SURETY DIVISION PERFORMANCE BOND MISINFORMATION By John Page, President of Surety Solutions Insurance Services, Inc. an independent, surety bond only agency based in Rancho Cordova, CA The town of Holiday Island, Arkansas had a small roof project out to bid. According to Carrollconews.com, Holiday Island District Manager, Gerald Hartley stated, “no qualified bids were returned.” The reason given was because of the performance bond requirements the city has on all jobs over $20,000. He goes on to state that financial reporting and the “cost of $2,500 to $3,500 was just too much for small contractors to qualify for.” I cannot help but to think he got this information from small contractors that were not qualified to do a $20,000 roof job without putting the taxpayers at risk. The job in question was just over $20,000 in size. The cost of a bond of that size would be well less than $1,000 (probably in the $600.00 range). As far as the financial reporting goes, for a job of that size, all it would take would be an owner of the construction company to have good credit and to complete an application of a couple of pages to get the surety bond. There are several surety companies that now offer “short form” performance bond programs specifically to service small and emerging contractors.

The city is considering waiving or changing the bond requirement which is short sighted. If all it takes is a contractor with good credit to get the bond, why would the city want to risk the taxpayer’s money? Without the bond, the city would potentially have to pay for materials twice and have no guarantee of the workmanship. The surety bond is a bargain for the city and the city’s tax payers. News Briefs Sacramento Gets $115 Million For Flood Control Projects The Sacramento region’s flood-control infrastructure got a fresh infusion of cash Last week with the announcement of about $115 million in federal money for projects for Folsom Dam, the American River watershed and south Sacramento.

center in Citrus Heights could be getting a minor makeover, with a proposal to reconfigure a portion of the development that went before the city’s planning commission last week. Staff’s recommendation was for the planning commission to approve both the design review permit modification and a tree permit for the changes outlined in the proposal.

Under the money, part of the allocation for the U.S. Army Corps of Engineers 2013 fiscal year work plan, the bulk, $98.8 million, will be spent on building an auxiliary spillway for Folsom Dam. Other projects include $2 million to raise the dam and $700,000 to improve flood protection around creeks and streams in south Sacramento County.

Under the proposal from Perkins, Williams, & Cotterill Architects, a portion of a former CVS store at 6197 Sunrise Boulevard would be torn down and a smaller addition constructed. The work would reduce the building’s footprint by a net 10,000 square feet, resulting in a 38,575-square-foot building intended for grocery or other retail users.

Though the funding also includes $13.5 million for American River watershed work, including design to support levees in Natomas and elsewhere, the region still has a bit longer wait for money to finish work on the Natomas basin, where a building moratorium over potential flood issues remains in place.

City staff wrote that the work also would allow construction of a new east-west “drive aisle” that would allow better access by connecting Sunrise Boulevard to Birdcage Street and improve visibility from Sunrise and Sunrise Mall to the east. Pedestrian access would also be increased. The project would also remove and replace several trees within the shopping center and add 30 new parking spaces along the drive aisle.

Jonelle Trimmer, press secretary for U.S. Rep. Doris Matsui, D-Sacramento, said Matsui is optimistic in getting congressional authorization this year to finish Natomas work. “We believe we’re going to see a draft bill in the next couple weeks, and the committee chair wants to have hearings this summer,” Trimmer said. The U.S. Senate included generic language giving such authorization in a bill already passed this year, so having House of Representatives authorization would then allow local flood-control officials to pursue funding to actually complete the work. Shopping Center Remodel Planned In Citrus Heights The Marketplace at Birdcage retail

Final EIR For $70 Million Jail Facility In Porterville Goes To Supervisors Another giant step toward the construction of a $70 million county jail facility in Porterville could be taken soon when the Board of Supervisors is asked to approve the final environmental impact report for the project. The EIR found that any potential environmental impacts can be mitigated, and the board should approval the final EIR to the county can proceed with the project.

The jail EIR is just one of several significant issues before the board today. Also on the agenda is the consideration of salary increases for more than 500 employees and the board itself, an appeal filed by the Tule River Indian Reservation over conditions placed on its plans to construct a wastewater treatment facility to serve residents of the reservation and the introduction of amendments to the county business licence ordinance. The jail is in the design stage, and construction could begin next year or as late as 2016. The county is proposing constructing a 500-bed — 250-double-occupancy units — jail facility on approximately 75 acres on Scranton Avenue just west of Newcomb Street. According to the staff report, the facility will employ up to 172 people working around the clock. Sport Complex In Petaluma Moves Forward A sports complex in East Petaluma that has languished on the sidelines for more than 20 years may actually break ground in the spring. The $23 million East Washington Park, which began as a $2.1 million public-private partnership concept in 1990, could see construction begin next spring on an abbreviated footprint. City leaders last week approved a $210,000 contract for design and engineering work on a $6.7 million segment, which includes at least two — maybe three — artificial turf multi-use fields, lighting, irrigation, frontage street improvements, a gravel road and parking area and provisions for seating and fencing. San Francisco Condo Project Breaks Ground Oyster Development has started demolition and excavation of its 114-condo development in the Mission District, a $70 million project that will eventually abut a refurbished New Mission movie theater. Build Group is the contractor. In addition to the Mission Street site, Oyster also bought a parcel at 1296 Shotwell, which will be handed over to the Mayor’s Office On Housing for development of affordable rental housing. Givas said the neighborhood made it clear they preferred a land dedication over on-site affordable units because it generates more affordable units than on-site affordable (46 versus 14) and provides the flexibility for deeper affordability (by allowing affordable rentals instead of only affordable condos).

Regional Forecast Exceptionally Good During the downturn, new home construction plummeted along with jobs and personal incomes. A new forecast for the Sacramento region predicts these measures of economic health are poised to rise together over the next four years Home building, an economic powerhouse in the region when it’s in full swing, will return in force, rising to levels in line with population growth by 2017, according to the latest forecast by the University of the Pacific’s Business Forecasting Center. The new report for the four-county Sacramento region predicts sizable job growth over the next four years, along with falling unemployment. Personal incomes, adjusted for inflation, will eventually rise again at a rate faster than during the boom years. With more good news, real estate information firm DataQuick reported

last week that the median price for resale homes in Sacramento County rose a stunning 42 percent in the past year, from $160,000 in May 2012 to $227,500 last month. New home prices have been on the rise, too. In Placer County, a prime home building area, the median sale price of new homes rose in May to $378,500, up 23.5 percent compared with the same month a year ago. Michael Strech, president of the North State BIA, said most builders agree the new home market is on track to recover. Tulare And Visalia Summer Projects The Tulare City School District will be replacing the heating, ventilation and air conditioning units at Cherry Avenue Middle School, as well as replacing the roof. The costs for replacing the air conditioning units will be $119,000 and costs for the roof replacements will be $205,000. The district will also be upgrading the refrigerator and freezer units in its central kitchen, where all of the lunch and breakfast meals are made for all 14 school locations. The upgrade will cost the district $81,000.

Other projects the district will be working on during the summer is the remodeling project of the library at Pleasant Elementary School, the installation of window covers at nine school sites and routine work orders for anything that needs to be fixed. Pleasant Elementary School will remodel the existing library and combine it with the computer lab to create more space. Tulare Joint Union High School District will also be working on its own construction projects this summer.

A classroom building at both Tulare Union and Tulare Western high schools will undergo construction. The planning for the new roofing began last October and is expected to cost the district $750,000 for both sites. The district decided to go with the same contractor, Gary Interrante Construction from Exeter, for both sites. For Visalia schools, summer improvements will come by way of Measure E, the voter-approved bond initiative used to fund ongoing construction and renovation projects. The largest project on tap for this summer is the installation of solar panels at 12 schools, beginning July 10. Redwood High School, Highland Elementary and Crowley Elementary — identified by Administrative Services Director David Loverin as the worst offenders in the district when it comes to energy costs — will be the first recipients of the new panels. The remaining schools — Pinkham Elementary, Linwood Elementary, La Joya Middle School, Veva Blunt Elementary, Willow Glen Elementary, Green Acres Middle School, Houston Elementary, Fairview Elementary and Ivanhoe Elementary — will be furnished with the new equipment by November.

replacing two portable classrooms. The school now has just one girls restroom and one boys restroom, and the boys restroom has just one urinal. It was also the consensus of the board to build a permanent, two-story, nineclassroom structure at Belleview, as opposed to a modular building. That will increase the cost of the project from around $2.8 million to more than $4.1 million. The building will replace portable classrooms across the street from Belleview, which have been at the school for 35 years. The construction of the swimming pool at Strathmore High will cost $3.3 million. The pool will be used by Harmony Magnet Academy and Strathmore High students who compete for Strathmore High boys and girls water polo and boys and girls swim teams. Those teams currently have to practice and compete in their home contests at the Granite Hills swim complex. The pool could also be used by youth clubs and possibly even the public as well. The pool will be constructed behind the tennis courts between Spartan Stadium and the junior varsity softball field on the SHS campus. All of the construction projects should be completed during the 2013-14 school year.

Four Porterville Projects Get District Approval

Central Valley Construction Rebounding

The Porterville Unified School District will include what it considers to be its four highest priority construction projects in the 2013-14 budget to be approved by the board at its June 27 meeting. Those projects are a modernization project at Roche Avenue Elementary School, the replacement of portable classrooms at Belleview School, the construction of a swimming pool at Strathmore High and the expansion of Butterfield Charter School.

Construction in the Central Valley made some definite headway by the second quarter of the year, with building permits up more than 30 percent over the same time last year. Throughout Fresno, Madera, Kings and Tulare counties, 4,449 construction permits were issued to builders in the first six months of the year, up 30.5 percent from 3,409 during the same period last year, according to a weekly report by Construction Monitor.

Commercial permits rose from 644 during last year’s second quarter to 667 so far this year. Among those, retail, warehouses and dining jumped from 18 to 26, while offices, banks and professional buildings went from 22 to 33. Industrial and manufacturing buildings and warehouses dipped slightly to 22, although the value of those permits doubled to $39.3 million. Housing Gains Document Economic Recovery U.S. builders stepped up home construction in May and applied for permits to build single-family homes at the fastest pace in five years. The gains show housing remains a key source of growth for the economy. The overall pace of homes started rose 6.8 percent last month to a seasonally adjusted annual rate of 914,000, the Commerce Department reported. Overall, the report points to more evidence of a housing recovery that has become sustainable. New-home construction has risen 28.6 percent since May of 2012. Construction increased in May for both single-family homes and apartments and condos. And builders sought more permits to build singlefamily homes, which make up nearly two-third of the market. The seasonally adjusted annual rate rose 1.3 percent to 622,000 - the highest since May 2008. That’s a sign that construction will increase further in the coming months. A better outlook for housing has made builders more optimistic, leading to more construction and jobs. The National Association of Home Builders/ Wells Fargo builder sentiment index released last week rose to 52 this month, up from 44 in May. That was the highest reading in seven years and the largest monthly increase in more than a decade. Each home built creates an average of three jobs for a year and generates about $90,000 in tax revenue, according to NAHB statistics.

Workplace Safety And Health Heat Stress By: Centers for Disease Control and Prevention Workers who are exposed to extreme heat or work in hot environments may be at risk of heat stress. Exposure to extreme heat can result in occupational illnesses and injuries. Heat stress can result in heat stroke, heat exhaustion, heat cramps, or heat rashes. Heat can also increase the risk of injuries in workers as it may result in sweaty palms, fogged-up safety glasses, and dizziness. Burns may also occur as a result of accidental contact with hot surfaces or steam. Workers at risk of heat stress include outdoor workers and workers in hot environments such as firefighters, bakery workers, farmers, construction workers, miners, boiler room workers, factory workers, and others. Workers at greater risk of heat stress include those who are 65 years of age or older, are overweight, have heart disease or high blood pressure, or take medications that may be affected by extreme heat. Prevention of heat stress in workers is important. Employers should provide training to workers so they understand what heat stress is, how it affects their health and safety, and how it can be prevented.

Heat Stroke Heat stroke is the most serious heat-related disorder. It occurs when the body becomes unable to control its temperature: the body’s temperature rises rapidly, the sweating mechanism fails, and the body is unable to cool down. When heat stroke occurs, the body temperature can rise to 106 degrees Fahrenheit or higher within 10 to 15 minutes. Heat stroke can cause death or permanent disability if emergency treatment is not given. Symptoms of heat stroke include: Hot, dry skin or profuse sweating Hallucinations Chills Throbbing headache High body temperature Confusion/dizziness Slurred speech First Aid Take the following steps to treat a worker with heat stroke: Call 911 and notify their supervisor. Move the sick worker to a cool shaded area. Cool the worker using methods such as: Soaking their clothes with water. Spraying, sponging, or showering them with water. Fanning their body. Heat Exhaustion Heat exhaustion is the body’s response to an excessive loss of the water and salt, usually through excessive sweating. Workers most prone to heat exhaustion are those that are elderly, have high blood pressure, and those working in a hot environment. Symptoms of heat exhaustion include: Heavy sweating Extreme weakness or fatigue Dizziness, confusion Nausea Clammy, moist skin Pale or flushed complexion Muscle cramps Slightly elevated body temperature Fast and shallow breathing

First Aid Treat a worker suffering from heat exhaustion with the following: Have them rest in a cool, shaded or air-conditioned area. Have them drink plenty of water or other cool, nonalcoholic beverages. Have them take a cool shower, bath, or sponge bath. Heat Syncope Heat syncope is a fainting (syncope) episode or dizziness that usually occurs with prolonged standing or sudden rising from a sitting or lying position. Factors that may contribute to heat syncope include dehydration and lack of acclimatization. Symptoms of heat syncope include: Light-headedness Dizziness Fainting First Aid Workers with heat syncope should: Sit or lie down in a cool place when they begin to feel symptoms. Slowly drink water, clear juice, or a sports beverage. Heat Cramps Heat cramps usually affect workers who sweat a lot during strenuous activity. This sweating depletes the body’s salt and moisture levels. Low salt levels in muscles causes painful cramps. Heat cramps may also be a symptom of heat exhaustion. Symptoms Muscle pain or spasms usually in the abdomen, arms, or legs. First Aid Workers with heat cramps should: Stop all activity, and sit in a cool place. Drink clear juice or a sports beverage. Do not return to strenuous work for a few hours after the cramps subside because further exertion may lead to heat exhaustion or heat stroke. Seek medical attention if any of the following apply: The worker has heart problems. The worker is on a low-sodium diet. The cramps do not subside within one hour. Heat Rash Heat rash is a skin irritation caused by excessive sweating during hot, humid weather. Symptoms of heat rash include: Heat rash looks like a red cluster of pimples or small blisters. It is more likely to occur on the neck and upper chest, in the groin, under the breasts, and in elbow creases. First Aid Workers experiencing heat rash should: Try to work in a cooler, less humid environment when possible. Keep the affected area dry. Dusting powder may be used to increase comfort.

Capitol Connection Q&A Resource For Contractors By Shauna Krause and David Kalb Capitol Services, Inc. Contractors want a ‘level’ field when making bids with competition. That’s why your license number is required in advertising, signage and other places a consumer can see it. Hopefully, when they check it at CSLB it ‘flattens’ the ambition of unlicensed competitors. We also take a ‘short circuit’ in describing the route to adding a low voltage class… Q: Can we take a contract with a “C-61” license and then subcontract out a portion to a “C” class? For instance, could a “D-28” (Doors Gates Activating devices) take a contract and, knowing that there is some electrical work, sub this portion to a properly licensed “C-10”? A: It should not be a problem as long as the subcontracted work is incidental and supplemental (i.e. essential) to the completion of the “D-28” project. To the best of my knowledge, there is nothing in the law or regulations to preclude a Specialty Contractor from doing (or subcontracting) incidental work. Q: We currently have a “C-10” Electrical license and we are starting a new corporation that will focus on doing low voltage electrical work. Can my boss obtain a separate license for the new company and get a waiver of the “C-7” low voltage exam since he has the “C-10” classification already? Because of the certification requirements of “C-10” electricians he wants to have a stand-alone “C-7” license. A: Except in extremely rare cases, the CSLB will not grant a waiver of a trade exam for a brand new license

unless the qualifying individual has previously held the classification. He can however apply to add the “C-7” to your existing license and request to waive the exam. Keep in mind that this is only a request and in order to be approved your boss will need to show proof of at least five years of work experience within the last 7 years where the “C-7” (Low Voltage) was a significant component of the “C-10” project.

A: Unfortunately many unlicensed “contractors” advertise that they meet all the state requirements when in fact they do not have a valid contractor’s license; bonding, or Worker’s Compensation coverage for their employees. In your case, we searched and could not locate a valid license; however, we did locate someone with that name who had a license that expired two years ago. This same individual has a pending judgment against him and other pending legal actions.

Once the “C-7” has been added to the existing license he can then apply for a stand-alone low voltage license for the new company. Q: I’m a homeowner and found your name on the Internet. I want to hire a contractor (for a small bathroom remodel) who advertises in our local newspaper, but could not locate his name on the CSLB website. He said he was “licensed, bonded and insured” and gave me a good price for the work. You folks appear to know a lot about contractors and I was hoping you might have some advice. Our advice is to stay well clear of this “contractor” and find someone who has an active contractor’s license in good standing. Also, make sure if the contractor has employees, they are covered by Worker’s Compensation. While this unlicensed individual may have given you a “good price”, you’ll likely end up paying much more in the long run. If this guy lied to you about having a valid license, bonding, etc. can you really trust him to keep his word regarding your bathroom remodel? So, no valid license, judgments pending and less than truthful is three strikes, you’re out!

Buckle Up - Save A Life ‘’Belt your wife - save her life”, “Click it or ticket’’, and “Buckle up – it’s the law”, are a sayings we’ve heard frequently over the years. Seat belts were first offered by U.S. automobile manufacturers in the early sixties. Those pesky old belts have been around for 40 years now but we still see people operating motor vehicle without them. The National Safety Council reports in their 1992 Accident Facts edition that 43,500 motor vehicle deaths took place in 1951; 3,500 of these deaths happened at work. The cost of these motor vehicle accidents was an astronomical 96.1 billion dollars! Many of these injuries and deaths could have been prevented if those involved had taken time to ‘’buckle up”. Studies by the National Highway Traffic Administration show that manual lap and shoulder belts are effective in preventing fatalities, 50% effective in preventing moderate to critical injuries, and 10% effective in preventing minor injuries. In early 1992 over 40 states had enacted mandatory safety belt use laws, but studies show that only 55% of the motoring public wear their seat belts. Many new cars and trucks are now equipped with supplemental restraint systems (SRS), better know as air bags. For the SRS to be effective the operator and/or the passenger must be wearing their seat belt to fully benefit from the air bag. You may think of many reasons why you don’t or can’t wear your belt -- “they’re uncomfortable”, ‘what happens if I’m knocked unconscious and can’t get out”, “hey, I’m only going to the store, nothing will happen”, or “never had an accident so I don’t need a belt” -- all of these are just excuses and indicate plain stupidity or a very poor safety attitude. Remember, YOU are the ONLY ONE to make the decision whether you do or don’t buckle up. On or off the job, start the new year by making every trip a safe one by buckling up, and insisting that all passengers in your vehicle do the same. Who knows, the life you save may be your own! IT’S A PROVEN FACT - SEAT BELTS SAVE LIVES - BUCKLE UP!

The Internet Accounts For 4.7% of the U.S. Economy

Survey Says: 77% of Americans would be willing to give up chocolate for an entire year, rather than go without the Internet. Only 21% though would give up sex, and an even smaller 7% would go without a shower.

According to a recent survey conducted by CNN Money, the Internet contributes more to the American economy than the entire federal government, according to a new study by the Boston Consulting Group. The Internet accounted for $684 billion, or 4.7% of all U.S. economic activity in 2010, Boston Consulting Group found. By way of comparison, the federal government, contributed $625 billion, or 4.3%, to the nation’s output. If it was considered its own separate industry, the Internet would also be larger than America’s education, construction or agricultural sectors.

In the retail sphere alone, e-commerce accounted for 5% of U.S. sales in 2010. “All businesses are increasingly digital and need to think about how to take advantage of these opportunities,” said Dominic Field, a BCG partner and co-author of the report. Boston Consulting Group predicts the Internet will grow about 10% a year through 2016 in the Group of 20 nations.
