The Steve Madden Steal The eco-friendly Stella McCartney and Steve Madden have run into a legal dispute over the copyright infringement of the McCartney it-bag Falabella.. Madden is not surprised.
It appears that it is not only us mortals who wish Stella McCartney’s it bag, Falabella was cheaper, Steve Madden does too. The difference between him and us is that he made his dream a reality, and now the duo are heading to court. Stella McCartney, the daughter of The Beatle Paul McCartney is currently suing the American footwear and accessories brand Steve Madden in New York for copying her iconic bag Falabella, or what Steve Madden refers to as the BTotally bag. Maddens tote go for $108 whereas McCartney’s top selling bag goes for roughly $1,195. The tote is a blatant steal in comparison to the original, but similarly it’s a steal to pay over $1,000 for a tote. Plenty of celebrities have been willing to pay the price for the it-bag such as Anne Hathaway, Jennifer Garner and Jenna Dewan-Tatum, living up to it’s hyped status as an it-bag. WWD revealed that the charges made include “trade dress infringement, unfair competition, deceptive trade practice, trade dress dilution, and design patent infringement” involving the “marketing and sale of a knock-off.” But this is not the only copyright infringement committed by Madden. In 2009 Balenciaga sued Steve Madden for “copyright infringement, trademark infringement, false designation of origin and unfair competition” of the Steve Madden Lego shoes. Just last year Balenciaga sued the designer a second time, for copyright infringement of the Balenciaga Motorcycle bag. Alexander McQueen is another top designer known to have filed a lawsuit against Madden for copying shoes. According to an interview conducted by FASHIONISTA with Madden, he is surprised that he hasn’t gotten sued more. Hats off to Madden’s lawyer, they must have a handful to do.
