o, how was convention?”

It’s a question I’ve answered many times in the three weeks since we gathered for the Cattle Raisers Convention and Expo. For those of you who missed it, I’ll tell you what I’ve told everyone: It was great.

About 4,500 cattle raisers, landowners and industry friends filled the halls and meeting spaces of the Fort Worth Convention Center, thrilled to be back in-person to learn, connect, shop and enjoy. Maybe it was the excitement of being back together after 22 months, because you could feel the optimism in the air.

This magazine, which is our largest since March 2020, is the annual wildlife issue. As such, it features stories on the beautiful (and wildlife-filled) Guitar Ranches and must-knows on hunting leases. But you’ll also find good news about beef, tips for improving your bottom line and read about a South Texas court decision impacting cattle raisers everywhere.

We hope you’ll find these 100 pages entertaining and educational — and that they leave you feeling optimistic, too. CT

And it only grew when CattleFax CEO Randy Blach told a full ballroom, “The bottom line: the market is headed higher. We have much better times ahead.”

No doubt: times have been tough for the last couple of years. So, it feels good to be a little bullish.

T

he beauty of an opera cannot be understated. Hearing the chorus, soloist and symphony orchestra working in unison to create a flawless production is unlike any other experience.

As any cattle raiser will tell you, one part of the ranch by itself is beautiful. However, to truly embrace the whole picture, Jane says it is necessary to consider every piece — the land, livestock, water and wildlife.

Jane Guitar knows this well. She is an accomplished vocalist who produces the Abilene Opera, not far from the family’s ranch.

While the world of music may seem distant to the cattle business, she says it is quite parallel.

“When it all comes together, balanced, intentional and in sync, the results are breathtaking,” Jane says.

“Ranching is like putting together an opera,” Jane says. “You have to have an orchestra. You have to have a chorus. You have to have soloists.

You have to have a venue. You have to have a conductor. You have to have a director. If you don’t have all these different areas controlled, it can all fall to pieces.”

She experiences this first hand on their cowcalf operation, Guitar Ranches. Spanning across West Texas and centered in Abilene, they are located in about five counties as far west as Big Spring. At all levels, stewardship is the goal.

“We’re stewards of the land,” says Phil Guitar.

“That’s our duty here: To take care of the land, the cattle, the horses, the wildlife, and let everything coexist together.”

THE BRASS

Phil and Jane Guitar own and operate the family business, which they have grown considerably since their time on the conductor’s stand over the last 30 years. Along with staff members who play essential parts in the operation, they are continuously making strides to integrate each piece of the ranch and ensure it is top-shelf.

“I have such a great interest in our business, our cattle, our land, and trying to improve it all the time,” Jane shares.

“We have a wonderful team we work with. Each person is so talented in their own way and it makes a wonderful cast.”

A Red Raider, Phil grew up in agriculture and spent time learning from many of the best in the business — namely his father Earl, the 6666s Ranch and Pitchfork Land & Cattle. He knew from the start he wanted to invest in the land and agriculture.

Jane’s experience was quite the opposite. A musician by trade, she expected to find herself on stage in New York City. But life has a way of bringing one back to their roots.

She was born to a ranching family, and now combines her heritage and musical passion.

Together, Phil and Jane are constantly seeking new and innovative ways to find the balance of wildlife and agriculture, while also providing a venue for visitors to get a front-row seat to a working ranch. Guitar Ranches have taken the balance of a cattle business and a hunting enterprise another step further.

“We do all this together,” Phil says. “Jane knows it from day one, and I've learned it, too. Even our children are a part of the operation. Our daughter, Catherine, works in the office and our son, Philip, on special projects.”

THE STRINGS

Cattle are the foundation of Guitar Ranches and will continue to be for years to come. Cattle Manager Jimbo Humphreys has held the reins of the ranch’s cattle section for more than 25 years and says at the same pace the industry has progressed, so has Guitar Ranches. They have found a rhythm that works, but it didn’t come without effort.

“Education is a lifelong pursuit, it's not just the class,” Jimbo admits. “It's not just in school, it's something that you need to do forever. You should be learning every day.”

With that mindset and using progressive genetics to reach long-range business goals, they have been able to weather the many storms thrown at ranchers today. From inclement weather to fluctuating markets, Guitar Ranches has used their available resources to keep it not only afloat, but also thriving. Their conservative stocking rate is to credit for this sustainability.

“Communication is a key to success as managers,” explains CEO Kirby Andrews. “Periodically, we get together and talk about our current conditions and plan for future conditions, which directly impacts our cattle rotation strategy.”

Their endgame is selling preconditioned yearling calves at a premium. The Angus cow base is covered with both black and Red Angus bulls to ensure a product with the utmost quality — a common theme across all sections of this ranching production. The Guitars knew there was potential for their business to expand further by utilizing the wildlife and natural resources already present on their properties.

“It's been a really good experience for me to learn,” Jimbo shares of the transition. “To achieve a balance between the cattle and the wildlife, we allow the wildlife to generate revenue in addition to the cattle.”

THE WOODWINDS

Relatively new to Guitar Ranches’ business model is the wildlife and recreation section — Guitar Outdoors.

While offering hunting trips isn’t anything new, the Guitars have added their own spin to help the two worlds of cattle and wildlife work in harmony.

The wildlife naturally occurring on the ranches today are white-tailed deer, mule deer, mourning dove, bobwhite quail, waterfowl, Rio Grande turkey and feral hogs. With stewardship as the top priority, they had to find a way to capitalize on the wildlife without depleting any species.

“We want to be very conservative in how we harvest our wildlife,” Kirby explains. “So, in doing so, we realized that for us to operate a lodge and make the most of our staff we could add non-consumptive activities on the ranch that are appealing and bring money to the bottom line.”

They began opening the ranch gates to groups and families for special events, meetings, or just as a weekend getaway for those not interested in hunting, but instead interested in touring nature by hiking, using UTVs or bikes. With their partner Outdoor Solutions, Guitar Ranches also offers long-range shooting school and culinary events. This segment of the ranch welcomes approximately 1,800 visitors yearly.

During the shooting school, guests sharpen their rifle skills on the 1,000-yard-long range with experts before going out to hunt. Once guests bring their trophy back, the ranch has a chef waiting to teach them how to prepare their wild game in a five-star fashion.

Culinary schools are even available to non-hunters.

This all-inclusive method takes guests through every component of the ranch, teaching them not only about hunting, but also how conservation plays a big role and how it works in unison with beef cattle.

“It has absolutely taken off like wildfire because people want to know where their food comes from,” Kirby explains. “This is a way we can utilize the ranch to help educate the public about their resources and food.”

“It also lets them reconnect with nature,” adds Wildlife Manager Lloyd LaCoste. “It's not just food you would go to the grocery store and pick up in a package, it has a connection with the land. It's all integrated and how we manage it is important.”

To do that, the ranch is constantly pursuing ways to improve the land.

Water was one of the first steps in that effort. In the beginning, their water was not dispersed correctly — leading to overgrazed areas. By adjusting the distance between each water source, they have been able to maximize the resources at hand.

The second verse has been a consorted effort on clearing and managing unwanted brush. This step has taken many hours of studying desirable and undesirable plants, but it has been worth it.

“In order to be a good steward of your property, you have to know your plants, know how to manipulate them, and know what their value is to both cattle and wildlife,” Lloyd notes.

By doing this, the Guitars have actually found hidden treasures including springs and caves — both things they would have never discovered without taking steps to improve their land. This, along with many other positive attributes, make it clear considering wildlife in a cattle enterprise is beneficial in more ways than one.

“Wildlife can pick up the slack economically to add to the bottom line,” Lloyd explains. “The ultimate goal of the wildlife operation is to allow an additional source of income to help the bottom line of Guitar Ranches and allow them to be better stewards of the land.”

THE PERCUSSION

From the blacktop, after a ranch visit with Phil and Jane or by viewing their online presence — it is clear the heartbeat of this operation stands on land stewardship.

“I'm really proud that we're trying to leave this land better than we got it,” Phil shares. “Jane and I are stewards of the land, and every step we take is moving us toward that goal.”

GUITAR RANCHES HOST

SPECIAL RANGERS TRAINING Guitar Ranches served as the host for the Texas & Southwestern Cattle Raisers Association Special Rangers training this summer in their state-of-the-art facility on the ranch near Hamlin.

All 30 special rangers gathered for a week to participate in firearm school, learn new investigative techniques, and complete a variety of other required trainings and evaluations.

Since the special rangers do not receive government funding, these trainings can be costly — hence the importance of donations and support of their annual Special Ranger Foundation Silent Auction from generous individuals.

Phil Guitar has been surrounded by ranching his entire life and has no plans of that changing.

Their actions stem from passion, after all. Maintaining this business for years to come in a sustainable fashion is of utmost important to Phil and Jane. They are here as an example that cattle and wildlife can comingle in perfect concert to maintain both profitability and the natural beauty of West Texas.

“Our main thing of course has always been cattle, but we love wildlife so much,” Jane says. “We love them both, and we have to take care of them both as best we can. We always want to improve it and make it better.

That's what we try to do.”

In the spirit of keeping the ranch a viable means of income, Phil and Jane insert their business know-how. They recognize without a business mindset, all the good they are doing will fall flat. It is absolutely critical to evaluate their various enterprises regularly to ensure they thrive for years to come.

“My suggestion, and it goes back to my dad telling me this, is to diversify,” Phil advises. “Don't ever put all your eggs in one basket. By diversifying, you can avoid being overexposed in any one area, so instead it is best to spread your risk across various sources of revenue.”

Even so, Scott Williamson, Texas & Southwestern Cattle Raisers Association executive director of law enforcement, brand and inspection services, says it is critical his team stay up-to-date on the latest in tactical training to ensure they are both prepared and safe while serving cattle raisers. Guitar Ranches generously supplied the use of their facilities, room accommodations for the week, and all meals were prepared and served by their staff at a substantial discount, greatly influencing the quality of the training and minimizing the cost to fit within the special ranger budget.

“Phil and Jane’s staff exceeded our greatest expectation every step of the way,” Williamson says. “Their kindness in gifting us the use of their facility is a key piece to our team continuing to advance in reaching our goal to maintain the same level of training state law enforcement must undergo.”

The 1,000-yard shooting range, offering targets as close as 250 yards, served as an ideal place for special rangers to sharpen their skills on different levels of firearms. Additionally, the ranch offered other spaces to be transformed into handson classrooms. In these spaces, they underwent physical readiness and first-aid trainings as well as crime scene training over the course of the week in Hamlin.

“We complete these trainings annually to perform our due diligence in preparing our team to face difficult situations in the field on behalf of our cattle raisers,” Williamson says.

“Phil and Jane Guitar have shown unbelievable support in this effort.”

Each of these sources must play their part — the livestock, the water, and the wildlife.

But as Jane or any other musician will say, the magic comes in the moment all the players join and the performance begins.

"We have hundreds of employees and families who are all working together to make this dream a reality. Each of them brings his or her own unique talents," Phil says. "It's amazing to see so many people working for the good of the whole." CT

TIME OF TRANSITION Tightened supplies, record demand signals greater profitability.

O

n the main stage during Cattle Raisers Convention and Expo, CattleFax CEO Randy Blach shared a message the crowd longed to hear — there are better times ahead.

The industry-leading market expert said cattle prices are expected to trend higher well into 2024.

“You will see the markets start to transition,” Blach said. “We should see improved industry profitability, which is really needed, particularly back for our cow-calf and stocker operators.”

A look at the supply and demand picture explains the increase.

Blach said the nation’s cattle inventory will be tight for at least the next four years. Severe drought in the western U.S. and Northern Plains is cause for herd liquidation, and there are fewer fed cattle numbers as the industry recovers from 2020’s backed-up supplies.

At the same time, overall beef demand is at an encouraging 33-year high.

“In the last 20 years, we’ve seen significant growth in beef demand,” Blach said. “It’s added $240 per head to the value of cattle. Why? We started listening to the consumer.”

Answering the call for higher quality and consistent beef products, ranchers have made tremendous strides in genetic improvement and overall carcass quality. Prime and Choice supplies have since increased 60%, Blach said.

As a result, the beef industry gained 8% market

share of total spending from pork and poultry.

Total meat spending was $263 billion in 2020. This shows U.S. consumers and customers around the world are responding with their pocketbooks, and are hungrier than ever for high-quality U.S. beef.

“Don’t forget why you are here,” Blach told the audience of cattle raisers. “The work you do really does matter, and it has a huge impact on this business as we look down the road.”

SUPPLY SHIFTS

To say the past two years have been challenging would be an understatement.

For the cattle business, Blach said it goes back to August 2019 when a fire at the Tyson plant in Holcomb, Kansas, set processing back for several months. Then came COVID-19. Around one million head of cattle were left in waiting because of processing complications caused by the global pandemic.

“We also made the cycle lows in the spring of 2020, coinciding with COVID-19 and the worst of that situation,” Blach said.

More than a year later, the bottleneck in the supply chain is just beginning to subside. According to USDA’s July Cattle on Feed report, inventories were down 1.3% from last year at a total of 11.29 million head. By October, Blach forecasts they will be down 4%.

The nation’s beef cow inventory is also tracking lower at around 31.2 million head. Beef cow slaughter is up, and Blach expects the decline will continue for the next couple of years.

“If you have a smaller beef cattle herd, what’s that tell you? Prices are going up,” Blach said. “If demand is sideways or higher, prices are going up.”

On the flip side, input costs for grain, crude oil and natural gas are expected to rise, as well. Blach said corn prices could average from $5-5.50 or higher in 2022, depending on crop yields. He expects more elevated grain prices over the next two to three years.

“We are going to see more inflationary costs across all aspects of your business,” Blach said.

“Money is in the system today,” Blach said. “Because of the bottleneck we’ve had with front-end supply, our wholesale and retail markets have already priced this rally in. It’s just a matter of moving the needle for you as producers to get your share of it.”

The U.S. is the No. 1 beef producer on the planet, supplying 75-80% of the world’s high-quality fed beef supply.

“U.S. Choice and Prime beef is the global standard,” Blach said.

“Consumers around the world love our products, because of its safeness and quality. There’s a lot of trust in that U.S. brand.”

The beef industry will have a net trade balance of more than $2 billion in 2021, which accounts for nearly $400 per head, Blach said.

When combined with pork and poultry, the U.S. will export about 19 billion pounds this year.

“On a per-capita basis, for every man, woman and child in the U.S., it is about 46 pounds per person,” Blach explained.

“These numbers are really pushing higher. It is incredible how we’ve seen that change,” said Blach, citing 19% of total U.S. protein production will be exported in 2021. In the 1980s, the number was less than 2 percent of the total.

Blach said the industry’s well-earned position as a global beef leader did not happen overnight. When he began his career with CattleFax 40 years ago, this was not the case. The industry was at a breaking point.

From 1980 to 1998, Blach said average profitability for cow-calf producers was $2.04 per head. More than 375,000 producers left the business during this time, beef consumption was down 12 pounds per capita and prices remained flat.

What happened to reverse the trend? Producers started raising beef with the consumer in mind. They were intentional about making decisions and realized there was a chance to generate more value from a commodity market, Blach said.

He reminded the audience to keep this focus in mind.

Consumers today are asking for more information on how beef products are raised, where they come from and how animals are treated — and the industry has a positive story to tell.

“All of these things are an opportunity,” Blach said. “An opportunity for producers to participate in sharing more

information with consumers. Some are doing that today — and they are going to get paid for it.”

Understanding where the industry came from, appreciating how it has changed and where it stands today, while anticipating the future are all important when navigating these trying times.

Blach said the bottom line for cattle raisers is this: supply has peaked, demand is strong, leverage will improve for producers and higher prices are ahead.

M

any avid hunters are already planning for deer season, which begins Oct. 2 for bowhunters and Nov. 7 for general firearms season. Landowners who participate in special management programs within the Texas Parks and Wildlife Department can begin harvesting deer Oct. 2 with a firearm, as well.

However, as we get ready for this exciting time, there is a growing threat that could impact our deer populations, ruin a cherished pastime and hurt our livelihood.

Chronic wasting disease is a neurological disease infecting numerous deer and certain exotic species, including mule deer and white-tailed deer. It is not known to infect humans, but it is fatal for deer. The disease cannot be prevented by vaccination nor is it treatable. Once established in an area, it cannot be eradicated and can cause significant impacts to deer populations and their composition.

With reports of chronic wasting disease in Texas steadily increasing, we must be vigilant. If it becomes more established in Texas, we will pay a tremendous price. Hunting brings $2.2 billion to the state’s economy and supports many ranchers, landowners and rural communities along the way.

Thankfully, Texas Parks and Wildlife Department and Texas Animal Health Commission are taking action to curtail the disease spread. Concerns led the agencies to enact emergency rules that will, among other things, require increased testing and identification of captive deer before they are transferred to a release site.

Steps like these will be vital to containing the spread of chronic wasting disease. Numerous organizations have

applauded the move, including Texas & Southwestern Cattle Raisers Association, where I serve as the chairman of the Natural Resources and Wildlife Committee.

Many of our members rely on income generated from white-tailed and mule deer hunting. Unfortunately, they can be left vulnerable when high-risk deer are released without current chronic wasting disease tests and into areas where they can co-mingle with other deer. Should an infected animal be released, the potential for disease spread to existing wildlife is very real. However, thanks to increased testing and identification requirements, we feel ranchers and landowners will be better protected from the spread of chronic wasting disease.

Collaboration between the state of Texas and private landowners will be essential to contain the disease. To do so, Texas & Southwestern Cattle Raisers Association is honored to serve on the Chronic Wasting Disease Joint Task Force on behalf of cattle producers across the state.

It is also vital hunters be vigilant and report any animals showing symptoms of chronic wasting disease, like emaciation, lack of coordination or a loss of fear of people. Hunters in chronic wasting disease management zones must also take their animals to a check station within 48 hours of harvest, and those outside of specified zones may request voluntary testing.

Texas & Southwestern Cattle Raisers Association is committed to preserving the hunting traditions so many of us know and love. We will fight to contain the terrible impact chronic wasting disease could have on our state, and I hope you will join us in that fight. CT

ep. Dustin Burrows, of Lubbock, represents part of Lubbock County in addition to Gaines, Terry, Lynn, Borden, Scurry and Mitchell counties. His agricultural roots go back to his childhood when he was involved with FFA and judged livestock.

Rep. Dustin Burrows Burrows has been an ardent supporter of Texas farmers and ranchers since he was first elected to the Texas House of Representatives in 2014. He is now serving his fourth term and currently chairs the influential House Calendars Committee.

During the recently concluded 87th Texas Legislative Session, Burrows joined the fight to make the state’s eminent domain process more respectful of landowners and private property rights.

A 70-day spring and fall calving season, provides a year round inventory of Rocking Chair raised bulls.

Entities entitled to the power of eminent domain have long had the unilateral right to enter a property that they might condemn to conduct a preliminary survey. Fortunately, Burrows authored H.B. 4107, which requires common carrier pipelines provide notice at least two days before entering their property for the survey. The notice must also contain certain protections for the property owner, including the restoration of damaged property, indemnification against damage and more.

Bulls come with performance data, EPD’s, and ultrasound information.

Fertility tested and guaranteed.

H.B. 4107 passed overwhelmingly, was subsequently signed by the Governor, and went into effect Sept. 1, 2021. The legislation reflects a significant step forward in eminent domain fairness by beginning to rein in the oftencontentious survey process. CT

NOBLE RESEARCH INSTITUTE NAMES GENERAL RANCH MANAGER

Joseph Pokay IV was recently hired by Noble Research Institute as general ranch manager. Pokay brings more than 13 years of full-time production agriculture experience to Noble, specializing in regenerative ranching practices.

During the last three years, he worked for Deseret Ranches, one of the largest cattle ranches in the U.S. As ranch general manager, Pokay will oversee Noble Ranches, about 14,000 acres of research and demonstration land.

Pokay will work with existing ranch managers and staff in implementing regenerative management planning and practices to improve soil health, which benefits society by improving the health and quality of our land, water and food.

He earned his bachelor of science with double majors in animal science and agricultural business from Colorado State University.

ANGUS MEMBERS ACHIEVE 1 MILLION GENOTYPES

Angus Genetics Inc., a subsidiary of the American Angus Association, has reached its 1 millionth mark in Angus genotypes. This was a monumental accomplishment for the Angus breed, says Kelli Retallick-Riley, Angus Genetics Inc. president.

The organization began including genomics in the genetic evaluation in 2010 with the idea of using this technology to enhance accuracy, evaluate for traits at earlier ages and predict difficult-to-measure traits for Angus breeders.

TEXAS BEEF COUNCIL RELEASES 2021-2025 LONG RANGE PLANS

Texas Beef Council released its official 2021-2025 Long Range Plan. Developed over the past few months, this new five-year plan will guide Texas Beef Council through 2025.

Texas Beef Council board of directors worked together to create this industry blueprint, meeting in February 2021 to begin fleshing out the plan. The group continued working throughout the spring season and approved the final version at Texas Beef Council’s June 2021 board meeting.

The plan is based on one primary mission: to strengthen demand for beef as the world’s most preferred and trusted protein. Keeping in mind the Texas Beef Council’s commitment to promotion, research and education, the new plan reflects three core beliefs:

BEEF EXPORTS REMAIN STRONG

U.S. red meat exports closed the first half of the year on a strong note, according to data released by USDA and compiled by the U.S. Meat Export Federation.

Although volume and value eased from the enormous totals posted in April and May, export value was still the highest on record for the month of June and first-half shipments established a record pace for both beef and pork exports.

June beef exports totaled 112,249 metric tons, up 42% from a year ago when exports were still hampered by a COVID-related slowdown in production. Export value was $804.4 million, up 68% from a year ago and the third highest on record after April and May of this year. First-

oin Texas & Southwestern Cattle Raisers Association for a virtual Ranching 101 session at 1 p.m. Sept. 1 with featured speaker Chip Kemp, International Genetic Solutions director of commercial and industry operations.

A tool in this conversation is the Feeder Profit Calculator from International Genetic Solutions. Kemp says the resource can aid producers when it comes to both marketing and long-term decision making within the cow herd.

Kemp will remind cattle raisers of the tried and true basics of generating feeder calf value. He will also discuss modern situations making proven calf performance more necessary than ever before.

A Cooke County rancher experienced the latter last year when an employee sold more than $6,000 worth of his boss’ cattle in his girlfriend’s name and pocketed the proceeds.

Texas & Southwestern Cattle Raisers Association Troy McKinney Special Ranger Troy McKinney TSCRA Special Ranger says James Paul Woodard, a District 11 55-year-old from Gainesville, was indicted June 23 by a Cooke County grand jury. He’ll face second-degree felony charges due to the victim’s advanced age. The grand jury determined Woodard’s girlfriend did not have knowledge of the illegal sales.

In October 2020, the victim reached out to the Overbrook Stockyards in Overbrook, Oklahoma, because he had reason to believe some of his cattle had been sold without permission. The auction market’s secretary contacted McKinney, whose investigation proved Woodard had not only sold cattle there, but also at the Decatur Livestock Auction in Decatur. He always put the cattle in his girlfriend’s name to lower suspicion. While the couple owns four cows, it was not enough to produce the number of calves Woodard sold.

McKinney says this case is a good reminder to thoroughly vet potential employees and to continue to monitor both them and your cattle.

Texas & Southwestern Cattle Raisers Association Special Ranger Ben Eggleston reports five cows stolen July 10 in Sweetwater. The black cows are branded with a connected H4 on their left hip. Anyone with information on this case is urged to contact Eggleston at 806-852-4741.

DISTRICT 4 — NORTH CENTRAL OKLAHOMA Texas & Southwestern Cattle Raisers Association Special Ranger Bart Perrier reports a missing John Deere tractor and rotary brush cutter in Prague. The tractor is a late 1990s 2350 two-wheel drive cabless with a yellow seat. The rotary brush cutter is a model 285 brush hog with a three-point hitch.

UTV missing in Osage County.

Perrier also reports a missing orange and black Kubota in Barnsdall. The UTV is a 2006 RTV900 with no doors and was last seen June 14.

Trailer missing in Grant County.

Texas & Southwestern Cattle Raisers Association Special Ranger H.D. Brittain reports cattle missing, including 12 Angus steers weighing approximately 650 pounds, with no marks or brands.

Brittain also reports 10 missing Dorper ewes with double under bit and 20 lambs.

Texas & Southwestern Cattle Raisers Association Special Ranger Wayne Goodman reports a stolen skid steer in Weatherford. The skid steer is a Kubota SVL752HWC and was stolen at approximately 7:18 p.m.

July 3 from Ellis Equipment. The suspect drove a gray- or silver- colored Ford, crew cab three-quarter or one-ton pulling a heavy equipment trailer.

Goodman also reports four missing American Bucking Bull Inc. registered cattle in Lipan. Last seen March 2, cattle missing include three, five-year-old horned cows; one black with T9 branded on the left ribcage, one black with a white belly and T19 branded on the left ribcage,

Texas & Southwestern Cattle Raisers Association Special Ranger Marvin Wills reports two horses stolen July 18 in Itasca. The horses include a sorrel gelding with a star and white strip, and three white stockings; branded HR on the left hip or thigh. The second horse is a bay gelding with a star and white strip extending onto his upper lip, and three white stockings. The theft occurred at approximately 10:30 p.m. July 18 when a witness spotted a dark colored truck and trailer. Anyone with information on this case is urged to contact Wills at 254-223-2330.

Five head of cattle are missing from a ranch southeast of Menard. The livestock, which consist of four heavybred Angus cows and one Angus/Simmental crossbred bull, were stolen from a property off Ranch Road 1773. All the cattle are black.

SOUTH TEXAS COURT DECISION

VICTORY FOR CATTLE PRODUCERS Previously seized cattle have been returned to owners.

W

hen Darrell Franke, an 81-year-old rancher, died in January, he left about 100 head of cattle and the land they ran on to Jorge and San Juanita Padilla. The couple worked for Franke for many years, helping care for his land and livestock in Goliad County.

The only problem? Franke’s children thought they, not the Padillas, should inherit it.

Contested wills are nothing new, but what happened during the probate trial left area ranchers deeply disturbed — and spurred Texas & Southwestern Cattle Raisers Association to step in.

According to Jim Bradbury, an attorney who represents the association, Franke’s children and the local constable began a campaign to seize the cattle, citing poor body condition scores. Others disagreed with the assessment, saying the cattle looked typical of those that had been through a drought and an unprecedented winter storm.

“So, they round up these animals and haul them off to a secure and unknown location,” Bradbury explains. “Now the Padillas, the rightful owners of these animals, don't know where they’re at. We don’t know where they’re at. Nobody knows where they’re at, except for the humane society.”

The complainant, who is also is a local constable, joining property owner to the Franke property and related to Franke’s children, asked another local constable to join up with an associate of theirs from Brazoria County in contacting the Houston Humane Society.

Together, they were successful. The local judge issued a warrant for the seizure of the animals. But the cattle weren’t sent to a nearby ranch — they were put in the care and custody of the Houston Humane Society. It was not only an interesting choice based on the type of animals involved, but also because Houston is more than 150 miles to the northeast of Goliad. Despite the claims this was in the animals’ best interest, cows and stillnursing calves were separated by authorities.

When local ranchers caught wind of what had happened, they reached out to Texas & Southwestern Cattle Raisers Association.

While the association couldn’t take a position in the formal legal case, members did want to express their concern about the process that took place.

In a letter to the judge who presided over the case, the association’s CEO and Executive Vice President Jason Skaggs wrote, “Based on experiences and other situations involving TSCRA members from across the

Ranching state of Texas, the immediate seizure of livestock is almost unheard of. Immediate seizure without notice should be the most extreme remedy used only when no other alternatives exist.

Here it appears that no other alternatives were explored.

John Zacek, a Texas & Southwestern Cattle Raisers Association director and rancher from Victoria, said the court case never even went far enough for the Padilla’s lawyer to produce witnesses there to testify on their behalf. The judge simply threw the case out.

“While TSCRA cannot determine that the owner was ever issued any caution, concern or warning John Zacek by the county prior to the TSCRA Director immediate seizure, if animal health and well-being is the primary interest of the county in seeking this order, TSCRA believes the most basic aspects of due process require prior notice and warning to the owners that the county contends the livestock are being mis-managed. Had the county done so, local veterinarians or other animal and range science resources should have been consulted. At a minimum, a local large animal veterinarian should be asked to assess the animals.

“From TSCRA’s review of the publicly available materials, it appears the matter was initiated at the suggestion of an interest group from Houston. It is TSCRA’s understanding this interest group also provided the veterinarian who opined on the facts in the affidavit and that the affidavit itself suggested the interest group itself be placed in control of the animals.”

Bradbury says in a hearing the next day, the judge told the Padillas they would have to file a bond of $72,000 if they wanted to appeal to the court’s ruling.

The local ranching community came together, pooled their money to help the Padillas, and paid to start the appeal process and hire Joe Glenn Kahla, an attorney from Jasper. Bradbury helped advise the counsel and prepare for what he called a “lightning-fast turnaround.”

He says it was imperative the association get involved in this case, because an unfavorable outcome would have had far-reaching implications. A different precedent could have been used against cattle raisers across the U.S. But also, Zacek says, “it’s just what the association is all about.

“When times are tough in our industry, our members come together to lend a helping hand,” he adds. “We give a hand up, not a handout.”

He says, regardless of the positive outcome, the case could’ve been handled so much better.

“The court’s ruling to have the cattle returned to Goliad County and to their owner’s possession was a great day for the ranching industry,” Zacek says. “[But still] there simply was a strong feeling among many area ranchers that this issue could have very easily been resolved locally without having to incur the hefty expenses and hauling of these cattle over 120 miles, thus stressing the cattle even further.”

Bradbury urges cattlemen to take note of this case, even if they think it could never happen to them.

“This wasn’t just a case of a family dispute and local politics coming together,” he says. “Something larger was at play, and that’s the policy goals of organizations seeking to end animal agriculture and our way of life.” CT

Through their research, the team of attorneys and ranchers discovered the constable asked an adjoining county to supply a drone and a technician.

“And that person came over, and I think flew four or five hours of visual observation to locate the cattle and observe the pasture and feed conditions with no warrant,” Bradbury says.

That was a turning point.

Bradbury explains they investigated statutes that set out the limited circumstances under which a drone can be used, absent a warrant. In the hearing, Kahla was able to get the constable to admit she never applied for a warrant and using the drone didn’t fall into the purposes set out in statute for use of drone footage.

“Once that was admitted, he moved the judge to dismiss, and then the judge did,” he says. “Much to our delight, the cattle were returned, and the county was ordered to pay fees to the Padillas.”

HUNTING LEASES What every landowner should know before opening the gates to hunting guests.

iffany Dowell Lashmet, an agricultural law specialist for Texas AgriLife Extension, recently spoke on the Texas & Southwestern Cattle Raisers Association podcast, TSCRA Talk, about the ins and outs of hunting leases and what landowners should keep in mind when introducing hunting leases to their operation.

Lashmet says the first step in leasing hunting rights is to make sure to have a written lease laying out all the rights, responsibilities and limits for anyone who might be hunting on the land.

“Make sure there is a lease in writing,” Lashmet says. “I know in agriculture we’re not always the best at that, but it’s really important to write it down.”

She says it’s important each person hunting on the property signs a lease to make sure the landowner is protected if anything happens or damages occur. Every hunting lease is different, but Lashmet says there are a few key items to keep in mind when drafting the document.

One thing to be clear about, she says, is the who, when, where and what as it pertains to hunting.

Lashmet added ranchers also need to consider a liquidated damages clause to protect their livestock and assets. A liquidated damages clause, she explains, is an upfront agreement to pay a set amount for any damages that may occur. It ensures there will be no dispute between the landowner and the hunter over what amount will be owed for damages.

“Instead of fighting over the worth of a cow if she gets shot,” Lashmet says. “Both parties could agree up front over what will be owed as damages.”

Other important aspects Lashmet says to consider are alcohol use, all-terrain vehicles, open flames or rules about gates being left opened or closed. She says ranchers need to address everything related to their livestock or property in the lease to ensure hunters are aware of the regulations and expectations.

“You want to be careful and make sure the hunters know exactly what you want done, like with the gates, for example,” Lashmet says.

Adding hunting to an operation has potential to be a big liability for ranchers, but Lashmet says a couple key steps for ranchers to protect themselves include liability insurance, liability waivers and confirming the landowner has a hunting lease license. She says it is important to have liability insurance specifically covering hunters on the property, as well as any property or housing accommodations the hunters could be using.

Lashmet also mentions two statutes protecting ranchers if their operations fall within the requirements. The statutes are the Texas Recreational Use and the Texas Agritourism Act, both of which can provide limited liability to landowners if someone is injured on their property.

A wildlife management plan is another important aspect of hunting leases, Lashmet adds. Landowners need to do their homework and consider how many hunts they are selling and what kind of hunts are being sold to preserve the wildlife population on their land. She also says it’s important to do homework on the hunters themselves, if landowners are concerned there could be an issue.

The final aspect Lashmet mentions is a hunting lease license, which is a requirement of the Texas Parks and Wildlife Department. If someone is going to lease private land and receive something of value in return, the landowner is required to obtain a hunting lease license from the department. Failure to do so can result in a fine and potential misdemeanor conviction.

There are many factors playing a role in incorporating hunting leases to an operation, whether it’s writing out a lease, making a liability waiver or creating a wildlife management plan. Lashmet says she can’t emphasize enough how important it is for landowners to take all the necessary steps to protect themselves legally if they are going to sell hunts on their property.

BACKGROUNDING CALVES How backgrounding may boost feeder calf value.

G

etting maximum value when marketing cattle is an evolving process requiring careful planning.

USDA National Agricultural Statistics Service 2017 data reports 70% or more beef calves are born in the spring. Come fall, this leaves the glut of 550-pound calves at a price disadvantage compared to their contemporaries held and sold after the first of the year.

Backgrounding calves can open gates to new revenue paths, though not without risk. When more cattle are sent to the grazing fields or grow yards, there’s a shift in the market’s seasonal patterns and more opportunity to take advantage of better prices.

WEIGHT ADDS DOLLARS

Even for a couple months, backgrounding can add weight and gross income without using limited grazing resources year-round to stock more cows.

Adding weight may boost income, but requires strategy, says Dan Loy, director of the Iowa Beef Center at Iowa State University. He suggests backgrounding the lighter half of steers to reach heavier average sale weights.

“If you market the heavier ones direct from weaning, and have done that for years, you'll have a more uniform group,” he says. “That in itself may help the price on those heavier calves.”

If it seems overwhelming to add a backgrounding enterprise, don’t be afraid to hire expertise, says Chad Cargill, of Cargill Ranch LLC, Medicine Lodge, Kansas.

Every producer has different needs, but the staples are the same. Bunk space with some kind of concrete apron or a grass trap on which feed can be delivered with a mixer wagon, are necessities, as are a chute and working facilities to vaccinate or treat sick calves.

“These resources are a substantial investment but necessary for successful backgrounding,” advises Dale Blasi, Kansas State University Extension beef specialist.

TIME BOOSTS HEALTH

Calf health is often the highest concern for feedyards, so this also gives calves’ immunity time to get through the most stressful event in their lives.

According to the 2020 Iowa Precondition Sales data, Loy says preconditioned calves vaccinated for respiratory and clostridial disease, treated for parasites and weaned for 45 days brought at least $50 per head more than unweaned contemporaries.

As calves mature, their immunity improves. That’s important as natural beef labels and other process verified programs become popular. The biggest challenge for those kinds of programs is ensuring calves’ health so they aren’t disqualified due to antibiotics.

Yesterday’s most valuable feeder calf may only be average moving forward. That’s because buyers still look for groups with uniform weight and hide color, but verification is gaining importance. The market may soon require certified pre-weaned and vaccinated, agesource-and-genetics verified, records for performance and carcass history, along with animal welfare claims.

When it’s time to head down a new road of marketing, learn from others who have made the trip before you, Blasi suggests. Network and learn from your peers. CT

U.S. RED MEAT EXPORTS New study reveals the impact of global trade on U.S. agriculture.

.S. beef and pork exports brought critical returns to the corn and soybean industries in 2020, according to an independent study conducted

by World Perspectives Inc. and released by the U.S. Meat Export Federation. According to the study, U.S. beef and pork exports added 41 cents per bushel to the value of corn and $1.06 per bushel to soybeans in 2020.

“As the study indicates, my farm gains from red meat exports in the price of every acre of crops that we grow,” says Dean Meyer, who produces corn, soybeans, cattle and hogs near Rock Rapids, Iowa. “Red meat exports are vital to my family’s operation.”

Corn and soybean producers support the international promotion of U.S. pork, beef and lamb by investing a portion of their checkoff dollars in market development efforts conducted by U.S. Meat Export Federation. This funding is leveraged with support from pork and beef checkoff programs and USDA. Meyer also highlights the industry-wide collaboration behind the promotion of value-added U.S. red meat in international markets.

“Something else this study points to is how different sectors of U.S. agriculture can work together to benefit the industry as a whole.” With such collaboration, Meyer adds, “there is great potential for U.S. agriculture on the world stage.”

Key findings from the study, which utilizes 2020 export data, include:

VALUE OF RED MEAT EXPORTS’ FEED USE •

Beef and pork exports used 530.5 million bushels of corn. At an average annual price of $3.52 per bushel, beef and pork exports accounted for $1.87 billion in market value to the corn industry.

•

Beef and pork exports also used 3.03 million tons of distiller’s dried grains with solubles at an annual average price of $154.59 per ton, generating $468 million in market value for ethanol mills’ coproducts.

VALUE TO U.S. CORN AND SOYBEAN CROP •

In 2020, beef and pork exports contributed 41 cents per bushel, or 11.5% of the average annual price of $3.52 per bushel. With total production of 14.18 billion bushels, the value of red meat exports to the U.S. corn crop was $5.8 billion, meaning corn growers would have lost $5.8 billion in value if there were no beef and pork exports.

IMPROVES BEEF’S IMAGE How public perception of beef has changed through the past three decades.

A

s the Beef Checkoff celebrates its 35th anniversary, the National Cattlemen’s Beef Association, a contractor to the Beef Checkoff, is shining a light on the successful promotion and research programs driving beef demand.

Consumers today are more open to beef’s nutritional benefits than at any other time since the Checkoff began more than three decades ago. But getting here was not easy and required consistent long-term investment in nutrition research to turn the tide.

The Beef Checkoff was implemented at a time when U.S. Dietary Guidelines encouraged Americans to limit beef in their diet and reduce their intake of fat and cholesterol. This coincided with Americans’ growing interest in healthy lifestyles, and it quickly became clear nutrition and health concerns could be a potential barrier to consumers eating beef.

To address the concerns and further understand beef’s role in health, the Checkoff began funding nutrition research. Through the years, the Checkoff has made significant contributions to the scientific understanding about beef’s role in health. And now, The Dietary Guidelines for Americans recommend introducing solid foods, like beef, to infants and toddlers, in order to make every bite count with protein, iron, zinc and choline.

“I’ve seen firsthand the evolution of nutrition behavior over the years,” said Becky Walth, South Dakota producer and member of the nutrition and health Checkoff committee. “The Beef Checkoff has been ahead of the curve, conducting research to demonstrate the importance of beef in a balanced diet.”

Beyond Our Gates Two landmark studies reinforce that beef not only fits heart-healthy diets, but may also help decrease risk of cardiovascular disease when included in hearthealthy diets. The Beef in an Optimal Lean Diet, or BOLD, study found people can enjoy 4-5½ ounces of lean beef daily, as part of a heart healthy lifestyle to lower blood pressure and improve cholesterol levels.

The Mediterranean-style eating pattern study found that eating a Mediterranean diet including 7-18 ounces of lean red meat per week can improve cardiometabolic disease risk factor profiles.

The Checkoff has done more than just defend beef’s position in heart-healthy diets using a strong foundation of science. In fact, nutrition research has been helping people discover the benefits of beef to health across the life span, starting with protein.

Recent studies have focused on the power of protein and its impact on physical and emotional strength.

While other research has shown the importance of high-quality protein for the aging population, as well as demonstrating beef’s critical role in growth and development, especially as a high-quality source of iron for older infants, women and girls.

New challenges are on the horizon as the nutrition and public health community grapple with how to ensure everyone has access to sustainable healthy food. BEEF LOVING CHEFS EXPLORE

PASTURE TO PLATE Connecting chefs with the product they (and their consumers) love.

I

t was a welcomed sight as Beef Loving Chefs, a program of the Texas Beef Council, joined together for their first in-person tour since the COVID-19 pandemic.

The council hosted 14 chefs in May for a “Pasture-to-Plate” tour in Amarillo.

“We were really excited to get back in the field after a long hiatus,” said Robert Hale, manager of culinary and foodservice for Texas Beef Council. “There was no better way to reignite the momentum we’d been building with our Beef Loving Chefs program than to host chefs from all over the state of Texas for a pasture-to-plate tour. It’s a great way to connect chefs with people who are producing beef they love.”

Since 2018, Beef Loving Chefs has arranged pasture-to-plate tours by working with beef producers and industry professionals to secure tour locations. Texas Beef Council staff take chefs out to cattle ranches where they can chat with producers about how they raise wholesome, delicious beef. These groups also tour other industry sectors to learn about beef’s role in a sustainable food system.

At the most recent event in Amarillo, chefs went behind the scenes to get a first-hand look at the inner workings of the cattle industry. They visited West Texas A&M University where animal science professors spoke on a wide range of topics, including sustainability, carcass grading and cattle genetics. The group also toured a cattle feedyard, cow-calf operation and beef packing plant, all located near Canyon.

“As the foodservice industry regains its footing after a difficult 2020, we want to ensure that chefs throughout Texas consider beef as they develop their new menus,” said Russell Woodward, senior manager of channel marketing for Texas Beef Council.

JAMES “ROOTER” BRITE JR.

CARING FOR THE LAND Knowledge is power when conserving natural resources, TSCRA director says.

J

ames “Rooter” Brite Jr. can recall with ease when he learned being a good cowman meant more than taking care of your cattle.

In the early 1960s, Brite’s father partnered with a local conservation program. After seeing the family’s ranch near Bowie through the droughts of the 1930s and 1950s, the elder Brite was determined to equip himself with better knowledge for the future. Participating with the government provided the opportunity to learn from stewardship experts and agronomists.

“They would spend the whole day out here and go over things with us,” says Brite, who was a child at the time. “If they were on the ranch and I wasn’t in school, I was with them.”

That time impacted Brite, who later went on to Texas Christian University’s ranch management school. Soon after graduation and returning to the ranch, he was elected to serve on his local Soil & Water Conservation District board — a board he still sits on today.

“I can tell you there is a lot I still don’t know,” he says.

“The learning curve is continuously increasing and at a faster rate. It’s hard to keep up, but the more we know, the more we can do, and the more we do, the more we can produce. It’s a dynamic we need to pursue, and being involved gives me access to continuing education.”

Brite has made the most of that education, implementing numerous land stewardship practices into the ranch’s conservation plan. He also relies on transects to help record and project the average production of his grasslands, thus allowing him to adjust his conservation plan and grazing management.

“We’ve done them every year without fail since 2010 or 2011, and I wish I had started sooner,” he says. “It’s allowed us to increase the productivity of the ranch without increasing expenses.”

While Brite’s grandfather and father ran strictly a purebred Hereford operation, today, the ranch is stocked with Red Angus, Angus and Hereford genetics. The family have been Texas & Southwestern Cattle Raisers Association members for as long as Brite can recall, and he was elected to serve as a director in 1999.

“My mother said, ‘You take care of your land, or God will take it away from you.’ And I know God can come in different forms. We’ve seen people lose land to foreclosures and bankruptcies, and it wasn’t because they did anything intentionally wrong, but they failed to take advantage of knowledge,” he says. “So her words have stuck with me.” CT

ersistence pays off.

Just ask Texas & Southwestern Cattle Raisers Association Special Ranger H.D. Brittain, who applied for the position every six months for seven years before getting the call for a job he’s now held 24 years.

And though he admits he’d almost given up by the time he got hired, it was worth the long wait for Brittain, who’d always dreamed of combining his love for law enforcement and ranching.

Brittain, who is based in Christoval and serves the association’s District 19, began his career with the Erath County Sheriff's Department. He started in dispatch while still going through the Police Academy and moved his way up, eventually working as an investigator. When former Executive Director of Law Enforcement and Theft Prevention Services Larry Gray first hired Brittain, it was

But as much as the job has changed over time, one thing remains the same: his top piece of theft prevention advice.

“Brand your cattle,” Brittain says, without hesitation.

“It’s like having a serial number on your television.

Because if it’s just a black cow that’s missing, that black cow is more than likely gone unless it winds up with an honest person.” CT

I

n the 18 months Lori Blankenship has worked as a Texas & Southwestern Cattle Raisers Association market inspector, she’s had more than a few sideways glances come her way.

She gets it: the 5-foot-tall grandmother with a purplestreaked ponytail and turquoise nail polish doesn’t look like she works in an auction market. But she has no doubt it’s where she belongs.

Blankenship spent most of her career as a veterinary nurse working in large animal clinics. Between the wear and tear it was causing on her body, and the lack of time it left for her family, she decided it was time for a change.

While Blankenship says her previous gig prepared her well for working with cattle and extensive paperwork, there was one aspect of market inspecting that came as a shock.

“I was surprised to learn how emotionally invested I’d become,” she says. “The people who come to this barn are a family. If someone calls with an issue, I know them. I’ve sat with them at the sales every week.”

Blankenship says while she’s always loved working with cows, it’s the cattle people who make her love her job.

She says, “There are a lot of good, good people at sale barns.” CT
