All Eyes on You with Miles D. Peterson

From the time I was a personal injury attorney till the present day, there is one message that I strive hard to hammer into my clients. BE CAREFUL WHAT YOU POST ON SOCIAL MEDIA. In all honesty I can end the article there and be satisfied that you got the message, but I’m going to continue to make sure the point drives home.

There is a surefire way to mess up your case, and that is posting something contrary to your claim or defense on social media. Fortunately, my clients seem to listen to my warning (at least for the most part). But there have been multiple times I have been able to get ammunition against the opposing party simply because they are not watching what they post. Recently, I tried a case against an abusive husband. He stated on the stand that he never broke or damaged his wife’s property. After a few set up questions on cross examination I hit him with his Facebook post which not only stated that he broke his wife’s cell phone, but why he did it. In another case, opposing party made claims of having no money or assets to pay his child support. Yet his Facebook and Instagram photos showed his extensive gun collection and wads of cash. Needless to say, when it came time for mediation he folded before lunch.

I tell my clients that if they insist on using social media during their case, it is imperative that

they use all privacy settings. Set your Facebook and Instagram profiles to private, turn on protected tweets on Twitter, and limit your Snapchat to only people you approve. Even after these measures have been taken review your friends list. Are some of your friends also friends with the opposing party in your case? Do you think they would turn over screenshots of your post to the opposing party? If the answer to either of those questions is yes unfriend and/or block them.

You also need to be very wary about what pictures you are posting, sharing, and retweeting. Anything that has to do with drug use, alcohol, gambling, or any other potentially negative vice needs to be nowhere near your social media pages.

Here We Go Again

A Message from the RBCA Chairman

Especially if there are children involved.

Which brings me to my final point, don’t post anything negative about your children, even if done in a joking matter. Because if it is presented as evidence, the Court is going to have to take that isolated post an examine it in a vacuum regardless of context. We all know a joke can be received differently when written instead of spoken because of the lack of tone and voice inflection. So, a joke about your seven-year-old son being “a pest” or how you’re going to “cut” the opposing party needs to be kept to yourself when you’re online. Because when your words are being read to you plainly on the stand in front of a judge and jury, they likely won’t seem like a joke at all.

Now it's in our own backyard. First, we must dispel any thoughts that because this is a "private venture", that "public dollars" are not involved, via tax credits through the City of Dallas Office of Historic Preservation. This process decreases the amount of taxes collected from the business community and further burdens the Dallas residential taxpayers.

The very important Forest Avenue Theater (which is the heart of the Black community and should be handled with a lot of sensitivity; yet there is

none), represents an opportunity for Black-owned Prime firms’ inclusiveness in the process. However, Fort Worth based, The Projects Group (who also did the Dickie’s Arena and yet to find any Blacks to work on that project) decided to selectively issue the RFP to two Fort Worth firms (Linbeck -White and Byrne-Hispanic), one Kansas City firm (JE DunnWhite), and one San Francisco firm (Swinerton-White). I guess The Projects Group either does not think there are qualified Black firms in Dallas, or would prefer to take the money west to Fort Worth, or out of Texas altogether! There is no way Larry James would have done this if he was still over City Square. When he built the headquarters on Malcolm X he included Black contractors which resulted in the largest Black contractor in Texas (Con-Real) and they built that beautiful building on Malcolm X.

Here We Go Again

A Message from the RBCA Chairman (CONTINUED)

Although the Request for Proposal (RFP) is initially for Preconstruction Services, and calls for Diversity, Equity, Inclusion and M/WBE Participation, if you look into the word “whether”, it means if you can’t or, you don’t have to. This is the main part of building any project; this is where growing capacity comes in at. They chose to put “whether” in the RFP, which means you don’t get credit for it if you do and you don’t get credit if you don’t. The most valuable part of the deal is this. We have White, Black and Hispanic contractors in Dallas that believe in true diversity. We have White, Black and Hispanic large construction companies in Dallas that pays taxes in Dallas and most of them believe in Diversity. This project has been looked at for the last two years; the prior developer/owner’s rep and the prior general contractor which was Balfour Beatty, included the Black contractors every step of the way. What happened to them? Is it a possibility that they had too many Blacks on their team? Who is carrying this proxy? It was brought to my attention they installed some new Board members; Who are they? Is it a possibility this is where the Proxy lies? I said this in my last writing: Segregation today, Segregation tomorrow, Segregation forever!

Black firms are once again relegated to waiting on a call from pre-selected firms (none from Dallas, none Black) to potentially "team" or provide services in a support role; but most importantly having to negotiate terms from a

weakened position due to not being in the room from the beginning. Why The Project Group selected firms did not include any Dallas-based or Black-owned firms in this solicitation is mind-boggling. Fort Worth leaders would never allow a project such as this to ignore the Fort Worth business community like they are ignoring the Dallas Black community. But apparently some of our leaders are asleep at the wheel or just doing their Proxy. Dallas - what are we doing? We talk about having to compete with our neighbors to the north and west, and true growth capacity and yet our Blacks are competing with everybody; we say we support true growth capacity but we allow those same neighbors to come into South Dallas, which is 84.6% Black, and ignore Black businesses. Who would do this? I guarantee you, not Larry James.

I guess it's appropriate this is happening during the State Fair of Texas, and nobody is paying attention. Some of our Black

leaders don’t tell the White community to stop it. They just stay on the Merry Go Round.

Proxy, Proxy, Proxy. …More to come

Debra’s Bits & Pieces

Recipe of the Week: Cheesy Ground Beef and Potatoes

DBDT Dancers Show Their Creative Side

When They Take Charge Of The Production

This dish is best described as comfort food. With the cheesy ground beef layered atop a bed of buttery potatoes, you will keep coming back for more. I use a mandolin to thinly slice the potatoes.

• Place sliced potatoes in a large bowl. Pour melted butter over top and sprinkle with salt; mix until potatoes are thoroughly coated. Line the bottom and sides of the prepared casserole dish with potatoes, overlapping as needed.

• Bake in the preheated oven until potatoes are forktender, about 30 minutes.

• While the potatoes are baking, heat a large skillet over medium-high heat. Cook and stir ground beef in the hot skillet until browned and crumbly, 5 to 7 minutes. Drain and discard grease.

• Transfer beef to a large bowl

and add condensed soup, 3/4 cup Cheddar cheese, and milk. Season with salt and pepper and mix until well combined.

• Remove potatoes from the oven. Pour beef mixture over top and return to the oven. Bake until heated through, about 15 minutes. Sprinkle remaining Cheddar over top and bake until melted, 4 to 5 more minutes.
