GREETINGS FROM THE KAPITI COAST After such a wet winter and with spring on the back-door step, here’s hoping things will dry out a little, motivating people to get out and get all those jobs done in that mad dash leading up to Christmas! Thanks to all those delegates and suppliers who attended conference in Blenheim this year. What a fantastic event. The feedback we have received via the post conference survey has been extremely positive. Areas for improvement have been noted for next year. Taking the conference to the regions is done with a little trepidation but thanks to your support the event was a huge success. Congratulations to all the Hire Excellence Award recipients. I commend you all in having the conviction in your business, systems and team to enter. Comments from previous entrants has taught us that the awards are a great learning experience. The feedback you have received from the judges if put into practice will provide your business with real tangible benefits.

Strategic planning is a focus for the board at this time each year, a considerable amount of time has been set aside at the November board meeting to review the past year and to look at the long-term goals of the association and how they will be bought to fruition within the budget required to execute them. Christmas networking functions are being held in November, and by now you will have received an invite to 9 holes of golf in Taupo or Christchurch. The idea behind this event is simply to have a fun afternoon and catch up with some industry mates prior to Christmas. I am really hoping this will be well supported as we could then have three events spread evenly across the HIANZ calendar. I will be attending both events and look forward to seeing as many of you there as possible. HIREPOOL BUYS BIG GENIE FLEET Hirepool has recently taken delivery of over 60 new Genie elevated work platform machines that according to Gary Richardson, General Manager of Sales and Marketing was a complete no brainer for the company.

MIKE O’NEILL AWARDED LIFE MEMBERSHIP AWARD

M

IKE O’NEILL was awarded Life Membership of the Hire Industry Association of New Zealand, at the Hire Excellence Awards held in Blenheim on the 25th July 2017.

He gave so much time and energy to the association and worked hard to stimulate our industry at every opportunity

Mike formerly owned and operated Cambridge Hire. Mike began his commitment to the HIANZ board in 1998 as Zone 2 director. His tenure spanned 11 years until 2009. Mike was instrumental at the time the Association moved from volunteer zone committees to the recruitment of a full time CEO. Giving freely of his time and with the well-being of the association always front of mind, he, along with the help of a business colleague, ran the financial affairs of the association after losing three CEO’s in a very short space of time. Thanks to his commitment, dedication and optimism, he was a prime mover in assuring the association remained operational and financially viable during those tough times. PAGE 6

HIRE INDUSTRY CONFERENCE A STUNNING SUCCESS This year’s Hire Industry Association of New Zealand (HIANZ) conference clocked up record attendance, with the industry having enjoyed many positive years and strong growth.

A

TOTAL OF 270 hire company owners, managers and staff, as well as equipment and service suppliers to the industry from New Zealand and Australia attended the stimulating and informative event held in Blenheim in late July. Attendees enjoyed an extensive programme of workshops, guest speakers, trade show, and networking opportunities. The conference was an opportunity for business owners, CEO’S, senior managers and employees to get together in a neutral, fun environment to discuss industry trends and legislative issues, talk with suppliers, attend workshops and catch up

exhibitor companies, displaying a good range of products and equipment. This year, there were a lot of new members at the trade show with new supplier companies impressing delegates with innovative enhancements to products in existing equipment categories. Guest speakers at the conference included business leader and sportsman Mark Weldon, and television personality and stand-up comedian Ben Hurley. with old friends. The conference also provided hire company delegates with educational material and an overview of the Association’s current and future initiatives. It was held at the Marlborough Events Centre, in Blenheim, a purpose built facility, amidst world-class scenery, and an excellent, spacious venue for the conference. Organisers were thrilled at the record turnout, which reflects the strength of the hire industry and the relevance of trade organisations, says HIANZ CEO, Phil Tindle. “The value of trade associations is hugely significant. Increased workload often results in less time for businesses to focus on planning and administrative functions. Less time can also make it difficult to access reliable and relevant industry support and services. HIANZ are dedicated providing valued resources to the industry.

Business sessions and workshops were presented by Lucy MacLean on Recruiting, Motivating and Retaining teams; Westpac chief economist Michael Gordon, on State of the Nation; Stewart Kearney from “Good for Business” on Return on your Investment; and Claire O’Connell from “The Classroom” on Social Media in Business. Amongst all the hard work and business networking, there was plenty of time for fun, and the pre-conference Marlborough Sounds Cruise was a stunning success. “It brought delegates and suppliers together for a wonderful afternoon of spectacular sightseeing, seafood and wine tasting. It was an absolutely stunning event.”

Aviation Heritage Centre, which features vintage aeroplanes and exhibits from World War II. “Holding this event amongst the vintage aeroplanes and war exhibits was just magic. It was a very special place to be.” Also very popular was a fancy dress event sponsored by Skyjack and held in the magnificent location of the Wither Hills winery. ◘

PARTY UP OPENS NEW STORE Party Up, the Manawatu’s premier event and party hire company has recently opened a new purpose built store in Palmerston North.

L

OCATED ON the corner of Milson Line and Maiden Street the new facility offers everything you would ever need for a wedding or special event including everything from marquees to essential catering requirements. “The building has only been opened a few short months but the response to date has been nothing short of positive,” says Richard Mikkelsen who along with wife Michelle are partners in the Party Up business. “The product range in our warehouse is very extensive and can accommodate a wide range of both large and small items of equipment. We also now have a bigger showroom area where customers can browse through a variety of ideas and options,” says Richard. “As well our carpark makes it

much easier and convenient to pick up and drop off any hired products no matter what size.” The new premises are a far cry from the early days going back to when John and Susan Mikkelson who owned City Hire Centre saw an opportunity to hire out party equipment in conjunction with their other product offerings. They purchased the house next door to the business and converted it into a party hire showroom storage facility and installed a commercial dishwasher. In 1984, John’s son Richard joined the company and started working in the party hire division. In 1995 City Hire Centre along with the party hire division moved to Rangitikei Street. A year later Richard and Michelle bought the party

business and have continued to grow the legacy ever since. In 2005, the company started a Christmas store within the showroom area which has quickly become a worthwhile and profitable division of the company.

“The industry has certainly changed over the years particularly with the birth of the internet which has opened up competition nationally and internationally,” says Richard. “We still however firmly believe that the ‘hands on’ personal approach is winning us customers especially when we hire a fully blown marquee for a wedding. All things being equal with the fantastic staff we have working alongside us we are looking forward to the years ahead.” John Mikkelsen celebrated his 80th birthday in April this year. He still calls in at Party Up for a coffee and to share a joke. Susan is still active, fit and enjoying retirement. 2019 marks the 50th anniversary from where it all began back in 1969 when John and Susan Mikkelsen purchased a machinery business, City Hire Centre in Palmerston North. T ALL BEGAN in a small rented workshop on Glover Road in Hawera when Gareth Boyd opened Hire Smart in October 2006 to meet the South Taranaki demand for heavy machinery hire. Starting with a small hire fleet of diggers, trucks and trailers, Gareth employed one full time staff member. By 2010, an established customer base saw Hire Smart too small for its Glover Road facilities so Gareth purchased a 2 acre property on Kerry Lane in Hawera. He fully developed the site from a paddock into a purpose built yard offering ample space to build a fully equipped, multi-purpose and multi-bay workshop, safe indoor and outdoor working environment with functional facilities for his staff and customers and space to accommodate an expanding hire fleet. To meet demand, Gareth has upgraded and expanded his hire fleet and now employs three full-time workshop staff, a full-time delivery driver and an office manager. Hire Smart hires out a diverse range of heavy machinery and equipment to customers Taranaki wide who are working within a wide variety of industry and private enterprise. More recently, Gareth has been purchasing quality branded diggers, loaders and bulldozers with low running hours directly from Japanese suppliers to sell, at affordable prices, on the New Zealand market.

2015. In June 2016, Vaughan Maaka from WorkSafe NZ conducted a voluntary assessment of Hire Smart’s facility and recording protocols. Vaughan identified inconsistent reporting of machinery maintenance. Discussion with Gareth highlighted the inefficiencies of managing and recording maintenance and servicing activities using pen and paper. Not to mention, ensuring the paper stayed clean and writing legible in a working mechanical and engineering environment. The Health and Safety recording requirement is that whenever a machine or piece of equipment is observed or handled to check for safety and/ or maintenance or servicing - a detailed record of the activity and subsequent actions must be archived and available for inspection. At this point, Gareth proposed the idea of an electronic maintenance recording App. Receiving positive feedback about the Apps potential, Gareth approached colleagues and peers from within the heavy machinery hire industry for further information and feedback. These companies also used cumbersome pen and paper recording systems and encouraged Gareth to develop the App. Thus, Gareth contracted New Plymouth based Efinity Digital to work with him in its design.

Managing Hire Smart’s health and safety requirements are a top priority for Gareth. While arduous, over the last 4 years he has invited and welcomed WorkSafe NZ and ACC workplace safety audits. The audits identify any gaps in Hire Smarts’ health and safety compliance protocols, thus supporting Gareth and his staff to fulfil their obligations under the Health and Safety at Work Act

The ‘Asset Smart Service App’ has been designed specifically to transform multi-handled pen and paper service and maintenance protocols into one seamless electronic system. Providing optimal functionality, the App is user friendly, fully interactive and designed to work on any smart phone, tablet or PC either on WiFi or mobile data. All information is digitally archived within

What You Should Know About the WANNACRY Ransomware Attack On May 12, 2017 computers around the world were hit with the largest ransomware attack ever. As of noon Central Time on May 15, 2017 the attack has hit over 200,000 computers in 150 countries, including New Zealand, within 24 hours. What Happened? A form of ransomware called WannaCry (also known as WannaCrypt, WannaCrypt0r, Wcry, and Wanna Decryptor) began spreading on May 12, 2017. Investigators initially thought the malware was introduced into computer systems through phishing attacks. Now the method of introduction is unclear. Once in a computer system, the malware spreads easily to other computers because it takes advantage of an exploit developed by the US National Security Agency called EternalBlue that makes use of a vulnerability in the Microsoft Windows operating system. WannaCry encrypts files on a computer and demands payment of a $300 ransom in Bitcoin to decrypt the files. The ransom increases to $600 if the $300 is not paid within three days. If that is not paid within seven days the files are permanently lost. Here is a screen shot of what an unfortunate user sees when the ransomware is launched:

What Should a WannaCry Victim Do? As with most ransomware attacks that encrypt files, victims of WannaCry are left with the choice of restoring the encrypted files from backups or paying the ransom. They must also eradicate the malware from all computers. Law enforcement authorities are encouraging victims not to pay the ransom because it will show cyber criminals that attacks like this one are successful.

Authorities are also referring victims to https://www.nomoreransom.org/ for advice on how to prevent and recover from ransomware attacks.

What Should Companies Do to Avoid Becoming Ransomware Victims? There are several steps a company should take: • Patch systems regularly. As vulnerabilities come to light companies like Microsoft quickly issue software patches that resolve them. The patches typically will not be automatically installed, so companies need to put procedures in place to ensure that they learn about and apply patches on a regular basis. • Back up systems regularly. A ransomware attack can be quickly resolved by restoring the encrypted files from backups. Backups should be kept on a different system so that a ransomware attack cannot encrypt the backup. • Install and conscientiously update antivirus software. • Train employees to recognize phishing attempts to minimize opportunities for ransomware to enter computer systems. • Ensure that the company has an incident response plan to follow when a ransomware attack takes place.

When the attack occurs a company must investigate what happened and take the necessary steps to end the event. Unlike the ransom demanded by the WannaCry ransomware, the costs incurred to evaluate and resolve an attack can be significant. Those costs can be covered under a good cyber policy. They may also be covered under a kidnap and ransom policy. Unfair Terms In Standard Form Contracts – How Does This New Law Affect You? By Geoff Hardy of Auckland law firm Martelli McKegg

A

CONTRACT IS A BARGAIN struck between two or more parties. It does not matter whether it is written or unwritten, our law will enforce it provided certain basic criteria are satisfied. Usually that is the case regardless of how one-sided or unfair it may be. The law respects the freedom of the parties to negotiate their own terms and, with limited exceptions, it will allow a party with greater bargaining power to drive a hard bargain. After all, weaker parties don’t have to enter into the contract if they don’t want to.

There are some exceptions, of course, and they generally apply to the more vulnerable members of society such as employees, residential tenants, household borrowers, and consumers. There are Acts of Parliament that prevent you from inserting certain provisions into contracts (for example, price-fixing agreements between competitors are banned by the Commerce Act 1986). There are other Acts that automatically insert certain provisions in contracts whether you like it or not (for example, the guarantees that are implied into contracts for the supply of goods or services to a consumer, under the Consumer Guarantees Act 1993). And finally there are Acts that allow a Court to re-write a contract or delete certain clauses from it (like the Fair Trading Act 1986). The Fair Trading Act was modified in March 2015 so that unfair contract terms in standard form contracts could be struck out. That immediately raises the possibility that contracts in common use in the hire industry might be vulnerable. After all, the industry relies on the use of standard-form hire

contracts. Plus, the major equipment and appliance suppliers all use terms of trade that are largely non-negotiable. Could someone who signed such a contract later ask a Court to change the ground rules? Well for a start, they can’t do it themselves. They have to persuade the Commerce Commission to do it for them, and the Commission is only going to bother to do that in the most deserving cases that are going to have the most widespread impact. What happens is that the Commission applies to the Court for a declaration that a term in a standard form consumer contract is an unfair contract term. The Court will only do that if it is satisfied that the term is in a consumer contract, the contract is a standard form contract, and the term is unfair. What is a consumer contract? It is a contract for the supply of goods or services between a supplier (in trade) and a consumer (for example, a hire agreement with a private individual), or a contract for the sale of an interest in land between a seller (in trade) and a purchaser who is buying for personal, domestic, or residential purposes (for example, the sale of a spec house). Who is a consumer? It is a person who acquires goods or services of a kind ordinarily acquired for personal, domestic, or household use or consumption, and doesn’t do so for the purpose of resupplying them in trade, or consuming them in the course of a process of production or manufacture, or repairing or treating (in trade) other goods or fixtures on land. What is a standard form contract? It is a contract in which there hasn’t

been a realistic negotiation between the parties over the terms. The Court will look at whether one of the parties has all or most of the bargaining power, whether the contract was prepared before any discussion relating to the transaction occurred, whether it was presented on a takeit-or-leave-it basis, and whether it catered for any party’s special needs. If the Commission alleges a contract is standard form, the onus is on the other party to prove that it isn’t. And what is an unfair term? It is a term that would hugely favour one party over another, that is not reasonably necessary in order to protect that party’s legitimate interests; and would cause hardship to the disadvantaged party if it was applied, enforced, or relied on. “Transparent” terms are less likely to be unfair, as distinct from those that are buried in fine print and not brought to a party’s attention. This law is most likely to be used against dominant suppliers with substantial market power such as utility companies, banks, big retailers, software suppliers, and insurance companies. But terms in insurance policies are not likely to be considered unfair if they simply define the risk, specify the sum insured, contain exclusions or limitations of liability, impose an excess or deductible, require a premium to be paid, or require absolute honesty or full and frank disclosure. So while most insurance policies are likely to be standard form consumer contracts, there is less scope to argue their terms are unfair. ► continued over...

Unfair Terms In Standard Form Contracts – How Does This New Law Affect You? ◄ The terms in standard form consumer contracts that are particularly vulnerable are those that give extremely powerful rights to one party or impose extremely heavy restrictions on the other, but those rights and restrictions aren’t applied equally. The hire contracts that most hire companies use, and the terms of trade of the equipment and appliance suppliers, are full of those sorts of terms - in fact they typically contain every one of the 13 examples of unfair terms that are listed in the Fair Trading Act. So most hire companies are very exposed to a potential challenge under the Fair Trading Act. However most suppliers can breathe easy – unless they are selling to the DIY market, their terms of trade won’t be consumer contracts. That is because their customers are usually hire companies who use the equipment and appliances for the purPAGE 30

pose of resupplying them in trade. It is different in Australia. They have a similar unfair contract terms law, but they recognise that smallmedium companies are just as powerless against the large suppliers as consumers are. So their law covers small businesses that employ less than 20 people and where the contract price is $300,000 or less (or $1m if the contract is for more than 12 months). The Australian law has already been very effectively enforced by the Australian Competition and Consumer Commission (“ACCC”). The ACCC first examined 46 standard form contracts across seven industries and published a report of their findings in November 2016. They then contacted the major players in those industries, many of whom voluntarily agreed to remove the offending provisions from their terms of trade. When one major waste

management company refused to do so, the ACCC applied to the Federal Court in September 2017 for an order that eight of their contract terms were unfair and therefore void. COMPLIANCE REMINDER FOR PORTABLE TOILETS In this issue we cover transporting of portable toilets, the information below highlights the responsibilities of all companies and persons involved in the commercial provision of portable toilet services, irrespective of the volume of waste or number of toilets transported. INTRODUCTION

PLACARDING & LABELLING

PLACEMENT OF PLACARDS

The transport of hazardous wastes is a high-risk activity which can attract a high public profile. Wastes generally do not present the same degree of hazard as the “new” hazardous substances from which they arise. Most liquid waste will be much less concentrated than the material it was derived from. However, waste is likely to contain a greater range of contaminants than the raw material. The transporter must therefore ensure that the risks associated with waste collection and transport are addressed, and that the public and emergency services have adequate information to ensure public safety, should an incident arise. Hire companies operating portable toilets must:

Portable toilets containing human wastes are classified for transportation as Division 6.2, infectious substances. These wastes may contain pathogens that cause human disease, but they are unlikely to pose a serious hazard. They are classified as Category B infectious substances, UN number 3373.

Vehicles used to transport portable toilets require placarding as follows:

• abide by the Land Transport Rule: Dangerous Goods 2005 and the Land Transport Rule: Dangerous Goods Amendment 2010; (collectively referred to as ‘the Dangerous Goods Rule’) and • refer to New Zealand Standard 5433 - The Transport of Dangerous Goods on Land, which is incorporated by reference into the Rule. The transporter must comply with the full placarding requirements for the cartage of infectious substances as set out in the Dangerous Goods Rule and NZS 5433 Transport of Dangerous Goods on Land, Appendix F, as follows: • each portable toilet shall be labelled and marked in accordance with Section 4 of the Dangerous Goods Rule; • all vehicles, portable toilets and containers used to transport infectious effluent and sludges shall be transported as dangerous goods, whether full or empty; • they shall remain appropriately placarded; • the dangerous goods declaration shall be carried whether the toilets or containers are full or empty, and shall correctly describe the load and the quantity of waste product; and • if the vehicle is carrying empty portable toilets or containers, this shall be shown on the documentation.

The required label to be placed on at least three sides of each portable toilet.

• the minimum size for placards on both sides and the rear of a tank wagon is 400mm; and • the Class 6.2 placard on the front of the vehicle is to have a minimum edge of 250mm.

If placards of the minimum size do not fit due to the design of the vehicle, then smaller placards may be used; however, these shall be as large as practicable and comply with the following requirements: • be clean and visible; • be unobscured and positioned on a contrasting background; • include the proper shipping name, legible from 10 metres; and • ensure the nature of the load is identifiable from 25 metres in daylight. • When portable tanks or other bulk containers are used for carrying portable toilet effluent the placards shall be: • at least 250 mm measured along any edge; and • be displayed on opposite sides or front and rear. • All vehicles shall be placarded as per the requirements of the Dangerous Goods Rule and NZS 5433:2007 Transport of Dangerous Goods on Land, Appendix F.

Post advertising equipment or special offers shouldn’t account for more than 25% of your total posts, especially while you are building your audience. Your Facebook page should not be the place for angry rants, political statements or explicit language, unless of course you especially want to depict your organisation as angry, extremist or foul mouthed. You should think about your Facebook page as your virtual shop counter, and that you are simply having a casual polite conversation with your customer. Always include interesting comment 2. A PICTURE IS WORTH A THOUSAND WORDS, A VIDEO A MILLION. There are a few websites which provide an excellent source of stock photos (see Pixabay) but local photos will be more attractive to your audience. Try and take photos from the same height as your subject (a photo of a new lawn mower look better at knee height than from a birdseye view) and ensure there are no visual distractions in the background. Always frame your photo and leave plenty of room around the edges to crop the picture.

3. SOME SMART GRAPHIC DESIGN

The Facebook community is becoming more discerning and video content is now gaining prominence. Facebook offers the opportunity to create a video slideshow using up to 10 pictures, which is more eye catching. A well-executed video from your mobile phone is also suitable for Facebook posting, especially if you can provide captions.

An Australian website Canva (www.canva.com) offers free cloud-based graphic design including an option to create Facebooks posts automatically sized to the correct dimensions. It also allows for the inclusion of company logos and custom colours. Canva can also provide stock photos for US1.00 each.

Of all the obstacles of social media, obtaining enough high quality photos or videos is perhaps the biggest challenge.

Bitly also provides a quick comparison between various links to show which posts are the most popular. 5. CALL TO ACTION Your Facebook posts should always include a ‘call to action’ such as ‘click here for more information’ or ‘call us now to make a booking’. If you have done your job well, the viewer will be excited and want to buy immediately. 6. PROMOTE YOUR FACEBOOK POSTS Facebook affords you the opportunity to specify an audience depending on several factors, but perhaps most importantly within a set distance of your business. You can specify interests, such as DIY or gardening, or occupations such as building and construction. Posts should run for 2-3 days, with a cost of only a few dollars per day, depending on the size of your desired audience. Calculate a monthly budget and stick to it. A monthly budget of $100 - $300 for a small – medium sized hire business is probably a good ball park starting point. Digital Media marketing should be attempted on a ‘suck it and see’ basis to work out what types of posts are most appealing to your target audience. Within a few weeks both positive and negative trends should start to appear and you’ll soon be well attuned to your target audience. ◘
