SUTTONS BAY GRADUATION POWWOW

The Suttons Bay Graduation powwow was held on Friday, May 17th to honor recent graduates of Suttons Bay High school. The event was guided by many GTB Tribal members and elders. Tribal Chairman McClellan and several other members of GTB Tribal Council also attended to show their support for these graduates. Post 120, pictured above, posted the flags for the event and former councilor Tom Shomin Emceed the function.

Congratulations to all those Graduating young adults. Best of luck on your future endeavors. We look forward to seeing your work in the future.

Congratulations to the Class of 2019 GRADUATES! I wish you all the best in life with your education goals, family, and all the adventures life has to offer! There’s a great big world out there and my hope is that you will not limit yourself but rather have the courage to achieve your most advantageous dreams! Graduation season also means the start of summer so I encourage everyone to spend some time outdoors as nature can be good medicine. As I’ve said many times before, we are so very blessed to live in north country where we are surrounded by nature’s bounty. The fresh air, trees, and water carry Ancestral power that can rejuvenate us by simply listening, watching, and taking in our surroundings. Take in some sunshine while you can as we all know these short summer months will go by quickly!

Happy Father’s Day on June 16th! One of the highest honors in my life has been the title of “dad” as fatherhood has been one of the biggest joys in my life. I hope you all get to enjoy the day celebrating all the dads and special people that have stepped in those fatherhood roles; stepdads, uncles, grandfathers, etc. Each family is unique, so may you celebrate the specialness of your family on this occasion.

As you will see further in this newsletter, the March membership meeting questions have been responded to. Miigwetch for all the questions/comments as we work together to improve services and strengthen our Tribal Nation on many levels. There were many highlights of the membership meeting and I thank those who worked hard to make it a special time and to all who attended. I would like to bring attention to the importance of safety and respect which should be mutual when we come together. It saddens me to think about the poor choices made by some tribal members at the March membership meeting held at the Grand Traverse Resort and Spa. It is never okay to intimidate or threaten anyone under any circumstances. There will be policies put in place for all future meetings that attendees will have to abide by to participate. I will not go into details on the situation; however, please know that Tribal Council is taking the situation seriously and addressing it with the person(s) involved. This is not a political issue; this is a safety issue.

The Grand Traverse Band is addressing policies and procedures across the board regarding safety for all tribal members and GTB employees in the workplace. It is the goal for all Grand Traverse Band employees to feel safe in the workplace and to know what to do if they are a victim and/or witness of any type of mistreatment, including being the victim of a bully. The term “bully” may sound elementary; however, the characteristics and acts of a bully can be seen in adult lives as well. The levels of harassment from a bully may vary but please know we take very seriously any act of mistreatment.

The women and children in our community are sacred and should always feel safe and respected. Our children need to see us demonstrate mutual respect towards one another regardless of differences. It is never okay for any type of violence whether it be physical, emotional, verbal, etc. In the best interest of our future generations, we must work together to break the dysfunctional cycles of abuse on all levels. It is my hope that our children will learn what healthy communication/relationships look like and how to deal with conflict in a safe and effective way, so their standards are not compromised as adults.

We as a Tribe are steadfast on upholding our zero-tolerance policy for any type of violence and/or harassment in the workplace. We appreciate the courageous people that have stepped up to speak out on mistreatment.

Equally important, if you witness mistreatment or something that just doesn’t seem right, please bring it to the attention of someone that can act on it appropriately. It is my hope that we can break the dysfunctional cycle of abusive behavior because it will not be tolerated at GTB. GRASP

GRASP is a summer math and reading program for children completing K - 8 th grade. The program seeks to help students retain skills learned during the past school year by providing review exercises.

GTB students may do one, or both subjects. Orientation sessions will be held at each classroom in June.

College for Kids classes are offered each week, June 17 through August 16, 2019. 

Parent/guardian will register each student (4-17years old) on the College for Kids webpage.



Students may enroll for more than one class - the total GTB payment/reimbursement per student is $150



Transportation will not be provided for College for Kids programming

SUMMER FUN DAYS All students, entering 1st – 8th grades who participate in either GRASP or College for Kids may attend 4 Summer Fun Days between June 25 th and July 31st. Students can submit and receive help with their GRASP work, have lunch, and enjoy fun summertime activities.

The Grand Traverse Band of Ottawa and Chippewa Indians now asserts Special Domestic Violence Criminal Jurisdiction as outlined in the 2013 Violence Against Women Act. This law recognizes tribes’ inherent power to exercise “special domestic violence criminal jurisdiction” (SDVCJ) over certain offenders, regardless of their Native or non-Native status. All individuals with sufficient ties to the Tribe who commit acts of domestic violence, dating violence, or who violate a protection order against a Tribal Member on Tribal Lands, may be subject to prosecution in Tribal Court. This jurisdiction goes into effect on October 31, 2018.

The Tribe will provide non-Native defendants with due process protections equal to those in the outside states, such as the right to a jury trial, the right to an attorney, the right to a law trained judge, and the right to petition for a writ of habeas corpus in a court of the United States. If you are an employee of the Grand Traverse Band, you may be called to sit on a jury.

GTB Green Committee Pick Up The GTB Green Committee, lead by Mary Kelley, held an “Adopt a Highway” pickup of M-22 on Monday, May 13th.

The group picked up roadside trash along M-22 from the Arthur Duhamel Marina, past the Eyaawing Museum.

A family caregiver is defined as an adult family member, or another individual who is an informal provider of in home and community care to an older individual or to an individual with Alzheimer’s disease or a related disorder with neurological and organic brain dysfunction. The family Caregiver Support program provides services for caregivers, not the elder.

WHO IS ELIGIBLE FOR FAMILY CAREGIVER SUPPORT SERVICES? • •

Informal, unpaid family caregivers of older adults.

Grandparents and relatives’ caregivers, age 55 and older, who are the primary caregivers of a child not more than 18 years old because the biological or adoptive parents are unable or unwilling to serve as the primary caregiver of the child. They must be related to the child by blood, marriage, or adoption and live with the child.

GTB Tribal Member Jason Pedwaydon was recently featured in an article by Anna C. Christensen in the Spring 2019 “ACT Against Cancer” magazine regarding the first study of its kind in which Native American trainers are using physical activity to combat Cancer. The programs name is “Restoring Balance” and includes exercise/ physical training and Native American Ceremonies. All “Restoring Balance” Trainers are currently working toward ACSM certification, specializing in serving cancer survivors. Free Bleeding Control basic classes is offered to the public to educate and inform citizens on what to do during a bleeding emergency. American College of Surgeons goal across the U.S. is to train everyone with registered instructors through local fire, EMS, and health care professionals.

Summer season brings all different types of weather from thunder and lightning to floods or other types of emergencies.

Now that we are into spring and wildfire season is upon us you are reminded to check the DNR website to see if open burning is allowed on any day. It changes daily, due to the amount or lack of rain we have had.

Remember you need a permit to burn! https://www.michigan.gov/dnr Check your smoke detectors monthly. Replace the batteries when they begin to chirp or every year at a minimum. Please do not take them off the wall because you do not like the sound that they are making. We have new ones if yours are old or you need them replaced. Call 231-534-7161 to replace your detectors.

I want you all to remember this. A fire doubles in size every minute it lives.

An average size living room will be wall to wall, floor to ceiling on fire in 3 minutes. That is not a lot of time. Think about it being 2:00 A.M. in the morning and your smoke detector goes off. It will take you about 30-45 seconds to recognize that it is going off and start to react. That is one third of your safe time. By the time you get everyone out to your meeting spot you have passed that time. Also do not go back inside once you have made it out as 99.9% of those who made it out but go back inside for any reason, never come out again. Don’t let that be you.

Always have bottled water and non-perishable food accessible, fill sinks and bathtubs with water for bathing, washing clothes or flushing toilets, close and lock windows and doors, secure outdoor objects from flying around, and wrap items in plastic bags to keep dry. When electricity goes out, have battery-operated radio ready with extra batteries and learn how to shut off water and electricity safely at http://www.ready.gov/utility-shut-safety FEMA website has free learning tools on preparedness as well as online training for utility outages, evacuation plans, creating support networks for you and your family on emergency preparedness and many other topics.

Make time to create pet emergency plans, secure important financial documents utilizing the Vital document checklist, develop evacuation plans and other emergency preparedness checklists to help you to know how to respond and recover from disasters whether at home or work. Carbon monoxide (CO) is known as a silent killer” and is colorless, odorless, tasteless and cannot be seen and is poisonous and deadly to humans. Carbon monoxide detectors provide early warning from CO leaks and notify humans of life-threatening situations in the home.

Carbon monoxide units have 10-year battery replacement and can be placed on shelves, walls, ceilings and on each level of your home and every bedroom and common areas to alert homeowners of carbon monoxide leaks in the home that has furnaces, drying machines, fireplaces, chimneys or other fuel-burning devices.

Alarm’s beeps from carbon monoxide units have different meanings.

Know the difference between the beeps: d •4 beeps and a pause: This means carbon monoxide is in the air and you m should seek fresh air immediately and call 911.

•1 beep every minute: This means alarm has low batteries and you should replace them.

•5 beeps every minute: This means alarm has reached the end of its life and needs to be replaced.

Regarding comments and questions raised by membership for the Minor Trust Funds, here is a response from our Financial Manager, STIFEL: Global stock prices dropped during 4Q 2018. In particular, they dropped in December when all major global stock indexes experienced significant declines. The global sell-off was driven by combined fears of a global economic slowdown, U.S.- China trade, Brexit, rising interest rates, and government shutdown. December 2018 was in fact the worst performance for the domestic stock market in a December since 1931. Said another way, December 2018 was the worst December in the past 86 years.

We monitored this situation closely. We have an Investment Policy that has been in place for many years that helps us do what is best for the Community. We stuck with the Investment Policy during this tough period, and in fact experienced a big increase during the month of January 2019. We are pleased that even with this tough December, and netting out any inflows, the Community’s portfolios are in fact up from the beginning of December 2018 through the end of January 2019. In addition, stock prices increased in both February and March.

Clearly the stock market does not go up every single month or year, however, our success in the financial markets has been based on the discipline of sticking with the Investment Policy during both tough times and good times, as well as our belief in diversifying your portfolio (in other words, not putting all the eggs in one basket). This belief has allowed us to do what is best for the entire Community. Some of you may recall that following your well-designed Investment Policy not only allowed you to survive the financial crisis, but also achieve financial success since early 2009.

I would like to get a discount on my propane like the tribe gets on the rez. My bill is about $2,000 a year. I keep my heat on 60, and I have a bone disease. My bones hurt from cold.

The Tribal manager will work with housing and facilities to plan negotiations with fuel providers this summer.

The Herkner property is being developed according to plans. There are two phases that were approved by Tribal Council. There is a Low-Income Housing Tax Credit request for proposal being advertised for developers to consider as Herkner grows in phases. Phases include, low income, market rentals, and home ownership. There will be updated articles in the newsletter to reflect this.

Great meeting! Love that you use our facility. Having the vendors in the perimeter of room during presentations and open forum showed disrespect to those speaking, and it made it too noisy for us trying to listen.

Short Answer: The Tribal Court does not authorize access to minor trust accounts for the costs a parent would normally provide, such as food, clothing, shelter.

Open Forum for members only. Yet I saw the GTED & BSSW, etc. businessmen in the room and casino workers (I think). Not good for the businessmen to see our discontent amongst leadership and members.

Long Answer: The Tribal Council passed laws for parents or guardians to access minor trust accounts for matters related to the minor’s health, education and welfare. 18 GTBC § 1605(e)(3)(B). These same laws created a process for parents to access minor trusts through the Tribal Court via a petition. Id. In relevant part, the law provides that: Upon a petition of the parents or legal guardians of the minor beneficiary, trust assets mayPage | 1 be distributed to the parents or legal guardians of such minor or minors in such amounts as from time to time the trustee or trustees [Tribal Council] or the Tribal Court, in their sole discretion, deem necessary for the minors health, education or welfare.

While previous Tribal Courts may have authorized access to minor trusts for varying reasons related to heath, education or welfare, no standards to guide the Tribal Court defined what “necessary” meant; in plain language, the laws did not define the limits as to how closely an expense should relate to health, education and welfare. For this reason, access may have been granted to assist a parent or guardian with the costs of rent, home payments, utilities, or clothes for the child. Notwithstanding previous Tribal Court decisions, in 2008 Retired Judge Wilson D. Brott established standards that prohibited access for: (1) items that are a parents basic responsibility (such as food, clothing, transportation or shelter); (2) loans to parents to be paid back to the minor trust fund; and, (3) access that only indirectly benefited the minor. GTBCR 4.301; see also, Memo re “Petitions to Access Minor Trust Funds (Jan. 25, 2008). Since 2008, the Tribal Court has denied parents/guardians access to minor trust account to pay for utilities, rent, mortgage payments, parent’s vehicle costs, etc. Since 2008, limited access has been authorized to pay for such as items as: orthodontics and dental (health), tuition, tutors and laptops (education), and vehicles up to $10,000 for the minor to drive to/from school or part-time jobs (welfare and education).

Why do GTB government employees get so many holidays off? Why does the medicine lodge get all the time off between Christmas and New Year’s? Isn’t that what vacations are for?

GTB Government employees have 11 standard holidays and each year management considers and reviews the impact of closing between Christmas and New Year’s for all government employees. The past few years it has worked to close due to staff ability to ensure that services are provided to the membership as any emergency may arise.

2. Jeanette Schwandt, TID #1941 I need a very badly needed medication that insurance won’t pay. I am struggling to pay my bills.

Why do we have the Cofinity if it’s not going to pay for meds that one needs?

Dept 08-Clinic Response: Purchased Referred Care Representatives researched and took care of this matter. GTB works closely with Forest County Potawatomi and are able to discuss matters of medical insurance coverage and pharmacy needs on behalf of members to ensure coverage.

I also would like to know where my grandkids’ trust went to. The $3,000.

I am a disabled Elder and I had to leave my home this winter because of snow. I have a mile long driveway, I need it plowed.

Is there a form online for burial benefit or explanation how to get? My non-member husband would need to know if I pass before him.

Breakout sessions should coordinate w/ the snacks being put out; again it created people up and about and loud. Elders (my mom) couldn’t hear.

6. Steve Feringa, TID #7261 GTB LLC/GTED: great we are diversifying economically. Regarding organization: why are these companies under the Tribal government and not EDC? The EDC is already set up for this.

Do we now have two economic development entities?

Legal Response: GTB LLC/GTED is a Tribal limited liability company chartered under the laws of the tribe to specifically access federal contracts based upon the unique market niches available to Indian tribes in the Federal contract in system under a process generally known as Section 8 contracts. GTB EDC is a federally chartered organization under Section 17 of the Indian Reorganization Act, the principal statutory authority and methodology used on an historical basis to separate governmental functions from commercial functions under federal law.

Both the GTB LLC and GTB EDC were created to limit the liability of the tribe—GTB of Ottawa and Chippewa Indians---which is established under Section 16 of the Indian Reorganization Act. The principal function of GTB EDC is to be the operating entity of the casinos, markets, and owned by the tribe. Because of the unique nature of Section 8 contracting and federal contracting law, GTB LLC/GTED was created as a stand-alone entity to conform with the requirements of a typical Section 8 eligible entity.

I have been in the architecture/engineering/development business for over 34 years as a licensed architect. I highly recommend master planning w/community involvement for all Tribal properties. This should be completed before any development starts. The Peshawbestown master plan (needs updating) is a very good plan and we need to continue this for all GTB counties/properties.

The Council will take your recommendation under consideration. The Council concurs that all Tribal properties should have master plans, moreover, Article XI Section 2 of the GTB Constitution requires the “Tribal Council shall buy ordinance establish a comprehensive land used and natural resource conservation plan for lands and natural resources subject to Tribal jurisdiction.” Under this provision, the Council has established a variety of land use plans, sometimes designated as master use plans, and other times designated as housing plans, commercial development plans, conservation plans, recreation plans, school plans, governmental service delivery plans, transportation plans, hunting lands and fishing plans (off-reservation rights under the 1836 Treaty and U.S. v. MI), and other uses in accord with land use planning principles. The main principle to note, however, is that the scope of land use planning is limited by the scope of the GTB’s jurisdiction over the land. In some cases, the GTB owns land in fee

For example, a major investment of the Tribe is the Grand Traverse Resort. The Grand Traverse Resort is in fee simple and therefore subject to the Acme Township master plan. not the tribe’s master plan. On the other hand, the tribe’s jurisdiction to off-reservation hunting and fishing extends to some state land and some fee simple land in the context of the United States vs.

Michigan ongoing litigation regarding the scope of exercising hunting and fishing rights off the reservation.

Over half of GTB membership lives outside the 6-county service area. They are not provided with any services and are not allowed to vote. How can we change this?

Legal response: In the context of any federal Indian Tribal Constitution, “voting” and “service area” are not the same thing. To amend the voting area residency requirement, a Secretarial Election is held to amend the geographic eligibility scope of the voting area. Under the present GTB constitution, all members of the GTB regardless of where they are geographically located, can vote to amend the voting requirements of the GTB constitution consistent with a process designated as “Secretarial Elections” which are a set of federal rules governing Tribal lections to amend Tribal Constitutions. A condition precedent to a Secretarial Election is that the proposed amendments if are not contrary to federal law.

In that regard the term “Service Area” has a unique federal definition. All federal domestic delivery service statutes—such as health, housing, BIA funding, transportation funding, and other demographic based statistical population areas to determine the amount of federal funding that goes to a geographic and demographic area—limit the “service area” in which such federal domestic assistance and service funds can be expended. “Service Area” and “Reservation” are not the same thing. Typically, the “service area” of a Tribe is statutorily proscribed in the organic act of the federal program or proscribed in the federal rulemaking process or in the federal approval process in the amendment of the Tribal constitution. An illustration will suffice to give this concept that some real-world Tribal experience. The GTB Constitution is authorized under the Indian Reorganization Act and the current constitution approved by the Secretary to include the County of Charlevoix in the GTB’s service area. That Constitution was approved by a Secretarial election and signed by the Secretary of the Interior on March 29, 1988. The GTB had made an initial request for the Secretarial election in early 1981. The Secretary of the Interior did not authorize the Tribal constitutional election because the then interim Tribal government argued with the federal government that all Ottawa members in the state of Michigan wherever located were eligible to receive federal services. The federal government declined to authorize an expanded service area. Ultimately, the then interim Tribal government negotiated the six counties currently included in the service area. Even though the Federal constitution was approved by the secretary of interior, it still took approximately 26 months to get the department of health and human services to expand the Indian Health Service delivery area for GTB to include Charlevoix county. The tribe had to go through a similar process for Housing Services from HUD. Based on this history is unlikely that the federal governmentPage | 5 would permit an expansion of the service area for GTB. 7. Marion Minzey-Wabanimkee, TID #6979 Why is there no separate membership for lower than ¼ Native? Even with/without per capita I am still Native, why can I not be recognized as Native American through the tribe? This is not fair to the descendants. Being full-blooded or 3/16 Native we still deserve to be recognized from our tribe.

Membership Response: The 1/4 Indian blood is required by the approved Constitution.

Article II – Membership; § 1(2)(a) Descendants of members are eligible for enrollment as members if they are of at least one-fourth (1/4) Indian blood, of which at least one-eighth (1/8) must be Michigan Ottawa and/or Chippewa blood.

Mary-Jo McSauby, TID #784 Hire better builders, not just the cheap ones and only pay up front 50% until it’s done and make sure it’s done right and if something happens, make them accountable (suing them if need be) Make this place look like it’s owned by Natives instead of white, that’s what people want to see.

I can go to Walmart, Meijer, Kmart, and get that stuff cheaper- but I have to go to other tribes to get native stuff (like clothing, jewelry, etc.).

When someone gets into trouble why not community service, like shoveling, raking, or whatever.

Court Response: Short Answer: Community Service is always part of any court order. However, various Tribal Restrictions (liability and legal) prevent the Tribal Court ordering or its Probation Officers from sanctioning community service on Tribal lands.

Long Answer: Community Service is part of every Tribal Court order. It is encouraged as part of the restitution process, vital to rehabilitation, and critical to reduce recidivism. However, certain restraints within the Tribal Community (IC-3 clearance and/or liability) preclude the Tribal Court and/or the Probation Officers from ordering community service within the Tribe’s Indian County to perform community needed tasks, such as shoveling, raking leaves, or cleaning up the local highways. The restraints of IC-3 Clearance and/or liability are not present with nonTribal Agencies.

The Tribal Court is aware that elders within the community do need assistance with their lawns throughout the year but we have been informed that in order for the probationer to perform community service with elders, the probation must get IC-3 clearance, which is a background check required for the Tribe to sanction any work a person (employed or volunteer) to work with elders, vulnerable adults and/or youth. The first impediment is the cost to perform the background check; the second impediment is the Tribal Court does not have staff to perform the background check; it is the Tribal Court’s understanding that the Tribe’s regulatory/background cannot perform these types of IC-3 background checks on probations. 1C-3 clearance aside, the Tribal Court has been informed by the Tribe’s risk manager that community service that involves labor on Tribal properties or at the direction of the Tribal Court’s Probation Officers cannot be done due to liability the Tribe may incur if the probationer is injured.

Nursing home in every county, even if only 10 beds and open it to everyone but always keep a bed for members. I have been to a lot of nursing homes around the area and some are just sad, cold, and yucky but open to the public to let it pay for itself.

9. Brittany Benson, TID #5344 We need to jump on the marijuana boat and start a whole new line of revenue for our future generations. Clean medicine the natural way.

Legal Response: Whether to develop marijuana under Tribal and state law is still an open question for the Tribal Council because Federal law clearly and categorically prohibits the development of marijuana products. The tribe is amending its criminal law by referendum—a vote of all the Tribal members eligible to vote—to exclude the Tribal prosecution for marijuana possession consistent with state law. Nevertheless, Federal criminal law prohibit still applies to on-reservation possession, cultivation, use, and development of marijuana and related products 10. Yvette Weese, TID #2155 I really think you should set time for Elders to talk and then time for others to talk. It would be nice if younger people could have a chance to talk at the membership meeting. Just a thought (equal time for all).

Page | 7 I go to MSU Law School. The law school is considered private but there are not a lot of options for public law school in Michigan. I tried to transfer to Wayne but didn’t get in. Financially I’m struggling, and I really wish I could get the regular scholarship for higher education. Plus, I don’t get tuition waiver, so I take out loans for tuition. They are going to make it public but I’m asking that you please allow MSU law students to get the regular higher education scholarship.

Legal Response: The Michigan tuition waiver program, although based in a treaty right, is defined by and state law, not Tribal law. We fund the best that we can to support in accordance to what is approved for scholarships for Tribal Members attending public colleges. With the current language instructors and the advertisement of another fluent instructor, my recommendation and/or suggestion would be to add other duties as assigned and make the current museum director the director for all the programs within the cultural department. This would allow the instructors to focus on direct services to enhance the language and teachings. This not only would increase numbers for potential grant opportunities but increase culture awareness that we so desperately need and want.

I would also like to recommend/ to encourage utilizing our Tribal members for potential workshops as instructors. For example, we have Tribal members that know loss and grief, historical trauma, ribbon skirt making, fire keeping, etc. This would allow our Tribal members an opportunity to give back to our tribe in a healthy role while allowing them to feel as a valued and/or as an asset as a community member.

Questions/Comments from Open Forum 1. Wallace Hall, TID Can we get the tribe to sponsor more softball teams? The softball field is not playable and needs to be looked at.

A sponsorship policy can be developed and considered by the Tribal Council/EDC Board.

The softball field by the Strongheart property is having issues with drainage and is being looked into by the Facilities department.

2. Pauline Barber, TID# 7152 I encourage everyone to attend language class. Miigwetch Tribal Council for okaying all the money for Anishinaabemowin. We need interaction with fluent speakers.

3. Catherine Crowley, TID #253 I have three issues: (1) We do have aging population- other areas besides Peshawbestown that have elders. More transparent in regard to what’s going on. When (elders complex?) was first built, it was built for assisted living, but what we really needed was housing close to services for the elders. They need access to services more easily-community, not just patient care.

A lot of elders like privacy and to have a little bit of room- they don’t have space for family to visit. Not just housing the elder but grandkids, etc.

(2) regarding the Cherry Bend Road site: I don’t see the purpose in replacing the Traverse City 3 Mile satellite office with this building. Look at the Herkner Rd. site building, just wait for that.

(3) Child’s trust fund- where is it at? What was it used for? That money was set aside from their |9 per cap; it’s not supposed to be used for funds. It’s for our kids’ future and theirs to spendPage when they graduate.

4. Helen Paul, TID #2304 We live on the reservation in East Jordan. Both of our driveways are really bad and we have been promised paved driveways for years. I have a large mud hole at the end of my driveway. I have a storm door on my house and it’s on backwards. We were promised sidewalks on the East Jordan reservation and we don’t have that either. Also, more lines on the road. Something needs to be done.

7. Connie TwoCrow, TID #68 Housing is supposed to be energy efficient. Geothermal heat does not work this far north. There is an elder living in elders housing in Charlevoix who is freezing- geothermal heat is all cold air.

He hurts because of the cold. If you turn the heat way up your bill goes way up. My bill is close to $200/month. Could housing please take a look at this issue.

The ground in front of my house is paved and due to runoff from ice and snow melting, there is a lot of water there. I have to walk through 3-4 inches of water to get to my car. If Housing could please go and take a look at this-not just in my area, but also the 8-plex across the street in Charlevoix.

Handicap ramps are not up to code. It’s only 3 feet wide, supposed to be 6 feet wide.

Dept 03 Housing Response: Ramps and landing areas – Housing Maintenance has been tasked with going out and taking measurements of all ramps and landings in the Housing community so that we may come up with a list of any that are not up to code and renovate them to match existing ADA code for ramps and landings. I hope to have a report to the Tribal Manager for the June Tribal Council Regular Session.

8. Catherine Crowley, TID #253 Ramp issues- when they put someone on a stretcher and went to take her down the ramp- the ramp is a 45-degree angle and they had to sit her up to get her down the ramp. This could have prevented her from getting medical help- ramp needs to be fixed immediately.

9. Pat Castaneda, TID #2393 Where is Tribal Council? I’d like to see who I’m talking to. How many are here? (per TMO everyone was here) Take care of your own before you go and spend money.

10. Mary-Jo McSauby, TID #784 Some people are slipping through the cracks- handicap people can’t get up and shovel the ramps.

Why not put roofs over the ramps to help keep the snow off? Also, spindles are coming off. Need to take care of these ramp issues.

11. Ernie Gablow, TID #7162 I live in the Elders complex in Peshawbestown. I have two issues to discuss: Recently when it snowed, one elder called for an ambulance. The ambulance driver and medic had to shovel a path to get to the door to get the elder out. This happened around 6:00 in the morning. We need our sidewalks plowed and shoveled. On the same night when I was coming home from lunch at the casino I slipped and fell. The parking lots and sidewalks were a sheet of ice and hadn’t been salted or anything. A casino driver was trying to help me up. I talked to Housing maintenance and said we need some salt out there. That Friday night, they ran out of salt. I would like to know how that happened.

I can hear the floor in the living room at the elders complex crunching.

13. Shirley Gant, TID #738 I have been listening to the comments regarding ramps, driveways, and other things being neglected- I want to know who built the ramps. There are a lot of things being neglected. To me it sounds like wasteful spending. Things aren’t being done right and should have been done right the first time. I live in Southwest Michigan and we have to pay for our own driveway. There is no elder help available in SW Michigan. So many Tribal members don’t live within the 6 county service area; could we set up some type of satellite office to get services out to these members?

14. Catherine Crowley, TID #253 I was told I couldn’t pay my rent because of litigation with Housing. However I was just informed that I need to do something about the rent that I owe, or I will be taken to court. I was told not to pay it, and now Housing is going to take me to court? I would like to see this looked into. Housing is not intended to be a money-making business, it is to provide affordable housing and we need to look at providing for our people and our kids. We need to look at what we can do as a government to provide and support them. I would like this looked into.

17. Ernie Gablow, TID #7162 I belong to the Elders Advisory Organization. I wish we could get a small group together- locally or otherwise- and make a list of questions that could be addressed at Tribal Councilmeetings. We need a different sized group besides the Elders Advisory. Sometimes we bring up issues and it takes awhile to get things done, we hear that it is “still in the works” or sometimes our questions go unanswered.

Dept 12 -Elders Response: The Elder’s staff do their best to advocate for the elder’s needs and follow-up on getting answers. The elders advisory organization is not a Tribal program.

18. Mary-Jo McSauby, TID #784 There are times when people who I have to interact with for my job call me names, threaten me, etc. I shouldn’t have to deal with this. This happens when people can’t get what they want; I can’t change policies for people. I think a message should be put out there to have some courtesy and be polite and respectful.

The GTB has a zero-tolerance policy for violence and this would extend to protection of our staff. We will work on getting positive messages to our membership on how to interact with staff and that courtesy is reciprocated.

Let’s start getting our GTB pride back. Respect is the number 1 thing. Our traditions are here for us and we need to keep them going.

23. Monique Clifford, TID #5989 I talk to a lot of Tribal members regarding Housing and there is no transition to get people into their own homes. Can we get a rent-to-own program as far as housing goes?

(#23) 24. Theresa Pelcher, TID #4237 Let’s work together to end the disconnect. Housing issues have been being discussed for over three years- we need to have people follow through on issues. We don’t help our people and it is our job as a tribe to work together. We need to try to get our traditions back and we need our leaders to lead us. I want solutions within six months.

My daughter’s (Doris) house caught fire. The siding is burnt and is an eyesore. No one has reached out to my daughter to let her know when this will be fixed. Maybe Housing could reach out to and let her know when her house will be fixed?

When will we have a traditional cemetery/ceremony? There were cedar ties/sun dance ties on the ceiling at the church and the church cut them down. When will we have traditional ceremonies to bury our dead? At one time we had a traditional cemetery committee, but nothing has been done.

I helped coach at Suttons Bay schools from 1998-present. We see a lot of title 7 programs giving out 2% funding- yet our kids are still struggling with academics and acceptance. Our kids don’t feel welcome at Suttons Bay schools. We shouldn’t be giving SB Schools so much money when our children experience racist jokes, Native kids getting suspended, and unfair treatment by teachers.

Dept 12 -Education Response: It is unfortunate that you experienced this behavior from Suttons Bay School. We will investigate your concern. Miigwetch for letting us know.

22. Rick Yannott, TID #1551 The elders complex is quite outdated. I would like to see a new elders complex above Eagles Ridge. We should have our elders complex on the reservation- it is far away.

Our education department should start promoting nursing- have our youth take care of our elders.

There are houses that need to be fixed-why can’t we have day labor? So many GTB Members have the skills to fix these houses.

Dept 03-Housing Response: Tribal members are encouraged to bid on Housing rehabs whenever possible. They must carry liability insurance and provide Davis-bacon wage certification records because of the HUD funding. (#22) Elders living in Peshawbestown need their driveways plowed.

How long does it take to renovate a house? Some of them have been vacant for over a year.

Charlevoix meetings are always being cancelled- we had a community meeting scheduled but it was cancelled.

My aunt had to sell her house to move up here in order to get health care, because she can’t get health care benefits outside of the 6- county service area. Services that are offered to Tribal members living within the 6-county service area should be offered to all GTB members.

My kids’ unity program was cut.

26. Bradley McClellan, TID #1417 I have been in business for 14 years providing housing and employment in Traverse City- if you want to be successful in business you have to be honest. If you are not honest you shouldn’t be Page | 15 working for the tribe Tribal Councilors should know laws, policies.

Tribal Member business alliance- group of 20 or so GTB Members who had businesses within the community and tried to collaborate- I feel this is something we could do.

I encourage GTB members to seek out honesty, that is how we will move forward.

27. Terry Antoine, TID #1188 When we had the last storm a pipe broke in my son’s house and fell to the basement making a huge mess. He is renting the house from the tribe. He called Maintenance and they said they couldn’t fix it right away but would be there on Monday. Please look into housing issues. Lots of people are trying to make it on their own and it is hard when they can’t get the help they need. If Maintenance can’t come out and fix an issue, let us fix it ourselves or get someone else.

Rick Yannott, TID #1551 This is on behalf of Patricia Sams, TID # 924 regarding the Strongheart Center. If we keep it open until curfew instead of closing at 5 or 6 pm, this would give our teens a safe place to be. I would like to see more sports events offered through Strongheart; we need more for our kids.

There are some youth that travel for sports. Maybe we could offer more programs at Strongheart for youth.

Regarding beach property that has been vacant for so many years- we do not have any water access. Could we convert the property over for GTB members’ use- swipe your TID to get beach access?

The Facilities department is working with the legal department to present appropriate signage and access for members to beachfront properties.

Dept 13-Education Response: In regard to Strongheart, the facility provides community base and physical fitness for Tribal members in the six-county services area. In addition, coordinates with youth services for programming. The hours are seasonal with summer and winter hours.

The winter hours, currently, includes Monday – Thursday 6am-9p, Friday 6a-6p and Saturday Page | 16

8a-1p. In addition, with a movie night second Friday of the month. The summer hours include Monday – Thursday 6a-8p, Friday 6a-6p. The sports that are provided basketball camp for youth, lacrosse, conditioning classes, running club, yoga, dance and Family Olympics.

Next fiscal year, FY2020, plan to propose Saturday 9a-1p and Sunday 9a-1p (tentative) starting in October 2020 for a trial period. This will depend upon attendance of Tribal members. ELDERS OPEN FORUM Tuesday, 14th, 2019 10:00 am- 12:00 pm, Traverse City Three Mile Office

Council Members in attendance: Chairman McClellan, Vice Chair Vargo, Secretary Frankenberger, Treasurer Rohl, Councilor Napont. Councilor Wilson is attending the Great Lakes Fishery Trust meeting.

Discussion began at approximately 10:05 a.m. GTB Elder Sandra Waukazoo spoke first. She asked who is in charge of the street lights along Stallman road. She said there are 10 or 12 burned out streetlights. Doris Winslow replied that those street lights were put in by a grant from the BIA. Whenever a street light goes out we notify Robert Kalbfleisch, Land and Roads Manager, and he sends a maintenance crew (not GTB Maintenance) to replace it.

Sandy then asked if the menu at Dex’s could be changed. She would like more variety in the menu and stated she gets tired of the same menu items. The meal offerings at Dex’s were discussed further.

GTB Elder Pat Castaneda spoke next. She discussed an incident that happened with her brother. She stated she would like to see the parking lot in pristine condition in the winter. This is especially important for Elders.

GTB Elder Leslie Antoine spoke next. He asked who the prosecutor answers to. He stated he contacted the prosecutor over a month ago and has not heard back. Treasurer Rohl stated the best route is to contact the police so they can do an investigation. The tribal police will report back to the prosecutor if there is something they want to charge someone for.

Chairman McClellan reiterated this point and suggested that Leslie call the police department.

The Per Capita distribution was discussed. Secretary Frankenberger stated she believes the amount will be $1,422.08. Councilor Napont added that this is an increase of $112. Chairman McClellan stated that the first half per capita distribution is usually the smaller one, because the winter months do not generate as high an amount of revenue. Councilor Napont discussed the RAO calculation. He stated that services have been increased as a result of having a little extra from the RAO calculation.

GTB Elder Ernie Gablow spoke next. He discussed an incident with his Life Alert button. Ernie stated that tribal police responds much faster than County police. He wanted to thank them for their fast response and aid in helping him when his Life Alert button went off.

Councilor Napont asked if there is a procedure within the Elders program that could contact any Elders that would like a regular check-in call to make sure they are alright. He asked if the elders would want this. Sandy Waukazoo mentioned that the elders coordinators do this, but some people need daily calls and the coordinators cannot call every day. Councilor Napont suggested if an elder states they would like to be called, the coordinators could keep a list of who wants a call and then check up on those elders. Treasurer Rohl mentioned that there is a program in place where elders can be contacted once a day. Doris Winslow stated that the elder has to request this, and added that coordinators will even stop by and make visits. Councilor Napont asked if someone could follow up with the elders and make sure they know this is available to them. This program was discussed further. Chairman McClellan stated that Council will work on this. Doris Winslow suggested a door tag system that could be used, where Elders could place “sleeping” or “in for the night” door tags on their doors, and if they aren’t removed by a certain time, staff could go in and check on them. Discussion ongoing for several minutes.

The need for a more involved assisted living facility, rather than an elders complex, was discussed. Assisted living facilities could provide assistance with more areas than an elders complex could. Doris stated we need to plan for this in the future. The potential cost of such a project was also discussed. Vice Chair Vargo suggested a Work Session with the Tribal Manager could be held.

Pat Castaneda stated that several elders spoke at the annual Membership Meeting regarding driveways being paved. She asked if this is going to get done. Chairman McClellan stated that a request has been put in to Rob Kalbfleisch for the sidewalks and driveways in Charlevoix. Pat mentioned that lighting is also needed. Councilor Napont stated that a clarification needs to be made to rentals versus homeowners; the properties with the paved driveways are tribally-owned rentals. Pat asked if there is anything in the works for homeowners. Councilor Napont stated that homeowners could work something out. Treasurer Rohl added that if it is not triballyowned, the chances of getting it paved is very low. We do not have the programming.

Discussion ongoing regarding driveways. Secretary Frankenberger suggested that when a crew comes around to pave the driveways for nonhomeowners, Pat could get a cheaper deal during that time than if she had someone come out at a different time. Pat asked if there is a grant they could get to help the elders with this. Councilor Napont suggested the loan program and Secretary Frankenberger suggested the emergency home repair. Treasurer Rohl suggested that a Work Session could be held for further discussion.

Sandra Waukazoo discussed an upcoming raffle for Father’s Day. She stated she needs more donations for prizes and encouraged everyone to buy raffle tickets. The money raised by the raffle will go back to the elders.

Pat Castaneda asked about a proposed new casino she heard about.

Treasurer Rohl stated a vote was never brought forward on that issue. She added that the majority of sitting Tribal Councilors do not support a new casino project of that magnitude. She added that the previous Councils never brought it forward for a vote. Chairman McClellan added that Tribal Council is not in favor of shutting down Leelanau Sands Casino; however they are in favor of looking at the numbers and perhaps downgrading.

Treasurer Rohl added that a new building for that casino would provide a lot of efficiencies; there is a way to make it cost effective.

Pat Castaneda asked how the new CEO/General Manager/CFO position is working out. Chairman McClellan replied that we do not have those positions filled yet. They are still working on the CEO position and have one person potentially in mind as far as the CFO position. He stated that General Managers are maintaining operations.

GTB Elder Betty Gibbs spoke regarding the remodeling of Seasons buffet.

She asked why it is taking so long. Chairman McClellan replied that Seasons will be open again in a couple of weeks. Betty then asked why we are having trouble with permits in that area. Chairman McClellan replied that the tribe does not have control over the permits.

Les Antoine spoke again to ask how much we purchased Bay Shore Steel Works for, and when we will see a return on that. It was purchased for under $4 million. Chairman McClellan replied that we will see a return in 2-3 years. Treasurer Rohl discussed a relevant Resolution. The GTB LLC was originally funded with the premise of seeing a return in 5 years. The GTB LLC will see a profit this year from that. In 5 years, they will return part of the profits that the LLC makes to GTB, to use however the tribe sees best. She added that during that five year period, they will not be returning any profits to the tribe. After the 5 years, they will return 25% of the profits back to the tribe.

Betty then discussed an issue with her due process in Tribal Court.

Chairman McClellan stated that Council can look into her issues and added that Tribal Council is separate from Tribal Court. Betty stated that some issues need more prompt attention than others, and the Court needs clear goals for working with families.

EXCITING NEWS! Tribal Council has approved an increase dollar amount available to each elder the “Elders Emergency Service Component” for FY19. within the six-county service area and there are no income requirement.

The funding for this service are categorized on your age ranging from $600 to $1000.

Age Category • 55-64 years • 65-70 years • 71-older

This program is for all elders living

and amounts: $600 $800 $1000

The Elders Emergency Service program is to assist elder’s and is not limited to any situation.

Examples: Food, Heating, cooling, snow removal @ $25/per trip and lawn care up to $25 per cut, appliance purchase, clothing, even reimbursement for payments that you incurred This program can be used in conjunction with LIHEAP and/or HUMAN SERVICES. Each Elder is required to complete an application. In order for the application to be processed in a timely manner, it is important that the directions for this program be followed and completed properly.

Procedures for program are as follows: • Application must be filled out completely, signed and dated by the applicant.

• Supporting documentation must be submitted with application • Assistance request must be for primary residence.

First Drive-In Movie Theater Opens!

In June of 1933, eager motorists parked their automobiles on the grounds of Park-In Theaters, the first-ever drive-in movie theater, located on Crescent Boulevard in Camden, New Jersey. The term “drive-in” came to be widely used only later–was the brainchild of Richard Hollingshead, a movie fan and a sales manager at his father’s company. Hollingshead came up with the idea of an open-air theater where patrons watched movies in the comfort of their own automobiles. He then experimented in the driveway of his own house with different projection and sound techniques, mounting a 1928 Kodak projector on the hood of his car, pinning a screen to some trees, and placing a radio behind the screen for sound. He also tested ways to guard against rain and other inclement weather, and devised the ideal spacing arrangement for a number of cars so that all would have a view of the screen. Advertising it as entertainment for the whole family, Hollingshead charged 25 cents per car and 25 cents per person, with no group paying more than one dollar.

The idea caught on, and in 1949, drive-in theaters began popping up all over the country. One of the largest was the All-Weather Drive-In of Copiague, New York, which featured parking space for 2,500 cars, a kid’s playground and a full service restaurant, all on a 28-acre lot. Drive-in theaters showed mostly B-movies–that

is, not Hollywood’s finest fare–but some theaters featured the same movies that played in regular theaters.

The popularity of the drive-in spiked after World War II and reached its heyday in the late 1950s to mid-60s, with some 5,000 theaters across the country. Drive-ins became an icon of American culture, and a typical weekend destination. Since then, however, the rising price of real estate, especially in suburban areas, combined with the growing numbers of walk-in theaters and the rise of video rentals has curbed the growth of the drive-in industry. Today, sadly enough, fewer than 500 drive-in theaters survive in the United States.

PROPOSAL Should the Grand Traverse Band Criminal Code, found at 9 GTBC §107(p) be amended by adding the language highlighted in bold font below? (p) Possession, Use, Sale, Manufacture, and / or Distribution (Controlled Substances) (1) Offense. It shall be unlawful for any person to possess, use, sell, manufacture, and / or distribute any controlled substance defined and / or described in the Uniform Controlled Substances Act, 21 U.S.C., § 812, as updated, without prior authorization.

(A) Possession and use of cannabis is exempt from prosecution under paragraph (p)(1), provided that both of the following conditions are met: (i) Such possession and use is in conformity with the Michigan Medical Marihuana Act or the Michigan Regulation and Taxation of Marihuana Act to the extent that such possession or use would be lawful in the jurisdiction of the state of Michigan; and (ii) Such possession and use does not occur in tribal programs funded by federal appropriations under the tribal housing programs and tribal health programs.

(2) Sentence. Any person convicted of this offense may be sentenced to a jail term not to exceed one (1) year or to pay a fine not to exceed five thousand dollars ($5,000.) or to both.
