knew that she wanted Sonia and Susan to be her guardians and they came to the Law Foundation for help.

Our social workers completed an assessment and we partnered with a pro bono attorney from Cooley to help Emma file for a guardianship. Emma felt empowered by the pro bono attorney’s commitment to her needs.

RACE EQUITY & INCLUSION Everyone deserves equal access to justice and the Law Foundation fights for that vision every day. Our work would be incomplete without our staff fully grasping the complex challenges our clients experience every day—this includes understanding the structural racism and systemic inequities that are upheld by policies, practices, and dominant narratives.

As part of our strategic plan, the Law Foundation staff launched a Race Equity Initiative. The initiative established four key goals: data collection and evaluation, assessing workload for bilingual staff, fair and equitable hiring, and foundational shared learning and training. This year, we formed workgroups for each of these goals.

In response to our staff expressing the need for foundational learning about race equity, we launched a six-month program that provided access to knowledge, tools, and resources. With this approach, our goal was to empower staff to bring a race equity lens to their daily work.

Everyone deserves equal access to justice.

Let’s push ourselves to expand our outlook and find ways to challenge the racist systems and structures that create unequal outcomes for our neighbors.

Every other week, the Law Foundation’s Training and Learning workgroup shared Word(s) of the Week and engaging articles, videos, and podcasts, with the goal of providing key vocabulary terms and critical concepts of race equity. In small cohorts, we discussed these concepts and further explored all the ways race equity is engrained in our lives and how it affects our clients and their outcomes. We also learned about new types of advocacy tools that the Law Foundation can develop and use to combat racial disparities.

Join us in this work by staying attentive to how racism plays a role in our society and legal system. Let’s push ourselves to expand our outlook and find ways to challenge the racist systems and structures that create unequal outcomes for our neighbors. Also, keep an eye out for our annual list of recommendations each December, which includes articles, books, podcasts, and more to educate ourselves about race equity work.
