The long awaited National Planning Policy Framework (NPPF) was published on 12th December 2024. As expected, the final version retains many of the proposals put forward in the Summer consultation and sets a clear and ambitious plan for growth.
In this article we summarise some of the key areas of change in the NPPF covering a number of topics including:
•Boosting housing supply;
•The presumption in favour of sustainable development;
•The Green/Grey Belt;
•Brownfield land; and
•The sequential test; and Renewable energy.
Boostinghousingsupply
The Standard Methodology (SM) used to calculate local housing requirements has been amended and broadly aims to achieve planning permission for 370,000 no. homes every year across England. It is hoped that this will enable the actual delivery of 300,000 no. homes per year, which is a crucial target in meeting the Government’s goal of delivering 1,500,000 no. homes over five years.
The requirement for all LPAs to maintain a five year housing land supply (5YHLS) is reinstated, with all references to 4YHLS removed. Where Local Plans are out-of-date, the NPPF confirms the new SM will provide the basis for calculating 5YHLS requirements with immediate effect. This will inevitably lead to an increase in those local planning authorities (LPAs) unable to demonstrate a 5YLHS, triggering the presumption in favour of sustainable development, and an increase in speculative planning applications for new homes in those areas.
In most cases the new SM must be used by LPAs when preparing new Local Plans, with a clear expectation that the requirement is met in full. The NPPF does allow certain exceptions to this rule. For example, where an emerging Local Plan has reached at least Regulation 19 consultation stage by 12th March 2025, it may continue to apply the previous version of the SM if it equates to at least 80% of the new SM requirement.
Thepresumptioninfavourofsustainabledevelopment
The presumption in favour of sustainable development remains a key feature of the NPPF. There is, however, a minor change to the wording for how the presumption is to be applied when relevant policies are out-of-date. In such circumstances LPAs are still required to grant planning permission for new development, unless the adverse impacts of doing so would significantly and demonstrably outweigh the benefits when assessed against the NPPF when taken as a whole. However, the updated version now also requires LPAs to pay particular regard to directing development to sustainable locations, making effective use of previously developed land, good design and the provision of affordable homes.
This is seemingly a minor change but is perhaps a helpful point of clarification over how the presumption is to be applied.
The new NPPF includes significant changes to Green Belt policy, most notably through the introduction of a new ‘Grey Belt’ classification. The Grey Belt is defined as land within the Green Belt comprising previously developed land and/or land that does not strongly contribute to the purposes of the designation. Qualifying land will be deemed suitable for development where there is a demonstrable unmet need for the type of development proposed (e.g. where an LPA cannot demonstrate a 5YHLS) and where certain ‘Golden Rules’ are satisfied, including:
•The provision of adequate affordable housing (up to 50%);
•The provision of necessary improvements to local infrastructure (e.g. highways, education contributions); and
•The provision of new or improved publicly accessible green spaces.
There has always been broad support for the development of previously developed (brownfield) land in the NPPF. However, the new version takes this support a step further. Firstly, it makes clear that development on such land within settlements ‘should be approved unless substantial harm would be caused.’ Secondly, the definition of previously developed land has been expanded to include large areas of fixed surface infrastructure such as hardstanding. These are helpful additions that should boost the delivery of development on previously developed land.
The NPPF now includes a helpful clarification as to how the Sequential Test (ST) is to be applied in the context of new development in areas affected by flood risk. In a win for common sense, the ST should not be applied unless built development is proposed on land that is at risk of flooding. Areas proposed as open green space, BNG or other uses that do not require built development in areas at risk of flooding will no longer trigger the ST. This is a welcome point of clarification.
As per the consultation draft, the new NPPF removes the effective ban on onshore wind developments. Wind energy developments are therefore placed on an equal footing with other forms of renewable and low carbon energy, which are afforded greater support in the new NPPF.
Overall it is clear that the new NPPF presents an ambitious plan for growth. Together with the updated SM we will see housing requirements for most LPA areas increasing and an expectation that emerging Local Plans must aim to meet those requirements in full. Although the NPPF seeks to incentivise LPAs to get up-to-date Local Plans in place, we can expect to see an increase in the number of LPAs without a 5YHLS for the foreseeable future while those new plans are prepared.
