Dear Friends, With continued restrictions, new COVID variants, and remote work, in some ways the past year has felt like an extension of 2020. And although the reality of a longer pandemic affects us all, it again disproportionately impacts our unhoused neighbors, communities of color, and working-class families – our client communities.

The past 20+ months have come with many, many challenges – some brought on by the unknowns of the pandemic, others more deeply entrenched in our society due to racial and economic inequities.

Throughout all of this, your support of our essential work has endured. Your financial commitment to justice has provided the stability so urgently needed during this crisis, allowing us to serve our neighbors facing dire legal challenges.

The Law Foundation remains steadfast as we continue to find innovative ways to serve our clients during these unprecedented times while deepening and expanding our impact. The critical work we undertook in 2021 includes fighting to keep families from losing their homes through unfair evictions, advocating for students with disabilities, and working to ensure that people with mental health issues have control over their own healthcare decisions.

ADVANCING JUSTICE

While our journey toward long-standing change in Silicon Valley is well underway, there is more work to be done. As we begin to recover from the devastating effects of COVID, we are working in coalition to ensure that our neighbors most impacted don’t get left behind.

COVID-19 RESPONSE

RACE EQUITY

Over the past year and until recently, the fear, stress, and instability we all felt during the height of the COVID-19 pandemic had begun to wane, especially with readily-available vaccines, boosters, and testing. However, for our clients, not much changed throughout. As we head into the reality of a longer pandemic, the COVID variants continue to threaten and disproportionately impact our unhoused neighbors, communities of color, and working-class families, serving as a reminder of the inequities within Silicon Valley.

The pandemic underscored the effects that systemic racism and inequality have on our collective health and safety. Every day our team works to protect the rights of our hardest-hit neighbors who are struggling to stay afloat. Over the last year, our attorneys, social workers, community advocates, and administrative staff worked diligently to provide legal services to our neighbors who need them most. With our physical office closed since March 2020, our team mobilized to connect with clients over the phone and virtually. For the past several months, staff has been going out to various Silicon Valley neighborhoods to meet clients where they are, with some attorneys even returning to court.

As we all continue to shape our “new normal,” we cannot forget that there are people in our community who still need our help. The pandemic has only exacerbated persistent inequities and we must keep working together to build a more inclusive community.

FIGHTING COVID-RELATED EVICTIONS Although eviction protections were in place during the height of COVID-19, many families were still facing eviction. Among those the Law Foundation helped was Marcus, who lived in an apartment with his three school-aged children and paid the rent with a federal Section 8 voucher. Sadly, Marcus contracted COVID-19 and wasn’t able to keep taking care of his children. As he co-parents with his ex-girlfriend, Yvette, he asked her to move in to help with the kids during his long hospital stay.

Knowing his chances for recovery were slim, Marcus asked Yvette, who was pregnant at the time, and her current partner to move in permanently with the children and take over his housing voucher.

The family was devastated when Marcus passed away. Yvette made sure to continue paying their share of the rent, which was about $340 of the $2,750 owed each month. However, because Yvette and her partner were not on the lease and weren’t named on the housing voucher, the landlord refused to take further payment and served them with an eviction notice. Yvette and her family, still grieving from Marcus’ death and now with a newborn, had few options for finding a safe and stable home.

The Law Foundation represented Yvette and the family through the eviction case and negotiated a settlement that would keep the family housed under one roof. Yvette’s story was featured in the Mercury News as an example of landlords who attempted to find loopholes to evict tenants during the pandemic. We continue to help families and individuals fight unfair evictions and displacement now that pandemic eviction protections have ended.

The communities we live in today were built on systems of racial inequity that continue to impact access to housing, healthcare, opportunity, and more. As lawyers and advocates, we see the everyday reality of racist laws and policies that impact the lives of our clients. The Law Foundation is deeply committed to increasing access to justice for low-income families and communities of color. Leading with race is at the core of the Law Foundation’s vision to eradicate racial disparities and the systems that perpetuate them. We continue to hold ourselves accountable, ensuring that: • the Law Foundation’s staff reflects the community we serve; • our systems change work is done in coalition with community members; • our work is rooted in racial justice and equity.

CONTINUING OUR LEARNING & TRAINING PROGRAM We are committed to ensuring that race equity is integrated into our practice, policies, and procedures – including adopting a community lawyering approach that centers community voice. Last year, as part of our Race Equity Initiative (REI), staff led and completed a six-month pilot program to establish shared knowledge and foundational concepts about race and equity.

Now a permanent fixture of our staff development, the Learning Program’s curriculum—which encourages staff to have more challenging and nuanced conversations about race equity—has been updated in response to current events.

The Law Foundation will continue collaborating with experts, including community members with lived experience, to refine our approach both internally and externally.

IMPROVING UNSAFE AND INHUMANE JAIL CONDITIONS As the pandemic began to spread throughout our region, incarcerated individuals at the Santa Clara County Jails were left with few protections against COVID-19. Our team of lawyers and advocates joined local advocacy organization Silicon Valley De-Bug and began to speak with people inside the jails, as well as family members, and learned immediately that the situation was dire. People incarcerated inside the jails were given a single cloth or disposable paper mask that was expected to last for months. With social distancing practices non-existent, shared spaces were cramped and cleaning and basic hygiene supplies were insufficient— forcing many into unsanitary and life-threatening living conditions. These unsafe conditions disproportionately impacted Black and Latinx members of our community, who make up most of the jails’ population due to pervasive racism in the criminal legal system.

During this time, individuals throughout the jails, and their family members began to organize and demand adequate protections against COVID-19.

We joined them along witht Silicon Valley De-Bug

in calling for urgent improvements to the inhumane conditions within the jails. Our demand letter to the County argued that the environment in both facilities violated the Eighth and Fourteenth Amendment rights of incarcerated individuals to be free from cruel and unusual punishment and state-inflicted harm and included a list of demands.

OUR CLIENTS

In response, the jails have started giving out more masks, upping some of the cleanings, and listening to community voices at times, but there is still a long way to go, particularly by drafting written and clear policies. Our team continues to monitor conditions at the jails and supports additional calls for transparency and accountability from the County and the Sheriff’s Office.

ADVOCATING FOR ALTERNATIVES TO POLICING IN SCHOOLS Police presence in schools disproportionately affects Black, Latinx, and Indigenous students as well as those with disabilities and students of color are suspended and arrested more often than their peers. Discriminatory discipline contributes to the school-to-prison pipeline by pushing these students into the juvenile justice system instead of offering more constructive behavioral interventions to keep them in school.

Our team worked alongside community coalitions throughout Silicon Valley to urge school districts to fulfill their commitment to building safer school environments that better serve all students. In July of 2020, we joined students, teachers, parents, and community advocates as part of the San José Unified Equity Coalition in urging the San José Unified School District (SJUSD) to end its contract with the San José Police Department (SJPD). The group called for investing funds used for policing to instead increase student support programs. After a year of advocacy led by members of the coalition, the SJUSD Board voted to end the district’s contract with SJPD. Even though shortly thereafter the Board voted to reinstate SJPD on campus as security for school events, the coalition’s work continues.

CHILDREN & YOUTH

INNOVATIVE SOCIAL WORKER ATTORNEY MULTIDISCIPLINARY MODEL FOR LEGAL SERVICES Our Children & Youth Program utilizes a multidisciplinary approach that partners attorneys and social workers to deliver the highest quality services to our clients. Social workers use their clinical expertise to support clients involved in various legal practice areas, including child custody, immigration, domestic violence, and education. They also perform risk assessments, safety planning, advocacy in team-decision making, and case management.

The pandemic forced our team to be creative since our practice model calls for attorneys and social workers to engage with clients in their homes, schools, and other community environments. We were able to maintain client engagement and gather information in a trauma-informed fashion while adhering to public health precautions. The Law Foundation is proud to be one of the first children’s law offices in California to utilize social workers and we are involved in efforts to train other juvenile dependency offices across the state.

DANIEL’S STORY

Many families come to the United States to build a better life for their children. Mario* and Fernanda* Perez are two loving parents who did just that. They found the Law Foundation when their son, Daniel*, began to fall far behind in school. Daniel is transgender and, on top of struggling with his identity, he couldn’t seem to keep up with his peers. At age 12, Daniel was functionally illiterate despite being a bright child.

His parents speak limited English and the family struggles with housing and food insecurity, but that didn’t hold them back from passionately advocating for their child. They deeply cared for his health and well-being and knew he had what it takes to succeed in school. They just didn’t know how to help him get there.

Our attorney worked with the Perez family over the course of five years, advocating alongside the family for Daniel’s education and even becoming a part of the family. Our attorney joined Mario and Fernanda at school district meetings and helped get accommodations for Daniel who was diagnosed with dyslexia. Daniel tried a variety of services over the years but was not progressing, reading at a first grade level in fifth grade. When schools closed during COVID, the family didn’t have access to a computer so Daniel received paper packets but was unable to complete them as he was unable to read or write.

Our attorney knew there had to be more that could be done for Daniel so she filed for a due process hearing, a formal way to resolve disputes with the school under the federal Individuals with Disabilities Education Act. Mario and Fernanda never gave up on Daniel and neither could we. The school district authorized Daniel to attend a special school for children with dyslexia for two years, at no cost to the family. His parents are grateful to finally have the right educational environment for Daniel that will support his special needs and provide him with the opportunity to learn, grow, and reach his fullest potential.

HEALTH

SECURING LIFE-CHANGING DISABILITY BENEFITS For low-income seniors or people with disabilities who are unable to work, Supplemental Security Income (SSI) benefits offer some financial stability. Unfortunately, the rules and bureaucratic process around who gets access to SSI benefits can be complicated. Many people who do qualify find that their request for benefits is denied, simply because they did not have the guidance needed to navigate the system. Such was the case for our client “Juanita*.” Juanita is a Latinx woman in her 50s who lives with severe mental health disabilities and type 2 diabetes. She began to receive treatment for stage 3 breast cancer at Santa Clara Valley Medical Center whom Law Foundation staff work closely with through our Valley Specialty Center Medical-Legal Partnership. Juanita’s treatment was aggressive and exacerbated her mental health symptoms. Her health interfered with her ability to work., Juanita applied for SSI disability benefits only to have her claim denied. Without income, Juanita was beginning to feel hopeless. Our attorneys appealed her denial, gathered supporting evidence, and presented her case to a Social Security judge. The day after the hearing, Juanita cried tears of joy upon hearing that she’d won her appeal and would not only receive monthly SSI benefits moving forward but would also get $17,000 in retroactive payments. Juanita’s cancer is now in remission and she is optimistic about the future. She plans to put the retroactive payments toward purchasing a home so she will have a stable place to live and can focus on her health and well-being.

SUCCESSFULLY ADVOCATING FOR IMPROVEMENTS TO GENERAL ASSISTANCE PROGRAM

During the pandemic, individuals and families experiencing homelessness or housing insecurity found it harder to access the help they need. General Assistance (GA) is a safety-net program that provides a meager cash-benefit to people who have almost no income or savings, many of whom are awaiting federal disability benefits. After learning that the County was illegally denying unsheltered individuals the housing portion of the GA grant without offering alternate housing assistance, Health Program attorneys partnered with other legal services organizations to advocate for policy change with the County. The County now offers shelter beds to all unsheltered individuals who apply for or receive GA. If no appropriate shelter option is available, the individual is provided the full GA grant. As the pandemic continues, having extra money is critical to getting medications and sanitation supplies, so Law Foundation staff also visits encampments to pass out flyers about these changes and other resources.

SWEEPS AND TAKING OF BELONGINGS OF UNHOUSED INDIVIDUALS For those living in encampments, COVID-19 is a real and present danger heightened by the lack of access to proper sanitation and increased instability. In March 2021, the Law Foundation learned that the City of San José was conducting encampment sweeps, despite Center for Disease Control (CDC) recommendations allowing unhoused individuals to remain in place to reduce the virus spread and help service providers streamline care. The Law Foundation sent letters to the City of San Jose and Santa Clara Valley Water District with our concerns that this violated CDO guidance and would likely disproportionately harm Black individuals, as they are overly represented within the unhoused community. At this time, sweeps have not fully resumed.

HOUSING

SECURING THE INCLUSION OF AFFORDABLE HOUSING AND GROUNDBREAKING COMMUNITY BENEFITS PACKAGE AT GOOGLE DEVELOPMENT Since Google announced in 2018 that it would develop a mega-campus in Downtown San Jose, the Law Foundation has been at the forefront of advocating for strong community benefits. In May, San Jose City Council approved Google’s proposed Downtown West transit-oriented neighborhood development plan. In a huge victory for the community, the deal also includes a monumental $150 million in community benefits to preserve affordable housing in the area, provide tenant protection services, and increase support programs for unhoused residents. The funds will be overseen by a community oversight board composed of residents from East San Jose, people with lived experience of homelessness, and other residents primarily affected by the development.

This kind of robust community benefits package is not common and was a hard-fought deal made possible by the relentless advocacy of the residents who will be most impacted by Google’s influence on the City’s future. Our team was there every step of the way during this years-long process, from engaging as part of the Station Area Advisory Group, drafting demand letters and legal analysis, meeting with City Councilmembers and community groups, and literally being at the negotiations table with the City and Google. The Law Foundation will continue to advocate for a strong community oversight board to ensure that community benefits will support those most at-risk of displacement when the Google campus is built.

CHALLENGING MOUNTAIN VIEW’S UNLAWFUL RV BAN Rising housing costs have driven families and individuals from the region, disproportionately impacting communities of color, people with disabilities, and low-income working families. For some residents fighting to stay in their communities, an RV has provided a safe and stable place to live that might not otherwise be attainable. However, cities across the Bay Area are threatening to further displace RV dwellers by passing restrictive parking ordinances that effectively ban RVs from city streets.

For years, Mountain View has tried to ban residents from living in RVs, and the Law Foundation has consistently argued that their attempts violate various provisions of the constitution. In November of 2020, voters approved an ordinance banning the parking of oversized vehicles on narrow streets or streets with bike lanes. The ordinance is unconstitutional and an attempt to ban residents who cannot afford to live anywhere in Mountain View but in an oversized vehicle. The Law Foundation sued the City of Mountain View – along with the ACLU of Northern California, Disability Rights Advocates, and pro bono partners Hewlett Packard Enterprise and King & Spalding – on behalf of Mountain View residents who live in RVs, some having lived there for decades with strong ties to the community, like our client Celerina Navarro.

Celerina is raising two school-aged children and has lived in Mountain View for over 20 years. “I was priced out of my apartment six years ago because of rent increases and I have lived in an RV since then,” says Celerina. “It’s hard to live every day knowing your home can be ticketed or towed. Every day you live in fear about your safety.” We continue to fight alongside residents and are optimistic that the families and individuals living in their RVs can remain in the communities they’ve always known.

ADVOCATING FOR PRESERVATION OF SECTION 8 HOUSING VOUCHER For many low-income families, a Section 8 housing voucher is a lifeline, limiting the tenant’s rent to a portion of their income. Ms. Nguyen is 63 years old and has multiple disabilities. She received a housing voucher several years ago that allowed her, along with her adult son and her live-in caretaker, to live in a stable place they could afford. The complicated rules around the housing voucher can cause confusion, so when Ms. Nguyen’s son unintentionally violated a policy by misreporting his income, the household became at risk of losing their voucher and their home.

Frightened and panicked, Ms. Nguyen reached out to the Law Foundation for help. One of our community advocates, who speaks Vietnamese, worked with her to explain the situation to the Santa Clara County Housing Authority. The Housing Authority agreed to allow Ms. Nguyen and her son to stay. Ms. Nguyen was relieved not only to be able to stay in the home she’s lived in for years but also to have her son remain by her side.

HONORING FORMER BOARD MEMBER

NORMAN J. BLEARS In November 2020, we lost Norman J. Blears, a highly respected attorney, devoted husband and father, and former Law Foundation Board member and champion of 20 years. To honor his life and dedication to social justice, the Norman J. Blears Memorial Fund was established to provide paid summer internships for up to six law students annually.

Through this fund, the Law Foundation is able to provide a more inclusive internship experience for diverse groups of students who do not have to forego the opportunity due to lack of income. By supporting aspiring lawyers, promoting public interest law, and advancing race equity in our community, we hope to honor Norm’s memory and commitment to justice.

ROZA PATTERSON ORRICK RACIAL JUSTICE FELLOWSHIP To make a significant investment and create long-lasting change in our community, international law firm Orrick created the Racial, Social & Economic Justice Fellowship Program in response to the murder of George Floyd by police. The program pairs senior associates from the firm with organizations working on racial justice issues for a year while continuing to pay each fellow their full salaries.

The Law Foundation is honored to be a part of this innovative public-private partnership and grateful to have Orrick Racial Justice Fellow Roza Patterson on our Housing team this year. Roza has worked on a broad spectrum of issues affecting clients with urgent housing issues during the pandemic. Through her work, Roza has been instrumental in expanding pro bono opportunities in preparation for the COVID eviction crisis, such as the Eviction Mediation Pro Bono Project and the Small Claims Court Back Rent Pro Bono Project.

We’re proud to work alongside community partners and pro bono attorneys who dedicate their time and expertise to help us provide more legal services. The Law Foundation’s Pro Bono Program relies on its deep, long-standing partnerships with law firms and local companies to help meet our community’s legal needs. Pro bono attorneys leverage their talents to provide legal services that we either do not have the expertise to provide in-house or we do not have the capacity to provide by relying solely on Law Foundation attorneys.

Over the past year, our Pro Bono team had to pivot to offer opportunities that met the community’s needs and that were safe. For example, the Name and Gender Marker Change Project connected clients with pro bono volunteers, but virtually. When Valley Medical Center and other community partners continued to send us clients seeking a court order to make gender-affirming document changes, we helped clients and volunteers connect online, and then e-file court paperwork.

Not having a break in these pro bono legal services was mportant to the transgender community so they could still turn to us for help with this important step to affirm their identity.

...PROJECT HELPS VULNERABLE TENANTS STABILIZE THEIR HOUSING, REDUCE THEIR FINANCIAL OBLIGATIONS, AND PROTECT THEIR CREDIT.

The Pro Bono team is continuing to expand its remote projects to reach additional clients in need of legal support. During the COVID-19 pandemic, many tenants have been unable to pay their rent. In May 2021, it was estimated that Bay Area renters faced an estimated $488 million in rent debt, approximately $3,600 per household. Eviction moratoriums that assisted tenants have expired. Tenants can now be sued in Small Claims Court by their landlord for rent that they were unable to pay and are also subject to eviction under certain conditions.

In order to address these pressing community legal needs, the Pro Bono team started the Eviction Mediation Pro Bono Project where volunteers represent tenants in a mediation against a represented landlord. This project helps tenants stabilize their housing, reduce their financial obligations, and protect their credit. The Pro Bono Program also launched the Small Claims Court Back Rent Pro Bono Project where pro bono attorneys advise tenants how to defend themselves in Small Claims Court after they are sued for unpaid rent accumulated during the eviction moratoriums.

Amidst all of the uncertainty and added stress we have all experienced during the pandemic, we’re grateful for all of our pro bono attorneys and volunteers who continued to serve our community when their expertise was so urgently needed.
