News Briefs Home Construction Booming In Folsom The biggest surge in homebuilding recently has come in south Placer County. But another city in the Sacramento region also is seeing strong new-home growth: Folsom. According to Folsom’s director of public works and community development, after several years of 10-12 home permits being issued per month, Folsom issued 57 permits in July, and is on pace to average about 60 per month for the remainder of the year. The city’s has approved six subdivisions of between 40 and 130 lots, with three builders: Elliot Homes, the New Home Co. and DR Horton constituting the bulk of the building. Much of what they’re doing is single-family homes on smaller lots, reflecting market demand for more energy efficiency and not more house than one can afford. As a result, the city is creating a public utilities financing plan for south of Highway 50, enough to accommodate more than 10,000 new homes. Developers have already bought up more than 1,400 potential lots in anticipation of the city expanding there. Roseville Electric Buys Solar Power Roseville Electri has signed a 10year purchase-power contract to get 320,000 megawatt hours of electricity from a photovoltaic plant that First Solar Inc. will build in Kern County. In the first year of the contract, the utility-and Roseville ratepayers--will save $6.5. The contract likely will begin sending electricity to Roseville sometime in 2015, as the Lost Hills solar array

comes on line. First Solar is only waiting for permits to begin construction of the 32-megawatt field. Construction on Lost Hills should start early next year. Lost HIlls will be one of the smaller solar arrays First Solar has planned for California. It is building two 550-megawatt arrays in Desert Center and San Luis Obispo, a 300-megawatt array in San Bernardino County and a 230-megawatt solar field in Los Angeles County. Rocklin Seeks In-Seat Dining Theater Donahue Schriber, who is building a shopping center in Rocklin, is finalizing a deal with Studio Movie Grill to bring to Rocklin one of the Dallas chain’s venues that offer a different kind of movie theater experience by including in-seat dining, a full bar and reserved seating. That’s according to Heather Beal, Donahue Schriber senior vice president of leasing. Like at the more expensive seats at ballparks and arenas, Studio Movie Grill patrons can place orders for food and drinks from their seat, table or counter for delivery before and during the show, the company’s website says. DBE Event Scheduled The City of Sacramento in conjunction with Rudolph & Sletten, Inc. are hosting a DBE event for construction DBE sub-contractors for the Sacramento Valley Station Phase II project. Sacramento Valley Station Phase II is a $28M historic renovation project

of the historic Southern Pacific train depot at 401 I Street, Sacramento. This project follows the completion of the Phase I Seismic Retrofit project. Scope includes site improvements, façade improvements including full window renovation, historic renovation of interior finishes, upgraded mechanical/electrical/ plumbing systems including a new geothermal system, photovoltaic (PV) system, and solar water heating system, tenant improvements for both Amtrak operations and also future tenant lease space. Rudolph & Sletten was selected as the prime contractor for this project and is now seeking out DBE sub-contractors. The event is being held at City Hall on September 4, 2013, 2:00PM in the Council Chamber, room 1103. San Joaquin County Home Construction Rising Fast San Joaquin County home construction is moving at the fastest rate since the start of the Great Recession. At the current pace, builders could put up more than 1,500 new homes and apartments in the county by year’s end with a value of more than $360 million. That’s roughly a 50 percent increase from 2012. According to figures from the California Homebuilding Foundation, countywide permits for nearly 700 single-family homes and 70 units of multifamily housing were issued in the first half of the year. The declared value of those projects totaled $180 million. In 2012, the foundation

reported the county saw about 1,050 units of new housing worth $250 million and in 2011 about 880 homes and apartments valued at $174 million. Most of this year’s new construction is occurring in the south county with about 350, or half of all the singlefamily homes, being built in unincorporated San Joaquin County and another 170 in Manteca, the home building foundation reported. The experts said most of those county permits were for the Mountain House community. Pleasanton Gateway Complex Greenlighted The Pleasanton Planning Commission has approved construction of a

high density, multi-story apartment complex along with 97 new homes on a 27-acre site along Valley Avenue just south of Bernal Avenue and the Pleasanton Gateway Center. The project is planned by South Bay Development, which has owned the entire 37 acre site since 2000. South Bay’s Scott Trobbe told the Planning Commissioners that his plan calls for construction of 210 apartment units in nine, 18-unit and 24-unit three story tall buildings just over 43 feet high. They will include one, two and three-bedroom apartments, each with a one car garage. The buildings will be clustered around a core center with entrances off Valley Avenue, across from the 100-unit Kensington Apartments, and another from a roadway that

runs alongside the south edge of the Gateway Center. The project will include a leasing office building for the apartment, a recreation area that will include a building with a business center, conference facilities, gymnasium and a media center. Outdoor amenities will include a swimming pool and spa, barbecue and fire pit areas, a tot lot, cabanas, outdoor seating and a bocce ball court. Of the 97 single-family homes planned for the site, 62 will be threestory tall homes with a maximum height of approximately 45 feet, and 35 will be two stories tall. The two-story homes will have four bedrooms, three-and-a-half bathrooms, two car garages and range in size from 3,541 to 3,654 square feet. Earlier this month, the council approved construction of a 345-unit upscale apartment complex on Bernal Avenue at Stanley Boulevard that will include a three-building retail center with a drug store and drivethrough pharmacy. The project, to be built and owned by E&S Ring Management Corp. of Los Angeles, will include two, three, and four-story apartment buildings on what is now a barren 16-acre site across Bernal from McDonald’s and an AM/PM gas station. Nevada Court, a cul de sac that serves Congregation Beth Emek, is at the southern edge of the site, and Stanley Boulevard is on the north. Sacramento Light-Rail Will Build New Line Sacramento Regional Transit officials have received official notification that the federal government will grant them $135 million to construct a light-rail line from Meadowview to Cosumnes River College.

RT officials say they will begin laying track in April, and have the four-mile line running by the end of 2015. Roseville Announces Bridge Design Competition The City of Roseville has launched a design competition for two new pedestrian and bike bridges over Dry Creek between downtown and Royer Park. There are two design finalists. Both include an elegant crossing near City Hall. City officials are inviting residents to vote on which design they prefer. You can vote online until Dec. 6. To see the drawings, go to www.roseville.ca.us Citrus Heights Considers New City Hall Proposal A proposal for a new medical office building has officials with the city of Citrus Heights considering whether a new city hall should be part of the package. Panattoni Development Co. has submitted a plan to construct a three-story, 66,465-squarefoot building on property that is part of Citrus Heights’ civic center. City officials said the building is proposed to house medical offices for Dignity Health. To make way for the project, all buildings on the civic center campus, except the Police Department building, would be demolished and a new, two-story city hall would be built north of the current location. “The real heart of the project is the medical building,” said Monica Alejandrez, assistant to the city manager. “It’s a prime spot for them to put it on our campus. The byproduct, hopefully, will be to get a new city hall.”

The square footage of the proposed new city hall, which would be developed by Panattoni in conjunction with the medical office building, would be less than the 38,000 square feet encompassed by the current buildings. But much of that extra square footage is space once occupied by boutiques that didn’t lend itself to city office needs. The proposed city building would be between the medical office building and the Police Department, and city hall parking would be provided north of the Police Department, on what is now the city’s corporation yard. Access to the site would be, as it is now, from Fountain Square Drive. San Ramon Votes To Approve Mixed-Use Project The San Ramon City Council has cleared the way for a mixed-use townhome development to be built by ACRE Investment Co. following an appeal of the project by the mayor. City Council members voted 3-2 to support the planning commission’s approval of the project, which includes 42 townhomes and six livework units. A resolution of support is to be formalized by the council Sept. 10. The developer initially sought approval for 48 townhome units on Ryan Industrial Court where semivacant older office buildings currently stand, which required a change in the city’s zoning and general plan. When that failed to gain council approval in April, the project was changed to meet the area’s current mixed use zoning plan. Demolition of the office buildings and construction could begin this spring

Contractors Should Prepare For Potential Changes Now Topic Sponsor Most people, regardless of political affiliation, agree that the current immigration system is broken. Although President George W. Bush pushed hard for immigration reform, the tragedy of 9/11 changed everything relating to immigration. Now, almost 12 years later, the opportunity for reform presents itself again. Where it Stands Earlier this year, the Senate “Gang of Eight” (Michael Bennet, D-Colo.; Richard J. Durbin, D-Ill.; Jeff Flake, R-Ariz.; Lindsey Graham, R-S.C.; John McCain, R-Ariz.; Bob Menendez, D-N.J.; Marco Rubio, R-Fla.; Chuck Schumer, D-N.Y.) introduced the controversial Border Security, Economic Opportunity, and Immigration Modernization Act, otherwise known as S.744. After a series of revisions and a number of amendments, the U.S. Senate passed the bill 68-32, with all democrats and 14 republicans voting in its favor. The bill is a work of compromise. As written, it encompasses overhauls to the immigration system on every front, from border security to humanitarian visas. The amendment that secured passage of the bill was designed to increase border security by, among other things, providing for the construction of a 700-mile border fence, mandatory E-Verify implementation for employers, an exitentry system that can track foreign Page 10

nationals who come to the U.S. on myriad visas and, most significantly, an administrative “trigger” that purportedly ensures that unauthorized workers currently in the U.S. do not gain permanent residency until the government deploys 20,000 additional agents to the border. President Obama, most democrats in Congress and some republicans have pressed the House to approve a similar version of immigration reform. House leadership, however, has indicated that it will not vote on a House version of S.744 but instead will take its time to develop its own immigration bill, possibly requiring that the bill receive support from a majority of House republicans before it is submitted for a vote. Groups on multiple sides of the issue have lined up with many Tea Party and other conservative groups insisting on stronger border security and limited or no right of citizenship for currently illegal immigrants. Many organizations have launched advertising and lobbying campaigns for and against various aspects of the bill. What Reform Would Mean For the U.S. construction business, the three most significant changes that would take place if S.744 became law are the following: • The legalization and potential 13year path to citizenship for the majority of the 11 million undocumented

immigrants currently in the country • A possible guest-worker program for low-skilled workers • Mandatory implementation of EVerify for all U.S. employers This legislation, if passed, will open many opportunities for employers and employees. However, while there may be more potential construction workers, the construction industry will be under more scrutiny than before to ensure that workers are work authorized. The legislation leaves little room for employers to assert that they did not know of their workers’ lack of authorization to work in the U.S. Until Then In the meantime, the Immigration and Customs Enforcement (ICE) worksite enforcement unit is busy auditing employers’ I-9 forms and employee authorization verification programs. The construction industry is often the target of many of these ICE audits. Audited companies face stiff fines for paperwork violations, and if they are found to be knowingly employing unauthorized workers, they can face criminal penalties. In some states, business licenses may be revoked for serious violations of immigration laws. The Office of Special Counsel of the Department of Justice also has con-


tinued to prosecute employers who engage in unfair employment practices, discrimination and retaliation for reporting any prohibited practice. So, contractors who go too far in their attempts to ensure a legal workforce may run afoul of other laws and face fines from a different government agency. Therefore, regardless of reform, contractors need to be especially careful in their compliance with all laws and regulations relating to immigration and hiring. Where to Begin Establishing these practices in your company will help you remain compliant: • Develop a written hiring and employment eligibility verification policy. • Ensure that your company’s internal compliance and training program covers everything related to the hiring and employment-verification process, including completion of Form I-9, steps for detecting fraudulent use of documents in the verification process and, for those companies to which it applies, instructions for using E-Verify.

• Require the Form I-9 and E-Verify process to be conducted by properly trained individuals only. • Include secondary checks in your compliance process to prevent attempts to subvert the process. • Conduct a Form I-9 and E-Verify compliance audit by an external and knowledgeable immigration lawyer or a trained employee not otherwise involved in your employment authorization verification process. • If you currently complete I-9 forms in electronic format, the compliance audit should include an evaluation of whether the I-9 software that you have chosen is compliant with the applicable regulations. • Ensure that your contracts with contractors or subcontractors have appropriate flow-down provisions that establish their compliance with employment eligibility verification requirements. • Establish a protocol for responding to discrepancy notices or other in-

formation received from government agencies or relevant third parties. • Create a tip-line mechanism (physical inbox, email, etc.) for employees to report activity relating to the employment of unauthorized workers. Also make sure that a protocol is in place for responding to employee tips. • Establish and maintain appropriate policies and safeguards to ensure that authorized workers are not discriminated against in the hiring, firing, recruitment and referral processes or during the Form I-9, E-Verify or social security number verification service processes because of citizenship status or national origin. • Maintain copies of any documents accepted as proof of identity or employment authorization for all new hires. • Work with your immigration counsel to ensure that the goals of your company are aligned to meet the advantages of future immigration reform and to fend off potential liabilities.

mPOWER Placer Reopens Residential Finance Program By: Schiller Cassell Placer County recently reopened the mPOWER Placer program to finance 100% of project costs for residential energy upgrades and water conservation improvements for existing residences. Loans are attached to the property with payments added to property taxes. Qualified owners may borrow from $2,500 to a maximum of 10% of the property value plus the project cost provided total property finance does not exceed 100% of the property value. Owners can request a repayment period (5, 10, 15, or 20 years) subject to maximum limits for specific improvements.

The loan covers program-related costs, soft costs (such as energy audits, consultant fees, permit and inspection fees) and hard costs for construction. Program-related costs include 6% interest plus fees for enrollment, processing and assessment. Rebates and incentives earned on completion, such as those under PG&E Energy Upgrade CA, would be paid directly to the owner. To qualify, property ownership generally must be in good standing (i.e. property tax and mortgage payments current), not subject to bankruptcy, and having no involuntary liens.

The program also requires property owners to attend an mPOWER financing seminar followed by Q&A. mPOWER Placer encourages owners to obtain a HERS (Home Energy Rating System) energy audit (assessment) to identify and select cost-effective opportunities for energy savings, improved comfort, increased home value and environmental protection. The presentation, for example, emphasizes the importance of upgrading the home before considering solar photovoltaic. Owners interested in participating in mPOWER Placer should also consider the potential impact of rising energy rates, the new time-of-use rate (effective November 2013), and the new 2013 Energy Efficiency Standards (effective January 1, 2014). Event Update

New Prison Realignment Proposals The U.S. Supreme Court recently rejected Governor Brown’s petition to appease a Three Judge Federal court demand to reduce the state prison population by an additional 10,000 inmates by December 31. In preparation, Governor Jerry Brown has put forth a $450 million twoyear proposal to accommodate the court’s directive. His plan recommends a transfer of 4,100 inmates to county jails and private prisons, and the transfer of another 8,500 inmates out of state. The proposal will also allow inmates to earn additional time off their sentences by serving at firefighting camps or meeting certain education requirements. It would also expand inmate eligibility for medical parole and elder release. In the face of this now two-pronged public safety crisis, AB 109 Realignment and the U.S. Supreme Court decision to put 10,000 more felons into our communities, I have asked the Governor to call a special session before the Legislature adjourns in September to deal with this growing crisis. It is more important than ever for citizens to work with local law enforcement officials in their neighborhood to secure their person and property from the increasing number of felons who roam our streets and to support legislation to correct deficiencies in AB 109.

Community Profile: Local Teen Launches “Operation ICE Pack” Eighteen-year-old Christian Wheeler of Roseville has launched a community-wide operation to help teen drivers in the event of an emergency. Wheeler recognized through his community service project that many teen drivers are prone to accidents, and more often than not, are less aware or equipped to handle the necessary safety precautions in the event of emergency. This young teen sought out the help of his local public safety agencies such as the California Highway Patrol, the Department of Motor Vehicles, Mothers Against Drunk Drivers, local police departments, small businesses, and city councils to produce and distribute 2,500 In Case of Emergency Packets, otherwise known as “ICE Packs.” Wheeler has created bright orange kits that contain those items that are primarily needed in the aftermath of an accident or road-side emergency. To date, Wheeler has begun distributing his ICE Packs to young drivers, and they can be found at the local library, driver’s training classes, PTA meetings, and even a local auto-body shop. Wheeler’s efforts have been recognized by the Roseville Press-Tribune and he has even gone before the

Roseville City Council to advocate for its distribution and use. He currently is going to businesses door-to-door to enlist help to spread automotive understanding and safety among young drivers. I am pleased to draw attention to this innovative young man who took his community service project to new heights by bringing awareness to safe driving habits and practices. Capitol Connection Q&A Resource For Contractors By Shauna Krause and David Kalb Capitol Services, Inc. Contractors come in all sizes. Some work close to home while some contractors need licensing across the country. Several quality answers ‘qualify’ as expert assistance to contractors large and small. But first we begin with an important question on an LLC licensing… Q: I have been approached by another company interested in purchasing 60% of my construction company to form a new Limited Liability Company (LLC). I currently hold a license as a Sole Owner/ Proprietor. Can my license be transferred to the new LLC if I will only have 40% ownership of the new company? A: You can transfer your qualification to the new LLC license, however because you only own 40% you will not be able to transfer the license number. The CSLB allows a Sole Owner to transfer their license number to an LLC only if the following conditions exist: • The Sole Ownership license is in good standing; • The LLC was formed by the same licensee as the Sole Ownership license; AND • The licensee maintains ownership directly or indirectly of membership interests evidencing at least 51% of the voting power of the LLC. This can be confusing, so call my office if any further clarification is needed. Q: We are a large company with licenses all over the country. In several States we have listed more than one Qualifier per classification to try

and avoid a situation where someone suddenly leaves and we have to scramble to replace them. We are currently in the process of obtaining a California license and I have heard that CA does not allow for more than one Qualifying Party per classification. Is that accurate?

A: Yes, that is accurate. Often times large companies will have one (or several) of their employees obtain their own Inactive Sole Owner licenses as a sort of “back up” license. That way if the company’s Qualifier leaves, in which case you would have 90 days to replace them, than one of the licensed employees can jump on the license right away without needing to go through testing and fingerprinting. Q: Our Company currently has a “C10” (Electrical) license however over the past several years we have strictly been doing low voltage work. As I’m sure you’re aware, the “C-10” license requires that our employees obtain an Electrical Certification to perform any work. If we wanted to obtain a separate “C-7” Low Voltage license to avoid the electrical certifications, would our Qualifying Individual need to take an exam, or would he be eli-

A: If your company is applying for a separate “C-7” license and your Qualifier has never held the license before then he will not qualify for a waiver of the trade exam. Under certain circumstances, B&P Code section 7065.3 allows an individual to request a waiver of an exam when adding the classification to an existing license. To request this, you have to be able to show that the classification being added is closely related to the classification currently listed on the license. Additionally, you will need to show that low voltage work has been a significant part of the work you have done with your “C-10”. The CSLB will want to see that you have at least four years of experience within the last ten performing “C-7” work at a journeyman level or above. Since your work is strictly low voltage, once you add that classification, you may want request to have the “C-10” classification removed from the license in order to avoid the need for electrical certifications for your employees.

Minor Injuries When we talk of someone being injured, we usually think of serious injuries, such as those involving broken bones or where a lot of blood is lost. We don’t think much about the little incidents, such as scratches, splinters, dust in the eye, and blisters. These things don’t give us much pain nor lay us up. And if properly treated, minor injuries shouldn’t give us serious concern. EVEN MINOR INJURIES CAN BECOME SERIOUS When we neglect a minor injury, however, we could end up in the hospital or even six feet under. Do you think that I’m exaggerating? Consider what can happen if you let a minor cut on your arm go untreated. Germs can enter and cause infection. If the infection, in turn, isn’t treated, it can cause blood poisoning, which can be fatal. TWO KINDS OF INJURIES OFTEN NEGLECTED A hard blow on the head. This can make you dizzy or unconscious for a few seconds. It’s easy to overlook this injury because after-wards you may feel OK, except for a headache. What many of us don’t realize is that a blow on the head can cause a slight concussion or fracture, which can’t be detected except by a doctor. As a result we later may go to sleep and not wake up. So if you have a head injury see a doctor for a checkup. A blow to the stomach. This can occur when you run into something or are struck by something. The blow may knock you down and take the wind out of you, but a few minutes later you may feel OK. Just because there may be no visible injury, however, is no reason for not reporting to first aid. Lt doesn’t take much of a blow to rupture an intestine or start internal bleeding. And these unseen injuries can kill you. REPORT ALL INJURIES The important thing to remember is to report all injuries, even though they are minor and no physical damage is apparent. Get proper first aid and see a doctor if necessary. Use the BOOKMARK feature built into the newspaper, located in the (vertical) navigation bar (dark blue) to the LEFT of the actual paper - it’s the 7th icon down. This will let you bookmark the pages you want and easily return to them whenever you want. Q: Once the search locates potential projects I’m interested in, it would be great if I could mark them somehow for later reference. Then the program could be used to generate a lead sheet either by printing, or on screen, or both that will show only those projects selected. The present system of printing the whole page is not practical. A: One way to create custom lead sheets is to create PDF pages. Use the PRINT icon (nav bar), select the page or pages you want to print, click the print button and then, when the next menu comes up, select ADOBE PDF and the software will print out a PDF of the page(s) you want. From the PDF, you can copy & paste text creating your own lead sheet and setting the font size at whatever works best for you.
