CHILD TRUST FUNDS HAVE YOU FORGOTTEN WHERE YOU PUT IT?

C

hildren born between 2nd September 2002 and 2nd January 2011 benefited from the Child Trust Fund (CTF) introduced by the Labour government as an attempt to encourage children to save.

Between these dates, new born children were given a £250 voucher each to be held in a CTF with an additional £250 credited at age 7.

Parents were given the opportunity to select the CTF but, if they didn’t, government selected it for them. Additional contributions were permitted up to a current limit of £4,260 pa. ere were eligibility requirements but, broadly, if parents qualified for child benefit in respect of the child then the CTF was available. And, CTFs had all of the same tax advantages as ISAs. ese accounts are administered by the parents until the child reaches age 16 at which stage the child takes over the administration, including selection of investment funds. ere is no access to the investment until the child attains age 18. e CTF was replaced by the ‘Junior’ ISA (JISA) in 2011 and this had broadly similar limits but, because it was an ISA, there were far more providers available and JISAs were cheaper than the CTF as well as having much wider investment options. e lack of access to the investment until the child attains age 18 was carried forward into

the JISA regime. CTFs are no longer available although it remains possible to contribute to existing CTFs BUT it is not possible to have a CTF and a JISA for the same child. Of course, the big difference is that there are no government contributions towards a JISA. So, why the history lesson? Well, it seems that nearly £1 million CTFs are ‘lost’ as families have lost paperwork or moved home without remembering to tell the CTF provider etc. And with the ‘average CTF’ being worth £650 (£500 from government and some growth) that’s a lot of money unaccounted for. And, of course, the first cohort of CTF beneficiaries is now reaching age 16 and can/should be taking control of their accounts themselves. Of course, since there are no more funds coming into the account from government, this is also the time to think about transferring the CTF into a JISA, which has been possible since April 2015 in order to benefit from the generally lower costs.

If you are the parent of a CTF beneficiary and can’t remember where it is – the CTF, not the child – the tax man can help as they have pretty complete records. HMRC has set up a ‘find your CTF’ service which requires signing into the Government Gateway www.gateway.gov.uk n

oopersale Hall in Epping is one of the privately-owned local Group of Oak-Tree Schools and takes children aged 2½ to 11. One of its strengths is recognising trends, and the school is currently aware of the ongoing requirement for more and more flexibility for parents and the need for full wrap around care.

In a recent survey almost 39% of schools said parents wanted wrap around provision, including an earlier start, a later pick-up time, and holiday provision. Coopersale Hall recognises that working parents need childcare flexibility outside of normal school hours provided on site.

Headmistress, Kaye Lovejoy says, “Our wrap-around care is very popular with parents looking to balance work with their children’s school lives. Breakfast Club runs from 7.30am each morning and Teatime Club runs until 6pm.

We have also been introducing more and more holiday clubs in the longer breaks at Coopersale Hall as well as at the other Oak-Tree Schools.

Commonly asked questions of upon commercial and residential development Nicky Cleightonhills - Property and Development Solicitor, Chigwell | Ranked in the Legal 500 Somewhere, amongst the pages of an auction catalogue or an agent’s books, is a plot of land: it is sufficiently far away from the furthest neighbouring building so no rights of light apply; it immediately abuts the registered highway so access is not an issue; planning has already been granted and no one objected; it is subject to no tenancies or charges that could be problematic; no one has thought to impose overage on the site that would force a split of profit with another; there are no restrictive covenants which are at odds with the proposed build; and there has been no historic land use which gives rise to environmental considerations. Sounds great, right? But how often is this the reality?

What land do we see being developed?

The above dream site is increasingly uncommon within the South East where developers are forced to maximise land already owned.

Brownfield sites are obvious ones, sometimes development through demolishing an existing building and replacing it with something bigger and better, sometimes it is fitting in another building between two existing buildings or making use of the land beneath the subsoil or an airspace development.

How might existing tenants prevent further development?

Rights under the existing leases: Consider whether the existing tenants have rights over the area to be developed: whether rights to enter to carry our repairs to the tenant’s own premises, rights to park, rights of way etc.

For example, landlords can’t put a building on the tenant’s car park and may not be able to put a building on parts where rights of recreational use have already been granted either. Disgruntled tenants threatening an injunction on the basis that the landlord’s proposals constitute a derogation of grant can be avoided in advance of construction.

What needs to be considered when a landlord wants to maximise the development potential of an existing site?

Right of first refusal: If there are residential tenants on site, in certain circumstances a disposal by a landlord of any space will be deemed a relevant disposal under the right of first refusal provisions of the Landlord and Tenant Act 1987. Before granting further leases or selling part of a site for development a landlord may need to offer existing tenants the right of first refusal. We often find that tenants can be motivated to accept this opportunity – even if they have no development aspirations themselves, they may wish to thwart any development going on above their heads, under their feet or in the communal garden.

Air space and basements offer a chance for development where there is little available land on the ground or where there is a building with large external areas where there is room to fit in another building. The chances are that the freeholder has already disposed of the site by granting tenancies to existing occupiers, whether residential or commercial. There is

Have the existing residential leases reserved the right to develop the landlord’s building as the landlord

deems fit? How will the landlord reach any upper parts? Are there rights to construct scaffolding outside the windows of the existing tenants?

If all else fails, the landlord may need to consider whether it needs vacant possession.

Ideally if the tenants cannot agree a harmonious development, it may be better for the tenants to leave and the parties to be able to agree an informal surrender. If that is not possible then rights to break the lease would need to be considered together with whether the tenants have security of tenure rights under various legislation.

SPRADBERY CELEBRATING THE OPEN AIR SOCIAL 80TH ANNIVERSARY

n ‘Open Air Social’ event that Spradbery and his wife Dorothy held at their home in 1938 was again held last month to celebrate the 80th anniversary.

An estimated 500 people came along to see the stalls, sideshows, donkey rides, traditional dances and art displays and raised over £600 for St John’s C of E Primary School. e event brought together the local community with Buckhurst Hill Residents Society working in partnership with the council, school and St John’s Church, Buckhurst Hill. ere was a specially choreographed dance performance

by Flux Dance Collective who worked with pupils from the school to create a piece inspired by Spradbery. A historical interpreter played the role of Walter Spradbery, leading tours into the Wilderness to visit the site where the house once stood, next to the school. Buckhurst Hill Community Association and Bedford House both had art exhibitions on display, and there was a small exhibition about Walter Spradbery. e day ended with a fun

performance by Impropera, the world’s only improvised Opera Company. is event is part of a programme of activities for the ‘Walter Spradbery, Artist in War and Peace’ exhibition, at Epping Forest District Museum, Waltham Abbey; on display until Saturday 22 December 2018.

Spradbery is best known for his poster designs for London Transport, one of which was recently used on the new signboards marking the boundaries of Epping Forest. He and his wife, opera singer Dorothy D’Orsay, also held many musical and opera performances in the gardens of ‘e Wilderness’ for the local community.

Spradbery was also a committed pacifist. He served in the Royal Army Medical Corps during the First World War, receiving the Distinguished Conduct Medal for his bravery in rescuing injured comrades under intense enemy fire. n

So many clients spend time and money on their face and neck but sadly neglect their chest and backs of the hands. Women will experience fluctuations in weight and lose the fatty layers in the hands especially at the start of menopause, it leads to veins and tendons becoming more noticeable.

THE DO’S AND DON’TS OF A RHINOPLASTY ( NOSE JOB ) Michelle Harris interviews Mr. Gaurav Kumar, ENT Consultant Surgeon

A

rhinoplasty can be one of the most important decisions of a lifetime. If you’re conscious of your nose, unhappy with its shape, size or tip, can be the cause of much grief, loss of confidence, anger and resentment every time you look in the mirror. But what do you need to consider if contemplating a rhinoplasty?

Michelle: Where do you begin to select a surgeon for a nose job?

Mr. Kumar: Firstly, it’s important to remember that the nose is far more than just an object on your face. Its primary purpose is to facilitate breathing. But also, who can structure an attractive well-shaped nose?

Michelle: Assume it is possible to have a beautiful and functional nose?

Mr. Kumar: Absolutely. When considering surgery, to ensure that the specialist operating factors in both the patient’s wish for a perfect (and realistically shaped) nose but also to retain its function and purpose. At worst, you do not want to end up breathing through your mouth for the rest of your life as an alternative to your nose.

Michelle: Have you personally, had many patients requiring revision surgery to rectify a rhinoplasty issue?

Mr. Kumar: Yes. I would say approximately 10% of my rhinoplasty surgeries are second and revision procedures. is could have been potentially avoided by going to an ENT surgeon in the first instance.

Michelle: How does it work and what is the process?

Mr. Kumar: Firstly I will consider the entire face. ere are five symmetrical quadrants; the two ears, area between ear and nose on either side of face, and the fifth quadrant being the nose. It is essential for there to be balance, correct shape to complement the face so the finished result looks natural and absolutely respects the patients’ requirements and objectives.

Michelle: How do people feel after their operation?

Mr. Kumar: Obviously there is the post-operative recovery time, reduction of swelling and healing but then for most, it’s a new beginning. Most patients are in the 18-25 year group and appearance is very important. For me personally, I feel immense pleasure and pride watching the patient’s journey from somebody who maybe shy and unhappy because of the shape of their nose, to a new person who is infinitely more confident and excited about their future because of their new look.

Having a rhinoplasty or indeed any other elective surgery, is a big decision and not one that should be entered into lightly. If considering whether to pursue and wanting to minimise the amount of surgeries that may be needed due to other factors such as potential breathing issues or imbalance, it is absolutely recommended to seek the advice and guidance of an ENT surgeon for a healthy and beautiful nose. n

Pots of Colour As Autumn makes itself feel known, plant some pretty pots to brighten the scene.

HANNAH STEPHENSON digs up top tips.

A

s pots of tired summer bedding are tipped onto the compost heap to make way for autumn and winter flowers, there are certain things you should do now to ensure your container plants for the cooler months get off to a good start. Here’s our step-bystep guide...

Provide good drainage Once you’ve emptied your pots of summer bedding and given the containers a good clean, line the base of your pots with crocks from broken terracotta pots or bits of polystyrene that your new bedding comes in, to make sure you have ample drainage for new autumn and winter bedding.

As autumn rains come, if your pots are exposed to the elements, the roots of your plants can become too wet if you don’t include sufficient drainage when you plant them up.

Mix a handful of sharp stone or grit into the fresh compost to help drainage and stand your pots on feet, so the moisture doesn’t come up through the pot and soak the roots from below.

Fill pots well Unlike summer bedding, which grows rapidly to cover the whole area of the pot, winter bedding is slower to make an impact - so it’s best to plant winter bedding closer together in tubs, troughs and hanging baskets.

They won’t have as much growing time as summer plants had to make their mark, so don’t penny-pinch on the amount you buy.

Don’t over-water Winter-flowering pansies and other bedding won’t need as much water as your summer annuals did, so don’t mix water-retaining granules into the fresh compost, or you’ll end up with rotten roots and wilted plants.

Shelter containers If you have planted up pots with spring bulbs, violas and pansies, put them in a sheltered spot say under a porch or cold greenhouse when the winter weather is at its worst - but make sure they get maximum light so they can benefit from even weaker sunshine.

As the weather gets cooler, protect plants by grouping containers and moving them closer to the wall to keep off wind and rain.

Choose plants wisely Some bedding only appears in the autumn, including dwarf Michaelmas daisies, pot chrysanthemums and miniature cyclamen, while orange-berried winter cherries and ornamental kales appear slightly later on in the season. All can be put to good use in a container and enhanced with evergreen foliage plants.

Garden centres will now be awash with autumn and winter bedding, including pansies and violas, wallflowers, dianthus and cyclamen. Use a showstopper as the centre plant and then use trailers, such as creeping Jenny or ivy, around the outside of your pots, filling the gaps with pretty violas and pansies.

What is a property management company?

When many people hear the phrase ‘property management’ they instantly think of high street lettings agents. While some do deal with flat lettings, property management companies do so much more than that.

The easiest way to understand what a property manager does is by thinking about the communal areas in a housing development, private community or block of flats. While families and individuals are responsible for the areas that they directly rent or purchase, the communal areas, such as hallways, stairways and landscaped areas, are generally managed by a property management company. These companies arrange services such as gardening, cleaning and general repairs while on larger sites property management companies maintain underground parking, lifts, and on-site gyms.

property management companies every year, if they are unhappy with their current service. Most contracts will be auto-renewed, generally with a three-month notice period.

Rebecca continued: “We find that most people who are unhappy with their property management company think that they are stuck, with no options open to them. That simply isn’t the case. It is always worth looking into finding a management company that fits the needs of the property.”

But how does someone go about changing their property manager, especially if they weren’t sure about where to look or who decides the manager for their property?
