Yet at the Law Foundation of Silicon Valley we are hopeful, because each day we make real and lasting impact in the lives of our neighbors and for our region.

The victories we achieved last year — helping low-income people access safe and affordable housing; ensuring students with special education needs received the accommodations necessary to be successful in school; protecting people living with mental health disabilities from discrimination — are dedicated to you.

We continue to provide an increasing number of ongoing legal services to those who need us the most: foster youth, seniors, single parents, people with physical and mental health disabilities, and many others. One goal of our recently completed strategic plan is to rely on our direct services work with individuals to inform our system change efforts. We see firsthand the challenges our clients face and that makes us better equipped to advocate for policy changes and long-term solutions.

For example, our work with youth and immigration makes us uniquely positioned as co-counsel on the Flores Settlement Agreement to represent the rights and needs of immigrant children being held at federal detention facilities. And our housing policy efforts throughout Silicon Valley are rooted in our clients’ daily need for safe, stable, and affordable housing.

ACCESS TO JUSTICE Equality is not the reality for everyone in our community. This is especially true when navigating the court system and accessing justice.

When families and community members in Silicon Valley face stressful and life-changing legal issues involving housing, health care, and children’s rights, the Law Foundation can make all the difference in achieving justice. Our clients’ stories are deeply personal and often very complex, but there are common themes.

The legal system is difficult to navigate alone and often requires a lawyer, which many low-income families and residents cannot afford — this prevents them from being fairly represented in court.

The explosive growth of Silicon Valley and rising income disparities means increased rents and limited housing options, making it challenging for many to maintain stability for themselves and their families.

A variety of circumstances, including language barriers, having a disability, being elderly, or living on a limited income, adds obstacles to accessing resources and assistance.

THE JUSTICE GAP Many do not receive the help they need during their most challenging life moments. On average, lowincome families experience 1-3 civil legal issues, such as housing evictions or loss of benefits, each year.

Last year, 86% of the civil legal problems reported by low-income people in the United States received inadequate or no legal help. This is the justice gap — the difference between the civil legal services available versus the level of services actually needed. The Law Foundation of Silicon Valley works to close this gap and increase the ability for everyone in our community to achieve stability, safety, and well-being.

HOUSING Safe and stable homes for our seniors, our families, and our children mean better social and economic outcomes for our community as a whole. Last year marked a significant 20% increase in the number of clients we assisted with housing-related matters. As the cost of living continues to rise, finding and keeping a safe and affordable place to live is a challenge for far too many, especially for underserved residents and communities of color.

Defending Mobile Home Park’s Affordable Housing for Families After receiving an eviction notice, you often feel scared and uncertain. Mobile home residents are especially at risk — they own their home but not the land it sits on. Residents risk losing their home, their largest financial asset, because relocation is often cost-prohibitive.

In April, our community workers noticed a high volume of calls coming in from residents at Golden Lake Mobile Home Park*, each with a similar story: they had received an eviction notice and had been given 60 days to vacate.

The Law Foundation dispatched community workers and attorneys to Golden Lake to educate 65 Spanish- and Vietnamese-speaking families and residents about their legal rights.

We learned that residents were being evicted for allegedly failing to make repairs to their homes following a state inspection. Although the state agency had sent notices outlining the necessary repairs, it failed to translate the notices for residents into their primary language. Many homeowners didn’t understand that their homes were out of compliance with state regulations until they heard the news directly from our legal team. Attorneys at the Law Foundation advocated with the state agency, which agreed to rescind notices to all mobile home owners, not only at the Golden Lake park, but in all parks in Santa Clara County, until notices were translated into Spanish and Vietnamese. The park owner then rescinded the eviction notices. Residents made necessary repairs and Golden Lake was able to keep its strong community intact.

Throughout Santa Clara County, some landlords looking to benefit from rising housing costs will evict tenants to raise the rent, often leaving residents displaced or even homeless.

Last year, the Law Foundation served over

people facing eviction.

Securing Benefits and Stable Housing Estelle is a 61-year-old woman with a mental health disability. She relies on disability benefits to help cover the monthly rent in the apartment where she’s been living for more than a decade. Last year, construction on the building next door to Estelle’s home led to an infestation of cockroaches. The landlord assumed it was Estelle’s fault and issued an eviction notice. This unjust eviction triggered the termination of her disability benefits, which would have made it nearly impossible to find alternative, affordable housing.

That’s when Estelle found the Law Foundation. Our attorney represented Estelle in a hearing before the Housing Authority of Santa Clara County, leading to her benefits being reinstated. We also represented Estelle in her eviction case and negotiated with the landlord to treat the infestation and allow Estelle to stay in her home.

Guarding the Rights of Families with Children Health starts with a safe home and neighborhood. Where we live, play, and grow matter. But for children at a rental complex in Gilroy, the housing where they were growing up was far from safe. The children at the complex feared a property manager who regularly yelled at them, took their toys, and forbid them from playing outside.

Their parents were fearful for other reasons. Families, all of whom are Latino, lived with bug infestations, mold, and broken faucets, among other issues. After working up the courage to make a complaint, their biggest fears were realized — they received eviction notices.

The families found a system of support at the Law Foundation.

Our attorneys took the case in collaboration with pro bono attorneys from the law firm Fish & Richardson. Through our investigation, we learned that at another property owned by the same company, the apartments were in good condition, Asian and white residents were treated well, and children were allowed to play outside.

We filed a lawsuit against the owners of the property. The court denied the owner’s attempt to dismiss the case and found the case could proceed under the framework that exploiting Latino tenants by making them live in uninhabitable conditions was a violation of the Fair Housing Act. The case settled and the owner was required to make the needed repairs and allow the children to play outside. Now, where they live can finally start feeling like home.

There were times when I would sit and cry and think, I can’t believe this is happening to us. But the Law Foundation was there from the beginning. They fight for you. They have words that you don’t have."

Dulce, along with her 3-week-old son and their family, were one of the many whose homes were destroyed in the Rock Springs neighborhood flood in San Jose, leaving them with nothing. Dulce’s landlord used the flood to extort money from his vulnerable tenants, doubling their rent. Unable to return home, the family of five was displaced for a year. The Law Foundation won damages for Dulce that allowed her family to leave the shelter and relocate to a new home.

CHILDREN & YOUTH We are proud to amplify the voices of those most underserved and underrepresented in our community, including the children we serve. The Law Foundation assists with a broad array of legal and social issues facing at-risk children, taking into account all their needs and helping them overcome significant obstacles, such as abuse, unstable housing, and access to education.

Successfully Advocating for Educational Rights Children in the foster care system are sometimes left behind — left to handle issues on their own, including their academic progress. The Law Foundation provides legal services for over 90% of foster youth in Santa Clara County, helping them access an avenue to advocate for their best interests, including educational needs.

Frankie was a foster youth who didn’t have a consistent educational advocate. At the start of his freshman year in high school, he was reading at a second-grade level. Due to being in foster care for much of his life, Frankie had moved schools several times and struggled academically. Instead of receiving the tutoring and support he needed, Frankie was passed from one grade level to the next, without question. Our team brought an administrative complaint against Frankie’s school district with the goal of obtaining increased support for him. After the district denied the request for services, a Law Foundation attorney and social worker went to mediation with school district representatives.

In the end, Frankie was granted 300 hours of private, one-on-one reading instruction tailored to his specific needs. With the Law Foundation, Frankie has a strong advocate that’s working with him to change his life for the better.

Tabitha is one of the children in foster care we fought for when abuse experienced at home threatened her safety. Advocacy from a Law Foundation attorney helped her find a safe place to live, retrieve lost possessions, and stay on track with her education.

Protecting Children After Sexual Assault Mariel, 10, and Mia*, 12, are sisters. After the two girls revealed to their mother that they’d been sexually assaulted by their landlord, the family sought our help.

Our attorney immediately moved to secure a restraining order against the landlord. He responded with an eviction notice. Concerned by the landlord’s intimidating threat of eviction, our legal team stepped in with support from pro bono counsel, Kilpatrick Townsend & Stockton, LLP, and brought a federal lawsuit against the landlord for sexual assault and discrimination.

Our social worker, together with our legal team, collaborated on behalf of the sisters, and secured relocation assistance for the family, short-term public benefits to help them recover, and counseling for the girls.

While no amount of money can undo the children’s emotional and physical suffering, the team of attorneys secured a judgment against the landlord for nearly $3 million in damages.

Engaging Youth During March for Our Lives On March 14, 2018, high schoolers across the Bay Area participated in a nationwide school walkout to protest gun violence, including students in Santa Clara County. The Law Foundation sent a letter of support to federal, state, and local leaders urging them to support the walkout. Our staff and attorneys also educated students on their right to participate in civil disobedience.

We continue to encourage school district personnel to support youth engaging in peaceful protest to express their views. The Law Foundation is inspired by the dedication of these young people and is proud to support this important movement. *Names have been changed for privacy

SOCIAL WORK-LEGAL COLLABORATION There are many emotional, familial, environmental, and social issues that complicate the legal barriers our clients face, especially our youngest clients. The Law Foundation’s unique approach of pairing professional social workers with lawyers, specifically in our children and youth program, plays an important role in our ability to help families and children overcome serious legal problems and lead healthy, stable, and more productive lives.

Through comprehensive assessments, expertise, and advocacy, our social workers collaborate with attorneys to consider the developmentally-appropriate needs of children during a stressful time. This social work-legal collaboration is just one of the many innovative ways in which the Law Foundation takes a holistic approach in our work to provide the best solutions for our community members facing life-changing legal issues.

HEALTH People living with mental and physical health disabilities face a unique set of challenges, particularly when they live in poverty. Every day we see clients who have been discriminated against or denied access to the employment benefits, health insurance, or other assistance they rely on for basic necessities such as food, medicine, and housing. The Law Foundation’s health team plays a significant role in strengthening our community’s safety net and ensuring access to benefits.

Fighting for Accountability An unforeseen illness can upend your entire life. Mounting medical bills can burden you and your family, adding stress during an already trying time. This was the case for Paul when he came to the Law Foundation for help.

Paul, a longtime San Jose resident, lives with a mental health disability that makes it difficult to maintain stable work. Unfortunately, Paul was diagnosed with colon cancer. He experienced major complications from treatment, including serious breathing difficulties, and his medical team decided a tracheotomy was the best course of action. Paul now has as throat tube that he must change each day in order to breath.

Although Paul has medical insurance under Medicare, reimbursement of the tracheal tube replacements was denied. This left him with significant, ongoing medical bills that he could not pay, placing his health at further risk. Our attorney advocated on Paul’s behalf and successfully convinced Medicare of its obligation to cover all aspects of his care, including the tubes, giving Paul time to focus on the most important task — his recovery.

Breaking Barriers with Persistence Since 2009, we have served hundreds of clients through our medical-legal partnership with Santa Clara County Valley Medical Center, where our attorneys team with doctors and nurses to address patient needs both in and out of the hospital. Just as a doctor would refer someone with a specific medical need to a specialist, the partnership allows doctors to refer a patient to a lawyer.

Deanna came to us through this partnership. She was homeless at the time and had a disability that made it difficult for her to secure housing and employment. Our attorney thought Deanna was likely eligible for monthly Social Security Insurance benefits and Medicare. However, her past requests for benefits had been denied. We filed an appeal with the Social Security Administration. After our first level appeal was denied, our attorney represented Deanna at a hearing and she was found eligible for Social Security and Medicare benefits — including the benefits she should have been receiving during the time that she had been appealing the initial denial.

However, the story didn’t end there. Despite the favorable decision granting Deanna her benefits, she was not receiving the funds. Our attorney tried every avenue with Social Security to determine what was preventing Deanna’s payment. When this was unsuccessful, our attorney persisted and contacted Deanna’s congressional representative on her behalf. After a congressional inquiry into Deanna’s case, her benefits were released. The overdue award amount of $81,000 was life-changing for Deanna and went a long way to helping her start anew.

Standing Up for Fair Treatment Jesenia made a mistake at work and paid a significant price for it — she was fired. Yet Jesenia’s colleague, who had made the same mistake, kept her job. What set Jesenia apart from her former co-worker is that she is living with HIV, and her employer had learned of her HIV status shortly before she lost her job.

Suddenly unemployed and struggling with a major health challenge that requires her to strictly adhere to a medication regimen, eat healthy, and take care of herself, Jesenia became panicked after her request for unemployment insurance was denied. She feared she would become homeless.

At the suggestion of her case manager, Jesenia contacted the Law Foundation and our attorney appealed the decision and represented Jesenia at a hearing. Concurrently, we referred her to private attorneys to assess her claim for employment discrimination. At the unemployment hearing, the judge found that the policy the employer said Jesenia violated wasn’t reasonable, and that her violation didn’t affect the employer in a significant way. She was soon awarded unemployment insurance, giving her the time and peace of mind she needed to secure a new job. The Law Foundation attorney also coordinated with Jesenia’s private employment attorney, who helped her pursue a discrimination claim.

Without the Law Foundation of Silicon Valley, I don’t know where I would be. They helped me through a very difficult time in my son’s life — getting the help he needed that I could not afford. They saved me, and they helped save my son."

Struggles with mental health placed Michael in and out of hospitals and supportive living homes, leading to his disability benefits being unjustly stripped.

His mother, Gwen, sought help from the Law Foundation, which elevated their voices when they weren't being heard.

As a result, Michael’s disability benefits were reinstated.

SYSTEMS CHANGE At the Law Foundation of Silicon Valley, we address the pressing issues facing individuals and families on a day-today basis while advocating for policy changes aimed at putting long-term solutions in place. The Law Foundation’s direct work with clients gives us a unique perspective into the systems that cause hardships and challenges. We use this insight to advocate for systems change that will improve the lives of our low-income and underrepresented clients. Last year, our advocacy resulted in a number of successes.

Co-counsel on the Flores Settlement Agreement The Law Foundation is one of several co-counsel representing immigrant minors in the Flores Settlement Agreement, which governs the length of time and conditions under which migrant children can be held at federal detention facilities. This year, we challenged threats posed to the agreement by the Trump Administration, and successfully advocated against efforts to indefinitely detain children and families in unlicensed facilities. This summer, members of our team traveled to a Customs and Border Patrol facility in Arizona to interview detained children and assess their living conditions. Based on our observations and those of many other volunteers, the Law Foundation filed paperwork describing the conditions, which became part of the court filing. As a result, the district court judge appointed an independent monitor to regularly assess conditions at detention sites.

Advocating for the Rights of Patients in Psychiatric Hospitals The Law Foundation’s Patients’ Rights Unit works to protect the rights of people living with mental health disabilities. Our multi-pronged approach includes direct advocacy on behalf of clients, serving as a watchdog for patients in the behavioral health system, and comprehensive training for professionals and community members. Last year, we provided more than two dozen trainings to hundreds of behavioral health providers and law enforcement officers on protecting mental health patients’ rights. In our oversight and monitoring role, we pushed for improved policies and procedures at a large, for-profit behavioral health hospital. Our advocacy also resulted in protections for patients around the use of seclusion and restraint, emergency medication, and increased access to personal hygiene supplies for people living with mental health disabilities at the Santa Clara County Main Jail. We partner with the Behavioral Health Services Department, clients, family members, service providers, and other advocates to promote a system of care that fosters recovery and wellness and provides services in the least restrictive setting.

Preserving Affordable Housing and Preventing Displacement Last year, the City of San Jose entered into an exclusive negotiating agreement with Google to build a new campus in the city's downtown corridor. For low-income people and families living in and around San Jose, displacement as a major risk only increases with this development due to the rising cost of living. Earlier this year, San Jose City Council organized the Diridon Station Area Advisory Group, comprised of nearly 40 companies, neighborhood associations, individuals, and non-profit organizations. This group is tasked with gathering and processing community input on the project, as well as other development near the transit hub. As the only legal services provider invited to join the group, the Law Foundation is advocating for preventative measures, including a community benefits agreement, aimed at protecting low-income residents.

PRO BONO The Law Foundation partners with a wide range of influential law firms, corporate legal departments, and solo practitioners to increase our impact with both individual client cases and system change efforts. Pro bono volunteers work alongside our staff attorneys to collaborate, share expertise, and ultimately, strengthen our community. Navigating Guardianship and Maintaining Stability The Law Foundation’s expertise in guardianship representation made a difference in a case with pro bono counsel at Skadden, Arps, Slate, Meagher and Flom, LLP. They represented a 15-year-old girl at risk of losing her stable home after her grandmother and long-time caretaker passed away in the midst of guardianship proceedings.

The pro bono counsel successfully petitioned for a guardianship with a classmate’s family, so the teen client was able to remain at the same school with an already established support network.

It was rewarding to see our client emerge from difficult circumstances into a loving and supportive home and family. The Law Foundation did a great job of providing mentorship and supporting us as the case took a few difficult turns."

Keeping Children Safe and Families Together When a pro bono attorney from Reed Smith LLP began representing an immigrant mother in obtaining custody and Special Immigrant Juvenile Status (SIJS) for her 13- and 15-year-old daughters, the Law Foundation was there to help. SIJS is available to minors forced to flee their home countries due to threats to their physical safety, abuse, severe neglect, or abandonment.

Through the partnership with a Law Foundation attorney and social worker, the pro bono attorney obtained a family court order establishing parentage and SIJS, and then successfully filed for legal status, obtaining green cards for the children. The girls are currently living safely with their mom in secure housing.

RACE EQUITY & INCLUSION As social justice lawyers and advocates, it is critical that we work to understand the complex challenges our clients experience every day. This includes working to understand structural racism and systemic inequalities that pervade through policies, practices, and cultural messages.

The Law Foundation is committed to making our organization and its services racially equitable.

Building on our previous year’s participation in the Sargent Shriver National Center on Poverty Law’s Racial Justice Training Institute, we created a Race Equity Steering Committee to guide our work internally, along with an experienced consultant to support our progress. The Steering Committee reviewed case data, completed staff and board surveys, conducted focus groups, and interviewed individuals. We did this all in an effort to collect information about who we are, who we serve, what it is like to work at the Law Foundation, and what we need to be successful in promoting race equity.

As our race equity initiative continues, we are making deliberate and positive changes when hiring, advocating, and working with clients. We are serious and committed to this work and your ongoing support of the Law Foundation makes it possible to advance our progress on these crucial issues affecting our clients and the systems in which we live.
