I

TRUST ALL IS WELL and the extended period of fine weather in March and April assisted you with some additional revenue before the customary slow down over the cooler and wetter months. OUR ECONOMY Favourable conditions are expected to continue in New Zealand’s domestic economy, which is fantastic! Business confidence appears to be good, with growth in the construction and tourism sectors remaining strong. Low inflation and interest rates will spur consumption and investment, however persisting low commodity prices will continue to challenge the country’s agricultural and export sectors. INTERNATIONAL RELATIONS I have just returned from Australia, having attended the Hire & Rental Association of Australia (HIRA) annual conference and trade show on the Gold Coast. As usual this event is packed with interesting and insightful speakers. The long standing relationship between HIANZ and HRIA continues to grow and prosper. I also had the pleasure of meeting global rental exchange representative, Shaun Blaisdell. Shaun will be working in hire within Australia for the next 4 weeks starting his exchange at a Kennard’s Hire branch in Sydney. Opportunities exist for companies within New Zealand who are interested in hosting a rental exchange student from the USA, UK or Canada, I would certainly welcome the opportunity to discuss this further with those who may be interested. MEMBERSHIP Our membership continues to track north, with a constant flow of applications being received each month. A testament to the value and need of trade associations, more so now than ever before.

REGIONAL MEETINGS HELD IN APRIL Thank you to everyone who supported the meetings in April. Attendance was pleasing with companies traveling far and wide to attend the General Hire meetings in Auckland and Christchurch. The Party and Event sector held it’s meeting in Rotorua. Sixteen companies were represented with attendees travelling from as far away as Invercargill. It would seem the membership has embraced the new format for the networking functions and feedback would suggest the dedicated party and events function should continue annually. CONFERENCE 2016

promote new products to an interested market and ultimately provides the opportunity to expand their customer base. This year’s conference is set in Rotorua, with a move to a larger venue and an inner CBD location. This will enable HIANZ to grow the trade show, and take the event to the next level. The theme of this year’s conference is “Sustainable Business Growth.” We will focus on delivering educational content and useful resources to assist members to be more profitable. JLG Launches New Metro-Pod Lighting Tower LG is excited to introduce the Metro-POD, the latest model in the Metro Series of lighting towers.

T

HE METRO-POD utilises the same chassis and mast design of the other towers in the Metro Series, the Metro-MH & Metro-LED, but utilises three LED POD lights. These lights are designed to provide a low glare 360 degree lighting pattern. JLG’s new Metro Series Lighting Towers are purpose-built using ISO9001 standards in Australia, with features designed to suit Australian and New Zealand markets. Results of recent surveys highlight what is important to light tower owners: proven reliability, prompt supply of parts and service and transportability over long distances. The JLG Metro-POD will also help users save on fuel. Extra low voltage, high-output LED lights, in combination with fuel-efficient engines and start stop controllers, greatly reduce fuel consumption. The Metro-POD has a 48-volt DC extra low voltage system removing the requirement for an electrician to ‘Tag & Test’ and a quick-disconnect light head makes short work of disassembly. Operators will find it easier to comply with noise regulations thanks to the new exhaust system, sound proofin and quieter running engines on the JLG Metro-POD. They will also enjoy the ease of set-up and maneuverability of this tower.

MANAGING CONSTRUCTION DUST ON SITE

Managing Construction Dust On Site Construction work can produce silica dust, which is a natural substance found in cement based materials on construction sites such as concrete, bricks and stone.

W

HEN THESE MATERIALS are cut, ground, drilled or otherwise disturbed, they create silica dust and if these dust particles are small enough, (known as respirable crystalline silica or RCS), they can be dangerous as they can be breathed deep into the lungs and cause damage and lung disease also known as Silicosis. If a worker has a lengthy exposure to high levels of silica dust, lung cancer may develop. One important fact to keep in mind is that silica dust that can be breathed in is not always visible to the naked eye so it’s often the construction dust that we can’t see that we need to be even more vigilant with. Worksafe estimates that construction workers are 20 times more likely to die prematurely from breathing in harmful substances than from a workplace accident or the “too many of us are being slowly killed by the air we breathe at work”. An estimated 600-900 people die each year from exposure to airborne contaminants.

The key to preventing silica exposure is keeping silica dust out of the air. One of the options available is the use of dust extractors in conjunction with power tools that are designed to extract the dust at the source of the material being worked on. For example, circular saws that have a dust extraction outlet incorporated into the machine can have the hose from the dust extractor attach directly into the saw housing so that the dust extractor can extract the dust from the

circular saw simultaneously. For added convenience, some dust extractors also have the ability for the power tool to be plugged directly into the dust extractor. It is important to note that Worksafe recommend RPE (Respiratory Protection Equipment) be used together with other dust control methods, and not as the primary way to prevent exposure to silica dust. This is particularly important when working in the vicinity of other contractors or even the public as dust extractors can help prevent construction dust from migrating away into open spaces. Worksafe also now promote the “bin the broom” concept, in other words, no more dry sweeping. Dust extractors / vacuums with HEPA (high efficiency particulate air) filters should now be used to vacuum construction dust from building site floors What ever material you are cutting that produces fine construction dust, always be sure to follow the manufacturer’s instructions of the material being cut as each manufacturer may advise differently on the correct

procedure to manage this construction dust. Does Liquidating Your Company Protect You From Liability? Geoff Hardy - Auckland based Commercial Lawyer

My perspective

W

HEN THE GOVERNMENT appointed Messrs Hunn, Bond & Kernohan to enquire into the causes of the leaky building syndrome in 2002 (they were called “The Overview Group on Weathertightness”) they took it upon themselves to investigate and report on all the failings of the construction industry in New Zealand. In their otherwise excellent report (issued in two parts on 31 August & 31 October 2002) they offered the following comments: “It is understood that (the Companies Act) offers little protection to a home builder/buyer consumer in the event of the vendor company being put into voluntary liquidation by the Directors. There is currently nothing to stop the unscrupulous builder from liquidating their company to avoid claims and action from dissatisfied customers

Since then I have lost count of the number of times I have heard a Minister of Building and Construction express disgust at the ease at which a builder can simply wind up his company and escape liability to his creditors while setting up business under a new company the very next day. It is a very popular misconception, and it is frequently parroted by the news media. So entrenched is the belief that this strategy will work, that accountants routinely advise their builder clients to put their companies into liquidation as a means of “cleaning the slate” and unsurprisingly, many builders take that advice. The only problem with that theory, is that it is a complete fallacy. Since the early 1990s our Courts have consistently ruled that the people who run companies can be equally as liable as the companies themselves, for wrongful acts and omissions committed in the course of the company’s business activities. A limited liability company does protect shareholders from having to contribute more money if the company can

no longer pay its debts, but it does not protect the directors and senior managers from liability if the company does something wrong and they were responsible. The principle is best illustrated in the context of leaky home claims. When a homeowner is bringing a claim in the Weathertight Homes Resolution Service (“WHRS”) against a number of respondents including a small building company, it is virtually automatic that the owner/operator of that company is joined as a respondent as well. In WHRS Claim no. 734 known as Heng v Walshaw, Adjudicator Green when issuing his decision on 30 January 2008, went so far as to say (at paragraph 297) “In the case of a one man building company it will be an almost insuperable hurdle for a Director to avoid personal liability for defective work.” Why does the fallacy persist, if that is the case? One reason is that directors and officers of large companies (as distinct from small-medium enterprises) do tend to escape liability when their company goes under. That is because personal liability usually stems from the director or officer being actively involved on site, either on the tools, or in a supervisory capacity. The Courts talk of the person being “in control” or “personally assuming responsibility”. In a large development or construction company the senior people tend to be more remote from the action, and they delegate to project managers or site supervisors. Ironically, that means the big guys tend to get off the hook while the little guys don’t. And it is the large, spectacular failures like Mainzeal that attract all the publicity. Our law on personal liability lacks clear guidelines on when you will or won’t be personally liable. The Courts come up with all sorts of justifications for it, but in reality they tend to find senior people personally liable in situations where they and the company are effectively one

and the same, and the creditor the insolvent company owes the money to, deserves a lot of sympathy. It is pretty tough on the small business proprietor, because after all, a company is a fictional entity that you can’t touch or feel, so it can’t do anything without some human being doing it for it. When that person volunteers to be the action man/ woman for the company, I imagine it would the last thing on their mind that they are offering to expose all their personal assets to risk, in the course of simply doing the company’s business. And yet the Courts routinely find that they did. Outside of the leaky home context, putting a company into liquidation may sometimes be an effective ploy simply because it creates an obstacle that the creditors can’t be bothered trying to overcome. It’s not an obstacle in a WHRS case because that is a low-cost, informal system where the personal liability of an owner/operator is simply assumed. In the Courts or in an arbitration, however, the creditor would have to spend a lot of money in the hope of persuading the Judge or Arbitrator that the case law points to personal liability on the facts of their particular case. Nevertheless, when their only other option is to pursue a defunct company, they will be more motivated to do so. Liquidation isn’t exactly a cure-all either. No matter how friendly the Liquidator may appear to be, they have a duty to the creditors to bring in as much money as they can. That means that if you want to take the business assets like the vehicles, the tools, the plant & equipment, office furniture & appliances, computer hardware and software, etc. and put them into your new company, then you will need to pay a fair price for them. You also need to be wary of the liquidator’s powers to claw back benefits that you extracted out of the company at an undervalue, in the years leading up to the liquidation.

ith a variety of trencher and skid steer equipment on tap for a wide array of clients, independent hire entities value machines that are simple to use and reliable too. Ditch Witch New Zealand’s product line appears to be fitting the bill

We recently caught up with three hire centre identities to see what it is they like about having specialised Ditch Witch gear on their rental fleets HUNTLY HIRE CENTRE, HUNTLY Ron Maddern is straightforward when it comes to the performance of his Ditch Witch RT30 ride-on trencher. “Honestly, if it didn’t perform, we wouldn’t keep it in the fleet. It’s as simple as that.” Ron says he is very impressed with the machine, which is often hired out for the day and then returned a few hours later because the customer has performed the task faster than anticipated. “It’s user-friendly across a broad spectrum of customers. It’s simple to drive and, from our side of things, it’s simple to maintain. Ditch Witch has really got the recipe right with this model.” Powered by a gutsy 24hp (17.9kW) Kubota engine, the Ditch Witch RT30 combines the compact footprint and manoeuvrability of a walk-behind trencher with the operator comfort and sure-footedness of a mini tractor. Designed as a dedicated trencher, the RT30 is built on a sturdy frame PAGE 20

and features easy-to-follow colourcoded instructions and a number of operational failsafe measures to ensure customers with varying degrees of experience can use the machine safely and efficiently. Ron has fabricated his own trailer for the RT30 and says it is regularly in use with customers as far away as Otorohanga in the King Country and Clarks Beach on the Manukau Harbour. It has even been deployed to complete ground work on the busy and complex Waikato Expressway project.

“Knowing that the machine is built for the hire and rental market in the US made it the easiest choice to include in our fleet “We have so many customers singing its praises. That’s a good result for someone in our business sector.” WESTERN BAY HIRE, TE PUKE Ron Judd from Western Bay Hire in Te Puke agrees. His Ditch Witch RT30 rideon trencher’s compact size comes in handy for one of his main customer groups; local kiwifruit orchardists.

“It is seasonal demand that keeps a machine like this busy, but when the local orchardists are laying irrigation channels, the RT30 is in demand,” says Ron. “Because it’s small it works really well among the vine frames and the customers think it’s the best thing since sliced bread.” “It allows them to work really fast and without any fuss; the controls are all very simple to use, which is another bonus because some employees might have English as a second language.” Ron, who purchased Western Bay Hire around five years ago afte moving to Te Puke from Auckland, also inherited an older Ditch Witch 1030 walk-behind trencher with the business, which he says is still going strong. “It’s getting some regular maintenance today, but nothing too dramatic. Anything that’s digging holes in the ground on a regular basis is going to need regular maintenance; that’s just the nature of the equipment. “But this machine would be 10 years old at least and we’re still getting a good run out of it.” WHITIANGA HIRE, WHITIANGA Up on the Coromandel Peninsular, Keith Finch from Whitianga Hire has a different looking Ditch Witch fleet, with both an RT24 walk-behind trencher and an SK755 mini skid steer available for customers.


Keith’s run of Ditch Witch gear goes back a fair way too; he bought an 1820 walk-behind trencher around 18 years ago and says he had a fantastic run out of it, having dug hundreds of kilometres with it. These days his 23.3hp (16.6kW) RT24 walk-behind trencher is available either as a stand-alone unit or with Keith himself as operator. Although with simple controls being a primary feature, many clients are happy to operate the trencher themselves. The growth in the Whitianga district has seen Keith’s RT24 walk-behind trencher utilised by local builders and electricians, although people from all walks of life can see the benefits in a trencher that dispatches the dirt in short order. “I basically weigh-up each customer who wants to take the machine away. We have a lot of regular clients – orchardists and contractors, for example – who know how to run it. Sometimes I’ll offer to go out with the machine and do the job and you can see the relief in the customer’s eyes,” he laughs. “The beauty of that though is that the RT24 makes those sorts of jobs quick and easy and the customer is always pretty amazed at how simple the machine is to operate. I could probably dig out 100m of trench in an hour if the conditions are right.” As to his Ditch Witch SK755 mini skid steer, Keith reckons he was sold on it within minutes of hopping on. “I saw it at the HIANZ show a couple of years ago in Rotorua; Ditch Witch’s North Island rep Carl Shepherd happened to be standing there and I hopped on and said to him almost straight away “I’m going to buy one of these”. “It’s a great machine; so manoeuvrable and precise. It always goes out for short stints, but I think that’s be-

cause it’s so quick at what it does. “I think the best thing about it is its predictable performance; I can get up right alongside a house or garage and work with it and never worry about it bucking or tipping. Some competitor models are vicious to control in slight increments and I wouldn’t put them anywhere near a house.” The Ditch Witch SK755 features a high-drive track system which delivers sure-footed performance and increased ground clearance.

Honestly, if it didn’t perform, we wouldn’t keep it in the fleet. It’s as simple as that. It’s a tough machine that offers superior lift and bucket capacity, faster ground speeds, longer track life and a safe, ergonomically-designed operator station.

ARA President Makes Informal NZ Stopover A special report from HIANZ Director, Greg Ward on the recent visit to New Zealand of newly appointed American Rental Association President, Roger Vajgrt.

D

URING my recent travel on behalf of HIANZ to the ARA Rental Show and GRA (Global Rental Alliance) meeting in Atlanta, my wife Sharon and I had the pleasure of having dinner with Roger and Laura Vajgrt at one of the official functions. Roger had just taken office as the 5 th President of the ARA. Roger’s rental business, Home Rental Center and Sales, is based in Marshalltown, Iowa and services a population of 35,000. As they are the only operator in the area they carry a broad range of all things rental – literally all sectors of the industry from access, trailers, pumps, diggers to party and bouncy castles. They are also sales and service agents for Toro and Stihl equipment. To complete things they are the town’s only propane (LPG) gas supply and delivery company. Roger and Laura have been married for 27 years and have three children – sons Adam 22, Noah, 20, and daughter Sarah, 18, who is currently attending University. Both sons now work full time at the rental store while Sarah helps out when not at school. Laura also manages the store’s party side of the

business, handles the books and is the main counter person. They have a total staff of 9. We extended an invitation for the Vajgrts to stay with us during their upcoming planned journey to attend the HRIA show in Australia. We were unsure if they would extend their trip however, we must have made an impression of some sorts as upon our return home their trip was confirmed. A whirlwind 2.5 days in NZ! Our goal was to share with them a typical kiwi family experience, show them some of our beautiful country, meet a few of our HIANZ members and visit their businesses. After settling into our home and meeting our three very excited girls we took them for a quick tour of our event hire business in Rangiora. We then dropped Roger and Laura off to spend some time with Wayne Hood of Rangiora Hire. Roger and Laura, as you might expect, were completely engrossed in any hire business we visited or passed in the car. They live and breathe our industry 24/7. As it was the school holidays our three girls tagged along for what was truly magical day excursion from our home in Rangiora to Kaikoura where we were booked on the whale watch tour with Whale Watch Kaikoura. This was a first class experience and something that was enjoyed by all. We were lucky enough to see two whales, dolphins and lots of other marine life on the 2.5 hour boat trip. We travelled by air from Kaikoura and our northbound journey took us slightly inland enabling us to show off some our Waipara wine region as well as the inland hills and mountains of rural NZ. On the return leg we flew down the coastline passing the likes of Gore Bay, Motunau and the northern part of Pegasus Bay. We do live in such a magical land.

Returning to Christchurch we had dinner on the Restaurant Tram. Another first class experience! The catering was outstanding, but then it should be as our company Continental Event Hire operate it. The following day was set aside to tour Christchurch with a general drive around the city including venturing out as far as Sumner to show some of the impact of the earthquakes. Returning to central city included popping into visit Paul Raymer at the Kennard’s Hire’s Moorehouse Avenue branch.

Again Roger and Laura were very interested to see another operation and share all things hire (or “rental” as is referred to in the USA). Before they headed off back to the states we ensured of course they enjoyed the experience of a typical kiwi BBQ. Wayne and Sandy Hood joined us along with Andy Youngman our hires manager with his partner Lyna, and some other friends. “Hoody” bringing some whitebait that he cooked for us – just divine. All accompanied later by some other kiwi favourites. It was a pleasure to host the Vajgrts. Hopefully we will see them back for a longer stay next time. GRA Countries Top US$77 Billion In Combined Rental Revenue

T

HE ANNUAL MEETING of the Global Rental Associations was held recently at The Rental Show 2016 in Atlanta. GRA member associations were widely represented. Items discussed during the full day meeting focused on advancing the business success of association members and promoting the image of the equipment rental industry THROUGHOUT THE WORLD. Topics addressed included membership engagement programmes within the associations, workplace issues, including employee recruitment and training

programmes, best practices in safety and legislative/regulatory matters. The agenda also included a review of the global survey initiative of the GRA, with release of a 2014 combined rental revenue figure among th GRA associations representing $US 77 Billion. This figure represents a 2.7 increase over 2013 rental revenues, as calculated by IHS Economics on behalf of the group. The purpose of the Global Rental Alliance is to increase the profile of equipment rental worldwide and to build global understanding of the industry. It is a partnership of rental

associations from around the world that meet semi-annually and share information on program initiatives throughout the year. The unity of this group has brought about an increased awareness of overall priorities internationally, adding to the strategic outlook and resources of each rental member association. The Global Rental Alliance consists of seven independent equipment rental/hire trade associations that have joined together to increase the understanding and concept of equipment rental worldwide. â—˜

Accommodation for the last years weekend was provided by East Pier and Harbour Views with both venues getting the thumbs up from all those who were staying there. No visit to the Hawkes Bay would be complete without a visit to a vineyard. On this occasion it was the Seleni Estate. The vineyard is known for its red wines largely due to its Red Winemaker, Cairn Coghill whose experience internationally and working in a number of well know wineries in the Hawkes Bay has given it its deserved reputation. Craig provided the ‘Hire Friends’ with a very interesting talk into the origins of the Seleni Estate with a history that goes back to 1851. Hire standards for health and safety The new Health and Safety at Work Act came into force on 4 April. WorkSafe New Zealand’s programme manager for construction, Marcus Nalter, explains what it means for the hire industry. That means you need to have systems in place to check that the gear you are hiring out is:

■ SAFE – is that wood-splitter properly guarded?

■ WELL MAINTAINED – make sure gear is checked and regularly serviced.

■ CURRENT – does that scissor lift have its six-monthly inspection certificate

■ DOCUMENTED – keep service history

P

ICTURE THIS – you’re driving home one night listening to the radio when the news comes on. Reports are coming in of a person being taken to hospital after a scissor lift toppled over at a construction site in your neck of the woods and WorkSafe is investigating. Then you hear the name of the building company involved and realise it was probably the scissor lift you hired out just yesterday. You pull over and take a deep breath, grab your phone and call the boss to let them know. It’s not that unlikely a scenario. So, under the new Health and Safety at Work Act what’s your responsibility when you hire out equipment and something goes wrong? Well, the first thing to know is that hire companies (and retailers) have a duty to ensure that the equipment they supply is safe and fit for purpose, and you can’t contract out of that duty in a rental agreement. If you’re taking money to provide gear you need to make sure it is up to scratch and you supply any essential safety information needed to use it.

records etc. but more importantly make sure you have proper safety information to supply when hiring out potentially dangerous gear.

When you’re finalising the rental agreement and handing over the gear you’ll also want to talk through any important safety information and provide any operators manuals or the like. If you’re doing this well you’ll not only explain the critical safety information, you’ll also check that it has been understood. If the gear you are hiring out requires a licence to operate (such as a forklift or truck) you must also check that the hirer has the appropriate licence. Of course, even if you’ve done everything right at your end, accidents can still happen. Take that scissor lift – even if it is brand new with the operator’s manual still taped to the controls it might topple over if it’s used on uneven or unstable ground. Under the law you’re only responsible for what you can reasonably influence and control. As the company that hired out the lift you’re not responsible for how it is used. If you’ve done your job supplying a safe bit of kit (and relevant safety info) to someone who is licenced to use it and they stuff up

that’s not your fault. But if you hire out a faulty scissor lift and someone is injured you might have some questions to answer. Of course hire companies also have responsibilities under the Health and Safety at Work Act to keep workers, customers and other visitors safe in its own workplace. So you need to identify any work-related risks (such as the movement of heavy machinery around the yard or the storage of any fuel) and do what is sensible to eliminate or minimise them in proportion to the seriousness of the consequences if something goes wrong. That doesn’t mean you have to eliminate all risks at any cost. That’s not realistic and not what WorkSafe expects. You need to systematically identify those serious risks to life and limb and manage them – don’t sweat the small stuff such as a stray hammer blow to the thumb. The trick is to make sure health and safety is integrated into your business at every level. Keeping an eye out for one another, should be part of everyone’s daily routine. If it’s not already then now is the time to take action. Not only will you and your workers be safer and healthier, so will your business. The Health and Safety at Work Act also includes a requirement for businesses to engage with their workers on health and safety matters and new duties for Directors and Chief Executives to pay close attention to health and safety policies, process and resourcing. ◘

So the last thing you need as a hire company is a customer having a bad experience with your equipment – no matter how minor it was. As a Hire customer, I’ll only hire a cheap piece of equipment once. That’s enough to learn the true cost of cheap. The next cost is the longevity, the repairs, the inferior products ability to fall apart and get tatty, because the customers are so much rougher than they used to be! Or are they? All equipment runs nice when it’s brand new (or should do!). But what about down the track? That is when

the real products start showing the differences. While the cheap ones are getting run out, real products are getting run in. And when 10 years has rolled around and the original products have had to be replaced (maybe more than once), the real products have been to the moon and back, and still in service…reliably.
