From the President TIM MIKKELSEN Greetings from the Kapiti Coast Thanks to all who attended the conference in Hamilton and helped make it the success it was. Mental health advocate and New Zealander of the year Mike King delivered a thought provoking and topical opening address. His comedic, engaging and very kiwi style delivered a powerful message to a very attentive audience. Mike was allotted an hour but with our agreement he continued for another 30 minutes to finish his story, such was the level of engagement with us all. Congratulations to all the award recipients of The Hire Excellence Awards. You have not only been rewarded with the hard work and effort it takes to enter these awards but recognised as leaders in our industry in your pursuit of excellence. Well done. Based on feed back the board has received and to spice things up little, conference 2020 will be in Queenstown July 29th – 30th. Queenstown does not have the capability of a big equipment-based trade show so we will be working with our suppliers as to see how this will look. Numbers will be limited and accommodation across 2 hotels so it will be on a first in first served basis. Queenstown is a stunning location so I would advise to get the dates locked in your diary and look forward to seeing you down there. I am not sure how many of you are using the Equipment Safety Data Sheets. Feed back I have had from customers and staff has been excellent. Health and Safety is now just part of our working culture and environment. The ability to provide these standardised information sheets is assisting us to fulfil our obligations to provide comprehensive and comprehendible instruction in the safe operation of the equipment being hired. Not sure how your businesses are disseminating the ESDS’s to your customers, but most POS hire systems should have the ability to print run on sheets with the item being hired. Check with your provider and see if this feature is available. I can speak from experience this is the way to go as it avoids the conscious decision having

to be made to find the data sheet and give it to the customer. We now have 8 sheets in operation and are continuing with the roll out of further sheets. This is a member benefit at no cost to you. The new look website is now fully operational, and you have the ability to log on, create team profiles and order stock online. Under the recent posts tab, you will see that MBIE are consulting on proposed new regulations in the high-risk categories. Of note to the HIANZ is working at heights, scaffolding and excavation work. The proposed changes will impact on our industry and our responsibilities under the Health and Safety at Work Act 2015. CEO Phil Tindle has attended the consultation the consultation meetings both in Auckland and Wellington. Subject to Phil’s feedback, the board we will be putting a submission to MBIE on behalf of the association. There is also a link on our website for further information and reading. Great progress continues to be made in the Party & Events sector, with Greg and Phil signing off on a member one-off evacuation scheme with the fire service, and changes to PS1 requirements. Members will be sent specific info on these in due course. New L1 and L2 training courses were run in Mt Maunganui in September with good numbers attending. The new APEX programme sign-up forms will be distributed over the next couple of months, and again this is a member benefit we urge all in the events sector to get behind. OPENING THE SECOND BRANCH After 40+ years of successful operation in Wanganui, Grant and Karine Harrisons plans to acquire a second hire business in Feilding might have looked risky, but it was a considered risk that has started to pay off.

H

ARRISON’S HIRE MASTER growth in Wanganui has been sure and steady since its inception by Grants parents Bruce and Ann in 1975. Since taking over from the seniors 15 years ago, the Churton street premises have steadily grown, with participation in a number of hire-aligned business activities over the years. Grant & Karine helped Garry and Heather Bull, and cousins Paul and Alison Harrison get the Upper Hutt Hire business off the ground in 2014. “I guess helping to start Upper Hutt Hire gave us the confidence to try and start a hire business on our own” says Karine. “We had been talking to Brent Smith about his hire operation in Feilding and we finally agreed on a price. “ The Manawatu township has been intermittently served by a succession of hire companies, most of which had closed due to industry consolidation. Brent Smith had opened a hire business 10 years ago, primarily in response to customers wanting to hire one of his reliable trailers, and was looking to exit the hire business so he could focus on the trailer manufacturing. “Apart from a garden equipment retailer offering some gear for hire, there wasn’t a lot of bigger gear available for hire. “We had a good look at what we had been doing in Wanganui, and how we might replicate it in Feilding, and then worked out the pro’s and con’s” he said.

Once the papers were all signed, the couple set about mirroring the successful parts of the Wanganui operation into the Feilding operation. They also installed new surveillance cameras and ensured they could have 24/7 access to the hire systems on Day#1. “Our style is much more ‘hands-on’ and we needed to be closely involved in the day to day operation of the business, even when working from Wanganui” says Karine.

They also beefed up the HireWin software package, that the Feilding operation had been using. “The Hirewin system was functioning but I don’t think it had been utilised to its full potential, especially for hire contracts and forward bookings” says Karine. They also replicated the Harrison Hire master Wanganui website to the Feilding address, in order to give the business an internet presence and adopted a similar social media program. “We even linked the phone systems, so that the Feilding phone would divert to Wanganui after 5 rings, and we could answer it and place bookings in the Feilding system remotely if required”.

Despite going shopping for a range of shiny new gear to bolster the Feilding warehouse, there are a couple of areas the couple haven’t replicated. “We’ve stayed away from party hire and marquees. They’re labour intensive parts of the business, and we really wanted to focus just on the equipment hire” said Grant As the business has flourished in its first 12 months, the sales mix has changed slightly. “We had a lot of interest in some of the bigger stuff, like Excavator and rollers, in the first few months. But as time has gone on, we’ve had more interest in the smaller gear, such as plate compactors and concrete saws. I think word is getting around, and the customer comments have been positive, especially on our Facebook page” says Grant. Wherever possible, Harrison’s Hire master Feilding has tried to source Feilding requirements from Fielding suppliers. You can’t expect the locals to do business with us unless we do business with them” says Grant. And has it been successful? “Funnily enough, money wasn’t our primary motivator for buying the Feilding business. I think we were looking for a challenge, and the chance to see if we could replicate the success of the Wanganui business” says Karine. “And it’s certainly heading towards that benchmark”. And next steps? “It’s probably time for some consolidation”” says Grant. We’ve got a whole lot of new gear that we need to get some more sales against, before we look at our next challenge”. ◘

People and profit are the central principles of any organisation, regardless of sector. They were also the key focus of this year’s Hire Industry Association of New Zealand Conference.

T

HE HIRE AND RENTAL INDUSTRY is ubiquitous, with horizontal market potential. HIANZ’s role involves representing 400 pan-sector product categories, and its annual conference – the flagship HIANZ event – brings together the who’s who of not only the immediate sector it serves, but business innovators and leaders from all walks of life. This year’s big names at the conference included New Zealander of the Year Mike King, Beyond the Darklands psychologist and TV personality Nigel Latta, and business strategist Karl Varley.

A record number of attendees – made up of 390 hire company owners, managers and staff, as well as equipment and service suppliers to the industry from New Zealand and Australia – convened to network and participate in an ever-growing knowledge sharing economy that is a catalyst for powerful change. Contemplating the outstanding outcome of this year’s conference, HIANZ CEO Phil Tindle says: “This year’s record attendance is a reflection of the strength of the hire industry and the relevance of trade organisations – their value is hugely significant. Increased workloads often result in less time for businesses to focus on planning and administrative functions. Less time can also make it difficult to access reliable and relevant industry support and services. HIANZ is dedicated to providing valued resources and support to our members and the industry.” ◘

SAYING ‘NO’ TO STIGMA

HARD-HITTING TOPICS LIKE mental health and wellbeing were introduced by Mike King in a no-holds-barred discussion that said ‘no’ to stigma and a loud and emphatic ‘yes’ to the type of cultural change that will literally save lives. In relation to how people can support each other – in professional and personal capacities – Mike talked about the need to identify depression, something that can be particularly hard to recognise. “As a young man, I was brought up to believe that when the pressure was on, I had to harden up and be strong,” he conceded.

“You weren’t allowed to admit that you were struggling with emotional stuff because in the eyes of the male world that made you weak ... Very soon, small problems became big problems and big problems became huge problems.” Mike suggested that peers and friends can use a few non-confronting ways to initiate a conversation: ‘Hey bro, you look really stressed, is everything alright?’ or ‘You haven’t been your usual self lately, is everything ok?’ He stressed that while it is normal for anyone to feel down from time to time, intense feelings of anger, despair, disappointment or helplessness can be a sign of depression. “It’s important to seek help … once correctly diagnosed, there is plenty you can do to successfully treat and manage depression.” Mike’s poignant words resonated with attendees and set a powerful precedent for other speaker presentations. ◘

THE VALUE OF PERSEVERANCE Karl Varley also had a captive audience with his presentation on simple strategies to increase profit. He discussed the importance of businesses understanding that they don’t need to be all things to all people, and that if they can’t state their position in eight words or less, they don’t have a position. Karl also extolled the value of perseverance, acknowledging that sales is a process. “Sales is a failure industry: 60% of customers say ‘no’ four times before saying ‘yes’, but 92% of salespeople give up by the fourth ‘no’.” Akin to Mike King’s advice about building meaningful relationships, Karl emphasised the importance of getting relationships right in business.

BOB YOUNGMAN TRIBUTE

HIRE INDUSTRY ICON LEAVES

LASTING LEGACY It is with great sadness that we acknowledge the passing of one of the construction industries greatest characters, and a founding Director of Youngman Richardson & Co Ltd, Bob Youngman. He was 90.

B

ORN IN TAURANGA Bob served his apprenticeship as a motor mechanic in Ohakune immediately after leaving school. In 1953 he bought the motor repair business and turned it into a Todd Motors dealership selling David Brown Tractors, Commer Trucks and Hillman and Desoto cars. In 1958 Bob moved to Palmerston North and bought a Europa service station which he subsequently sold back to the company and in the process took up a position with them as a Senior Sales Executive. During his time in the Manawatu Bob served a term as President of the Palmerston North Junior Chamber of Commerce and was also a the National Director of Membership and Extension. In 1964 he became

a JC Senator and later an Associate Fellow of the NZ Institute of Management. Bob also served as a Justice of the Peace. Following the acquisition of Europa by BP in 1972 he accepted the position of Sales & Marketing Director with Richardson McCabe which also lead to a seat on the board. The move also culminated in the start of a lifelong friendship and business relationship with Tim Richardson. Richardson McCabe was subject to several takeover bids before finally being sold to Tappenden Motors and then Ceramco. This provided an opportunity for a new venture which resulted in Bob and Tim pooling their resources and taking the bold step of founding Youngman Richardson & Co Ltd in 1981 with a staff of 3. The company’s

initial master distributor appointments of note were Robin engines and Denyo generators. Forty years ago he was also involved with others in the setting up of the Hire Industry Association of New Zealand (HIANZ). At the inaugural meeting Bob came the rescue of the chairman, who seeing him out of his depth offered to take over. In doing so Bob set in motion the start of one of the country’s largest business associations. Bob will certainly be missed but his legacy will live on through Youngman Richardson and Co Ltd, a company that goes from strength to strength supplying an extensive range of equipment to the construction and hire sectors. Today the company has a total staff of 75 and represents 23 international brands. ◘

Auckland based Pro Services have recently taken delivery of a powerful new Manitou MRT-X 2150 Privilege Rotating Telehandler complete with pallet forks, a 5 ton winch and 1,000kg ORH basket from New Zealand distributor, AB Equipment.

T

HE MRT-X 2150P is a an all-terrain 4-wheel drive, rotating telehandler specially designed for the most demanding of industrial activities and construction sites. The hydrostatic transmission and ergonomic controls ensure maximum precision when manoeuvring to approach and place loads for consistently smooth operations and increased productivity. Floor space, time and budgets are optimised as this 3-in-1 machine (telehandler, crane and work platform) is capable of handling a wide range of tasks.

When it comes to providing rental access equipment and transport needs to the New Zealand film industry as well as commercial construction and infrastructure projects nobody does it better than Pro Services. Then, Murray and I took a trip to Germany earlier this year for the Bauma Construction Equipment Exhibition where the Manitou MRT-X 2150P Telehandler was being put through its paces.” “Being able to rotate 360 degrees, reach heights of up to 21m, have a lifting capacity of 5,000kg and with a remote control as standard was enough for Murray and I to feel that adding the Manitou MRT X 2150P to our fleet was a complete no-brainer,” says Neil. The 360 degree rotation feature of the Manitou means the main body of the machine can stay in one place whilst performing a multitude of tasks around it. Likewise the remote control allows the operator to activate the machine either from on the ground or up in the work platform basket. This is particularly relevant as sometimes it’s better to see what you’re working on close up. “The Manitou MRT-X 2150P allows us to provide something different for both our local and International customers.

However for us, the best thing about the Manitou is the stabilisers which in the case of the film industry provides the ability to easily adjust to the different environments And speaking of cameras the Manitou has three of their own, one at the back and 2 on the side. “With the broad base of customers that we have at Pro Services this type of flexibility and functionality offered by the Manitou MRT-X 2150P suits us right down to the ground,” says Murray. “As well as the film industry our rental fleet of lifting equipment and transport vehicles caters to glaziers, light commercial construction and certain infrastructure projects.” Pro Services has built their own facility on Rosebank Road, Avondale just behind Bunnings Trade. POINT OF RENTAL PROVIDES SOFTWARE SOLUTION FOR DRY AND WET HIRE OPERATION BACKGROUND - RAM Equipment is an innovative, caring equipment dry hire* company based in Richmond, South Australia. They partner throughout the continent to serve civil, earthmoving, railway and pipe contractors, no matter where in Australia a job takes place. Michael Grace, the company’s Sales Director, has been with the company since its founding in 2014, helping grow it from a few pieces of equipment into a growing fleet of 120+ items in 2019. THE PROBLEM As a startup, the company began tracking their data with online ERP software. As they grew, they began to notice its limitations – chiefly, they were frustrated with limited reporting and a lack of clarity on the company’s fleet and cost tracking. As they surveyed the landscape for software, RAM also needed a hire software with a Xero integration to properly manage their bookkeeping.

THE SOLUTION In 2018, after going through a trialling process with various software options Michael and RAM Equipment opted to implement Point of Rental’s Syrinx product. Because the conversion needed to occur quickly, RAM Equipment put the Point of Rental team to the test, asking for their data to be converted, new software set up, and team to be trained within two months. RAM appreciated the team’s in-depth knowledge of both the software and the hire industry – Point of Rental’s trainers ensured the entire experience was seamless by being on hand as RAM went live, answering staff questions as they came up to ensure implementation went smoothly. “After having exposure to a few software systems, I think that Syrinx was one of the easiest systems to get set up,” said Michael. “From a customer’s perspective, having a consultant that was able to provide detailed, no-fuss answers patiently and calmly was exceptional.”

SOME RECENT AUSTRALIAN CASE LAW ON THE PPSA By Geoff Hardy of Auckland law firm Martelli McKegg

The value of the turbines has been reported as being between A$44 million - A$50 million. How’s that for an expensive lesson in PPSR registration?

B

Y NOW most of you will be aware of the risk of hiring something out long-term without registering your ownership of the items in question against the customer’s name on the Personal Property Securities Register (the “PPSR”). The risk is that if your customer goes bust while still in possession of your goods, one of their secured creditors such as a bank – which holds a security over all the customer’s assets – might step in and take your goods because they have registered their security on the PPSR ahead of you. There have been plenty of cases in New Zealand where that has happened, and items such as portable buildings, construction equipment, rental cars, and even racehorses have been forfeited from their owners. Exactly the same situation has occurred in Australia where they adopted a Personal Property Securities Act (“PPSA”) about 10 years after us. The Australian Hire and Rental Industry Association agitated very strongly for lease or hire agreements to be exempted from their PPSA, but were only partially successful. They managed to get the definition of PPS Leases changed so that the minimum term was two years rather than one year, and leases of an indefinite term are not deemed to be PPS leases unless and until they run for a period of more than two years. There are some other exceptions. For example, a PPS lease does not

include a lease or a bailment by a person who is not regularly engaged in that business, nor does it include a bailment where the bailee does not provide any value. A bailment is an arrangement whereby someone has possession of your goods temporarily, but typically they don’t get to use it, and you can take it back at any time. There have been a couple of recent PPS Lease cases in Australia which are of interest, and they are likely to have some application here as well.

FORGE GROUP POWER PTY LIMITED VERSUS GENERAL ELECTRIC INTERNATIONAL INC General Electric leased turbines to Forge Power for a fixed term. Forge Power subsequently went into voluntary administration and liquidation, and General Electric had not registered its ownership of the turbines on the PPSR. The case considered whether General Electric was regularly engaged in the business of

leasing goods in Australia, because if it wasn’t, then the lease would not be a PPS Lease. It was accepted that General Electric was in the business of leasing goods outside of Australia. The Court found that in testing whether General Electric was regularly engaged in the business of leasing goods, you have to look at its activities world-wide. The relevant time to look into those activities was the time the lease was entered into. The question was whether leasing goods was a proper component of General Electric’s business. The Canadian approach was preferred over the New Zealand approach in this case. Frequency or repetitiveness is a factor, and in some cases may be critical, but it is not the only factor. Evidence was led to show that General Electric had leased turbines to various other parties in Australia under various forms of agreement. It was found that there was a PPS lease in this case, and the interests in the turbines vested in Forge Power immediately before the appointment of voluntary administrators. Therefore, Forge Power’s right to the turbines was superior to that of General Electric. This decision was later appealed, but unsuccessfully. The value of the turbines has been reported as being between A$44 million - A$50 million. How’s that for an expensive lesson in PPSR registration?

RE BREDENKAMP; WELLDOG PTY LTD VERSUS GAS SENSING TECHNOLOGY CORP Gas Sensing Technology Corporation (“GSTC”) was the US parent of Welldog Pty Ltd (“Welldog”). Welldog stored equipment on behalf of GSTC in Australia. Welldog went into voluntary administration and a secured creditor appointed receivers. If the storage arrangement was a bailment, and the bailment was not registered, then the equipment would vest in Welldog and subsequently the receivers and/or liquidators. There were three issues in this case: 1. Had the equipment been bailed? 2. Was GSTC regularly engaged in the business of bailing goods? 3. Did Welldog give value for the bailment? It was found that there was an indefinite bailment in this case as Welldog had possession of the

equipment and there was an implied promise to return the equipment on demand by GSTC. The Court rejected the submission that the bailments were a series of short (less than one year) bailments that were not captured by the definition of PPS lease. However it was also found that GSTC was not regularly in the business of bailing goods. It was not shown that GSTC generated revenue by bailing equipment. The bailment allowed Welldog to conduct aspects of its business which resulted in revenue for GSTC as its parent company. These outcomes arose from service arrangements and not the bailment. The court considered that the definition of “value” was that the value must be provided by the bailee specifically for the bailment, and not value provided by the bailee at large. There was no value in this case as Welldog had not paid GSTC for the bailment or provided any financial

benefit sufficiently linked to the bailment. Therefore there was no PPS lease and the equipment did not vest in Welldog immediately before the appointment of administrators and receivers under section 267 of the PPSA. No doubt GSTC breathed a huge sigh of relief, and learned a valuable lesson for the future. ◘

OPERATOR COMPETENCY & REGULATION REVIEWS

W

ORKSAFE NZ attended the recent AGM and spoke to members about the Government’s review of Vocational Education and what impact this may have on the industry. It was noted that the current AcoP is seriously out of date and the NZFIA sought feedback on ways that it could begin a process to identify areas of the AcoP in most need of change and to work with industry to agree on an acceptable interim alternative. This groundwork will not only mean that industry could potentially realize and work to a new industry accepted alternative but would also reference this guidance when the replacement document for the AcoP is drafted over time. A working group will be formed to agree on areas that should be prioritized, before engaging with industry to seek feedback. The plan is to only work on one or two parts at any time. Discussion was held in relation to forklift licensing and it was agreed there is need for change from what is currently in place. The current review of the plant and structures regulation include forklifts but only the plant itself, whilst it refers to operator competency it does not go into great depth. Worksafe advises that the next stage of their review will be high risk work, and this is where competency and licensing of forklift operators will be padded out. It seems highly likely that compulsory licensing of forklift operators may well be one of the outcomes of the review. The Association has a very close working relationship with Worksafe. Effective representation of the forklift industry is a primary objective and members are welcomed and encouraged to communicate as often as possible with the NZFIA should there be any issues, concerns or suggestions. All members were reminded of the consultation, forums and submission process being undertaken by MBIE in relation the Plant & Equipment Regs, thanks to the members who submitted directly and to the group who assist with the NZFIA online submission. ◘

This Equipment Safety Data Sheet is intended as a guide only for the safe operation of this Forklift. It does not override Worksafe NZ recommendations or the manufacturers recommendations or any other industry requirements. You must be a competent qualified person to operate this Forklift. IMPORTANT HAZARDS Danger! Collisions between Forklifts and pedestrians can be fatal! You must have a traffic management plan in place to minimise the risk of collisions between forklifts, goods and pedestrians. Risk of Tipping! Never exceed the load capacity of the Forklift or the maximum slope. Always carry the load in as low a position as possible. Avoid turning with load raised. The Forklift + load must be stable at all times. Always wear your seatbelt! Risk of crush! Never drive with fork blades higher than 150mm above ground. Load must be at lowest possible heights at all times. Risk of injury from falling objects. Identify and secure any objects which might fall. Observe the minimum 3 metre exclusion zone around the Forklift. Ensure Forklift is equipped with Falling Object Protection System (FOPS).

Always ensure terrain is stable and able to support weight of the Forklift + load. Check intended path for obstructions and faults such as pot holes, plastic manhole covers and edges of loading docks. Take care when entering or exiting the Forklift. Always use three points of contact when climbing in or out. Do not leave Forklift unattended when running. Always ensure machine is in "Park" or "Neutral" and handbrake applied. Exhaust gases are poisonous. Never run the engine in confined places, especially when unloading shipping containers. Keep hands well clear of the mast mechanism. Never reach through the Forklift mast. Be aware of rear end swing and risk of rear of forklift striking objects. Exposure to noise louder than 85dB will lead to long term hearing loss. Wear ear protection if noise exceeds 85dB. Diesel or LPG is highly flammable. Turn off the engine when refueling or changing LPG tanks or when machine not in use. No Smoking. Fatigue warning: Do not operate continously for long periods. Never operate this Forklift if you are under the influence of alcohol, drugs, medications or any substances capable of impairing your abilities. Minimum age 18 years.

So, what has been happening at the EWPA? 2019 has been a year of change so let’s start at the start any identifiable initiatives that are common and of benefit to all, a good example of this would be lobbying to government for changes to the Personal Properties Security Act to have hire contracts removed from the Act which is highly beneficial to each industry Association due the high percentage of rental in each sector. NEWLY ELECTED BOARD MEMBERS This year’s board elections have seen changes at the top! Newley elected board members are Neil Radley (Rich Rigging) and Jason McAllister (LiftX), it is great to see growing interest from members wishing to join and participate at board level. We farewell Robert Molynuex and Andrew Messent who have been longstanding board members and great advocates of the EWPA. SHARED RESOURCE MODEL Three Association’s (EWPA, HIANZ and NZFIA) have now agreed on the structure and funding of a shared administration resource model which includes staffing, industry advocacy & marketing, and membership initiatives. This is great news for all members who will see an increase in activity in these areas moving forward. It is important to note that each Association will maintain their independence in terms of governance structure, constitutions, financials and core business activity. The new model is a smart choice and will mean streamlining commonly used systems and activities to create greater efficiencies. The Associations will share PAGE 38

Association’s will review and discuss their experiences and expectations on an annual basis, to ensure members continued to receive value from the investment. REGISTERED INSPECTOR PROGRAMME The EWPA has introduced the Registered Inspector Programme. This is a national initiative whereby EWP inspectors are formally assessed to ensure they possess the level of experience and expertise required to undertake 6 month and/or major inspections of Mobile Elevating Work Platforms as required by the Australian Standard AS2550.10. This Standard, and the New Zealand EWP Best Practice Guidelines for MEWP state that only a Competent Person can carry out 6 month and/or major inspections. The RI Programme sets an industry benchmark. The application process seeks evidence related to the maintenance of high skill levels, industry knowledge and experience. The EWPA suggests that owners of EWP’s should only use service providers who have ‘Registered Inspectors’. For inspection companies, the RI Programme enables them to genuinely differentiate themselves from the

cowboys! If you are in the business of EWP inspections, find out more about the Registered Inspector Programme and associated benefits on the EWPA website. SAFETY VIDEOS The EWPA has developed a few safety videos that provide good education and clarification to industry. I encourage people to take a moment to acknowledge the great people behind these projects.” McConnell Dowell won the ‘Projects with a value of between $20M and $100M’ category with its Army Bay Ocean Outfall project at Shakespeare Regional Park - a project which resulted in the world’s longest pipeline built using trenchless tunnelling technology at 1.9 kilometres. Higgins Contractors won the ‘Projects between $5M and $20M’ category for its Watchman Road Roundabout and airport intersection project in Napier which created a safer intersection with special regard for an adjoining wetland. HEB Construction was also highly commended in this category for its work extending the wharf at Port Otago - a project that required deep pile driving around a ‘minefield’ of underwater boulders. Fulton Hogan won the award for ‘Projects up to $5M - larger companies’ for the Wynyard Quarter Pump Station - a 14-metre deep wet well pumping station situated in the heart of Auckland which required innovation to work at depth well below the water table.

The award for ‘Projects up to $5M smaller companies’ went to Concrete Treatments NZ for restoring the South Karori Stormwater Culvert in a project which replaced rusting corrugated iron tunnels underground with a new geopolymer lining. Canterbury-based Rock Control was highly commended in this category for its work stabilising a 100-metre cliff face above the highway and rail lines south of Kaikoura following the earthquakes which devastated the region. The award for excellence in the maintenance and management of assets went to HEB Construction for its work maintaining 2,600 kilometres of roads across the Selwyn District with excellence and significant cost savings thanks to extensive use of data. Civil Contractors New Zealand Chief Executive Peter Silcock said these awards represented important

recognition, not just for the skilled people who worked on planning and construction of these projects, but also for the excellent outcomes they brought to local communities. “It’s important we take the time to recognise a job well done. These projects are vital for the economy and wellbeing of their communities. RAINING IS NOW an essential part of each business operating with the sector, the BPG states that proof of training and competency is a site requirement. Basic and Advanced Training Courses were run in August and September and it was great to see the level of interest from members with a total of 28 joining the new APEX program. 2020 courses will be scheduled and added to the events calendar of the website. Phil Tindle and Greg Ward have attended numerous meetings with key stakeholders, including presentations to the New Zealand Building Officials (BOINZ) Conference in Wellington and more recently meeting with Auckland Council and New Zealand Fire Service.

Keeping An Eye On Health And Safety Performance From The Board Table

O

NE OF THE MOST significant changes in the Health and Safety at Work Act (HASWA) was the introduction of a positive duty of due diligence on a PCBU’s officers (person conducting a business or undertaking). Board members and senior leaders must now exercise the care, diligence and skill that a “reasonable” officer would exercise to ensure their business complies with its duties and obligations under HASWA – including eliminating or minimising risks to workers and others so far as reasonably practicable. One of the ways officers can ensure their business is meeting its duties is to require and consider meaningful indicators and metrics about health and safety performance. Lost time injury rates (LTIs) have historically been central to this process although it is now widely accepted that a broader range of measures is useful. Focusing

on LTIs might drive perverse and unintended outcomes (e.g. under-reporting) and fail to provide sufficiently relevant, robust and timely information on the state of health and safety in a business.

Safe Work Australia has also published guidance about measuring and reporting on work health and safety to assist officers effectively meet their due diligence duties. ◘

The NZ Business Leaders’ Health & Safety Forum has produced a useful guide for leaders on identifying critical health and safety reporting indicators.

EXECUTIVE TEAM CHANGES AT ELB EQUIPMENT

E

LB EQUIPMENT has enjoyed extraordinary growth in recent years in both the Underground Construction and Waste Equipment sectors. To ensure they continue to offer exceptional customer support ELB Equipment has announced changes to their executive team. New Zealand General Manager John Grant has been appointed to the newly created role of Parts & Service Director tasked with leading the after-sales support functions of the business throughout Australia and New Zealand. This will mean that John will be relocating to ELB’s Head Office in Sydney and will commence his exciting new role from the beginning of next year.

“I have enjoyed a long and personal relationships with many people in the industry and will miss the interaction and friendships. However, I will remain closely involved in the ELB business and feel confident and proud of the legacy that I leave behind,” says John. “I am excited to announce the appointment of John Familton to the role of General Manager for ELB Equipment Ltd (NZ). John is well known in the industry and brings a wealth of skill and knowledge to the role and will add considerable management strength to our NZ operation.” John Familton will join the ELB team in September and will continue to support ELB Equipment’s existing customer base with his extensive

knowledge and experience. ELB is committed to maintaining its position in the market with its vast range of tooling, consumables and spare parts from Ditch Witch and Cetco and including Radius - now with an added range available According to John Grant it is important that ELB continue providing action ready solutions and support services. “We are making a commitment to support not only our renowned Orange Iron but also support solutions for Vermeer, Astec and Toro machinery.
