Welcoming the grand re-opening of Australia

President’s message

New South Wales is leading the way by allowing domestic movement on a business and travel front to resume.

We can only hope the other states follow quickly.

Finally, our state premiers have started talking about road maps, re-opening and floating a potential ‘Freedom Day’. It may sound like a movie, but that’s exactly what we have all been waiting for — a clearer vision of what the near future holds when we all can get back to some form of normality.

Early in October I called around the country speaking with some of our members and getting feedback on how their states are tracking. The good news is, I’ve heard many positive comments from HRIA member companies. Here’s the state by territory summary:

STATE AND TERRITORY ROUND-UP

Queensland is going gang busters, even within the events sector. Brisbane Festival ran all of September and everyone was extremely busy, restaurants were booked out and it was a success, however there is still caution with tourism remaining a concern and businesses relying on this sector feeling uncertain about their future.

Western Australia has had no COVID restrictions for a while now, so things are very positive across the sector. Mining and general equipment hire are both doing well. Likewise, government spending on new infrastructure is very positive.

General hire and access hire are extremely busy across Victoria. Click and collect is a popular addition to affected businesses and there is a positive vibe in general. However, the

event sector is struggling with little or no work coming in and regional Victoria is re-opening but there is a disconnect from the city. I hear the access sector is about to ramp up as they try and catch up on the backlog from recent construction shutdowns.

Housing construction is keeping NSW extremely busy and the site services sector, portable buildings, toilets and temporary fencing are struggling to keep up with demand. General hire is coming back strongly.

The event hire sector can see some light at the end of the tunnel and those with long term hire at COVID sites have enjoyed the regular cash flow. With lock downs and restrictions easing, more work is predicted to come in.

South Australia is experiencing the busiest general equipment and access hire period we have seen in years. The event hire is slowly coming back with small to medium sized weddings, fairs, field days all now taking place across the state.

In short, there is plenty to be positive about. We are all still struggling with supply of new capital equipment, so it pays to order stock early and regularly keep in contact with your suppliers to avoid missing out. Finding staff remains a challenge, which hopefully will change as the government ends pandemic related support payments. We are noticing future staff are more interested in work life balance than the big salaries they might achieve in fly in fly out work or on temporary projects.

SAFETY IN THE SPOTLIGHT

I’d like to extend my congratulations to James and staff for securing additional funding for the Chain of Responsibility (CoR) Awareness Course roll out for 2022.

Our management team completed CoR training earlier this year, which created some very interesting and constructive discussions. If you missed the opportunity to do this half day training session, I encourage you to get involved with the online training that is being expanded to cover more CoR topics.

October was national Safe Work Month and that is an initiative HRIA strongly supported. It is important we all remember a safe and healthy workplace benefits everyone. Summer and warmer weather is coming, so it’s vital you ensure you have your hot weather policies in place and that your staff understands them. If you need any advice or support setting up policies and procedures, the HRIA has resources and knowledge to assist you with this.

Neither last nor least, congratulations to WA, SA, QLD for running successful state meetings, we are all hungry for face-to-face networking. I look forward to seeing all the other states finally being able to hold meetings soon.

END OF YEAR WRAP UP

For the second year running, our national AGM was held via a Zoom meeting. It may not be the best way to hold an AGM, but these are the times we are living in though I am confident this will be our last AGM via Zoom.

A big thank you to all those who attended and thank you to all our members for your continued support of our association.

As this is our last magazine for 2021. I want to wish everyone a Merry Christmas and prosperous 2022. Take care, stay safe and support each other. I look forward to catching up with you all in Adelaide next year.

The simple, sweet gesture boosting hospital staff spirits Miles Beamish, Finlease Group’s Partner, shares how their company lifted healthcare staffs spirits during the peak of COVID.

I recently found myself reflecting on a question that is relevant to all of us at this time: “If you were asked tomorrow to step into a Covid Ward or ICU unit — even with full PPE protection, to provide personal and close up care to a group of strangers, would you do it?”

This was the catalyst for Project Freddo Frog, an initiative which has had the backing of the 80 staff members making up the Finlease family. Since its inception, over 50,000 individually wrapped chocolates (we ran out of Freddos) have been distributed across both the Greater Sydney and Melbourne hospital and ambulance networks.

It is Finlease’s small but symbolic gesture in support of the thousands of frontline workers across our hospitals, ambulances and other healthcare professionals who have worked tirelessly and selflessly throughout this Covid pandemic. They are not only to be admired, but we owe them an enormous debt of gratitude for doing so much to keep us all safe throughout this pandemic and into the months ahead.

We can’t do their jobs for them, so the least we can do is provide a little something that gives them a nice surprise and a sugar hit during their long and stressful days. A response from one of the hospitals which received their surprise of delivered chocolates sums it up perfectly.

Below are some quotes from hospital staff.

“You have made our day, we can’t express enough the joy of receiving a chocolate especially at 2.00pm in the afternoon, the difference it made to our day.”

“As COVID-19 continues to spread, the future has never felt so unpredictable. These are challenging times for us all, and we hope you’re in good spirits and health. Right now, we’re doing everything possible to sustain daily operations and provide services to our community. While there’s a lot of uncertainty, we know that we will get through this.

We are so grateful to you for taking the time to think about us and sending good vibes our way.”

“Your ‘small’ token of appreciation as you call it, makes a big difference to us and is felt and very much appreciated by each and every one of our staff.”

Indemnity clauses: what you should consider when negotiating indemnities Bartier Perry’s Michael Cossetto, Partner; Eric Kwan, Senior Associate and Natalie Zomaya, Lawyer explain the why’s and how’s of indemnities.

When negotiating equipment rental and other agreements, you have likely come across the term ‘indemnity’ – what does this really mean and how wise is it to give an indemnity? It is important to understand the implications of both requesting and providing an indemnity as there can be significant ramifications.

While this overview can assist in understanding when it is (and is not) appropriate to include indemnity clauses in agreements, reliable legal advice is essential.

UNDERSTANDING INDEMNITY

Essentially, an indemnity in a contract is a promise or guarantee to compensate the other party to the contract for loss or damage suffered. However, an indemnity is not required to recover loss suffered under a contract.

If a party has suffered loss under a contract and there is no indemnity to rely on, that party can rely on their rights under common law to make a claim for damages against the breaching party to recover the loss suffered.

Recovering loss by way of a claim for damages under common law may be considered more beneficial to parties, especially given that there are inherent checks and balances to protect both sides.

WHY ARE INDEMNITIES USED?

While an indemnity is not required to recover loss, indemnities are commonly used because they are seen as an easier way to recover loss. This is because a party does not need to prove or demonstrate everything they would normally need to prove if they were to make a claim for damages under common law. Rather, they are only required to demonstrate the event giving rise to the indemnity occurred and that they have suffered loss or damage and they can provide parties with increased certainty regarding liability under a contract.

WHAT ARE THE CONSEQUENCES OF GIVING AN INDEMNITY?

While indemnities may be good for the party receiving it, they can have some unintended consequences for

the party giving it. One example is the contracting out of defenses. One of the main consequences for the party giving the indemnity is that they are effectively contracting out of some of the defenses they may have under common law. This is because the party receiving the indemnity may not need to show any causal link between the event and the damage suffered.

All they must do is show the event that they are being indemnified for has occurred and that they have suffered loss. They may not need to show that they have taken any steps to try and minimise or mitigate their loss. This means that the party giving the indemnity may find themselves liable for loss beyond what the common law would deem them liable for.

It is also common to find ‘exclusion provisions’ in insurance policies which limit or completely exclude coverage for assumed contractual liabilities (such as an indemnity). This means the party giving the indemnity may not be able to recover from their insurance policy all the amounts they have paid out, or are required to pay out, under the indemnity.

WHEN ARE INDEMNITIES APPROPRIATE?

An indemnity may be appropriate where there is no other practical way to manage or apportion risk fairly.

Typical examples of this include situations where the potential impact to a party is huge but they have no direct control or ability to manage, for example, if the equipment is used by someone other than a customer.

Another example is a party being promised something fundamental but there is no practical way for that party to verify that promise — for example, the other party has not infringed on someone else’s intellectual property.

When considering whether to ask for an indemnity, it’s advisable to first conduct an internal risk assessment.

This would include identifying potential risks and work out where you might suffer loss or damage, assessing the likelihood of those risks occurring; and evaluating what steps can be taken to manage those risks if no indemnity is given.

If the identified potential risk of loss or damage is significant and cannot be effectively managed, then it may be appropriate to request an indemnity from the other party. If this is the case, the party seeking the indemnity should also consider when the indemnity should come into play; and what the potential cost to the other party might be if the indemnity is triggered, and whether having an indemnity is fair on each of the parties.

A fairly drafted indemnity designed to address a legitimate concern and not disproportionate to the risk involved is more likely to be accepted by the other party, and ultimately save time and effort in negotiations.

WHEN ARE INDEMNITIES NOT APPROPRIATE?

If a party has been asked to give an indemnity, they should consider whether it is commercially appropriate or if there is a more appropriate remedy. For example, it may not be appropriate to give an indemnity for a breach of contract, because the other party already has a right to claim damages for breach of contract under common law. It may also be inappropriate for events or circumstances where the party giving the indemnity receives no benefit or has no control over.

It is vital you review the clause carefully to understand when the indemnity kicks in and what the scope of the liability is. This will help determine if the indemnity is acceptable or if it needs to be finessed to make it fair for all parties involved. When finetuning an indemnity, certain limitations or restrictions can be imposed. These may include placing time restraints, restricting recourse to certain types of loss, setting a cap, limiting recourse to ‘reasonable’ costs and expenses, or imposing an obligation to mitigate.

In summary, parties should always seek legal advice before entering into an equipment rental agreement that includes an indemnity clause. As parties have common law rights to make a claim for damages to recover loss they may have suffered, indemnities should generally not be given unless it is appropriate in the context of the commercial arrangement.

If an indemnity is considered appropriate, parties should take into consideration the potential impact of the indemnity on their insurance coverage, their risk of exposure to liability under the contract, and whether any limitations should be imposed on the indemnity to limit their exposure.

What should you look for in a Trusted Advisor?

Being a business owner can be difficult at the best of times with the constant juggling of competing priorities pulling you in multiple directions. Richard van der Merwe, Lead Partner and David Hinchey, Senior Manager of Fordham Business Advisors sow you how take the stress out of choosing the right Trusted Advisor.

If you’ve run your own business, you know the drill. One minute you’re negotiating a big contract, the next you might be dealing with one of your team on an employee matter or talking to your bank about renewing your finance. As everybody is human and can’t possibly know everything, it is vital to always surround yourself with the best possible advice. So how do you make sure you choose the right trusted advisor?

It is useful to start by understanding what trusted advisors consider to be important traits they need to be the best their jobs. One of the most referred to sources for professional advisors when they are trying to better themselves is the book, ‘The Trusted Advisor’ by David H. Maister. In his book, he lists’ 10 key traits of the Trusted Advisor, and as we have paraphrased, he says they: 1. Focus on the client, and not just themselves.

2. See the client as an individual, and not just a person that is filling a role or job.

3. Always work towards problem definition and solution, not just technical or content mastery.

4. Are competitive with themselves to always provide a better service to their clients.

5. Ensure they do the next right thing, or take the next right step on the journey without being tied to specific outcomes or destinations 6. Are motivated to do the right thing rather than focusing on the interests of themselves or their firm.

7. View techniques, processes, methodologies, and models as useful tools, however, discard them if not applicable or useful to the client or circumstances.

8. Seek out client contact, knowing that a successful relationship is founded on the accumulation of shared experiences.

9. Know that both selling and serving are part of being a professional.

10. Understand the distinction between private and business life, and knows that while they are different that they often overlap.

WHAT SHOULD YOU WATCH FOR?

Whilst it is helpful to know how trusted advisors want to position themselves, asking yourself a few questions can further help you choose the right person for your company. Firstly, look to how well they listen. Have you ever been in a meeting with an advisor where you spend most of your time listening, and not much talking, for example? A trusted advisor should be actively listening and drilling down into the details of not only what you are saying, but what lies underneath that, and the basis of your questions and concerns.

You should leave a conversation feeling as though you have unburdened yourself, not the other way around.

Consider whether you feel they are actually interested. Everybody is at their best when they are engaged and interested, so a trusted advisor should be genuinely interested in both you and your business. It doesn’t mean that they must be fanatical about the product or service that you offer to your customers, but they have to be genuinely interested and passionate about helping you be the best that you can be in what you are doing.

THE RIGHT EXPERTISE

Having the right expertise and experiences is another box they’ll need to tick. Everybody is made up of the sum of their experiences, so ask yourself if your trusted advisor has the right experiences both professionally, and personally, to be able to help you on your journey. Their experiences and expertise should complement your own, and that of your other advisors. Honesty is also a must-have trait, so think about whether you trust them to tell you how it is.

There is no point having an Advisor who is just going to parrot back to you what you have said to them. A trusted advisor should be able to critique your plans and provide guidance to help you get to where you want to go. Rephrasing the question may be helpful here as well — when was the last time your advisor said ‘No’ to you?

Whilst it is helpful to know how trusted advisors want to position themselves, asking yourself a few questions can further help you choose the right person for your company.

Given a genuine advisor isn’t in it for themselves, their reputation, or their own profitability, always ask yourself if they are really working for you. Sure, a trusted advisor needs to have something in it for them too, but the real reason they are there should be about them helping you, not the other way around. Likewise, be sure you can answer yes to “can you get a hold of them?” Life is fast paced, and decisions need to be made. A Trusted Advisor needs to be contactable, and able to respond to you in a timely fashion so that you can get on with whatever you are doing.

And neither last nor least, like mortgages, trusted advisors are not a set and forget service, so regularly check in that they are the right advisor for you today: As life goes on, in both our personal and professional lives, we all need different things at different times. A trusted advisor should be able to help you with your problems and provide the advice that you need today. That doesn’t mean that they will be the right advisor for you tomorrow though, as our needs will continue to change over the course of our journey. Be prepared to acknowledge that the advisor you had yesterday may not be the right one to help steer you on tomorrow’s journey.

Having the right trusted advisors around you can be vitally important to your success, both personally and professionally. When was the last time you took the time to consider if your advisor(s) are trusted advisor(s), and if they are really helping you to maximise your success?

Royal Wolf acquires Price & Speed Containers Pty Ltd Royal Wolf continues to expand its footprint in Australia.

Royal Wolf Australia, a United Rentals Company is excited to announce they’ve recently acquired the container rental, sales and modification division of Price & Speed Containers Pty Ltd. Founded in 1990, Price & Speed operates five businesses at its Botany site in south-eastern Sydney, including a quarantine facility, container depot operations, permanent cold storage and a container rental, modification and sales business.

An Australian, family-owned business founded by Kevin Malouf, Price & Speed Containers supplies new and second-hand storage containers for storage, work site accommodation, refrigeration, transportable bars, and modular site facilities.

Royal Wolf managing director Neil Littlewood said Price & Speed Containers is a quality business and a natural fit for Royal Wolf. The acquisition complements Royal Wolf’s existing Sydney business and provides substantial synergies.

“We have acquired a hire fleet of around 720 units, with approximately 570 containers currently on hire

to 230 customers,” Littlewood said. “We are delighted to be welcoming so many new customers to the Royal Wolf fold.”

The Price & Speed fleet is relatively young, and the mix of units is similar to Royal Wolf’s offering, with a generous number of refrigeration units.

“We are confident this acquisition offers huge potential to enhance and strengthen our marketleading position in Sydney and New South Wales, and we look forward to the successful completion of the acquisition process,” Littlewood said.

Royal Wolf specialises in the hire, sale, and modification of new and used shipping containers, and is Australasia’s largest shipping container provider with 41 customer service centres throughout Australia and New Zealand.

“In our 26-year history, Royal Wolf has focused on service and innovation. As Australasia’s leading supplier of containerised solutions, we will continue to offer the hire, sale, and innovative design of specialised shipping containers.”

Kennards Hire expands into Northern Rivers Region Family-owned equipment hire company Kennards Hire has set up shop in Lismore, building upon its regional presence across its booming New South Wales network.

With regional NSW becoming more popular for those looking for a tree-change, Lismore is primed to become a thriving cultural and community city. Situated in the Northern Rivers Area, the new Kennards Hire branch anticipates helping local tradies and DIYers alike with their projects of all shapes and sizes.

Having worked in the hire industry for almost 30 years, Green started out working for his father’s hire business, which he eventually took over. His business was acquired by Kennards Hire in 2009 and Green has now been part of the team for 13 years.

Teammate Jordan Tomkins has a similar tale. Son of the owners of the original hire company which previously sat on the branch location, Tomkins will continue to represent his family and their history in hire by continuing to grow his career in the industry at the new Kennards Hire branch.

“It’s a great industry, we are lucky to keep Jordan on with us,” Green said. “He is passionate about hire and keen to develop there is a lot ahead of him here at Kennards Hire. There will be lots of career growth opportunities for him within the business.”

Newcomer Luke Collier will help run the branch and the team is excited to continue to hire more Lismore locals to help meet the needs of the growing infrastructure industry, tradies and DIY’ers in the region.

They’re also eager to start building relationships with the local community and are currently on the lookout for a community or sporting group to support as an extension of Kennards Hire’s family values.

Haulotte rolls out telematics solution for Australia Haulotte has recently launched their newest technology SHERPAL, a fleet management solution that has now started to be installed on several machines in Australia. More than 250 Coates Optimum 8’s have installed the telematics solution.

Easy to use, SHERPAL fleet management system offers remote access to machine data, proactive energy management and assists with preparing for technical callouts and identifying on-site unsafe behaviors.

Monitor your fleet from anywhere, in real-time SHERPAL uses an on-board GPS system to instantly locate machines in the field. The interactive map allows owners to track a specific asset or get an overview of the entire fleet. As the SHERPAL device constantly monitors what is happening on the machine’s CAN bus communication network, it can intercept and transmit a wide range of data.

the lifespan of batteries and engine components and simplifies energy management.

The permanent record provides better insights to improve the equipment’s uptime. By analysing them, it is possible to identify under utilised machines. Usage, fault, and maintenance history are also very helpful to enhance the equipment resale value. The operator benefits with data from the basket including weight and working height recorded.

“There are cases where people are just hiring the same machine they always have, but with this data the hirer can recommend the right machine for the work carried out,” Barber said. “They might need something with more outreach rather than the height.”

TWO WAYS OF ACCESSING TELEMATICS DATA

Access to the SHERPAL data can be gained either via the MyHaulotte.com service portal or alternatively integrate the data into their existing system to display machine data.

By using a standard Application Programming Interface (API) Information and functions are organized by topic to ease the integration.

“The data we capture from the Haulotte machines will be fed into our fleet management system along with other data from other areas to give us a clear picture of our machines in use,” Goodfellow said.

• In 2022, Coates has progressed its electric and hybrid vehicle roadmap and is establishing minimum standards for energy efficiency for new buildings.

• Coates is establishing circular systems plans for all major product categories. Working across three phases — ‘Design and manufacture’, ‘Use’ and ‘End of life’, these plans will guide the company in pursuing sustainability outcomes across its equipment portfolio at each stage of the equipment’s development and use – including working with its supply chain to reduce energy use and emissions optimise materials efficiency and reduce waste through improved design for disassembly and recycling.

Many business owners have been so focused on keeping their businesses afloat during the last 18 months that they have neglected their personal finance.

When you look at your personal wealth situation, are you happy with the plan that you have for your future retirement? What things could you change today to affect your desired retirement?

Accumulating wealth is the goal of any good investor, but is all wealth created equal? And how you rate the investments you currently have? In terms of being able to fund your retirement lifestyle and becoming financially independent, a rough guide is to have an amount that can support withdrawals of 5 per cent a year. For example, those who wish to spend $100,000 a year would need at least $2 million invested.

Don’t forget tax. People would need more than $2 million invested to fund $100,000 a year after tax, also assuming their investments are of a quality that can maintain at least 5 per cent earnings.

MY CHECKLIST FOR ANALYSING THE QUALITY OF YOUR INVESTMENT PORTFOLIO

1. Goals and objectives. Consider how much you want saved for your retirement and when do you plan on retiring, for example. If your goal is to have cash to fund a certain lifestyle, then the five per cent rule of thumb above is the best approach. If, however, the goal is capital accumulation, the types of investments required are different.

2. The structure for holding investments is important, too, affecting accessibility and tax.

A 65-year-old having all their investments in superannuation is great for minimising tax and optimising accessibility. But the same can’t be said for a 50-year-old who cannot access their superannuation until they retire.

Understanding your liquidity is vital. This refers to your ability to access your funds. If you need to access funds to cover living and over expenses, having investments tied up in areas such as property is not ideal – managed funds or shares are much easier to access.

Diversity, or how your investments are spread across the broad asset classes is important to consider. Within each class, how well have you diversified? An Australian equity portfolio containing just the big four banks does not represent diversification. Managed funds can be useful to improve your diversification.

Ask what level of risk you are prepared to accept. A cautious investor may prefer less risky assets, like cash or bonds, but these won’t deliver a 5 per cent return in the current environment. The traditional 70/30 asset allocation split that was providing returns of 7-8 per cent is now predicted to return closer to 4-5 per cent over the next 10 years.

Lifting the riskier part of a portfolio to 80 per cent, with the remainder in fixed interest and cash, could boost the average annual compound return by about half a percentage point, to between 4.5 and 5.5 per cent.

Quality of investments matter. Make sure you seek out the ratings and reports of researchers to

find out the true quality of investments.

7. Understand the expected returns of your investments. Different investments have different return profiles over different periods of time. They also have different tax outcomes. Capital growth tends to be more tax effective, for example, than the yield on income-producing investments.

8. The timeframe, or duration of your portfolio is key, are you investing for the long term (potentially even for the next generation) or are you investing to create funds to buy property in the next five years?

9. Don’t forget wealth protection. The use of superannuation and trusts can be effective in protecting investments from creditors. Insurance products such as income protection can help protect accumulated wealth if you can no longer work.

10. And finally, is the wealth administered and structured in a manner that will be easy to bequeath to beneficiaries upon death? This includes keeping reliable records and making sure beneficiaries know where these records are kept.

Improving real-time data flows Hire Express uses Inauro’s Perspio platform to rationalise equipment telemetry and automate the data exchange with Baseplan.

Apprentices on the rise Haloutte are now preparing for future growth by investing in tomorrow’s generation.

After a concerted effort for the last few years to increase the amount of the apprentices, Haulotte are now proud to be training seven apprentices. With business growing and more and more machines being delivered, Haulotte are seeking more resources and need to train for the future.

Haloutte have actively started recruiting apprentices to fill the gap. In conjunction with a recruitment drive, Haloutte have also started implementing some actions and initiatives to become an employer of choice as part of the global Let’s Dare program.

Operations manager for Haulotte Australia Evan Goulis explains the role apprentices play.

“They all start very green, but that isn’t a bad thing, they arrive with a great attitude and have a willingness to learn, which makes it easier to instil safety and procedures,” Goulis said. “It isn’t long before they are taking on more responsibility, like completing certain elements of a pre delivery inspection or assisting on a service job. They are supported by an experienced team that wants them to grow and develop.”

As part of the Let’s Dare program, one of the primary focus areas is diversity. The benefits offered by having a diverse workforce include more ideas and greater productivity.

“We looked at our gender balance in 2020 across the organisation and it wasn’t what we wanted it to be,” Goulis said. “Now we are proud to have a much better ratio of females, which includes two of our apprentices.

The target is not there yet, but we are focused on getting the best possible workforce with all the benefits that diversity brings.”

I would like to take this opportunity to recognise the difficulties our members have faced over the last year.

The wider community has shown support for our government’s advice and I am sure that, soon we will be living a more normal life with business back to usual for the areas that have been affected most.

I will reflect briefly on the year that was.

President’s message

We were lucky to find a window of normality in May when we held the HRIA Convention.

We got through it without border restrictions which allowed members the freedom to travel

As we move toward Christmas, I wish all our members a healthy and bountiful finish to 2021 and a smooth start to 2022. interstate and enjoy the event.

The staff who organised the convention worked tirelessly and the whole week was very successful for all the Hire and Elevating Work Platform industries Thank you for all involved.

Also, in May our CEO James Oxenham reached 10 years service with the associations.

James is doing a fantastic job and is well supported by all the dedicated staff of the HRIA, EWPA and TSHA. In June we managed a face to face board meeting in Adelaide and went over the plans for HIRE22 which will be held in Adelaide. This allowed the meeting participants just enough time to return to our home states before more travel restrictions were enforced.

Also, during the year, we progressed with our five-year strategic plan, and are on track to complete our goals by 2023. Some of the high-level achievements since 2018 include the addition of a dedicated marketing specialist, new branding, new website, digital roadmap, government grant for EWPA to exhibit at HIRE21.

In the last few months, the EWPA said goodbye to some talented staff members who decided they needed to pursue different career paths and we thank Nic and Andrew for their contributions. We have since also employed a new operations manager who has added his expertise to the team and we welcome Scott Mundy to this role.

The association continues to work with expert consultants as well as the valued contribution from its members who volunteer their time on various committees and work groups and because of this the association continues to thrive, keeping the access industry safe and strong.

I would also like to wish John Glover (Board Member and past Dave Single Award winner) a speedy recovery from an accident in October. John has served the industry tirelessly for over 20 years and we all look forward to his recovery and input in the future.

The EWPA board continues to provide direction and support for the national office and its final board meeting coincides with our November AGM. Thank you to all the directors who volunteer their time and for the companies supporting these individuals.

As we move toward Christmas, I wish all our members a healthy and bountiful finish to 2021 and a smooth start to 2022.

The TSHA kept up its momentum through the last year, working on many projects aligned to the association’s vision of a safe, versatile, and skilled telehandler industry.

Following on from work with the Victorian Farmers Federation we worked with the Queensland Farmers Federation on their Telehandler Safety Book. Thanks to our rental and supplier members for working with the QFF on this proactive safety guidance for both Victoria and Queensland.

The TSHA continues its work with the agricultural sector, consulting with the Regulators in Victoria on a possible exemption under regulation 538(2) of the

OHS Regs 2017 in relation to 128 and 129.

Specifically relating to the requirement of operators of non-slewing Telehandlers with a rated capacity greater than 3.0 tonnes fitted with a fixed load attachment (i.e. not designed to handle freely suspended loads) to have a CN licence. If the Regulators agree, this would bring Victoria in line with the other states, leaving just the ACT requiring a crane licence to operate machines with a rated capacity greater than 3.0 tonnes fitted with a fixed load attachment. We will keep members informed as this work progresses.

Our Good Practice Guide for Telehandlers remains a valuable resource for industry and the National office receives several inquiries each month, which can often be resolved by referring to this comprehensive guide.

The Guide is freely available on our website

and because it is a live document, updates can quickly be published as they become available. I strongly encourage members to make full use of this resource.

Representation on Australian and International standards ensures that Australia has a voice when it comes to the review of existing standards and the drafting of new ones. Following the adoption of design standard ISO 10896, the operational standard AS2550.19 is scheduled for review.

There have been a good number of New Accredited Trainer applications to the national office and several of these are applying to train the TSHA Gold Card.

The delivery of training year on year has increased and with fewer restrictions as we come out of lockdowns, we are optimistic that this trend with continues to rise.

Incident reporting is something the TSHA encourages its members and industry stakeholders to share with the association.

The more information we can obtain, the better the understanding of the incident, whether it be a near miss, accident, or in the worse case a fatality. Key findings can be taken and information added to training, or specific resources developed to assist industry and end-users. The national executive has a good network that allows for the sharing of information between all stakeholders, including OEMs, rental companies, third party providers, regulators, and end-users, all with a view to improving safety and preventing incidents. This is something we all need to strive for.

Five things you must do to prepare for a post-lockdown world As the world prepares to ease into business as somewhat usual, Chad McPhee, APG Australia’s operations manager shares his five-point preparation plan.

It’s safe to say every business in Australia has been challenged more than ever before thanks to COVID and the country’s required lockdowns. These trying times have been a real eye-opener for many as we see just how resilient — or for some, how vulnerable, our businesses really are. It is sad to say that on the other side of COVID there will be many who will not reopen or may never fully recover. Considering the civil, mining and construction industry makes up the backbone of Australia’s economic structure, supporting many businesses and families, when our industry is struggling or has been impacted, everyone in the country feels in the knock-on effect.

As an Australia-wide equipment distributor, we partner with many businesses across our country.

From dedicated sole-trading concreters who support leading civil construction firms to family-owned and operated fabricators, local mining operations and equipment hire stores, we have truly seen the impact of this lockdown at every level of our industry. This has afforded us a unique perspective and first-hand experience with how lockdowns can impact a business and puts us in a good position to help businesses in our industries plan their next moves as we move into the early stages of our new normal.

1. DECIDE WHAT YOUR SUMMER SEASON PRIORITIES WILL BE

As we speed towards the summer months of the year, normally many in our industry will be starting to wind down, finish off projects or postpone new inquiries for the start of 2022. The second half of the year, around Christmas and New Year, is often an expensive time for many and will be many people who are struggling for income or who will be wanting to continue work/take a reduced time off over Christmas.

Take the time now to determine what time you will be taking off over the summer months, or if you’d prefer to seize the opportunity when others are off to gain new business. You could instead use this time to plan out your projects, strategise your leave, and scaffold out your work for the first few months of the new year.

You will thank yourself come next year when you finish 2021 being productive and profitable and beginning the next with a strong start against your competition.

3. GET A SERVICE!

Many businesses are experiencing a reduced workload thanks to the lockdown and restrictions on the building/construction industry. Your equipment that was being used daily has now been sitting around gathering dust. As soon as the construction industry can kick back into full force, you will need your equipment to be firing on all cylinders and readily available for the rigorous day-to-day requirements, so take the time now to book your equipment in for a scheduled service or tune-up. Everything from your compressors to your jackhammers, power tools, pumps, vibrators, jetters and every other tool you rely on, should be kept in optimum condition.

4. DO YOU HAVE AN AGILITY COVID PLAN?

While vaccination rates are rising and the government is planning a return for all civil, mining and construction services, we must still prepare for the inevitability of more restrictions or another lockdown. It is important to have a plan in place ready to roll out if the worst happens. An ‘agility’ COVID plan is a way to streamline and reduce expenses and pivot to an alternative form of trade. For example, preparing your equipment hire company to become an online-only store for bookings, or informing staff for a temporary closure with leave in case of another shutdown, or moving your fabrication/ servicing business to pick up and drop off.

2. ALLOW FOR EQUIPMENT PROVISIONS FOR REDUCED WORKSITE WORKERS

When worksites reopen completely, there may still be restrictions on the number of people that can be working at each workplace. This means you may experience delays completing projects as tasks that previously took a team of people may need to be completed by one to two workers. You will need to expect that in these circumstances you will need to adapt to reduced numbers to see the longevity of your business.

We recommend reviewing your current equipment to see if you should upgrade or source new innovative equipment that can make the workload easier and more efficient even with reduced work numbers. 5. COMMUNICATE WITH EVERYONE

During times of uncertainty, it is vital that you stay on top of your communications to ensure people know what is happening. You may still be trading well during these times, but this will remind them of your business and keep them engaged. Once lockdown has lifted, this could take several forms. For example, you could call or email your customers to let them know your business is back in full swing and you are ready and available to help.

Updating your website and social media accounts can help new or existing customers understand how you can help them and your operating hours — you can also provide relevant information from your Agility plan through these channels. Neither last nor least, speak to your staff so there is clarity around what happens now — not only does it reassure and inform them — it enables them to plan their work and answer customer queries accurately.

Carroll Cotton recently announced a $20 million investment program. Gunnedah’s “Carroll Cotton Co” is building a new cotton gin — local contractors race to finish the project ahead of the 2021 ginning season.

“That equates to about 800 million pairs of socks every year” reported NBN News.

About the picture LinCon had been called out to do some upgrade works on the light towers at Larkin Hill racecourse, as LinCon’s 45m Palfinger Travel Towers offered the best stability to undertake the works.

Our operator and project site supervisor Graham LeClus, with 10 years’ experience with LinCon and 25 years+ in the industry) , was the right person to conduct these works.

Graham arrived at site bright and early, on a very cold, frost biting morning. The lighting contractors were running late, so Graham (like many of our operators) offered a hand in the stables until they arrived. He managed to feed, move, and assist with unloading horses while he waited. Unfortunately he didn’t get any tips for the upcoming race, but did gain new experiences.

By the time the contractors had arrived, Graham had set up the 45m Palfinger Truck Mounted EWP, completed his prestart, JSA forms, and reviewed the SWMS. He then talked the contractors through any potential site risks, completed the signing of numerous documents before they started work.

It was during the process of upgrading the light towers that provided the opportunity to absorb one of many spectacular views from the basket. “On this occasion Graham took quite a few photos and shared them with the business. His photos are often commented on by many people in the industry” said Craig.

Service and maintenance workflow automation The care and maintenance of any hire company’s fleet is paramount to the longevity of the equipment and the safety of operators, but as a fleet grows, scheduling and tracking this becomes increasingly difficult. KJ Park, vice president of growth and strategy from Texado Software, shares their top tips for ensuring vital work gets done.

One of the best ways to mitigate the risk of renting equipment which has not undergone proper maintenance is to automate the service workflow with a work order management system which sends alerts to your service team’s mobile device. An online maintenance calendar can organise service intervals using different methods of automated workflows to let the team know a service is due. There are a variety of ways rental companies can automate service schedules to ensure proper maintenance and identify any issues before equipment gets to a jobsite, which generally comes down to the specific needs of the equipment.

One is to set a notification based on the number of rental days. This method uses a set number of days rented per the invoiced rental time to determine the next best day for maintenance. For example, a filter and oil change may be required on a generator for every 30 days rented. By triggering notifications in your mobile and desktop work order management software, you can ensure your service team is staying on top of regular and repetitive maintenance.

Notifications could also be set by the number of calendar days: This sets a reminder for longer maintenance intervals that must occur at specific calendar day periods. As an example, a scissor lift may be due for checkup every 6 months since the last service date, irrespective of usage. Equipment that is sitting in the yard most of the time, or out in the field for long periods may benefit from this notification setting in your maintenance software.

Alerting the team to the need for servicing or maintenance activities by a specific date is another option and can sometimes be necessary. For instance, a trailer may need to be certified by a certain date. Even if the equipment is out on a contract, a reminder would still appear on the maintenance report to inform staff to call the customer or to send a crew to the site for inspection.

A fourth method used in the industry is number of metre units. Calculating usage period or kilometres driven are common ways to determine service intervals.

However, automatically triggering notifications per equipment will ensure none are missed from critical checkpoints. A compressor might be due for service every 100 hours. If a company has over fifty compressors, that is a lot of historical review.

Automating reminders at those intervals and reviewing fleet service history on a dashboard will provide much more visibility to the service team.

Neither last nor least, you can set notifications by specific meter reading. Meter reading reminders can be critical especially for equipment that are under warranty.

Setting an alert for 35,000.00 hours for a ride-on roller whose warranty expires at 40,000.00 hours triggers the rental company to act before the warranty period is up. If this equipment returns from a jobsite after rental, the service team will be notified so they can perform a thorough inspection to secure any repairs that can be covered by warranty before it expires.

Moving onto bigger, better and more exciting activities

The last quarter of 2021 sees many of the states that were experiencing lock downs start to open up.

New life is breathing into retail, hospitality and EVENTS! I know I am speaking on behalf of our events members when I say this is an exciting time for us all.

Along with the excitement, I am sure you are all experiencing a level of apprehension as to what the future holds in the new COVID normal world. Will we go into more snap lockdowns and have to deal with more postponements and cancellations? Will it ease on slowly or will we be hit like a freight train with work? Will we be able to meet the demand? And my biggest one- will we be able to get good staff?

Recruitment of key people and labour will continue to be the biggest hurdle for our industry in the coming 6-12 months. There is a real shortage of people resources out there in the world and I feel all industries will struggle with this.

The recruitment market will be so competitive as we all vie to attract and retain staff. The newly reformed events committee

has identified this as a real issues facing our industry and is currently working on some recruitment strategies and extra support for our members in how to attract and retain good people. Offering our team members something intangible that connects with them will be the key to attraction and retention.

Where you can go local to sporting clubs, universities and schools to attract candidates. Make sure you are offering upskilling opportunities and a career pathway for candidates that are looking for a career, not just a job.

Bunker down for the next 6–12 months and don’t fall into the trap of taking on more than you and your team can physically handle, burnout is a real risk and we can never make up for what we have lost in the last 12–18 months so we just need to focus on the future.

Victoria’s Business Event Program given extra cash Applications are now open for the next round of the National Business Events Program, offering eligible event organisers more choice and more cash to offset costs for hosting events anywhere in Victoria.

The funding program has been topped up to provide a three-fold cash boost to attract events to Melbourne and a new funding stream is now available for events hosted in regional Victoria.

The expanded program boasts increased funding amounts, up to $90,000 per applicant to hold multiyear business events in Melbourne, plus grants available up to $25,000 per applicant to hold events in regional Victoria before 31 December 2023.

Cash grants offered under the National Business Events Program can be put towards accommodation, venue hire, transport, and other event costs, and

depending on where the event is held, 50 per cent may be payable before the event commences to cover upfront expenses.

The National Business Events Program launched in May, with Melbourne Convention Bureau (MCB) receiving more than 200 expressions of interest, with 73 events approved to date.

MCB Chief Executive Julia Swanson said business event organisers can apply for funding to help event organisers in both in Melbourne and regional Victoria.

Applications are open until 31 December 2021, or earlier, if available funding is exhausted.

Sydney’s business events industry gets multi-million-dollar boost The NSW Government announced a boost in rebuilding business confidence with the launch of the ‘COVID-19 Economic Recovery Plan’, which will incentivise peer-to-peer meetings and events, according to the State’s global bidding specialists BESydney.

The $530 million support package includes $6 million for business events, conferences and conventions across Greater Sydney, Newcastle and Wollongong, as part of a major COVID-19 recover package designed to encourage people back into the Sydney CBD and support industry suppliers hard hit by COVID-19 restrictions.

The package also includes an Event Saver Fund to provide immediate support to organisers if events are cancelled or disrupted by any Public Health Orders during the 2021-22 summer, and $60 million for an Aviation Attraction Fund to incentivise international airlines to recommence flights to Sydney.

Minister for Jobs, Investment, Tourism and Western Sydney Stuart Ayres said the much-needed investment will help revive businesses and bring tourism providers back to their vibrant best.

“This funding recognises the sustained impacts from the pandemic, which severely damaged our tourism industry and put significant strain on businesses and staff.

“For our once thriving business visitor economy to reach its full potential we need caps to be lifted, delegates able to fly in, and staff attracted back to our world-class hospitality and event venues to put on the best of events for which Sydney is well-known.”

BESydney CEO Lyn Lewis-Smith said the funding announcement was a great outcome for Sydney’s business events industry which has the lion’s share of the events market and could therefore have the biggest impact in restarting the economy, as we build

back, and gives event organisers another reason why #itsgottobesydney for their next business event.

Ms. Lewis-Smith added: “With restrictions continuing to ease, Sydney is coming back to life and the funding will continue the positive momentum that we are starting to see. People are excited about reconnecting with friends and family and the prospect of travel as borders open. We can’t wait to see that same confidence now flow through to business and to welcome our national and global business delegates back here soon.”

The funding package announcement continues BESydney’s industry support initiatives, alongside the ‘It’s got to be Sydney’ campaign which launched last year to drive domestic business whilst international borders were closed, and to provide a suite of resources on meetinsydney.com.au for decision-makers and event planners when booking in Sydney. BESydney will administer the funding program in conjunction with Destination NSW, on behalf of the NSW Government. Matched funding will be available by application in rounds, commencing in late November 2021.

Events eligible for funding are conferences, conventions, symposia, congresses, seminars, training courses, trade exhibitions attracting a minimum of 100 delegates to a venue for a gathering of at least one day’s duration.

The temporary kitchen solutions for the COVID-era Brisbane-based Mobile Kitchens began when director Mitch Carter saw a gap in the market to provide temporary food service infrastructure and compliant kitchens to various industries and sectors, often in far-flung locations.

Years providing backstage catering for the crew and artists of large-scale events like Byron Bay’s Splendour in the Grass enabled Mitch Carter to see an existing niche to provide caterers and other food service companies with temporary food service infrastructure for such things as events and refurbishments.

His company, Mobile Kitchens, has quickly become an industry leader, providing purpose-built solutions for the health and aged care, building and construction, defence, hospitality and mining industries across Australia and New Zealand.

Since the emergence of COVID-19, the company has been providing effective and streamlined solutions to COVID-specific issues, enabling businesses to become agile and operate within the changing landscape of government and health guidelines.

One of their clients, Peppers Waymouth Adelaide, became a dedicated quarantine hotel for returning overseas travellers in early 2020. As such, they needed to increase their food service capabilities.

“We were able to offer Peppers a solution to the introduced regulations they were now working within, mainly enabling them to increase the numbers of kitchen staff able to work with the existing hotel kitchen being utilised alongside our Hotline Kitchen. This enables three additional chefs to safely work,” Carter said.

This year Mobile Kitchens were engaged to provide a large mining company a solution for social distancing requirements at service points for staff, and more recently, thrown into the mix with a pre-made cocktail client based on the Gold Coast.

Aquajet to the rescue Adverse weather conditions wreak havoc on concrete. Trying to remove old concrete is a labour intensive job. Hydrodemolition believe they have the answer.

Acid rain, road salt and normal wear and tear wreak havoc on concrete over time. Because new construction isn’t always practical, contractors typically rely on processes to remove deteriorated concrete and create a suitable surface to which new concrete will easily adhere.

JLG Unveils New Australian-Made Lt³ Lighting Tower JLG ANZ has expanded its range of locally developed and manufactured lighting towers, with the launch of the exciting new LT³ skid-mounted model.

Made at JLG’s Port Macquarie manufacturing and technology hub, the LT³ Lighting Tower offers many benefits for users, including superior light output, low noise operation and impressive fuel efficiency. It features high output 300W L.E.D light heads and offers a high-quality white light to safely illuminate the worksite.

Thoughtful design allows the new model to be easily setup by a single person.

The tower’s clean and compact dimensions (stowed width of just 1.18 x 1.18m) also allows for convenient side by side loading, making these lights easier to transport to jobs sites in bulk. Loading and unloading is also aided by the unit’s forklift tine pockets and crane lifting points.

Power for tower comes courtesy of a modern Kubota engine that meets stringent ‘Tier 4 Final’ standards.

As well as its low emission performance, the engine is extremely quiet (<60 dB(A) at seven metres) and frugal, offering over 245 hours of operation from its standard 172 litre tank.

For improved productivity, the LT³ Lighting Tower has a generous wind rating, allowing its 8.3 metre hydraulic mast to remain at full height in up to 80 kilometre per hour winds while a long 1000-hour engine oil servicing interval will keep these lights operating for longer. Considerable thought has also been given to the model’s ease of operation and maintenance. The LT³ is equipped with an external emergency stop, high engine

temperature cut-out, and simple-to-use long extension wind-down outriggers. A 48V ‘extra low voltage’ electrical system further assists longevity.

Other standard features include bunding for all fluids, electronic module including auto stop/start and advanced engine management with individual light switch, 340° rotation of light head, 50° light tilt, lockable battery isolator, level indicator bubble and low fuel warning.

Along with the LT³ Lighting Tower’s long list of standard equipment, these units can be further specified with a range of options to further suit the specific requirements of the application. Options include 360° electric rotate, fire extinguisher, double pole battery isolator, starter motor isolator, Anderson jump start receptacle, beacon, reflective tape, customized paint, exhaust heat wrap and MDG-15 spec.

Neither last nor least, the LT³ Lighting Tower is covered by JLG’s comprehensive ‘1 & 5’ Warranty, comprising one full year of complete coverage supported by a further five years’ coverage of all specified major structural components.
