In traditional Chinese culture, plum blossoms’ four stages of growth represent four noble virtues: Budding represents vitality, blooming represents prosperity, bearing fruit represents harmony, and maturity represents steadfastness. As the bird-and-flower genre of painting (hua niao hua) burgeoned in China during the 10th century, plum blossoms became known as one of the Four Gentlemen of Flowers and along with the orchid, bamboo, and chrysanthemum, as the Four Plants of Virtue. The Three Friends of Winter, plum, pine, and bamboo, are popular in Chinese works of art because these three plants do not wither even in the worst of winters. Plums burst into a riot of blossoms in winter, representing an indomitable determination that the Chinese have long valued.

SENDING REGARDS WITH A BRANCH OF PLUM BLOSSOMS Prior to the Northern and Southern dynasties (circa A.D. 420–589), Chinese people would plant plum trees to harvest plums and make plum-blossom vinegar. Plums appeared frequently in the Classic of Poetry (Shijing). For instance, one poem reads, “Cuckoo birds sing in the mulberry forest, their fledglings play among the ripe plums.” From the Han Dynasty to the Northern and Southern dynasties, plum blossoms grew to be a popular topic for poetry and prose. Lu Kai, a poet from the Southern Dynasty wrote: “I gave a branch of plum blossoms to the messenger, may he bring it to my friend at the mountain base. / There are few valuable things in Jiangnan, therefore I could only send you a sprig of spring.” A branch of plum blossoms for friends living far away could convey one’s deep regards and blessings. The gift reminds one to aspire toward plum blossoms’ virtues, and also signals the forthcoming spring. The number of poems about plum blossoms skyrocketed during the Song Dynasty, as the natural character of the flower related to those uncertain times. People of the Song Dynasty saw their own virtues in the resilience of plum blossoms. Despite political corruption and the Mongol invasion, the Song people defended their homeland faithfully and courageously. Lu You, a patriotic poet from the Southern Song Dynasty wrote in “Ode to the Falling Plum Blossoms”: “Staying firm against the battering winds and heavy snow, plum blossoms hold the greatest virtues.” 28│

PLUM BLOSSOMS, CONFIDANTS FOR LIFE Literati who adore plum blossoms often share common virtues: high moral standards, resilience, perseverance, and a firm belief in ideals. Lin Bu, a reclusive poet from the Northern Song Dynasty, is one such person. Rather than seeking fortune and fame through a government position, Lin resided alone in the mountains near West Lake. He took plum blossoms as his companions and raised cranes as his children. In the poem “Little Plum Blossoms in a Mountain Garden,” he gave a brief description of plum blossoms at dusk: “Their scattered shadows fall lightly on clear water. / Their subtle scent pervades the moonlit dusk.” Lin did not describe the flowers directly, yet the poem was recognized by later generations as one of the greatest poems about plum blossoms in Chinese history. Su Shi, one of the greatest poets a nd essay ist s f rom t he Nor t her n Song Dynasty, was exiled three times during intense factional disputes. He compared his unappreciated talents and solitude in exile to the loftiness

of plum blossoms. In his poem “Red Plum Blossoms,” Su wrote that the blossoms sleep soundly, afraid of drowning in sorrow. They bloom only when everything else has withered, lest they become the subject of others’ envy. They burst into light pink petals to accord with peach blossoms, yet their branches are slim and solitary. They are meant to endure harsh winters, and are thus reluctant to present their beauty in spring. Their light pink petals are simply a lady’s blush. Should one be unaware of plum blossoms’ virtues, how could one tell peach and plum blossoms apart? Su asked. Although plum blossoms seem similar to peach blossoms, plum blossoms symbolize the unchanging virtues of purity and loftiness. Likewise, Su Shi, facing adversity, refused to blindly follow the crowd and held fast to his moral code. Lu You, a famous and patriotic poet from the Southern Song Dynasty, spent his childhood in exile after the Jin’s invasion. At the age of 29, he obtained the highest marks during the Chinese imperial examinations. However, Lu’s triumph threatened Qin Sun, the grandson of Qin Hui, a notorious yet powerful aristocratic traitor in the Song Dynasty, and Lu was excluded from selection. Lu embarked upon his public career only after Qin Hui’s death, but he was 30│

still demoted several times. Even after he retired to live in seclusion, he still held hope of a reunification of China under the Song Dynasty. He expressed his sorrows and ideals in “Ode to Plum Blossoms”: Beside a broken bridge by a post station a fragrance untended and solitary grieving in dusk laden with loneliness and whipped by wind and rain. Not for it the bitter strife or springtime glories Envy of the myriad flora concerns it not Fallen, mingled with dust crushed into mud the fragrance yet lingers on. Although plum blossoms eventually perish, their fragrance lingers. Gong Zizhen, a poet and philosopher from the Qing Dynasty, wrote, “The fallen red petals are not without feelings, for they turn into mud to fertilize the flowers in spring.” THE SPIRIT OF PLUM BLOSSOMS Only a man of virtue can truly appreciate the noble character of plum blossoms. Mencius depicted the ideals of a noble man in this way: “Neither riches nor honors can corrupt him; neither poverty nor humbleness can make him swerve from principle; and neither threats nor powers can subdue him.” Wen Tianxiang, a politician and poet in the last years of the Southern Song Dynasty, went on a hunger strike at Plum Blossoms Peak in the Dayu mountain range after the Song surrendered to the Yuan. In his poem “Song of Righteousness,” he wrote, “All men are mortal, but my loyalty will illuminate the annals of history forever.” In it, he spoke of the values of righteousness presented by plum blossoms. Shi Kefa, a patriotic government official in the late Ming Dynasty, refused to surrender even after the Qing army bombarded his city. He was buried at Plum Blossom Ridge in Yangzhou Province, and his integrity is commemorated by literati to this day. One such poem reads, “A teardrop on the petals of plum blossoms, the moon is waning, yet my loyalty as a civil servant remains unchanged.”

Jiang Shiquan, a poet in the Qing Dynasty, wrote about Shi’s martyrdom: “His loyal sacrifice shows his singleness of heart; man after man has come to salute him, and even the land is left with plum blossoms’ enduring fragrance.” White plum blossoms are considered as lofty and pure as jade. Wang Anshi of the Song Dynasty wrote: “Even from afar they cannot be mistaken for snow, for a delicate fragrance comes wafting with the breeze.” Xin Qiji of the Southern Song Dynasty wrote: “Plum blossoms care not about their appearance; what is left is the snow-white spirit of purity within.” Plum Blossoms were adopted as the national flower of the Republic of China. The song “Plum Blossom,” written by Chia Chang (Steven) Liu and popularized by the late Taiwanese singer Teresa Teng, told of resilience in the face of adversity: The plum blossoms bloom all over the homeland. The harsher the winter, the more the flowers blossom. Its resilience represents the steadfastness of China. The plum blossoms bloom everywhere. Wherever there is land, there is the flower. It fears not snow, storm, or wind. The plum blossom is our national flower. The five petals of the plum blossom have had multifold meanings in Chinese history. Firstly, they represent Five Races Under One Union, a major principle held by the Republic of China. The tenet calls for harmony among the five major ethnic groups in China: the Han, the Manchus, the Mongols, the Hui, and the Tibetans. Secondly, the five petals correspond to the five interpersonal relationships in Confucian thinking: parent and child, minister and ruler, husband and wife, older and younger brother, as well as friend and friend. Thirdly, the petals echo the five basic ideal ethics: humaneness (ren), righteousness (yi), propriety (li), wisdom (zhi), and sincerity (xin). Last but not least, in folklore, each petal stands for a blessing: peace, happiness, success, longevity, and luck. Chao Buzhi, a poet from the Northern Song Dynasty, wrote: “Blooming and withering like snow, the white plum blossoms are nature’s chef d’œuvre. / Neither does its fragrance come from the stamen, nor the sepal—it is intrinsically aromatic.” Plum blossoms embody the sincere wishes of the Chinese people, and their perseverance will be carried on forever. │31

ost of us know some sort of bare-bones history about the origins of Thanksgiving, that three-day feast in 1621 at the Pilgrim colony in Plymouth, Massachusetts. It included some of the colony’s Native American allies from the Wampanoag tribe and their chief, Massasoit. Having been taught how to plant corn as well as other survival skills by English-speaking Squanto (a member of the confederation of Wampanoag tribes),

the Pilgrims wanted to celebrate both their survival and their successful harvest. But what about the 19th-century writer and editor Sarah Josepha Hale? Ever hear of her in relation to Thanksgiving? Me neither. A WOMAN OF ACCOMPLISHMENT AND A DEFENDER OF TRADITION In her own day, Sarah Hale (1788–1879) was quite the celebrity. For one, Hale was a New England poet whose most famous work—“Mary Had a Little Lamb”—is still known and recited by American youngsters. She turned to writing and poetry as a means of income to support herself and her five children after her husband died in the ninth year of their marriage. Hale’s literary accomplishments led to her appointment as the editor of Godey’s Lady’s Book, a women’s periodical that she made into the most popular magazine in the country. In addition to her editing skills and business acumen, for 40 years, Hale wrote columns as well. She was a staunch abolitionist but extolled the traditional roles of women as wives and mothers, and opposed women’s vote. Though criticized as being too traditional in her views, Hale’s position as editor and her writing made her, according to an online encyclopedia, “perhaps the most widely known and most influential woman of her time.” Hale also championed restoring or building various historical sites. Through her advocacy and her fundraising, for example, she helped preserve George Washington’s home, Mount Vernon, and worked tirelessly soliciting money for the building of the monument that now stands at Bunker Hill. But one more jewel belongs in the diadem of this remarkable woman.

THE MOTHER OF THANKSGIVING For years, Sarah Hale, through articles and scores of letters, pushed politicians to make Thanksgiving a national holiday. Though New Englanders had long celebrated the occasion—the dates varied from state to state—Thanksgiving did not resonate with the rest of the country. In 1789, George Washington declared a day of national thanksgiving to honor the victory of the American Revolution and the passage of the Constitution, and John Adams and James Madison did likewise during their presidencies. But otherwise, American leaders showed little interest in this celebration until 1863. It was in that year—when the country was engaged in a brutal civil war—that Hale, who for 36 years had pushed for a national day of giving thanks, wrote to President Lincoln about this idea and was finally rewarded with success. In his proclamation to the nation, Lincoln declared the last Thursday of November as “A National Day of Thanksgiving and Praise” on which Americans were to ask God to “commend to his tender care all those who have become widows, orphans, mourners or sufferers in the lamentable civil strife” and to “heal the wounds of the nation.” As a result, Sarah Hale earned the nickname the “Mother of Thanksgiving.”

GRATITUDE Sometimes the trials of this long and sometimes dark year we have endured—COVID-19 with its attendant masks, social distancing, and closures, the riots and fires in many of our major cities, a bitter election that has only deepened the already ugly divide among the American people—make gratitude seem in as short supply as some commodities in our grocery stores during the worst of the pandemic. These days, being grateful often requires a summoning of the will, if we even remember to appreciate the good people and things in our lives. Moreover, Thanksgiving Day gratitude usually involves expressing our appreciation to some form of a higher power, even for nonbelievers. We can offer a “thank you” to a person, but the atheist who spuriously says “I’m grateful for my children” or “I’m grateful for America” is inexact in his language. Exactly who or what does he intend as the recipient of that gratitude? But to whatever god we may pray, or whatever our circumstances, we can find in the practice of gratitude not only a remembrance of the blessings in our lives, but also a source of consolation, hope, and strength. Whether for large gifts like the birth of a child or a successfully treated cancer, or the small everyday pleasures of a cup of coffee and a biscotti, expressing our appreciation, even just to ourselves, frequently lifts our spirits and keeps us moving forward. To have set an entire day aside just to express this thanks makes Thanksgiving one of the best of holidays. Perhaps, as in that dark time of the Civil War, Lincoln’s hopes for that first official Thanksgiving should be our hope as well for a country that is almost as terribly and bitterly divided as America was then. If we are to coexist as a people, we mustn’t depend on politicians to reunite us. Instead, individuals must bridge that chasm: America’s sons and

LET’S MAKE THIS THANKSGIVING SPECIAL On this feast day, let’s take a few moments to appreciate the blessings bestowed on us. We flip a switch, and a room lights up. We turn on a tap, and hot water cascades from the spigot. We pull a small device from our pocket and check out the latest news, laugh at a joke Aunt Rosemary sent us, and send a message via social media to our cousin in France. We drive to Grandma’s house for our meal in 30 minutes, a journey that would have taken half a day or more just a century earlier. In addition, we still possess the rights and liberties that are as natural to most Americans as breathing. Some of those liberties are under attack, but when in our history was this not the case? Like our ancestors, we must defend and fight for those rights; otherwise they will vanish. But on Thanksgiving, we can pause to appreciate and treasure them. Finally, we can use Thanksgiving Day as a teaching moment for our children. Professor and author Peter W. Wood wrote 1620: A Critical Response to the 1619 Project, a rebuttal of the radical revisionist history of our past that was published by The New York Times. Near the end, Wood wrote, “A citizen should grow up knowing we are a free people under the rule of law. A citizen should know that it is not some happy accident but the result of an immense effort over many generations. It was the work of courageous men and women who pursued principle even when the situation seemed hopeless.” Let’s bear those thoughts in mind in the next few weeks and hope we possess the same valor and virtues of our predecessors. Happy Thanksgiving to all!

hen Yun Performing Arts tenor Gao Liang has had a rich and successful vocal career. He smiles humbly and says: “Everyone is good at something different. I found that I was really best at music. After realizing this, I was really blessed, really blessed.” Gao has won awards in prestigious international vocal competitions in Russia and has performed in operas on time-honored European stages. He has used his voice to lead audiences to appreciate the magnificence of different eras, singing of both joy and melancholy. After each successful performance, he would hear praise for a few days. But afterward, he knew that this type of success was not truly his calling. In 2019, he chose to leave behind everything he was familiar with to come to the United States, and take on new challenges. A TAPE RECORDER RESTARTS HIS MUSICAL JOURNEY Gao was born in northeastern China. When he was 4 or 5 years old, his mother brought him a piano the size of a small box. Gao was quickly able to play

melodies from television theme songs by ear. He had a gift for music from such a young age, and like his mother, he had a talent for singing. But people who heard Gao sing would often have a look of pity on their faces afterward. “In class when I was reading aloud, everyone would laugh. I didn’t know why,” Gao recalled. As a young man, Gao unwittingly pronounced many words incorrectly. Though people had difficulty understanding him, he could not perceive any difference between how he and others spoke. But one day he recorded himself with a tape recorder, and he was totally shocked. Hearing his own voice for the first time, he finally understood what everyone was trying to tell him. The voice from the recorder was totally different from the voice he had been expecting to hear. He became determined to correct his pronunciation issues. He started to copy the subtle changes in people’s lips and mouths when they spoke, in particular his younger brother. Gao would practice while he was playing with his brother or walking. His persistence paid off, and Gao gradually corrected the pronunciation problems that had hampered him for 10 years. People couldn't believe that he had corrected his speech issues himself. From then on, Gao could sing as much as he liked.

IMMERSING HIMSELF IN THE WORLD OF BEL CANTO To continue on the road of music, he sought out masters and underwent professional vocal music training. His efforts paid off, and he was accepted to a top vocal academy—the Shanghai Conservatory of Music. He didn't have much interest in bel canto at first, but after trying it, he couldn't help but stick with it. He was impressed that singers could produce such loud and clear sound, and their singing could pass through the accompaniment of the band and permeate a huge space, far beyond the reach of ordinary singing. After learning traditional bel canto technique and studying classical European culture, he understood the meaning of the lyrics and their artistic beauty. When he performed pieces that express the sincere emotions of heartfelt relationships, he became fascinated by classical music and felt he would never tire of it. However, vocalists must undergo arduous professional training, enduring the loneliness of it all while

Gao described the process: "A person sits in a small piano room just to seek a sound, seek a state, tempering oneself over and over again.” In addition, the biggest difference between learning vocal music and other types of music is that the performer cannot see the “instrument” he is playing—his vocal cords. The only way to learn vocal music is to rely on powerful ideas, and to try repeatedly to realize a correct state of vocalization, Gao said. He needed to focus and put his heart into studying. Enduring this kind of solitude, with his extraordinary talents, he climbed to new heights.

ENDLESS LEARNING, SURPASSING THE PEAK After graduating from the Shanghai Conservatory of Music, Gao studied in Russia at the Gnesin Russian Academy of Music. He participated in seven international vocal competitions during this time and won five awards. While participating in Russia's Third International B. T. Shtokolov Vocal Competition in St. Petersburg, Gao competed alongside top European singers and advanced all the way to the third round of the finals. For a vocalist, it's a huge achievement to perform on this world-renowned stage. Gao was the only tenor to enter the third round of finals and won the excellence award. Thinking back to this experience, he's extremely grateful: "These experiences are very unforgettable. It was a stage of maturing, a stage of affirmation that strengthened my confidence and allowed me to continue to improve." In 2019, Gao realized his wish to follow a more meaningful artistic path. He passed a tryout for joining New York-based Shen Yun Performing Arts, which features a singing style that is entirely different from the European operas he had performed in the past. Shen Yun Performing Arts aims to revive traditional Chinese culture through music and classical Chinese dance. Before joining Shen Yun, Gao was a highly qualified opera singer. But after performing the same opera many times, he felt exhausted. He observed that Shen Yun's artists regard each performance as their first show. Their attitude is pure, and they think only of the audience. This impressed him. He also felt that the training for Shen Yun was the most rigorous singing

training he had ever experienced. "No one has ever asked us to be so technically perfect," he said. Shen Yun artists put immense effort into every detail of their training. Gao said the training at Shen Yun is more rigorous than anywhere else in the world at the moment, even more rigorous than training he read about throughout history. Gao saw his road of artistic attainment stretch out almost endlessly. Joining Shen Yun has allowed him to keep improving himself while remaining humble. AN ARTIST'S WISH As a child, simply answering a question in class would cause Gao’s heart to beat faster. "I was a nervous person," Gao said. How could someone with his temperament stand on a stage and perform calmly before thousands of spectators? Gao said that he had to rely entirely on self-regulation. He realized that adjusting himself like this was a process of self-cultivation. He started to feel calmer standing on a stage before large crowds. His understanding is that cultivating oneself can calm one’s heart, and only by singing with a calm heart can the meaning behind the lyrics be conveyed to the audience. His sense of mission as an artist has allowed him to continually improve. "Artists have always been influencing the civilization of mankind," he said. Gao believes that being an artist carries a sacred mission. He explained that true artistic creation requires inspiration, and inspiration often surpasses the mundane; it's a display of wisdom. He believes artists have a duty to remind people that they came from the heavens and that their yearning for purity and beauty comes from a profound source. Shen Yun has given Gao the artistic values that he had sought all of his life. Performing on stage with Shen Yun is for him the apex of a lifetime of hard work. The lyrics he sings resonate magnificently and clearly and touch audiences' hearts. After his final note is complete, thunderous applause sounds. The crowd's gratitude is an affirmation for him and reinforces his sense of mission as an artist.

Gao enjoys singing outdoors in the fresh air. He studied vocal music at the Shanghai Conservatory of Music, one of China’s top music schools, and at the renowned Gnesin Russian Academy of Music in Moscow.

he pandemic is still hav ing an impact worldwide. Whether we’ve had the jab or not, we still need to rely on our immune system to keep us well. Our goal is not a stronger immune system, but a balanced one. Let’s take a look at some ways to help tackle viral infections. TACTIC 1: HYDRATION Stay well-hydrated and drink a traditional herbal tea to guard against viral infections. Viruses tend to keep a distance from well-hydrated people because drinking water can boost metabolism. How can you check if you are drinking enough water? Constant thirst, less urine, and changes to the color of your urine are all signals of dehydration. Try keeping about 2 quarts of water with you and sip it throughout the day to increase your daily water intake. Drinking more water can also aid weight loss and give you healthier skin. You can also try out a tea recipe inspired by “Yu Ping Feng San,” an ancient Chinese herbal decoction for treating certain health issues. The tea is comprised of 18.75 grams of Radix astragali (Huangqi), 11.25 grams of Atractylodis macrocephalae rhizoma (Baishu), and 11.25 grams of Saposhnikoviae radix (Fangfeng). Add the ingredients to 5 cups of boiling water and simmer for 10 minutes. When about 1 1/2 cups of water are left in the pot, you have two portions of the herbal tea drink. Drinking this tea regularly is like putting on an invisible cloak that protects you against viruses. However, if you have cold symptoms (common symptoms include a sore throat, a runny nose, and coughing), you are advised not to drink this tea.

A tale from “Bowuzhi,” a text written by scholar Zhang Hua during the Western Jin Dynasty, tells of an epidemic during the Western Han Dynasty that struck the capital city, Chang’an. An envoy from a small country on the northern edge of the Kunlun Mountains presented three types of aromatic herbs to the emperor. Soon after, a plague surged in Chang’an, and many people in the palace were infected. The envoy begged to have an audience with Emperor Wu and suggested that the emperor burn the herbs to ward off the plague. Over the next three months, the herbs were burned throughout the city, and the infected soon recovered. That is to say, the aroma of certain herbs can help cure infectious diseases. 46│

The emotion that overwhelms you can affect a corresponding organ. Massaging your fingers on a regular basis can maintain harmony in your organs and keep you healthy. Here’s how: Use your index finger and middle finger on one hand to rub the two sides of each knuckle on your other hand for 10 seconds. Massage each knuckle like this once or twice per day. Being compassionate may also help your health. If you are constantly arguing or quarreling with

others, your rage can weaken your immune system and adversely affect your health. The “Yellow Emperor’s Classic of Internal Medicine” (“Huangdi Neijing”) states that maintaining righteous qi inside your body can expel pathogenic factors. Righteous qi boosts both physical immunity and mindfulness. So think more about the people and things that bring you positivity. For someone suffering from the symptoms of COVID-19, “proning” could help. The term refers to lying face-down, on the abdomen, rather than on the back. This position allows better expansion of the rear lung regions and enhances the removal of phlegm while facilitating breathing.

ulled wine, with its aromatic mixture of red wine, spices, and just a hint of sugar, is a festive season staple that carries cozy winter memories across the generations. You can try this traditional beverage recipe with red wine, white wine, whisky, brandy, apple cider, or rum as a base. Simply simmer with spices and sweetener, and you will have made your own winter warmer to get you into the Christmas spirit. The custom of heating wine is thought to have originated in ancient Greece during the second century. After a feast, ancient Greeks would heat any leftover wine along with coarse wine and add spices to enhance the aroma. As the Romans expanded across Europe, the popularity of mulled wine spread through the empire.

When the Black Death struck Europe during the Middle Ages, brewing red wine became a common practice because people wanted to ensure their drink was hygienic. They would mix their heated wine with spices and herbs, believing the ingredients would promote health and repel the rampant disease. In Victorian Britain, Charles Dickens wrote about a mulled wine recipe called Smoking Bishop in his novel A Christmas Carol. With the appropriate marketing and promotion, mulled wine has since become the drink of Christmas. Different cultures have developed different customs and recipes for mulled wine. For instance, in some parts of Britain, apple cider is used as the base. In Sweden, mulled wine is called glögg, a name derived from the Old Swedish word glödga, which means to heat up. Aside from the standard spices, Swedes like to add raisins, ginger, and almonds and use whisky or vodka as the base. The glögg is like a warm and radiating fireplace that brings inner comfort during the winter. This Christmas, why not try your own version of mulled wine with your loved ones?

INGREDIENTS ・1 bottle of red wine ・5 tablespoons sugar ・10 cloves ・5 slices ginger, peeled ・5 apple slices ・2 cinnamon sticks ・1 orange ・1 bay leaf ・1 star anise ・a small amount of grated nutmeg DIRECTIONS Carefully peel the zest from an orange in strips, and then juice the orange into a large pot. Pour the red wine and the rest of the ingredients into the pot and simmer (do not boil) for 10 to 20 minutes. Drain the wine into glasses or mugs, and then garnish with either a few slices of apple or orange zest and a stick of cinnamon.

The pandemic might have forever changed the way documents and transactions are handled between buyers and sellers. Although the world is waking up from lockdown, recent changes in the real estate market may become the new normal. We’ve invited Sylvia P. Tsai Esq., a practicing lawyer based in New York, to fill us in on what we need to know.

VIRTUAL DOCUMENTATION PUSHES UP COSTS According to Ms. Tsai, the global coronavirus outbreak has moved the process of buying or selling a house into the virtual world. Online house tours and the signing of sales and purchase agreements are a welcome change to most, but when it comes time to pass around legal documents, transfer of ownership has made the transaction more expensive. There are three key elements in the transfer of ownership. The first is to sign an impressive number of documents. During face-to-face meetings, missing signatures can be found and corrected in real time. However, in a virtual setting, lawyers have to remind the clients via email. The back and forth increases billable hours, driving up costs. Second, wire transfer is replacing cashiers' checks amid the pandemic. Luck ily, this shif t ha sn’t brought any serious problems. Last but not least, is the exchange of documents. Previously, all parties, including the buyer, the seller, the title company, and the banking lawyer, were given their respective paperwork immediately after signing. Now, the buyer and seller need to send their documents to a banking lawyer or title company. After collecting all the documents, signatures, and payments, the completed paperwork is finally mailed to the client. This prolonged process is causing the overall cost of real estate transactions to escalate.

到,線上看房、遠程簽訂買賣合約,還不至於衍生太多 問題。但過戶此一程序,卻讓交易成本上升。 過戶的重點有三:一是文件簽署,有大量文件要雙 方簽字。面對面簽字時,有漏簽時可以及時糾正,遠程 時若遇漏簽問題,就必須再次以電郵通知對方,糾正後 還要再次來回確認,溝通成本上升;二是金錢的交易, 過去多採用銀行本票交付款項,但疫情下多改為電匯轉 帳(wire transfer)的方式,該程序並未帶來太多問題。 關鍵 在於第三步驟:交換文件。往常,雙方親自面 見過戶時,在簽完所有相關文件後,文件會當場交付予 相應人的手上,比如買家、賣家、產權公司、銀行律師等, 都能在場拿到各自應持有的文件。而遠程操作時就變得 複雜,通常需要由各方簽過字後,統一將文件發到中立 方,如產權公司或銀行律師等。待中立方收妥所有文件、 無漏的簽字以及各款項後,再統一分配,期間若加上文 件郵寄問題,過戶時間勢必會拉長,所以整體交易成本 也相應提升。 遠程公證的可行性 地 產 買 賣 過 戶 文 件 中, 有 許 多 需 要 公 證 方(Notary Public)簽字。「 紐約州來說,以前是沒有遠距公證, 沒有線上公證(Remote Online Notarization),一定 要實體,在公證人面前簽字,才會幫你公證。」蔡律師表 示,疫情期間,透過州長頒布行政命令,破例讓民眾在 此特殊時期以此變通方式交易,然而,該行政令已於今 年6月24日過期。 不過,紐約立法部門正在討論是否把遠程公證變 成永久法令,但法令尚未通過主要是擔憂該做法便於造 假,因為視頻公正和親眼作證有著本質上的差異。蔡律

Tsai says that in pre-pandemic New York, signers had to personally appear before the notary. In March 2020, a statewide executive order temporarily waived the in-person requirement and authorized remote notarization. However, the order expired on June 24, 2021. New York legislators have been discussing whether a permanent remote notary authorization should be added to the state’s omnibus budget bill. The decision is still in limbo because of lawmakers’ concerns over the difference between physical presence and video conferencing. Tsai noted that the order

Even so, unless one tracks down the notary’s IP address, it is difficult to tell the exact location of the notary at the time of the remote notarization. So far, California, New York, and Washington, D.C, are the few areas that have not enacted permanent remote notarization. Several state governments are re-examining the feasibility of various forms of notarization. Tsai emphasized that different title insurance services may hold different views toward remote notarization. Thus, not all remote notarizations can be accepted. Please be reminded that the form of notarization depends on the service provider.

VIRTUAL BOARD INTERVIEWS FOR CONDOS AND CO-OPS Real estate laws are especially complex in New York City where a lot of condominiums and co-ops change hands. Property lawyers who represent condos need to conduct heavy research to win a board’s approval for a sale. Generally speaking, a board reviews buyers' applications, and an applicant needs to pass the board's interview to purchase a condo. Before the pandemic, board members would meet in person to discuss sales and examine applicants’ eligibility. But now, meetings have moved online, as have the board interviews and the signing process. Now that boards
