Jingle Bell Hike Although COVID-19 continues to cramp our travel plans to some degree, there are still countless ways to put sparkle (and convalescence) into your end-of-year holiday. With the pandemic still top of mind, and pandemic fatigue a real thing, most Capetonians are looking forward to a 2021 finale that’s decidedly low-key.

Despite being on Lockdown Level 1 with relative freedom, public spaces don’t bode well for one’s serenity – especially over a busy season like Christmas – plus, although very welcome in the Mother City, we do have the influx of upcountry travellers looking for their own hallowed escape from the grind.

For many, that means festive prepping for a well deserved staycation. And why not? Living in one of the most beautiful destinations in the world continues to have its perks. Who needs the bother of quarantining or jet lag to convince you you’ve made the most of your break?

Hiking remains a beloved Capetonian go-to to really get away from it all. A 3-hour thigh-burning hike offering exquisite, tear-inducing vistas can truly make you feel like you’ve been ensconced at a resort for days.

So what to do to recharge without breaking the bank, being mobbed by beach-hungry crowds, or travelling too far from home?

With undulating mountain chains, hectares of luscious forest, and vast nature reserves right on its doorstep, our city has a thriving outdoor culture with hiking rated as one of the premier activities. There are the usual suspects within metropolitan Cape Town – Table Mountain, Steenberg, Chapman’s Peak, and all the Southern Peninsula stunners – but slightly further afield

we also have a curation of impressive trails only a stone’s throw from the city. If you’re up for a bit of a road trip, three periphery towns offer the perfect mountainous getaway. You’ll get to Paarl within 45 minutes, Stellenbosch within 40 minutes, and Fransschoek within an hour. With a nuance of European flair, each district offers its own unique flavour. You may as well be trekking Europe itself, Sound-ofMusic-style, if you let your imagination run that wild. PAARL Huguenot Peak via Miaspoort Trail in the Haweqwa Nature Reserve. With Du Toits Peak soaring at 1,995m, which, incidentally, is the highest seaward facing peak in the Western Cape within direct sight of the ocean, this hiking locale is a winner in terms of views. Named after Francois Du Toit, a French Waldesian, who with the Huguenots fleeing religious persecution arrived as a refugee in the Western Cape, Miaspoort Trail will make you sweat, then reward you handsomely for your efforts. With many of us fleeing our own 9-to-5 workweek persecution this December, let this gorgeous mountaintop be your refuge for as long as you need. Buried within the depths of the Bainskloof Pass, you’ll find secret waterfalls boasting unbeatable sunset views. Straddling the Bobbejaans River (a tributary of the Witte River) in Bainskloof, a Narnian trail takes you straight to the waterfalls and numerous river swimming spots. The Limietberg Trail is very popular in summer when the disa and giant proteas are in bloom. FRANSCHHOEK Rated moderate, Uitkyk Trail in Mont Rochelle Nature Reserve is a 6.8 kilometer out-and-back trail featuring breathtaking wild flowers, and is primarily used for hiking, walking, running, and bird watching. Part of the Cape Winelands Biosphere Reserve, characterized

by a mosaic of diverse ecosystems and physiographic environments, every twist and turn of your trail reveals new jaw-dropping vistas. This region is renowned for its mixed range of land uses and human settlement patterns associated with the Cape Winelands viticultural landscape. STELLIES For the very adventurous, and energetic, why not throw your bike into the mix and head for Coetzenburg Mountain Biking Trails just outside Stellenbosch. Offering a variety of gravel roads, ride-able walking trails, horse riding paths, purpose built singletracks and its world class XCO track, you can Evel Knievell to your heart’s content. Here adventure and adrenaline collide to promise an outdoors adventure you may just get addicted to. Hiking might officially be the new therapy. Few activities offer such a heady and holistic mix of mental soothing, emotional recharge, spiritual healing, and physical exertion. Best of all, sharing the experience with friends and family guarantees a meaningful time creating unforgettable memories, connecting with nature, and a sobering reminder that as with every climb in life, we eventually always do get to the top. SOMETHING MAIN /

Slow Roasted Lamb Roast INGREDIENTS 2.5kg lamb roast 2 Tablespoons olive oil 1 Tablespoon paprika 1 Tablespoon oreganum 1 Tablespoon mixed herbs 2 Tablespoons freshly chopped rosemary 1 Tablespoon braai spice 1 Tablespoon coarse salt Freshly ground black pepper 1 cup water METHOD Rub the olive oil onto the lamb roast Mix all the spices together in a small bowl, then rub into the meat Place the lamb into a large Ziploc bag and refrigerate for a few hours or overnight Preheat oven to 180° Remove the lamb from the bag and place in a roasting pan Add the water, then cover tightly with foil Reduce oven temperature to 140° and roast for 2 hours Reduce the oven to 110° and roast for a further 4 hours Remove the foil and increase oven temperature to 180°, to crisp the skin about 20 - 30 minutes Check the lamb at regular intervals to ensure the liquid hasn’t dried up and lamb is dry Remove from the oven, loosely cover with foil and leave to rest for a few minutes TO SERVE Using two forks, tear the lamb off the bones and place in a serving platter. Sprinkle torn mint leaves over the lamb

Apple Latkes INGREDIENTS 4 Granny Smith apples 2-3 tablespoons sugar 2 eggs, separated 2 tablespoons oil pinch of salt 1 cup flour 200ml water extra oil for frying latkes sifted icing sugar for dusting METHOD Core and peel the apples and cut each into 4 thick slices For the batter, beat the yolks with the oil and salt, then stir in the flour and mix well Gradually add the water, beating vigorously until smooth – leave for 1 hour Beat egg whites with a pinch of salt until stiff – gently fold into batter Heat some oil in a frying pan. Dip the apple slices into the batter and lower into hot oil Fry in batches until lightly brown – be careful that batter does not go dark before apples are cooked Remove from oil and drain on kitchen towel before serving. Dust with icing sugar. Serve with cinnamon and sugar mixture

Linda’s Potato Latkes INGREDIENTS 6 potatoes, peeled and grated 1 onion, peeled and grated (optional) 2 eggs, beaten 3 Tablespoons flour 1 teaspoon baking powder Salt and white pepper METHOD Grate the potatoes and onion Squeeze the liquid out using a clean kitchen cloth Once liquid is removed, place all the ingredients in a large bowl and mix well Drop the batter into hot oil and brown on both sides Place latkes on greaseproof paper to soak up excess oil Sprinkle with a little salt before serving Makes approximately 25-30 latkes

Festival of Lights

As a community we do not celebrate Christmas. The Jewish Festival of Chanukah usually falls around the same period but otherwise unrelated. This year Chanukah was observed the first week of December. On Chanukah we traditionally eat fried foods like Latkes and Sufganiot (Doughnuts). A latke is a popular dish in Ashkenazi Jewish Cuisine and is typically made from potato’s although one can do variations with other fruit or vegetables. Chanukah is an eight-day celebration that commemorates the rededication of the Holy Temple after the Jewish people battled the Syrian-Greeks (Seleucids) to reclaim it in the second century BCE. It has both historical and spiritual meaning in the Jewish religion, and is celebrated by lighting candles each night in a menorah, spinning a dreidel and giving gifts. This year the Sabbath will be observed from sunset on Christmas Eve to sunset on Christmas Day. The Slow Roasted Lamb is a dish served often on festivals and the Sabbath.

The relationship between landlord and tenant and the process of eviction can be complex and burdensome, as we all know. Add to that the declaration by the President on 15 March 2020 of a national state of disaster, brought on by a global pandemic, and things have gotten even more challenging. However, whilst we have been under lockdown “a competent court may suspend or stay an order for eviction … until after the lapse or termination of the national state of disaster unless the court is of the opinion that it is not just or equitable to suspend or stay the order…” What this means is that a court has the discretion to grant an eviction order, but to suspend it until lockdown is uplifted in its entirety. i.e. Until the end of level 1! And as we all know, this could mean another 10 years for all we know.

OUR RECENT MATTER We dealt with a matter last year where the Magistrate court granted an eviction. The court however ordered that the eviction order be stayed until the end of alert level 1. As it could not be predetermined when this date would arise, and after nearly a year from the date on which the order was stayed, we approached the court a few weeks ago, for a variation of the eviction order on the following grounds: That the eviction order was ambiguous; and/or It could not be regarded as just and equitable to further stay or suspend the eviction order. This tenant has not paid rent since March 2021!

The intention of PIE is not to expropriate private property. The purpose thereof is instead to delay or suspend the exercise of the owner’s entitlement to the property until such a time that the court has made a determination as to whether an eviction would be just and equitable in the circumstances of the case. In our matter, we contended that allowing the Respondents to live in the property, which was owned by the Applicant, against their will and without paying rent, had the effect of expropriating the Applicant’s private property beyond what is constitutionally permissible and beyond what can be said to be just and equitable. The eviction order, as it stood, had the effect of imposing a positive obligation on the landowner to provide free housing to the illegal occupiers of the land. This was not, in our opinion, a display of balancing of what is just and equitable for both parties, and it was submitted to the court that further staying the order would amount to an unjustifiable limitation on the landowners rights in their property. The court agreed and the tenants are now ordered to leave at the end of January 2022.

AMBIGUITY OF THE EVICTION ORDER In interpreting any court order in the face of ambiguity, a sensible interpretation is preferred to one which undermines the purpose of the document or order. Although it was clear from the order that the court intended that the eviction order be stayed until the end of Lockdown Level 1, it was unclear from the wording of the court order, whether or not the tenants would be required to vacate the property as soon as lockdown level 1 was lifted, and on what date exactly the sheriff would be authorised to evict them.

CONSIDERATIONS OF JUSTICE AND EQUITY: While PIE (Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998) is aimed at protecting tenants’ unfair treatment at the hands of their landlords, it is not intended to unduly prejudice the owners of properties’ entitlement to the use and enjoyment of their property either. The courts are therefore tasked with having to strike a balance between the rights and interests of the landlord and the tenant.

The court in Port Elizabeth Municipality v Various Occupiers[1] confirmed that in matters brought under PIE, the court is obliged to balance the opposing interests of the landowner, who has a real right inherent in ownership, and the rights of people in need of accommodation. Thus, the term ‘just and equitable’ is a relevant aspect to consider in respect of all parties to eviction proceedings and not just in regard to the interests of those individuals illegally occupying the property.
